GENERAL CONDITIONS OF ALLOTMENT
(a) The following conditions should be read carefully along with the
“TERMS AND CONDITIONS FOR ALLOTMENT OF ONE BED
ROOM FLATS (without lift, G+2) UNDER 24 LIG HOUSING
SCHEME AT VALATHERU – KARAIKAL” attached herewith and
understood before filling up the application form requesting for
allotment of a flat. These conditions are binding on the applicants
for purchase of any flat in this scheme.
(b) Number of flats available, plinth area, tentative cost of each flat,
specifications, etc. are shown in the notice board of Puducherry
Housing Board, Anna Nagar, Nellithope, Puducherry – 5 &
Puducherry Housing Board Unit Office, Nehru Nagar,
Karaikal.
(c) Passport size photo of the applicant along with that of his/her
spouse shall be affixed on the application form.
(d) An Income Certificate shall be furnished as indicated below:
(i) When the applicant is an assessee to income tax, an assessment
order on the income for the year preceeding the year of
application.

(ii) When the applicant is not an assessee to income tax but a
Government Servant or an employee in any concern and is not
in receipt of any income for lands or other sources, a certificate
from his/her official superior about his annual income.
(iii) When the applicant is not an assess to income tax nor is a
Government Servant or an employee in any concern, but is in
receipt of income from lands, a certificate as regards his/her
annual income from lands from a Revenue Officer, not below the
rank of a Deputy Tahsildar of a Taluk/Sub-Taluk.
(iv) When the applicant is neither an employee of the Government
nor any concern and he/she is not in receipt of income from
lands, an affidavit as regards his/her annual income duly sworn
before a Judicial Magistrate/Notary Public.
(v) When the applicant is an employee as well as a recipient of
agriculture income, a certificate from the employer regarding
his/her annual salary paid by the employer as well as a
certificate from the Tahsildar or Deputy Tahsildar of the
Taluk/Sub-Taluk regarding his/her annual agriculture income.
(e) The applicant shall make the nomination in favour of any one of the
members of his/her family. In case of death of the allottee, the flat
shall be transferred in favour of his/her nominee. However, the

allottee is at liberty to change the nomination during his/her
lifetime.
(f) The specifications, plans, layouts and/or design of the flats are
subject to minor variations from the plans as may be made by the
Board during construction.
(g) The cost of the flats as fixed by the Board is binding on the
allottees.
(h) The applicants shall apply in the prescribed form duly filled in,
giving full particulars required therein. The application form shall be
accompanied by the Original Receipt, which can be obtained making
payment of the required Earnest Money Deposit mentioned.
(i) If on scrutiny, even after allotment, it is found from the documents
submitted or obtained subsequently that the applicant is not eligible
for allotment of flat for one or more reasons, the Board may at its
discretion, cancel the allotment without any prejudice to its rights
and the amount deposited shall be forfeited.
(j) Failure to pay the installments by the specified dates will result in
the cancellation of the allotment itself and entitle the applicant
in the waiting list to fill the resultant vacancy.
(k) An incomplete application will not be entertained and may be
rejected without reference to the applicant even if so detected
during detailed scrutiny after the drawal of lots for allotment and

even in respect of those applicants who are successful in the drawal
of lots.
(l) In case of withdrawal by the applicant, refund of deposit shall
normally be made within 90 days from the date of submission of
application for such withdrawal.
(m) All correspondence will be made with the applicants in the address
noted in their application forms. Any change of address will have to
be notified to the Board in writing immediately by the applicant.
(n) Flats are allotted on outright sale basis only and payment shall be
made within the stipulated period.
(o) Applicants in their own interest are advised to retain a photocopy of
completed application, as a matter of caution.
(p) The allottee shall continue as a tenant of the Board till such time
the flat is conveyed to him/her through a registered sale deed.
(q) On payment of Sale Price as finally fixed, the flat shall be
transferred in the name of the allottee by the Board, by executing a
Sale Deed at his/her own cost.

PROGRESSIVE PAYMENT SCHEDULE FOR OUTRIGHT PURCHASE:
Rs.1,00,000/- as EMD along with the application.
To remit 50% of the tentative cost of the flat after deducting EMD
amount of Rs.1,00,000/- within one month from the date of issue of
provisional Allotment Order of the Flat.
To remit the balance 50% of the tentative cost of the flat within two
months from the date of issue of Provisional Allotment Order of the
flat.

TERMS AND CONDITIONS FOR ALLOTMENT OF ONE BED ROOM
FLATS (without lift, G+2) UNDER 24 LIG HOUSING SCHEME AT
VALATHERU, KARAIKAL.
Puducherry Housing Board announces the terms and conditions for allotment
and sale of one Bed Room Flats under 24 LIG Housing Scheme at Valatheru,
Karaikal.

