REGULATION (EU) No 517/2014 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 16 April 2014 on fluorinated greenhouse gases and repealing Regulation (EC) No 842/2006 (Text with EEA relevance) THE EUROPEAN PARLIAMENT AND THE COUNCIL OF THE EUROPEAN UNION, Having regard to the Treaty on the Functioning of the European Union, and in particular Article 192(1) thereof, Having regard to the proposal from the European Commission, After transmission of the draft legislative act to the national parliaments, Having regard to the opinion of the European Economic and Social Committee ( 1 ), After consulting the Committee of the Regions, Acting in accordance with the ordinary legislative procedure ( 2 ), Whereas: (1) The Fourth Assessment Report of the Intergovernmental Panel on Climate Change (‘IPCC’) of the United Nations Framework Convention on Climate Change (‘UNFCCC’), to which the Union is party ( 3 ), stated that, on the basis of existing scientific data, developed countries would need to reduce greenhouse gas emissions by 80 % to 95 % below 1990 levels by 2050 to limit global climate change to a temperature increase of 2 °C and thus prevent undesirable climate effects. (2) To reach this target, the Commission adopted a Roadmap for moving to a competitive low carbon economy in 2050, which was noted by the Council in its Conclusions of 17 May 2011, and endorsed by the European Parliament in its Resolution of 15 March 2012. In that Roadmap, the Commission laid out a cost-effective way of achieving the necessary overall emission reductions in the Union by 2050. That roadmap establishes the sectoral contributions needed in six areas. Non-CO 2 emissions, including fluorinated greenhouse gases but excluding non- CO 2 emissions from agriculture, should be reduced by 72 % to 73 % by 2030 and by 70 % to 78 % by 2050, compared to 1990 levels. If based on the reference year 2005, a reduction in non-CO 2 emissions, except those from agriculture, of 60 % to 61 % by 2030 is required. Fluorinated greenhouse gas emissions were estimated at 90 million tonnes (Mt) of CO 2 equivalent in 2005. A 60 % reduction means that emissions would have to be reduced to approximately 35 Mt of CO 2 equivalent by 2030. Given estimated emissions of 104 Mt of CO 2 equivalent in 2030 based on the full application of current Union legislation, a further decrease of approximately 70 Mt of CO 2 equivalent is required. (3) The Commission report of 26 September 2011 on the application, effects and adequacy of Regulation (EC) No 842/2006 of the European Parliament and of the Council ( 4 ) concluded that the current containment measures, if fully applied, have the potential to reduce emissions of fluorinated greenhouse gases. Those measures should therefore be maintained and clarified on the basis of the experience gained in implementing them. Certain measures should also be extended to other appliances in which substantial quantities of fluorinated greenhouse gases are used, such as refrigerated trucks and trailers. The obligation to establish and maintain records of equipment that contains such gases should also cover electrical switchgear. Given the importance of containment measures at the end of life of products and equipment containing fluorinated greenhouse gases, Member States should take account of the value of producer responsibility schemes and encourage their establishment, based on existing best practices. (4) That report also concluded that more can be done to reduce emissions of fluorinated greenhouse gases in the Union, in particular by avoiding the use of such gases where there are safe and energy-efficient alternative technologies with no impact or a lower impact on the climate. A decrease of up to two thirds of the 2010 emissions by 2030 is cost-effective because proven and tested alternatives are available in many sectors. (6)Toencouragetheuseoftechnologieswithnoimpactorlowerimpactontheclimate,thetrainingofnatural personswhocarryoutactivitiesinvolvingfluorinatedgreenhousegasesshouldcoverinformationontechnologies thatservetoreplaceandreducetheuseoffluorinatedgreenhousegases.Giventhatsomealternativestofluorinatedgreenhousegasesusedinproductsandequipmenttoreplaceandreducetheuseoffluorinatedgreenhouse gasescanbetoxic,flammableorhighlypressurised,theCommissionshouldexamineexistingUnionlegislation coveringthetrainingofnaturalpersonsforthesafe-handlingofalternativerefrigerantsand,ifappropriate,should submitalegislativeproposaltotheEuropeanParliamentandtotheCounciltoamendtherelevantUnionlegislation. (7)Certificationandtrainingprogrammesshouldbeestablishedoradaptedtakingaccountofthoseestablishedunder Regulation(EC)No842/2006andmaybeintegratedintothevocationaltrainingsystems. (8)ToensurecoherencewithmonitoringandreportingrequirementsundertheUNFCCCandwithDecision4/CMP.7 oftheConferenceofthePartiesservingasthemeetingofthePartiestotheKyotoProtocoltotheUNFCCC, adoptedbytheseventhConferenceofthePartiesoftheUNFCCCmeetinginDurbanon11December2011, globalwarmingpotentialsshouldbecalculatedintermsofthe100-yearglobalwarmingpotentialofonekilogram ofagasrelativetoonekilogramofCO 2 .Thecalculationshould,wherepossible,bebasedontheFourth AssessmentReportadoptedbytheIPCC. (9)Effectivemonitoringoffluorinatedgreenhousegasemissionsiscriticalfortrackingprogresstowardsthe achievementofemissionreductiontargetsandforassessingtheimpactofthisRegulation.Theuseofconsistent, high-qualitydatatoreportonfluorinatedgreenhousegasemissionsisessentialtoensuringthequalityofemissions reporting.TheestablishmentofreportingsystemsbyMemberStatesofemissionsoffluorinatedgreenhousegases wouldprovidecoherencewithRegulation(EU)No525/2013oftheEuropeanParliamentandoftheCouncil ( 1 ). DataonleakageoffluorinatedgreenhousegasesfromequipmentcollectedbycompaniesunderthisRegulation couldsignificantlyimprovethoseemissionreportingsystems.Inthatway,itshouldbepossibletocheckthe consistencyofthedatausedtoderiveemissionsandtoimproveapproximationsbasedoncalculations,leadingtoa betterestimationofemissionsoffluorinatedgreenhousegasesinthenationalgreenhousegasesinventories. (10)Giventhattherearesuitablealternativesavailable,thecurrentbanonusingsulphurhexafluorideinmagnesium die-castingandtherecyclingofmagnesiumdie-castingalloysshouldbeextendedtofacilitiesthatuselessthan 850kgofsulphurhexafluorideperyear.Similarly,withanappropriatetransitionalperiod,theuseofrefrigerants withaveryhighglobalwarmingpotentialof2 500ormoretoserviceormaintainrefrigerationequipmentwitha chargesizeof40tonnesofCO 2 equivalentormoreshouldbebanned. (11)Wheresuitablealternativestotheuseofspecificfluorinatedgreenhousegasesareavailable,bansontheplacingon themarketofnewequipmentforrefrigeration,air-conditioningandfireprotectionthatcontains,orwhose functioningreliesupon,thosesubstancesshouldbeintroduced.Wherealternativesarenotavailableorcannot beusedfortechnicalorsafetyreasons,orwheretheuseofsuchalternativeswouldentaildisproportionatecosts,it shouldbepossiblefortheCommissiontoauthoriseanexemptiontoallowtheplacingonthemarketofsuch productsandequipmentforalimitedperiod.Inthelightoffuturetechnicaldevelopments,theCommissionshould furtherassessbansontheplacingonthemarketofnewequipmentformedium-voltagesecondaryswitchgearand newsmallsinglesplitair-conditioningsystems.EN L150/196Official Journal ofthe European Union20.5.2014 ( 1 )Regulation(EU)No525/2013oftheEuropeanParliamentandoftheCouncilof21May2013onamechanismformonitoringand reportinggreenhousegasemissionsandforreportingotherinformationatnationalandUnionlevelrelevanttoclimatechangeand repealingDecisionNo280/2004/EC(OJL165,18.6.2013,p.13).