3. A maximum building height of 7.18 metres shall be permitted instead of a maximum 6.0 metres; and,

4. A maximum height of the underside of any fascia, eaves, overhead or lower ends of the roof joist, rafters or trusses shall be 3.85 metres instead of a maximum of 3.0 metres.

Flamborough Zoning By-law 90-145-Z

5. An accessory structure within the required exterior side yard to a distance of 4.0 metres from the north-west property line along Carlisle Road shall be permitted instead of no accessory structures within the required 7.5 metre exterior side yard; and,

6. A maximum building height of 7.18 metres shall be permitted instead of a maximum 4.6 metres.

The maximum gross floor area for an expansion of the existing single detached dwelling shall not be permitted to exceed 102% of the gross floor area of the existing single detached dwelling instead of the requirement that the maximum gross floor area for an expansion to an existing building or structure shall not exceed 10% of the gross floor area of the existing building or structure;

3. A maximum parking space size shall not be required instead of the maximum required parking space size of 3.0m wide x 6.0m long; and,

4. A maximum driveway width of 17.5m shall be permitted instead of the requirement that the width of a driveway may not exceed the width of an attached garage.

Further to Variance # 2 a maximum increased encroachment of up to 37% of the existing setback for the northerly side yard shall be permitted instead of the requirement that a maximum increased encroachment of up to 10% of the existing setbacks may be permitted for an existing building which is to be demolished in whole or in part and rebuilt;

4. A maximum parking space size shall not be required instead of the maximum required parking space size of 3.0m wide x 6.0m long; and,

5. A driveway width shall be permitted to exceed the width of the garage instead of the requirement that the width of a driveway may not exceed the width of an attached garage.

NOTE:

i. Based on the scope of work, this is considered a rebuild of the dwelling and not additions.

ii. If Variances # 2 and 3 are granted, a maximum encroachment of 8.11m (26.64’) shall be permitted into the existing 21.94m (72’) northerly side yard so that the dwelling may be as close as 13.83m (45.37’) to the northerly side lot line. APPLICATION FOR MINOR VARIANCE

APPLICATION NO. HM/A-17:85

IN THE MATTER OF The Planning Act, R.S.O., 1990, c.P. 13, as amended and of the Zoning By-Law No. 6593, of the City of Hamilton, Sections 18, 18A and 19.

AND IN THE MATTER OF the Premises known as Municipal number 799 Dunn Avenue in the City of Hamilton and in a "C" (Urban Protected Residential and etc.) district;

AND IN THE MATTER OF AN APPLICATION by the agent Elen Abunahla on behalf of the owners Nabil Husein & Deena Romman, for relief from the provisions of the Zoning By-Law No. 6593, under Section 45 of The Planning Act, R.S.O. 1990, c. P. 13, so as to permit the conversion of the existing single family dwelling into a two (2) family dwelling under Section 19 (Residential Conversions Requirements) of Zoning By-law, notwithstanding,

1. A minimum floor area of 50 square metres shall be permitted for a dwelling unit instead of the minimum required floor area of 65 square metres for a dwelling unit;

2. A minimum lot area of 185 square metres shall be provided instead of the minimum required lot area of 270 square metres;

3. The parking area located in the front yard shall occupy 100% of the gross area of the front yard instead of a maximum of 50% of the gross area of the front yard permitted to be occupied by a parking area;

4. No landscaped area shall be provided within the front yard instead of providing a minimum of 50% of the gross area of the front yard as a landscaped area;

5. No on-site manoeuvring space shall be provided instead of providing a manoeuvring space with a width of 6.0 metres required to be provided abutting upon and accessory to each required parking space;

6. A parking space length of 5.0 metres shall be provided for the parking space located within the front yard instead of the minimum required parking space length of 6.0 metres; and,

7. A portion of the required parking space located in the front yard and the manoeuvring space for both of the required parking spaces shall be provided on the road allowance instead of providing all required parking and manoeuvring space only on the same lot on which the principal building is located.

NOTES:

1. A Residential Boulevard Parking Agreement with the Hamilton Municipal Parking Authority may be required for the portion of the parking space shown to encroach onto the Dunn Avenue road allowance.

AND IN THE MATTER OF the Premises known as Municipal number 150 Sanford Ave. N., in the City of Hamilton and in an "E/S-174" (Multiple Dwellings, Lodges, Clubs, etc.) (Amending By-law 70-285) district;

AND IN THE MATTER OF AN APPLICATION by the agent PMG Planning Consultantson behalf o f the owner 150 Sanford North Residences Corp., for relief from the provisionsof the Zoning By-Law No. 6593, under Section 45 of The Planning Act, R.S.O. 1990, c. P.13, so as to permit a multiple dwelling containing a maximum of 131 dwelling units to beincreased to contain a maximum of 149 dwelling notwithstanding that;

1. No more than 131 dwelling units shall be permitted;

2. A minimum of 1 parking space per dwelling unit, except 0.3 parking spaces for each dwelling unit that is 50 m2 in GFA or less shall be provided underground, whereas the By-Law as amended requires a minimum of 1.25 parking spaces per dwelling unit comprising a maximum of 29 parking spaces on or above the surface o f the lands (12 to the north o f the building and 17 sleeve spaces) and the remainder below the surface;

3. A minimum of 17 parking spaces shall be provided for the visitors comprising o f 10 parking spaces to be provided above ground to the north o f the existing building and seven (7) parking spaces to be provided in the underground garage instead of the minimum required thirty eight (38) visitor parking spaces;

4. To provide seven (7) visitor parking spaces within the underground parking garage which will require an access card, whereas the By-Law states that each visitor parking space shall be maintained readily accessible to visitors and free and clear of all obstructions;

5. No loading space shall be provided on site instead of the minimum required 2 loading spaces in total, one having a minimum of 9.0 m in length x 3.7 m in width x 4.3 m in height and the remaining having a minimum of 18.0 m in length x 3.7 m in width x 4.3 m in height; and

6. Required parking ratio, total number of parking spaces, total number o f dwelling units, shall not be in compliance with Schedule “B” of amending By-Law 70-285.