1.
(i) These terms and conditions shall apply to the allotment
and sale of flats constructed by the Puducherry Housing
Board under category of One Bed Room flats under 24 LIG
Housing Scheme at Valatheru, Karaikal.
(ii) One Bed Room flats are located on prime land called
“Valatheru Housing Scheme” adjacent to NH45-A
(Bharathiyar Road), only ½ K.M. from new Bus Stand and
Karaikal Ammaiyar Temple. The complex has links with a
host of public and private means of transport bank, post
offices, nursing homes, schools, colleges, port. In fact all
the basic amenities are located close by.
2 Definitions:-
(a) “Act” means the Puducherry Housing Board Act, 1973 (No.7 of
1974).
(b) “Allottee” means the person to whom a flat is allotted under these
terms and conditions and includes his/her legal heirs.
(c) “Allotment” means allotment of a flat under these terms and
conditions.

(d) “Applicant” means a person who has applied for allotment of flat
under these terms and conditions.
(e) “Flat” means a portion of a building along with proportionate
undivided share of land on which the flat is constructed which is
delineated as a dwelling unit.
(f) “Form” means application for allotment under these terms and
conditions prescribed by the Chairman (PHB).
(g) “Income” means the aggregated income regularly derived by the
applicant at the time of submitting the application.
(h) Words used in these terms and conditions but not defined shall
have the same meaning as assigned to them in the Act.
3. The Board may subject to the provisions of these terms and
conditions, allot flats to persons who agree to purchase the same in the
manner provided hereunder.
4. The Board, for the purpose of allotment of flats, shall issue a
notification published in one English daily newspaper or two vernacular daily
newspapers, or both, in circulation in the region to which it relates,
prescribing such details, which include the number of flats available for
allotment, the tentative cost price of the flat, plinth area, Super Built Up
Area, locality in which the scheme is in operation, Earnest Money Deposit

payable, last date of receipt of application, percentage of reservation,
category of flats, etc., as may be deemed fit by the Chairman (PHB).
5.
(i) The Applicant should submit the application along with the
certificates as specified in the application form.
(ii) The Applicant should have completed 21 years of age and should
be a native or be a permanent resident of any one of the regions
of Puducherry, Karaikal, Mahe and Yanam in the Union Territory
of Puducherry.
(iii) The reservation criteria is dispensed for allotment of flats under
the 24 LIG Housing Scheme at Valatheru, Karaikal alone and
allotment under all other housing schemes shall be made in
terms of reservation criteria as specified in G.O.Ms.No.11/99/Hg.
dated 28.06.1999.
(iv) Priority shall be given to the applicants who fall under reserved
categories as per the existing reservation criteria and without
houses in the Union Territory of Puducherry in the allotment of
flats under 24 LIG Housing Scheme at Valatheru, Karaikal.

6.
(i) The applications received against a particular notification for a
scheme shall not be transferred to any other scheme and all the
unsuccessful applicants in respect of that notification should take
back their Earnest Money Deposit with or without interest as the
case may be.
(ii) The Chairman is empowered to permit mutual exchange of flats
under the same category in a particular scheme on the joint
request made by the respective allottees in writing.
7. A Notice specifying the date, time, and venue of the drawal of „lots‟
shall be intimated to all the eligible applicants ten days before the drawal of
„lots‟ either individually or through a notification published in the local Tamil
Daily newspapers.
8.
(i) After the allotment of a flat is finalised, the Chairman (PHB) or any
officer authorized by him in that behalf, shall issue a provisional
allotment order to the allottee subject to such terms and conditions
as may be specified herein.

(ii) The Earnest Money Deposit shall be refunded without interest in full
to all the unsuccessful applicants including those in the waiting list,
after completing the allotment of all the flats in a particular scheme.
(ii) The possession of the flat will be handed over to the allottee on
completion of the construction of the flat and the allottee having
completed the payment of the entire tentative price of the flat to
the Board.
(iii) The allottee shall pay all rates, taxes, cesses, or other charges
payable to the Government or Local Authority as demanded by
them from after allotment.
(iv) The allottee shall continue as a tenant of the Board till such time
the flat is conveyed to him/her through a registered sale deed.
(v) The allottee shall not make any additions or alterations or sublet,
transfer, mortgage, etc., of the flat without the permission of the
Board.
(vi) If there is any contravention by the allottee of any of the terms
expressed or implied under these terms and conditions or in the
application, it shall be lawful to the Board to evict the allottee or
as the case may be, the occupant of the flat by duly canceling
the allotment and resuming the flat.