(12)Equipmentcontainingfluorinatedgreenhousegasesshouldbeallowedtobeplacedonthemarketiftheoverall greenhousegasemissionsofthatequipment,takingintoaccountrealisticleakageandrecoveryrates,arelower, duringitslifecycle,thanthosethatwouldresultfromequivalentequipmentwithoutfluorinatedgreenhousegases, whichhasthemaximumallowedenergyconsumptionsetoutinrelevantimplementingmeasuresadoptedunder Directive2009/125/ECoftheEuropeanParliamentandoftheCouncil ( 1 ).Theregularandtimelyreviewofthose implementingmeasures,inaccordancewiththatDirectivewouldhelptoensurethatthoseimplementingmeasures continuetobeeffectiveandappropriate. (13)Graduallyreducingthequantitiesofhydrofluorocarbonsthatcanbeplacedonthemarkethasbeenidentifiedas themosteffectiveandcost-efficientwayofreducingemissionsofthosesubstancesinthelongterm. (14)ToimplementthegradualreductionofthequantitiesofhydrofluorocarbonsthatcanbeplacedontheUnion market,theCommissionshouldallocatequotastoindividualproducersandimportersfortheplacingofhydrofluorocarbonsonthemarketinorderthattheoverallquantitativelimitfortheplacinghydrofluorocarbonsonthe marketisnotexceeded.Toprotecttheintegrityofthegradualreductionofthequantitiesofhydrofluorocarbons placedonthemarket,hydrofluorocarbonscontainedinequipmentshouldbeaccountedforundertheUnionquota system.Wherehydrofluorocarbonscontainedinequipmenthavenotbeenplacedonthemarketpriortothe chargingoftheequipment,adeclarationofconformityshouldberequiredtoprovethatthosehydrofluorocarbons areaccountedforundertheUnionquotasystem. (15)Initially,thecalculationofreferencevaluesandtheallocationofquotastoindividualproducersandimporters shouldbebasedonthequantitiesofhydrofluorocarbonsthattheyreportedashavingbeenplacedonthemarked duringthereferenceperiodfrom2009to2012.However,inordernottoexcludesmallundertakings,elevenper centoftheoverallquantitativelimitshouldbereservedforimportersandproducerswhohavenotplacedonthe market1tonneormoreoffluorinatedgreenhousegasesinthereferenceperiod. (16)Byregularlyrecalculatingthereferencevaluesandquotas,theCommissionshouldensurethatundertakingsare allowedtocontinuetheiractivitiesonthebasisoftheaveragevolumestheyplacedonthemarketinrecentyears. (17)Themanufacturingprocessforsomefluorinatedgasescanresultinsignificantemissionsofotherfluorinated greenhousegasesproducedasby-products.Suchby-productemissionsshouldbedestroyedorrecoveredfor subsequentuseasaconditionfortheplacingoffluorinatedgreenhousegasesonthemarket. (18)TheCommissionshouldensurethatacentralelectronicregistryisinplacetomanagequotas,fortheplacingof hydrofluorocarbonsonthemarket,andthereporting,includingthereportingonequipmentplacedonthemarket, inparticularwheretheequipmentispre-chargedwithhydrofluorocarbonsthathavenotbeenplacedonthe marketpriortothecharging,thusrequiringverification,throughadeclarationofconformityandsubsequentthird partyverification,thatthequantitiesofhydrofluorocarbonsareaccountedforundertheUnionquotasystem. (19)Tomaintaintheflexibilityofthemarketinbulkhydrofluorocarbons,itshouldbepossibletotransferquotas allocatedonthebasisofreferencevaluestoanotherproducerorimporterintheUnionortoanotherproduceror importerwhichisrepresentedintheUnionbyanonlyrepresentative. (20)ToenablethemonitoringoftheeffectivenessofthisRegulation,thescopeofthecurrentreportingobligations shouldbeextendedtocoverotherfluorinatedsubstancesthathavesignificantglobalwarmingpotentialorthatare likelytoreplacethefluorinatedgreenhousegaseslistedinAnnexI.Forthesamereasonthedestructionof fluorinatedgreenhousegasesandtheimportationintotheUnionofthosegaseswhencontainedinproducts andequipmentshouldalsobereported.Deminimisthresholdsshouldbesettoavoiddisproportionateadministrativeburden,inparticularforsmallandmedium-sizedenterprisesandmicro-enterprises. (21)TheCommissionshouldcontinuouslymonitortheeffectsofreducingthequantitiesofhydrofluorocarbonsplaced onthemarket,includingitseffectsonthesupplyforequipmentwheretheuseofhydrofluorocarbonswouldresult inlowerlife-cycleemissionsthanifanalternativetechnologywasused.TheCommissionshouldproduceareport ontheavailabilityofhydrofluorocarbonsontheUnionmarketbytheendof2020.AcomprehensivereviewEN 20.5.2014Official Journal ofthe European UnionL150/197 ( 1 )Directive2009/125/ECoftheEuropeanParliamentandoftheCouncilof21October2009establishingaframeworkforthesetting ofecodesignrequirementsforenergy-relatedproducts(OJL285,31.10.2009,p.10).shouldbecarriedoutbytheCommissionbytheendof2022intimetoadapttheprovisionsofthisRegulation,in thelightofitsimplementationandofnewdevelopmentsandinternationalcommitments,andtopropose,if appropriate,furtherreductionmeasures. (22)InordertoensureuniformconditionsfortheimplementationofthisRegulation,implementingpowersshouldbe conferredontheCommission.ThosepowersshouldbeexercisedinaccordancewithRegulation(EU)No 182/2011oftheEuropeanParliamentandoftheCouncil ( 1 ). (23)Inordertoamendcertainnon-essentialelementsofthisRegulation,thepowertoadoptactsinaccordancewith Article290oftheTreatyontheFunctioningoftheEuropeanUnion(TFEU)shouldbedelegatedtothe Commission.ItisofparticularimportancethattheCommissioncarryoutappropriateconsultationsduringits preparatorywork,includingatexpertlevel.TheCommission,whenpreparinganddrawingupdelegatedacts, shouldensureasimultaneous,timelyandappropriatetransmissionofrelevantdocumentstotheEuropean ParliamentandtotheCouncil. (24)SinceitisadoptedpursuanttoArticle192(1)TFEU,thisRegulationdoesnotpreventMemberStatesfrom maintainingorintroducingmorestringentprotectivemeasuresthatarecompatiblewiththeTFEU.Pursuantto Article193TFEU,MemberStatesaretonotifytheCommissionofanysuchmeasures. (25)ThisRegulationamendsandcomplementsthesubjectmatterofRegulation(EC)No842/2006,whichshould thereforeberepealed.However,inordertoensureasmoothtransitionfromtheoldregimetothenewregime,itis appropriatetoprovidethatCommissionRegulations(EC)No1493/2007( 2 ),(EC)No1494/2007( 3 ),(EC)No 1497/2007( 4 ),(EC)No1516/2007( 5 ),(EC)No303/2008( 6 ),(EC)No304/2008( 7 ),(EC)No305/2008( 8 ),(EC) No306/2008( 9 ),(EC)No307/2008( 10 )and(EC)No308/2008( 11 )shouldremaininforceandcontinuetoapply unlessanduntilrepealedbydelegatedorimplementingactsadoptedbytheCommissionpursuanttothis Regulation. Accordingly,thisRegulation: (a)establishesrulesoncontainment,use,recoveryanddestructionoffluorinatedgreenhousegases,andonrelated ancillarymeasures; (b)imposesconditionsontheplacingonthemarketofspecificproductsandequipmentthatcontain,orwhose functioningreliesupon,fluorinatedgreenhousegases; (c)imposesconditionsonspecificusesoffluorinatedgreenhousegases;and (d)establishesquantitativelimitsfortheplacingonthemarketofhydrofluorocarbons. Article2 Definitions ForthepurposesofthisRegulationthefollowingdefinitionsapply: (1)fluorinatedgreenhousegasesmeansthehydrofluorocarbons,perfluorocarbons,sulphurhexafluorideandother greenhousegasesthatcontainfluorine,listedinAnnexI,ormixturescontaininganyofthosesubstances; (2)hydrofluorocarbonsorHFCsmeansthesubstanceslistedinsection1ofAnnexI,ormixturescontaininganyof thosesubstances; (3)perfluorocarbonsorPFCsmeansthesubstanceslistedinsection2ofAnnexI,ormixturescontaininganyofthose substances; (4)sulphurhexafluorideorSF6meansthesubstancelistedinsection3ofAnnexI,ormixturescontainingthat substance; (5)mixturemeansafluidcomposedoftwoormoresubstances,atleastoneofwhichisasubstancelistedinAnnexI orinAnnexII; (6)globalwarmingpotentialorGWPmeanstheclimaticwarmingpotentialofagreenhousegasrelativetothatof carbondioxide(CO 2 ),calculatedintermsofthe100-yearwarmingpotentialofonekilogramofagreenhousegas relativetoonekilogramofCO 2 ,assetoutinAnnexesI,IIandIVorinthecaseofmixtures,calculatedin accordancewithAnnexIV; (7)tonne(s)ofCO 2 equivalentmeansaquantityofgreenhousegasesexpressedastheproductoftheweightofthe greenhousegasesinmetrictonnesandoftheirglobalwarmingpotential; (8)operatormeansthenaturalorlegalpersonexercisingactualpoweroverthetechnicalfunctioningofproductsand equipmentcoveredbythisRegulation;aMemberStatemay,indefined,specificsituations,designatetheowneras beingresponsiblefortheoperatorsobligations; (9)usemeanstheutilisationoffluorinatedgreenhousegasesintheproduction,maintenanceorservicing,includingthe refilling,ofproductsandequipment,orinotherprocessesreferredtointhisRegulation; (10)placingonthemarketmeanssupplyingormakingavailabletoanotherpartyintheUnionforthefirsttime,for paymentorfreeofcharge,orusingforitsownaccountinthecaseofaproducer,andincludescustomsreleasefor freecirculationintheUnion; (11)hermeticallysealedequipmentmeansequipmentinwhichallfluorinatedgreenhousegascontainingpartsaremade tightbywelding,brazingorasimilarpermanentconnection,whichmayincludecappedvalvesorcappedservice portsthatallowproperrepairordisposal,andwhichhaveatestedleakagerateoflessthan3 gramsperyearunder apressureofatleastaquarterofthemaximumallowablepressure;EN 20.5.2014Official Journal ofthe European