ORDER
The bail application filed U/s. 437 Cr.P.C. on behalf of the petitioner by
Advocate Thiru.R.Manimuthu, B.A., B.L., in C.M.P. No. 20091/2021 received by
this court on 23.09.2021. The respondent/police submitted their reply on
28.09.2021.
After carefully consideration of the bail application and the reply submitted
by the respondent/police this court passed the following order,
The petitioner is the accused in the above crime number. The
Petitioner/accused was arrested and remanded to Judicial custody U/s. 5, 7(3)
Lottery Act on 22.09.2021. For the past 7 days the petitioner is in Judicial
custody. The case of the prosecution is that the petitioner totally 32 numbers of
Kerala State Akshaya lottery tickets possessed in his shirt pocket which were
banned by the Government of Tamilnadu and caught by the respondent/Police.
In the bail application it was submitted the accused was arrested for the
alleged offence U/s.5, 7(3) Lottery Act. In the bail application it was further stated
the petitioner has never committed any offence as alleged by the
respondent/police and he is a law abiding citizen and if the petition is allowed he
will produce substantial sureties and he will not abscond. On these grounds the
petitioner asked this court to grant bail.
In the reply the respondent/police has stated the petitioner was arrested
and remanded to judicial custody on 22.09.2021. The respondent/police further
stated that the petition is allowed the petitioner will abscond and tamper the
witness and he will commit the same kind of offence. The respondent/police
further submitted the investigation is still pending and strongly opposed this
petition.
On perusal of the records the petitioner was arrested and remanded to
judicial custody on 22.09.2021 for the alleged offence U/s. 5, 7(3) Lottery Act.
For the past 07 days the petitioner is in judicial custody. The case property was
recovered. Hence, considering the facts and circumstances and considering the
Covid-19 Pandemic situation in the interest of justice this court is inclined to
grant bail to the petitioner with following conditions.
1. The petitioner shall produce two sureties like some each to the value of
Rs.10,000/- to the satisfaction of this court.
2. The petitioner and the sureties are directed to produce their ID proof.
3. The petitioner is directed to co-operate the investigation and shall not
tamper the evidence.
4. The petitioner is directed to sign before the respondent/ police daily at
10.30 AM for the period of 30 days.

This petition is coming before me on 29.09.2021 as final hearing, the

The petitioner/Defacto Complainant filed this petition U/s.451 r/w 457
Cr.P.C to pass an order to return the property.
Petition filed one Deeparani, W/o.Kittusamy for return of the property
remanded in P.R.No.94/2021, dated:29.09.2021. The case property is சமமரர 80
ககரமமர எடடயளரள தஙரக கடரட ஒனரற. The petitioner further submitted the petitioner
undertakes to produce the above said property when directed by this Hon'ble
Court at the time of trial.
Reply received. Records perused. The petitioner is the owner of the
property. There is no dispute regarding his ownership. The petitioner is identified
by the respondent/police. The prosecution has no objection to return the
property is சமமரர 80 ககரமமர எடடயளரள தஙரக கடரட ஒனரற. The petitioner also produced
I.D. Proof.
If the property is under the Court custody for long time, it will get damage
and became useless to anybody. Hence, considering the facts and circumstances
and in the interest of justice this court is inclined to return the property with the
following conditions.
1. The petitioner shall produce one surety and execute a bond for
Rs.1,98,250/-
2. The petitioner shall produce a photo copy of the property.
3. The photo copy of the property should be attested by both the petitioner,
Surety and the Investigating Officer.
4. The petitioner is directed to produce the property whenever this court
directs to do so.

After carefully consideration of the bail applications and reply submitted by the
respondent/police this court passed the following order,
The petitioners who are the accused in the above crime number. The accused 1
& 2 were arrested and remanded to Judicial Custody on 01.09.2021 for the past 28
days. The case of the prosecution is on the date of occurrence when the defacto
complainant went to his native place and returned to home the defacto complainant's
wife saw the house at that time the door and windows were broken and theft the 30
Sovereign Gold Ornaments. Based upon the complaint on investigation the petitioners
and co-accused were arrested and as per the confession given by the petitioner 1 & 2
and co-accused is involved in the offence.
The petitioners are the accused 1 & 2 in the above crime number. The
Petitioner/accused 1 & 2 were arrested and remanded to Judicial custody U/s. 454,
457, 380 IPC on 01.09.2021. In the bail application it was further stated the petitioners
has never committed any offence as alleged by the respondent/police and they were
falsely implicated in this case and they are the only breadwinner of his family and the
petitioners/accused 1 & 2 law abiding citizen. In the bail application it was further
stated the previous bail application filed by the petitioners in CMP.No.19041/2021 was
dismissed by this court on 15.09.2021. This is second bail application. It was further
stated if the petitions are allowed the petitioners will not abscond and pleaded to grant
bail. Both the petitioners asked this court to grant bail and their ready to produce
surety as per the orders passed by this court.
In the reply, the respondent/police further stated, the investigation is not yet
completed. The respondent/police further stated if bail is granted the petitioners will
abscond and tamper the witnesses. In the reply it was further stated the petitioners
already involved various cases in various Police Station. On this grounds
respondent/police strongly object to grant bail.
On perusal of the records the petitioner/accused No.1 & 2 were arrested and
remanded in Judicial custody for the past 28 days. The accused 1 & 2 filed an
application the grant bail him and the same was dismissed already. This is the second
application filed by the petitioner. The learned APP argued that investigation is not yet
completed. But, this case stolen property was recovered. Considering the facts and
circumstances of this case and considering the Covid-19 Pandemic situation and this
court is inclined to grant bail to the petitioner with following conditions, accordingly
this petition is allowed.
1. The petitioner shall produce two sureties like some each to the value of Rs.10,000/-
to the satisfaction of this court.
2. The petitioner and the sureties are directed to produce their ID proof.
3. The petitioner is directed to co-operate the investigation and shall not tamper the
evidence.
4. The petitioner is directed to sign before the respondent/police daily at 10.30 a.m.
until further orders.

