The public informal work session of the Board of Chosen Freeholders of the County of Morris was called to order by Director DeFillippo at 3:35 p.m. on January 28, 2015 at the Administration and Records Building, Court Street, Morristown, New Jersey.

Deputy Clerk of the Board Susan Allard read the open public meeting announcement as to the scheduling resolution and the publication of notice as required by law.

The Board of Chosen Freeholders went into executive session at 3:40 p.m. and resumed open session at 5:35 p.m. with the following in attendance:

FREEHOLDER CONFERENCE MEETING – JANUARY 28, 2015- 2 -

At 3:35 p.m. the meeting began in open session with the following in attendance:

Those present were: Director DeFillippo, Deputy Director Cesaro, Freeholders Cabana, Krickus, Lyon, Mastrangelo and Scapicchio.

Also present were: John Bonanni, County Administrator; Cathy Burd, Assistant Administrator; Daniel O’Mullan, County Counsel; and Randall Bush, Assistant County Counsel.

At 3:40 p.m. the Board went into closed session after reading the following resolution by County Counsel O’Mullan:

WHEREAS, pursuant to the Open Public Meetings Act, the Board of Chosen Freeholders of the County of Morris in the State of New Jersey may exclude the public to discuss matters as are provided under the Act (N.J.S.A. 10:4-12(b)).

NOW, THEREFORE, BE IT RESOLVED that this Board hereby excludes the public in order to discuss four (4) such matters:

1. As it pertains to personnel and contracts, the status of the Morris County Sheriff’s Office staffing levels pursuant to N.J.S.A. 10:4-12(b)(7)(8);

2. As it pertains to contracts, personnel and staffing levels in departments and agencies, to discuss preliminary budgetary approaches pursuant to N.J.S.A. 10:4-12(b)(7)(8);

3. As it pertains to contract for the potential lease of space at Morris View pursuant to N.J.S.A. 10:4-12(b)(5); and

4. As it pertains to two (2) appointments to the Morris County Municipal Utilities Authority pursuant to N.J.S.A. 10:4-12(b)(8).

The Board reserves the right, as the Board exchanges ideas related to the above matters and attempts to develop appropriate plans of actions as it may be suggested by individual Freeholders or staff members, to broaden discussion and to attempt to arrive nonbinding consensus provided such broadening of discussion continues within the limits set for in N.J.S.A. 10:4-12(b)(1) through (9). Matters discussed in Executive Session will be made public at the earliest point in time that the need for confidentiality for each such matter shall no longer be necessary.

The meeting resumed open session at 5:35 p.m.

Human Trafficking Awareness MonthDirector DeFillippo presented a proclamation to Ada Visakay, Pam Bennett-Santoro and Patti Paige, members of the Advisory Committee on Women. She noted that human trafficking is a very serious crime whose victims are often women, children and men who do not speak or understand English and who are sexually exploited or forced into labor. The traffickers may threaten the victims’ lives or their families’ lives to prevent them from trying to escape.

She noted that when she first came on the Board last year she was not aware of the human trafficking issue, but because of the Superbowl, it became a topic in the news and there were some arrests. She now has been talking regularly to people about this, particularly to those of high school and college age.

Ms. Visasky said she previously was not aware that human trafficking occurred in Morris County. This year their committee is focusing on the domestic violence issue which goes hand in hand with human trafficking. People need to be educated. Their next meeting will feature speakers from the NJ Battered Women’s Shelter. They will be focusing on speaking to high school age athletes about domestic violence.

PresentationThe Director presented a plaque to Freeholder Mastrangelo to honor him on his past two years as Freeholder Director. Freeholder Mastrangelo appreciated serving the citizens for the last two years.

Economic DevelopmentMr. Boudreau reported that we are going to have a great 2015 in Morris County. Business community connections are up this year. The annual luncheon this past Friday had 690 people in attendance. Most importantly, they have hired a new executive director for the MCEDC, Meghan Hunscher. They had several candidates. She will make a great contribution to our effort in Morris County. Jim Jones will continue to stay on the MCEDC Board.

Director DeFillippo noted that the candidates were all excellent choices, but Meghan did shine through.

Every year the Chamber of Commerce recognizes the major real estate deals in Morris County. That event will take place on February 27. Richard Smith, CEO of Realogy, will be the speaker.

Mr. Boudreau noted we are fortunate that GAF has moved from Wayne to Parsippany to take over the building that was vacated by Realogy. This will bring 700 people into Morris County.

He discussed Picatinny and spoke about the effort being made to keep this base off the military BRAC list. The Governor has set aside $200,000 in the budget to hire a firm in Washington that will work with us to represent the bases in New Jersey. Every state that has bases around the country is trying to keep their bases off the list. We need an opportunity to talk to people who make the decisions about military bases.

Mr. Boudreau wrote a white paper on the subject for the Lt. Governor to keep her informed and up to date.

Freeholder Mastrangelo said it is important to note we are competing with other states. We are not the only state that has hired a firm to assist.

