    Work Permit Application Form for a F oreign Worker/Trainee in Non-Domestic Sector

    Key Information:

    1. An employer who wishes to employ a foreigner (except Singapore Permanent Resident and Dependants Pass holderunder the Employment Pass scheme), needs to submit a Work Permit application for the foreigner.

    2. A foreigner must be at least 16 years old at the time of the Work Permit application.

    3. A non-Malaysian worker must not be in Singapore at the time of the Work Permit application. He can enter Singaporeonly after the employer has obtained the In-Principle Approval letter and furnished a Security Bond of SGD$5000.

    4. All employers who employ foreign workers are required to pay the monthly foreign worker levy by Inter-Bank GIRO.

    5. If the employer has not made prior arrangements for payment of foreign worker levy by GIRO, he has to complete theattached GIRO Application Form and mail it to the CPF Board. The employer is advised to sign up for GIRO early asthe processing of GIRO applications takes about 4 weeks. The GIRO deduction for levy due each month will be madeon 17th of the following month. The employer is required to maintain sufficient funds in his bank account for the GIROdeduction, failing which interest for late payment will be charged. The deduction will cease once the Work Permit iscancelled.

    6. The employer should continue to pay the levy using his current payment mode to the CPF Board until his GIROapplication is approved by the bank. The CPF Board will inform the employer when the GIRO deduction of the levywill take effect. The employer does not have to pay any fee for GIRO application.

    Documents to be attached to this completed Application Form:

    a) A photocopy of the Foreign Workers Passport/Travel Document that shows his particulars including anyamendments made.

    b) A photocopy of the Foreign Workers Educational Certificates [e.g. GCE O Level, Sijil Pelajaran Malaysia (SPM) orequivalent] if his educational level is Sec 4 or above. If the workers SPM Result Slip is submitted in lieu of the originalcertificate, the worker/employer is required to present the original SPM educational certificate at the WPD forverification 12 months after the issue of the Work Permit. The WPD will inform the worker/employer accordingly whenit is required to do so. If the worker/employer is unable to present the original educational certificate when required,the Work Permit will be revoked. The worker may also be placed on future employment ban.

    c) A photocopy of the Foreign Workers Identity Card (applicable to all Malaysian workers and the group of PRCworkers who have not obtained their Passports).

    d) For companies that are currently not employing any Work Permit holders, please attach:

    i) A photocopy of the Company/Business Profile from the Accounting and Corporate Regulatory Authority(ACRA)

    ii) A photocopy of the Companys most recent past 3 monthly CPF Contribution Statement(s) for its localworkforce

    iii) A photocopy of the Food Establishment Licence issued by the National Environment Agency (NEA)(applicable to food establishments)

    FIRST SCHEDULECONDITIONSANDREGULATORYCONDITIONSOF IN-PRINCIPLE

    APPROVAL FORAWORK PERMITPART III

    CONDITIONSTOBECOMPLIEDWITHBY EMPLOYEROF FOREIGNEMPLOYEEWHO ISNOTDOMESTICWORKER,WHO IS ISSUEDWITH

    IN-PRINCIPLEAPPROVAL FORWORK PERMIT1. The employer shall be responsible for and bear the costs of the upkeep

    (including the provision of food andmedical treatment) andmaintenance of theforeign employee in Singapore.

    2. Theemployershallalsobearanymedicalexpensesincurredbytheforeignemployee for anymedical examination required by theController.3. Theemployershallregisterorupdatetheforeignemployeesaccommodation

    addressinsuchformormannerastheControllermaydeterminepriortoissuanceof thework permit.

    4. The employer shall ensure that the foreign employee has acceptableaccommodation. Such accommodationmust be consistent with any written law,regulation,directive,guideline,circular or other similar instrument issued by theGovernment.

    5. An employer shall not demand or receive any sum or other benefit froman employment agency or any other person in connection with the employmentor change in employment of a foreign employee.

    6. If the foreign employee dieswhile in Singapore,the employer shall(a) bear the cost of either

    (i) burial of the body in Singapore;(ii) cremation of the body in Singapore and return of the ashes to

    the country of origin;or(iii) return of the body to the country of origin,

    with the foreign employees family deciding on burial, cremation orreturn of the body;

    (b) bear the cost of returning the foreign employees belongings to theforeign employees family;and

    (c) paytotheadministratorsoftheforeignemployeesestateanyoutstandingsalaries ormoneys due from the employer to the foreign employee.

    7. Subject to paragraph 8, the employer shall repatriate the foreignemployee to the international port of entry that affords reasonable access to theforeign employees hometownwithin the foreign employees home country if thein-principle approval for the foreign employee expires or is cancelled or revokedandiftheemployeeisnotearlieremployedbyanotheremployer.Intheeventofany dispute about the international port of entry to which the foreign employeeshallberepatriated,thedisputeshallbereferredtotheController,whosedecisionshall be final.