UnionL150/199(12)containermeansaproductwhichisdesignedprimarilyfortransportingorstoringfluorinatedgreenhousegases; (13)anon-refillablecontainermeansacontainerwhichcannotberefilledwithoutbeingadaptedforthatpurposeoris placedonthemarketwithoutprovisionhavingbeenmadeforitsreturnforrefilling; (14)recoverymeansthecollectionandstorageoffluorinatedgreenhousegasesfromproducts,includingcontainers,and equipmentduringmaintenanceorservicingorpriortothedisposaloftheproductsorequipment; (15)recyclingmeansthereuseofarecoveredfluorinatedgreenhousegasfollowingabasiccleaningprocess; (16)reclamationmeansthereprocessingofarecoveredfluorinatedgreenhousegasinordertomatchtheequivalent performanceofavirginsubstance,takingintoaccountitsintendeduse; (17)destructionmeanstheprocessofpermanentlytransformingordecomposingallormostofafluorinated greenhousegasintooneormorestablesubstancesthatarenotfluorinatedgreenhousegases; (18)decommissioningmeansthefinalshut-downandremovalfromoperationorusageofaproductorpieceof equipmentcontainingfluorinatedgreenhousegases; (19)repairmeanstherestorationofdamagedorleakingproductsorequipmentthatcontain,orwhosefunctioning reliesupon,fluorinatedgreenhousegases,involvingapartcontainingordesignedtocontainsuchgases; (20)installationmeansjoiningtwoormorepiecesofequipmentorcircuitscontainingordesignedtocontainfluorinatedgreenhousegases,withaviewtoassemblingasysteminthelocationwhereitwillbeoperated,thatentails joiningtogethergascarryingconductorsofasystemtocompleteacircuitirrespectiveoftheneedtochargethe systemafterassembly; (21)maintenanceorservicingmeansallactivities,excludingrecoveryinaccordancewithArticle8andleakchecksin accordancewithArticle4andpoint(b)ofArticle10(1)ofthisRegulation,thatentailbreakingintothecircuits containingordesignedtocontainfluorinatedgreenhousegases,inparticularsupplyingthesystemwithfluorinated greenhousegases,removingoneormorepiecesofcircuitorequipment,reassemblingtwoormorepiecesofcircuit orequipment,aswellasrepairingleaks; (22)virginsubstancemeansasubstancewhichhasnotpreviouslybeenused; (23)stationarymeansnotnormallyintransitduringoperationandincludesmoveableroomair-conditioningappliances; (24)mobilemeansnormallyintransitduringoperation; (25)one-componentfoammeansafoamcompositioncontainedinasingleaerosoldispenserinunreactedorpartly reactedliquidstateandthatexpandsandhardenswhenitleavesthedispenser; (26)refrigeratedtruckmeansamotorvehiclewithamassofmorethan3,5tonnesthatisdesignedandconstructed primarilytocarrygoodsandthatisequippedwitharefrigerationunit; (27)refrigeratedtrailermeansavehiclethatisdesignedandconstructedtobetowedbyatruckoratractor,primarilyto carrygoodsandthatisequippedwitharefrigerationunit; (28)technicalaerosolmeansanaerosoldispenserusedinmaintaining,repairing,cleaning,testing,disinsectingand manufacturingproductsandequipment,installingequipment,andinotherapplications; (29)leakagedetectionsystemmeansacalibratedmechanical,electricalorelectronicdevicefordetectingleakageof fluorinatedgreenhousegaseswhich,ondetection,alertstheoperator; (30)undertakingmeansanynaturalorlegalpersonwho: (a)produces,uses,recovers,collects,recycles,reclaims,ordestroysfluorinatedgreenhousegases; (b)importsorexportsfluorinatedgreenhousegasesorproductsandequipmentthatcontainsuchgases; (c)placesonthemarketfluorinatedgreenhousegasesorproductsandequipmentthatcontain,orwhosefunctioningreliesupon,suchgases; (d)installs,services,maintains,repairs,checksforleaksordecommissionsequipmentthatcontains,orwhose functioningreliesupon,fluorinatedgreenhousegases;EN L150/200Official Journal ofthe European Union20.5.2014(e)istheoperatorofequipmentthatcontains,orwhosefunctioningreliesupon,fluorinatedgreenhousegases; (f)produces,imports,exports,placesonthemarketordestroysgaseslistedinAnnexII; (g)placesonthemarketproductsorequipmentcontaininggaseslistedinAnnexII; (31)feedstockmeansanyfluorinatedgreenhousegas,orsubstancelistedinAnnexII,thatundergoeschemicaltransformationinaprocessinwhichitisentirelyconvertedfromitsoriginalcompositionanditsemissionsare insignificant; (32)commercialusemeansusedforthestorage,displayordispensingofproducts,forsaletoendusers,inretailand foodservices; (33)fireprotectionequipmentmeanstheequipmentandsystemsutilisedinfirepreventionorsuppressionapplications andincludesfireextinguishers; (34)organicRankinecyclemeansacyclecontainingcondensablefluorinatedgreenhousegasconvertingheatfroma heatsourceintopowerforthegenerationofelectricormechanicalenergy; (35)militaryequipmentmeanarms,munitionsandwarmaterialintendedspecificallyformilitarypurposeswhichare necessaryfortheprotectionoftheessentialinterestsofthesecurityofMemberStates; (36)electricalswitchgearmeansswitchingdevicesandtheircombinationwithassociatedcontrol,measuring,protective andregulatingequipment,andassembliesofsuchdevicesandequipmentwithassociatedinterconnections,accessories,enclosuresandsupportingstructures,intendedforusageinconnectionwiththegeneration,transmission, distributionandconversionofelectricenergy; (37)multipackcentralisedrefrigerationsystemsmeanssystemswithtwoormorecompressorsoperatedinparallel, whichareconnectedtooneormorecommoncondensersandtoanumberofcoolingdevicessuchasdisplaycases, cabinets,freezersortochilledstorerooms; (38)primaryrefrigerantcircuitofcascadesystemsmeanstheprimarycircuitinindirectmediumtemperaturesystems whereacombinationoftwoormoreseparaterefrigerationcircuitsareconnectedinseriessuchthattheprimary circuitabsorbsthecondenserheatfromasecondarycircuitforthemediumtemperature; (39)singlesplitairconditioningsystemsmeanssystemsforroomairconditioningthatconsistofoneoutdoorunitand oneindoorunitlinkedbyrefrigerantpiping,needinginstallationatthesiteofusage. CHAPTERII CONTAINMENT Article3 Preventionofemissionsoffluorinatedgreenhousegases 1.Theintentionalreleaseoffluorinatedgreenhousegasesintotheatmosphereshallbeprohibitedwherethereleaseis nottechnicallynecessaryfortheintendeduse. 2.Operatorsofequipmentthatcontainsfluorinatedgreenhousegasesshalltakeprecautionstopreventtheunintentionalrelease(leakage)ofthosegases.Theyshalltakeallmeasureswhicharetechnicallyandeconomicallyfeasibleto minimiseleakageoffluorinatedgreenhousegases. 3.Wherealeakageoffluorinatedgreenhousegasesisdetected,theoperatorsshallensurethattheequipmentis repairedwithoutunduedelay. WheretheequipmentissubjecttoleakchecksunderArticle4(1),andaleakintheequipmenthasbeenrepaired,the operatorsshallensurethattheequipmentischeckedbyacertifiednaturalpersonwithinonemonthaftertherepairto verifythattherepairhasbeeneffective. 4.Naturalpersonscarryingoutthetasksreferredtoinpoints(a)to(c)ofArticle10(1)shallbecertifiedinaccordance withArticle10(4)and(7)andshalltakeprecautionarymeasurestopreventleakageoffluorinatedgreenhousegases. Undertakingscarryingouttheinstallation,servicing,maintenance,repairordecommissioningoftheequipmentlistedin points(a)to(d)oftheArticle4(2)shallbecertifiedinaccordancewithArticle10(6)and(7)andshalltakeprecautionary measurestopreventleakageoffluorinatedgreenhousegases.EN 20.5.2014Official Journal ofthe European UnionL150/201Article4 Leakchecks 1.Operatorsofequipmentthatcontainsfluorinatedgreenhousegasesinquantitiesof5tonnesofCO 2 equivalentor moreandnotcontainedinfoamsshallensurethattheequipmentischeckedforleaks. Hermeticallysealedequipmentthatcontainsfluorinatedgreenhousegasesinquantitiesoflessthan10tonnesofCO 2 equivalent,shallnotbesubjecttoleakchecksunderthisArticle,providedtheequipmentislabelledashermeticallysealed. ElectricalswitchgearshallnotbesubjecttoleakchecksunderthisArticleprovideditcomplieswithoneofthefollowing conditions: (a)ithasatestedleakagerateoflessthan0,1 %peryearassetoutinthetechnicalspecificationofthemanufacturerand islabelledaccordingly; (b)itisequippedwithapressureordensitymonitoringdevice;or (c)itcontainslessthan6 kgoffluorinatedgreenhousegases. 2.Paragraph1appliestooperatorsofthefollowingequipmentthatcontainsfluorinatedgreenhousegases: (a)stationaryrefrigerationequipment; (b)stationaryair-conditioningequipment; (c)stationaryheatpumps; (d)stationaryfireprotectionequipment; (e)refrigerationunitsofrefrigeratedtrucksandtrailers; (f)electricalswitchgear; (g)organicRankinecycles. Asregardstheequipmentreferredtoinpoints(a)to(e)ofthefirstsubparagraph,thechecksshallbecarriedoutby naturalpersonscertifiedinaccordancewiththerulesprovidedforinArticle10. Bywayofderogationfromthefirstsubparagraphofparagraph1,until31December2016,equipmentthatcontainsless than3 kgoffluorinatedgreenhousegasesorhermeticallysealedequipment,whichislabelledaccordinglyandcontains lessthan6 kgoffluorinatedgreenhousegasesshallnotbesubjecttoleakchecks. 