ZONING ORDINANCE
Zoning is the division of the community into zones or districts (e.g. commercial,
residential, industrial, and institutional, etc.) according to present and potential uses of land to
maximize regulate and direct their use and development in accordance with Comprehensive Land
Use Plan of the community. It takes the form of locally enacted ordinance which embodies, among
others, regulating affecting uses allowed or disallowed in each zone or district, conditions allowing
them and deviations legally allowed from requirements of the ordinance.
Zoning is concerned primarily with the use of land and control of density of population
through imposition of building heights, bulk open space and density provision in a given area.
BENEFITS
The benefits attributes to zoning are as follows:
1. Maximum optimum use of land based on suitability/capability, e.g. use of prime
agricultural land for agricultural purposes.
2. Promotion of public health and safety through compatible arrangement of various
land use, e.g. residential area should maintain considerable distance from
industries.
3. Preservation of desirable character and real estate values of district or zones.
4. Promotion of the rational and orderly growth of the community.
LEGAL BASES
The power to zone is derived from the police power of the state which vest in the legislative body
the power to make, ordain and establish reasonable laws, statutes or ordinances promote the
general welfare. It is specified and defined in a number of laws and

and enhance the right of all the people to human dignity, reduce social and

acquisition, ownership use and disposition of property and its increments.”
2. Section 20 of RA 7160, “THE NEW LOCAL GOVERNMENT CODE”
Reclassification of Lands. A.) A municipality may, through an Ordinance passed by
the Sanggunian after conducting public hearings for the purpose, authorize the
reclassification of agricultural lands and provide for the manner of their utilization or
disposition in the following cases: (1) when the land ceases to be economically

feasible and sound for agricultural purposes as determined by the Department of
Agriculture or (B) where the land shall have substantially greater economic value for
residential, commercial or industrial purposes, as determined by the Sanggunian
concerned: provided that such reclassification shall be limited to the following
percentage of the total agricultural land area at the time of the passage of the ordinance:
(1.) for first to third class municipalities, ten percent (10%); and
(2.) for fourth to sixth class municipalities, five (5%): provided, further, that
agricultural lands distributed to agrarian reform beneficiaries pursuant to Republic
Act
numbered Sixty Six Hundred Fifty Seven (RA No. 6657) , otherwise known as
“The Comprehensive Agrarian Reform Law”, shall not be affected by the said
reclassification and the conversion of such lands into other purposes shall be
governed by Section 65 of said act.
a.) the President may when public interest so requires and upon recommendation
of the National Economic Development Authority (NEDA), authorize a
municipality to reclassify lands in excess of the limits set in the next preceding
paragraph.
b.) the Local Government Unit shall, in conformity with existing laws, continue
to prepare their respective comprehensive land use plans enacted through
zoning
ordinances which shall be the primary and dominant bases for the future use of
land resources: provided, that the requirements for food production, human
settlements, and industrial expansion shall be taken into consideration in the
preparation of such plans. c.) where approval by a national agency is require for
reclassification, such approval shall not be unreasonably withheld. Failure to act
on a proper and application within three (3) months from receipt of the same shall
be deemed as approval, thereof.
3. Section 447 A.2 (VII-IX) and Section 458 A.2 (VII-IX) of RA 7160
The Sangguniang Bayan, as the legislative body of the municipality, shall: (a) adopt a
comprehensive land use plan for the municipality: provided, that the formulation,
adoption, or modification of said plan shall be in coordination with the approved
provincial comprehensive land use plan; (b) reclassify land within the jurisdiction of
the municipality, subject to the pertinent provisions of this code; (c) enact integrated
zoning ordinances in consonance with the approved comprehensive land use plan,
subject to existing laws, rules and regulations, establish fire limits or zones, particularly
in populous centers, and regulate the construction, repair or modification of buildings
within said fire limits or zones in accordance with the provisions of the fire code.
4. P.D 1396 (Amending P.D 933) Creating the Ministry of Human Settlements,
renaming the Human Settlements Commission as the Human Settlements Regulatory
Commission.
“It is hereby declared to be the policy of the government to foster the growth and
renewal of our communities, both rural and urban, in and integrative manner that
promotes optimum land use, adequate shelter, environmental protection, utilization of
appropriate technology and rational interdependence among self-reliant
communities.”

5. LETTER OF INSTRUCTION NO. 729
“Municipalities shall submit their land use plans’ enforcement system and
implementing guidelines, including zoning ordinance to the Ministry of Human
Settlements
thru the HLURB for review and ratification.”
6. Section 5, Executive Order 648, Reorganizing the Human Settlements Regulatory
Commission.
The HLURB shall: a.) promulgate zoning and other land use control standards and
guidelines which shall govern land use plans and zoning ordinance of local
governments ”
a. Review, evaluate and approve or disapprove comprehensive land use development
plans and zoning ordinances of local governments”
c.) Issue rules and regulations to enforce the land use policies on human settlements
as provided for in PD Nos. 399, 815, 933, 957, 1216, 1344, 1396, 1517, LOI Nos.
713, 729, 935 and other related laws regulating the use of land.”
7. PD 933 and EO 648 as amended by EO 90, empower the HLURB to review and
approve or disapprove Land Use Plans of Municipalities.
The aforesaid laws likewise authorize the HLURB to prescribe the standards and
guidelines governing the preparation of land use plans, to monitor the implementation
of such plans and to adjudicate and settle the disputes among LGUs over their land use
plans and zoning programs.

MUNICIPAL ORDINANCE ADOPTING THE COMPREHENSIVE LAND USE PLAN
AND ENACTING THE ZONING ORDINANCE
“WHEREAS, San Jose de Buenavista is a fast urbanizing community and this
development trend was influenced by its being a strategic center of trade and commerce in the
province of Antique as well as being the seat of government for the entire province;
‘WHEREAS, as San Jose de Buenavista is the preferred investment location of
entrepreneurs and investors, there is a need for the municipality to have an approved
Comprehensive Land Use Plan in order for prospective investors to locate their respective
businesses in the municipality;
“WHEREAS, the implementation of the Comprehensive Land Use Plan would require the
enactment of regulatory measures to translate its planning goals and objectives into reality, and a
Zoning Ordinance is one such regulatory measure which is an important tool for the
implementation of the Comprehensive Land Use Plan;
“WHEREAS, the Local Government Code authorized local government units to enact
zoning ordinances subject to and in accordance with existing laws;
“WHEREAS, the Housing and Land Use Regulatory Board has spearheaded and now
assists in and coordinates the activities of local governments in comprehensive land use planning;
“NOW, THEREFORE, on motion of SB Member Arthur D. Moscoso and seconded en
masse, be it
“RESOLVED, as it is hereby resolved, to adopt the Comprehensive Land Use Plan (CLUP)
and enacting the Municipal Zoning Ordinance of the Municipality of San Jose de Buenavista,
Antique;
AN ORDINANCE ADOPTING THE COMPREHENSIVE LAND USE PLAN AND
ENACTING THE ZONING ORDINANCE
Be it ordained by the Sangguniang Bayan of San Jose de Buenavista, Antique in session
assembled that:

