Executive Summary

Environmental and Social Safeguard is one of the most important issue in project funding and

implementat ion. ADB is seriously concerned about this issue and st rict ly ensure that any

development project f inanced by them will not affect the natural and social environment of the

borrower/ loan recipient count ry. According to ADB’s Safeguard Policy Statement (SPS-2009)

borrowers need fulfill the safeguard policy requirements. So the Environment M anagement Plan

(EM P) for the concerned development project must be prepared, implemented, monitored and

reported annually / semiannually so that the project does not impart any serious adverse impact

on the natural and social environment . M uhuri Irrigat ion Project (M IP) under IM IP has been

categorized as Category-B and an IEE is prepared to full fill the ADB’s required. But according to

Bangladesh Environment Act (1995) and Environment Conservat ion Rule-1997 it was categorized

as Red Category and a detail Environmental Impact Assessment (EIA) was done to fulf ill the GoB

requirement as well as ADB’s requirement . The Environmental Clearance Cert ificate (ECC) was

obtained from DoE in November, 2014 (Appenix-VII). This 4th

is prepared by monitoring the EM P and following the Environmental M onitoring Plan described

in that EIA report (Appendix-I & II). To meet ADB’s report ing requirements (a) semi-annual

Environmental Monitoring Report (in July and December) during const ruct ion phase and (b)

annual Environmental M onitoring Report (in December) during operat ion phase are mandatory

to submit ADB for disclosure.

The main components of M IP project are (a) rehabilitat ion of coastal embankment of about 22.4

km, (b) re-excavat ion of drainage/ irrigat ion khals (460 km), t ill December , 181.277 km has been

done . (c) const ruct ion of Elect ricity dist ribut ion lines (180), (d) installat ion of irrigat ion water

dist ribut ion underground pipelines (712 km) and (e) installat ion of uPVC pipe 18.48 km was

done. Finally total length of coastal embankment has been f ixed to 17.753 km as the remaining

parts of 92.50% was already done of total volume of 17.753 km of embankment has been

excavat ed in different parts of the embankment . Till December , 2017 physical works of 5

cont ract packages have been started. Progress of physical works t ill December, 2017 has been

described in table 1.1.

The project is expect ed to have generally posit ive impacts on the environment including (i)

protect ion from t idal surge/ f lood by const ruct ion of coastal embankments & wat er cont rol

st ructures, (ii) protect ion from salinity int rusion through water regulat ing st ructures thereby

preventing land degradat ion; (iii) increased water use efficiency through retent ion surface wat er

by storing in reservoir and dist ribut ion of both surface & ground water through a profuse

networks of irrigat ion khals (canals) for cult ivat ion in the dry seasons in the project areas; (iv)

reduced water logging through drainage khals / st ructures and cont rol measures and (v)

diversificat ion of cropping pat terns and obtaining food security by providing year round

irrigat ion water by modern and efficient prepaid metered pumps.

On the other hand, negat ive impacts identified include (i) possible exacerbat ion of downst ream

salinity int rusion due to water ext ract ion from the rivers; (ii) obst ruct ion of fish migrat ion

between the rivers and internal water bodies by regulators and other st ructures (including that

past impacts when exist ing structures were placed); (iii) water quality deteriorat ion due to

agriculture intensificat ion; and (iv) temporary impacts during const ruct ion of st ructures and

embankments.

These will be mit igated through (i) implementat ion a continuous salinity monitoring and

informat ion sharing program at the project and downst ream areas with promotion of

coordinated water ext ract ion; (ii) introducing and promot ing fish friendly operat ion of regulators

with provision of fish culture opportunit ies t o professional fisher folks, (iii) int roducing

integrat ed pest management and effect ive soil nut rient management as a part of agriculture

extension; and (iv) ensuring safe and environmentally sound const ruct ion pract ices. These were

incorporated in the EIA. At the field level cont ractors are responsible to implement prepared

EM P for M IP. C-IM O, PIU and WM A are responsible for monitoring, supervision and enforcing

the cont ractor to comply with the EM P, Environmental health and safety and national and

internat ional labor laws. Safeguard cell at PM U is responsible to oversee the whole process and

verify the claims and grievances raised by community people/ farmers if any and finally prepare

and submit safeguard reports to ADB regularly for disclosure.

As the majority of physical works and ent ire operat ion works are left to start so most of the

environmental parameters / indicators are not monitored. Because most of the adverse impacts

will emerge during operat ion of the project . So only (a) impacts during const ruct ion, (b)

environmental health and safety compliance and (c) Felling/ cut t ing of t rees have been

monitored and results have been found sat isfactory within limited monitoring arrangements

except some a few issues stated in appendix-VII.

