Re: Update - Draft Claimant Definition for Ngati Maru – Tipuna List

1.0 Introduction: This memo is an update on the Draft Claimant Definition for Ngati Maru – Tipuna

List. Following my memo of 20 December 2013 further research was undertaken to complete

some of the outstanding tasks as identified in the Appendix to the Schedule of that memo. The

purpose of this memo is to summarise the results of that research and the amendments that

have been made to the draft Tipuna List. No changes are proposed for any of the

recommendations made in the memo 20 Dec 2013 which still stand and need consideration.

2.0 Summary of research findings

The further research has primarily been undertaken by Pare Hayward and a copy of that

research has been made available to the runanga and the iwi. In summary the research involved

the following:

A review of all Maori Land Court source documentation to ensure it is correctly

referenced and that the most appropriate source documents have been used.

A search for source documentation where this was not obtained from previous efforts.

As a result of this research, Pare has made a number of recommendations. Her reasoning is set

out in her report. The recommendations which I have accepted and have resulted in

amendments to the draft Tipuna List are:

Re Kawau Block: That the tipuna listed in the above source (Original Owners Kawau Block 1884) be included in the Tipuna list in place of those from the currently cited source (Residue order for Kawau Block dated 4 Nov 1920).

Re Kerikeringa Block: That the tipuna named in the above source (Original list of owners Kerikeringa Block 1884) be included in the Tipuna List in place of those from the currently cited source (Residue order for Kerikeringa 5B Blk III Huiroa SD).

Re Onepoto Block: That the tipuna Tukirikau, Totara, Motunui and Taukawa be included in the Tipuna list in place of those listed from currently cited source (Freehold Order related to Onepoto Block)

Re Pukehou Block: That the tipuna named in the above source (Pukehou Schedule of Owners dated 9 June 1916) be included in the Tipuna list.

Re Pukerata Block: That the tipuna named in the above source (Pukerata List of Owners and Rents Received, AHJR 1907, Session 1) be included in the Tipuna list.

Re Pahautuhia: That the above list of PAHAUTUHIA owners (1 Mokau-Waitara MB 54-58) be included in the Tipuna List.

Re Whitianga: That the Original Whitianga List for Ngati Maru be used in place of the Whitianga Appellate List

3. 0 Ongoing research:. This section updates outstanding research required to complete the Tipuna

List and suggests on-going research post project.

Petitions: A researcher was engaged in Wellington to help find the outstanding petitions in archives

but this has not been successful. I have contacted National Archives directly and am engaging their

researchers to see if they can locate the documents themselves.

The value of pursuing the names of all petitioners needs to be reconsidered. 10 petitions have been

identified. Only 4 petitions (where signatories have been included) have been found despite

considerable time and effort and only names from 2 have been included in the Tipuna List.

Currently the names on the Tipuna List are sourced from documents from the time period 1882 to

1925, a span of 43 years or 2 generations. 4 petitions are 10-18 years outside this time span so

including these petitions would mean bringing another generation into the list. As a result I

recommend that we not include those petitions (Set A) and instead include those only in Set B and

this is where future efforts will be focussed:

- Petition 21/1935 of Te Kapua Rangataua and Another - Landless Members of Ngatimaru

Tribe

- Petition 61/1937 - Titi Te Ikahaehae Kupenga and 22 others re Pukemahoe Block

- Petition 174 of 1937, of Te Hekenui Whakarake and others concerning Ngatimaru Landless

Natives Lands (Pare has located this from the Raupatu document bank)

- Petition number: 54/1943 of Hekenui Whakarake of CastleCliffe Wanganui

Set B (included)

- Petition number 29/(Session I 1909) of Te Weri Haeretuterangi and 7 others

- Petition number 115 (1899) Tutanuku Tume and 72 others

- Petition number 314/1898 of Waingarunui and 16 others

Multiple Generations: There are instances of several generations within the list so there is still scope

to further refine. By way of example, Ko Tohe, ka puta ko Waingarunui Tohe, ka puta ko Paura

Waingarunui. Only Tohe needs to be on the list as all his descendants will be Ngati Maru. However,

we also need to be cautious in removing names and ensure all the implications are thought through.

Further research post project should include researching all successions to all tipuna on the list.

