The Board of Public Works met in the Governor's Reception Room, State House,Annapolis, Maryland, on Wednesday, October 20, 2010.

On items where payments are to be made from proceeds of the above listed bondissues, full regard is given to the provisions of each Act and its prospective amendments.

Except as otherwise provided in these Acts, before the State agency or institutionresponsible for an individual item may begin work with funds secured under the Act, theagency or institution shall provide satisfactory assurances to the Board of Public Works that thework described in the individual items can be completed with the funds specified for that item.

If federal funds are available to help accomplish any project identified in these Acts, theState agency or institution responsible for the project shall make efforts through properadministrative procedures to obtain these federal funds. Before spending any funds securedunder these Acts, the agency or institution shall certify its efforts to the Board of Public Worksand state the reason for any failure to obtain federal funds. If federal funds are obtained, theyshall be used to defray the costs of the project described in these Acts, not to expand its scope.

Additional funds arc requested for these projects to offset additional costs realized at thecompletion of the project. Recommendation: That the Board of Public Works rescind two capital grants and reallocate thefunds to eligible county library capital projects as described.

Background: Reference is made to Secretary's Agenda Item 4 (5/19/10) and Secretary'sAgenda Item 8 (6/3/09) in which the Board of Public Works approved the State Department ofEducation's fiscal years 2011 and 2010 grants to county public library systems through theCounty Library Capital Project Grant Program. The law authorizing the grants requires grantrecipient to match their grants. Since the Board approved the grants, budget difficulties havecaused two proposed grant recipients to rescind their matching funds, meaning they are no longereligible for the grants. MSDE recommends reallocating those funds as additional b'Tantfunds tolibrary projects that the Board previously approved.

Reallocation: MSDE recommends that the $825,000 in rescinded funds be reallocated asadditional funds to library projects for which the Board previously approved grants (Sec. Item 4[5/19110]). The rescinded funds are being reallocated to projects that were not fully funded.These projects benefiting from the additional funding have been fully vetted by the MSDElibrary projects review committee, the Maryland State Board of Education, and the Departmentof Budget and Management.

8. MARYLAND DEPARTMENT OF THE ENVIRONMENT

Recommendation: That the Board of Public Works approve new loans up to $449,000 to theTown of Denton for the Denton Wastewater Treatment Plant Enhanced Nutrient Removal(ENR) Upgrade project in Caroline County. (Legislative District 378)To secure this debt, the Town of Denton will deliver its bond, along with its full faith and creditendorsement, to the Maryland Water Quality Financing Administration.

A. Up to 556,000 loan to be repaid over a period not to exceed 20 years following projectcompletion, at an interest rate 0£25% of the average of the Bond Buyer II-Bond Index for themonth preceding loan closing, currently estimated at 1.00% interest rate.

8. Up to $393,000 will be Principal Forgiyeness loan. Repayment may be forgiven as adisadvantaged community under the federal Clean Water Act. The loan tenus are enforceableshould there be a programmatic default on the loan agreement.

Project Description: The project is to plan, design and construct ENR facilities at the existing0.8 mgd Denton Wastewater Treatment Plant. After the ENR upgrade is complete, the DentonWWTP will be able to achieve effluent quality with annual average nutrient goals of 3 mg/I fortotal nitrogen and 0.3 mg/I for total phosphorous. These improvements will reduce nutrientsdischarged to the Upper Choptank River and the Chesapeake Bay.

Project Dc!)'Criptioll: This project consists of restoring approximately 3,000 linear feet ofdegraded mainstem of Rcdhousc Run and a tributary in the Back River watershed. RecommeJJt1mioll: The Department of Natural Resources recommends that the Board ofPublic Works approve an amendment to a forest conservation casement that will pemlit theconstruction ofa hikerlbiker trail from the Falls Road Light Rail Station to the Robert Lee Park.

Reference: Reference is made to Secretary's Agenda Item 18 (July 22, 2009) in which the Boardof Public Works approved DNR's acceptance of a forest conservation donation from theMaryland Transit Administration. The casement provides long-term protection for 1.29 acres offorest area located on the falls Road Light Rail Station property in Baltimore County.