Project stakeholders of Bangladesh have basic knowledge of environmental compliance about

safeguard issues. Proper t raining on Environmental M onitoring, Environmental Health and Safety

compliance, Internat ional Labor law and concerned compliances provided to concerned

safeguard personnel working in PM U-safeguard cell, C-IM O, PIU, WMA and Const ruct ion

Cont ractor w ill develop their safeguard monitoring, implementat ion and report ing capacity

(International Standard) in near future.

Implementat ion status of EM P and its monitoring have been stated separately for each type of

project intervent ion like (a) EM P for Coastal Embankment , (b) EM P for re-excavat ion of irrigat ion

canal, (c) IM P for Farmers’ canal system and pump houses etc in this 4th Safeguard Report.

M oreover Health and Safety Plan (HSP) with implementat ion and monitoring status, Grievance

Readdress M echanism (GRM ) etc have been added in this report . Environmental Clearance

Cert ificate (Appendix-VII) for M IP and HSP (Appendix-VIII) requirements incorporated in both

bidding documents and cont ract documents are at tached with this report .

CHAPTER 1: PROJECT BACKGROUND

1.1 Background

Bangladesh is most probably the most densely populated count ry in the world. On an

average 1252 people live here per km2. That is about 163 million people live within 147,000

km2 area. About 1,915,222 new faces (1.19% per annum) are being added to the total

populat ion of Bangladesh, but the land for agriculture is decreasing by 1% every year. In

Bangladesh, agricultural development and sustainable natural resource management are

crit ical for poverty reduct ion, as the majority of the poor (85%) live in rural areas and depend

on agriculture for their livelihood. Agriculture generat es 50% of employment , cont ributes

20% of gross domest ic product, and provides an almost secure food supply for the whole

populat ion. M ajor causes of poverty are recurrent floods and riverbank erosion, as well as

drainage congest ion, salinity, cyclones and t idal surges, arsenic contaminat ion, over-

exploitat ion of groundwater, chemical and biological contaminat ion of surface water, and

drought. M oreover recent climate risk has made the situat ion more crit ical. So climate smart

intensive agriculture pract ices have been inevitable not only for Bangladesh but also for the

climate vulnerable part of the globe. At the same t ime to insure the efficient use of water

resources with diversificat ion of crops/ cropping pat tern is very much essent ial for obtaining

food security. Agriculture growth is driven by a shift from subsistence rice-based cult ivat ion

to commercial high-value agriculture commodit ies, which is inst rumental in advancing rural

economic growth and cont ribut ing to long-term food security. The Government promotes

diversificat ion in agriculture by encouraging private agribusiness as well as providing access

and improvements to rural infrast ructure. The Government ’s object ives for surface irrigat ion

are, among others: (i) promot ing peoples part icipat ion in conformity w ith Integrat ed Water

Resources M anagement principles; (ii) achieving food security of food grains through

ensuring year-round sustainable irrigat ion; (iii) ensuring climate change resilience; (iv)

st rengthening and capacity building of water resource inst itut ions; (v) command area

development and irrigat ion expansion; (vi) increasing beneficiary part icipat ion and, where

possible, t ransfer management to beneficiary organizat ions, local government and the

private sector; (vii) int roducing of public-private partnerships (PPPs) to provide support to

agriculture and for selected-services; and (viii) providing agricultural extension services

including irrigat ion technology and on-farm water management .

Keeping pace with the vision 2020 Government of Bangladesh, with the financial assistance

of ADB, has taken init iat ive to modernise 3 large scale irrigat ion projects (old projects) of

BWDB under Irrigat ion M anagement Improvement Project (IM IP). Under IM IP the

implementat ion (modernizat ion) of M uhuri Irrigat ion Project (M IP) at Feni & Chit tagong

dist ricts and Feasibilit y studies for modernizat ion of another two old BWDB projects named

Ganges Kobotak Irrigat ion Project (GKIP) at Kust ia, M eherpur, Chuadanga and M agura

dist ricts and Tista Barrage Irrigat ion Project (TBIP) at Rangpur, Dinajpur and Nilphamari

dist ricts are supposed to be completed within. Up to December , 2017 a significant port ion of

physical works of M IP has been completed and the feasibilit y study of GKIP & TBIP have been

almost completed. At present modernizat ion of M IP subproject is going on. So safeguard

monitoring and/ or Environmental M onitoring Report will be limited to M IP subproject only.