The petitioners who are the accused in the above crime number. The accused No.1 was
arrested and remanded to Judicial Custody on 31.08.2021. For the past 29 days the
petitioner/Accused No.1 is in judicial custody. The accused No.2 was arrested through P.T.
Warrant and remanded to Judicial Custody on 02.09.2021. For the past 27 days the
petitioner/Accused No.2 is in judicial custody. The case of prosecution on the date of
occurrence both the accused came on a two-wheeler and snatched the cellphone of the defacto
complainant's shirt pocket. Hence, the defacto complainant preferred the complaint against
both the accused.
The petitioner in CMP.No.19852/2021 is the 1st accused in the above crime number. The
Petitioner/accused was arrested and remanded to Judicial custody U/s. 392 IPC on 31.08.2021.
In the bail application it was further stated the petitioner has never committed any offence as
alleged by the respondent/police and he was falsely implicated in this case and he is the only
breadwinner of his family and he is a lawful citizen. The petitioner have not committed any
offence as alleged by the respondent police. The petitioner will not abscond or tamper the
witnesses and the petitioner is having permanent residence. In the bail application it was
further stated the previous bail application filed by the petitioner in CMP.No.17693/2021 was
dismissed by this court on 13.09.2021. This is second bail application. It was further stated if
the petition is allowed he will produce substantial sureties and he will not abscond. On this
grounds the petitioner asked this court to grant bail.
The petitioner in CMP.No.19706/2021 is the 2nd accused in the above crime number. The
Petitioner/accused was arrested and remanded to Judicial custody for the offence U/s. 392 IPC
on 02.09.2021. The petitioner's father is bedridden due to arthritis. The petitioner have not
committed any offence as alleged by the respondent police. In the bail application it was further
stated the previous bail application filed by the petitioner in CMP.No.18209/2021 was dismissed
by this court on 13.09.2021. This is second bail application. It was further stated if the petition
is allowed he will produce substantial sureties and he will not abscond. On this grounds the
petitioner asked this court to grant bail.
In the reply, the respondent/police further stated, the investigation is not yet completed.

This petition is filed by the petitioner / appellant, u/s.389(1) of Cr.P.C.,
praying to suspend the sentence till the disposal of appeal.
This petition is coming on this day for final hearing before this Court in the

ORDER

The petitioner seeks suspension of sentence pending disposal of appeal.
2. The learned counsel appearing for the petitioner has submitted that the
petitioner has been convicted and sentenced to undergo SI for a period of two
years, for the offence u/s.380 IPC, imposed by the learned Judicial Magistrate
No.7, Coimbatore, in C.C.No.1850/2020, dated 12-02-2021. The learned counsel
further submitted that from 29-01-2021, the petitioner is in judicial custody and
prayed to suspend the sentence till the disposal of the appeal.
3. The learned Public Prosecutor has no objection to allow this petition.
4. After considering all the above said aspects, since the petitioner is in
judicial custody from 29-01-2021, and also having regard to the facts and
circumstances of the case and also considering the nature of offence and this Court
is inclined to allow this petition and the substantive sentence of imprisonment
imposed on the petitioner by the lower Court alone is hereby suspended till
disposal of the appeal subject to the following conditions:-
(i) The petitioner is ordered to be enlarged on bail on his executing a bond for
Rs.10,000/- with two sureties for a like sum each to the satisfaction of the Judicial
Magistrate No.7, Coimbatore, within 15 d ays from the date of this order.
(ii) The petitioner shall report before the trial Court on the 1st working day of
every English calendar month at 10.30 a.m. without fail, until further orders.
The appeal is made over to the IV Additional District & Sessions Court,
Coimbatore. The appeal stands posted to 02-11-2021.
On the failure of the petitioner, to comply with any of the above said
conditions, the suspension granted to him shall stand cancelled automatically and
the Magistrate concerned shall take necessary steps to secure the petitioner /
accused.

This petition is filed by the petitioner, u/s.451 and 457 of Cr.P.C, seeking to
pass an order to return the original R.C. Book pertaining to the vehicle bearing
Reg. No.KL 63 H 0398.
2. The learned counsel appearing for the petitioner has submitted that the
petitioner is the owner of the vehicle bearing Reg.No. KL 63 H 0398. . The said
vehicle was seized in connection with the present case. Thereafter, the petitioner
filed a petition praying to return the said vehicle as interim custody. While passing
order in the said petition, this Court directed the petitioner to produce original RC
book before the Judicial Magistrate, Madukkarai. As per the order passed by this
Court, the petitioner produced original RC book before the lower Court. Now the
said RC book is required to the petitioner for the purpose of paying Road Tax
which will expire on 30-09-2021. Hence, the petitioner prayed to return the
original RC book as interim custody.
3. The learned Public Prosecutor requested to allow this petition on some
condition.
4. Considering the reason stated in the petition, this Court is inclined to
allow this petition on deposit of amount payable by the petitioner.
5. Accordingly, this petition is allowed on condition that the
petitioner shall make a refundable deposit of Rs.20,000/- to the credit of
the same in Crime No.28/2021 of K.G.Chavadi Police Station before the
Judicial Magistrate, Madukkarai. The petition mentioned RC Book
pertaining to the vehicle bearing Reg.No. KL 63 H 0398 is ordered to be
returned to the petitioner as interim custody for a period of 30 days for the
petition mentioned purpose. Further the petitioner is directed to surrender
the original RC Book to the Judicial Magistrate, Madukkarai, after
completion of the petition mentioned purpose. Thereafter, the petitioner
shall get back the amount of deposit from the Court concerned. Further the
factum of interim custody of RC Book given by this Court to the petitioner
is to be intimated to the RTO Concerned.