3.Theleakcheckspursuanttoparagraph1shallbecarriedoutwiththefollowingfrequency: (a)forequipmentthatcontainsfluorinatedgreenhousegasesinquantitiesof5tonnesofCO 2 equivalentormore,butof lessthan50tonnesofCO 2 equivalent:atleastevery12months;orwherealeakagedetectionsystemisinstalled,at leastevery24months; (b)forequipmentthatcontainsfluorinatedgreenhousegasesinquantitiesof50tonnesofCO 2 equivalentormore,but oflessthan500tonnesofCO 2 equivalent:atleasteverysixmonthsor,wherealeakagedetectionsystemisinstalled, atleastevery12months; (c)forequipmentthatcontainsfluorinatedgreenhousegasesinquantitiesof500tonnesofCO 2 equivalentormore:at leasteverythreemonthsor,wherealeakagedetectionsystemisinstalled,atleasteverysixmonths.EN L150/202Official Journal ofthe European Union20.5.20144.Obligationsofparagraph1forfireprotectionequipmentasreferredtoinpoint(d)ofparagraph2shallbe consideredtobefulfilledprovidedthefollowingtwoconditionsaremet: (a)theexistinginspectionregimemeetsISO14520orEN15004standards;and (b)thefireprotectionequipmentisinspectedasoftenasisrequiredunderparagraph3. 5.TheCommissionmay,bymeansofimplementingacts,specifyrequirementsfortheleakcheckstobecarriedoutin accordancewithparagraph1ofthisArticleforeachtypeofequipmentreferredtointhatparagraph,identifythoseparts oftheequipmentmostlikelytoleakandrepealactsadoptedpursuanttoArticle3(7)ofRegulation(EC)No842/2006. ThoseimplementingactsshallbeadoptedinaccordancewiththeexaminationprocedurereferredtoinArticle24. Article5 Leakagedetectionsystems 1.Operatorsoftheequipmentlistedinpoints(a)to(d)ofArticle4(2)andcontainingfluorinatedgreenhousegasesin quantitiesof500tonnesofCO 2 equivalentormore,shallensurethattheequipmentisprovidedwithaleakagedetection systemwhichalertstheoperatororaservicecompanyofanyleakage. 2.Operatorsoftheequipmentlistedinpoints(f)and(g)ofArticle4(2)andcontainingfluorinatedgreenhousegasesin quantitiesof500tonnesofCO 2 equivalentormoreandinstalledfrom1January2017,shallensurethatthisequipment isprovidedwithaleakagedetectionsystemwhichalertstheoperatororaservicecompanyofanyleakage. 3.Operatorsoftheequipmentlistedinpoints(a)to(d)and(g)ofArticle4(2)thatissubjecttoparagraph1or2of thisArticleshallensurethatleakagedetectionsystemsarecheckedatleastonceevery12monthstoensuretheirproper functioning. 4.Operatorsoftheequipmentlistedinpoint(f)ofArticle4(2)thatissubjecttoparagraph2ofthisArticleshall ensurethatleakagedetectionsystemsarecheckedatleastonceevery6yearstoensuretheirproperfunctioning. Article6 Recordkeeping 1.OperatorsofequipmentwhichisrequiredtobecheckedforleakspursuanttoArticle4(1),shallestablishand maintainrecordsforeachpieceofsuchequipmentspecifyingthefollowinginformation: (a)thequantityandtypeoffluorinatedgreenhousegasesinstalled; (b)thequantitiesoffluorinatedgreenhousegasesaddedduringinstallation,maintenanceorservicingorduetoleakage; (c)whetherthequantitiesofinstalledfluorinatedgreenhousegaseshavebeenrecycledorreclaimed,includingthename andaddressoftherecyclingorreclamationfacilityand,whereapplicable,thecertificatenumber; (d)thequantityoffluorinatedgreenhousegasesrecovered; (e)theidentityoftheundertakingwhichinstalled,serviced,maintainedandwhereapplicablerepairedordecommissionedtheequipment,including,whereapplicable,thenumberofitscertificate; (f)thedatesandresultsofthecheckscarriedoutunderArticle4(1)to(3); (g)iftheequipmentwasdecommissioned,themeasurestakentorecoveranddisposeofthefluorinatedgreenhouse gases. 2.Unlesstherecordsreferredtoinparagraph1arestoredinadatabasesetupbythecompetentauthoritiesofthe MemberStatesthefollowingrulesapply:EN 20.5.2014Official Journal ofthe European UnionL150/203(a)theoperatorsreferredtoinparagraph1shallkeeptherecordsreferredtointhatparagraphforatleastfiveyears; (b)undertakingscarryingouttheactivitiesreferredtoinpoint(e)ofparagraph1foroperatorsshallkeepcopiesofthe recordsreferredtoinparagraph1foratleastfiveyears. Therecordsreferredtoinparagraph1shallbemadeavailable,onrequest,tothecompetentauthorityoftheMember StateconcernedortotheCommission.Totheextentthatsuchrecordscontainenvironmentalinformation,Directive 2003/4/ECoftheEuropeanParliamentandoftheCouncil ( 1 )orRegulation(EC)No1367/2006oftheEuropean ParliamentandoftheCouncil ( 2 )shallapplyasappropriate. 3.ForthepurposeofArticle11(4),undertakingssupplyingfluorinatedgreenhousegasesshallestablishrecordsof relevantinformationonthepurchasersoffluorinatedgreenhousegasesincludingthefollowingdetails: (a)thenumbersofcertificatesofthepurchasers;and (b)therespectivequantitiesoffluorinatedgreenhousegasespurchased. Theundertakingssupplyingfluorinatedgreenhousegasesshallmaintainthoserecordsforatleastfiveyears. Theundertakingssupplyingfluorinatedgreenhousegasesshallmakesuchrecordsavailable,onrequest,tothecompetent authorityoftheMemberStateconcernedortotheCommission.Totheextentthattherecordscontainenvironmental information,Directive2003/4/ECorRegulation(EC)No1367/2006shallapplyasappropriate. 4.TheCommissionmay,bymeansofanimplementingact,determinetheformatoftherecordsreferredtoin paragraphs1and3ofthisArticleandspecifyhowtheyshouldbeestablishedandmaintained.Thatimplementing actshallbeadoptedinaccordancewiththeexaminationprocedurereferredtoinArticle24. Article7 Emissionsoffluorinatedgreenhousegasesinrelationtoproduction 1.Producersoffluorinatedcompoundsshalltakeallnecessaryprecautionstolimitemissionsoffluorinated greenhousegasestothegreatestextentpossibleduring: (a)production; (b)transport;and (c)storage. ThisArticlealsoapplieswherefluorinatedgreenhousegasesareproducedasby-products. 2.WithoutprejudicetoArticle11(1),theplacingonthemarketoffluorinatedgreenhousegasesandgaseslistedin AnnexIIshallbeprohibitedunless,whererelevant,producersorimportersprovideevidence,atthetimeofsuchplacing, thattrifluoromethane,producedasaby-productduringthemanufacturingprocess,includingduringthemanufacturingof feedstocksfortheirproduction,hasbeendestroyedorrecoveredforsubsequentuse,inlinewithbestavailabletechniques. Thisrequirementshallapplyfrom11June2015. Article8 Recovery 1.Operatorsofstationaryequipmentorofrefrigerationunitsofrefrigeratedtrucksandtrailersthatcontainfluorinated greenhousegasesnotcontainedinfoamsshallensurethattherecoveryofthosegasesiscarriedoutbynaturalpersons thatholdtherelevantcertificatesprovidedforbyArticle10,sothatthosegasesarerecycled,reclaimedordestroyed. Thisobligationappliestooperatorsofanyofthefollowingequipment: (a)thecoolingcircuitsofstationaryrefrigeration,stationaryair-conditioningandstationaryheatpumpequipment; (b)thecoolingcircuitsofrefrigerationunitsofrefrigeratedtrucksandtrailers;EN L150/204Official Journal ofthe European Union20.5.2014 ( 1 )Directive2003/4/ECoftheEuropeanParliamentandoftheCouncilof28January2003onpublicaccesstoenvironmental informationandrepealingCouncilDirective90/313/EEC(OJL41,14.2.2003,p.26). ( 2 )Regulation(EC)No1367/2006oftheEuropeanParliamentandoftheCouncilof6September2006ontheapplicationofthe provisionsoftheAarhusConventiononAccesstoInformation,PublicParticipationinDecision-makingandAccesstoJusticein EnvironmentalMatterstoCommunityinstitutionsandbodies(OJL264,25.9.2006,p.13).(c)stationaryequipmentthatcontainsfluorinatedgreenhousegas-basedsolvents; (d)stationaryfireprotectionequipment; (e)stationaryelectricalswitchgear. 2.Theundertakingthatusesafluorinatedgreenhousegascontainerimmediatelypriortoitsdisposalshallarrangefor therecoveryofanyresidualgasestomakesuretheyarerecycled,reclaimedordestroyed. 