1.2 Project outputs

The impact of the Project will be sustained high growth in irrigated agriculture. The project ’s

outcome will be efficient and sustainable management the M IP producing higher yields, w ith

expanded irrigated areas, and with a higher cropping intensificat ion including diversificat ion

into higher value crops. The Project w ill be implemented over 5 years from 2014-15 to 2018-

19. The Project will have the following three key components:

Output 1: Performance based irrigat ion management and agriculture support services are

established for 3 large irrigat ion schemes including: (i) establishing Irrigat ion M anagement

Operators (IM Os) at the M IP; that w ill supervise rehabilitat ion and modernizat ion works and

provide long-term sustainable M OM ; (ii) establishing efficient management and cost -

recovery systems to maximise water use ef ficiencies and develop sustainable and reliable

cost-effect ive service delivery of irrigat ion water supply that meets farmer’s needs and

improves their productivity; (iii) providing agricultural support services through the IM Os

that promote efficient water use, crop diversificat ion through sustainable pract ices, and

developing opportunit ies for more commercial farming or agribusiness; and (iv) assist ing

with government reforms and inst itut ional st rengthening for long-term support of IM Os

including: (a) the establishment of a PPP cell within the Bangladesh Water Development

Board (BWDB); (b) the establishment of Implementat ion Coordinat ion Committee (ICC) for

M IP that w ill guide and support the establishment of sustainable and effect ive management .

Output 2: Irrigat ion syst em infrast ructure is rehabilitated and modernized: The Project w ill

rehabilitate and modernize irrigat ion infrast ructure including repair of head and cross

regulators, canals, ancillary facilit ies, flood embankments and associated drainage st ructures.

The prime focus will be to provide more efficient and equitable irrigat ion distribut ion

systems through appropriate technologies including provision of syst ems for cost recovery

such as pre-paid water metering system.

Output 3: The Project is eff icient ly managed with effect ive inst itut ional Development

including: (i) project management at all levels to ensure the effect ive and t imely delivery of

the project outputs, including the highest possible standards of quality cont rol; (ii) planning,

feasibilit y assessment and detailed engineering design for Output 2; and (ii i) Undertaking

inst itut ional st rengthening, enhancing awareness, and providing t raining of key stakeholders

including: (a) working with BWDB, water users associat ions (WM As) and local government to

redefine their role in the context of a new and changed approach to M OM ; (b) working with

farmers to ensure clear understanding of the new irrigat ion management st rat egies including

requirements for cost recovery; and (c) t raining for farmers in irrigat ion water management

for more efficient water use.

1.3 Project Location

The major area of the M uhuri Irrigat ion Project (M IP) is situated in six Upazila like

Purshuram, Phulgazi, Chhagal Naiya, Feni Sadar and Sonagazi of Feni Dist rict ; and only a

small port ion is situated in M irsharia Upazila of Chit tagong Dist rict (Figure-. The total land

area of the two dist ricts (Feni and Chit tagong) is 6,211km² and the total populat ion is 7.75

million people. This gives an average populat ion density of 1248 persons per square

kilomet re; populat ion density in Feni Dist rict is 1,300 per sq km and in Chit tagong 1,239

persons per sq km. The M IP is on the flood plains of 3 flashy rivers M uhuri, Feni and Selonia

river networks between the Indian hills of Tripura state of India to the East and the Bay of

Bengal to the West . So during heavy downpour in Indian hills suddenly flashes the area

violent ly and damages houses and property, submerges the crops and land under sand/ silt

carried with flood water.

The M IP area experiences natural disasters like t ropical storms, cyclones and t idal surges after

each several years which have been frequent in recent years as a consequence of climate

change. The project area of M IP is also prone to earthquake due to the presence of India-

M yanmar fault to its eastern periphery.

A. The overall object ive of the project is reducing poverty by enhancing food security

through increased yield of crops.

B. The specific object ives of the project are-

1. Sustainable operat ion and maintenance of M uhuri Irrigat ion Project (M IP) through

rehabilitat ion of the irrigat ion infrast ructures, improvement of irrigat ion management

through innovat ive approaches for modernizat ion and cost recovery in full for the

Level 2 (Secondary canal systems) and the Level 3 (framers’ canal syst em)

infrast ructures’ O&M while the Execut ing agency will carry out O&M of the Level 1

(Embankment , regulators and primary canal syst em/ rivers) of the M IP with

cont ribut ion by the GoB.

