DECISION AND ORPER
By this Decision and Order, the commission establishes
the Telecommunications Relay Services carrier
contribution factor at 0.0012 and establishes the projected
TRS fund size at approximately $218,640, effective July 1, 2011.
The carrier contribution factor and fund size established herein
of 0.0012 and approximately $218,640, respectively, are for the
2011 TRS funding period and each period going forward, until
revised otherwise by the commission.
I.
Background
On May 23, 2003, the commission issued Order No. 20193
in Docket No . 03-0058 ("Order No. 20193*) which, among other
things, ordered: (ll every telecommunications carrier providing
intrastate telecommunications service in the State of Hawaii
("State") to contract with SPRINT COMMUNICATIONS COMPANY, L.P.

( • Sprint •)' for the provision of TRS for the period beqinning
July 1, 2003 to June 30, 2006; (2) carrier contributions to the
TRS fund shall be based upon the carriers' gross operating
revenues from the retail provision of intrastate
telecommunications services during the preceding calendar year;
(31 contributions to the TRS fund shall be calculated as the
product of the carriers' gross operating revenues from the retail
provision of intrastate telecommunications services during the
preceding calendar year, which is subject to investigation by the
commission, and a contribution factor determined annually by the
commission; and (4) that the annual TRS funding period commences
on July 1"" and ends June 30"' of each year.
'In Docket No. 03-0058, the commission selected Sprint as the exclusive provider of intrastate TRS within the State from July l, 2003 to June 30, 2006. .SU Decision and order No. 20163, filed on April 30 2003, in Docket No. 03 - 0058; Order No. 20193. By Order No. 22438, filed on May 1, 2006, in Docket No. 03-0058, the commission extended Sprint's provision of TRS for an additional two years (from July 1, 2006 to June 30, 2008), and approved a price increase for Sprint's services under the extended period. By letter dated March 4, 2008, the commission selected Sprint to be the TRS provider for the period from July 1, 2008 to June 30, 2011. The price per session minute for TRS and Captel Relay Service remained at $1.90, however, the fixed monthly recurring charge was· increased from $34,000 to $38,000 per month (amended to $37,000 in 2009 to account for a reduction in the cost of offering Emergency Notification System in the State). By Decision and Order, issued on April 15, 2011, in Docket No. 2010-0302, the commission adopted the evaluation committee's selection of Sprint as the exclusive provider of intrastate TRS within the State for the service period commencing from July 1, 2011 to June 30, 2014, subject to execution of the service contract with Sprint.

II.
Investigation
By Order Initiating Investigation, filed May 11, 2011
(•Order Initiating Investigation•) , the commission initiated this
proceeding to examine whether to modify the TRS carrier
contribution factor and fund size, effective July 1, 2011,
established in accordance with Order No . 20193, and updated by
Order No. 21049, filed on June 10, 2004, in Docket No . 04-0070 ;
by Decision and Order No. 21847, filed on May 31, 2005, in Docket
No . 05-0088; by Decision and Order No. 22536, filed on June 16.
2006, in Docket No . 2006-0126; by Decision and Order No . 23481,
filed on June 7, 2007, in Docket No. 2007-0113; by Decision and
Order , filed on June 27, ~008, in Docket No. 2008-0089;
by Decision and Order, filed on June 9, 2009, in Docket
No . 2009-0095; and by Decision and Order , filed on May 24, 2010,
in Docket No. 2010-0070.
Specifically, in the Order Initiating Investigation,
the commission proposed to continue the existing carrier
contribution factor of 0.0012 for the 2011 TRS funding period and
each period going forward , until revised otherwise by the
commission. In addition, the commission proposed to maintain an
annual fund size of approximately $218, 640 which represents an
approximate 3. 0 month operating fund reserve for the 2011 TRS
funding period and each period going forward, until revised
otherwise by the commission .
The commission served copies of the Order Initiating
Investigation on the DIVISION OF CONSUMER ADVOCACY, DEPARTMENT OF

COMMERCE AND CONSUMER AFFAIRS (°Cansumer Advocate•), 2 Sprint, and
all chartered, certificated, and registered telecommunications
carriers in the State, except payphone providers,' at their
mailing addresses on file with the commission to solicit written
comments. The deadline for'written comments on the proposals was
May 31, 2011. As of the date of this Decision and Order, no
written comments were filed with the commission on any of the
commission's proposals.
Upon review, the commission finds the proposals in the
Order Initiating Investigation to be reasonable and in the public
interest. Accordingly, the carrier contribution factor shall
continue to be 0.0012 and the projected TRS fund size is
established at approximately $218,640, effective July 1, 2011.
The carrier contribution factor and fund size of 0. 0012 and
$218,640, respectively, are for the 2011 TRS funding period and
each period going forward, until revised otherwise by the
commission.'
'The Consumer Advocate is statutorily mandated to represent, protect, and advance the interests of all consumers of utility service and is an ~ officio party to all proceeding before the commission. ~ Hawaii Revised Statutes ( •HRS•) § 269-51 and Hawaii Administrative Rules (•HAR•) § 6-61-62.