3.Operatorsofproductsandequipmentnotlistedinparagraph1,includingmobileequipment,thatcontainfluorinatedgreenhousegasesshallarrangefortherecoveryofthegases,totheextentthatitistechnicallyfeasibleanddoes notentaildisproportionatecosts,byappropriatelyqualifiednaturalpersons,sothattheyarerecycled,reclaimedor destroyedorshallarrangefortheirdestructionwithoutpriorrecovery. Therecoveryoffluorinatedgreenhousegasesfromair-conditioningequipmentinroadvehiclesoutsidethescopeof Directive2006/40/ECoftheEuropeanParliamentandoftheCouncil ( 1 )shallbecarriedoutbyappropriatelyqualified naturalpersons. Fortherecoveryoffluorinatedgreenhousegasesfromair-conditioningequipmentinmotorvehiclesfallingwithinthe scopeofDirective2006/40/EConlynaturalpersonsholdingatleastatrainingattestationinaccordancewithArticle10(2) shallbeconsideredappropriatelyqualified. Article9 Producerresponsibilityschemes WithoutprejudicetoexistingUnionlegislation,MemberStatesshallencouragethedevelopmentofproducerresponsibilityschemesfortherecoveryoffluorinatedgreenhousegasesandtheirrecycling,reclamationordestruction. MemberStatesshallprovideinformationtotheCommissionontheactionsundertakenunderthefirstparagraph. Article10 Trainingandcertification 1.MemberStatesshall,onthebasisoftheminimumrequirementsreferredtoinparagraph5,establishoradapt certificationprogrammes,includingevaluationprocesses.MemberStatesshallensurethattrainingisavailablefornatural personscarryingoutthefollowingtasks: (a)installation,servicing,maintenance,repairordecommissioningoftheequipmentlistedinthepoints(a)to(f)of Article4(2); (b)leakchecksoftheequipmentreferredtoinpoints(a)to(e)ofArticle4(2),asprovidedforinArticle4(1); (c)recoveryoffluorinatedgreenhousegasesasprovidedforinArticle8(1). 2.MemberStatesshallensurethattrainingprogrammesfornaturalpersonsrecoveringfluorinatedgreenhousegases fromair-conditioningequipmentinmotorvehiclesfallingwithinthescopeofDirective2006/40/ECareavailable,onthe basisoftheminimumrequirementsreferredtoinparagraph5. 3.Thecertificationprogrammesandtrainingprovidedforinparagraphs1and2shallcoverthefollowing: (a)applicableregulationsandtechnicalstandards; (b)emissionprevention; (c)recoveryoffluorinatedgreenhousegases; (d)safehandlingofequipmentofthetypeandsizecoveredbythecertificate;EN 20.5.2014Official Journal ofthe European UnionL150/205 ( 1 )Directive2006/40/ECoftheEuropeanParliamentandoftheCouncilof17May2006relatingtoemissionsfromairconditioning systemsinmotorvehiclesandamendingCouncilDirective70/156/EEC(OJL161,14.6.2006,p.12).(e)informationonrelevanttechnologiestoreplaceortoreducetheuseoffluorinatedgreenhousegasesandtheirsafe handling. 4.Certificatesunderthecertificationprogrammesprovidedforinparagraph1shallbesubjecttotheconditionthat theapplicanthassuccessfullycompletedanevaluationprocessestablishedinaccordancewithparagraphs1,3and5. 5.TheminimumrequirementsforcertificationprogrammesarethoselaiddowninRegulations(EC)No303/2008to (EC)No306/2008andunderparagraph12.Theminimumrequirementsfortrainingattestationsarethoselaiddownin Regulation(EC)No307/2008andunderparagraph12.Thoseminimumrequirementsshallspecify,foreachtypeof equipmentreferredtoinparagraphs1and2,therequiredpracticalskillsandtheoreticalknowledge,whereappropriate, differentiatingbetweendifferentactivitiestobecovered,aswellastheconditionsformutualrecognitionofcertificates andtrainingattestations. 6.MemberStatesshallestablishoradaptcertificationprogrammesonthebasisoftheminimumrequirementsreferred toinparagraph5forundertakingscarryingoutinstallation,servicing,maintenance,repairordecommissioningofthe equipmentlistedinpoints(a)to(d)ofArticle4(2)forotherparties. 7.ExistingcertificatesandtrainingattestationsissuedinaccordancewithRegulation(EC)No842/2006shallremain valid,inaccordancewiththeconditionsunderwhichtheywereoriginallyissued. 8.MemberStatesshallensurethatallnaturalpersonsholdingcertificatesundercertificationprogrammesprovidedfor inparagraphs1and7haveaccesstoinformationregardingeachofthefollowing: (a)technologiesreferredtopoint(e)ofparagraph3;and (b)existingregulatoryrequirementsforworkingwithequipmentcontainingalternativerefrigerantstofluorinated greenhousegases. 9.MemberStatesshallensuretheavailabilityoftrainingfornaturalpersonswhowishtoupdatetheirknowledgein relationtothemattersreferredtoinparagraph3. 10.By1January2017MemberStatesshallnotifytheCommissionofcertificationandtrainingprogrammes. MemberStatesshallrecognisecertificatesandtrainingattestationsissuedinanotherMemberStateinaccordancewiththis Article.Theyshallnotrestrictthefreedomtoprovideservicesorthefreedomofestablishmentbecauseacertificatewas issuedinanotherMemberState. 11.Anyundertakingwhichassignsataskreferredtoinparagraph1toanotherundertakingshalltakereasonablesteps toascertainthatthelatterholdsthenecessarycertificatesfortherequiredtaskspursuanttothisArticle. 12.IntheeventthatitappearsnecessaryforthepurposesoftheapplicationofthisArticle,toprovideforamore harmonisedapproachtotrainingandcertification,theCommissionshall,bymeansofimplementingacts,adaptand updatetheminimumrequirementsastotheskillsandknowledgetobecovered,specifythemodalitiesofthecertification orattestationandtheconditionsformutualrecognitionandrepealactsadoptedpursuanttoArticle5(1)ofRegulation (EC)No842/2006.Thoseimplementingactsshallbeadoptedinaccordancewiththeexaminationprocedurereferredto inArticle24.Whenexercisingthepowerconferredonitbythisparagraph,theCommissionshalltakeintoaccount relevantexistingqualificationorcertificationschemes. 13.TheCommissionmay,bymeansofimplementingacts,determinetheformatofthenotificationreferredtoin paragraph10ofthisArticleandmayrepealactsadoptedpursuanttoArticle5(5)ofRegulation(EC)No842/2006. ThoseimplementingactsshallbeadoptedinaccordancewiththeexaminationprocedurereferredtoinArticle24. 14.WheretheobligationsunderthisArticlerelatingtotheprovisionofcertificationandtrainingwouldimpose disproportionateburdensonaMemberStatebecauseofthesmallsizeofitspopulationandtheconsequentlackof demandforsuchtrainingandcertification,compliancemaybeachievedthroughtherecognitionofcertificatesissuedin otherMemberStates. CHAPTERIII PLACINGONTHEMARKETANDCONTROLOFUSE Article11 Restrictionsontheplacingonthemarket 1.TheplacingonthemarketofproductsandequipmentlistedinAnnexIII,withanexemptionformilitary equipment,shallbeprohibitedfromthedatespecifiedinthatAnnex,differentiating,whereapplicable,accordingto thetypeorglobalwarmingpotentialofthefluorinatedgreenhousegascontained. 2.Theprohibitionsetoutinparagraph1shallnotapplytoequipmentforwhichithasbeenestablishedinecodesign requirementsadoptedunderDirective2009/125/ECthatduetohigherenergyefficiencyduringitsoperation,itslifecycle CO 2 equivalentemissionswouldbelowerthanthoseofequivalentequipmentwhichmeetsrelevantecodesign requirementsanddoesnotcontainhydrofluorocarbons. 3.FollowingasubstantiatedrequestbyacompetentauthorityofaMemberStateandtakingintoaccountthe objectivesofthisRegulation,theCommissionmay,exceptionally,bymeansofimplementingacts,authorisean exemptionforuptofouryearstoallowtheplacingonthemarketofproductsandequipmentlistedinAnnexIII containing,orwhosefunctioningreliesupon,fluorinatedgreenhousegases,whereitisdemonstratedthat: (a)foraspecificproductorapieceofequipment,orforaspecificcategoryofproductsorequipment,alternativesare notavailable,orcannotbeusedfortechnicalorsafetyreasons;or (b)theuseoftechnicallyfeasibleandsafealternativeswouldentaildisproportionatecosts. ThoseimplementingactsshallbeadoptedinaccordancewiththeexaminationprocedurereferredtoinArticle24. 4.Forthepurposesofcarryingouttheinstallation,servicing,maintenanceorrepairoftheequipmentthatcontains fluorinatedgreenhousegasesorwhosefunctioningreliesuponthosegasesforwhichcertificationorattestationis requiredunderArticle10,fluorinatedgreenhousegasesshallonlybesoldtoandpurchasedbyundertakingsthat holdtherelevantcertificatesorattestationsinaccordancewithArticle10orundertakingsthatemploypersons holdingacertificateoratrainingattestationinaccordancewithArticle10(2)and(5).Thisparagraphshallnot preventnon-certifiedundertakings,whodonotcarryouttheactivitiesreferredtointhefirstsentenceofthisparagraph, fromcollecting,transportingordeliveringfluorinatedgreenhousegases. 5.Non-hermeticallysealedequipmentchargedwithfluorinatedgreenhousegasesshallonlybesoldtotheenduser whereevidenceisprovidedthattheinstallationistobecarriedoutbyanundertakingcertifiedinaccordancewith Article10. 