2. Increasing sustainabilit y of M IP through effect ive community part icipat ion.

3. Cont rolling f loods and using water resources effect ively and efficient ly.

4. Increasing farmers' income and st rengthening livelihood through improved

product ivity.

1.5 IM IP Implementation Arrangements

The Execut ing Agency for the Project is the Bangladesh Water Development Board (BWDB) in

which a Project M anagement Unit (PM U) has been established and led by the Project

Director (PD). The Project M anagement and Design Consultant (PM DC) support the PM U and

PD. The PM U manages the implementat ion of the M IP. The PD, PM U manages design and

implementat ion works; and manages the Irrigat ion M anagement Operator (IM O). The PD is

being supported by a team of planning, design and const ruct ion, procurement , accounts and

administ rat ion staff. A Project Steering Commit tee (PSC) is established within the M inist ry of

Water Resources (M oWR) to provide overall coordination of the Project and facilitate inter-

ministerial coordinat ion. The PSC is chaired by the Secretary, M oWR. The PD is the PSC’s

member secretary and all concerned minist ries and agencies will be represented.

A Safeguards Desk was specially established on 24 December, 2015 at PM U off ice for overall

monitoring, verif icat ion and report ing to ADB and DoE. The Safeguard cell is consist of 3

members (1 water resources expert and 1 gender and social compliance expert headed by 1

environmental monitoring expert ) to support the M onitoring office with safeguard

compliance management .

PM DC is responsible to support PM U-Safeguard cell, IM O and PIU for developing capacity to

monitoring environmental and social compliance issues. Cont ractor is obliged by bid

document / cont ract agreement to implement the project EM P outlined in IEE/ EIA report .

IM O is responsible for day to day monitoring and supervising cont ractor’s act ivit ies relat ing

to EM P implementat ion, recording any grievances/ complaints raised by society/ stakeholders

and report ing monthly to PM U. PIU is responsible to enforce the cont ractor to implement

EM P in the field level and report to PM U the progress of implementat ion status. Safeguard

cell w ill consolidate all reports sent by IM O and PIU, verify those by visit ing field and prepare

semiannual safeguard report (Const ruct ion period)/ annual safeguard report (operat ion

period) and submit it to ADB for disclosure in their own websites.

An Implementation Coordination Committee (ICC) is established for the project to manage

field implementat ion issues that arise related to conflicts, safeguards, security, and more

generally concerns about the performance of the implement ing part ies. The ICC is chaired by

the project ’s BWDB Chief Engineer, East ern Zone, Comilla and commit tee members comprise

representat ives from the offices of the Deputy Commissioner, the Water Users’ Associat ions

and the IM O.

1.6 Physical progress of project activities

The IM IP will modernize Muhuri Irrigat ion Project (M IP) which has been being implemented

from 2014-2015 and is going to be completed in 2019-2020.

This Project has also completed feasibilit y study of (i) Ganges-Kobadak Irrigat ion Project

(GKIP) having a dry season irrigated area of about 96,000 ha and going on studying (ii) Teesta

Barrage Project (TBP) having a dry season irrigat ion area about 60,000 ha. Study of these two

projects has been completed for formulat ion of Development Project Proposal (DPP) and

implementat ion arrangement later on under the financial assistance of the Asian

Development Bank (ADB) or any other donors. The Project target s include rehabilitat ion of

the water infrast ructures of the M IP for gross 60,258 ha area in Purshuram, Phulgazi,

Chhagyal Niayyia, Feni Sadar and Sonagazi Upazila of Feni Dist rict and M irsarai Upazila of

Chit tagong Dist rict. The net cult ivable area of the project is 28,663 ha; net irrigated area of

17,900 ha (with surface water and ground water) in the pre-project condit ion; but the “ With-

Project ” irrigated area will be 23,600 ha.

The main physical works under M IP are (a) rehabilitat ion of coastal embankment ,(b) re-

sect ioning of drainage/ irrigat ion canals, (c) rehabilitat ion of water cont rol st ructures like

regulators/ sluices/ reservoirs, installat ion of low lif t pumps (LLPs) w ith underground pipes &

prepaid meters and upgrading of elect ricity dist ribut ion systems. safeguard monitoring

According to the RDPP of IM IP total 22.6 km of coastal embankment was supposed to be

rehabilitated/ re-sect ioned but the target has been reduced to 17.753 km as some part of the

embankment is already rehabilitated and paved under some other projects. The physical

works/ const ruct ion/ rehabilitat ion of coastal embankment t ill December, 2017 has been done

92.50% by length.