ARTICLE I
TITLE OF THE ORDINANCE
Section 1. Title of Ordinance. This Ordinance shall be known as the Comprehensive
Land Use Plan and Zoning Ordinance of the Municipality of San Jose de
Buenavista, Antique, Philippines.
ARTICLE II
AUTHORITY AND PURPOSE
Section 1. Authority. This Ordinance is enacted pursuant to the provisions of the new
Local Government Code, RA 7160 Sections 458 a.2 (7-9) and 447 a.2 (7-9) dated 10
October 1991, “authorizing the municipality through the Sangguniang Bayan to
adopt Zoning Ordinance subject to the provisions of existing laws and in conformity
with EO No. 72.
Section 2. Purposes. This Ordinance is enacted for the following purposes:
a. Guide, control and regulate future growth and development of the Municipality of
San Jose de Buenavista, Antique in accordance with its Comprehensive Land Use
Plan.
b. Protect the character and stability of residential, commercial, industrial,
institutional, agricultural, open space and other functional areas within the
locality and promote the orderly and beneficial development of the same.
3. Promote and protect the health, safety, peace, comfort, convenience
and general welfare of the inhabitants in the locality.
ARTICLE III
DEFINITION OF TERMS
The definition or technical terms used in the Zoning Ordinance shall carry the same meaning
given to them in already approved codes and regulations, such as but not limited to the National
Building Code, Water Code, Philippine Environmental Code and other Implementing Rules and
Regulations, promulgated by the HLURB. The words, terms and
phrases enumerated hereunder shall be understood to have the meaning corresponding indicated
as follows:
1. Agricultural Zone (AGZ) – an area WITHIN A MUNICIPALITY INTENDED for
cultivation/fishing and pastoral activities, e.g. fish, farming, cultivation of crops,
goat/cattle raising, etc.
2. Agro-Industrial Zone (AIZ) – an area WITHIN A MUNICIPALITY INTENDED
primarily for integrated farm operation and related product processing activities such
as plantation for bananas, pineapple, sugar, etc.
3. HLURB/Board – shall mean the HOUSING AND LAND USE REGULATORY
BOARD.

4. Buffer-Area - these are YARDS, PARKS or Open Spaces INTENDED to separate
incompatible elements or uses to control pollution/nuisance and for identifying and
defining development areas or zones where NO PERMANENT STRUCTURES ARE
ALLOWED.
5. Built-Up Area – a contiguous grouping of ten (10) or more structures.
6. Central Business District – shall refer to area designated principally for trade services
and business purposes (Commercial Zone).
7. Certificate of Non-Conformance – certificate issued TO OWNERS OF all uses existing
prior to the approval of the Zoning Ordinance which do not conform in a zone as per
provision of the said Ordinance.
8. Compatible Use – uses or land activities capable of existing together harmoniously,
e.g. residential use and parks and playground.
9. Component Municipalities – which so not meet the requirements for highly urbanized
cities shall be considered component cities of the province in which they are located.
10. Comprehensive Land Use Plan (CLUP) – a document embodying specific proposals
for guiding, regulating growth and/or development. The main components of the
Comprehensive Land Use Plan in this usage are the sectoral studies, I.e. Demography,
Socio- economic, Infrastructure and Utilities, Local Administration and Land Use.
11. Conflicting Uses – uses or land activities with contrasting characteristics sited adjacent
to each other, e.g. residential uses adjacent to industrial plants.
12. Conforming Use – a use which is in ACCORDANCE with zone classification as
provided in the ordinance.
13. Easement – open space imposed to land use / activities sited along waterways, road
right of ways, cemeteries / memorial parks and utilities.
14 Environmentally Critical Areas – refer to those which are environmentally sensitive
and are listed in Presidential Proclamation 1146 dated December 14, 1981.
15. Environmentally Critical Projects – refer to those projects which have high potential
for negative environmental impacts and are listed in Presidential Proclamation 2146
dated December 14, 1981.
16. Exception – a device which grants a property owner relief from certain provisions of
a Zoning Ordinance where because if the specific use would result in a particular
hardship upon owner, as distinguished from a mere inconvenience or a desire to make
more money.
17. General Commercial Zone (GCZ) – an area within a municipality for
trading/services/business purposes.
18. General Institutional Zone (GIZ) – an area within a municipality principally for
general types of institutional establishments, e.g. government offices, schools,

hospital/clinics, academic/research, convention centers.
19. General Residential Zone (GRZ) – an area within a municipality principally for
dwelling/housing purposes.
20. General Zoning Map – a duly authenticated map delineating the different zones in
which the whole municipality is divided.
21. Gross Floor Area (GFA) – the GFA of a building is the total floor space within the
perimeter of the permanent external building wall occupied by:
- office areas
- residential areas
- corridors
- lobbies
- mezzanine
- vertical penetrations, which shall mean stairs, fire escapes,
elevator shafts, pipe shafts, vertical ducts, and the like, and their
enclosing walls
- rest rooms or toilets
- machine rooms and closets
- storage rooms and closets
- covered balconies and terraces
- interior walls and columns and other interior features
but excluding:
- covered areas used for parking and driveways, including
vertical penetrations in parking floors where no residential or office
units
- uncovered areas for cooling towers, overhead water tanks, roof
decks, laundry areas and cages, wading or swimming pools,
whirlpools or jacuzzis, gardens, courts or plazas
22. Innovative Design – introduction and/or application of new/creative designs and
techniques in development projects, e.g. PLANNED UNIT
DEVELOPMENT (PUD), New Town, etc.
23. Locational Clearance – a clearance issued to a project that is allowed under the
provisions of this Zoning Ordinance as well as other standards
rules and regulations on land use.
24. Mitigating Clearance – a means to grant relief in complying with certain provisions
of the Ordinance.
25. New Town – shall refer to a town deliberately planned and built which provides, in
addition to houses, employment, shopping, education,
recreation, culture and other services normally associated with a town.
26. Non-Conforming Use – existing non-conforming uses/establishments in an area
allowed to operate inspite of the non-conformity to the
provisions of the Ordinance subject to the conditions stipulated in this Zoning
Ordinance.

27. Parks and Recreation Zone (PRZ) – an area designated for diversion/amusements and
for the maintenance of ecological balance of the community.
28. Piggery Farm – shall refer to any parcel of land devoted to the raising or breeding of
pigs/swine, generally under the management
of a tenant or owner.
29. Planned Unit Development (PUD) – it is a land development scheme wherein project
site is comprehensively planned as an entity
via unitary site plan which permits flexibility in planning/design, building siting,
complementarily of building types and land uses,
usable open space and the preservation of significant natural land features.
30. Poultry Farm – shall refer to a parcel of land devoted to the raising of domesticated
fowls which serve as the sources of eggs and meat
for human consumption. It includes chicken, ducks, geese, quails and pigeons.
31. Rezoning – process of introducing amendments to or a change in the text and maps of
the Zoning Ordinance. It also includes amendment
or change in view of reclassification under Section 20 of RA 7160.
32. Setback – the open space left between the building and lot lines.
33. Urban Areas – includes all barangay/s or portion/s of which comprising the
Poblacion, Central Business District (CBD) and other built-up
including the urbanizable land in and adjacent to said areas and where at least more
than fifty percent (50%) of the population are engaged
in non-agricultural activities. CBD shall refer to areas designated principally for
trade, services and business purposes.
34. Urban Zoning Map – a duly authenticated map delineating the different zones into
which the urban area and its expansion area are divided.
35. Variance – a SPECIAL LOCATIONAL CLEARANCE which grants a property
owner relief from certain provisions of Zoning Ordinance
where because of the particular, physical surrounding, shape or topographical
conditions of the property, compliance of height, area,
setback, built and/or density would result in a particular hardship upon the owner, as
distinguished from a mere inconvenience or a desire
to make more money.
36. Warehouse – refers to a strorage and/or depository of those in business of performing
warehouse services for others, for profit.
37. Water Zone (WZ) - are bodies of water within a municipality for specific land use
as defined by manmade or natural boundaries.
38. Zone/District – an area within a municipality for specific land use as defined by
manmade or natural boundaries.
39. Zoning Administrator/Zoning Officer - a municipal government employee
responsible for the implementation/enforcement of
Zoning Ordinance in a community.