6.TheCommissionshallcollect,onthebasisofavailabledatafromMemberStates,informationonnationalcodes, standardsorlegislationofMemberStateswithrespecttoreplacementtechnologiesusingalternativestofluorinated greenhousegasesinrefrigeration,air-conditioningandheatpumpequipmentandinfoams. TheCommissionshallpublishasynthesisreportontheinformationcollectedunderthefirstsubparagraphby1January 2017. Article12 Labellingandproductandequipmentinformation 1.Productsandequipmentthatcontain,orwhosefunctioningreliesupon,fluorinatedgreenhousegasesshallnotbe placedonthemarketunlesstheyarelabelled.Thisonlyappliesto: (a)refrigerationequipment; (b)air-conditioningequipment;EN 20.5.2014Official Journal ofthe European UnionL150/207(c)heatpumps; (d)fireprotectionequipment; (e)electricalswitchgear; (f)aerosoldispenserthatcontainfluorinatedgreenhousegases,withtheexceptionofmetereddoseinhalersforthe deliveryofpharmaceuticalingredients; (g)allfluorinatedgreenhousegascontainers; (h)fluorinatedgreenhousegas-basedsolvents; (i)organicRankinecycles. 2.ProductsorequipmentsubjecttoanexemptionunderArticle11(3)shallbelabelledaccordinglyandshallincludea referencethatthoseproductsorequipmentmayonlybeusedforthepurposeforwhichanexemptionunderthatArticle wasgranted. 3.Thelabelrequiredpursuanttoparagraph1shallindicatethefollowinginformation: (a)areferencethattheproductorequipmentcontainsfluorinatedgreenhousegasesorthatitsfunctioningreliesupon suchgases; (b)theacceptedindustrydesignationforthefluorinatedgreenhousegasesconcernedor,ifnosuchdesignationis available,thechemicalname; (c)from1January2017,thequantityexpressedinweightandinCO 2 equivalentoffluorinatedgreenhousegases containedintheproductorequipment,orthequantityoffluorinatedgreenhousegasesforwhichtheequipment isdesigned,andtheglobalwarmingpotentialofthosegases. Thelabelrequiredpursuanttoparagraph1shallindicatethefollowinginformation,whereapplicable: (a)areferencethatthefluorinatedgreenhousegasesarecontainedinhermeticallysealedequipment; (b)areferencethattheelectricalswitchgearhasatestedleakagerateoflessthan0,1 %peryearassetoutinthetechnical specificationofthemanufacturer. 4.Thelabelshallbeclearlyreadableandindelibleandshallbeplacedeither: (a)adjacenttotheserviceportsforchargingorrecoveringthefluorinatedgreenhousegas;or (b)onthatpartoftheproductorequipmentthatcontainsthefluorinatedgreenhousegas. ThelabelshallbeintheofficiallanguagesoftheMemberStateinwhichitistobeplacedonthemarket. 5.Foamsandpre-blendedpolyolsthatcontainfluorinatedgreenhousegasesshallnotbeplacedonthemarketunless thefluorinatedgreenhousegasesareidentifiedwithalabelusingtheacceptedindustrydesignationor,ifnosuch designationisavailable,thechemicalname.Thelabelshallclearlyindicatethatthefoamorpre-blendedpolyol containsfluorinatedgreenhousegases.Inthecaseoffoamboards,thisinformationshallbeclearlyandindelibly statedontheboards. 6.Reclaimedorrecycledfluorinatedgreenhousegasesshallbelabelledwithanindicationthatthesubstancehasbeen reclaimedorrecycled,informationonthebatchnumberandthenameandaddressofthereclamationorrecycling facility. 7.Fluorinatedgreenhousegasesplacedonthemarketfordestructionshallbelabelledwithanindicationthatthe contentsofthecontainermayonlybedestroyed. 8.Fluorinatedgreenhousegasesplacedonthemarketfordirectexportshallbelabelledwithanindicationthatthe contentsofthecontainermayonlybedirectlyexported.EN L150/208Official Journal ofthe European Union20.5.20149.Fluorinatedgreenhousegasesplacedonthemarketfortheuseinmilitaryequipmentshallbelabelledwithan indicationthatthecontentsofthecontainermayonlybeusedforthatpurpose. 10.Fluorinatedgreenhousegasesplacedonthemarketfortheetchingofsemiconductormaterialorthecleaningof chemicalsvapourdepositionchamberswithinthesemiconductormanufacturingsectorshallbelabelledwithanindicationthatthecontentsofthecontainermayonlybeusedforthatpurpose. 11.Fluorinatedgreenhousegasesplacedonthemarketforfeedstockuseshallbelabelledwithanindicationthatthe contentsofthecontainermayonlybeusedasfeedstock. 12.Fluorinatedgreenhousegasesplacedonthemarketforproducingmetereddoseinhalersforthedeliveryof pharmaceuticalingredientsshallbelabelledwithanindicationthatthecontentsofthecontainermayonlybeused forthatpurpose. 13.Theinformationreferredtoinparagraphs3and5shallbeincludedininstructionmanualsfortheproductsand equipmentconcerned. Inthecaseofproductsandequipmentthatcontainfluorinatedgreenhousegaseswithaglobalwarmingpotentialof150 ormorethisinformationshallalsobeincludedindescriptionsusedforadvertising. 14.TheCommissionmay,bymeansofimplementingacts,determinetheformatofthelabelsreferredtoinparagraph 1andparagraphs4to12andmayrepealactsadoptedpursuanttoArticle7(3)ofRegulation(EC)No842/2006.Those implementingactsshallbeadoptedinaccordancewiththeexaminationprocedurereferredtoinArticle24. 15.TheCommissionshallbeempoweredtoadoptdelegatedactsinaccordancewithArticle22amendingthelabelling requirementssetoutinparagraphs4to12whereappropriateinviewofcommercialortechnologicaldevelopment. Article13 Controlofuse 1.Theuseofsulphurhexafluorideinmagnesiumdie-castingandintherecyclingofmagnesiumdie-castingalloysshall beprohibited. Asregardsinstallationsusingaquantityofsulphurhexafluoridebelow850kgperyear,inrespectofmagnesiumdie- castingandintherecyclingofmagnesiumdie-castingalloys,thisprohibitionshallonlyapplyfrom1January2018. 2.Theuseofsulphurhexafluoridetofillvehicletyresshallbeprohibited. 3.From1January2020,theuseoffluorinatedgreenhousegases,withaglobalwarmingpotentialof2 500ormore, toserviceormaintainrefrigerationequipmentwithachargesizeof40tonnesofCO 2 equivalentormore,shallbe prohibited. Thisparagraphshallnotapplytomilitaryequipmentorequipmentintendedforapplicationsdesignedtocoolproductsto temperaturesbelow 50 C. Theprohibitionreferredtointhefirstsubparagraphshallnotapplytothefollowingcategoriesoffluorinatedgreenhouse gasesuntil1January2030: (a)reclaimedfluorinatedgreenhousegaseswithaglobalwarmingpotentialof2 500ormoreusedforthemaintenance orservicingofexistingrefrigerationequipment,providedthattheyhavebeenlabelledinaccordancewith Article12(6); (b)recycledfluorinatedgreenhousegaseswithaglobalwarmingpotentialof2500ormoreusedforthemaintenanceor servicingofexistingrefrigerationequipmentprovidedtheyhavebeenrecoveredfromsuchequipment.Suchrecycled gasesmayonlybeusedbytheundertakingwhichcarriedouttheirrecoveryaspartofmaintenanceorservicingor theundertakingforwhichtherecoverywascarriedoutaspartofmaintenanceorservicing. Theprohibitionreferredtointhefirstsubparagraphshallnotapplytorefrigerationequipmentforwhichanexemption hasbeenauthorisedpursuanttoArticle11(3).EN 20.5.2014Official Journal ofthe European UnionL150/209Article14 Pre-chargingofequipmentwithhydrofluorocarbons 1.From1January2017refrigeration,airconditioningandheatpumpequipmentchargedwithhydrofluorocarbons shallnotbeplacedonthemarketunlesshydrofluorocarbonschargedintotheequipmentareaccountedforwithinthe quotasystemreferredtoinChapterIV. 2.Whenplacingpre-chargedequipmentasreferredtoinparagraph1onthemarket,manufacturersandimportersof equipmentshallensurethatcompliancewithparagraph1isfullydocumentedandshalldrawupadeclarationof conformityinthisrespect. From1January2018,wherehydrofluorocarbonscontainedintheequipmenthavenotbeenplacedonthemarketprior tothechargingoftheequipment,importersofthatequipmentshallensurethatby31Marcheveryyeartheaccuracyof thedocumentationanddeclarationofconformityisverified,fortheprecedingcalendaryear,byanindependentauditor. Theauditorshallbeeither: (a)accreditedpursuanttoDirective2003/87/ECoftheEuropeanParliamentandoftheCouncil ( 1 );or (b)accreditedtoverifyfinancialstatementsinaccordancewiththelegislationoftheMemberStateconcerned. Manufacturersandimportersofequipmentreferredtoinparagraph1shallkeepthedocumentationanddeclarationof conformityforaperiodofatleastfiveyearsaftertheplacingonthemarketofthatequipment.Importersofequipment placingonthemarketpre-chargedequipmentwherehydrofluorocarbonscontainedinthatequipmenthavenotbeen placedonthemarketpriortothechargingoftheequipmentshallensuretheyareregisteredpursuanttopoint(e)of Article17(1). 3.Bydrawingupthedeclarationofconformity,manufacturersandimportersofequipmentreferredtoinparagraph1 shallassumeresponsibilityforcompliancewithparagraphs1and2. 