6. REPORTS 6.1 AGRICULTURE .1 Agricultural Land Commission application for a non-farm use for the property located at

28268 Huntingdon Road (Owners: R. and C. Crawford) (3100/PRJ16-117) The Director, Development Planning, provided an overview of the application for a non-farm use received subsequent to the Bylaw Enforcement action for a non-compliant use (commercial vehicle parking) on the property. He explained that the proposal is not consistent with the Agriculture One (A1), Abbotsford Zoning Bylaw and if approved by the Agricultural Land Commission (ALC), a rezoning application will be required. The applicant explained his proposal and answered questions for the Committee. He noted that the land was swamp land and the soil reports were done prior to him purchasing the property. The location of the property being on the truck route surrounded by industrial activity was one of the determining factors for their decision to purchase the property. The General Manager, Planning and Development Services, confirmed that the commercial vehicle parking issue will be addressed as part of the AgRefresh project. The Ministry of the Agriculture indicated they do not support the application as it is in prime farmland location, and soils are improvable to Class 2 and 3 which is good for a range of crops. A few members of the Committee expressed their concern in regards to the trend of agricultural properties purchased at lower rates with intent to their further use for other non-agricultural purposes.

Moved by T. De Jong, seconded by F. Keis, that the Agriculture, Dyking, Drainage and Irrigation Advisory Committee recommend to Council that the Agricultural Land Commission application for non-farm use for the property located at 28268 Huntingdon Road, not be supported.

ADDIAC040-2016 CARRIED. .2 Agricultural Land Commission application for non-farm use for the property located at

33955 Clayburn Road (Owners: Char-Rob Holdings Ltd.) (3100/PRJ16-025) The Director, Development Planning, provided an overview of the non-farm use application to permanently retain the existing restaurant (which is not allowed in the Agricultural Two Zone) and to increase the maximum retail sales area from 300m2 to a total of 530m2. This proposal is being considered by the Committee a third time after receiving advice from ALC staff during a meeting with the applicant, business owners, and City staff in June 2016. The applicant noted that since the application was before the Committee on June 8, 2016, they would only talk about what has been done since then. The City staff and Chief Executive Officer, ALC, held a meeting with the Lepp Farm Market Owners and Applicant on June 24,

2016, and it was decided that the Applicant cancel the Exclusion application and submit a Non-Farm Use application. The Ministry of Agriculture commented on the value the Lepp Farm Market brings to the farming community, but suggested that a covenant be placed on title that restricts the non-farm use to the current use. The applicant answered questions for the Committee. The members of the Committee agreed that the service provided by the applicant is beneficial to the agriculture.

Moved by D. Wiebe, seconded by M. Dykshoorn, that the Agriculture, Dyking, Drainage and Irrigation Advisory Committee recommend to Council that non-farm use on the Agricultural Land Reserve for the property located at 33955 Clayburn Road, be supported.

ADDIAC041-2016 CARRIED. .3 Agricultural Land Commission non-farm use, Official Community Plan (OCP), and

Rezoning applications to allow for the establishment of a spiritual centre on the Agricultural Land Reserve for the property located at 32839 Downes Road (Owner: Gurdwara Sachland Isher Darbar Society) (3040-20/A14-012)

The Planner, Development Planning provided an overview of the application which was previously considered by the former Agricultural Advisory Committee (“AAC”)on October 15, 2014. At that meeting the AAC resolved to advise Council to approve the applications with conditions. The application was put on hold due to the preparation of the new Official Community Plan (“OCP”). With adoption of the OCP, new criteria were established when considering the location of new places of worship. The proposal for a spiritual centre on the subject property does not adhere to the locational criteria identified in the new OCP as the property is outside the Urban Development Boundary, is designated Agriculture, and does not have adequate water and sanitary servicing. If supported, an OCP amendment and Rezoning applications will need to be considered. The applicant explained his proposal, stating that the location of the property at the intersection of two major roads with bus stops in close proximity make the subject property accessible and convenient for the purpose of the application. The applicant also noted that no agricultural activity has occurred on the property. City staff noted that assembly uses are not encouraged in Agricultural Land Reserve. A member of the Committee confirmed the property used to be a cattle farm and can be farmed again.

Moved by M. Janzen, seconded by A. Asaph, that the Agriculture, Dyking, Drainage and Irrigation Advisory Committee recommend to Council that the application for non-farm use on the Agricultural Land Reserve for the property located at 32839 Downes Road, not be supported.

NEW BUSINESS .1 Understanding Conflict of Interest – presentation from the City Clerk The Director, Legislative Services/City Clerk explained the concept behind disclosure of conflict and the types of conflict. He provided examples of conflict and explained what the process of conflict declaration is. He answered questions to the Committee and confirmed legal obligations under the Community Charter and City Bylaws.

Moved by D. Wiebe, seconded by T. De Jong, that the presentation on Conflict of Interest by the Director, Legislative Services/City Clerk, be received for information.

REPORTS 6.2 DYKING, DRAINAGE & IRRIGATION .1 Report No. ENG I 088-2016 on Water Licensing in Matsqui Prairie The Senior Engineer, Drainage & Wastewater, explained that the City is planning to apply for a water licence for supplying water to the irrigation system in Matsqui Prairie to meet the requirements of the Water Sustainability Act. In 2016, the Provincial government made changes to the rules governing the use of surface water and groundwater. The Senior Engineer, Drainage & Wastewater, and General Manager, Engineering & Regional Utilities, answered questions for the Committee.

SUMMARY OF THE ISSUE

The annual dyke inspection is a requirement under the Dyke Maintenance Act. City of Abbotsford is the local dyking authority for Matsqui Dyke, Sumas Dyke and Vedder Dyke. This report summarizes the findings in this year's inspection program.