40. Zoning Ordinance – a local legal measure which embodies regulations affecting land
use.
ARTICLE IV
ZONE CLASSIFICATION
Section I. Division into Zones or Districts. To effectively carry out the provisions of
this Ordinance, the municipality is hereby divided into
the following zones or districts as shown in the Official Zoning Maps.
1. General Residential Zone (GRZ)
2. Socialize Housing Zone (SHZ)
3. General Commercial Zone (GCZ)
4. General Institutional Zone (GIZ)
5. Agricultural Zone (AGZ)
6. Agro-Industrial Zone (AIZ)
7. Light Industrial Zone (LIZ)
8. Cemetery/Memorial Park (CMP)
9. Dumping Site/ Sanitary Landfill (DS/SL)
10. Parks and Recreation Zone (PRZ)
11. Conservation Zone (CZ)
12. Swamps/Marshes (S/M)
13. Mangrove (M)
14. Tourism Zone (TZ)
15. Transportation, Utilities Zone (T/U)
16. Marine Protection Zone (MPZ)

Section 2. Zoning Maps.
It is hereby adopted as an integral part of this ordinance, the official Zoning Maps
for urban areas and for the whole municipality (General), wherein the designation,
location and boundaries of the districts/zones herein established are shown and
indicated Such Official Zoning Maps shall be signed by the Local Chief Executive
and duly authenticated by the SANGGUNIANG PANLALAWIGAN.
Section 3. Zone Boundaries.
The locations and boundaries of the above-mentioned various zones into which the
municipality has been divided are hereby identified and specified as follows:
GENERAL RESIDENTIAL ZONE (GRZ): Those color yellow in the Proposed Land Use Plan
Map and Zoning Map are zoned as General Residential Zone (Please refer to Zoning Map).
GRZ(B203) - An L shape of land located at Barangay Durog measuring about 1,200 meters long
from the mouth of shoreline and about 100 meters wide bounded by the proposed road and
proposed commercial area in the proposed San Pedro International Transshipment Port on the
south and agricultural land AGZ(B1) on the north containing an area of 16.85 hectares more or
less.

GRZ(B200) - An irrigular shape of land located at Barangay San Pedro measuring about 400
meters long and about 320 meters wide bounded by the proposed commercial area GCZ(B19),
general institutional zone GIZ(B1) and GCZ(B68) in the west. GCZ(B19) in the east, Tating Street
on the south and GCZ(B19) on the north containing an area of 10.65 hectares more or less.
GRZ(B111) - An irrigular shape of land located at between Barangay San Pedro and Barangay
Mojon measuring about 2200 meters long and about 500 meters wide bounded by the coastline on
the west , Bantayan San Pedro National Road and Bagumbayan Street (Brgy. Road) on the East,
proposed commercial area GCZ(B20) on the north and tourism area TZ(B3) at the south containing
an area of 80.34 hectares more or less.
GRZ(B99) - A trapezoidal shape of land located at Barangay San Pedro measuring about 200
meters long and about 140 meters wide bounded by the Bantayan-San Pedro National Road on the
west , San Pedro Street on the East, Tating Street on the north and San Pablo Street on the south
containing an area of 2.47 hectares more or less.
GRZ(B110) - A trapezoidal shape of land located at Barangay San Pedro measuring about 150
meters long and about 34 meters wide bounded by Bagumbayan Street on the west , Barangay
Road on the East, proposed commercial area GCZ(B30) on the north and barangay road at the
south containing an area of 0.47 hectare more or less.
GRZ(B106) - A rectangular shape of land located at Barangay San Pedro measuring about 150
meters long and about 40 meters wide bounded by Bagumbayan Street on the west , Barangay
Road on the East, San Pablo Street on the south and barangay road at the north containing an area
of 0.59 hectare more or less.
GRZ(B98) - A trapezoidal shape of land located at Barangay San Pedro measuring about 45
meters long by 40 meters wide bounded by the barangay road on the west , Bantayan San Pedro
National Road on the East, proposed commercial area GCZ(B67) on the north and San Pablo
Street on the south containing an area of 0.19 hectare more or less.
GRZ(B107) - A trapezoidal shape of land located at Barangay San Pedro measuring about 123
meters long by 115 meters wide bounded by the barangay road on the west , San Pedro Street on
the East, San Pablo Street on the north and barangay road on the south containing an area of 1.0
hectare more or less.
GRZ(B117) - A trapezoidal shape of land located at Barangay San Pedro measuring about 286
meters long by 181 meters wide bounded by the Bagumbayan Street road on the west , Atabay San
Pedro National Road on the East, San Pablo Street on the north and barangay road on the south
containing an area of 5.26 hectares more or less.
GRZ(B101) - A trapezoidal shape of land located at Barangay San Pedro measuring about 123
meters long by 80 meters wide bounded by the barangay road on the west , San Pedro Street on
the East, Barangay road on the north and national road (Rizal St.) on the south containing an area
of 1.0 hectare more or less.
GRZ(B102) - A trapezoidal shape of land located at Barangay San Pedro measuring about 123
meters long by 50 meters wide bounded by the Bantayan-San Pedro National Road on the west ,
Barangay Road on the East, national road (Rizal St.) on the north and barangay road on the south
containing an area of 0.61 hectare more or less.

GRZ(B103) - A trapezoidal shape of land located at Barangay San Pedro measuring about 123
meters long by 66 meters wide bounded by barangay road on the west , San Pedro (Barangay Road)
on the East, national road (Rizal St.) on the north and barangay road at the south containing an
area of 0.81 hectare more or less.
GRZ(B100) - A trapezoidal shape of land located at Barangay San Pedro measuring about 128
meters long by 88 meters wide bounded by the San Pedro St. on the west , Barangay Road on the
East, national road (Rizal St.) on the north and barangay road on the south containing an area of
1.15 hectare more or less.
GRZ(B112) – A trapezoidal shape of land located at Barangay San Pedro measuring about 126
meters long by 73 meters wide bounded by the Bantayan San Pedro National Road on the west
,barangay road on the East, barangay road on the north and barangay road on the south containing
an area of 0.83 hectare more or less.
GRZ(B104) - A trapezoidal shape of land located at Barangay San Pedro measuring about 123
meters long by 58 meters wide bounded by the barangay road on the west , barangay road on the
East, barangay road on the north and barangay road on the south containing an area of 0.72 hectare

TZ(B9) An irregular shape of land located at Barangay Funda-Dalipe measuring about 430 meters
long by 50 meters wide bounded by coastal road on the west, GRZ(B72) on the east, GRZ(B72)
on the north, and Taringting Street on the south containing an area of 2.14833 hectares more
or less.
TZ(B12) - An irregular shape of land located at Barangay Funda-Dalipe measuring about 682

TZ(B6) – A triangular shape of land located at Barangay Funda-Dalipe measuring about 99

TZ(B7) An irregular shape of land located at Barangay Funda-Dalipe measuring about 241 meters
long by 50 meters wide bounded by coastal road on the west, GRZ(B71) on the east, San Jose

TZ(B10) - An irregular shape of land located at Barangay Madrangca measuring about 483 meters

PRZ(B1) – A trapezoidal shape of land located at Barangay San Pedro measuring about 246
meters long by 114 meters wide bounded Real Street on the west, barangay road on the east,
Rizal Street on the north, and San Pablo Street on the south containing an area of 1.96 hectares
more or less.
PRZ(B2) – An irregular shape of land located at Barangay 7 measuring about 150 meters long
by 148 meters wide bounded Recarze Street on the west, Gov. Villavert Street on the east, Solana

long by 159 meters wide bounded by AGZ(B12) on the west, AGZ(B12) on the east, AGZ(B12)