'While a carrier • s contribution to the TRS fund is subject to investigation by the commission and the contribution factor is determined annually, the commission reserved the right to change the contribution factor at its discretion in Order No . 20193. See Order No. 20193 at 10, n.10 . Here, the commission makes clear that a new investigative proceeding regarding a carrier's contribution to the TRS fund will only be commenced if the commission determines that the carrier contribution factor should be revised.

III.
Orders
THE COMMISSION ORDERS:
1 . The carrier contribution factor shall be 0 . 0012
and the projected TRS fund size shall be approximately $218,640,
effective July 1, 2011. The carrier contribution factor and
fund size of 0.0012 and $218,640, respectively, are for the
2011 TRS funding period and each period going forward, until
revised otherwise by the commission.
2 . Hereafter, a new investigative proceeding will
only be initiated upon a commission determination that the
TRS carrier contribution factor should be revised.
3 . Each carrier shall complete and submit a TRS
Carrier Remittance Worksheet, found on the commission's website.
at http://puc.hawaii.gov/industries/Telecom/telcomforms, for the
2011 TRS funding period and each period going forward.
4. Annual contributions are due July 26"' of each
funding period; carriers who owe contributions of $1,200 or more
may pay in twelve equal monthly installments, due on the 26'" of
each month, provided that they submit their TRS Carrier
Remittance Worksheet by July 26"' of each funding period.
5. Carriers reporting $10,000 or less in gross
intrastate retail revenues shall contribute at least $12 . 00
for the 2011 funding period and each period going forward (i.e.,
July 1"' to June 30"' of each year) .
6. Every carrier. except Commercial Mobile Radio
Service ("CMRS-) providers, shall comply with the 30-day notice

requirement of HRS § 269-16 (b) and HAR § 6-80-40 (b) for any
TRS surcharge imposed on its customers, both residential and
business, to recover the amount of its contribution.
CMRS providers shall place information on their TRS surcharges on
their websites, consistent with Decision and Order No. 20890,
filed on April 7, 2004, in Docket No. 03-0186.
7. Order No. 20193, filed on May 23, 2003, in
Docket No. 03-0058, is amended consistent with the terms and
conditions of this Decision and Order. In all other respects,
Order No. 20193 remains unchanged.

Thank you for Sprint Relay's ("Sprinf') proposal in response to the Hawaii Public Utilities Commission's ("Commission/ Request for Services and for its interest in continuing to provide telecommunications relay services ("TRS") in the State of Hawaii. The Commission is pleased to select Sprint as the exclusive provider of ms in the State of Hawaii from July 1, 2008 to June 30, 2011 .
The Commission looks forward to continuing its positive relationship with Sprint, through its dedicated Life-Cycle Team, led by Ms. Maggie Schoolar, and Ms. UsaAnn Tom, as its local account manager. The Commission is dedicated to working with Sprint to ensure that high quality, reliable TRS is maintained throughout the State and to provide for the availab~ity of new features and services, where possible.
The Commission will forward a contract to you for completion and execution shortly. The contract will, however, be subject to final approvals prior to full contract execution and start of work by July 1, 2008.

SECTION ONE INTRODUCnON
1.1. TERMS AND ACRONYMS
"ASL" or "American Sign Language" means a visual language based on hand shape, poSition, movement and orientation of the hands in relation to each other and the body.
"ASCir means American Standard Code for Information lnterexchange, which employs an eight bit code and can operate at any standard transmission baud rate Including 300, 1200, 2400, and higher.
"Baudot" means a seven bit code, only five of which are information bits. Baudot is used by some text telephones to communicate with each other at a 45.5 baud rate.
"BREG" means the Hawaii State Department of Commerce and Consumer Affairs, Business Registration Division.
"CapTeiTM" means Captioned Telephone TRS technology which enables VCO users to speak to the called party directly and the voice response is enabled through voice-to-text captioning application displayed on the user's telephone.
"Commission" or "PUC" means Hawaii Public Utilities Commission.
"Communications Assistant" or "CA • means a person who transliterates or interprets conversation between two end users of TRS. CA supersedes the term "TOO operator:
"Contracting Officer" means the State of Hawaii Public Utilities Commission Chair.
"FCC" means Federal Communications Commission.
"GC" means General Conditions, iSSued by the Hawaii State Department of the Attorney General.
"GET" means General Excise Tax.
"HAR" means Hawaii Administrative Rules.
"HCE" means Hawaii Compliance Express.
"HAS" means Hawaii Revised Statutes.
"H.S.T." means Hawaii Standard Time.

