ROHDE HEATING ELEMENTS Precisely calculated with an additional power reserve.

Heating element design

A heating element is made from a high-quality resistance wire from Kanthal. To produce a heating element, the wire, depending on the area of application, is formed into one or more spiral heating coils which are connected by bars. At the beginning and end of the heating element, there is a straight connector which connects the heating element to the electrical or switch box. The elements shown are for illustration. A heating element can consist of many connected heating coils.

In diagrams, a heating element is always shown in simplified form, regardless of whether the heating element represented consists of one, two or more coils.

Tip

Heating elements are wear parts that age with every use and lose performance in small steps. Many factors influence wear, such as the number of firings, the maximum firing temperature, the ingredients in the fired goods, the type of firing curve or premature opening of the kiln. We, therefore, recommend that you always have a set of heating elements in stock so that the furnace can be put into use again quickly if a heating element needs to be replaced. In addition, we generally recommend replacing all heating elements in the kiln and do not recommend mixing individual new heating elements with existing heating elements.

Heating element installation positions

The installation position of heating elements is specified by a combination of letters and numbers. • The letter indicates the location in the kiln where the heating element can be used: e.g. „S“ for the sidewall or „B“ for the floor• A number is also used to distinguish between the top, middle and bottom of the kiln body. The numbering of the locations is

from top to bottom. If only one installation position is required, this is numbered 1.• A heating element can be used in several positions. The appropriate positions are given in the table.• An installation position may require several heating elements. The number of heating elements required for a position is given in

the table (1x, 2x, 3x, etc.)

Toploaders

The installation positions for frontloader heating elements are marked with the letter „S“ for the sidewall, „B“ for the floor and, if applicable, with „T“ for the doors and „R“ for the back wall. The heating element for the sidewall installation position of a frontloader (e.g. S1) is identical for both sides. The heating element can, therefore, be used either for the left or right sidewall.

ROHDE HEATING ELEMENTS Find the right heating element.

The model name and serial number are necessary to find the right heating element:

The serial number of the product must be within the range specified in the „Serial number from to“ column. If a model is delimited by serial numbers, the serial number ranges are displayed in ascending order.

All models of the series are listed in the first column „Suitable for“. The model name must exactly match the information on the type plate. If there are several versions of a model, these are displayed one below the other.

There are installation positions that require multiple heating elements. The number of heating elements required for the respective installation position is shown in the table. In the example below, the KE 35 B kiln requires two heating elements with the item number 651107 for installation position B (floor).

Note

There are heating elements that can be used in several positions. The possible installation positions are marked in the tables. In the following example, the heating element with the item number 650261 can be installed at positions H1, H2 or H3.

You will find the installation position for where the heating element is intended in the „Installation position“ column.

You will find the item number of the suitable heating element in the „Heating element item number“ column. If there are several different heating elements for a kiln model, the item numbers are grouped together.

HEATING ELEMENTS Ecotop series

• Depending on the size and design of the kiln, either one or three individual heating elements are installed in Ecotop series toploaders, the installation positions for which are designated H1, H2 or H3. (see version 1 and 2 above).

• The installation positions are numbered from top to bottom. If only one heating element is installed, the position is designated H1.

• Heating elements can be used in several installation positions. The possible positions are specified in the „Heating element position“ column.

• If there is more than one kiln model, the serial number range must be checked.• If the kiln requires several different heating elements, these are shown summarised in a column.

HEATING ELEMENTS TE-Q and BT series

• Depending on the size and design of the kiln, one, two, four or six individual heating elements are installed in TE-Q series toploaders, the installation position for which is designated H1 (see version 1 above).

• The installation positions are numbered from top to bottom. If only one heating element is installed, the position is designated H1.• Heating elements can be used in several installation positions. The possible positions are specified in the „Installation position“

column. Example: The TE 135 QT requires six identical heating elements for the installation position H1 (sidewall).

• Nine individual heating elements are installed in BT series toploaders, the installation positions for which are designated H1 and B (see version 2 above).

• The installation positions are numbered from top to bottom. If only one heating element is installed, the position is designated H1.• Heating elements can be used in several installation positions. The possible positions are specified in the „Heating element

position“ column. Example: For the installation position H1 (sidewall), the BT 300 requires seven identical heating elements.

