Australia & New Zealand These Terms, Conditions and Rules are part of the INFOCUS ANZ Conference Corporate Promotion opportunities, and should be read before signing the Space Application Form. TERMS For the purpose of these Terms, Conditions and Rules, unless expressly stated to
the contrary, the following definitions apply: “Exhibition” means the Exhibitor Showcase conducted by the Organisers during
the Term in the Exhibition Hall; “Exhibitor” means an individual, company or other form of organisation that is
granted a right by the Organisers to occupy and use one or more booths as a participant exhibitor at the Exhibition; “Exhibition Fees” means fees payable by an Exhibitor to the Organisers for
participation as an exhibitor at the Exhibition; “Exhibition Hall” means the area allocated to the exhibition within The
Menzies Hotel Sydney, 14 Carrington Street Sydney in Australia; “Licence Agreement” means the terms and conditions contained in the license agreement between The Menzies Hotel Sydney and the Organizers for use and
occupation of the Exhibition Hall by the Organisers, a copy of which is available from the Organisers upon written request by an Exhibitor; “Licence” means the licence granted to the Exhibitor in the clause headed Licence;
“Organisers” means Quest Australia & New Zealand Users Group Inc, PO Box 1670, Lane Cove NSW 2066“ Term” means the period specified in the clause herein
headed Term. NATURE OF EXHIBITION The INFOCUS ANZ Exhibitor Showcase is an exhibit of products and services of
complimentary vendors of Oracle. Quest Australia & New Zealand Users Group Inc reserves the right to refuse rental of display space to any company whose display
of goods or services is not, in the opinion of Quest Australia & New Zealand Users Group Inc compatible with the general character and objectives of the Exhibitor Showcase. Quest Australia & New Zealand Users Group Inc reserves the right to
remove, at exhibitor cost, any merchandise deemed by the Conference Committee as not suitable for display at the Exhibitor Showcase. Quest Australia & New Zealand Users Group Inc reserves the right to remove, at exhibitor cost, any
Exhibitor staff or contractors deemed by the Conference Committee as not suitable to participate in the Exhibitor Showcase. Quest Australia & New
Zealand Users Group Inc does not represent that any space will be available to any applicant. If space is not available, a waiting list will be developed in the order of the date of receipt by Quest Australia & New Zealand Users Group Inc of
each completed Space Application Form. Quest Australia & New Zealand Users Group Inc will refund all payments received with the Space Application Form to any
applicant for whom space is not available or to whom exhibit privileges are not extended or are revoked for reasons other than violation of the rules and regulations, which follow.
TERM The term of the Licence is the period during which the Exhibitor is permitted by the Organisers to use and occupy their allocated space within the Exhibition Hall,
and includes the periods of move in and move out as notified to the Exhibitor by the Organisers.
LICENCE The Organisers, in consideration for the fees payable by the Exhibitor to the Organisers pursuant to these Terms, Conditions and Rules, grant to the
Exhibitor a nonexclusive licence to enter and occupy that part of the Exhibition Hall designated by the Organisers for the permitted use of the
Exhibitor participating as an exhibitor at the Exhibition, for the Term, and upon and subject to: (a) these Exhibitor Terms, Conditions and Rules; and
(b) the L icence Agreement. All terms and conditions contained in the Licence Agreement which are
applicable to the Exhibition (including definitions and rules for interpretation and enforcement of the Licence Agreement), and which are not inconsistent with or contrary to these Exhibitor Terms, Conditions and Rules, shall, to the extent
that they are not inconsistent or contrary, be deemed to be incorporated into, and form part of, these Exhibitor Terms, Conditions and Rules. INDEMNITIES The Exhibitor acknowledges that it occupies its allocated space within the Exhibition Hall at the risk of the Exhibitor. The Exhibitor hereby indemnifies, and
will keep indemnified, the Organizers, to the fullest extent permitted by law, from and against: (a) all claims, demands, writs, summonses, actions, suits, proceedings,
judgments, orders, decrees, damages, costs, losses and expenses of any nature whatsoever which the Organisers or any other person may suffer or incur in
connection with the loss of life, personal injury or damage to (or loss of ) property incurred or suffered directly or indirectly in connection with this Licence, or the Exhibitor’s use or occupation of its allocated space within the Exhibition Hall;
