FCBA Lunch with Edward Lazarus on March 18 The FCBA will be holding a luncheon on Thursday, March 18, 2010 featuring Edward P. Lazarus. The luncheon will be held at the Mayflower Hotel, 1127 Connecticut Avenue, NW. Registration begins at 11:30 a.m. and the luncheon begins at Noon. As Chief of Staff for Chairman Genachowski, Mr. Lazarus oversees major telecommunications policy initiatives, as well as the day-to-day operations of the FCC. Mr. Lazarus came to the FCC from Akin, Gump, Strauss, Hauer & Feld, where he was co-head of the firm-wide global litigation practice and a member of the firm’s management committee, overseeing more than 800 lawyers. He is a former prosecutor who served as an assistant U.S. Attorney for the Central District of California. Mr. Lazarus started his legal career as a law clerk for Supreme Court Justice Harry A. Blackmun and for Judge William A. Is it spring yet?

Spring will come – no, really – and when it does, it will bringa number of programs related to the release of the FCC’sNational Broadband Plan. A couple of early highlights:

On March 18, we will host a luncheon featuring FCC Chief ofStaff Edward Lazarus to discuss the National Broadband Plan.The luncheon, which will be held at the Mayflower Hotel, willbegin at noon.

Also, on March 22, in conjunction with the CTIA convention in Las Vegas, theassociation’s wireless committee will present a CLE program that includes industryreactions to the National Broadband Plan. That will start at noon in the Las VegasConvention Center.

So mark your calendars – and watch this space and check your e-mails foradditional broadband programs and events.

On other fronts, on March 11, the FCBA, in conjunction with the ABA ForumCommittee, will hold the 5th Annual ABA/FCBA Privacy and Data SecuritySymposium for Communications and Media Companies. The afternoon CLE startsat 2 p.m. in the Arnold & Porter Conference Center and will be made available viavideo feed in Denver, New York, and San Francisco through Arnold & Porter offices.

On March 31, the Mass Media Committee, in association with the Freedom Forum,the ABA Forum Committee, and the Newseum, will present “Media Regulation andthe First Amendment in the 21st Century.” This CLE will start at 1 p.m. at theNewseum.

And please make plans to attend the 2010 Annual Seminar – to be held at TheHomestead Resort April 30-May 2. It’s sure to be both an informative and relaxingweekend in this great family resort.

One final note: Because of one of the February blizzards, the NationalTelecommunications Moot Court Competition, originally scheduled for February 5-6, was rescheduled to March 27. I’m pleased to report that all but two of the originalteams have been able to participate in the rescheduled competition.

Judges Needed for Moot CourtCompetitionThe National Telecommunications Moot Court Competition Committee isseeking interested attorneys to serve as judges for the 2010 competition. Judgesare needed to grade briefs and to judge oral arguments, which will be held at theCatholic University of America Columbus School of Law on Saturday, March27, 2010. Overview: The new decade brings a hostof new laws, increased governmentoversight, and class action lawsuitpotential regarding the privacy andsecurity of personally identifiableinformation for consumers, clients, andemployees of communications andmedia companies.

This year’s Symposium will open with akeynote from The Honorable PamelaJones Harbour, Commissioner of theFederal Trade Commission.Commissioner Harbour will provide herperspective on privacy and data security.Three substantive sessions will follow.The first will cover the government’srole in privacy and data security,including the effectiveness of regulatoryenforcement mechanisms and self-regulatory regimes. The second willdiscuss requisite contract clauses, duediligence requirements, and insurancecoverage to help reduce liability forrelationships with third party serviceproviders, behavioral advertising andsocial networking websites/services, ande-commerce services. Interested in Hosting an FCBA event?The FCBA greatly appreciates the support of our members’ firms and companieswho provide space for our brown bag lunches, committee meetings, and CLESeminars throughout the year. We are, however, always looking for newlocations that can host FCBA events. We will be experimenting with some newpresentation technology in future CLE seminars, which require more technicalsupport than we have needed in the past.