• If there is more than one kiln model, the serial number range must be checked.• If the kiln requires several different heating elements, these are shown summarised in a column.• The BT 500 model has three different designs for the heating element at installation position B (floor). The appropriate type

(A, B and C) must be requested by the customer using the form.

General Conditions of Sale

General Conditions of Sale of Helmut Rohde GmbH 04/2014

All our deliveries and services shall be subject to the terms and conditions of contract set

forth below.

§ 1 Conclusion of Contract, Condition of Goods

A contract between Rohde GmbH and the Customer shall first come into being upon the

signing of the delivery contract. Our offers are non-binding and subject to change. If we

confirm an order then the contract shall come into being upon the Customer‘s receipt of

our confirmation of order. The customer shall be committed to orders for the duration of

one month, counting from the date of the order being received by the supplier (Rohde

GmbH) unless the customer has specified a shorter acceptance period at the time of

placing the order.

The content of the contract is governed by the contractual agreements, our offer, our

written confirmation of order, as well as these terms and conditions of delivery. Verbal

collateral agreements shall not exist. Any amendments to the content of the contractual

obligations may not be instructed unilaterally and shall require to be made in writing; any

claims to additional remuneration arising therefrom shall be made prior to the work being

carried out.

Statements regarding the condition and service life of the goods, through which we convey

to the Customer further rights notwithstanding their legal claims, shall only then represent a

guarantee of condition and service life in accordance with § 443 BGB (German Civil Code)

if we have expressly named them as guarantees. The contents of our product brochures

do not provide binding information regarding the condition of the goods, quotations and

price lists.

§ 2 Delivery, Passing of Risk

Our deliveries are effectuated ex works or warehouse. We shall dispatch the goods on

request of the Customer to the Customer‘s company or to another location arranged with

the Customer. The Customer shall carry the forwarding expenses. Partial deliveries shall be

admissible, as far as they are reasonable for the Customer.

The risk shall pass to the customer at the earliest upon our goods being supplied, once

the customer has been notified by us that the goods are ready. The risk of accidental

destruction or damage to the goods shall pass to the Customer as soon as the goods

have been handed over to a forwarding agent, the carrier or any other person or institution

assigned with the effecting of the delivery of the goods, and at the latest upon departure

from our factory or warehouse. If the goods are ready for dispatch and their forwarding is

delayed for reasons for which Rohde GmbH is not responsible, the risk shall be passed to

the Customer upon receipt of the dispatch advice notice. This also applies if the delivery

has been agreed „carriage free“. Rohde GmbH shall be under no obligation to take out

transport insurance, unless we have expressly agreed on doing so with the Customer. In

this case the Customer shall carry the insurance costs.

§ 3 Delivery Periods, Delivery Hindrance

The observance of agreed delivery periods and times can only be demanded if the dates

were agreed on as fixed dates by the parties and have also been called fixed dates. The

observance of delivery dates is, in every case, subject to Rohde GmbH‘s punctual receipt

of all documents, required approvals and releases, in particular of plans to be supplied

by the Customer, as well as the observance of the arranged terms of payment and other

duties held by the Customer. If these presuppositions remain unfulfilled, fulfilled only in part,

or not fulfilled in time, the delivery dates shall be extended accordingly; this shall not apply

if Rohde GmbH is responsible for the delay. Deadlines for delivery shall be extended further

if the hindrance is at the customer‘s risk or any obligations not originally envisaged in the

agreement are agreed.

Cases of force majeure (unexpected circumstances and occurrences which are not caused

by us and which could not have been avoided with the due care of a proper business

person, e.g., labor disputes, war, fire, transportation hindrance, raw material lack, official

measures) shall interrupt, for the time of their duration and the extent of their effect, our duty

of delivery, even then if we are already in breach of delivering in a timely manner. Provided

that Rohde GmbH has concluded a congruent covering transaction with Rohde GmbH‘s

own suppliers in time, the delivery periods stated by Rohde GmbH are subject to punctual

and orderly self-supply.

§ 4 Right of Rescission

In cases of force majeure or inability to conclude a timely matching hedging transaction

we shall be entitled to rescind the contract if we have informed the Customer immediately

of the onset of the incidence of force majeure or of a breach to the proper and timely

self-supply, and to refund the Customer immediately for any provision already made by

the Customer. In the event of the customer falling behind with the obligation to accept

deliveries, we may – subject to the statutory provisions - withdraw from the contract

if the deadline of one week previously set for the customer to carry out the acceptance

has expired fruitlessly.