BACKGROUND

Every dyking authority is required to submit an annual dyke inspection report to the Inspector of Dykes under the Dyke Maintenance Act. City of Abbotsford is the local dyking. authority for Matsqui Dyke, Sumas Dyke and Vedder Dyke (Attachment "A"). The annual dyke inspection reports were submitted to the Province in October 2016. This report summarizes the findings in this year's inspection program.

DISCUSSION

The annual inspection for Matsqui Dyke, Sumas Dyke and Vedder Dyke was carried out by the City's Dyking, Drainage and lrrigaUon (DOI) division in May and October 2016.

The inspection revealed the dykes are in excellent shape. The floodboxes and pertinent gates were also found to be in good condition.

Fraser River bank erosion was identified as an issue in the location of Erosion Arc F, which was only 40 m away from the Matsqui Dyke. In March 2016, Provincial funding was received to undertake emergency repair. During the work in April 2016, Erosion Arc F expanded downstream. The City is currently reviewing corrective action with the Ministry of Forests, Lands and Natural Resource Operations (MFLNRO), Emergency 'Management BC (EMBC) and other approving agendes.

FINANCIAL PLAN IMPLICATION

There is no financial plan implication at this time.

IMPACTS ON COUNCIL POLICIES, STRATEGIC PLAN AND/OR COUNCIL DIRECTION

The annual dyke inspection program supports the four Cornerstones of Council 's Strategic Plan by:

• Vibrant Economy: reducing the risk of dyke failure and impacts of flooding to the Matsqui Prairie, Sumas Prairie and major local and regional infrastructure in Abbotsford such as the JAMES Wastewater Treatment Plant;

• Complete Community: upholding public safety by ensuring potentially critical conditions to the dykes are identified early on and facilitating maintenance and inspection;

• Fiscal Discipline: reducing the risk of dyke failure and negative impacts to the City's infrastructure; and

• Organizational Alignment: upholding public trust by providing a high quality of life for residents protected by the dykes.

THAT Report No. ENG I 110-2016, dated December 20, 2016, from the Senior Drainage and Wastewater Engineer, regarding the National Disaster Mitigation Program (NDMP) application , be received for information.

SUMMARY OF THE ISSUE

In September 201 ,6, Emergency Management BC (EMBC) announced that the Flood Protection Program (FPP) has been replaced with the BC Disaster Miti.gation Program (BCDMP), which has access to the Federal National Disaster Mitigation Program (NDMP). This report provides an overview of the new funding program and discusses next steps.

BACKGROUND

In September 2016, EMBC announced that the FPP has been replaced with the BCDMP. The new ten year program will access federal cost-sharing programs such as the NDMP, New Building Canada Fund (NBCF), and the Green Infrastructure Fund (GIF) once they are available.

BCDMP currently has access to the NDMP which focuses on non-structural flood mitigation priorities. Four funding streams are available under the program:

• Stream 1 - Risk assessments • Stream 2 - Floodplain mapping • Stream 3 - Mitigation Planning • Stream 4 - Investments in non-structural and small scale structural mitigation

projects.

DISCUSSION

Upon a review of the Capital Program, staff identified the Geotechnical Assessment for Dykes as a candidate for the application, under Stream 4.

A recent report prepared by the BC Ministry of Forests , Lands and Natural Resource Operations (Lower Mainland Dyke Assessment, July 2015) 1included Geotechnical Stability - Seismic as one of the nine evaluated characteristics. The three Abbotsford dykes (Matsqui Dyke, Sumas Dyke, and Vedder Dyke) were rated 11 unacceptable" and "poor'', due to potential liquefaction of sands that could affect dyke stability and cause 15

lateral spreading. In addition, the Ministry of Forests, Lands and Natural Resource Operations has recommended the City conduct geotechnical testing along the dykes to confirm the soil conditions underneath the dykes.

The proposed project involves geotechnical testing at key locations along the three dykes to confirm the findings, determine risk associated with the current location and potential alternate locations and provides high-level cost estimates for future upgrades to address the seismic risk.

After a review by staff and EMBC, the project has been submitted to the Province. The project receives support from EMBC and has been now forwarded to the Federal Government for funding consideration (Attachment A). It is anticipated decisions will be made by the end of March 2017.

FINANCIAL PLAN IMPLICATION

The "Geotechnical Assessment for Dykes" is in the 2017 Capital Program, with a total budget of $200K.

If the funding application is successfu 1I the project will be 100% funded, 50% by the Province and 50% by the Federal governments.

Geotechnical (Seismic) Assessment of Abbotsford Dykes

We are pleased to confirm that your proposal under the National Disaster Mitigation Program

(NDMP) for the above project has been submitted to Public Safety Canada (PSC} for funding consideration.

A provincial cross-ministry committee evaluated and prioritized all proposals for technical merit and need. Proposals were evaluated by NDMP stream in accordance with eligibility under the NDMP Guidelines and the availability of funding. This process establishes a ranking for projects that are approved until funding is exhausted.

The proposal will now be reviewed and evaluated under PSC' s process. Jf successfuJ, approval

will be conditional upon PSC and the Province, as well as the Local Authority and the Province, entering into written funding agreements that include the NDMP Terms and Conditions.

You will be notified in 2017 regarding the outcome of PSC's evaluation. Timelines regarding the

review and approval notice have not been communicated but it is anticipated decisions will be made by the end of March 2017 ..

We appreciate your interest in the program and encourage you to consider applying for additional projects under future intakes of the NDMP. The next call for proposals closes on

October 31, 2017. Due to the review and evaluation process, proposals are due to EMBC by August 1, 2017.