In general terms, we need conference rooms that can seat at least 30 (more ifpossible) people at tables for brown bag lunches and committee meetings andconference rooms that can seat a minimum of 60 for CLE seminars. Firms andcompanies hosting brown bag lunches provide beverages and desserts; firmsand companies hosting CLE seminars provide beverages and snacks. CLEseminars are generally held from 6:00 – 8:30 p.m. Additionally, for CLEseminars we need facilities that can provide technology support formicrophones for as many as six speakers on a panel, the ability to tie the housesound system into a teleconference bridge, video projection capabilities forPowerPoint presentations, and access to the internet for presentations byspeakers. Originally established by the Institutefor Communications Law Studies andthe FCBA, the NationalTelecommunications Moot CourtCompetition provides students theopportunity to argue before private andgovernment practitioners in thecommunications field. This year’sproblem addresses difficultjurisdictional and statutory questionsthat may arise if policymakers seek toregulate how broadband providersdesign their service offerings.

This year’s competition will feature aselect group of elite schools, with teamshailing from, among other schools, theUniversity of Wisconsin, HowardUniversity, and the University ofColorado. In 2009, a CatholicUniversity team won the competition.

Law JournalCommitteeWhether by e-mail hyperlink, paperissue, or website download, FCBAmembers have ready access to anotheryear of the Association’s long-runningacademic publication, the FederalCommunications Law Journal. Overthe past year, the Law JournalCommittee continued to serve as aprimary point of contact between theAssociation and the Journal’s hostschool and co-publisher, IndianaUniversity School of Law-Bloomington.The Committee works with theJournal’s student editors, faculty advisor,and administrators on matters relatingto our publication contract. Throughregular conference calls and an annualon-site visit, the Committee also worksto make the student editors aware ofspecific communications-related topicsof interest to our membership anddiscusses general issues of editorialpolicy. In addition, the Committee triesto facilitate interaction betweenstudents who are members of the

Journal and members of the Associationby, for example, working with the FCBAleadership to secure resources forstudent notes and book review authors.

The Committee has traditionally beencomprised of members with differentprofessional perspectives, includingprivate practitioners, FCC staff, andacademics who specialize incommunications law. The currentmake-up is no different. This yearDeborah Salons, an associate at DrinkerBiddle & Reath LLP and former Editor-in-Chief of the Journal, returns as co-chair, and Donna Gregg, Law Professorat the Catholic University of AmericaColumbus School of Law, joins as co-chair. Chris Wright, partner atWiltshire & Grannis LLP, also returns asExecutive Committee Liaison. We aregrateful to Jamison Prime, of the FCC’sOffice of Engineering and Technologyand a former editor of the Journal,whose contributions were many duringhis seven years as a co-chair, from 2002-2009.

With the encouragement of the FCBAleadership, the Committee hascontinued to examine how scholarlypublishing is evolving in the electronicage, and to make recommendations asto how we could better use electronicresources to enhance the Journal’savailability and value to themembership. The co-chairs of theCommittee had the opportunity to visitBloomington in November to meet withstudents and faculty to discuss theeditorial process and the advantages ofmaking the Journal available on variousonline databases. Currently, theCommittee is working with theleadership of the Journal to explorescholarly electronic databaseopportunities.

The Committee always enjoys theopportunity to engage with law studentsand the academic community, and hasbeen encouraged by the recent work atIndiana and for the enthusiasm andcontributions of Professor Jody Madeirain her role as faculty advisor. This year’sstudent editorial staff, led by Editor-in-Chief Jeff Lawson, is hard at work onthe remaining two issues of the Journal,which are slated to includecontributions, among others, dealingwith network management, netneutrality, broadcast localism, andbroadband penetration rates. TheJournal staff is comprised of 60students, 23 of which are on theEditorial Board. The JournalCommittee is also pleased to report thatthe Journal staff encourages theirmembers to participate in various FCBAevents, and sends two teams toparticipate in the Catholic UniversitySchool of America Columbus School ofLaw’s National TelecommunicationsMoot Court competition.

We encourage committee members andothers in the Association to help withour ongoing efforts to assist studentwriters in the development of timelyand informative notes. As always, weencourage all members of theAssociation to contact the co-chairswith their comments and ideas.

FCBA FoundationNow AcceptingApplications forFunding of UnpaidLegal InternshipsFor the seventeenth consecutive year,the Federal Communications BarAssociation (FCBA) Foundation willaward stipends to law students from itsChairman Robert E. Lee Scholarshipand Internship Fund. In 2010, theFoundation will award at least five$5,000 stipends to law studentsemployed as unpaid summer interns inpositions with the FCC and othergovernment agencies or entities with aconnection to the communicationsindustry (i.e., broadcasting, cabletelevision, telephony, satellite, wireless,and information technology).

