WHEREAS the Planning Commission has forwarded to the City Council itsreports and recommendations regarding an amendment to the UDC for creation of twonew zoning districts the Commercial Compatible District and the Industrial CompatibleDistrict
WHEREAS the City Council has determined that certain uses which maycongregate large groups of people such as schools churches and commercial andindustrial uses may not be appropriate under airport flight zones or near hazardouspublic or private industrial facilities
WHEREAS the City Council has determined that this amendment to the UDC toestablish two new commercial and industrial compatible use districts is necessary toprotect the public health safety and general welfare of the City of Corpus Christi and itscitizens and
WHEREAS with proper notice to the public public hearings were held onWednesday September 26 2012 during a meeting of the Planning Commission andon Tuesday December 11 2012 during a meeting of the City Council during which allinterested persons were allowed to appear and be heard and

SECTION 1 The Unified Development Code UDC is amended by establishing newsection 48 Compatible Districts including its subparts and Tables482 and 483under Article 4 Base Zoning Districts to read as follows

SECTION 13 If for any reason any section paragraph subdivision sentence clausephrase word or provision of this ordinance is held to be invalid or unconstitutional byfinal judgment of a court of competent jurisdiction such judgment shall not affect anyother section paragraph subdivision sentence clause phrase word or provision ofthis ordinance for it is the definite intent of this City Council that every section paragraph subdivision sentence clause phrase word or provision of this ordinance begiven full force and effect for its purpose
SECTION 14 A violation of this ordinance or requirements implemented under thisordinance constitutes an offense punishable as provided in Article 1 Section 1101and Article 10 of the UDC Unless otherwise specifically stated within the provisions ofthis ordinance or the Code of Ordinances City of Corpus Christi any violation of thisordinance or the requirements implemented under this ordinance that is punishable by afine that exceeds the amount authorized by Section 1223 of the Texas Penal Codeshall require a culpable mental state of criminal negligence
SECTION 15 Publication shall be made in the official publication of the City of CorpusChristi as required by the City Charter of the City of Corpus Christi