    8. The employermay repatriate the foreign employee to a destination otherthan that specified in paragraph 7

    theemployeroftheemployersintentiontodoso,beforetherepatriationoccurs;or

    PART IVREGULATORYCONDITIONSTOBE COMPLIEDWITHBY EMPLOYEROF FOREIGNEMPLOYEEWHO ISNOTDOMESTICWORKER,WHO IS

    ISSUEDWITH IN-PRINCIPLEAPPROVAL FORWORK PERMIT1. The employer shall take all necessary steps to ensure that the foreign

    employees copy of the in-principle approval letter,in its entirety as furnished bytheMinistry ofManpower, is sent to the foreign employee within a reasonabletime prior to the foreign employees departure for Singapore.The employer willbe regarded to have taken all necessary steps

    (a) where the employer does not engage the service of an employmentagency,if the employer can provide sufficient evidence that the foreignemployees copy of the in-principle approval letter, in its entirety asfurnished by theMinistry ofManpower, has been sent to the foreignemployee;or

    (b) where the employer engages the services of an employment agent, ifthe employer can provide sufficient evidence that(i) the employer instructed the employment agency to send the

    foreignemployeescopyofthein-principleapprovalletter,initsentiretyasfurnishedbytheMinistryofManpower,hasbeensentto the foreign employee;or

    (ii) theemploymentagencyinformedhimthattheemploymentagencywillsendtheforeignemployeescopyofthein-principleapprovalletter,in its entirety as furnished by theMinistry ofManpower,to the foreign employee.

    2. Theemployershallpurchaseandmaintainmedicalinsurancewithcoverageof at least $15,000 per 12-month period of the foreign employees employment(or for such shorter period where the foreign employees period of employmentislessthan12months)fortheforeignemployeesin-patientcareanddaysurgeryexcept

    the

    Controller

    may

    otherwise

    provide

    by

    noti

    fi

    cationin

    writing.

    Where

    theemployerpurchasesgroupmedicalinsurancepolicyforhisforeignemployees,the employer shall not be considered to have satisfied the obligation under thiscondition unless the terms of the employers groupmedical insurance policy aresuch that each and every individual foreign employee is concurrently covered tothe extent required under the conditions in this Part.

    3. The employer shall send the foreign employee for amedical examinationbyamedicalpractitionerregisteredundertheMedicalRegistrationAct(Cap.174)as andwhen directed by theController.

    4. If the foreign employee goesmissing, the employer shall inform theControllerwithin7daysaftertheemployerbecomesawareoftheforeignemployeegoing

    missing.

    FOURTH SCHEDULECONDITIONSANDREGULATORYCONDITIONSOFWORK PERMIT

    PART IIICONDITIONSTOBECOMPLIEDWITHBY EMPLOYEROF FOREIGNEMPLOYEEWHO ISNOTDOMESTICWORKER,WHO IS ISSUEDWITH

    1. The employer shall be responsible for and bear the costs of the foreignemployees

    upkeep

    (excluding

    the

    provision

    of

    food)

    and

    maintenance

    in

    Singapore.

    Thisincludestheprovisionofmedicaltreatment,exceptthattheforeignemployeemaybemadetobearpartofanymedicalcostsinexcessoftheminimummandatorycoverage if

    (a) thepartofthemedicalcoststobepaidbytheforeignemployeeformsnotmore than 10%of the employeesmonthly salary;and

    (b) the foreign employees agreement to pay part of anymedical costsis stated explicitly in the foreign employees employment contract orcollective agreement.

    2. Theemployershallprovidesafeworkingconditionsandtakesuchmeasuresasarenecessarytoensurethesafetyandhealthoftheforeignemployeeatwork.Theemployershallalsoensuretheforeignemployeehasacceptableaccommodation.Suchaccommodationmustbeconsistentwithanywrittenlaw,regulation,directive,guideline,circular or other similar instrument issued by theGovernment.

    3. Theemployershallpaythesalary(includingallowances)duetotheforeignemployee not later than 7 days after the last day of the salary period.Any salaryperiod agreed between the employer and the foreign employee shall not exceedonemonth.

    4. Exceptwheretheforeignemployeeisonno-payleaveoutsideSingapore,the employer shall, regardless of whether there is actual work for the foreignemployee,and subject to any written law,pay the foreign employee no less thanthe basic salary amount declared in the application for a work permit submittedto theController.

    5. The employer shall bear anymedical expense incurred by the foreignemployee for anymedical examination required by theController.

