Hey,

A student who ran for ASB President at SRVHS made a campaign video that was inappropriate. It involved ethnic bias

against Muslims. Our leadership teacher deemed it inappropriate and immediately suspended the kid from Leadership.

The student never apologized and as a matter of fact, the student's parents sued for his reinstatement The District

fought the first round and backed Janet, the leadership teacher, Ruth and Ruth's boss Jason Reimann. The first judge

dismissed the case because he/she said it was filed under the wrong writ. It needed to be a freedom of speech case. .

The family refiled and added a financial lawsuit against the District. The attorneys for the District advised the District to

settle and to reinstate the student as President of ASB. »0' It

1 . There is a strict guideline for campaign videos and conduct of students on ASB. The student broke it.

2. The student never apologized. Instead his family sued.

3. The District was just recognized as a "non-hate" District earlier this week but they are reinstating a student whose video

was blatantly disparaging to Muslims.

4. What's the point in having ANY rules/code of conduct/criteria for a prestigious position like ASB President if parents can

just bully the District via a financial lawsuit into submitting into their wishes?

5. Early on, Janet asked for an apology and then things could have been attempted to be remedied, but the

student/family refused.

there are numerous suspensions this week for drugs and vaping on campus. This school is so out of contra I... it's one ofthe reasons I must go. I do not blame Ruth, per se....but her inability to build a strong team of admin has turned this placeinto a free for all. I LOVED teaching here until about this time last year and then the wheels just came off the bus. Mostkids carry vape pens. Most kids have medical cards (who are 1 8). SRVUSD-think about the precedent you just set. You pretty much tied the hands of your principals, teachers and safetystaff. Get caught drinking-just sue. Don't like your grade-sue. Apparently things like right and wrong don't matter hereanymore.

thing. The outcome is precedent for all sorts of unfair behavior.

San Ramon Valley Unified School District just caved in to legal bullying by parents of a junior who ran for SRVHS ASBPresident using a racially offensive "joke" video as his campaign tactic.He and his friend dressed up like Muslim terrorists and had fake guns. I saw the video and was so outraged.These kids agree to a campaign contract with clear consequences for breaking it.. .you will not get an office. I know it wellbe my daughter is the current ASB president.

Initially the boy was not allowed to be president. Parents sued. Parents refused to have their son apologize or take anyresponsibility for a dreadful decision. " ' y ' 1 . •

AND I heard from students that parents changed their (losing) lawsuit to a freedom of speech suit and asked for big $$$.DISTRICT caved!!!! Gave in rather than stand up for all the principles they expect our kids to leam and exhibit. Boyreturns tomorrow as new ASB President. UNBELIEVABLE!!

This is awful! I'm disgusted. Are students involved in protesting this in a vocal way? It seems like there should be a strongmessage to our community at large that we do not tolerate racism. Of course, behind some doors in Danville, there is a

total double standard. This "silent" racism is even more insidious.

I also understand the price of litigation for a district. In moraga, to even go to court, it's minimum $100,000. It's often more

cost effective to settle for $40,000 for example, then have a minimum of triple the cost. And of course that litigation

expense takes money away that could be used for teachers' salaries, student resources, etc.

Public school districts are in a real jam in relation to this. I also must wonder about the district's legal counsel. This seems

like a pretty justifiable point for the district...

I believe the board meeting has a set place on the agenda for public comment when something is not on the agenda.

Then 3 minutes per speaker will be given. I don't see a posted agenda for Tuesday yet...

I get it that the District doesn't want to "waste" the money but in my opinion, and based on Supreme Court decisions, it isa slam dunk. He violated the campaign contract, never apologized, never mea culpa'd anything . .his parent sued. TheDistrict tried to fight then gave in. My students are irate and are planning to deal with it. As are MANY parents.

Does the general student body know about this? William hasn't said anything to me, but that doesn't mean that he doesn'tnecessarily know about it. May 19th, 2017Dear San Ramon Valley Unified School District Board Members,

Yesterday, May 18th, 2017 I learned about a recent school board decision regarding a campaign video created by astudent at San Ramon Valley High School.

