The cost for the Design Engineering services shall not exceed $50,000 and is budgeted in the current water budget.

Re: Campbell Avenue Water Main Replacement Program Design Engineering Authorization

Dear 1\/lr. Zimmer:

Our office is requesting authorization to prepare water main replacement plans for Campbell Avenue, from Van Born Road to Annapolis Avenue. This project was approved with joint funding from Community Development Block Grant (CDBG) funds and Water Department funds. Community Development Block Grant will contribute $250,000 toward the construction of the water main. Water Department funds will pick up the remaining construction cost and design and construction engineering costs.

The breakdown of the budget for the Project is itemized below:

After bids are received, a recommendation for award will be submitted to the City for consideration.

Honorable Council Chair Baron and Council Members;

I am requesting to purchase the following with the Department of Justice Bulletproof vest grant that was awarded to the department this year.

The grant award will reimburse the City 50% of the cost of newly purchased vests. All current issued vests where purchased in the 2007-2008 budget year and are at the end of their wananty life span. The National Institute of Justice Standard recommends replacement of vests every five (5) years.

The grant will cover 50% of the purchase price for 55 vests. The department is in need of63 total vests to replace all five year old models. Fund availability for this purchase exists in the Federal Forfeiture account.

The Police Department recommends the purchase of the Point Blanc Hi-Lite BII, Level II, to include two caniers and trauma plate. This is the same model purchased and issued by the department in 2007-2008.

Three vendors submitted separate bids for this purchase. CMP Distributors Inc. is the low bid at unit pricing. The total cost for the vests is $32,886.00 ($522.00 per vest). I recommend that the bid for this purchase be awarded to CMP Distributors who will include measure and delivery of all vests.

Road conditions at several locations on Cherry Hill had deteriorated to the point that hazardous driving conditions existed. These conditions also created the potential for damage to our snow plow trucks.

In September, we received bids for the asphalt portion of our 2012/13 roads project The low bidder for this project was Ajax Paving Industries, Inc. I received a quote from Ajax to do the repairs on Cherry Hill for $1.62 per square foot Best Asphalt offered to do the work for $1.40 per square foot.

I am requesting the City Council approve for payment, the attached invoice in the amount of $34,776.00 to Best Asphalt 6334 N. Beverly Plaza Romulus, Mi. 48174. Funds for this work are available in Major Streets budget 202-202-880-500. Repair work on Cherry Hill was completed on October 25, 2012.

Dear City Council Members:

Please find attached the revised version of the proposed Policy Regarding Public Comment at City Council Meetings ("Revised Poiicy"). The Revised Policy is different from the version of the proposed Policy Regarding Public Comment at City Council Meetings that was submitted on August 20, 2012 ("Original Policy") in several ways.

First, the paragraph pertaining to members of the public complying with Council rules has been moved from under "Public Comment at Regular or Special Council Meetings". Since what is stated in this paragraph is generally applicable to public comment at all Council meetings, this paragraph is now located under the heading "Generally". More specifically, this paragraph is now located on page 1 of the Revised Policy as the second paragraph under "Generally". It had been located starting on page 1 and continuing onto page 2 of the Original Policy under the heading "Public Comment at Regular or Special Council Meetings".

Other than a few minor, non-substantive corrections or improvements, the rest of the changes in the Revised Policy vis-a-vis the Original Policy pertain to having to incorporate "Announcements" into the Revised Policy. With respect to the text under "Public Comment at Regular or Special Council Meetings", these changes start on page 1 of the Revised Policy at the fourth paragraph and continue through the first sentence of the last paragraph on page 2 of the Revised Policy.

The fourth paragraph under "Public Comment at Regular and Special Council Meetings" which is on page 1 of the Revised Policy notes that public comment at regular or special Council meetings is divided into two sections. One is "Announcements". The other is "Comments".