MARINE PROTECTION ZONE (MPZ). Hatch blue color in the marine water body of the
Proposed Land Use Plan Map and Zoning Ordinance Map is Marine Protection Zone.
MPZ - An irregular shape of marine water body located at Cuyo East Pass between Barangay
Funda Dalipe and Barangay Madrangca measuring about 450 meters long by 311 meters wide
containing an area of 10 hectares more or less.
RECLAMATION AREA. Sky blue color in the Proposed Land Use Plan Map and Zoning Map
is proposed for Reclamation Area.
- An irregular marine water body located between Barangay Maybato South, Barangay
Maybato North, Barangay San Angel, Barangay Malaiba, Barangay 8, and Barangay 4
measuring about 3174 meters long by 238 meters containing an area of 80 hectares more
or less.
TRANSPORTATION/UTILITIES (T/U). Those gray color in the Proposed Land Use Plan
Map and Zoning Map are zoned for Transportation / Utilities Uses.
T/U (B1) - An irregular shape of land located between Barangay Durog and Barangay San Pedro
measuring about 1265 meters long from shoreline by 426 meters wide bounded by shoreline on
the west, proposed port wharf on the east, proposed port wharf on the north, and proposed port
wharf on the south containing an area of 42.54 hectares more or less.
T/U (B1-2) - An irregular shape of land located between Barangay Durog and Barangay San
Pedro measuring about 12500 meters long from shoreline declared as Proposed Quarry Area
and Processing Plant containing an area of 0.8037261513 hectares more or less.
T/U (B1-3) - An irregular shape of land located between Barangay Durog and Barangay San
Pedro measuring about 12500 meters long from shoreline declared as portion of river
channel containing an area of 4.210460159 hectares more or less.
T/U (B2) - A rectangular shape of land located between Barangay Funda Dalipe measuring about
2197 meters long by 397 meters wide bounded by GRZ(B72) on the west, GRZ(B72) & GRZ

T/U (B3) A rectangular shape of land located between Barangay 4 measuring about 120 meters
long by 80 meters wide bounded by GRZ(B201) on the west, marine water on the east,
GRZ(B201) on the north, and marine water on the south containing an area of 1.1488 hectares
more or less.
1. Water Zone (WZ) - Marine water body (Municipal water) about 14.0
kms by 15.0 kms from coastline bounded by 14 coastal barangays and
extended 15kms from shoreline of Cuyo East Pass is Municipal Water
zone of San Jose.
Section 4. Interpretation of the Zone Boundary.
In the implementation of the boundaries for any of the zones indicated on the
Zoning Map, the following rules shall apply:
1. Where zone boundaries are so indicated that they approximately follow the
center of streets or highway right of way lines,
shall be construed to be the boundaries.
2. Where zone boundaries are so indicated that they approximately follow the
lot lines shall be construed to be the boundaries.
3. Where zone boundaries are so indicated that they are approximately parallel
to the center lines or right of way lines of streets
and highways, such zone boundaries shall be construed as being parallel
thereto and at such distance there from as indicated in
the zoning map. If no distance is given, such dimension shall be determined
by the use of the scale shown in said zoning map.
Where the boundary of a zone follows approximately a railroad line, such
boundary shall be deemed to be railroad right of way.
ARTICLE V
ZONE REGULATIONS
Section 1. General Provision; The uses enumerated in the succeeding sections are not
exhaustive nor all inclusive. The LOCAL ZONING BOARD OR ADJUSTMENT
AND APPEALS (LZBAA) shall, subject to the requirements of this Article, allow
other uses not enumerated hereunder provided that they are compatible with the
uses expressly allowed.
Allowance of further uses shall be based on the intrinsic qualities of the land and
the socio-economic potential of the locality with due regard to the maintenance of
the essential qualities of the zone.
Section 2. Use Regulations in General Residential Zone (GRZ). A GR Zone shall be used
principally for dwelling/housing purposes so as to maintain peace and quite of the
area within the zone. The following are the allowable uses:

a. The number of persons engaged in such business / industry shall
exceed five (5) inclusive of the owner;
b. There shall be no change in the outside appearance of the building
premises;
c. No home occupation shall be conducted in any customary accessory
uses cited above;
d. No traffic shall be generated by such home occupation in greater
volume than would normally be met off the street and in a place
other than the required front yard;
e. No equipment or process shall be used in such home occupation
which creates noise, vibration, glare, fumes, odors and electrical
interference in any radio or television receiver or causes fluctuations
in line voltage off the premises.
13. Home industry classified as cottage industry provided that:
a. Such home industry shall not occupy more than thirty (30%) of the
floor area of the dwelling unit. There shall be no change or
alternation in the outside appearance of the dwelling unit and shall
not be a hazard or nuisance.
b. Allotted capitalization shall not exceed the capitalization as set by
the Department of Trade and Industry (DTI).
14. Recreational facilities for the exclusive use of the members of the family
residing within the premises, such as;
a. Swimming pool
b. Pelota court
c. Others

17. Vocational School

schools, technical schools and other institution of higher learning.
4. General hospitals, medical centers, multi-purpose clinics
5. Scientific, cultural and academic centers and research facilities except
nuclear, radioactive, chemical and biological warfare facilities.
6. Convention centers and related facilities.
7. Religious structures, e.g. church, seminary, convents.
8. Museums.
9. Embassies / consulate
10. Students housing, e.g. dormitories, boarding house.
Section 5. Use Regulations for Agricultural (Agr.) Zone (AGZ). In Agr. Zone the
following uses shall be permitted:
1. Cultivation, raising and growing of staple crops such as rice, corn, camote,
cassava and the like.
2. Growing of diversified plants and trees, such as fruit and flower bearing trees,
coffee, tobacco, etc.
3. Siriculture, mushroom culture, fishing and fish culture, snake culture, crocodile
farm, monkey raising and the like.
4. Customary support facilities such as palay dryers and treshers and storage barns
and warehouses.
5. Ancillary dwelling units/farmhouses for tillers and laborers.
6. Agricultural research and experimentation facilities such as breeding stations,
fish farms, nurseries, demonstration farms, etc.
7. Pastoral activities such as goat raising and cattle fattening.
8. Home occupation for the practice of one’s profession or engaging home
businesses such as dressmaking, tailoring, baking, running a sari-sari store and
the like provided that:
a. Number of persons engaged in such business/industry shall not
exceed five (5), inclusive of the owner;
b. There shall no change in the outside appearance of the building
premises.
c. No home occupation shall be conducted in any customary uses cited
above.
d. No traffic shall be generated by such home occupation in greater
volume than would normally be met off residential neighborhood
and any need for parking generated by the conduct of such home
occupation shall be met off the street in a place other than the
required front yard.
e. No equipment or process shall be used in such occupation which
creates noise, vibration, glare, fumes, odors and electrical
interference detectable to the normal senses and visual or audible
interference in any radio or television receiver or causes fluctuation
inline voltage off the premises.