Baltimore County is building a hiker/biker trail that will connect the light rail station with RobertLee Park. Because of nontidal wetlands on site, the proposed hikerlbikcr trail has to go throughproperty protected by the forest conservation easement. REQUESTING AGENCY REMARKlii: Request for approval of a sole source contract forresidential foster care for one severely, medically-fragile youth for a period of 14 months and 19days in order to continue existing critical services. In 2007. on behalf of the client theDepartment entered into an emergency one-year contract with LifeLine, Inc .• an in-state facility.A second sole source contract for two years was approved on the 111512008 DHM BPW Agenda,Item 3-5. That contract began on 1l/1212008 and is due to expire on llli 1/20 IO. Lifeline Inc. isan assisted living facility that provides out of home care for children with medical/developmentaldisabilities and for children who no longer meet the medical necessity criteria for continuedhospitalization.

LifeLine Inc. is approved by the Developmental Disabilities Administration and has a programthat will allow this youth to transition into the adult system when he becomes age appropriate.This youth requires continuity and familiarity with nursing care in his current placement that isconsistent with the treatment plan. It is, therefore, in the best interests of the child and the Slatenot to disrupt the current placement or change the existing provider of nursing services. Theprocurement method used for this contract is Sole Source and COMAR 21.14.01.06.C(I)(b)supports the decision of Sole Source for continuity of care.

COMAR 14.31.06.01 articulates the standards that must be met and maintained by residentialchild care programs for children and youth. These requirements are designed to protect thehealth, safety, and well being of children placed in residential child care programs.

This sole source contract is needed through 1/30/2012 al which time the child will be 21 yearsold and his care cost will no longer be provided by the Department.

The total award amount of $331,174 a'isumes that the slot purchased will be occupied by thisyouth for the 14 months and 19 days period. This is a reimbursement contract. The vendor ispaid solely for the actual number of days this child is with the vendor.

II of which arc Maryland firms and six are MBEs. Inaddition. six prospective vendors were directly solicited via email, two of which arc Marylandfirms and none are MBEs. A copy wa<;also provided to !.heGovernor's Office of MinorityAffairs.

Five proposals were received in response to the RFP. As indicated in Attachment I, all of theproposals were deemed rea'ionably susceptible of being selected for award. Award is beingrecommended to CTL Engineering of West Virginia, Inc. (CTL) and CME Engineering LP(CME).

CTL wa~ ranked overall #1 with the second highest Technical Offer and the lowest price. Thealmost $27,000 difference in price (36%) between CTL and the #1 ranked Technical Offeror wasjudged to outweigh the comparatively slight technical differences between the two Offerors.CME was ranked overall #2 with the second lowest price and the fourth ranked Technical Offer.CME's Financial Offer was 32% lower than the #1 ranked Technical Offeror and 30% lowerthan the #3 ranked Technical Offeror. These price differences were determined to outweigh thetechnical differences between these two offerors and CME.

Multiple awards were made due to workload and possible conflicts-of-interest with regulatedcustomers, Since CTL provided the most advantageous offer, it will have the right of firstrefusal on any task order work under this contract.

The geneml contractor will provide technical services to support MDE's Mining Program'sresponsibilities for regulating mining and accomplishing mine reclamation project activities,such as how coal mining and mine reclamation affects:

This Contract prepares and places Temporary Cash Assistance (TeA) and Non-custodial ParentEmployment Program (NPEP) customers in jobs that provide independence from welfare; andprovides training for Food Stamp Employment Training (FSET) and Able-Bodied Adultswithout Dependents (ABAWD) customers identified as mandatory work registrants.Marvatemp, Inc. has successfully bcen providing these services to FCDSS customers. Theprogram services include a wcek.long classroom experience, which focuses on job readinesstraining to help assure the success of customers who hope to transition from welfare rolls tofinancial independence through employment. The Welfare~to.Work Initiative involves workingcollaboratively with FCDSS to provide a continuum of services. aggressively leveragingresources in order to maximize employment skills, provide community service sites, as well asexternal work experience opportunities with private employers and other human service and non-profit agencies, which in turn will lead to identifying potential employment opportunities. Inaddition. the program's subcontractor. BRIDGES, Inc.• also offers a daily job lab option for allof these same customers. The BRIDGES program also provides assistance in placing customerswho are asked to do community service work, and acts as a liaison with the employer communityfor BRIDGES graduate.