Re-excavation of drainage/irrigation canals are going on. About 181.277Km out of total 460 km

has been done till December, 2017. Under contract package no. CW-3 construction works of

farmers canal system with construction of pump houses is also going on. More over under the

farmer’s canal system only 29 pump houses out of 950 pump houses have been found to be

constructed partially till December, 2017. Under contract package no-CW 8 the BWDB building

in the Field office (PIU Office) has been progressed 100% of 1 Building. A MoU has already

been signed between BWDB and REB (Rural Electrification Board) for construction of 180 km

electricity distribution system with installation of 1 substation. Tendering process is going on. So

the implementation of construction works is expected to start in full swing in the Fy 2017/2018.

1.7 Scope and status (till December, 2017) of Safeguard monitoring in M uhuri Irrigation

Scheme (M IP) under IM IP

Among 3 subunits (large scale irrigat ion projects of BWDB) of IM IP only M IP subunit is being

implemented within this t ranche of project period Fy: 2014/ 2015 to 2019/ 2020. So this 4t h

Environmental safeguard report includes only the environmental monitoring of M IP.

Categorizat ion of MIP for different safeguard issues and report ing requirements for each

category are described below.

(a) Environmental Safeguards: According to ADB’s Safeguard Policy Statement (2009) M IP

(M uhuri Irrigat ion Project ) under IM IP was categorized B for environment and an init ial

environmental examination (IEE) was prepared as the negat ive impacts are typical to any

const ruct ion act ivit ies involving earth works which can easily be mit igated through

adoption of measures described in the environmental management plan (EM P). But

according to Bangladesh Environment Act (1995) and Environment Conservat ion Rule-

1997 it was categorised-Red as under M IP modernizat ion process natural water flow will

be cont rolled by const ruct ion of water cont rol st ructures. To meet the requirement of

DoE (Department of Environment ), Bangladesh an Environmental Impact Assessment

(EIA) study was done and Environmental Clearance (EC) from DoE was obtained on

30.11.2014 (Appendix-8). Consultat ions were undertaken with affect ed stakeholders and

a suitable grievance redress mechanism had been proposed to resolve any project

related grievances. To meet ADB’s report ing requirements (a) semi-annual Environmental

M onitoring Report (in the month of July and December) during const ruct ion period and

(b) annual Environmental M onitoring Report (in every December) during operat ion

period are mandatory to submit ADB for disclosure.

Physical works of excavat ion of Khal (canal) and rehabilitat ion of coastal embankment

under only 4 cont ract packages: CW-1, CW- 2, CW-3 & CW-8 actually started in the year

2016. The first semi-annual report for durat ion January to June, 2016 and second semi-

annual report for durat ion June to December, 2016 and the 3rd

semi-annual report for

durat ion January to June , 2017 were submitted to ADB and hoisted to the website of

ADB Bangladesh M ission for disclosure. This safeguard monitoring report is the 4th

semi-

annual report for the durat ion of July to December , 2017. The report has been due to

submit as the Safeguard and Public communicat ion expert of IM O who has the main

responsibilit y of monitoring and report ing the day to day physical act ivit ies specially the

environmental and social safeguard issues, health and safety issues of the workers,

grievance issues to PM U office. Safeguard team of PM U office has visited the sites of

each physical components in the field, talked to the labours’ leaders, cont ractors’

supervisors, villagers, squat ter families, IM O officers and BWDB field officers about the

environmental and social safeguard issues, workers and villager’s health and safety issues

etc at end of December, 2017 and this report reflects status of all those issues going on in

the field.

(b) Social Safeguards: The M IP was classif ied as Categorized as a “ C” project for involuntary

reset t lement in accordance with the ADB’s Safeguard Policy Statement (SPS), 2009.

Requirement for temporary relocat ion and reset t lement init ially envisaged can be

avoided through: (i) modified designs by reducing the cross sect ions (st eeper side slopes)

allowing for some increase in hydraulic in populated area; and (ii) removing the

embankment rehabilitat ion from the const ruct ion program. A reset t lement framework

(RF) has been prepared for the entire M FF that would guide the preparat ion of

reset t lement plans for the subsequent t ranches, if required. The RF follows the

Government ’s laws and regulat ions and ADB’s SPS (2009), and prescribes for ent it lement

to compensat ion for land acquired and lost assets at replacement cost as well as

reset t lement assistances. To meet ADB’s report ing requirements (a) a semi-annual Social

Safeguard Monitoring Report (in June) during const ruct ion phase and (b) an annual Social

safeguard M onitoring Report (in December) during operat ion phase are mandatory to

submit to ADB for disclosure.