9. Home industry classified as cottage industry, e.g. mat weaving, pottery making,
food preservation, etc. provided that:
a. Such home industry shall not occupy more than thirty percent (30%) of
floor area of the dwelling unit. There shall be no change or alteration in
the outside appearance of the dwelling unit and shall not be a hazard or
nuisance.
b. Allocated capitalization shall not exceed the capitalization as set by the
DTI.
c. Such shall consider same provision as enumerated in letters, c d, and e
of home occupation, this section.
10. Backyard raising of livestock and fowl provided that:
a. For livestock a maximum 1 sow and 10 heads.
b. For fowl a maximum of 500 birds.
Section 6 Use Regulations in Parks and Recreation Zone (PRZ). The following shall be
allowed in Parks and Recreation Zones:
1. Parks /green
2. Open air or outdoor sports activities and support facilities, including low rise
stadia, gyms, ampetheaters and swimming pools.
3. Golf courses, ball courts, race tracks and similar uses.
4. Memorial/shrines monuments, kiosks and other park structures.
5. Sports club.
6. Underground parking structures/facilities.
Section 7 Use Regulations in Water Zone (WZ).
1. The utilization of the water resources for domestic and industrial use shall be
allowed provided it is in consonance with the development regulations of
DENR provisions of the Water Code, and revised Forestry Code of the
Philippines, as amended and provided further that is subjected to an
environmental impact assessment prior to the approval of its use.
2. Other uses such as recreation, fishing and related activities shall be allowed
provided it is in consonance with the provisions of the Water Code and the
revised Forestry Code of the Philippines, as amended. Such bodies of water
shall include rivers, streams, lakes and seas.
Section 8 Use regulations in Agro-Industrial Zone (AIZ). In Agri I Zone the following
uses shall be permitted:
1. All uses allowed in agriculture

Section 12 Use Regulation in Tourism Zone.
No tourism project or tourist related activities shall be allowed in tourist zones unless developed
or undertaken in accordance with the Department of Tourism (DOT) guidelines and standards and
granted approval by the Tourism Estate Department of DOT. Enumerated below are the allowable
use:
1. All uses allowed in the General Residential Zone
2. Resort areas, e.g. beaches including accessory uses.

Section 13 Conservation Zone (CZ). This zone is use primarily for watershed conservation
no other activities are allowed to degrade the purpose of this zone.
Section 14 Swamps/Marshes. This zone is use for fishing and fish culture.
Section 15 Mangrove. This Zone is for mangrove plantation and conservation. No other
activities are allowed that may destroy the mangrove area.
Section 16 Transportation/Utilities Zone. This Zone is for roads, airport runway & facilities,
port wharf & facilities and vehicles terminal.
Section 17 Marine Protection Zone. This zone is primarily for the protection of coral reefs
and fish sanctuary. No other activities are allowed in this zone that may destroy
the coral reefs.
Section 18 Use and Regulation in Socialized Housing Zone (SHZ). A SHZ shall be used
principally for socialized housing/dwelling purposes for the underprivileged and homeless as
defined in RA 7279. Allowable uses:
1. All uses allowed in General Residential Zone
2. Relocation site for informal settlers.
ARTICLE VI
GENERAL DISTRICT REGULATION
Section 1 Development Density. Permitted density shall be based on the zones capacity to
support development.
ALL Zones
There is no fixed maximum density but should be based on the planned
absolute level of density that is intended for each concerned zone based on the
comprehensive land use plan.
Section 2 Height Regulations. Building height must conform to the height restrictions and
requirements of the Air Transportation Office (AT0) as well as the requirements of
the National Building Code, the Structural Code as well as all laws, ordinances,
design standards, rules and regulations related to land development and building
construction and the various safety codes.
All Zones
There is no fixed building height limits except those prescribed by the Air
transportation Office (LTO) and other government regulations, within these zones,
building height shall be based on the prescribed Floor Area Ratio (FAR). (refer to
annexes b-f for illustration on how floor area ratio is used in a zoning).
Section 3 Area Regulations. Are regulations in all zones shall conform with minimum
requirement of the existing code such as:
a. PD 957 - the “Subdivision and Condominium Buyer’s Protective Law”
and its revised implementing rules and regulations.

Section 5. Easement. Pursuant to the provisions of the Water Code: 1) the banks of rivers and
streams throughout their entire length and within a zone of three (3) meters in urban
areas; twenty (20) meters in agricultural areas and areas and forty (40) meters in
forest areas, along their margins, are subject to easement of public use in the interest
of recreation, navigation, floatage, fishing, and salvage.
Section 6. Buffer Regulations. A buffer of at least 3 meters shall be provided along the entire
boundary length between two or more conflicting zones allocating 1.5 meters from
each side of the district boundary. Such buffer strip should be open and not
encroached upon by any building or structure and should be a part of the yard or
open space.
Section 7. Specific Provisions in the National Building Code. Specific provisions stipulated
in the National Building Code (PD 1096) as amended thereto relevant to traffic
generators, advertising and business signs, erection of more than one principal
structure, dwelling or rear lots, access yard requirements and dwelling groups,
which are not in conflict with the provisions of the Zoning Ordinances, shall be
observed.
Section 8. Performance Standards. All land uses developments or constructions shall conform
to the following standards:

c. Noise and Vibrations. All noises and vibrations-producing machinery
shall be enclosed by a building and shall be provided with effective
noise-absorbing materials, noise silencers and mufflers and an open
yard of a distance of not less than twenty (20) meters from the street or
adjoining property planted to dense trees as buffers. To minimize
vibration, a machinery should be mounted on shock-absorbing
mountings, such as cork set on reinforces concrete foundations of a
floating isolated foundation set on piles, as needed by the machinery
concerned, to reduce all noise and vibration to a reasonable minimum.
Noise which is objectionable due to intermittence beat frequency or high
pitch shall not be allowed unless enclosed in soundproof building as
tested and approved by the city/municipal officials concerned.
b. Smoke. Any smoke emitted from any source for a period aggregating
seven (7) minutes in any thirty
minute interval particularly when starting a new fire, shall have a
density not greater than No. 2 of the
Ringlemann Chart.
c. Dust, Dirt and Fly Ash. The emission of dust, dirt or fly ash from
any source or activity which shall
pollute the air and render in unclean, destructive unhealthful or
hazardous or cause visibility to be
impaired, shall not be permitted. In no case whatsoever shall dust,
dirt, or fly ash be allowed to exceed
0.3 gram per cubic meter of flue gas at stack temperature at 0 degree
centigrade or to create a haze with
opaqueness equivalent to or greater that No. 1 of the Ringlemann
Chart.
d. Odors and Gases. The emission of foul odors and gases deleterious to
public health, safety and general welfare shall not be permitted.
Activities emitting foul odors and obnoxious gases shall be enclosed by
airtight buildings provided with air conditioning system, filters,
deodorizing and other air cleaning equipment.
e. Glare and Heat. Glare and heat from any operation or activity shall nor
be allowed to be radiated, seen or felt from any point beyond the limits
of the property.
f. Agro-Industrial Wastes. Agro-Industrial/plant wastes shall be disposed
of any in a manner which shall not create any nuisance or danger to
adjoining properties or to the community in general.
g. Sewerage and Disposal. No sewerage dangerous to the public health,
safety and general welfare shall discharged into any public sewer
system, natural waterway of drainage channel. In addition to the
following requirements, all sewerage shall comply with pertinent
requirements of the DENR-EMB and the Local Ordinances.