Since November of 2009, the Contractor served approximately 203 TCA clients and 74FSET/ABAWD clients. Of those clients served. 115 TCA clients have been placed in jobs (a57% success rate). In addition, 25 NPEP clients were served, and 14 were placed in jobs (a 56%placement rate). DHR is satisfied with the performance of the Contractor for these services.

These services were awarded to Marvatemp, Inc. through a competitive procurement on the10131/2007 DBM BPW Agenda, Item 3-S. The two-year contract (11/112007 -10/31/2009)contained a one-year renewal option. However, the Procurement Officer (PO) at FCDSS retiredin January 2009. The person that replaced him did not submillhe option renewal to DHR in timefor presentation to the BPW for approval. As a result. the renewal option was nol exercised byDHRlFCDSS prior to the end of the base contract term; however the Contractor continued toprovide services for FCDSS. When DHR realized the omission, a retroactive sole source BPWitem was submitted for the time period that would have been the one-year renewal option (DBMBPW Agenda 6/9/2010, Item 6-5). The BPW approved this retroactive submission.

DHR intended to have the new Request for Proposals (RFP) to DBM for review in June 2010.However, there were numerous programmatic revisions made to the RFP, including a change inthe Contract term from two years with a one-year option to a four year term, which necessitatedrevised financial approval by DHR. This has caused a delay in forwarding the new RFP to OHMfor approval prior to publication.

The new RFP is undergoing final review by DHR's Assistant Anorney General (AAG) for formand legal sufficiency, before being forwarded to DBM for approval to solicit. It is judged thatthe nine month extension will be a sufficient amount of time to complete the RFP process andhave an award recommendation to submit to the BPW in July 2011.

REMARKS: Request for approval to extend contract term for one year to complete newprocurement. The new RFP procurement process has taken longer then expected. DHMHanticipates recommending a new contract for award by May 2011 for a November 2011 effectivedate.

The contract provides support and maintenance for the Eligibility Verification System (EVS).EVS is a toll-free telephone-inquiry system, available 24-7, that enables healthcare providers toquickly and efficiently verifY a Medicaid recipient's current eligibility status. Emdeon hasperformed very well for the State since it was awarded the contract in 2005. The system has hadlittle-to-any dov,ntime. The system is updated daily with immediate access to updates forproviders. The vendor has provided the State with two different locations (Tennessee andBaltimore) for access so that in the event of a problem at one location, providers still have accessto information. Emdeon has provided a 5% discount for services when the State due to theeconomic situation, requested vendors to accept lesser monetary payments.

DHMH believes that it is in the best interest of the State to extend this contract for services toenable DHMH to solicit and award a new contract to achieve the best tenns of quality of service,cost control, and timeliness.

Of these firms, 20 are certified Minority BusinessEnterprises and 43 are Maryland firms. A copy of the RFP was sent to the Governor's Office ofMinority Affairs.

DolT received three proposals. One proposal was deemed not reasonably susceptible of beingselected for award. The remaining two proposals were evaluated. The Motorola, Inc. proposalwas ranked number one technically and number one financially. Therefore, Motorola's overallproposal was determined to be the more advantageous offer to the State.

In the past, jurisdictions and agencies have built stand alone systems that met individual agencyneeds. However, the deployment of independent non-integrated systems throughout the State(owned and operated by State, county, and local agencies) has created situations that hampercross-jurisdictional and cross-discipline (e.g., police, fire, EMS, transportation) communications.In Maryland, radio communication interoperability among State agencies and localities ishampered by the use of different operating frequency bands, technologies, and systemarchitectures. These systems are generally voice only and do not support mobile dataapplications.