My understanding of the video is that it contains messages of discrimination, violence, and inappropriate sexual innuendo.

As a former student in the district (K-12), a current teacher in the district (14 years), and a future parent (MVHS class of

2031) I am horrified by the decision that was made.For the 14 years that I have taught at San Ramon Valley High School, I have been continually impressed with the social

changes and progress that has occurred. Over the fourteen years, I have seen a dramatic decrease in homophobia,

islamophobia, and the use of derogatory words to refer to various groups. I believe this is part of the ongoing educationthat the school and district has provided to both students and parents in this community. I know that San Ramon ValleyHigh School in particular has provided a "Safe-haven" for many students who feel isolated and discriminated against atother schools in the district. In addition, I have always felt supported and safe in my ongoing support of various groups,

and the efforts I have put in to making sure students are treated fairly and feel safe in my classroom. Sadly, with one

decision the SRVUSD School Board has reversed years of progress.I now fear for my students, and I fear for myself. What will happen the next time I am teaching about Civil \Nar and slavery

and a student uses the word nigger. If I punish that student will I be threatened a "freedom of speech lawsuit?* What

about when I teach the Hitler and the Holocaust and students start discussing conspiracy theories? That they state the

Holocaust never happened? That Jews made the entire thing up for sympathy? Am I supposed to engage in thatdiscussion and give it validity even though there are enormous amounts of physical historical evidence to counter that

point? But because of "free speech" students can say whatever they want regardless of historical facts? Or what about

when I teach September 11th, and students make inappropriate statements about Muslims or Arabs? Where are thelimits? Where does it stop? What about the kids in my classes that are Jewish, or Muslim, or Gay? What about their

rights? What about their safety?Racism is taught. Discrimination is taught. Bigotry is taught. Every day as educators we are faced with a daunting and

sometimes scary task of challenging racism, discrimination and bigotry that is taught outside of our classrooms. It is not

easy to do, BUT in the past we have been provided with the support to be proactive and to make positive change in ourcommunity. Now, that security is gone. Now we will be consistently challenged and our classrooms of positive change will

become classrooms where we can no longer fight the bigotry and racism. As more and more "free speech" lawsuits get

threatened, the teaching community in the San Ramon Valley Unified School District will face a moral crisis. How can we

teach in an environment that does not protect students and staff from the constant threat of discrimination? I fear the

district will see an exodus of teachers who will refuse to teach in such a hostile environment. I fear sending my daughter

to schools in which her teachers and administrators cannot protect her from hate speech. I fear that no matter how much Ieducate her at home the messages that she will hear in her classrooms and hallways and playgrounds will influence her.

I am not a constitutional historian or lawyer, but it is my understanding that there are three separate court decisions that

have ruled that freedom of speech has limitations within the school system:Wynarvs. Douglas County School District

La Vine v Blaine School District

Bethel School Dist No 403 v Fraser

As the leaders and decisions makers for thousands of students and educators I beg you to reconsider your decision, toreview the court cases listed above, to seek different legal counsel, and to consider that sometimes the money spent

Thank you so much! I miss you all very much. The new job is good.. ..and here's a caveat that I think you'll appreciateknowing:

The best part of my job is that I get to go work with really positive teachers/districts who are embracing change (as bestas they can) and who genuinely love teaching/students/learning. It has been good for me to see this because it'srekindling my interest in admin. I needed to see functional schools again. I hear Jason is doing great things and that'sawesome. I don't think I could have seen the forest through the trees there.. ..so, I definitely made the right choice for me.For Luke? Ifs been rough and good. His new school is awesome and his teachers are solid. He's seeing what it's like tobe around "normal" people. Which is awesome. He longs for Danville and his friends.. .but it's not about "school" per se.

He signed up for APUSH here. :-) . And he's not doing any worse than most of my kids did at first...so that's good.

Jarod and Greg are doing really well. It's nice to be mostly settled.