    6. Theemployershallregisterorupdatetheforeignemployeesaccommodationaddress in such form ormanner as the Controllermay determine,within 5 daysoftheforeignemployeemovingtoanewaddress.Unlessspecified,thisconditionapplies as long as the foreign employee is not repatriated.

    7. Theemployershallnotretainpossessionoftheforeignemployeesoriginalworkpermitandvisitpassandshallallowtheforeignemployeetoretainpossessionof the foreign employees work permit and visit pass.

    8. The employer shall inform the Controller of any change to the businessaddressstatedintheworkpassapplicationformwithin14daysaftersuchachange.

    (i) burial of the body in Singapore;(ii) cremation of the body in Singapore and return of the ashes to

    thecountry

    of

    origin;

    or

    (iii) return of the body to the country of origin,with the foreign employees family deciding on burial, cremation orreturn of the body;

    (b) bear the cost of returning the foreign employees belongings to theforeign employees family;and

    (c) paytotheadministratorsoftheforeignemployeesestateanyoutstandingsalaries ormoneys due from the employer to the foreign employee.

    10. Theemployershallnotdemandorreceiveanysumorotherbenefitfroman employment agency or any other person in connection with the employmentor

    change

    in

    employment

    of

    a

    foreign

    employee.

    Cancellation ofworkpermitandvisitpassanddutiesbeforeoruponrepatriationof foreign employee

    11. TheemployershallreturntheworkpermitandvisitpasstotheControllerwithin 7 days after the cancellation of thework permit.

    12. Subject to paragraph 13, the employer shall repatriate the foreignemployee to the international port of entry that affords reasonable access to theforeign employees hometownwithin the foreign employees home countrywhentheforeignemployeesworkpermitorvisitpassexpiresoriscancelledorrevokedand if the foreign employee is not earlier employed by another employer.In theevent of any dispute about the international port of entry to which the foreignemployee shall be repatriated, the dispute shall be referred to the Controller,whose decision shall be final.

    13. Theemployermayrepatriatetheforeignemployeetoadestinationotherthan that specified in paragraph 12

    (a) if the foreign employee so requests,and the Controller is informed bytheemployeroftheemployersintentiontodoso,beforetherepatriationoccurs;or

    (b) if theController so determines.14. Theemployershallbearthecostsassociatedwithrepatriatingtheforeign

    employeeatanytimeexceptwheretheControllerpermitsotherwise.Theemployershall ensure that all outstanding salaries ormoneys due from the employer tothe foreign employee have been paid before the foreign employees repatriation.

    15. Unless requested by the Controller of Immigration or the ControllerofWork Passes, the employer shall not repatriate the foreign employee whensuch repatriation would frustrate or deny any statutory claim that has been filedor is intended to be filed by the foreign employee for salary arrears under theEmploymentAct (Cap.91) or work injury compensation under theWork InjuryCompensationAct (Cap.354).

    1. The employer shall control and supervise the foreign employee. Exceptas provided in paragraphs 6 to 12 of PartV,the foreign employee shall be underthe

    2. Theemployershallnotpermittheforeignemployeetobeemployedbyorcontractedtoanyotherpersonorbusinesstodoworkforthatpersonorbusiness.

    3. Theemployershallnotemploytheforeignemployeeineitheranoccupationor a sectorwhich is different from that specified in thework permit.

    4. Theemployershallpurchaseandmaintainmedicalinsurancewithcoverageof at least $15,000 per 12-month period of the foreign employees employment(or for such shorter period where the foreign employees period of employmentislessthan12months)fortheforeignemployeesin-patientcareanddaysurgeryexcept as theControllermay otherwise provide by notification in writing.Wheretheemployerpurchasesgroupmedicalinsurancepolicyforhisforeignemployees,the employer shall not be considered to have satisfied the obligation under thiscondition unless the terms of the employers groupmedical insurance policy aresuch that each and every individual foreign employee is concurrently covered tothe extent required under the conditions in this Part.

    5. If the foreign employee so requests, the foreign employees salary shallbe paid via direct transfer into the foreign employees bank account in a bankestablished in Singapore.

    6. The employer shallmaintain a record of themonthly salary paid to theforeignemployeeandproducetherecorduponrequestbyanypublicofficeractingin his official capacity.

    7. The employer shall send the foreign employee for amedical examinationbyamedicalpractitionerregisteredundertheMedicalRegistrationAct(Cap.174)as andwhen directed by theController.

    8. If the foreign employee contravenes any of the work permit conditionsapplicable to the foreign employee, and the employer has knowledge of thecontravention, the employer shall inform the Controller and, if required by theController,apply for the cancellation of the foreign employees work permit andvisitpassandcomplywithanyotherinstructionfromtheControllerwithrespectto the contravention.

    9. TheemployershallpaythemonthlyforeignemployeelevythroughGeneralInterbankRecurringOrder(GIRO)orbysuchothermeansasmaybeapprovedby theController in writing.