This new system will provide interoperable communications. This is the ability for firstresponders to transmit voice and data communications seamlessly and in real-time, when needed,regardless of agency or jurisdictional boundary. When communications systems areinteroperable, police and firefighters responding to a routine incident or a catastrophicemergency can talk to and share information with each other to coordinate efforts and workeffectively together. Many State agency voice systems will need to be replaced within the next five years as theyreach the life-cycle end and must meet the FCC narrow banding deadline. The State willimplement this enterprise solution by the Statewide public safety wireless communication systemthat supports: operable and interoperable public safety voice, low speed data communications,and Homeland Security. The State will use this integrated Statewide public safety \-'lirelesscommunication system as the primary radio communication system for State agencies. Local andmunicipal first responders may also use the system for primary radio communications. Thesystem will provide voice and low-speed data interoperability among its primary users and otherpublic safety agencies to support Day~to-Day, Mutual Aid, and Task Force operations.

For this contract, it was determined that subcontracting opportunities were available in computer/telecommunications equipment installation, in tower construction, in tower equipmentinstallation in field staging and in system testing. The MBE participation goal of 12% wasdetermined based upon analysis of the available subcontracting opportunities for these types ofwork. The contractor has committed to 13.04% MBE participation.

ARINC Inc protested the initial award of this procurement. On March 5, 2010 and March 10,2010, ARINC Inc. sent protest letters to the State. On April 2, the State of Maryland denied theARINC Inc. protests. On April 12, ARINC Inc. filed an appeal with the Maryland State Board ofContract Appeals (Docket No. MSBCA 2707). On October 7, the MSBCA granted the State'smotion to dismiss the appeal.

The MTA is replacing the switches at the North Avenue Light Rail yard to improve the efficiency andthe safety of the LR maintenance facility. Switches allow trains to move from one set of tracks toanother and the current switches are operated manually by hand cranks. This project will replace themanual switches with electrified switches that can be operated via a pushbutton that controls the trackswitch movement. The project also includes for the installation of switch stands which provideshousing for the pushbutton located near the track switch.

The DBE goal established for this contract was 8%; however the Contractor is exceeding the goal by2%.

The estimated number of jobs that will be retained/created from this contract is 2-3.

REMARKS: This Contract is for the preventative maintenance coverage of the MTA's thirty-nine (39)elevators and eighty one (81) escalators. The work involved preventative maintenance coverage of allMTA elevators for a period of five (5) years from the date of nolice to proceed and preventativemaintenance coverage of all MTA escalators for a period of four (4) years commencing one (I) yearfrom the date of notice to proceed.

This contract was designed to take on the maintenance of SI escalators as they phased out ofmaintenance coverage under a prior construction contract (1'-1240-0140). Due to budgetary issues, theprior construction contract was later forced to transfer preventative maintenance coverage of itsescalator units to 1'-1096 ten months before scheduled. therefore causing a shortage in funds for elevatorand escalator maintenance. To maintain this equipment in a safe manner. MTA began to usc theexisting contract sooner than expected.

MTA has an aggressive maintenance plan to preserve the integrity, function and safety of all verticaltransportation equipment. For each type arunit (escalator or elevator) the maintenance planincorporates five (5) types of inspections with varying frequencies. The basic activities occur bi~weeklyand constitute visual inspection and light cleaning. The most laborious occurs annually and involves theremoval of steps, lubrication of chains, etc. Unfortunately, due to the nature of the industry, these unitsundergo a lot of abuse. Whether due to operator error, weather related issues, and/or vandalism, theequipment periodically requires service repairs above routine maintenance measures.

The existing contract expires December 31, 2011. The MTA is requesting a 242 day extension toAugust 31-,20 II to allow time for the procurement of a replacement contract. -The new contractsolicitation was advertised on October 6, 2010.

REMARKS: On July 8, 2008, the Department of General Services delegated the authority to theMaryland Department of Transportation for the procurement of the Maryland State Police medevachelicopter fleet. A Request for Information (RFI) was developed and directly issued to the fourknO\\l1 Helicopter manufacturers (Agusta Aerospace Corporation, American Eurocopter, BellHelicopter and Sikorsky Aircraft Corporation). The RFI process was used 10 provide themanufactures with an opportunity to review and comment on the State's requirements/specificationdocument and provide the State with a rough order of magnitude as to the potential cost of eachHelicopter. All four manufacturers responded with their suggested/requested changes to the State'srequirements with costs ranging from $14,900,000 to $18.830.000 per Helicopter. All manufacturerssuggested/requested changes to the specification (as a result of the RFI) were incorporated into theRequest for Proposal.