During the feasibilit y study of IM IP in the year 2013/ 14 most of physical works specially

rehabilitat ion of coastal embankments, reconst ruct ions / re-sect ioning of drainage

/ irrigat ion canal was proposed to be conducted on old/ degraded coastal

embankment / canals. So there was no scope of land acquisit ion or reset t lement of

houses/ st ructures etc. in M IP area as well as the implementat ion/ monitoring of

Reset t lement Act ion Plan (RAP). But during last 2-3 years squat ters families (above 350

families), most ly climate vict ims of south-west coastal areas of Bangladesh like Noakhali

and Barisal dist ricts and displaced by t idal surges/ t ropical cyclones, found to set t le on the

coastal embankments. The 350 families are actually rehabilited temporally in the

embankment during t idal surges/ t ropical cyclones but after this natural disaster has-been

over, this peoples has been shifted to their original locat ion.

M oreover 25% of earth works of M IP subunit is supposed to be done by WM O (Water

management organizat ions) and remaining 75% by cont ractors. There was a scope of

employment for the female labour (30% of total labour force) but due to some religious

norms, especially in Muslim community in the M IP area, local women are not interested

to part icipate in outdoor works. So implementat ion of Gender Act ion Plan (GAP) faces

difficulty in M IP area. But during the f ield visit on August , 2017 some women of squatter

families showed the safeguard team quite interest s for earth works as labours in the

embankment . Gender act ion plan has been implemented in PM U, PIU, IM P and WM O

offices. Quarterly Gender Act ion Plan monitoring report has been prepared and

submit ted to ADB separately for disclosure.

(c) Indigenous Peoples Safeguard: The M IP is categorized as C for the Indigenous Peoples

safeguard. There are no Indigenous Peoples as defined for operat ional purposes by ADB's

SPS (2009) in the Project areas and the areas under the subsequent t ranche of the

Program. As the subsequent t ranche is also categorized as C, an Indigenous Peoples

Planning Framework has not been prepared. So there is no scope of report ing on

Indigenous Peoples Safeguard under M IP.

CHAPTER 2: ENVIRONMENTAL MANAGEMENT PLAN

2 Environment M anagement Plan

M anagement of Important Environmental Impacts (IECs) comprises 3 components like-

(a) Environmental mit igat ion plan: Plan containing suggest ion on mit igat ion measures to

minimize possible negat ive impacts,

(b) Compensat ion plan: Plan suggest ing measures required for providing compensation for

well assessed negat ive impacts which cannot be mit igated,

(c) Environmental monitoring plan: Plan for detect ing changes that may take place due to

the planned intervent ions in the project .

Environmental M anagement Plan (Appendix-I) for M IP suggest ed in the concerned EIA report

unveils that during the preconst ruct ion phase there are no adverse impacts as w ell as no

mit igat ion/ monitoring plan. But during const ruct ion and post const ruct ion phase there may

have some adverse impacts which need to be mit igated. The EIA study was conducted during

the FY 2013-2014 and the report did not show any issues which might be compensated. But

at during the implementat ion period o FY 2016/ 2017 reset t lement of squat ter families on

the embankment faces some challenges as DPP of IM IP and Bangladesh Environment Act

(1995 amended in2010) do not allow to compensate squat ters. So this 4th

EM R includes no

compensat ion plan for M IP. The proposed EM P of M IP has been described below (Table- 2.1)

in brief.

2.1Environmental M onitoring Plan

Environmental M onitoring Plan which was prepared under Environmental Impact

Assessment (EIA) process of Muhuri Irrigat ion Project (M IP). The cont ractors, IM O, PIU and

Safeguard cell have the obligat ion to follow this Environmental M onitoring Plan (Appendix-2)

during the const ruct ion and operat ion phase of the project . Before preparat ion of EIA report

BWDB prepared an IEE report which full fi ll the requirement of ADB’s safeguard requirement .

But in order to full fill the environmental and social compliance requirement of GoB

especially of DoE (Department of Environment ), Bangladesh EIA is compulsory for this red

category project of M IP. According to ADB’s SPS (2009) meet ing the count ry’s (Borrower)

environmental and social compliance is mandatory. In this back ground Environmental

M anagement Plan and concerned Environmental M onitoring plan prepared in the EIA report

of M IP is compulsory to follow for BWDB, IM O, PIU and WM A and ensure Environmental and

Social compliance of MIP under IM IP.