The fifth paragraph under "Public Comment at Regular and Special Council Meetings" which starts on page 1 of and continues onto page 2 of the Revised Policy explains and describes the "Announcements" section of public comment. It states its general purpose and its relationship to legally required public comment. It also gives examples of appropriate "Announcements" consistent with the Council's current practices.

The sixth paragraph under "Public Comment at Regular and Special Council Meetings" which is on page 2 of the Revised Policy sets froth the procedure for members of the public to make comments under "Announcements". This reflects the Council's current practices.

The seventh paragraph under "Public Comment at Regular and Special Council Meetings" which is on page 2 of the Revised Policy explains and describes the "Comments" section of the public comment. It states its general purpose and its relationship to legally required public comment. It notes that the scope of "Comments" is extremely broad, but it also gives some illustrations.

The eighth paragraph under "Public Comment at Regular and Special Council Meetings" which is on page 2 of the Revised Policy sets forth some very general and reasonable limitations on the speech and actions of persons participating under the "Comments" section of public comment.

The ninth and final paragraph under "Public Comment at Regular and Special Council Meetings" which is at the bottom of page 2 of the Revised Policy sets forth the procedure for addressing the Council during the "Comments" section of public comment. The only change from the Original Policy is that a sentence has been added at the beginning of this paragraph. This was necessary because of the newly added text concerning public comment under "Announcements" and public comment under "Comments".

Under "Public Comment at Council Study Sessions", there are only changes in the third paragraph on page 3 of the Revised Policy. Because of the distinction added in the Revised Policy between "Announcements" and "Comments", text was added to this third paragraph to the effect that: 1. Public comment at study sessions does not include "Announcements". 2. To the extent public comment is required at study sessions, it only includes "Comments". 3. The rules

POLICY REGARDING PUBLIC COMMENT AT CITY COUNCIL MEETINGS

Generally

This Policy Regarding Public Comment at City Council Meetings ("Policy") is being adopted to ensure compliance with the Open Meeting Act and with City Charter Section 6.7. This Policy shall be considered to be part of the City Council's rules of order pursuant to City Charter Section 6.9 and is to be incorporated into the City's Policies and Procedures Manual upon adoption. This Policy shall take precedence to any policy, procedure, rule of order, or other requirement adopted by the City to the extent that there is any conflict between this Policy and the conflicting policy, procedure, rule of order, or other requirement.

A member of the public who violates these rules or any other applicable rules established by the Council may be directed by the Council Chair to comply with the rules. If the member of the public continues to violate the rules, the Council Chair may direct him or her to end his or her comments. A member of the public shall comply with the Council Chair's orders. A member of the public shall not be excluded from a meeting otherwise open to the public except for a breach of peace actually committed at the meeting.

Public Comment at Regular or Special Council Meetings

Members of the public shall have a reasonable opportunity to be heard at any regular meeting of the Council or at any special meeting of the Council on matters within the Council's jurisdiction. Members of the public may address the Council under the rules established by the Council including this Policy.

The time of a Council meeting where members of the public may address the Council shall be known as public comment. Public comment shall take place during Council meetings at the time specified in the agenda for the meeting. Members of the public shall not comment in general during a meeting or participate in a meeting unless specifically permitted to do so by the Council.

The Council may temporarily suspend the requirement of this Policy that public comment may only take place as specified in the meeting's agenda at a particular meeting for a special purpose or with respect to a particular issue. To temporarily modify or suspend this requirement, two-thirds of the Council's members present at the meeting must vote to temporarily modify or suspend the requirement. The modification or suspension of the requirement shall only be effective for the meeting at which the requirement has been modified or suspended.

Public comment at regular or special Council meetings shall be divided into two sections, one for "Am1ouncements" and the other for "Comments".

"Announcements" is the part of public comment intended to let persons make others aware of things of general interest to the City. This section of public comment is not intended to ensure compliance with the Open Meetings Act or with City Charter Section 6.7. Rather, it is intended to let persons publicize events, activities, happenings, or things that may be of interest to the City or to those who live or work in the City. Some examples of items that may be

appropriately raised during "Announcements" are updates from public officials concerning information relating to their duties and to the City; announcements from City civic, charitable, educational, or community organizations about their activities or events; and other such statements notifying others of something of general interest to the City.