Mr. Boudreau said hats off to Congressman Frelinghuysen for reaching out to the Governor on this. He has been an integral part in conversations with the Governor to put money aside in the budget to hire a firm to represent our bases.

ADMINISTRATOR’S REPORTHe reported that the annual NJAC re-organization meeting takes place this Friday morning.

The Insurance Fund Commission meets this Monday, February 2 at 4:30 p.m.

February 4 at 6 p.m. is the new date for mayors and the public sector to give their input on the 2015 County budget. The original meeting on January 26 had to be cancelled due to weather conditions.

GAF has a grand opening of their new corporate headquarters on February 10 at 10 a.m. in Parsippany.

Staff worked well in preparing for the snow blizzard that did not amount to much.

Mr. Garifo noted that on February 11 at 3:30 p.m. the Board is scheduled to have pictures taken.

COUNTY COUNSEL’S REPORTHis department has reviewed 34 resolutions for tonight’s meeting. There is one bond ordinance for second hearing/adoption that is an amendment to an ordinance adopted in May 2010 for restructuring of purposes.

FREEHOLDER KRICKUSThere is no Improvement Authority solar update scheduled for today, but he does anticipate this to be a closed session topic at next meeting.

He reported regarding the renewable wind energy program, Senator Smith has introduced a piece of legislation that would remove the requirements by the BPU of a cost benefit analysis to be prepared.

At tonight’s evening meeting there will be a special presentation on the County College’s capital projects.

He noted when he was at a council meeting in Jefferson Township they were very complimentary of the work the County is doing to pave the roadways which is especially helpful for bike races.

FREEHOLDER LYONHe noted when he made the 2014 budget presentation last year there were some avid bicyclists present who were very appreciative of the paved roadways.

FREEHOLDER MASTRANGELOThere was nothing to report at this time.

FREEHOLDER CESAROHe attended a meeting of the Rockaway River Watershed Committee.

There is no activity to report from the Mosquito Control Division. There will be a Transparency Committee meeting set up in the near future.

FREEHOLDER SCAPICCHIO He and Director DeFillippo participated in a round table discussion at Riker Danzig regarding the different levels of government and how we can interact with each other. There were thirty in attendance including Assemblyman Bucco and Mayor Dougherty from Morristown.

FREEHOLDER CABANAThe Park Commission monthly meeting was cancelled the other night due to the weather. It has been re-scheduled for this Monday at 7 p.m.The NJAC re-organization meeting will take place this Friday. This year the selection will be a Democratic President, Ann M. Cannon from Mercer County.

There is a proposed bill in the legislature that the Board may want to consider opposing. It requires any correction facility to provide prescription medications to inmates for chronic conditions or that were prescribed for chronic conditions prior to incarceration. This could be expensive for the County Jail.

FREEHOLDER DEFILLIPPOShe presented the Board with a resolution that she asked them to consider placing on tonight’s agenda. It is a re-affirmation of the Freeholder Board’s 2003 commitment to fund churches of historic significance within the Historic Preservation Trust Fund rules and regulations. She read the resolution to the Board. Based on the amount of contacts all the Board has received from the constituents in the past two weeks – hundreds of emails, many phone calls – she proposed this be placed on the agenda to re-affirm the Board’s commitment.

Director DeFillippo asked for a straw vote. All the members of the Board concurred to place the resolution on tonight’s agenda.

DEPARTMENT HEADS REPORTSMr. Kovalcik reported that his department is continuing to work on the 2015 budget.

Ms. Carpinteri reported that the Resource Center Fair for the homeless has been rescheduled to the summer. About 30 volunteers are engaged today in counting sheltered and unsheltered people in Morris County. The count is done on the 4th Wednesday of each month.

Ms. Leary reported on the Circulation Element Project. There was a joint meeting between the Board of Transportation, Planning Board and the Freight Railroad Advisory Committee. The consultant came and made a presentation on what this long process will be. They have a nice slogan, “Morris County in Motion.” The Technical Advisory Committee meeting will take place in February. This is a diverse, large advisory committee. There will be public outreach.

Mr. Tugman spoke about the virus that has been affecting Morris County computers.  It is a weaponized Trojan that is designed to compromise banking information and capture e-

mail address information.  The County’s anti-virus product(s) are effective at protecting end-users.  He explained that Windows based systems and android phones are vulnerable if the attachment is opened, as well as Apple systems running on IOS’s prior to IOS8.  As a precautionary measure and to lessen the impacts of infected email attachments OIT is disabling the ability for users to activate the MS Outlook Auto-Preview feature that will automatically open an e-mail attachment when the message is read. 

Mr. DiGiralomo reported that they knew the storm would hit during the night and this would not require additional staff to be brought to the center. Even if it hit as predicted, they felt the problems would not occur until the next day. Prior to the storm occurring, all departments made a quick conference call to coordinate their efforts.

RESOLUTIONSThe Board reviewed and discussed the resolutions.

ROAD OPENING PERMITThe Board approved placing the road opening permit on tonight’s agenda.

On motion by Freeholder Cabana and seconded by Freeholder Krickus, the meeting adjourned at 6:25 p.m.