4.TheCommissionshall,bymeansofimplementingacts,determinethedetailedarrangementsrelatingtothe declarationofconformityandtheverificationbytheindependentauditorreferredtointhesecondsubparagraphof paragraph2ofthisArticle.Thoseimplementingactsshallbeadoptedinaccordancewiththeexaminationprocedure referredtoinArticle24. CHAPTERIV REDUCTIONOFTHEQUANTITYOFHYDROFLUOROCARBONSPLACEDONTHEMARKET Article15 Reductionofthequantityofhydrofluorocarbonsplacedonthemarket 1.TheCommissionshallensurethatthequantityofhydrofluorocarbonsthatproducersandimportersareentitledto placeonthemarketintheUnioneachyeardoesnotexceedthemaximumquantityfortheyearinquestioncalculatedin accordancewithAnnexV. ProducersandimportersshallensurethatthequantityofhydrofluorocarbonscalculatedinaccordancewithAnnexVthat thateachofthemplacesonthemarketdoesnotexceedtheirrespectivequotaallocatedpursuanttoArticle16(5)or transferredpursuanttoArticle18. 2.ThisArticleshallnotapplytoproducersorimportersoflessthan100tonnesofCO 2 equivalentofhydrofluorocarbonsperyear. ThisArticleshallalsonotapplytothefollowingcategoriesofhydrofluorocarbons: (a)hydrofluorocarbonsimportedintotheUnionfordestruction; (b)hydrofluorocarbonsusedbyaproducerinfeedstockapplicationsorsupplieddirectlybyaproduceroranimporterto undertakingsforuseinfeedstockapplications; (c)hydrofluorocarbonssupplieddirectlybyaproduceroranimportertoundertakings,forexportoutoftheUnion, wherethosehydrofluorcarbonsarenotsubsequentlymadeavailabletoanyotherpartywithintheUnion,priorto export;EN L150/210Official Journal ofthe European Union20.5.2014 ( 1 )Directive2003/87/ECoftheEuropeanParliamentandoftheCouncilof13October2003establishingaschemeforgreenhousegas emissionallowancetradingwithintheCommunityandamendingCouncilDirective96/61/EC(OJL275,25.10.2003,p.32).(d)hydrofluorocarbonssupplieddirectlybyaproduceroranimporterforuseinmilitaryequipment; (e)hydrofluorocarbonssupplieddirectlybyaproduceroranimportertoanundertakingusingitfortheetchingof semiconductormaterialorthecleaningofchemicalsvapourdepositionchamberswithinthesemiconductormanufacturingsector; (f)from1January2018onwards,hydrofluorocarbonssupplieddirectlybyaproduceroranimportertoanundertaking producingmetereddoseinhalersforthedeliveryofpharmaceuticalingredients. 3.ThisArticleandArticles16,18,19and25shallalsoapplytohydrofluorocarbonscontainedinpre-blended polyols. 4.FollowingasubstantiatedrequestbyacompetentauthorityofaMemberStateandtakingintoaccountthe objectivesofthisRegulation,theCommissionmay,exceptionally,bymeansofimplementingacts,authorisean exemptionforuptofouryearstoexcludefromthequotarequirementlaiddowninparagraph1hydrofluorocarbons foruseinspecificapplications,orspecificcategoriesofproductsorequipment,whereitisdemonstratedthat: (a)forthoseparticularapplications,productsorequipment,alternativesarenotavailable,orcannotbeusedfortechnical orsafetyreasons;and (b)asufficientsupplyofhydrofluorcarbonscannotbeensuredwithoutentailingdisproportionatecosts. ThoseimplementingactsshallbeadoptedinaccordancewiththeexaminationprocedurereferredtoinArticle24. Article16 Allocationofquotasforplacinghydrofluorocarbonsonthemarket 1.By31October2014theCommissionshall,bymeansofimplementingacts,determineforeachproduceror importer,havingreporteddataunderArticle6ofRegulation(EC)No842/2006,areferencevaluebasedontheannual averageofthequantitiesofhydrofluorocarbonstheproducerorimporterreportedtohaveplacedonthemarketfrom 2009to2012.ThereferencevaluesshallbecalculatedinaccordancewithAnnexVtothisRegulation. ThoseimplementingactsshallbeadoptedinaccordancewiththeexaminationprocedurereferredtoinArticle24. 2.ProducersandimportersthathavenotreportedplacingonthemarkethydrofluorocarbonsunderArticle6of Regulation(EC)No842/2006forthereferenceperiodreferredtoinparagraph1maydeclaretheirintentiontoplace hydrofluorocarbonsonthemarketinthefollowingyear. ThedeclarationshallbeaddressedtotheCommission,specifyingthetypesofhydrofluorocarbonsandthequantitiesthat areexpectedtobeplacedonthemarket. TheCommissionshallissueanoticeofthetime-limitforsubmittingthosedeclarations.Beforesubmittingadeclaration pursuanttoparagraphs2and4ofthisArticle,undertakingsshallregisterintheregistryprovidedforinArticle17. 3.By31October2017andeverythreeyearsthereafter,theCommissionshallrecalculatethereferencevaluesforthe producersandimportersreferredtoinparagraphs1and2ofthisArticleonthebasisoftheannualaverageofthe quantitiesofhydrofluorocarbonslawfullyplacedonthemarketfrom1January2015asreportedunderArticle19forthe yearsavailable.TheCommissionshalldeterminethosereferencevaluesbymeansofimplementingacts. ThoseimplementingactsshallbeadoptedinaccordancewiththeexaminationprocedurereferredtoinArticle24. 4.Producersandimportersforwhichreferencevalueshavebeendeterminedmaydeclareadditionalanticipated quantitiesfollowingtheproceduresetoutinparagraph2.EN 20.5.2014Official Journal ofthe European UnionL150/2115.TheCommissionshallallocatequotasforplacinghydrofluorocarbonsonthemarketforeachproducerand importerforeachyearbeginningwiththeyear2015,applyingtheallocationmechanismlaiddowninAnnexVI. QuotasshallonlybeallocatedtoproducersorimporterswhichareestablishedwithintheUnion,orwhichhave mandatedanonlyrepresentativeestablishedwithintheUnionforthepurposeofcompliancewiththerequirements ofthisRegulation.TheonlyrepresentativemaybethesameastheonemandatedpursuanttoArticle8ofRegulation(EC) No1907/2006oftheEuropeanParliamentandoftheCouncil ( 1 ). TheonlyrepresentativeshallcomplywithallobligationsofproducersandimportersunderthisRegulation. Article17 Registry 1.By1January2015,theCommissionshallsetupandensuretheoperationofanelectronicregistryforquotasfor placinghydrofluorocarbonsonthemarket(theregistry). Registrationintheregistryshallbecompulsoryforthefollowing: (a)producersandimporterstowhichaquotafortheplacingonthemarketofhydrofluorocarbonshasbeenallocatedin accordancewithArticle16(5); (b)undertakingstowhichaquotaistransferredinaccordancewithArticle18; (c)producersandimportersdeclaringtheirintentiontosubmitadeclarationpursuanttoArticle16(2); (d)producersandimporterssupplying,orundertakingsinreceiptofhydrofluorocarbonsforthepurposeslistedinpoints (a)to(f)ofthesecondsubparagraphofArticle15(2); (e)importersofequipmentplacingpre-chargedequipmentonthemarketwherethehydrofluorocarbonscontainedinthe equipmenthavenotbeenplacedonthemarketpriortothechargingofthatequipmentinaccordancewith Article14. RegistrationshallbeeffectedbymeansofapplicationtotheCommissioninaccordancewithprocedurestobesetoutby theCommission. 2.TheCommissionmay,totheextentnecessary,bymeansofimplementingacts,ensurethesmoothfunctioningof theregistry.ThoseimplementingactsshallbeadoptedinaccordancewiththeexaminationprocedureinArticle24. 3.TheCommissionshallensurethatregisteredproducersandimportersareinformedviatheregistryaboutthequota allocatedandaboutanychangestoitduringtheallocationperiod. 4.Thecompetentauthorities,includingcustomsauthorities,oftheMemberStatesshallhaveaccess,forinformation purposes,totheregistry. CHAPTERV REPORTING Article19 Reportingonproduction,import,export,feedstockuseanddestructionofthesubstanceslistedin AnnexesIorII 1.By31March2015andeveryyearthereafter,eachproducer,importerandexporterthatproduced,importedor exportedonemetrictonneor100tonnesofCO 2 equivalentormoreoffluorinatedgreenhousegasesandgaseslistedin AnnexIIduringtheprecedingcalendaryearshallreporttotheCommissionthedataspecifiedinAnnexVIIoneachof thosesubstancesforthatcalendaryear.Thisparagraphshallalsoapplytoundertakingsreceivingquotaspursuantto Article18(1). 2.By31March2015andeveryyearthereafter,eachundertakingthatdestroyed1metrictonneor1000tonnesof CO 2 equivalentormoreoffluorinatedgreenhousegasesandgaseslistedinAnnexIIduringtheprecedingcalendaryear shallreporttotheCommissionthedataspecifiedinAnnexVIIoneachofthosesubstancesforthatcalendaryear. 3.By31March2015andeveryyearthereafter,eachundertakingthatused1 000tonnesofCO 2 equivalentormore offluorinatedgreenhousegasesasfeedstockduringtheprecedingcalendaryearshallreporttotheCommissionthedata specifiedinAnnexVIIoneachofthosesubstancesforthatcalendaryear. 4.By31March2015andeveryyearthereafter,eachundertakingthatplaced500tonnesofCO 2 equivalentormore offluorinatedgreenhousegasesandgaseslistedinAnnexIIcontainedinproductsorequipmentonthemarketduring theprecedingcalendaryearshallreporttotheCommissionthedataspecifiedinAnnexVIIoneachofthosesubstances forthatcalendaryear. 5.Eachimporterofequipmentthatplaceonthemarketpre-chargedequipmentwherehydrofluorocarbonscontained inthisequipmenthavenotbeenplacedonthemarketpriortothechargingoftheequipmentshallsubmittothe CommissionaverificationdocumentissuedpursuanttoArticle14(2). 