In addition, the Foundation will selectone outstanding intern among thosechosen to receive an additional stipendof $600 for the summer—the “MaxPaglin Award.” Mr. Paglin was theformer General Counsel and ExecutiveDirector of the FCC, and the founder ofthe Golden Jubilee Commission onTelecommunications, which compiled adefinitive legislative history of theCommunications Act.

Applicants will be selected on the basisof: (1) a demonstrated interest in thecommunications field, (2) havingsecured or having pending, an unpaidsummer position (internship) for at least8 weeks in communications with agovernment agency or entities with aconnection to the communicationsindustry, (3) dependence on financialassistance in order to accept the unpaidinternship in a government agency orentity involved in communications; and,(4) community activities. To the extent arecipient receives unanticipated fundingfor the unpaid internship, the FCBAFoundation’s general policy is to reduceits scholarship awards by any amountthat a recipient’s total funding (includingall sources) for the internship wouldotherwise exceed $7,000.

McKenna’s Wagon is a mobile soup andsandwich wagon that goes “on location”to deliver food to the needy. For thosewho have volunteered, it has been awonderful experience and a great wayto help the needy in the D.C.community. This is an especially goodexperience for the teens and pre-teensamong us who do not have a fullappreciation of the many privileges theyenjoy. Community service credits arealso available.

The Wagon is a white van that is loadedup with sandwiches, snacks and soup.We meet at Martha’s Table at 4:45 p.m.in comfortable clothes and shoes.Martha’s Table is located in a yellowbuilding at 2114 Fourteenth Street, NW,

in the District, near the intersection of14th and U Streets. On-street parking isavailable.

Upon arrival we get assignments (someof us will distribute snacks andsandwiches, others will serve soup), andput on aprons before we depart in thevan to 5th and New York Ave., NW(near the new Convention Center). Weare driven by one of our experiencedvolunteers and the trip to distributionlocation takes about 10-15 minutes.

We serve about 30-75 people per visitincluding a few mothers who come forfood for their families. The area is wellpatrolled by police. The fooddistribution is conducted in an efficient,

calm and orderly fashion and many ofthe people we serve are quiteappreciative of our efforts. Once weserve all of the food, we do a clean up ofthe immediate area. Total time for thedistribution takes about one hour andwe usually return to Martha’s Table byor before 6:30 p.m.

Joseph M. Morrissey(1923-2009)Joe Morrissey, 86, a retiredcommunications lawyer and a formerFCBA member, died on December 30,2009 at his home in Fairfax County,Virginia. He suffered complicationsfrom seizures attributed to injuriesincurred several years ago in anautomobile accident.

Morrissey was born in Brooklyn, NewYork in 1923. He joined the Army AirForce during World War Two andserved as a navigator in North Africaand Italy during the War, flyingmissions over enemy-held territory atthe age of 21. He later served inGermany and in Asia during theKorean and Viet NamWars.

While still in the Air Force, Morrisseygraduated from the University ofHouston in 1950 and from St. Mary’sUniversity Law School in San Antonioin 1957. He came to the Washington,D.C. area in 1964.

Morrissey retired from the Air Force in1968, and was awarded the Legion ofMerit. In his legal career, he initiallyworked for the Air Line PilotsAssociation and later became a partnerin the law firm of Welch & Morgan inWashington. A part of Morrissey’spractice consisted of representingapplicants in comparative broadcasthearings, including license renewalproceedings, before the FCC. Inaddition, he represented agents of theFederal Bureau of Investigation.

Morrissey is remembered as an affableraconteur and a creative lawyer. Hisdaughter Sheila Morrissey recalls thaton one occasion, in the course of herfather’s representation of some FBIagents, Morrissey concluded thatadditional time was needed to preparehis case, under circumstances where itwas not clear that he would be grantedthat additional time. He argued that hewould need the additional time in orderto obtain a special security clearance

that was required for him to representhis clients effectively, a point whichwon him the additional time,notwithstanding that in his lastassignment for the Air Force he was infact performing intelligence work.

Morrissey was also an adjunct professorof business law at the University ofMaryland from 1962 to 1989. In 1986,he retired from the practice of law, buthe remained a member of the FCBAuntil 1998.

James H. Quello(1914-2010)On January 24, 2010, James Henry“Jim” Quello, who served for nearly 24years as an FCC Commissioner and asFCC Chairman in 1993, died at homewith his family by his side. He was 95.