The petitioner is the accused in Crime No.917/2021 of Sulur Police Station,
for the alleged offence u/s.379 of IPC and Sec.21(1) of Mines and Minerals
(Development and Regulation) Act, he has filed this petition, seeking grant of bail.
2. The case of the prosecution is that the petitioner is found to have
transported gravel in a tipper lorry without any valid permission.
3. The learned counsel for the petitioner submitted that the petitioner is no
way connected with the offence. The petitioner is the sole bread winner of his
family. The petitioner has been falsely implicated in this case and he never
indulged any activities as alleged and he is in judicial custody from 22-09-2021
and prayed to release the petitioner on bail.
4. The learned Public Prosecutor submitted that occurrence happened on
22-09-2021 and the same has been reported to the respondent police on the same
day. There are two accused in this case. The petitioner is arrayed as A-2. On the
date of occurrence, the accused had taken soil from Government Poramboke kuttai,
by using tipper lorry. The respondent police intercepted the said vehicle at
Pallapalayam to Kannampalayam Road and found that the said vehicle was loaded
with gravel. On enquiry, it came to know that the accused used the said soil for
commercial purpose. Investigation is going on. No previous case is reported
against the petitioner.
5. This Court has considered the submissions made by either side. The
petitioner has been remanded to judicial custody for the offences u/s. 379 of IPC
and Sec.21(1) of Mines and Minerals (Development and Regulation) Act. The
petitioner is in judicial custody from 22-09-2021. According to the petitioner, he
has been falsely implicated in this case and he never indulged any activities as
alleged. The learned Public Prosecutor submitted that the accused had taken the
soil from Government Kuttai. Investigation is going on. No previous case is
reported against the petitioner.
6. Taking all the above said aspects into consideration, considering the
nature of offence, period of incarceration, being the first offender, and also
considering the facts and circumstances of the case, this Court is inclined to
grant bail to the petitioner subject to the following conditions:-
(i) The petitioner is ordered to be enlarged on bail on his executing a bond for
Rs.10,000/- with two sureties for a like sum each to the satisfaction of the Judicial
Magistrate, Sulur.
(ii) The petitioner is directed to sign before the respondent police, daily
at 10.00 a.m. until further orders.
(iii) The petitioner or his men shall not tamper the evidence.
(iv) The petitioner shall not abscond and he shall co-operate with the
investigation agency as and when required.
(v) Violation of any of the condition imposed by this Court will result in
cancellation of the bail.
(vi) In case of the condition No.(i) to (iv) are violated, it is open to the
investigating officer to file appropriate application before the learned Judicial
Magistrate for cancellation of bail granted hereby, as held by the Hon’ble Supreme
Court in P.K.Shaji /vs/ State of Kerala [(2005) AIR SCW 5560].

2. The learned counsel for the petitioner appeared before this Court and
submitted that bail was granted to the petitioner, by this Court, on 06-09-2021, in
C.M.P.No.3562/2021 with a condition to sign before the respondent police daily at
10.00 a.m., until further orders. As per the order passed by this Court, the
petitioner has been complying with the condition for the past 15 days without any
violation. Now, the petitioner prays to relax the condition totally.
3. The learned Public Prosecutor has no objection to relax the condition
totally.
4. Considering the above said aspects, having regard to the period of
compliance, nature of offence and also considering the other circumstances of the
case, this Court is inclined to relax the condition totally which is already