The Request for Proposal (RFP) was published on eMarylandMarketplace on June 26, 2009 anddirectly mailed to the four manufacturers who responded to the RFI. A pre-proposal conference washeld and all additional suggested/requested changes from each manufacturer were incorporated byaddendum into the RFP. One proposal was received on August 26. 2009 from Agusta AerospaceCorporation (AAC) in response to the RFP.

A protest from American Eurocopter was received on August 25, 2009 regarding the specificationsof the RFP. The protest was denied by MOOT on October 16, 2009. American Eurocopter did notappeal MOOT's decision to the Maryland State Board of Contract Appeals.

A comprehensive technical evaluation of the solicitation was completed on October 23, 2009. Thecriteria used by the committee for evaluating the factors was in accordance with the RFP. Theproposal received from Agusta Aerospace Corporation (AAC) meets all of the State's mandatoryrequirements. The utilitarian nature of the proposed AWI39 Helicopter makes it an ideal platform toperform the Multi-Mission operational requirements of the Maryland State Police AviationCommand (MSPAC). The AWl39 Helicopter can readily accommodate mission expansion andgrov.1h should that be required over the next 20+ years. The speed and overall capabilities of theAW139 will allow for a faster response time to and from an accident or incident scene. Theevaluation team consisted of pilots, medics, and maintenance personnel from MSPAC, a medicaldoctor from MIEMSS and a member from the State Fireman's Association.

The Financial Committee completed a comprehensive evaluation of the financial proposal submittedin response to the RFP. In the absence of competing proposals regarding price, a price analysis wasperfonned. The price analysis included market research for similar contracts for the AW 139Helicopter. In addition. pricing investigations and comparisons were completed from variousmanufacturers and other sources of supply. This market research. pricing investigations andcomparisons were used to develop a detailed negotiation strategy. Pursuant to COMAR 21.05.03.05,MOOT entered in price negotiations. Discussions and negotiations were held with Agusta AerospaceCorporation (AAC) to assure the State would receive the best overall value. Best value was definedas a contract with AAC that would; (I) satisfy the State's requirements in terms of product qualityand timely delivery; (2) has a fair and reasonable price; and (3) fairly apportions risk between AACand the State.

REMARKS: (cont'd)The negotiations resulted in Maryland receiving a 13.2% better value as compared to another nearbyState that recently purchased AWl39 helicopters. This better value equates to $1,673,580 perHelicopter. totaling $10,041,482 for the six (6) Helicopters. A representative from the MSPHeadquarters. DBM and MEIMMS made up the Price Evaluation Committee.

In addition to the purchase of the new helicopters, the contract will include initial and recurrenttraining for pilots, maintenance and avionics technicians. a cabin~training device, special tools andequipment. consumable/non-consumable parts and supplies and PilotIMedie Safety/SurvivalEquipment. The State will have the option to purchase up to six (6) additional Helicopters betweenJuly 1, 2011 and July 31. 2013 at the original contract price plus an adjustment (increase or decrease)in the annual Consumer Price Index-Urban not to exceed 3% increase in anyone-year period. Theoption to purchase additional Helicopters will include training for ten (10) pilots for each Helicopterpurchased, The vendor has agreed to support all the helicopters purchased under this contact for thelife of the helicopter or 30 years, whichever comes first. AAC has agreed to give Maryland a 15%discount on parts over the life of this contract. Any additional parts or tools purchased after thedelivery of the new helicopters will be part of MSP's annual Operational Budget.

The MDOT PRG researched and determined that there are no MBE certified contractors for any ofthe potential subcontracting opportunities. However, we intend to seek MBE opportunities for thehelicopter maintenance RFP, Two of ACC's largest suppliers are Hone)'\vell and Pratt and Whitney,Both corporations have been involved in leadership roles in diversity programs for the past severaldecades. Both have received multiple national and regional awards for establishing and participatingin supplier and vendor diversity programs. In addition. both firms also have significant participationand leadership roles in employee diversity programs. Although there are no MDOT certified MBEsfor this requirement. a supplier diversity goal of II % is estimated on this procurement.