Quello was appointed to the FCC in1974 by then-President Richard Nixon.His first confirmation hearing lasted anunprecedented eight days, a good deallonger than his final confirmation,which lasted a mere eight minutes.The “Boss,” as Quello’s loyal staffreferred to him, was reappointed to theCommission several times. He retiredfrom the FCC in 1998 to join the lawfirm of Wiley Rein as a consultant,where he remained until his passing.

His brief tenure as Chairman in 1993was active. During this time, theCommission voted on many rulesimplementing the Cable TV Act of1992 and created a more competitivewireless market through approval ofthe Personal Communication Servicerules. The New York Times describedhis stint as Chairman with theheadline, “Temporary Chief ProvesMore Than a Fill-In.”

As Chairman and Commissioner,Quello was known for his affablenature and for not taking himself tooseriously. As Chairman, he wasinstrumental in improving the esprit d’corps among the FCC staff and

coworkers. Right up to the weekbefore his death, Jim was inquiringabout the morale of the employees atthe Commission, whom he greatlyadmired for their hard work anddedication.

As an FCC Commissioner, Quello wasrespected for his independent, non-partisan thinking. He was an ardentadvocate of free universal televisionand of local public service by TV andradio stations. “I do deregulation, Idon’t do anarchy,” he told the New YorkTimes.

Quello entered World War II as aPrivate in the U.S. Army infantry,ultimately reaching the rank ofLieutenant Colonel and earningnumerous commendations for hisservice, including the Bronze Star. Hetook part in six amphibious landings;fought across northern Africa, Sicily,the Italian boot, France, Germany, andAustria; and participated in thecapturing of the Nazi War College.Later, he wrote of his war years in his2001 autobiography, My Wars,Surviving WWII and the FCC, but oftenself effacingly confided to many thathis war stories became “more heroicwith every telling.”

After returning from World War II,Quello worked in the promotionsdepartment at WXYZ in Detroit,jumping two years later to rival WJR,where, in 1960, he was named VicePresident and General Manager. WhenCapital Cities Broadcasting purchasedWJR, Quello continued to run thestation and became a CapCities VicePresident. In his radio years, he wasinvolved with such early shows as TheLone Ranger and The Green Hornet. Aleader known not only for his publicrelation skills and writing ability, butalso for his dedication to developingdiversity, Jim worked for equality andfairness both in the workplace at WJRand through participation on theDetroit Fair Housing Commission.

Association of Broadcasters in 1994and from the National CableTelecommunications Association in1997. He was inducted into theBroadcasting and Cable Hall of Famein 1995 and was named by the Libraryof American Broadcasting as one of the“Giants of Broadcasting” in 2008.

In 1999, Jim Quello was honored byhis alma mater, Michigan StateUniversity, with the creation of theJames H. and Mary B. Quello Centerfor Telecommunication PolicyManagement and Law. The Center is afitting tribute to the couple and theirlife’s work.

Jim is survived by his two sons, JamesQuello of Ohio and Dick Quello ofFlorida. The family has asked thatcontributions be made to the QuelloCenter.

Richard J. Shiben(1937-2009)Richard Joseph (Dick) Shiben, a formerChief of the Broadcast Bureau at theFCC, died December 4, 2009 at hishome in Largo, Florida to which he hadretired six years ago. Shiben joined theFCC in 1964, two years after earning hislaw degree at West Virginia University.His undergraduate degree was from St.Vincent College of Latrobe,Pennsylvania. Before becoming BureauChief in 1979, Dick served for severalyears as Chief of the Renewal andTransfer Division in the Bureau. Afterleaving the Bureau in the mid-1980s, heserved until his retirement as Chief of theLand Mobile and Microwave Division ofthe Private Radio Bureau and, briefly, asActing Chief of that Bureau. Afterdeparting the FCC, Shiben operated aconsulting business in the Washingtonarea until his move to Florida.

Barbara Kreisman, Chief of the VideoDivision in the Media Bureau’s Office ofBroadcast License Policy recalls Dick as“a great boss; honest, straightforwardwith great integrity. He was fun andnever took himself too seriously.” Shibenwas a member of the Senior ExecutivesAssociation and the National Society ofthe Arts and Letters, and was very activewith the Big Brothers Program inWashington, D.C. He was an avid golferand played many courses throughout theU.S. and abroad.

Survivors include his wife, DennaShiben; two brothers; three sons; adaughter; a stepson and threestepdaughters; 16 grandchildren; andone great-grandchild.