The petitioner is the accused in Crime No.916/2021 of Sulur Police Station,
for the alleged offence u/s.379 of IPC and Sec.21(1) of Mines and Minerals
(Development and Regulation) Act, he has filed this petition, seeking grant of bail.
2. The case of the prosecution is that the petitioner is found to have
transported gravel in a tipper lorry without any valid permission.
3. The learned counsel for the petitioner submitted that the petitioner is no
way connected with the offence. The petitioner is the sole bread winner of his
family. The petitioner has been falsely implicated in this case and he never
indulged any activities as alleged and he is in judicial custody from 22-09-2021
and prayed to release the petitioner on bail.
4. The learned Public Prosecutor submitted that occurrence happened on
22-09-2021 and the same has been reported to the respondent police on the same
day. There are two accused in this case. The petitioner is arrayed as A-2. On the
date of occurrence, the accused had taken soil from Government Poramboke kuttai,
by using tipper lorry. The respondent police intercepted the said vehicle at
Chettipalayam to Palladam Road and found that the said vehicle was loaded with
gravel. On enquiry, it came to know that the accused used the said soil for
commercial purpose. Investigation is going on. No previous case is reported
against the petitioner.
5. This Court has considered the submissions made by either side. The
petitioner has been remanded to judicial custody for the offences u/s. 379 of IPC
and Sec.21(1) of Mines and Minerals (Development and Regulation) Act. The
petitioner is in judicial custody from 22-09-2021. According to the petitioner, he
has been falsely implicated in this case and he never indulged any activities as
alleged. The learned Public Prosecutor submitted that the accused had taken the
soil from Government Kuttai. Investigation is going on. No previous case is
reported against the petitioner.
6. Taking all the above said aspects into consideration, considering the
nature of offence, period of incarceration, being the first offender, and also
considering the facts and circumstances of the case, this Court is inclined to
grant bail to the petitioner subject to the following conditions:-
(i) The petitioner is ordered to be enlarged on bail on his executing a bond for
Rs.10,000/- with two sureties for a like sum each to the satisfaction of the Judicial
Magistrate, Sulur.
(ii) The petitioner is directed to sign before the respondent police, daily
at 10.00 a.m. until further orders.
(iii) The petitioner or his men shall not tamper the evidence.
(iv) The petitioner shall not abscond and he shall co-operate with the
investigation agency as and when required.
(v) Violation of any of the condition imposed by this Court will result in
cancellation of the bail.
(vi) In case of the condition No.(i) to (iv) are violated, it is open to the
investigating officer to file appropriate application before the learned Judicial
Magistrate for cancellation of bail granted hereby, as held by the Hon’ble Supreme
Court in P.K.Shaji /vs/ State of Kerala [(2005) AIR SCW 5560].

The petitioner is the accused in Crime No.245/2021 of Pollachi CSCID
Police Station, for the alleged offence u/s.6(4) of TNSC (RDCS) Order 1982 r/w
7(1)(a)(ii) of EC Act 1955, he has filed this petition, seeking grant of bail.
2. The case of the prosecution is that the petitioner and yet another accused
found to have transported 2205 kgs of PDS rice unauthorisedly.
3. The learned counsel for the petitioner submitted that the petitioner is
cleaner. The petitioner is an innocent and he has been falsely implicated in this
case and he is in judicial custody from 18-09-2021 and prayed to release the
petitioner on bail.
4. The learned Public Prosecutor submitted that occurrence happened on
18-09-2021 and the same has been reported to the respondent police on the same
day. On the date of occurrence, the respondent police was engaged in vehicle
checking at Pollachi to Palladam Road. At that time, one Mahindra Boldero pick
up vehicle was coming from South to North. The respondent police intercepted the
said vehicle and stopped the vehicle. At that time, the driver of the vehicle fled
away from that place. The person who accompanied the driver was arrested by the
respondent police. Thereafter, the respondent police seized the rice. Investigation
is not yet completed. No previous case is reported against the petitioner.
5. This Court has considered the submissions made by either side. The
petitioner has been remanded to judicial custody for illegal transportation of 2205
kgs of PDS rice. The petitioner is in judicial custody from 18-09-2021. It is stated
that the petitioner is the cleaner of the vehicle. The learned Public Prosecutor
submitted that investigation is not yet completed. No previous case is reported
against the petitioner.
6. After considering all the above said aspects, considering the nature of
offence, quantum of PDS rice involved, considering the period of incarceration,
being the first offender, and also considering the facts and circumstances of the
case, this Court is inclined to grant bail to the petitioner subject to the
following conditions:-
(i) The petitioner is ordered to be enlarged on bail on his executing a bond for
Rs.10,000/- with two sureties for a like sum each to the satisfaction of the Judicial

2. The case of the prosecution is that on 28-07-2021, at about 12.15 hours,
the petitioner and other accused threatened the defacto complainant and snatched a
sum of Rs.1,600/- and a cell phone from the defacto complainant and his realtive.
3. The learned counsel for the petitioner submitted that there is some
previous enmity between the petitioner and the defacto complainant. Due to
which, the present complaint has been foisted against the petitioner. The petitioner
is an innocent and he has been falsely implicated in this case and the petitioner is
in judicial custody from 20-09-2021 and prayed to release the petitioner.
4. The learned Public Prosecutor submitted that occurrence happened on
29-07-2021 and the same has been reported to the respondent police on the same
day. The defacto complainant is working as Manager in HDFC Life, R.S.Puram
Branch. On 28-07-2021, at about 12.15 hours, the defacto complainant and his
relative were travelling in a two wheeler. When they are nearing Railway Station,
Lanka Corner, two persons came in a two wheeler behind the defacto complainant
and they intercepted the defacto complainant’s vehicle and snatched a sum of
Rs.1,600/- and a cell phone from the defacto complainant and his relative. Except
the present case, two cases in B-4 Police Station in Crime No.181/2021 and
359/2021 are pending against the petitioner. Another case is pending against the
petitioner in Crime No.269/2021 of Kuniyamuthur Police Station. The said case
has been registered for the offence u/s.302 IPC. In this case, investigation is not
yet completed. In the said circumstances, if the petitioner is released on bail, he
will threaten the witness and accordingly, the learned Public Prosecutor prayed for
dismissal of the petition.
5. This Court has considered the submissions made by either side. The
petitioner has been remanded to judicial custody for the offences u/s.392 IPC @
Sec.392, 397, 341, 323 and 506(ii) of IPC. The petitioner is in judicial custody
from 20-09-2021. According to the petitioner, there is some previous enmity
between the petitioner and the defacto complainant. Due to which, the present
complaint has been foisted against the petitioner. Per contra, the learned Public
Prosecutor submitted that on the date of occurrence, the accused persons
threatened the defacto complainant and his relative and snatched cash and cell
phone. Except the present case, three cases are pending against the petitioner. In
which, one case has been registered for the offence u/s.302 IPC. Investigation is
going on.
6. After considering all the above said aspects, considering the nature of
offence, date of arrest, stage of investigation, antecedents of the petitioner, this
Court is of the considered view that if the apprehension raised by the prosecution
that the petitioner is released on bail, he will threaten the defacto complainant and
the witnesses is reasonable and acceptable one. Hence, this Court is not inclined to
grant bail to the petitioner.
Hence, this petition is dismissed.

