Expert Guest Column employees into two categories, exempt and non-exempt. Exempt employees are identified in 29 U.S.C. § 213. If an employee does not fall within one of the categories in Section 213, he or she is non-exempt. Compensation rules are different depending on an employee's classification as exempt or non-exempt. Most importantly, exempt employees are not subject to the standards set forth in Sections 206 and 207, meaning that the rules regarding minimum wage, maximum hours and overtime pay, among others, do not generally apply to them. This distinction also has ramifications in the wake of Sandy. While it would be impossible to cover every variation in which the FLSA was implicated by the Hurricane, here are five important points to consider in evaluating post-Sandy compensation decisions:

1. If an employer was closed for only one day, it likely has to pay its exempt employees but not its non-exempt employees.

the Northeast missed work due to Hurricane Sandy. Some missed work because they could not get there. Others had no choice, with employers closing their doors. In either case, many employers and employees wondered, 'who gets paid, how much and who doesn't?' It depends. The Fair Labor Standards Act, the statute setting forth minimum wage (29 U.S.C. § 206), maximum hours and overtime compensation (29 U.S.C. § 207) and a multitude of other important labor standards, separates

3. Employers must pay both exempt and non-exempt employees who worked from home during the storm.

4. While exempt employees working from home should be paid regardless of the hours they spent working (so long as it was more than de minimis), non-exempt employees must track their time and should be paid for time worked.

5. The overtime rules still apply even if Hurricane Sandy caused the need for overtime hours.

Keep in mind that the FLSA is not the only set of rules impacting post-Sandy compensation. Employer-specific policies and procedures or state laws may also affect compensation requirements. Be sure to refer to these other bodies of rules. No excuses.

Assembly Passes Constitutional Amendment to Raise Minimum Wage Question to be Put to Voters on November Ballot

On February 14, the Assembly passed SCR-1 (Sweeney/Turner)/ ACR-168 (Oliver/Eustace/Spencer), which would amend the State Constitution to increase the minimum wage to $8.25 per hour with annual increases tied to the Consumer Price Index (CPI), by a vote of 46 to 31. All Assembly Republicans voted against the amendment and all Democrats voted in favor of the amendment except Assemblyman Matthew Milam (District 1) who has consistently voted against increasing minimum wage this year. Once again, the Chamber joined with a coalition of business organizations on a desk letter addressed to all Assembly members opposing utilizing the State Constitution to increase the minimum wage and tie future increases to the Consumer Price Index (CPI). The Coalition pointed out in the letter that the issue of increasing the minimum wage has already gone through the legislative process, and has been conditionally vetoed by the Governor. Under Governor Christie’s conditional veto, the minimum wage would be increased by $1.00 per hour, phased in over three years with the first increase effective next month, and contains no automatic annual increases based upon the CPI. The letter urged members of the Assembly to instead support the Governor’s changes to A-2162 (Oliver/Greenwald/Green/Johnson/Prieto/Wisniewski) /S-3 (Sweeney/Vitale/Codey). Increasing the minimum wage through the State Constitution essentially creates a labor contract in the Constitution, and doing so will make it nearly impossible for the state and its businesses to respond flexibly to economic considerations. The CCSNJ and the

Coalition do not believe that opening up the State Constitution to complex issues such as wage and hour issues is prudent. Please click here to see the coalition desk letter to the General Assembly. NJTC Receives Technology and Entrepreneurship Talent Network Grant

The New Jersey Technology Council (NJTC) is the recipient of the Technology and Entrepreneurship Talent Network (TETN) grant from the State of NJ Department of Labor & Workforce Development (LWD). MEET THE POLICYMAKERS On Friday, February 15, Chamber members gathered to hear from NJDEP Commissioner Bob Martin who discussed the latest development in environmental policy relative to the business community, and the impacts of Hurricane Sandy and the Paulsboro bridge collapse. This event was sponsored by

Kathleen Davis, EVP/COO, CCSNJ, along with Rowan School of Business Professors Linda Ross and Kimble Byrd presented a workshop on the South Jersey Summer Institute at the United States Association for Small Business and Entrepreneurship’s (USASBE) 27th Annual Conference. The workshop, “Building Strategic Alliances Between Business and K-12 Educators: A Model Gateway Program,” included an overview of the Summer Institute, a video about the Institute, and a “how-to” manual for implementing such a program anywhere in the country.

In 1991, a local Mobil Refinery plant manager approached his fellow plant managers in two South Jersey Counties to ask their support for an innovative program: The South Jersey Summer Institute for Educators. The goal of the program was to help the education community keep pace with the changes that had been occurring in the business/manufacturing community, and to give educators the tools to better prepare the future workforce – their students. The thinking was to build a link between the business and education communities by: familiarizing teachers with key economic, business and public policy issues that impact on industry; providing teachers with a better understanding of the skills and characteristics their students will need to be successful in the workforce; and involving participants in team projects to develop curricula that incorporates the lessons of the Institute in the classroom. Today, the Institute’s agenda includes a number of plant and facility tours, several panel discussions on topical issues and high level speakers during the three-week long program and educators meet more than 100 business and government leaders. The Institute takes a truly unique approach to better preparing the future workforce by targeting educators, who can reach hundreds of students each year with the lessons necessary to make these students successful in the workplace. To date, more than 500 teachers from dozens of schools throughout Southern New Jersey have graduated from the Institute, and we estimate that they have reached more than 50,000 students with the messages they learned during the Institute. The business community ultimately benefits by having a pool of better prepared workers. The Summer Institute is a program of the Chamber of Commerce Southern New Jersey’s non-profit foundation.

Plan a Company Blood Drive in ’13 to Help NJ’s Critical Blood Shortage

January is National Blood Donor Month. The Chamber and the New Jersey Workplace Blood Donor Coalition invite all members to take this opportunity to plan blood drives for 2013 and encourage your employees to donate blood throughout the year. Blood is often in short supply in our State--while five percent of eligible donors nationally donate blood on a regular basis, in New Jersey, only 3.6 percent do so. As a New Jersey employer, you can help to meet the need for blood donation by hosting a workplace blood drive, promoting community blood drives in your area, joining with other businesses to sponsor a blood drive, or inviting employees to donate at their nearest blood center or hospital donation center.