(vii) Any allottee, who has been allotted a flat is permitted to
mortgage the said flat in favour of the Central Government, the
State Government, the Life Insurance Corporation or any other
Government recognized loan advancing Institution, as the case
may be, with the permission of the Chairman or the Secretary of
the Board. In such an event, the Board shall have the first lien
of the said flat.
(viii) In case of flats, the allottees in respect of a specified scheme
should form an Association for the maintenance of flats in good
condition. Such an association should be formed within a period
of six months from the specified date mentioned in the
notification contemplated under Clause 14(1) of these terms and
conditions. In case, if any flat is vacant in a block, the Board will
also join as a Member in the Association till such time that all
those vacant flats are disposed off by allotment.
11.
i) The maintenance of external water supply and drainage will be
looked after by the Board upto a maximum period of six months
from the date of allotment. Thereafter, it is the responsibility of
the concerned Local Authority to maintain these amenities and
on failure, the Association formed by the allottees should take

over such maintenance. The Board shall hand over open spaces
reserved for park and play grounds to the concerned Local
Authority within six months from the date on which the flats are
ready for occupation.
ii) On payment of sale price as finally fixed, the flat shall be
transferred in the name of the allottee by the Board, by
executing a Sale Deed at his/her cost.
CONDITIONS REGARDING SALE PRICE OF A FLAT AND GTERMS OF
ITS PAYMENT
1. The flats are sold on out right sale basis.
2. The sale price at which flats are offered is tentative and subject to
revision by the Board.
3. The tentative rate of sale price per sq.ft. of Super built up area of a
flat in each scheme will be indicated in the notification published by
the Board, calling for applications for allotment.
4. An applicant for allotment of a flat shall alsong with the application
make an Earnest Money Deposit with the Board as specified in the
application.
5. The applications received will be scrutinized and a lot will be drawn
within three months from the last date of receipt of applications.

6. Selected applicants in the lot should be termed as “Successful
allottees” and they should be issued Provisional Allotment Orders.
7. The Successful allottee should make payment of the tentative cost
of the flat in the manner specified herein below:-
(a) To remit 50% of the tentative cost of the flat after deducting
EMD amount of Rs.1,00,000/- within one month from the date of
issue of Provisional Allotment Order of the flat.
(b) To remit the balance 50% of the tentative price of the flat within
two months from the date of issue of provisional Allotment Order
of the flat.
8. A successful allottee shall be issued a “No Objection Certificate” to
mortgage, if he/she applies for it, so as to enable him/her to
procure a loan from any financial institution recognized by the
Government.
9. In case, a successful allottee wants to opt out of the scheme after
allotment made, a sum equivalent to 1% of the tentative cost of flat
will be forfeited. In case, an applicant wants to opt out of the
scheme before participating in the lot, an amount of Rs.1,000/-
(Rupees one thousand only) should be deducted from the Earnest
Money Deposit made by him/her and the balance should be
refunded to him/her.

10. In respect of flats, the Board should transfer the undivided interest
in the land portion on which the tenements have been erected
along with the common facilities excluding the Board‟s retention
portion, that individual allottees.
11. The allottees should execute the necessary agreement and other
documents as desired by the Board in order to effect the transfer of
the undivided interest in the land portion in favour of them.
Thereafter, the allottees should hold the land on which the
tenements are erected, common pathways, staircase and all other
amenities enjoyed in common and take over the maintenance of
the buildings and the amenities, subject to such covenants touching
the formation of the Association under the scheme. Such an
association should be formed within a period of six months from the
date of occupation.
12. If payment of the tentative cost of the flat is not made by the
applicant within the time specified, the allottee shall lose his right to
claim the allotment of the flat and the allotment shall be deemed to
be cancelled. However the Chairman may, on nay reasonable
cause being adduced by the allottee before the due date, extent the
due date for payment by another maximum period of thirty days
from the time specified.

13. The Board is competent to revise the cost of the flat at any time for
any reason which discloses that the price fixed tentatively is less
than what it should be. The decision of the Board in this behalf is
final.
14. The Board may intimate the revised cost before the issue of Final
allotment order and the allottee should remit the same before
occupation of the flat.
15. No allottee can sell or transfer the flat allotted to him, except with
the previous permission of the Board, after fulfilling the terms and
conditions prescribed by the Board from time to time.
16. Detailed instructions regarding payments including monthly charges
and other allotment conditions shall be contained in the
communications, which may be sent by the Board to the successful
allottees from time to time, and those instructions shall be binding
upon them.
17. The allottee shall not carry out any repair works in the flat without
the prior permission of the Board in writing.
18. Any construction with kutcha and inflammable materials by the
allottee by way of addition to a flat is prohibited.
19. An applicant shall use only the prescribed application form which is
available in the Board.

20. In regard to any doubt in the interpretation of these clauses, the
Chairman‟s decision is final and binding.
21. All disputes relating to allotment, acceptance and refusal of
applications and drawal of the lots will come under the purview of
the arbitration by the Chairman, Puducherry Housing Board as the