The petitioners are the accused in Crime No.728/2021 of Karamadai Police
Station, since they are apprehending arrest at the hands of the respondent police,
for the alleged offences u/s.294(b), 323 and 506(i) of IPC, they have filed this
petition, seeking grant of anticipatory bail.
2. No representation for the petitioners. In the petition submitted on
behalf of the petitioners, it is stated that on the date of occurrence, the 1st petitioner
was grazing cows in his land. At that time, the defacto complainant came there and
picked up quarrel with the 1st petitioner not to graze the cows. The petitioners are
innocent and they have been falsely implicated in this case and they are no way
connected with the offence and prayed for grant of anticipatory bail to the
petitioners.
3. The learned Public Prosecutor submitted that on the date of occurrence
there was some wordy quarrel between the petitioners and the defacto complainant.
As a result of which, the present case as well as counter case has been registered
against either party. Investigation is going on.
4. This Court has considered the submissions made by either side. The
alleged occurrence happened due to the wordy quarrel between the parties. Except
Sec.506(i) IPC, the other petition mentioned offences are bailable in nature.
Investigation is going on. Considering the nature of offence and facts and
circumstances of the case, this Court is inclined to grant anticipatory bail to
the petitioners subject to the following conditions:-
(i) Anticipatory bail is granted to the petitioners.
(ii) The petitioners shall execute a bond for Rs.10,000/- each in the event
of their arrest or the petitioners shall surrender before the Judicial Magis -
trate, Mettupalayam, and execute a bond of Rs.10,000/- each within 15
days from the date of this order.
(iii) The petitioners shall produce two sureties likesum each to the value
of Rs.10,000/- each to the satisfaction of the Judicial Magistrate, Met -
tupalayam, within 15 days from the date of this order.
(iv) The petitioners are directed to sign before the respondent police daily
at 10.00 a.m., until further orders.
(vi) The petitioners or their men shall not tamper the evidence.
(vii) The petitioners shall not abscond and they shall co-operate with the investi-
gation agency as and when required.

The petitioner is the accused in Crime No.163/2021 of Ukkadam Police
Station, since he is apprehending arrest at the hands of the respondent police, for
the alleged offences u/s.143, 341, 294(b) and 506(i) of IPC, he has filed this
petition, seeking grant of anticipatory bail.
2. The learned counsel for the petitioner submitted that the petitioner is no
way connected with the offence. The petitioner is an innocent and he has been
falsely implicated in this case and prayed for grant of anticipatory bail.
3. The learned Public Prosecutor submitted that occurrence happened on
31-03-2021 and the same has been reported to the respondent police on the same
day. The defacto complainant is the Sub-Inspector of Police. On the date of
occurrence, the defacto complainant and other police officials were engaged in
patrol duty at Town Hall, Big Bazaar Street area. At that time, at about 1 O’clock,
huge crowd of Hindu Munnani people came in two wheelers and raised slogans.
At that time, some other people who were standing in front of one foot wear raised
some slogans. Due to which, large crowd gathered in the said place and traffic was
affected. Hence, the defacto complainant registered the case.
4. Considering the submissions made by either side, having regard to the
nature of offence and also considering the date of occurrence, and other facts and
circumstances of the case, this Court is inclined to grant anticipatory bail to
the petitioner subject to the following conditions:-
(i) Anticipatory bail is granted to the petitioner.
(ii) The petitioner shall execute a bond for Rs.10,000/- in the event of his
arrest or the petitioner shall surrender before the Judicial Magistrate No.5,
Coimbatore, and execute a bond of Rs.10,000/- within 15 days from the
date of this order.
(iii) The petitioner shall produce two sureties likesum each to the value of
Rs.10,000/- to the satisfaction of the Judicial Magistrate No.5, Coimbatore,
within 15 days from the date of this order.
(iv) The petitioner is directed to sign before the respondent police daily at
10.00 a.m., until further orders.
(v) The petitioner or his men shall not tamper the evidence.
(vi) The petitioner shall not abscond and he shall co-operate with the investiga-
tion agency as and when required.
(viii) In case of the condition No.(ii) to (vii) are violated, it is open to the investi-
gating officer to file appropriate application before the learned Judicial Magistrate
for cancellation of bail granted hereby, as held by the Hon’ble Supreme Court in
P.K.Shaji /vs/ State of Kerala [(2005) AIR SCW 5560].