6.By30June2015andeveryyearthereafter,eachundertakingwhichunderparagraph1reportsontheplacingon themarket10 000tonnesofCO 2 equivalentormoreofhydrofluorocarbonsduringtheprecedingcalendaryearshall,in addition,ensurethattheaccuracyofthedataisverifiedbyanindependentauditor.Theauditorshallbeeither: (a)accreditedpursuanttoDirective2003/87/EC;or (b)accreditedtoverifyfinancialstatementsinaccordancewiththelegislationoftheMemberStateconcerned. Theundertakingshallkeeptheverificationreportforatleastfiveyears.Theverificationreportshallbemadeavailable,on request,tothecompetentauthorityoftheMemberStateconcernedandtotheCommission. 7.TheCommissionmay,bymeansofimplementingacts,determinetheformatandmeansofsubmittingthereports referredtointhisArticle. ThoseimplementingactsshallbeadoptedinaccordancewiththeexaminationprocedurereferredtoinArticle24. 8.TheCommissionshalltakeappropriatemeasurestoprotecttheconfidentialityoftheinformationsubmittedtoitin accordancewiththisArticle.EN 20.5.2014Official Journal ofthe European UnionL150/213Article20 Collectionofemissionsdata MemberStatesshallestablishreportingsystemsfortherelevantsectorsreferredtointhisRegulation,withtheobjective ofacquiring,totheextentpossible,emissionsdata. CHAPTERVI FINALPROVISIONS Article21 Review 1.TheCommissionshallbeempoweredtoadoptdelegatedactsinaccordancewithArticle22concerningthe updatingofAnnexesI,IIandIVonthebasisofnewAssessmentReportsadoptedbytheIntergovernmentalPanelon ClimateChangeornewreportsoftheScientificAssessmentPanel(SAP)oftheMontrealProtocolontheglobalwarming potentialofthelistedsubstances. 2.OnthebasisofinformationontheplacingonthemarketofthegaseslistedinAnnexesIandII,reportedin accordancewithArticle19,andonemissionsoffluorinatedgreenhousegasesmadeavailableinaccordancewith Article20andonthebasisofanyrelevantinformationreceivedfromMemberStates,theCommissionshallmonitor theapplicationandeffectsofthisRegulation. Nolaterthan31December2020,theCommissionshallpublishareportontheavailabilityofhydrofluorocarbonsonthe Unionmarket. Nolaterthan31December2022,itshallpublishacomprehensivereportontheeffectsofthisRegulation,includingin particular: (a)aforecastofthecontinueddemandforhydrofluorocarbonsuptoandbeyond2030; (b)anassessmentoftheneedforfurtheractionbytheUnionanditsMemberStatesinlightofexistingandnew internationalcommitmentsregardingthereductionoffluorinatedgreenhousegasemissions; (c)anoverviewofEuropeanandinternationalstandards,nationalsafetylegislationandbuildingcodesinMemberStates inrelationtothetransitiontoalternativerefrigerants; (d)areviewoftheavailabilityoftechnicallyfeasibleandcost-effectivealternativestoproductsandequipmentcontaining fluorinatedgreenhousegasesforproductsandequipmentnotlistedinAnnexIII,takingintoaccountenergy efficiency. 3.Nolaterthan1July2017,theCommissionshallpublishareportassessingtheprohibitionpursuanttopoint13of AnnexIII,consideringinparticular,theavailabilityofcost-effective,technicallyfeasible,energy-efficientandreliable alternativestomultipackcentralisedrefrigerationsystemsreferredtointhatprovision.Inlightofthatreport,the Commissionshallsubmit,ifappropriate,alegislativeproposaltotheEuropeanParliamentandtotheCouncilwitha viewtoamendingtheprovisionpursuanttopoint13ofAnnexIII. 4.Nolaterthan1July2020,theCommissionshallpublishareportassessingwhethercost-effective,technically feasible,energy-efficientandreliablealternativesexist,whichmakethereplacementoffluorinatedgreenhousegases possibleinnewmedium-voltagesecondaryswitchgearandnewsmallsinglesplitair-conditioningsystemsandshall submit,ifappropriate,alegislativeproposaltotheEuropeanParliamentandtotheCounciltoamendthelistsetoutin AnnexIII. 5.Nolaterthan1July2017,theCommissionshallpublishareportassessingthequotaallocationmethod,including theimpactofallocatingquotasforfree,andthecostsofimplementingthisRegulationinMemberStatesandofapossible internationalagreementonhydrofluorocarbons,ifapplicable.InlightofthatreporttheCommissionshallsubmit,if appropriate,alegislativeproposaltotheEuropeanParliamentandtotheCouncilwithaviewto: (a)amendingthequotaallocationmethod; (b)establishinganappropriatemethodofdistributinganypossiblerevenues.EN L150/214Official Journal ofthe European Union20.5.20146.Nolaterthan1January2017,theCommissionshallpublishareportexaminingUnionlegislationwithrespectto thetrainingofnaturalpersonsforthesafehandlingofalternativerefrigerantstoreplaceorreducetheuseoffluorinated greenhousegasesandshallsubmit,ifappropriate,alegislativeproposaltotheEuropeanParliamentandtotheCouncilto amendtherelevantUnionlegislation. Article22 Exerciseofthedelegation 1.ThepowertoadoptdelegatedactsisconferredontheCommissionsubjecttotheconditionslaiddowninthis Article. 2.ThepowertoadoptdelegatedactsreferredtoinArticles12(15)and21(1)shallbeconferredontheCommission forperiodoffiveyearsfrom10June2014.TheCommissionshalldrawupareportinrespectofthedelegationofpower notlaterthanninemonthsbeforetheendofthefiveyearperiod.Thedelegationofpowershallbetacitlyextendedfor furtherperiodsoffiveyears,unlesstheEuropeanParliamentortheCouncilopposessuchextensionnotlaterthanthree monthsbeforetheendofeachsuchperiod. 3.ThedelegationofpowerreferredtoinArticles12(15)and21(1)mayberevokedatanytimebytheEuropean ParliamentorbytheCouncil.Adecisiontorevokeshallputanendtothedelegationofthepowerspecifiedinthat decision.ItshalltakeeffectthedayfollowingthepublicationofthedecisionintheOfficialJournaloftheEuropeanUnionor atalaterdatespecifiedtherein.Itshallnotaffectthevalidityofanydelegatedactsalreadyinforce. 4.Assoonasitadoptsadelegatedact,theCommissionshallnotifyitsimultaneouslytotheEuropeanParliamentand totheCouncil. 5.AdelegatedactadoptedpursuanttoArticles12(15)and21(1)shallenterintoforceonlyifnoobjectionhasbeen expressedeitherbytheEuropeanParliamentortheCouncilwithinaperiodoftwomonthsofnotificationofthatactto theEuropeanParliamentandtheCouncilorif,beforetheexpiryofthatperiod,theEuropeanParliamentandtheCouncil havebothinformedtheCommissionthattheywillnotobject.Thatperiodshallbeextendedbytwomonthsatthe initiativeoftheEuropeanParliamentoroftheCouncil. Article23 ConsultationForum InimplementingthisRegulation,theCommissionshallensureabalancedparticipationofMemberStatesrepresentatives andrepresentativesofcivilsociety,includingenvironmentalorganisations,representativesofmanufacturers,operatorsand certifiedpersons.Tothatend,itshallestablishaConsultationForumforthosepartiestomeetandprovideadviceand expertisetotheCommissioninrelationtotheimplementationofthisRegulation,inparticularwithregardtothe availabilityofalternativestofluorinatedgreenhousegases,includingtheenvironmental,technical,economicandsafety aspectsoftheiruse.TherulesofprocedureoftheConsultationForumshallbeestablishedbytheCommissionandshall bepublished. Article24 Committeeprocedure 1.TheCommissionshallbeassistedbyacommittee.Thatcommitteeshallbeacommitteewithinthemeaningof Regulation(EU)No182/2011. 2.Wherereferenceismadetothisparagraph,Article5ofRegulation(EU)No182/2011shallapply.Wherethe committeedeliversnoopinion,theCommissionshallnotadoptthedraftimplementingactandthethirdsubparagraphof Article5(4)ofRegulation(EU)No182/2011shallapply. Article25 Penalties 1.MemberStatesshalllaydowntherulesonpenaltiesapplicabletoinfringementsofthisRegulationandshalltakeall measuresnecessarytoensurethattheyareimplemented.Thepenaltiesprovidedformustbeeffective,proportionateand dissuasive. MemberStatesshallnotifythoseprovisionstotheCommissionby1January2017atthelatestandshallnotifyitwithout delayofanysubsequentamendmentaffectingthem. 2.Inadditiontothepenaltiesreferredtoinparagraph1,undertakingsthathaveexceededtheirquotaforplacing hydrofluorocarbonsonthemarket,allocatedinaccordancewithArticle16(5)ortransferredtotheminaccordancewith Article18,mayonlybeallocatedareducedquotaallocationfortheallocationperiodaftertheexcesshasbeendetected.EN 20.5.2014Official Journal ofthe European UnionL150/215Theamountofreductionshallbecalculatedas200%oftheamountbywhichthequotawasexceeded.Iftheamountof thereductionishigherthantheamounttobeallocatedinaccordancewithArticle16(5)asaquotafortheallocation periodaftertheexcesshasbeendetected,noquotashallbeallocatedforthatallocationperiodandthequotaforthe followingallocationperiodsshallbereducedlikewiseuntilthefullamounthasbeendeducted.