Acidity or alkalinity shall be neutralized to a pH of between 6.5 and 8.5
as daily average to a volumetric basis with a temporary variation of 5.0
to pH 10.0.
Wastewater shall not certain grease oil in excess of 300 PPM or exceed
as daily average of 10 PPM.
h. Fire and Safety Hazards. The storage and handling of flammable
liquids, gases or explosive, shall be done in the safety manner possible.
All bulk storage receptacle for any flammable liquid, gas or explosive
shall be located not less than fifty meters from any property line.
i. Traffic. All employees and freight traffic into and out of any compound
shall be so managed at all times that the affection any neighboring uses
and on the outside traffic in general will be minimized to the greater
extent.
j. Off-Street Parking and Loading Facilities. Every permitted use which
needs parking and loading facilities for its employee, customer,
company or other transport vehicles shall be provided with its own off-
street parking and loading facilities located either on the same lot with
the principal use or building or on another lot located not more than one
hundred meters from same use or building. These required facilities may
be located on the front yard or on any other required yards. No stuck
loading and reloading on streets whatsoever shall be permitted.
Section 9. Pollution Control. For effective pollution control, all locational clearance granted
for industrial activities must be subject to the condition of compliance with DENR-
EMB laws, rules and regulations as well as Local Ordinances or restriction.
ARTICLE VII
SUPPLEMENTARY REGULATIONS
Section 1 Innovate Techniques or Designs. For projects that introduce flexibility
and creativity in design or plan such as BUT NOT LIMIT to Planned Unit
Development, HOUSING projects covered by New Town Development
under RA 7279, BLISS Commercial Complexes, etc., the Zoning
Administrator/Zoning Officer shall on grounds of innovative
developments techniques forward applications to HLURB for appropriate
action, UNLESS THE LOCAL GOVERNMENT UNITS
CONCERNED HAS THE CAPACITY TO PROCESS THE SAME.
Section 2 Special Use Permits. The following shall require a special permit from the Local
Zoning Board of Adjustments and
Appeals in accordance with the criteria below prescribed:
1. Cemeteries/Memorial Parks
a. It shall conform which the pertinent provision of the Sanitation Code,
Water Code, Executive Order 648 and applicable laws and rules
affecting related services.
b. It shall be located on the periphery of the town center or in area sparsely
inhabited and where little hazard to human life or health could result.

It shall therefore be located in areas zone for cemetery purposes and
maybe allowable in areas zoned as agricultural.
c. A burial ground shall at least be 25 m distance from any dwelling unit
and house shall be constructed within the same distance from any burial
ground. No burial ground shall be located 50 meters from either side of
the river or within 50 meters from any water source as certified by
NWRB.
d. It must be located on ground where water table is not higher than 4.25
meters below the ground surface as certified by the National Water
Resources Board.
e. It shall not be allowed in environmentally critical areas as defined in
Proclamation 2146.
f. If located along national, primary and secondary roads, as defined by
EO 113, as amended, and identified as such by DPWH, a distance of at
least 25 m from the edge of the road right of way shall be imposed where
no burial shall be allowed, provided that it shall conform with the
pertinent provisions of the sanitation Code and Water Code.
g. It shall be totally enclosed by a perimeter fence of strong material, and
all gates provided with strong door and lock. Perimeter wall shall not
exceed 3 m in height.
Where a cemetery is enclosed by a solid reinforced concrete wall at least
2 meter high, but not exceeding 3 meters, that is allowed to construct
tombs, vaults, mausoleums or other types of sepulchers for the dead up
the walls. Otherwise a clearance of 5 meters shall be maintained
between fence and the nearest interment plot.
2. Gasoline Stations/filling Stations
a. They must conform to standards set by the department of Energy.
b. Filling stations shall be located at least 50 meters distance from the
nearest schools, churches, hospitals and other similar institutions.
c. They shall be located at least 200 meters distance from an existing
gasoline station/filling station.
d. They shall not constitute safety hazards in community developed
entirely for residential purposes.
e. Buffer strip of 3 meters from the next property line, perimeter wall must
be constructed about 7 meter high and adequate fire lighting equipment
must be provided.
3. Dumpsite and Sanitary Land Fill
a. Shall preferably lie on flat or gently rolling area that is not subject to
flooding
b. Location shall not be closer than 50 meters from water ways or any
surface water resources, aquifer or ground water reservoir, and not be
located within a watershed area. Likewise, it shall not be closer than 200
meters from any dwelling home or unit, commercial establishment, any
recreational area or institution.
c. Shall not be within any functional area of the municipality but must be
accessible from collection point though an all weather road.
d. To minimize leachate and spread of vectors, a dumpsite /landfill shall
be enclosed by a perimeter made of durable materials.
e. General maintenance of the site shall be the sole responsibility of the
applicant.

f. Other sanitary requirements of the municipality shall be complied with.
4. Abattoirs/Slaughterhouse
a. Abattoir shall be located at least 200 meters distance from residential
and commercial areas as determined by the Office of the Local Zoning
Administrator and the Sangguniang Bayan provided that they shall not
be located within the same premises as public markets and should be at
least 25 meters from markets and other food establishments.
b. A written authority to operate shall be secured from the local health and
sanitation office by the applicant at least 90 days before the intended
date of operation, and a notice shall be posted in the municipal hall to
determined public oppositions if any to the proposed abattoir.
c. Proper waste disposal, odor control and other abatement procedures
must be adopted.
d. The proponent shall obtain sworn statements of owners of land
immediately adjacent to the proposed site signifying their conformity
or non-conformity to the proposed activity as one of the re-requisites for
the granting of a special use permit.
5. Funeral Establishment
a. Funeral establishment shall be classified as follows;
a.1 Category I – funeral establishments with chapels, embalming
facilities and offering funeral services.
a.2 Category II – funeral establishments with chapels and offering
funeral services without embalming facilities.
a.3 Category III – funeral establishment offering only funeral services
from the house of the deceased to the burial place.
b. Funeral establishment shall be allowed in the following zones:
a.1 Category I – Commercial Zone
a.2 Category II – Commercial and Institutional Zones
a.3 Category III – Commercial and Institutional Zones
c. Category II and III must have an existing valid contract with a Category
I establishment for embalming purposes.
d. Funeral establishment shall be a minimum radial distance from the
following:
d.1 restaurant, food center and other food establishment – at least 25
meters
d.2 markets – at least 50 meters
d.3 abattoirs, school and hospitals – at least 200 meters
e. The funeral establishment shall conform with the existing laws, rules
and regulations, such as PD 825 (Provided penalty for improper disposal
of garbage and other forms of uncleanliness and for the other purpose),
PD 856 (Code on sanitation of the Philippines) and other related rules
and regulations of appropriate agencies.
6. Cockpit
a. Site should preferably be located outside of the urban area and served
by the major road.

b. Must be situated at a distance of 200 to 500 meters from the national
highway to avoid congestion and obstruction to smooth traffic flow. It
should be accessible to transportation.
c. Shall be constructed at least 200 meters away from any existing
residential and commercial areas, school buildings, churches or other
related buildings.
d. A planting screen/buffer is 3-5 meters wide along the perimeter of the
site shall be provided to project both the cockpit and the adjacent land
uses.
7. Open Storage
a. Open storage shall be located at least two hundred meter distance from
dwelling units, schools, churches, hospitals and other similar
institutions.
b. Their sound maintenance shall be the sole responsibility of the
proponent.
8. Poultry and Piggery
a. Piggery and poultry farm shall be situated in an area with good drainage.
Flood prone areas and other environmentally critical area shall be
avoided.
b. They shall be located in Agro-Industrial Zones outside of the urban area
at least 500 to 1,000 meters distance the Built-Up Areas (residential,
commercial, institutional, etc.)
c. The site shall be away from the path of immediate urban expansion (5-
10 years)
d. The piggery shall be 500 meters away from the major roads and
highways. For poultry farm, it shall be 200 meters away from major
roads and/or highways.
e. A written authority to operate shall be secured from the local health and
sanitation office by the applicant before the intended date of operation.
f. Proper waste disposal, odor control and other abatement procedures
shall be provided.
g. The proponent shall require sworn statements of owner of land
immediately adjacent to the proposed site signifying their conformity
and non-conformity to the proposed activity as one of the pre-requisites
for granting the special use permit.
h. An Environment Compliance Certificate from the Department of
Environment and Natural Resources shall be secured before the
operation of the proposed project.
9. Base stations of Cellular Mobile, Telephone services, Paging Services,
Trucking services, Wireless Local Coop. service and other Wireless
Communication Services.
a.1 On the ground
a.1.1 Air rights of transportation routes and railroads.
a.1.2 Within commercial, industrial, residential, institutional zones.
a.1.3 Within agricultural zones.
a.1.4 Along existing buffer strips
a.2 On top of existing structures which are structurally sound as attested
and signed as attend and signed by a duly licensed/registered
structural engineer.