The petitioner is the accused in Crime No.459/2021 of R.S.Puram Police
Station, since he is apprehending arrest at the hands of the respondent police, for

petition, seeking grant of anticipatory bail.
2. The case of the prosecution is that the accused persons picked up quarrel
with the defacto complainant and abused the defacto complainant by using filthy
language and assaulted and threatened the defacto complainant with dire
consequences.
3. The learned counsel for the petitioner submitted that all are friends. In
this case, already A-1 was released on bail by the learned Judicial Magistrate No.1,
Coimbatore. The petitioner is an innocent and he has been falsely implicated in
this case and prayed for anticipatory bail to the petitioner.
4. The learned Public Prosecutor submitted that occurrence happened on
18-09-2021 and the same has been reported to the respondent police on the same
day. There arose some wordy quarrel between the accused and the defacto
complainant. In that process, the accused abused the defacto complainant by using
filthy language and assaulted and threatened the defacto complainant with dire
consequences. After the occurrence, the defacto complainant has been admitted in
the hospital on 18-09-2021 and discharged on the same day. Investigation is going
on.
5. This Court has considered the submissions made by either side. The
respondent police registered the case for the alleged offences u/s.294(b), 323, 324
and 506(i) of IPC. The petitioner and the defacto complainant are known persons.
The alleged occurrence happened due to the wordy quarrel between the parties. In
this case, the defacto complainant has been admitted in the hospital on 18-09-2021
and discharged on the same day. Investigation is going on.
6. After considering all the above said aspects, considering the nature of
offence, since victim has been discharged from the hospital, and also considering
the facts and circumstances of the case, this Court is inclined to grant
anticipatory bail to the petitioner subject to the following conditions:-
(i) Anticipatory bail is granted to the petitioner.
(ii) The petitioner shall execute a bond for Rs.10,000/- in the event of his
arrest or the petitioner shall surrender before the Judicial Magistrate No.1,
Coimbatore, and execute a bond of Rs.10,000/- within 15 days from the
date of this order.
(iii) The petitioner shall produce two sureties likesum each to the value of

40 F 2810, as interim custody to the petitioner.
2. The learned counsel appearing for the petitioner has submitted that the
petitioner is the owner of the vehicle i.e., Ashok Leyland Vehicle bearing the
Registration No. TN 40 F 2810. The said vehicle has been seized by the
respondent police in Crime No.174/2021. The petitioner used the said vehicle to
supply building materials to the public. The said vehicle is essential for the
petitioner for his day to day life. As of now, the vehicle is kept idle without any
use. The value of the vehicle will get depreciate. In the said circumstances, the
petitioner prays to return the vehicle to the petitioner as interim custody.
3. The learned Public Prosecutor has filed counter, wherein it is stated that
the vehicle has been seized by the authorities concerned stating that the said
vehicle was used to transport gravel sand without any valid permission. On the
same day, information was sent to the Revenue Authority to take necessary action.
As of now, the vehicle was produced before the Judicial Magistrate No.2, Polalchi,
and PR No has been assigned as PR No.185/2021.
4. This Court has considered the submissions made by either side. The
petitioner is the owner of the petition mentioned vehicle. The vehicle was seized
by stating that it was used in transporting gravel illegally. The respondent police
registered the case in Crime No.174/2021. As of now, the vehicle was produced
before the Judicial Magistrate No.2, Pollachi and PR number assigned as PR
No.185/2021.
5. After considering all the above said aspects, this Court is inclined to allow
this petition and thereby the petition mentioned vehicle is ordered to be returned to
the petitioner as interim custody subject to the following conditions:-
(i) Petitioner shall deposit a sum of Rs.20,000/- (Rupees Twenty thousand
only) to the credit of the same in Crime No.174/2021, of Aliyar Police Station,
before the Judicial Magistrate No.2, Pollachi.
(ii) Petitioner shall execute a personal bond for a sum of Rs.10,000/- (Rupees
Ten Thousand only) with two sureties for a like sum each to the satisfaction of
the Judicial Magistrate No.2, Pollachi.
(iii) Petitioner shall give an affidavit before the Judicial Magistrate No.2,
Pollachi, stating that she will not use the vehicle in question for any illegal
activities in future and shall produce the said vehicle as and when required by the

4. The learned Public Prosecutor submitted that occurrence happened on
19-09-2021 and the same has been reported to the respondent police on the same
day. There are two accused in this case. The accused are in possession of 15
numbers of brandy bottles. On enquiry, it came to know that they involved in
selling the said liquor bottles for higher price. In this case, investigation is still
pending. The petitioners belong to other District. No previous case is reported
against the petitioners.
5. This Court has considered the submissions made by either side. The
petitioners have been remanded to judicial custody for illegal possession of 15
numbers of brandy bottles. After arrest, the respondent police seized the liquor
bottles. In this case, investigation is still pending. The petitioners belong to other
District. No previous case is reported against the petitioners.
6. After considering all the above said aspects, considering the nature of
offence, period of incarceration, since properties have been recovered and bring the
first offender, this Court is inclined to grant bail to the petitioners subject to
the following conditions:-
(i) The petitioners are ordered to be enlarged on bail on their executing a bond
for Rs.10,000/- each with two sureties for a like sum each to the satisfaction of the
Judicial Magistrate No.2, Coimbatore.
(ii) The petitioners are directed to sign before the respondent police,
daily at 10.00 a.m. until further orders.
(iii) The petitioners or their men shall not tamper the evidence.
(iv) The petitioners shall not abscond and they shall co-operate with the

