4th Amendment
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
4th Amendment Exceptions
• Incident to a Lawful Arrest (for weapons)• Stop and Frisk upon suspicious behavior• Consent• Plain View• Hot Pursuit• Vehicle searches with probable cause• Emergency Situations• Borders and Airports• Patriot Act
Miranda Rights
• You have the Right to Remain Silent• Anything you say can and will be used against you in
a court of law.• You have the Right to talk to an Attorney and have
him present while you are being questioned.• If you cannot afford to hire a lawyer, one will be
appointed to represent you before any questioning if you wish.
• You can decide at any time to exercise these rights and not answer any questions or make any statements.
Miranda Rights

Arraignment

Plea Bargaining
• Can occur at any time, but usually starts now• Reasons for defense?

Discovery