a.2.1 Shall conform with setback requirements of the National
Building Code and the DOH
a.2.2 A perimeter fence as per specifications in the DOH radiation
evaluation report shall be constructed to prevent access of the public
to the antenna.
ARTICLE VIII
MISCELLANEOUS PROVISIONS
Section 1. Projects of National Significance. Projects may be declared by the NEDA
board as projects of national significance pursuant to Section 3 of EO 72.
When a project is declared by the NEDA board as project of national
significance the locational clearance shall be issued by HLURB pursuant to
EO 72.
Section 2. Environmental Compliance certificate (ECC). Notwithstanding the issue
of locational clearance under Article (), section of this Ordinance, no
environmentally critical projects located in environmentally critical areas
shall be commenced, operated unless the requirements of ECC have been
complied with.
Section 3. Cultivation/Utilization of Riverbeds and Sand bars. No riverbeds or
sandbars shall be subject to cultivation or utilization except upon prior
recommendation of Municipal Planning Development Office and upon
prior permission from Department of Environment and natural Resources
provided further that no permission shall be granted if it obstruct the flow
of water or it shall increase the flood levels so as to cause damage to other
areas.
ARTICLE IX
MITIGATING DEVICES
Section 1. Deviation. Exceptions variances or deviations from the provisions of this
Ordinance may be allowed by the local Zoning Board of Adjustment and
Appeals (LZBAA) only when the following terms and conditions are
existing.
1. Variance
a. The property is unique and different from other properties in the
adjacent locality and because of its uniqueness, the owner/s
cannot obtain a reasonable return on the property:
This condition shall include at least 3 of the following provisions:
- Conforming to the provisions of the Ordinance will cause undue
hardship on the part of the owner or occupant of the property
due to physical conditions of the property (topography, shape,
etc.) Which is not self created.

- The proposed variance is the minimum deviation necessary to
permit reasonable use of the property.
- The variance will not alter the physical character of the district
or zone where the property for which the variance is sought is
located and will not substantially or permanently injure the use
of the other properties in the same district or zone.
- That the variance will not weaker the general purpose of the
Ordinance and will not adversely affect the public health safety
or welfare.
- The variance will be harmony with the spirit of the this
Ordinance.
2. Exceptions
a. The exception will not adversely affect the public health, safety
and welfare and is in keeping with the general pattern of
development in the community.
b. The proposed project shall support economic based
activities/provide livelihood, vital community service and
facilities while at the same time posing no adverse effect on the
zone/community.
c. The exception will not adversely affect the appropriate use of
adjoining property in the sane district.
d. The exception will not alter the essential character and general
purpose of the district where the exception sought is located.
Section 3 Procedures for Granting Exceptions and variances. The procedure for the
granting and/or variance is as follows:
1. A written application for an exception or variance SHALL be WITH
THE LOCAL ZONING BOARD OF ADJUSTMENT AND APPEAL
(LZBAA) citing the section of this Ordinance under which the same is
sought and stating the ground/s thereof
2. Upon filling of application, a visible project sign (indicating the name
and nature of the proposed project) shall be posted at the project.
3. The LOCAL ZONING BOARD OF ADJUSTMENT AND APPEALS
(LZBAA) shall conduct preliminary studies on the application.
4. A written affidavit on non-objection of the project by the owners of the
properties adjacent to the project shall be filled by the applicant with the
LZBAA at least fifteen (15) days prior to the decision for
exception/variance.
5. In case of objection, the LZBAA shall hold public hearing.
6. At the hearing, any party may appear in person, or be represented by
agent/s. All interested parties shall be accorded the opportunity to be
heard and present evidences and testimonies.
7. The LZBAA shall render decisions within thirty (30) days from the
filling of the application, exclusive of the time spent for the preparation
of written affidavit of non-objection and the public hearing in case of
any objection to the granting of exception variance.
ARTICLE X
ADMINISTRATION AND ENFORCEMENT

Section 1. Locational Clearance. All owners/developers shall secure LOCATIONAL
CLEARANCE from the Zoning administrator/zoning officer OR IN CASES
VARIANCE AND EXCEPTION FRON THE LOCAL ZONING BOARD
ADJUSTMENT AND APPEALS (LZBAA) prior to conducting any activity or
construction on their property/land.
Section 2. Building Permit. No building permit shall be issued by the local building officer
without a valid locational clearance in accordance with this Ordinance
Section 3. Non-User or Locational Clearance. Upon issuance of a locational clearance, the
grantee thereof shall have one year within which is commence or undertake the use,
activity or development covered by such clearance on his property. Non use of said
clearance within said period shall result in its automatic expiration, cancellation and
the grantee shall not proceed with his project without applying for a new clearance.
Section 4 Certificate of Non-Conformance. A certificate of Non-Conformance shall be
applied for by the owner of the structure or operate of the activity involved within
six (6) months from the ratification of the Zoning Ordinance by the
SANGGUNIANG PANLALAWIGAN (SP). Failure on the part of the owner to
register/apply for a Certificate of Non-Conformance shall be considered in
violation of the Zoning Ordinance and is subject to fine/penalties.
Upon approval of his Ordinance, the Zoning Administrator/Zoning Officer shall
immediately notify owners of known existing non-conforming use to apply for a
certificate of non-conformance.
Section 5 Existing non-Conforming/Uses and Billing. The lawful uses of any building
structure or land at the time of adoption or amendment of this Ordinance may be continued
although such uses do not conform with the provision of this Ordinance, provided:
1. That no such non-conforming use shall be enlarged or extended to occupy a
greater area of land that already occupied by such uses at the time of the
adoption of this Ordinance or moved in whole or in part, to any other portion
of the lot or parcel of land where such non-conforming uses exist at time of the
adoption of this Ordinance.
2. An idle/vacant structure may not be used for non-conforming activity.
3. That any non-conforming structure or structures under one ownership which
has been damaged may be reconstructed and use as before provided that such
reconstruction is not more than fifty percent (50%) of the replacement cost,
That should such non-conforming portion of structure be destroyed by any
means to an extent of more than fifty percent (50%) of its replacement cost at
the time of destruction, it shall not be reconstructed except in conformity with
the provision of this Ordinance.
4. That no such non-conforming use may be moved to displace any conforming
use.
5. That no such non-conforming structure may be enlarged of altered to decrease,
it non-conformity, but any structure or portion thereof may be altered to
decrease its non-conformity.