Aliases: As identified in Pare’s report, our tipuna had various aliases and there are variations on

spellings. Where this is obvious, I have merged the information and identified aliases. Again further

work needs to be done post project by researching successions to all those on the Tipuna List.

Consultation and feedback Consultation and feedback has commenced with the publication of the

previous memo on the Ngati Maru Website and interviews by members of the Runanga and publicity

on Te Korimako. We have received some feedback Ngati Maru whanau and look forward to hearing

more feedback from the hui next week. In particular we are interested in whether there are tipuna

not on the list who should be and whether there are tipuna on the list who should not be. We are

very keen for contributions and suggestions from the iwi to improve our work to date.

List Compilation: The schedule was compiled as a result of the research commissioned by the

Runanga and is a list of Ngati Maru ancestors identified from the following sources:

1. Schedule to the Purangi Landless Natives Act 1907

2. Schedule to the Ngati Maru Landless Natives Act 1907

3. Those persons who identified themselves as Ngati Maru in the Western Maori electoral roles

1908 and 1919.

4. Those persons listed as the original owners (or where the original list has not been located,

the most appropriate substitute) to the following land blocks granted by the West Coast

Reserves Commission:

Aotawa Kawau & Kerikeringaz Kopua Makahau Makino Mangaoapa Manutangihia & Te Nau Namunamu

Ngakorako & Mangahau Onepoto Paritutu Pohohitoa Pukehou Pukerata Puketui

5. Those persons who are listed as signatories to the following petitions:

The Schedule does not include:

1. Those persons who meet the above criteria but are known to have died leaving no issue.

Further research post project: Search succession orders of all tipuna on the list to determine

whether they had issue and if no issue then the names should be removed from the

Schedule for the purposes of this definition.

2. Those persons listed as owners of the following land blocks granted by the West Coast

Reserves Commission:

Reason: Original list not found yet. We are continuing efforts to try and locate the ownership

list for this block

Reason: The list of Owners for these blocks has been located but it is not always possible to

determine from the evidence which owners are Ngati Maru and which are not and therefore

including the owners of these blocks will compromise the integrity of the Ngati Maru Tipuna

List.

4. Those persons who are signatories to the following petitions:

- Petition 21/1935 of Te Kapua Rangataua and Another - Landless Members of Ngatimaru

Reason: It is submitted that the names of these ancestors not be included on the tipuna list.

The sales of these blocks occurred primarily in the 1870s and therefore a generation prior to

the determining ownership of the West Coast Settlement Reserves and the Ngati Maru A-F

Blocks (granted through Ngati Maru Landless Natives Act and the Purangi Landless Natives

Act). Including these tipuna is unnecessary because:

- such persons or their descendants are likely to be listed as owners in the West Coast

Reserves or the Ngati Maru and Purangi Landless Natives reserves and therefore

included in the Schedule;

- If we did include them in the Schedule this could result in duplication of tipuna from the

same lineage.

- The work required to clarify the descendants from these ancestors and thereby tidy up

the list will be very difficult particularly as there will be no Maori Land Court succession

records as these land blocks were sold by Deed.

- In some cases it is difficult to distinguish which sellers were Ngati Maru and which

belonged to other tribes as specific iwi were not referenced and therefore including

them will compromise the integrity of the Ngati Maru tipuna list.

Further Research post project: It is recommended that following the completion of this

project, that further research into the owners of these blocks be undertaken to determine

whether the Ngati Maru tipuna can be isolated and confidently included in the list without

unnecessary duplication within lineage or compromising the integrity of the list.

7. Those persons who are signatories to the following petitions:

- Henare Te Rangipiahouho and 12 others

Reason: With regards to the petition Henare Te Rangiahouho, these were tipuna of Ngati

Maru who had migrated to and settled on the Kapiti Coast. It is submitted that these

persons and their descendants not be included in the definition of Ngati Maru for the

purposes of the claim as they are now a separate iwi under the mana of Te Ati Awa ki

Whakarongotai.

Duplicated names and aliases - Some persons may be known by more than one name. Where this

has been identified by the research I have not specified all names but taken one version, usually the

most expansive and have now added in a column to record all variations, aliases and misspellings. It

is possible that some of the persons listed in the schedule are the same person under their

alternative names as identified in Pare’s research. Further research is required to determine these

persons.

Gender – I have included gender where the research has revealed the sex of the ancestors.