The petitioner is the accused in Crime No.414/2021 of B-3, Variety Hall
Road Police Station, since he is apprehending arrest at the hands of the respondent
police, for the alleged offences u/s.6(a), 6(b), 24(1) and 20(2) of COTPA Act and
Sec.77 of JJ Act, he has filed this petition, seeking grant of anticipatory bail.
2. The learned counsel for the petitioner has submitted that the petitioner is
arrayed as A-1. In this case, A-2 and A-3 are arrested and remanded and
subsequently they are released on bail by the learned Judicial Magistrate No.5,
Coimbatore. The petitioner is no way connected with the offence. The petitioner
is the owner of the shop. The petitioner is not present in the occurrence place at
the time of occurrence. The petitioner is an innocent and he has been falsely
implicated in this case and prayed for grant of anticipatory bail to the petitioner.
3. The learned Public Prosecutor submitted that occurrence happened on
14-09-2021 and the same has been reported to the respondent police on the same
day. There are three accused in this case. A-1 is the owner of the shop. The
respondent police was engaged in patrol duty at Idayar Stree, near Meera Stores.
At that time, one minor boy came and he had given a substance like a powder and
on suspicion the respondent police enquired the said minor boy. On enquiry, the
respondent police came to know that the accused persons stored banned tobacco
products in a particular godown. The respondent police seized banned tobacco
products in the three gunny bags. Investigation is going on.
4. Considering the submissions made by either side, having regard to the
nature of offence, quantum of banned articles involved, and also considering the
facts and circumstances of the case, this Court is inclined to grant anticipatory
bail to the petitioner subject to the following conditions:-
(i) Anticipatory bail is granted to the petitioner.
(ii) The petitioner shall execute a bond for Rs.10,000/- in the event of his
arrest or the petitioner shall surrender before the Judicial Magistrate No.5,
Coimbatore, and execute a bond of Rs.10,000/- within 15 days from the
date of this order.
(iii) The petitioner shall produce two sureties likesum each to the value of
Rs.10,000/- to the satisfaction of the Judicial Magistrate No.5, Coimbatore,
within 15 days from the date of this order.
(iv) The petitioner is directed to sign before the respondent police daily at
10.00 a.m., until further orders.
(v) The petitioner or his men shall not tamper the evidence.
(vi) The petitioner shall not abscond and he shall co-operate with the investiga-
tion agency as and when required.
(viii) In case of the condition No.(ii) to (vii) are violated, it is open to the investi-
gating officer to file appropriate application before the learned Judicial Magistrate
for cancellation of bail granted hereby, as held by the Hon’ble Supreme Court in
P.K.Shaji /vs/ State of Kerala [(2005) AIR SCW 5560].

These two petitions are coming on this day for final hearing before this

Advocate for the petitioner in C.M.P.No.3854/2021 and Thiru. M.Kanagaraj,
Public Prosecutor, represented for State, upon perusing the petitions submitted
via e-mail and upon hearing both side arguments, this Court pronounced the
following:-
COMMON ORDER
Heard on both sides.
The petitioners in the respective petitions are the accused in Crime
No.764/2021 of Rathinapuri Police Station, for the alleged offences u/s.147, 148,
294(b), 323, 324 and 307 of IPC, they have filed these three petitions separately,
seeking grant of bail.
2. The case of the prosecution is that on 29-08-2021, the petitioners in the
respective petitions and other accused unlawfully assembled in the occurrence
place and picked up quarrel with the defacto complainant and abused the defacto
complainant by using filthy language and assaulted the defacto complainant and
another person and caused injuries to them. Hence, the present complaint.
3. The learned counsel for the petitioners in C.M.P.3738/2021 submitted that
the petitioners are arrayed as A-6 and A-7. Initially, the defacto complainant was
admitted in a private hospital and thereafter the defacto complainant has been
admitted in CMC Hospital and thereafter, the case has been registered. In this
case, victim has been discharged from the hospital on 31-08-2021. The petitioners
are innocent and they have been falsely implicated in this case and they are in
judicial custody from 06-09-2021 and prayed to release the petitioners on bail.
4. The learned counsel for the petitioner in C.M.P.3854/2021 has submitted
that the petitioner is mentally abnormal and he is taking medicines for the past two
years. The petitioner is in need of medical assistance. The petitioner is an
innocent and he has been falsely implicated in this case and he is in judicial
custody from 29-08-2021 and prayed to release the petitioner on bail.
5. Opposing to grant anticipatory bail to the petitioners in the respective
petitions, the learned Public Prosecutor submitted that occurrence happened on
29-08-2021 and the same has been reported to the respondent police. There are
eight accused in this case. Already seven accused were arrested and remanded.
On receipt of intimation from the Government Hospital, the respondent police
went to the hospital and recorded the statement of the victim. On 29-08-2021, at
about 8.00 p.m., the defacto complainant and three others went to a biriyani hotel.
At that time, three accused persons were standing there. At that time, there arose
some wordy quarrel between the accused persons and the defacto complainant. In
that process, the defacto complainant’s relative namely Sadam Hussain assaulted
one of the accused. Thereafter, at about 8.20 p.m., the defacto complainant and
others were standing in Kannappan Nagar area. At that time, the petitioners in the
respective petitions along with other accused unlawfully assembled in the said
place and picked up quarrel with the defacto complainant and others and assaulted
the defacto complainant by using iron rod and knife. In that process, the defacto
complainant’s relative also sustained injury. After the occurrence, the victim was
admitted in Coimbatore Medical College Hospital on 30-08-2021 and discharged
from the hospital on 31-08-2021. Thereafter the victim was admitted in private
hospital. In this case, investigation is not yet completed. No previous case is
reported against the petitioners in the respective petitions. Against A-1, two
previous cases are pending against him. Against A-4, two previous cases are
pending against him.
6. This Court has considered the submissions made by either side. The
petitioners in the respective petitions have been remanded to judicial custody from
u/s.147, 148, 294(b), 323, 324 and 307 of IPC. The petitioners in
C.M.P.3738/2021 are in judicial custody from 06-09-2021. The petitioner in
C.M.P.3854/2021 is in judicial custody from 29-08-2021. According to the
petitioners in the respective petitions, they have been falsely implicated in this case
and they are no way connected with the offence. The learned Public Prosecutor
submitted that on the date of occurrence, the petitioners in the respective petitions
along with other accused unlawfully assembled in the occurrence place and picked
up quarrel with the defacto complainant and others and assaulted the defacto
complainant by using iron rod and knife. In that process, the defacto complainant’s
relative also sustained injury. Victim was admitted in CMC hospital on 30-08-
2021 and discharged from the said hospital on 31-08-2021. Investigation is going
on. No previous case is reported against the petitioners in the respective petitions.
7. After considering all the above said aspects, considering the nature of
offence, having regard to the period of incarceration, considering the alleged overt
act in the FIR, being the first offenders, and also considering the facts and
circumstances of the case, this Court is inclined to grant bail to the petitioners
in the respective petitions subject to the following conditions:-
(i) The petitioners in the respective petitions are ordered to be enlarged on bail
on their executing a bond for Rs.10,000/- each with two sureties for a like sum
each to the satisfaction of the Judicial Magistrate No.2, Coimbatore.
(ii) The petitioners in the respective petitions are directed to sign before
the respondent police, daily at 10.00 a.m. until further orders.
(iii) The petitioners in the respective petitions or their men shall not tamper the
evidence.
(iv) The petitioners in the respective petitions shall not abscond and they shall
co-operate with the investigation agency as and when required.
(v) Violation of any of the condition imposed by this Court will result in
cancellation of the bail.
(vi) In case of the condition No.(i) to (iv) are violated, it is open to the
investigating officer to file appropriate application before the learned Judicial
Magistrate for cancellation of bail granted hereby, as held by the Hon’ble Supreme
Court in P.K.Shaji /vs/ State of Kerala [(2005) AIR SCW 5560].