2.2 Limitations of EM P and M onitoring Plan

The safeguard team seems that the Environmental Monitoring Plan (EM P) prepared under

EIA report (at tached in Appendix-2) has some limitat ions stated below.

(a) Why did the EIA Team avoid the issue of re-set t lement of squat ter families living on the

coastal embankment was not clear to the safeguard team. So EM P does not include re-

set t lement plan for the squat ter families.

(b) EM P does not describe any health and safety issues as w ell as their monitoring plan in

the EIA report .

(c) EM P does not describe possible grievance issues and their redress mechanism in the EIA

report .

2.3 Implementation Arrangement of Environmental M onitoring Plan

According to Approved DPP of IM IP Environmental and Social Safeguard compliance of M IP

will be implemented/ monitored by 4 stakeholder groups of M IP such as IM O, PIU, WM A,

PM U (Safeguard Cell) and PMDC. Responsibilit ies and scope of work of each stakeholder

group have been described below.

(a) IM O is responsible to conduct the day to day monitoring and supervising the

implementat ion of environmental and social safe guard issues and keeping concerned

records of act ivit ies like progress, complaints and grievances from labours, community

peoples, farmers, etc and any breach of Bangladesh Environmental law, labour law,

Occupational Health and Safety measures by cont ractors. IM O is also responsible to

consolidate those daily records as monthly reports and submit it to PM U-Safeguard cell.

Inst ructed by PD office ,IM O must monitor the cont ractor’s responsibilit y to comply

concerned issues like internat ional labour law, Occupational health and safet y measures

and social safeguard compliance etc.

(b) PIU director is primarily responsible to insure the implementat ion of EM P by cont ractors

and enforce them to implement EM P and record & report monthly and quarterly to PD,

PM U in case of any grievances raised and breaches in implementat ion of EM P by

cont ractors.

(c) PM U (Safeguard cell) is responsible to foresee the ent ire safeguard implementat ion

process, consolidate those monthly reports, validate those complaints and grievances,

inform PD-IMIP for necessary act ions and finally prepare & submit Semi-annual

Safeguard Report to ADB and DoE for disclosure.

(d) PM DC has the responsibilit y to st rengthen PM U-Safeguard Cell, PIU, IM O, cont ractors

and developing their capacity for implementat ion/ Monitoring/ supervision/ report ing of

safeguard issues of M IP project by providing necessary t raining and demonst rat ions etc.

Though PM DC was supposed to t rain and build up capacity both PM U and PIU for

safeguard monitoring but they didn’t take any responsibilit y and/ or arranged such

t raining.

2.4 Implementation status of Environmental Monitoring Plan

The physical progress/ const ruct ion works of M IP is less t ill December 2017. But most of the

environmental monitoring indicators are concentrated in const ruct ion and operat ion phases

of M IP. MIP (M uhuri Irrigat ion Project ) is basically rehabilitat ion by modernizat ion of old

irrigat ion project of BWDB. So the environmental adverse impacts which are supposed to

happen had happened 30 years back when M IP first implemented in 1986 with aid of IDA,

SIDA and EEC. Now that old and degraded irrigat ion project is just being rehabilitated on the

same place. So it is expect ed that environment will be impacted very less by rehabilitat ion

process. According to EIA study report of M IP major environmental impacts may specially

be imparted on land, water and fishery resources. Present status of environmental

monitoring is described in the Table 2.2.

2.6 Monitor ing of implementation status of Grievance Redress Mechanism

Recent ly safeguard and public communicat ion officer has been deployed in the field by IMO and

safeguard mechanism report he submit t ed to PM U off ice for approved and the GRM frame work will

established in the field soon. Then people specially complainant/ sufferer/ beneficiary and will know

where, to what person and in format/ medium the complaint should be submit ted. A minor port ion of the

construct ion works of total 10 packages has been completed and most ly lef t to complete. Within this

small extent of construct ion works no writ ten complaints were reached/ recorded in IM O, PIU or PM U

offices. During the f ield visits of PMU-safeguard t eam in August , 2017 no stakeholders raised any

complaint against the contractors or BWDB or ADB. The people were found to be happy and some

requested the safeguard monitoring team to complete the physical work before the next rainy season.