A subsidiary of AAC, AgustaWestland North America was recently awarded a U.S. Navy contract toprovide depot level Helicopter maintenance on three H-3 Helicopters. This work will be carried outat the company's 88,000 sq ft facility in Hagerstown Maryland. An additional 20 new employees areexpected to be added to the existing staff of26 at Hagerstown Airport for the U.S. Navy contract.During the past 16 months. Agusta Aerospace Corporation has purchased over $15,000,000 inproduct and/or services from 20 firms located in Maryland,

The MARC Odenton Station is owned by Amtrak and MTA must receive approval from Amtrak beforethe eCTV system can be installed at that facility. A Master Project Agreement between the MT A andAmtrak was signed on February 25, 2010 outlining the various phases of the project. A ProjectInitiation (PI) form was then issued to Amtrak for the Design portion of the work and the MTA iscurrently awaiting a response in order to proceed with the Construction Project Initiation (CPI) portionof the work. The CPI fOfm will need to be submitted to Amtrak for final approval prior to any workbeing performed.

Amtrak has not granted a work agreement or finalized the documents and procedures required 10facilitate the start of construction within the Odenton Station. The delay in approvals makes it necessaryto extend the Contract period. Currently, MTA Systems Engineering is in the process of finalizing anagreement with Amtrak to proceed with the work.

Per Change Order No 1 (eCR No. 003) a Contract Time Extension of one hundred and eighty (180)calendar days was granted due to delay in acquiring a contract work agreement with Amtrak for workslated for the Odenton MARC station of the MTA HSSP Phase 11project.

In addition, the completion dates established in Change Order No. I need to be clarified. The originalContract allowed for the duration of Six-Hundred (600) calendar days. The Contract Notice to Proceedwas noted as 09/08/08, however, NTP should have been 09110/08 with a Contract Completion date set atMay 03, 2010. Based on this information the new Completion date currently noted on Change OrderNo.1 should be changed to 10/30/20 IO.

The DBE goal established for this contract was 30%, however the Contractor will be exceeding the goalby 27%.

REl\lARKS: The Maryland Broadband Cooperative, Inc. ('MDBC') is a non.profit cooperativetelecommunication service provider that currently provides fiber optic infrastructure and services inunderserved rural areas of the State of Maryland. The Maryland General Assembly, under Senate Bill753 (SB753) in the 2006 Legislative Session and subsequently signed into law, granted non-profittelecommunication service providers in rural and underserved areas the use of SHA rights-of-way forthe installation of broadband communication infrastructure \',:ithout imposition of any charge for the useof the rights-of-way.

In November 2007, the Maryland Department of Transportation (MDOT)/State Highway Administration(SHA) entered into a Memorandwn of Understanding (MOU) \\lith the Maryland BroadbandCooperative, Inc. (MOBC) referred to as the "Original MOU". The tenn of the Original MOU is 10years. Federal guidelines contemplate that SHA will receive a benefit resulting from MOBC's use ofSHA's right of way. However. State law allows MOBC access to SHA right-of-way at no

charge. As pan of the Original MOU, MDBC would provide the State with the use ofa portion ofMOBC's fiber in all of its backbone (including future construction) consisting of 12 fiber optic strandsfor State use. As part of the Original MOU, MDBC also agreed to construct ten (10) fiber optic lateralsthat provide connectivity for several State and local agencies. The agreement was structured as an MOUon the incorrect assumption that MDBC was a quasi~govemment agency.