The procedure for addressing the Council during the "Announcements" section of public comment shall be as follows. One or more members of the public may address the Council in making an announcement. Each member of the public who wants to address the Council shall state his or her name. Plus, if applicable to the particular announcement to be made, each such member of the public shall also state his or her title and the organization he or she represents. Thereafter, the member or members of the public will make the announcement about the thing or things of general interest to the City. There shall be no prescribed allotment of time for any members of the public to make any announcement. However, only the amount of time needed to make the particular announcement shall be made available to and used by the person or persons making the announcement. The Council Chair in his or her discretion shall determine and limit the time available to and used by the person or persons making the announcement to ensure that the requirements in the preceding sentence are upheld.

"Comments" is the part of public comment intended to let persons speak about things they want to speak about whether or not those things are of general interest to the City. While the things spoken about may be of general interest to the City, and may even be of the type that they may have been appropriately addressed as part of the "Announcements" section of public comment, the "Comments" section of public comment is intended to ensure compliance with the Open Meetings Act and with City Charter Section 6.7. Accordingly, the scope of things that may be spoken about under "Comments" is extremely broad. For purposes of illustration only, and not for purposes of limitation, some examples of items typically raised during "Comments" are a person's agreement or disagreement with a particular City policy, a person's praise or criticism of how the City addressed a particular problem, a person's observations and opinions about what happened at a Council meeting, and a person's questions and concerns about how his or her problem may have been or should be addressed by the City.

Although the scope of things that may be spoken about under "Comments" is extremely broad, a person's speech and actions while addressing the Council during the "Comments" section of public comment are not without limits. In addition to any other applicable legal requirements, a person shall not engage in profane, obscene, or criminal speech or actions while addressing the Council during the "Comments" section of public comment. Moreover, a person shall not commit a breach of peace while addressing the Council during the "Comments" section of public comment.

The procedure for addressing the Council during the "Comments" section of public comment shall be as follows. Any member of the public who wants to address the Council shall begin doing so by stating his or her name, the street he or she lives on, and the municipality in which he or she resides. He or she shall have up to three (3) minutes to address the Council, unless the Council, any member of the Council, a City elected or appointed ofticial, or a City employee or contractor uses part of his or her allotted time by asking a question or questions or making a comment or comments. To the extent that a member of the public's allotted time is used by someone else affiliated with the City as noted in the preceding sentence, then the member of the public's time shall be extended to provide him or her the full three (3) minutes to address the Council.

Public Comment at Council Study Sessions

Council study sessions differ significantly from regular or special Council meetings in various ways. Most significantly, the Council does not convene such meetings for the purpose of rendering a decision on public policy. Also, study sessions are not specifically noted in the Charter. Further, study sessions are much more informal than regular or special Council meetings. Moreover, the purpose for convening a study session can vary from being purely an opportunity for the Council to gather information to being an opportunity for the Council to deliberate toward rendering a decision on public policy even though the Council will not actually render a decision on public policy at the meeting.

Depending on the purpose and conduct of a study session, members of the public may or may not be allowed to comment at the study session. If the study session is convened for the purpose of only gathering information, and the study session is conducted such that no deliberations take place toward a decision on public policy, then members of the public will not have an opportw1ity to be heard unless the Council otherwise decides to entertain public comment.

If the study session is convened for the purpose of deliberating toward a decision on public policy, or if deliberations toward a decision on public policy take place regardless of the study session's purpose, then the public shall have a reasonable opportunity to be heard at the study session. Notably, public comment at Council study sessions shall not include an "Announcements" section. Instead, public comment at Council study sessions shall only include a "Comments" section as described above m1der the heading "Public Comment at Regular or Special Council Meetings". Further, the rules noted above under the heading "Public Comment at Regular or Special Council Meetings" and applicable to the "Comments" section of public comment shall apply to public comment at study sessions except in three (3) respects.