§ 5 Prices and Payments

Our prices shall be considered net ex works excluding packing, freight, postage and

transport insurance. If Rohde GmbH has accepted further services, in addition to the

delivery of the goods, e.g., setting-up, assembly, connection, functional tests, initiating,

test mode and/or personnel instruction, then the Customer shall carry all necessary expen-

ses arising here from for our additional services, above and beyond the price of the goods,

in particular the wages payable at our respective valid hourly rate, travel expenses

(transportation expenses and accommodation costs), expenses for the transportation of

tools and personal luggage.

Rohde GmbH reserves the right to adjust prices accordingly, if after conclusion of the

contract our production costs and delivery charges should rise due to circumstances

for which we are not responsible (e.g., increase in pay rates, materials price raises, tax

increases, etc.) and if we inform the Customer about the price increase in due time before

delivery. Our invoices shall fall due for payment immediately upon the receipt of the goods

by the Customer. If payment is effected within 8 days from receipt of invoice, we shall

grant a 2% discount. The contracting parties agree on a calendric performance time

in accordance with § 286 section 2 no.1 BGB (German Civil Code) for the obligation

to payment no later than 14 days after invoice receipt. In case of delay in payment by

the Customer we shall be entitled to charge a default interest at a rate of 8 percent above

the ECB base rate. The Customer shall only be entitled to offset counterclaims or claim

retention of goods because of counterclaims, if these counterclaims are undisputed and

confirmed by a court of law. The offset of a claim against us, which does not consist of a

monetary claim shall be subject to our agreement in order to become effective.

§ 6 Delivery and Service Scope; Duty for Co-operation at Assembly

The scope of our deliveries shall be based upon the content of the services agreed on.

Our deliveries shall not include the delivery of technical program control software, unless

we have expressly agreed on the delivery of such software with the Customer. The delivery

of the software can be arranged together with the delivery of our goods or separately.

Advancements and / or new developments to the software supplied shall not be part of our

delivery and service duties.

The Customer shall ensure that all actions and preparations which must be performed by

the Customer, including the supply of all agreed appliances and support staff, are prepared

duly and in time, before we perform any deliveries and services in the Customer‘s company

or at any other place agreed on. If the Customer does not fulfill their duty for co-operation

and if this results in a delay to our deliveries and services, then the Customer shall refund

us appropriately for the expenses for the waiting periods and additional travel required of

Rohde GmbH employees and the assembly staff.

The following regulations apply for setting-up and assembly, unless an additional agreement

in writing states otherwise:

• all earth works, construction works and other works foreign to the trade, including

the herefore required skilled and unskilled workers, building materials and lubricants,

• all objects and materials required for the assembly and initialing, such as stands,

hoists and other equipment, fuels and lubricants,

• power and water supply on site, including connections, heating and lighting,

• at the place of assembly: sufficiently large, suitable, dry and lockable rooms for

keeping machine parts, equipment, materials, tools etc., as well as adequate work

and relaxation rooms for the assembly personnel, including adequate sanitary

facilities; also the Customer must take measures to protect Rohde GmbH

possessions as well as the possessions of the assembly staff to the extent to which

the Customer would also protect their own possessions,

• Protective clothing and safety devices which are required as a result of special

circumstances at the assembly place.

• Before we begin the assembly works the Customer must supply us unbidden with

the necessary information about the position of hidden electrical, gas or water lines,

or similar arrangements, as well as the requisite static information.

• Before we begin setting-up or assembly all provisions and equipment necessary

for the commencement of the work must be prepared at the site of setting-up or

assembly, and all preparations before setting-up must have progressed to the extent

that the setting-up or assembly can be commenced as arranged and can be carried

out without interruption. Access ways and the place of setting-up or assembly must

be leveled off and cleared. Should the setting-up, assembly or initiation be delayed

by circumstances for which we are not responsible, then the Customer shall refund

us appropriately for the expenses incurred during waiting periods and additionally

travel required of Rohde GmbH personnel or the assembly staff.

• The Customer shall provide a report on the working hours of the assembly staff

weekly, and the finishing of the setting-up, assembly or initiation immediately.

If we require official acceptance of delivery, the Customer shall carry out such an

acceptance within a period of two weeks. We shall provide the acceptance protocol.