(b) all negligent or other wrongful loss and damage to the Exhibition Hall (and any property in or about the Exhibition Hall) incurred or suffered directly or indirectly in connection with this Licence, the entry temporary engaged or visited by the
exhibitor into and departure from the Exhibition Hall by the Exhibitor or any other person, (or any servant, employee, agent or contractor associated with any of
them) or any work being affected by the Exhibitor or any other person, their servants, employees, agents or contractors; and
(c) all losses, damages, costs and claims whatsoever arising in relation to a postponement, delay, interruption or cancellation of the Exhibition caused by the negligence or international wrong doing of Exhibitor; excluding loss and
damage to the extent that it is caused by the negligence of the Organisers. The Exhibitor agrees and acknowledges that the Organisers are not liable for or responsible to the Exhibitor for any loss of life, personal injury or damage to or
loss and which is not caused by negligence or intentional wrong doing of the organiser of property which may be suffered or sustained in or about the Exhibition
Hall including loss or damage arising from interruption, failure or variation of the supply of services of any kind to the Exhibition Hall including audio visual facilities, telephone, water, electricity and gas. Without limiting the generality
of the foregoing the Exhibitor releases the Organisers from all liability whatsoever the Organisers incur in relation to such loss, injury or damage described in this term other than international wrong doing any loss, injury or
damage to the extent that it is caused by the negligence of the Organisers. INSURANCE The Exhibitor shall effect and keep current during the Term, an insurance policy
or policies in respect of those insurable risks which the Organisers may nominate including: (a) public liability for an appropriate amount of cover being not less than
$10,000,000, or such other amount as may be reasonably determined by the Organisers and advised to the Exhibitor in writing;
(b) all risks property loss or damage; and (c) all necessary work cover, workers’ compensation and employer’s liability
insurance covering the Exhibitor’s employees and agents, and contractors of the
Exhibitor. Each insurance policy shall name and indemnify both the Exhibitor and the Organisers as co-insureds. The Exhibitor shall provide the Organisers with proof
of such insurances, and the insurer’s receipt for payment of the applicable premium, upon request by the Organisers.
PAYMENT OF EXHIBITOR’S FEES The Exhibitor shall pay all Exhibition Fees due of it to the Organisers in the
amounts, at the times and in the manner specified in the Organisers’ Invitation to
Exhibit, or as otherwise notified from time to time by the Organisers to Exhibitors. The Exhibitor is responsible for prompt payment of all its other accounts for
expenses incurred by it, or on its behalf, in connection with the Exhibition. If an Exhibitor fails to make prompt payment of its Exhibition Fees, or having made
such payment, fails to occupy its allocated space within the Exhibition Hall at
the times and in the manner specified by the Organisers, then the Organisers are entitled to unilaterally cancel the Exhibitor’s booth booking. The Organisers
are then at liberty, within their absolute discretion, to allocate the Exhibitor’s space within the Exhibition Hall to another Exhibitor. In those circumstances, the Exhibitor shall be liable to reimburse the Organisers’ costs and expenses
arising directly or indirectly as a result of such failures, and shall not be entitled to a refund of any Exhibition Fees paid or payable except as otherwise expressly
provided for in these terms, conditions and rules. Exhibition Fees payable by the
Exhibitor to the Organisers are inclusive of a goods and services tax (“GST”). WITHDRAWAL’S Exhibitors withdrawing from the Exhibition must give prompt written notice of that fact to the Organisers. If an Exhibitor gives to the Organisers written notice of withdrawal, which notice is received by the Organisers prior to 1st July 2014,
the Exhibitor shall be liable to the Organisers for, and shall pay to them, 50% of
the Exhibition Fees, or be entitled to receive a refund from the Organisers in that
amount, if Exhibition Fees had already been paid in full by the Exhibitor. When
an Exhibitor fails to give to the Organisers written notice of withdrawal, or such a notice, although given, is received by the Organisers on or after 1st July 2014, the
Exhibitor is liable to the Organisers for, and shall pay to them, the whole amount of Exhibition Fees due, and if Exhibition Fees had already been paid in full by the
Exhibitor, it is not entitled to any refund. Quest Australia & New Zealand Users
Group Inc assumes no responsibility for having included the name of the cancelled exhibitor or description of its products or services in the conference