First, a member of the public addressing the Council shall have up to two (2) minutes to address the Council.

Second, the timing and sequence of public comment will be determined to maximize its utility to the Council in the discretion of the Chair. Public comment may take place at various points throughout the study session or may take place at a prescribed point during the study session. In the absence of a prescribed part of the study session at which public comment may take place, public comment will be allowed just before the study session is ended.

Third, if a member of the public's comments will count against his or her allotted time, then the member of the public must be informed of this fact prior to the time that he or she addresses the Council.

MICHIGAN VEHICLE CODE (EXCERPT) Act 300 of 1949

257.627a "Regularly scheduled school session," "school," and "school zone" defined; prima facie speed limit in school zone; signs; applicability of section to walkway; location of school; school in session year-round. Sec. 627a. (1) As used in this section and section 629: (a) "Regularly scheduled school session" means that part of a day of student instruction that is followed by

a break for lunch or by a final dismissal of the student body for that day. (b) "School" means an educational institution operated by a local school district or by a private,

denominational, or parochial organization. School does not include an educational institution that the department of education detennines has its entire student population in residence at the institution.

(c) "School zone" means school property on which a school building is located and the area adjacent to the school property that is designated by the signs required under subsection (2). Except as otherwise provided in subsection (5), the school zone extends not more fhan 1,000 feet from the property line of the school in each direction.

(2) Except as provided in subsection (4), the prima facie speed limit in a school zone, which shall be in force not less than 30 minutes but not more than I hour before the first regularly scheduled school session until school commences and from dismissal until not less than 30 minutes but not more than I hour after the last regularly scheduled school session, and during a lunch period when students are permitted to leave the school, shall be 25 miles an hour, if permanent signs designating the school zone and the speed limit in the school zone are posted at the request of the school superintendent. The signs shall conform to the Michigan manual of uniform traffic control devices.

(3) This section does not apply to a limited access highway or to that portion of a street or highway over which a pedestrian overhead walkway is erected, if the walkway is adjacent to school property and is designed and located so as to be used, and is being used, as the principal means by which students of a school that bas property adjacent to the walkway travel to and from the school.

(4) Local authorities may increase or decrease the prima facie speed limit within a school zone under their jurisdiction pursuant to section 629.

(5) Notwifhstanding the requirements for a school zone as defined in subsection (!)(c), if a school is located in an area that requires school children to cross a state trunk line highway or county highway fhat has a speed limit of 35 miles per hour or more to attend that school, the school superintendent may submit a request to the state transportation commission, county road commission, or local authority having jurisdiction over the roadway, as applicable, for a school crossing as permitted under section 613a. If, based on the traffic engineering studies, the road authority determines the need for a lower speed limit, the road authority may designate the crossing as a school zone. Before submitting a request, the school superintendent shall have completed a school route plan as prescribed by section 7 A- I of the Michigan manual of uniform traffic control devices.

(6) Notwithstanding the 25-mile-per-hour prima facie speed limit established by subsection (2), the prima facie speed limit for any street in a school zone that has sidewalks along at least I side of the street, which shall be in force during the same periods that a 25-mile-per-hour speed limit provided by subsection (2) would otherwise be effective, shall be set at the limit requested by the superintendent of schools with jurisdiction over the school within the school zone, but this limit shall neither be more than 15 miles per hour below the regularly posted speed limit for that street nor less than 25 miles per hour. Permanent signs designating the school zone and the speed limit in the school zone shall be posted. These signs shall conform to the Michigan manual of uniform traffic control devices.

(7) If appropriate, the school superintendent may request that a sign be erected in the school zone indicating that a school is in session year-round. A sign erected under this subsection shall be posted on the same signpost as the school zone sign and immediately below fhe school zone sign. The sign shall read "Year-Round School" and shall conform to the Michigan manual of uniform traffic control devices.