    10. If the foreign employee goesmissing, the employer shall inform theControllerwithin7daysaftertheemployerbecomesawareoftheforeignemployeegoingmissing.

    vehicles in the course ofwork on public roads.3. Theemployermayallowtheforeignemployeetoonlyperformthespecified

    activitiesatconstructionsites,exceptthatthefollowingfabricationworksmaybeperformed at or outside a construction site:Fabrication works

    (a) thefabricationofstructuralprecastconcreteproducts,suchasslabpanels,wall panels,column and beams;and

    (b) the fabrication of prefabricated steel reinforcement products, such asbeam cages and pile cap cages.

    4. Subjecttoparagraph6,theemployershallnotpermittheforeignemployeeto be employed by or contracted to any other person or business to dowork forthat person or business.

    5. Subject to paragraph 8(b), the foreign employee shall be under theemployers direct employment,and the employer shall control and supervise theforeignemployeeandensurethattheforeignemployeeperformsonlythespecifiedactivities.

    6. Notwithstanding paragraph 4, an employermay,with the consent of theforeign employee,enter into a contract for the supply of labour with an eligiblethirdpartyengagedintheconstructionindustry,inrelationtoaforeignemployeetowhomtheregulatoryconditionsinthisPartandtheconditionsinPartVIapply.

    7. The employer shall verify the eligibility of the third party with theController, through suchmeans asmay be provided by the Controller, beforeentering into any such contract for the supply of labour.

    8. Any such contract for the supply of labour shall provide that(a) the third party shall ensure that the foreign employee is not sent to

    work for any other person or business;(b) thethirdpartyorhisemployeesshallsupervisetheforeignemployeeand

    ensure that the foreign employee performs only the specified activitiesaswork for the third party;

    (c) the third party shall notify and update the employer of the particularspecified activities that the foreign employee will perform;

    (d) the third party shall notify and update the employer of the worksiteaddress where the foreign employee will work;

    (e) thethirdpartyshallproducetheforeignemployeetotheemployeroncetheforeignemployeesservicesarenolongerrequired,andthecontractfor the supply of labour in respect of the foreign employee shall bedeemed terminated;

    (f) the third party shall produce the foreign employee to the employer ifthe contract for the supply of labour is terminated by either party,forwhatsoever reason;

    (g) the third party shall inform the employer immediately if the foreignemployee goesmissing;and

    and shall allow the foreign employee to retain the foreign employeeswork permit and visit pass.

    9. The employer shall specify in the contract for the supply of labour thatany breach by the third party of the contractual provisions stated in paragraph 8shall be amaterial breach of the contract between them and the contract for thesupply of labour for all foreign employees shall be deemed terminated.

    10. Subject to the terms specified in paragraph 8, no other responsibilitiesof the employer as specified in the conditions in this Schedule shall be delegatedto the third party.

    11. Thecontractforthesupplyoflabourshallbeinwriting,acopyofwhichshall be retained for a period of no less than 2 years from the date of execution.

    12. Where the contract for the supply of labour is terminated or where theforeign employee is no longer working for the third party for any reason, theemployershalltakeallnecessarymeasurestoresumecompliancewithparagraphs4 and 5 as if therewas no contract for the supply of labour.

    PARTVICONDITIONSTOBECOMPLIEDWITHBY FOREIGNEMPLOYEE

    ISSUEDWITHWORK PERMITEmployment

    1. The foreign employee shall work only for the employer specified and inthe occupation and sector specified in thework permit.

    2. Wheretheforeignemployeewhoseoccupationasstatedintheworkpermitisthatofadomesticworker,theforeignemployeeshallonlyperformhouseholdanddomesticdutiesandresideattheemployersresidentialaddressorresidentialpremises as stated in the work permit and visit pass.

    3. Except for a foreign employee whose occupation as stated in the workpermit is that of a domestic worker, the foreign employee shall reside at theaddressindicatedbytheemployertotheforeignemployeeuponthecommencementofemploymentoftheforeignemployeeandshallinformtheemployeraboutanysubsequent self-initiated change in residential address.

    4. The foreign employee shall undergo amedical examination by amedicalpractitionerregisteredundertheMedicalRegistrationAct(Cap.174)asandwhendirected by theController.

    5. TheforeignemployeeshallreporttotheControllerasandwhenrequiredby theController to do so.Conduct

    6. Theforeignemployeeshallnotgothroughanyformofmarriageorapplytomarry under any law, religion, custom or usage with a Singapore citizen orpermanent resident in or outside Singapore, without the prior approval of theController, while the foreign employee holds a work permit, and also after theforeign employeeswork permit has expired or has been cancelled or revoked.