If the Customer fails to effectuate the acceptance within a 2 week term, the acceptance

shall be considered as provided. The acceptance shall also be considered as provided,

if the delivery object has been put into operation, where applicable following the

conclusion of an arranged test run.

§ 7 Rights and Duties of the Customer in Case of Defects

The Customer shall inspect the goods for defects immediately after delivery. The Customer

shall notify us immediately, but no later than within 7 workdays, of any noticeable damage.

The inspection and objection notice period commences with delivery, and no later than with

conclusion of a test run. The Customer shall notify us of hidden defects immediately after

detection of such. If the Customer fails to carry out an inspection of the goods or provide

notice of an objection arising from a defect, then the Customer shall forfeit all rights which

relate directly or indirectly to the defect.

If the goods are defective, the Customer shall initially have the right only to claim supplementary

performance, unless the supplementary performance is unreasonable for the Customer.

We shall be entitled to choose between providing remedy or additional delivery. Should

the supplementary performance fail twice or should it be refused by us, then the Customer

shall be entitled to claim an appropriate price reduction or to rescind the contract. If our

expenditure increases with a supplementary performance because the goods were transported

to a place other than the site of the Customer or the place of use indicated - especially in the

case of export trade - then the Customer must refund us for the increased expenditure. In the

case of claims for damages, the limitations of liability stated in the following paragraphs shall

apply. If from several purchased goods only individual goods are defective, or if from

one purchased good only individual parts are defective, then the Customer‘s right

of rescission shall be restricted to the individual good or the individual part of the

good respectively. This shall not apply if the individual defective good or the individual

defective part of a good cannot be separated from the other goods or parts without

damage or functional losses or if this is unreasonable for the Customer. The Customer

shall be required to explain the reasons for this being unreasonable. If we produce

custom-made goods for the individual requirements of the Customer, then the Customer

shall be permitted to rescind the contract right up to the point of completion of our goods

production for essential reasons only. We shall not be liable for the correctness of the cost

estimates upon which the contract was based. Incidentally § 651 BGB (German Civil Code)

applies.

§ 8 Limitation of Liability, Exclusion of Rescission on Grounds of Certain

Breaches of Duty

We shall be liable without limitation according to the legal presuppositions in every case of

injury to life, limb or health insofar as we are at fault, and independent of fault in accordance

with the Produkthaftungsgesetz ( German Product Liability Law). In the case of a breach

of material contractual duties, we shall be liable in principle without limitation for damage

where willful intent or gross negligence apply, and in cases of ordinary negligence our

liability shall be limited to the scope of damage foreseeable for business transactions of

the kind in question.

Claims for damages against us on any legal grounds whatsoever shall be excluded in all

other cases, unless a case arises of a willful or grossly negligent breach of duty committed

by us, our legal representatives or our vicarious agents. Our liability in the case of gross

negligence shall be limited to the scope of damage foreseeable for business transactions

of the kind in question. The Customer‘s rights to rescind the contract on the grounds of a

breach of contract for which we are not responsible and which does not consist of a goods

defect shall be excluded. The liability exclusions stated in the sections above shall also be

effective for our vicarious agents and all persons and institutions working on our behalf.

§ 9 Reservation of Title

We reserve full title to the subject matter of the contract of sale until all due payments

have been effected by the Customer. In the case of any attempt by a third party to seize

reserved goods, the Customer shall inform such third party of the reservation of title by

Rohde GmbH and inform us immediately. In the case of delay in payment on the part of

the Customer we shall be entitled to reclaim the reserved good at his expense, if we have

rescinded the contract. If the Customer is a businessperson in the sense of § 14 BGB

(German Civil Code), sections 5-10 apply additionally. We reserve exclusive title of all

delivered goods until the settlement of all claims, including future claims, arising from the

business relationship and the settlement of the respective balance of invoice. The Customer

may not pledge the goods or assign them by way of security or realize them otherwise,

unless the purchase of the goods is effectuated for the purpose of reselling. In such a case

the Customer is entitled irrevocably to resell the reserved goods within the framework of an

orderly business establishment in the Customers own name, as long as the Customer is in

no delay of payment with us.