6. That should such structure be moved for any reason to whatever distance, it
shall thereafter conform to the regulation of the district in which is moved or
relocated.
In addition, The owner of a non-conforming use shall program the phase out
and relocation of the non-conforming use within ten (10) years from the
effectivity of this Ordinance.
Section 6. Responsibility of Administration and Enforcement. This Ordinance shall be
enforced and administered by the LOCAL CHIEF EXECUTIVE THOUGH the
Zoning Administrator/Zoning Officer who shall be appointed BY THE FORMER
IN ACCORDANCE WITH EXISTING RULES AND REGULATIONS ON THE
SUBJECT.
Section 7. Powers and function of a Zoning Administrator/Zoning Officer. Pursuant to the
provision of EO 72 implementing RA 7160 in relation to Section 5 paragraph a and
d, section 7 of Executive Order 648 dated 07 February 1981. The Zoning
Administrator/Zoning officer shall perform the following functions, duties and
responsibility:
1. Enforcement
a. Act all applications for locational clearances for all projects.
1. Issuance of Locational Clearance for projects conforming to zoning
regulations.
2. RECOMMED TO THE LOCAL ZONING BOARD OF
ADJUSTMENT AND APPEAL (LZBAA) the
grant or denial of applications for variances and exceptions and the
issuance of Certificate of Non-
Conformance for non-conforming projects lawfully existing at the
time of the adoption of the Zoning
Ordinance, special use ones including clearances for repairs
renovations on non-conforming uses
consistent with the guidelines.
b. Monitor on going/existing projects within their respective jurisdiction
and issue notices of violation and show court order to owners,
developers, managers of projects that are violative of Zoning Ordinance
and IF NECESSARY PURSUANT TO SEC. 3 OF EO 72 AND SEC. 2
OF EO 71 refer subsequent actions thereon to the HLURB.
c. Call and coordinate with the Philippines National Police for
enforcement of all orders and processes issued in the implementation of
this Ordinance.
d. Coordinate with the City Fiscal/Municipal Attorney for other legal
actions/remedies relative to the foregoing.
2. Planning
a. Coordinate with the Regional Office of the HLURB regarding proposed
amendments to the Zoning Ordinances prior to adoption by the
Sangguniang Bayan.
Section 8. Action on Complaints and Oppositions. A complaints for violations of any
position of the Zoning Ordinance or of any clearance or permits issued pursuant
thereto shall be filled with the LZBAA.

However, oppositions to application for clearance, variance or exception
shall be treated as a complaint and dealt with
in accordance with the provisions of this section.
Section 9. Function and Responsibilities of the Local Zoning Board of Adjustment and
Appeals. There is hereby created a LZBAA which shall perform the following
functions and responsibilities:
a. Act on Application of the following nature
3. Variances
4. Exceptions
5. Non-Conforming Uses
6. Special Uses Permits for gasoline stations, funeral parlor, cockpits and
other uses as specified in Article VII Section 2.
7. Complaints and opposition to application
8. SAFDZ
b. Act on appeals on grant or denial of locational clearances by the Zoning
Administrator/Zoning Officer.
Decisions of the Local Zoning Board of Adjustment and Appeals shall be
appealable to the HLURB.
Section 10 Comp of the Local Zoning Board of Adjustment and Appeals (LZBAA). THE
MUNICIPALITY DEVELOPMENT COUNCIL SHALL CREATE A SUB-
COMMITTEE WHICH SHALL ACT AS THE LZBAA COMPOSED OF THE
FOLLOWING MEMBERS:
1. Municipal Mayor as Chairman
2. Two (2) SB Members
3. Municipal Legal Officer
4. Municipal Assessor
5. Municipal Engineer
6. Municipal Planning and Development Coordinator (if other than the Zoning
Administrator)
7. Two (2) representatives of the private sector, nominated by their respective
organizations and confirmed by the Municipal Mayor. In the event of non-
availability if any of the officials enumerated above the Sangguniang Bayan
shall elect the number of its members as may be necessary to meet the total
number above set forth, as representatives.
8. Two (2) representatives from non-government organizations nominated by their
respective organization and confirmed by the Municipal Mayor.
In any event of non-availability of any of the officials enumerated above the
Sangguniang Bayan shall elect the numbers of its members as may be necessary to
meet the total number above set forth, as representatives.
Section 11. Interim Provision. Until such time that the LOCAL ZONING BOARD OF
ADJUSTMENT AND APPEALS shall have been constituted the HLURB shall act
as the LOCAL ZONING BOARD OF ADJUSTMENT AND APPEALS. As an
appellate board, the HLURB shall adopt its own rules of procedures to govern the
conduct of appeals arising from the administration and enforcement of this
Ordinance.

Section 12. Review of the Zoning Ordinance. The Municipal development Council shall
create a sub-committee, the Local Zoning Review Committee (LZRC) that shall
review the Zoning Ordinance considering the Comprehensive Land Use Plan, as
the need arises, based on the following reasons/situations.
a. Change in local development plans
b. Introduction of projects of national significance
c. Petition for rezoning
d. Other reasons which are appropriate for consideration
Section 13. Composition of the Local Zoning Review Committee (LZRC). The Local
Zoning Review committee shall be composed of sectoral experts.
These are the Local Officials/Civic Leaders responsible for the operation,
development and progress of all sectoral undertaking in the locality, e.g.
e. Municipal Planning and Development Coordinator
f. Municipal Health Officer
g. Municipal Agriculturist
h. President, Association of Barangay Captains
i. Municipal Engineer
j. Community Environment and natural Resources Officer
(CENTRO) representative
k. Municipal Agrarian
l. District School Supervisor
m. Three (3) Private Sector representatives (Local People’s
Housing Industry/Developers and Local Homeowner’s
Association)
n. Two (2) NGO representatives
For purposes of policy and program coordination, the LZRC shall be attached to
the Municipal Development Council.
Section 14. Function of the Local Zoning Review Committee. The Local Zoning Review
Committee shall have the following powers and functions:
a. Review the Zoning Ordinance for the following purposes:
1. Determined amendments or revisions necessary in the Zoning
Ordinance because of changes that might have been introduced in the
Comprehensive Land Use Plan.
2. Determine changes to be introduced in the Comprehensive Land Use
Plan in the light of permit given and exceptions and variances granted.
3. Identify provisions of the Ordinance difficult to enforce or are
unworkable.
b. Recommend to the Sangguniang Bayan necessary legislative amendments and
to the local planning and development staff the needed changes in the plan as a
result of the review conducted.
Provide information to the HLURB that would be useful in the exercise of its
function.

Section 15. Amendments to the Zoning Ordinance. Changes in the Zoning Ordinance as
result of the review by the Local Zoning Review Committee shall be treated as
amendment, provided that any amendment to the Zoning Ordinance or provision
thereof shall be SUBLECT TO PUBLIC HEARING AND REVIEW
EVALUATION OF THE LOCAL ZONING REVIEW COMMITTEE AND
SHALL BE carried out through a mechanism of three-fourths vote of the
Sangguniang Bayan. Said amendments shall take effect only after approval and
authentication by SANGGUNIANG PANLALAWIGAN.
Section 16 Violation and Penalty. Any persons who violates any of the Provisions of this
Ordinance shall upon conviction be punished by a fine NOT EXCEEDING Php
2,500.00 or an imprisonment for a period not exceeding six (6) months or both at
the discretion of the Court. In case of violation by a corporation, partnership or
association the penalty shall be imposed upon the erring officers thereof.
Section 17 Suppletory Effect of Other Laws and Decrees. The provision of this Ordinance
shall be without prejudice to the application of other laws, Presidential Decrees,
letter of instruction and other executive or administrative orders vesting national
agencies with jurisdiction over specific land areas, which shall remain in force and
effect, provided that land use decisions of the national agencies concerned shall be
consistent with the Comprehensive Land Use Plan of the locality.
Section 18. Separability Clause. Should any section provision of this Ordinance be declared
by the Courts to be unconstitutional or invalid, such decision shall not affect the
validity of the Ordinance as a whole or any part thereof than the part so declared to
be unconstitutional or invalid.
Section 19. Repealing Clause. All ordinance, rules or regulations in conflict with provisions
of this Ordinance are hereby repealed, provided that the rights that are vested upon
the effectivity of this Ordinance shall not be impaired.
Section 20. Effectivity Clause. This ordinance shall take effect upon approval by the
Sannguniang Panlalawigan.

APPENDIX A - Resolution of Sangguniang Panlalawigan