The petitioners in the respective petitions are the accused in Crime
No.380/2021 of Madukkarai Police Station, for the alleged offence u/s.395 and 397
of IPC, they have filed these two petitions separately, seeking grant of bail.
2. The case of the prosecution is that the defacto complainant was assaulted
and threatened by the accused persons on the guise of purchase of two vans for his
business purpose.
3. The learned counsels for the petitioners in the respective petitions have
submitted that in this case, the respondent police recovered the car. The petitioners
in the respective petitions are innocent and they are no way connected with the
offence and they have been falsely implicated in this case and they never
committed any offence as alleged and the petitioners in C.M.P.3662/2021 are in
judicial custody from 07-07-2021 and the petitioner in C.M.P.3706/2021 is in
judicial custody from 12-07-2021. The learned counsels further submitted that the
earlier bail petition filed by the petitioner in C.M.P.3706/2021 has been dismissed
by this Court on 06-08-2021 and this is the second bail petition.
4. The learned Public Prosecutor has submitted that occurrence happened on
07-07-2021 and the same was reported to the respondent police on the same day.
There are seven accused in this case. The defacto complainant’s native place is
Kerala and he is doing courier service. He intended to purchase van for his
business purpose through OLX Service. He contacted one Suraj and the said Suraj
informed the defacto complainant to come to Palakkad with a sum of Rs.3.0 lakhs.
As such, on the date of occurrence, on the instruction given by Suraj, the defacto
complainant along with his friends came to Karpagam College and stopped their
car. At that time, three persons intercepted the car and got into the car. They went
to a house and stopped the car. All are gone inside the house and already four
persons are there in the house. All of a sudden, they locked the house and started
to threaten the defacto complainant and assaulted the defacto complainant. They
had taken amount and two ATM cards and three cell phones from the defacto
complainant and his friends. After arrest, car has been recovered. Portion of
amount recovered. Investigation is going on. The learned Public Prosecutor
submitted CD File for this Court’s perusal.
5. This Court has considered the submissions made by either side and
perused the CD File. The petitioners in the respective petitions have been
remanded to judicial custody for the offences u/s.395 and 397 of IPC. The
petitioners in C.M.P.3662/2021 are in judicial custody from 07-07-2021 and the
petitioner in C.M.P.3706/2021 is in judicial custody from 12-07-2021. As per the
complaint, the accused persons had snatched cash, ATM Card, car and other things
from the defacto complainant. According to the petitioners in the respective
petitions, they have been falsely implicated in this case and they never committed
any offence as alleged. The learned Public Prosecutor submitted that after arrest,
car has been recovered and portion of amount has been recovered. Investigation is
going on.
6. After considering all the above said aspects, considering the nature of
offence, period of incarceration, and also considering the facts and circumstances
of the case, this Court is inclined to grant bail to the petitioners in the
respective petitions subject to the following conditions:-
(i) The petitioners in the respective petitions are ordered to be enlarged on bail

M.Kanagaraj, Public Prosecutor, represented for State, upon perusing the
petition submitted via e-mail and upon hearing both side arguments, this Court
pronounced the following:-
ORDER
The petitioners seek anticipatory bail.
The learned counsel for the petitioners submitted that petitioners attended
enquiry.
The learned Public Prosecutor has submitted that petitioners attended
enquiry. Enquiry is going on.
In view of the submissions, this petition is adjourned to 04-10-2021.
Call on 04-10-2021. Till such time, the respondent police is directed
not to arrest the petitioners.