The squatter families who were living on the coastal embankment illegally and were replaced by the

contractors temporarily during re-sect ioning the embankment were found to be grieved as they were not

compensated for replacement. Compensat ion was not possible as DPP of IM IP project has not any such

provision and Government’s legislat ion of Bangladesh does not allow compensat ion to squatters. But the

contractor locally managed them though the grieved squatter families did not submit any complaint in

black and white.

CHAPTER 3: RESULTS OF ENVIRONMENTAL MONITORING

3 Results of environmental monitoring and compliance measures

As the physical progress/ const ruct ion works t ill December 2017 is limited to (a) Re-

sect ioning of 16.421 km (92.50%) of Costal Embankment out of 17.754 km and (b) Re-

excavat ion of 181.277 km (42.70%) khals out of total 460 km, (c) const ruct ion of 29 pump

houses out of total 950, (d) installat ion of 18.48 km uPVC pipes out of tolal 680 km and

(e) format ion of 44 WUOs (37 WM Gs, 6 WM As) out of 44 WUOs. The adverse environmental

and social impacts of M IP are most ly limited to const ruct ion and operat ion phases so the

t ime to monitor those possible impacts has not come. M oU between BWDB and the other

project partners like DoF, DAE, FD, DoC and DoPHE etc who will also monitor Environmental

parameters, has not been conducted t ill December , 2017. M ore over the main monitoring

personnel of IM O especially the Safeguard and Public Relat ion Officer who is responsible for

day to day monitoring of those environmental social safeguard compliance deployed very

recent ly in the field yet . So the quantitat ive environmental monitoring parameters specially

water quality parameters, Soil fert ilit y parameters, vegetat ion coverage’s, wild life habitats

and biodiversity loss etc following according to the items ment ioned in the table head of the

Table: 3.1 given bellow is beyond the scope of this 4th

EMR (safeguard monitoring) report.

CHAPTER 4: RECOMMENDATION AND CONCLUSION

4 Recommendation and Conclusion

The safeguard team of PM U recommends the following measures/ correct ive act ions to

overcome the present noncompliance/ limited compliance issues of M IP under IM IP.

1. During the meet ing of ADB mission the concerned Environmental Safeguard officer of ADB

Resident M ission in Dhaka, Bangladesh should call all 4 groups like IM O, PM DC, WM G,PM U

and PIU and clarify the Safeguard responsibilit y of each part ies in M IP or send all a writ ten

not ice clarifying their safeguard responsibilit ies.

2. The qualitat ive and quant itat ive paramet ers like water quality, biodiversity, soil fert il it y,

Occupational health and Safety as well as social safety compliance are clearly stated in the

EIA report of M IP. Environment Division of ADB resident M ission should fix the mandatory

parameters and their methods, frequencies and standards on above ment ioned indicators

discussing the issue with the BWDB, DOE and WM A leaders.

3. Proper t raining on Environmental M onitoring, Environmental Health and Safety compliance,

International Labor law and concerned compliances should be provided to concerned

safeguard personnel working in PM U-safeguard cell, C-IM O, PIU, WUA and Const ruct ion

Cont ractor in order to develop safeguard monitoring, implementat ion and report ing

(International Standard) capacity.

4. Field based t raining workshops for cont ractors specially the labor leaders, WM O should be

conducted for raising awareness on Environmental compliance measures, safeguard, health

and safety measures, issues mandatory for contractors to comply internat ional labor laws

etc.

5. Donor and DoE Bangladesh should enforce BWDB to comply the above ment ioned issues

st rict ly.

6. BWDB should enforce the cont ractor to maintain the environmental and health & safety

compliance of both ADB and GoB.

7. Under agriculture support services and cost recovery act ivit ies (a) plantat ion of local fruit ,

forage, t imber, medicinal and fuel wood species along the canal bank, (b) growing vegetables

specially creepers and climbers crops on the bamboo fences/ stacks over the irrigat ion canals,

(c) growing open/ cage fishery in the canal water and (d) rearing ducks in the canal should be

implemented soon by the WM Gs. Preparat ion for plantat ion specially ensuring the land

ownership, conduct ing the bilateral agreement / lease between BWDB (WM Gs) and

Government (DCs), preparat ion and approval of plantat ion plan/ manual based on canal

bank/ site should be completed before coming the next rainy season.

The physical/ const ruct ion works are expected to be completed within next year and

installat ion of elect ricity dist ribut ion line and irrigat ion pumps with that t ime. So the

operat ion of M IP project w ill be started very soon to the end of 2018 year and then

monitoring of almost all environmental parameters will be conducted well.