"Hearing carry over" or "HCO• means a reduced form of TRS where the person with the speech dlsabUity is able to listen to the other end user and, In reply, the CA speaks the text as typed by the person with the speech disability. The CA does not type any conversation.
"lnterexchange carrier" or "IXC" means a telecommunications carrier that provides service between local exchange carriers. Commonly called a long-distance telephone company.
"Internet Protocol Relay" or "IP" means a text-based form of TRS that uses the Internet, rather than traditional telephone lines, for the leg of the call between the person with a hearing or speech disability and the CA. Otherwise, the call is generally handled like a TTY-based TRS call. The user may use a computer or other web-enabled device to communicate with the CA.
"Non-English language relay service• means a telecommunications relay service that allows persons with hearing or speech disabilities who use languages other than English to communicate with voice telephone users in a shared language other than English, through a CAwho is fluent in that language.
-Offeror• means any individual, partnership, firm, corporation, joint venture, or other entity submitting directly or through a duly authorized representative or agent, a bid for the goods, service, or construction contemplated.
"Pay-per-calr means a service, offered only using a 900 number, (a) providing audio information or entertainment; (b) providing access to simultaneous voice conversation; (c) including the provision of a product, where charges are assessed on the basis of completion of the call; or (d) for which the caller pays a per-call or per-time charge greater than the charge for the transmission of the call.
"Procurement Officer" means the Contracting Officer.
"PubUc Safety Answering Poinf' or "PSAP" means a facility that has been designated to receive 911 calls and route them to emergency services personnel.
"Qualified interpreter" means an interpreter who is able to interpret effectively, accurately, and impartially, both receptively and expressively, using any necessary specialized vocabulary.
"RFS" means Request for Services. For purposes of this document, RFS is equivalent to an Invitation For Bids, a.k.a. IFB.

"Selected Service Provider" means the Offeror awarded the contract by the Commission to provide TRS for the State from July 1, 2011 through June 30, 2014, with an option to extend an additional three (3) years, at the sole discretion of the Commission.
"Signaling System 7" or "SS7. means a standard for control signaling In the Public Switched Telephone Network.
"Speech-to-Speech relay service or "STS" means a telecommunications relay service that allows people with speech disabilities to communicate with voice telephone users through the use of specially trained CAs who understand the speech patterns of persons with disabilities and can repeat the words spoken by that person.
"Sprint Communications Co., LP" or "Sprint" means the current TRS service provider in the State.
"State• means State of Hawaii.
"Telecommunications carrier" or "Carrier" means any telecommunications carrier engaged In Interstate communication by wire or radio as defined In section 3(h) of the Communications Act of 1934, as amended (the "Acr), and any telecommunications carrier engaged In intrastate communication by wire or radio, notwithstanding section 2(b) and 221 (b) of the Act.
"Teleoommunlcations relay services• or "TRS" means telephone transmission services that provide the ability for an Individual who has a hearing or speech disability to engage in communication by wire or radio with a hearing individual In a manner that is functionally equivalent to the ability of an individual who does not have a hearing or speech disability to communicate using voice communication services by wire or radio. Such term includes services that enable two-way communicatiOn between an individual who uses a text telephone or other nonvoice terminal device and an Individual who does not use such a device, speech-to-speech services, video relay services and non-English relay services. TRS supersedes the term "dual party relay system," "message relay services," and "TOO Relay."
"Text telephone" or "TTY" means a machine that employs graphic communication in the transmission of coded signals through a wire or radio communication system. TTY supersedes the term "TOO" or "telecommunications device for the deaf," and "TT."
"VIdeo relay service" or "VAS" means a telecommunications relay service that allows people with hearing or speech disabiMties who use sign language to communicate with voice telephone users through video equipment. The video link allows the CA to view and Interpret the party's signed conversation and relay the conversation back and forth with a voice caller.

·voice carry over" or "VCO" means a reduced form of TRS where the person with the hearing disability is able to speak directly to the other end user. TheCA types the response back to the person with the hearing disability. The CA does not voice the conversation.
'Wireless Relay" means a telecommunications relay service provided through the use of a wireless device, allowing a person with a hearing or speech disabMity to make a relay call while mobile.
1.2. OVERVIEW
The purpose of this RFS is to select a telecommunications relay services provider to provide telecommunications relay services for the period beginning July 1, 2011 and ending June 30, 2014, with an option for three (3) additional years at the Commission's discretion. The source of revenue for the service described herein will be a percentage surcharge upon the revenues of every telecommunications carrier in the State, except payphone providers.
1.3. ISSUING OFFICE
This RFS is issued by the PUC. The PUC is the D. point of contact concerning this RFS.