Programme, brochures, news releases, or any other materials concerning the conference. PERMISSIONS The Exhibitor grants permission for the Exhibitor’s name and logo to be used on promotional material such as printed items and the event website, including
links from the event website to the Exhibitor’s website. RECIPROCAL PROMOTION
Quest Australia & New Zealand Users Group Inc grants permission to the
Exhibitor to use the INFOCUS ANZ logo to promote the Exhibitor’s participation in the event. The Exhibitor agrees to post the INFOCUS ANZ logo with link to the
INFOCUS ANZ website on the Exhibitor’s website. The Exhibitor is encouraged to promote their involvement with INFOCUS ANZ through social media, newsletters, direct marketing and other communication strategies. NOISE The use by an Exhibitor of a public address system during the course of the Exhibition requires the prior written approval of the Organisers, which approval
is within their absolute discretion. Requests for such permission must be made to the Organisers prior to commencement of the Exhibition. Exhibitors showing films, or in any way creating excessive noise, or using audio visual aids which
disturb adjacent Exhibitors shall, if so required by the Organisers in their absolute
Australia & New Zealand discretion, cease such activities, in the interests of other Exhibitors. The Organisers also reserve the right, in their absolute discretion, to require an Exhibitor to, and the Exhibitor shall following receipt of such a request, reduce the noise level of
any activity being conducted by it during the course of the Exhibition. COMPETITION
Exhibitors conducting raffles or competitions must first obtain, and then abide
by the rules of, all necessary licences, permits and approvals in compliance with the law. The Organisers reserve the right, in their absolute discretion, to prohibit, or require Exhibitors not to conduct, or to cease the conduct of, any
raffles, competitions or similar activities that the Organisers deem to be illegal or otherwise unsuitable. SUBLETTING OF EXHIBIT SPACE AND PROHIBITED USES
Exhibitors are prohibited from assigning or subletting any portion of their exhibit space to another company without the express written approval of the
Organisers. Vendor or Quest Australia & New Zealand Users Group Inc Business
Partner Members of the exhibiting company may participate within the space
occupied by the exhibiting company only if the participation of the Vendor or
Quest Australia & New Zealand Users Group Inc Business Partner Members is to
enhance the marketing efforts of the exhibiting company’s products/ services. Vendor or Quest Australia & New Zealand Users Group Inc Business Partner
Members are prohibited from marketing their own products/services within the
confines of another company’s exhibit space without the express written approval
of the Organisers. PROHIBITION OF SELLING PRODUCTS AND TAKING ORDERS FOR SHOW DELIVERY
Quest Australia & New Zealand Users Group Inc provides exhibit space for
exhibitors to display and demonstrate products on the basis of their potential informational and commercial value and not for the purpose of direct commerce. Orders during the exhibition may be taken but transactions involving the exchange
of product for payment are prohibited. FOOD AND BEVERAGES Exhibitor is not permitted to offer food or beverages to delegates. The serving of
alcoholic beverages by exhibitors in any part of the exhibit area is strictly prohibited. CANVASSING Exhibitors may not canvass or distribute promotional material other than from
their own stand. SECURITY Security guards will maintain perimeter security when the Exhibitor
Showcase is closed. However the exhibitor is solely and fully responsible for his own exhibit material. NAME BOARDS All stands must clearly show the registered or business name of the exhibiting
company. Shell scheme Exhibitors are advised that the company name appearing on their Name board may not be altered or added to in any way. Shell scheme
exhibitors are also reminded that their name board details must be consistent with their Programme entry. HEIGHT OF STANDS The height of shell scheme stands is limited to 2.4 metres. Any Exhibitor wishing
to exceed this should apply to the Organisers for rates and subsequent height restrictions. Double-deck and multi-storey stands are not permitted unless written
permission is obtained from the Organisers. Exhibitors exceeding a height of 2.4 metres must check with the Organisers that there are no physical height restrictions. (Please note all plans for free design stands must be submitted for approval). PARTITION WALLS AND ADJACENT SITES Where one Exhibitor wishes to exceed a height of 2.4 metres, that Exhibitor becomes responsible for both sides of the partit ion wall above 2.4 metres.