Where our goods are combined with other goods Rohde GmbH shall acquire co-title,

our share being calculated on the basis of invoice value (our delivery price including VAT,

excluding discount deductions); if the Customer acquires full title according to the law,

the Customer shall transfer the respective proportionate co-title to us and shall keep the

subject matter for us free of charge. Processing shall take place on behalf of Rohde GmbH.

The Customer herewith assigns to us with immediate effect all claims , including all balance

claims from current accounts, which will have resulted with regards to the reserved goods

through resale or on other legal grounds (e.g. insurance, tortious act) , to the amount of the

invoice value to us by way of security. This also applies in the case that a resale was not

permissible in accordance with the limitations stated above. We accept the assignment.

If we only hold co-title of the reserved goods, the pre- assignment shall be limited to the

percentage of the claim which corresponds to the percentage of our co-title on the basis

of the invoice value.

The Customer shall be entitled irrevocably to collect the claims assigned to us in their own

name and for our account. This collection authorization can be revoked if the Customer does

not follow his/her payment obligations duly. In the case of the legitimate revocation, the

Customer or their legal successor or insolvency administrator has to disclose on demand

all assigned claims and their debtors including their addresses, give all information

necessary for the collection, deliver the respective documents and inform the debtor

immediately about the assignment. Rohde GmbH shall release the aforementioned securities

on the Customer‘s request, as per our choice, if its liquid value surpasses the secured claim

in sustainable terms by more than 10%. The liquid value shall be defined as the estimated

price for reserved goods and the nominal value for claims assigned for way of safety, with

a deduction of one third respectively. In the case of any attempt by a third party to seize

reserved goods, the Customer shall also immediately file suit according to § 771 ZPO

(so-called third party proceedings) as nominated representative on the Customer‘s own

account.

§ 10 Property Rights and Copy Rights

We unreservedly reserve the rights to property and industrial property, as well as copy rights

to all services provided by us, in particular to all programs, drawings and other documentation

created and provided by us. If a contract with us does not come into existence then the

Customer shall be required to return all drawings, documents and other services already

effectuated immediately to us. The documents and other services shall only be made

accessible to a third party if we have expressly agreed to such. Should this provision be

infringed, the customer shall be obliged to exempt us from any claims filed by third parties.

§ 11 Period of Limitation

Claims of the Customer on defects of the good shall be subject to a limitation period of

one year. Claims of the Customer based on a defect of the good, which consists of an

in rem right of a third party, on which grounds the return of the good can be claimed,

shall be subject to a limitation period of ten years. Claims based on a defect of a construction

are subject to a limitation period of five years. If the Customer is a consumer for

the purpose of § 13 BGB (German Civil Code), then claims based on a defect of a new

good shall be subject to a limitation period of two years. Other contractual claims by the

Customer based on breaches of duty shall be subject to a limitation period of one year.

Claims based on a guarantee shall also be subject to a limitation period of one year, if we

have granted a guarantee and the guarantee does not state otherwise. The legal periods of

limitation apply to the rights of the Customer to rescind the contract for reasons of breach

of duty by us. Incidentally the legal regulations apply to the claims of the Customer. Our

claims against the Customer are also subject to the legal periods of limitation.

§ 12 Applicable Law, Place of Fulfillment, Jurisdiction

German Law shall be exclusively applicable for the contract. The United Nations

Convention on Contracts for the International Sale of Goods (CISG) shall not apply. The

place of fulfillment, also for settlements effectuated by the Customer, is Prutting, Germany.

If the Customer is a businessperson, the place of jurisdiction for any claims directly or

indirectly arising from this contractual relationship shall be exclusively and mutually

Rosenheim, Germany. We shall, however, be entitled to sue the Customer at their place

of general jurisdiction. For transnational deliveries the exclusive jurisdiction for all disputes

arising from the contractual relationship shall be Rosenheim, Federal Republic of Germany

(Art. 17 EuGVÜ or Art. 23 EuGVVO). We reserve the right to call on any other court presiding

on account of EuGVÜ or EuGV- VO.

Should a provision of these contractual conditions be or become legally invalid, the supply

agreement and the remaining provisions of these contractual conditions shall nonetheless

remain valid. Any invalid provision in the supply agreement or a contractual loophole is to be

replaced by a provision which comes closest to the parties‘ economic intention. An invalid

provision in these contractual conditions shall be replaced by a provision which the parties

would have chosen had they been aware of said provision being invalid.
