¿Qué es FATCA?
Foreign Account Tax Compliance Act (FATCA) se promulgó el 18 de
Marzo de 2010 por el congreso de los E.U.
Su objetivo es prevenir la evasión fiscal, identificando residentes fiscales
norteamericanos que tienen ingresos o activos financieros fuera de su
país.
Requieren de la colaboración en primera instancia de las Instituciones
Financieras Extranjeras. (IFF´s) por ejemplo Bancos comerciales o de
inversión mexicanos y,
Entidades extranjeras no financieras con inversiones directas o
indirectas en los Estados Unidos o con beneficiarios de Estados Unidos
también se verán afectadas.

¿Qué es FATCA?
FATCA introduce un nuevo sistema de retención de Impuesto a la Renta
sobre ciertos pagos de fuente norteamericana realizados a ciertas instituciones extranjeras financieras y no financieras, si no se cumplen ciertas reglas de información.
Bajo esta ley, las Instituciones Financieras Extranjeras (FFI’s) requieren
firmar un acuerdo con el Internal Revenue Service (IRS).
Si una FFI se rehúsa a firmar el acuerdo de revelación de información,
ésta y sus clientes serán sujetos a una retención de un 30% en todos sus
intereses, dividendos y ganancias provenientes de inversiones
norteamericanas, ya sea pagado o no a una persona de EUA.
El acuerdo de revelación de información requiere que las FFI’s
identifiquen a sus cuentahabientes de EUA y lo revelen al IRS
anualmente.

6 acciones que el FFI debe llevar a cabo en su Acuerdo
1. Identificar cuentas de EUA (mantenidas por un individuo o una entidad)
2. Cumplir con los requerimientos de due diligence solicitados por el IRS
para identificar cuentas
3. Reportar al IRS anualmente las cuentas de EUA
4. En su caso, efectuar retención de 30% a aquellos cuentahabientes que
no se identifiquen y/o a entidades que decidan no participar
5. Proveer información adicional que solicite el IRS
6. Si la ley del país previene el proporcionar información al extranjero,
obtener un permiso de los cuentahabientes relevantes, o bien, dejar la
cuenta.

¿Qué se va a reportar?
Entre otros, se reportará a través de un formato electrónico:
− Nombre, domicilio, número de identificación fiscal de cada persona
− Número de cuenta
− Saldos al fin de año de cada cuenta, en dólares.
− Ingreso bruto pagado o acreditado de esa cuenta
− Ganancias pagadas en esa cuenta
− Para cuentas cerradas o transferidas, reportar el saldo cerrado o
transferido, más el ingreso pagado por el año.

* Para evitar una retención, deberán proporcionar al agente retenedor, certificación de

¿Cuándo entra en vigor?
Las retenciones 30% de FATCA inician el 1 de enero de 2014.
Con relación a cualquier obligación emitida antes del 18 de marzo 2012
por la que se generen intereses y ganancias, no habrá retención.
Se han publicado “regulaciones” a FATCA, y proveen una guía
preliminar, pero están sujetas a cambio.
Aunque la retención sobre ingresos pasivos será efectiva a partir del
2014 y para otros ingresos a partir de 2015, las FFI’s necesitan
documentar sus esfuerzos FATCA al momento de firmar su acuerdo con
el IRS.

Acuerdos intergubernamentales.
Acuerdos con países europeos (países facta)
El día 8 de Febrero de 2012 junto a la publicación de las regulaciones
propuestas, el Tesoro de los Estados Unidos publicó una declaración
conjunta junto a los 5 países mas grandes de Europa donde expresan su
interés y compromiso en implementar FATCA a nivel de acuerdo
gubernamental por medio del cual FFIs en dichas jurisdicciones
enviarían la información al fisco de sus propios países, quien enviaría la
información al IRS, y con ello las FFIs no se encontrarían requeridas de
entrar en acuerdos individuales con el IRS.

Director de Cumplimiento (CCO)
El Director de Cumplimiento (Chief Compliance Officer) deberá certificar
que la FFI ha cumplido con los requisitos establecidos
Deberá certificar que entre el 9 de mayo de 2011 y la fecha efectiva de su
acuerdo, no realizó ninguna actividad para apoyar a cuentahabientes a
evitar su identificación
Certificará que existan políticas y procedimientos que prohíban a los
empleados a apoyar a los cuentahabientes para evadir los
requerimientos de identificación.