It must be of solid construction, suitably decorated on the reverse side to the requirement of the adjoining Exhibitor but carry neither titles nor advertising matter where the elevation looks over the lower stand. OBSTRUCTING GANGWAYS
No part of any stand or exhibit including fascia, signs, corner posts or fittings shall project into or overhang any gangways or obscure any fire or exit signs. WATER AND WASTE Water and waste services are available in certain areas of the Exhibitor Showcase. Exhibitors must, when booking space, verify that these are or can be installed
on site by the officially appointed contractor. The cost of the service and the installation is an additional charge.
TRAPS, SERVICE OPENINGS IN FLOORS, FIRE ALARMS AND HYDRANTS, EXIT SIGNS, ETC Traps and other service openings in floors must be left accessible at all times, and
where sited under stands, provision must be made for free access. Fire Alarms,
Hydrants, Exit signs, etc must not be masked, obstructed, moved or altered in
any way.
THE EXHIBITOR SHOWCASE VENUE No person shall attach any fixture or fitting to the floors, ceilings or walls of the
Exhibitor Showcase venue. Only approved adhesives are to be used to mark layout of stands. No nail, screw or other fitting is to be driven into any part of the Exhibitor Showcase venue. Approval is required for the use of balloons in
the Venue.
SHELL SCHEME STANDS The completion date for contractors building shell schemes is 6:00am on Monday
18 August 2014. In the event of any Exhibitor having a particularly elaborate interior, they should contact the Organisers to arrange a move-in time to facilitate completion on time. Nothing is to be removed from the structure of the
stands during breakdown. Cost of making good electrics, name boards etc will be charged to the Exhibitor. No persons shall cut through or into any part of the shell
scheme structure without written permission from the Organisers.
FIRE REGULATIONS The materials used by Exhibitors within their booths, and all fixtures and
fittings forming part of their display, shall be and comply with all applicable
standards relating to fireproof material. Fire extinguishers and firefighting
equipment must at al l t imes be visible and accessible and must not be removed from their correct location.
HEALTH REGULATIONS
Various regulations apply where food is served within the Exhibition Hall and
must be strictly observed.
STORAGE
Storage space available for Exhibitors at within the Menzies Hotel Sydney. vwnuThe Organisers will, at their discretion, use their best endeavors to provide
reasonable storage for Exhibitors within the venue, to store Exhibition materials, products and equipment, from 8:00am on Thursday 17 September 2015.
REMOVAL OF EXHIBITS
Exhibitors may not remove any products, on display during the course of the Exhibitor Showcase, without the express consent of the Organisers.
DISMANTLING The time allowed Exhibitors for dismantling booth fittings and displays will begin at 4:00pm and is to be finished by 6:00pm on Friday 18 September 2015 or
any other period as the Organisers may in their absolute discretion determine. Dismantling booth fittings and displays and general packing up is NOT to commence prior to this allocated start time. Should any Exhibitor so fail to remove
any of its materials, fixtures, fittings, equipment or any rubbish (“the Exhibitor’s property”) from the booth and the Exhibition Hall within the times stipulated,
then the Exhibitor shall be liable for, and shall indemnify the Organisers from and against, any claim by The Manzies Hotel Sydney as advised or other third party, occasioned by the Exhibitor’s failure to give vacant possession of any part of the
Exhibition Hall by the required time on the due date. The Organisers shall be entitled, but will not be obliged, to remove such of the Exhibitor’s property as the Organisers may determine at the cost of the Exhibitor who shall be liable for all
loss, expenses and costs thereby occasioned.
SITE PLAN
The Organisers reserve the right to alter the layout, plans and positions of stands if, in their opinion, this is desirable from the point of view of the Exhibitor Showcase as a whole.
BRANDING & PROMOTIONAL OPPORTUNITIES
In order to participate, Sponsors and Advertisers must adhere to the production requirements and timings set by the INFOCUS ANZ committee including supply of
the correct quantity of insert items needed for delegate satchels. Exceptions will not be made to the limit of one delegate satchel insert item per Sponsor where offered.
Items bundled by paper clip, rubber band or any other means will not be accepted. Unused items or items received too late for inclusion will be returned to Sponsor only if pick up of materials is arranged and paid for by the
Sponsor / Advertiser. There will not be an opportunity to replace delegate satchel insert items once they are received by INFOCUS ANZ committee nor will
any other opportunities be extended due to deadlines or requirements not met by Sponsors and/or Advertisers.
GALA EVENT No vendor is to put on any external event prior to 8pm on Thursday 17 September 2015