In early 2009, MDBC informed the State that it was in the process of constructing its fiber opticsinfrastructure from the Bay Bridge to Parole located on SHA right-of-way in two segments, (1) alongMD Route 50 from the \Villiam Preston Lane Memorial Bridge to the Severn River and (2) along MDRoute 450 from the Severn River into the Maryland State Goldstein Treasury Building (collectivelyRoutes 450 and 50 Project). This type of arrangement would normally be structured with a for-profitagency as a Resource Sharing Agreement: the for-profit agency would build the laterals and theconstruction costs would be negotiated on a barter or resource sharing basis without any monetarycompensation from the State for the laterals or from the provider for the use of the State right-of-way.In this case, Maryland law provides MDBC with special access to the SHA right-of-way and the Stateneeded additional fibers as the original 12 fibers provided to the State under the Original MOU were notsufficient for purposes of implementing the Routes 450 and 50 Projects. Through multiple jointdiscussions between MDOT, SHA and Dolt, it was determined to be in the State's best interest to haveMDBC co-build and co-locate State-o\\11ed fiber at the same time that MDBC was constructing itsnetwork infrastructure. By doing so, the reliability and structural integrity of the State's infrastructurewould be ensured. The State would realize fewer disruptions on the affected highways \vhich in turnwould increase the safety of the travelling public. Further, the compatibility of operational andmaintenance requirements would also be ensured. In addition, having MDBC perform this work while itwas also constructing its network infrastructure was found to be extremely cost-effective. Again, sinceMaryland law provides MDBC \\lith special access to the SHA right-of-way, SHA agreed to pay forthese laterals at a reduced cost.

Construction of these two laterals was incorrectly approved as an extension of the Original MOU. Thework along Route 50 has been completed and approved by the State. The work along Route 450 isapproximately fifty percent (50%) completed by MDBe and the completed work has been reviewed andapproved by the State. For the Routes 450 and 50 Project, MDOT agreed to pay MDBC the amount of$350,000 ($189,000 for Route 450 and $161,000 for Route 50). Upon completion of the work, thesefiber segments are o\'med by the State and all subsequent maintenance, repair, upgrade and operation isthe State's responsibility.

On or about December 2009, MDOT became aware that several MDBC invoices for the Routes 450 and50 Project could not be paid because the requisition had been rejected by the Comptroller's Office dueto the amount of the invoice and the lack ofa valid contract. The State has not paid for any work relatedto this contract even though a portion of the work was completed in 2009. Further, MDBC has not paidsome of its subcontractors for the work; it is waiting for payment from the State. From the period ofJanuary 2010 until August 2010, SHA, MDOT, DolT staff and counsel met on numerous occasions todiscuss the Original MOU and the Routes 450 and 50 Project. As a result of these meetings, it wasdetermined that the Routes 450 and 50 Project was incorrectly, but in good faith, deemed within theOriginal MOU. The agreement to install the Routes 450 and 50 Project should have been deemed a solesource award that required BPW approval.

IT staff has stated that MDBe was the only organization that was constructing fiber optic infrastructurein SHA's right of way along Routes 450 and 50 at the time this work was performed. Because the mainfor-profit telecommunication providers are members of MDBe and due to numerous communicationswhereby these providers stated to the State that it would not be cost effective to provide fiber in theareas from Routes 450 and 50 and the Bay Bridge to the Eastern Shore, it is the opinion of IT staff thatno providers other than MDBe would be in a position to perform this work in this manner.

With the construction and installation of Routes 450 and 50 Project, the State will be able tointerconnect three unique and distinct State communications networks comprising of networkMarylandoperated by the DolT, MOOT enterprise network, and Public Safety Interoperability Network (PSINet)to connect \\'ired and wireless infrastructure and even to assist local governmental entities as the needmay arise. The cost to the State for its share to construct these laterals has been determined by ITpersonnel to be fair and reasonable. In fact, procuring these services through MDBC achieved a savingsof almost of at least $500,000 by the State. In addition, according to IT personnel, because the work forthese fiber optic strands is been performed by MDBC, it ensures infrastructure reliability, minimizesimpact to motorist's safety, and minimizes disruption to SHA right-of-way.

The Original MOU will be presented to the BPW for retroactive approval on a separate agenda item.

REMARKS The work is necessary because NFPA 101and 18C-404 Atrium's code requires the rating separation between the atrium and office spaceon the third floor. The glazing surface must be continuous from top to bottom and fire protectedwith a "sheet" of water.

This modification will add glazing (3/8" tempered glass) to the corridor side of curtain wall on,the third floor (office space and elevator lobby) areas in accordance with RFI #17. Curtain walls8 and 21 are approximately 200 If of a 12' high curtain wall. These curtain walls also have acontinuous set of four foot long light fixtures that have to be mounted with stainless steel spacersone inch away from the glass surface.

The City of Frostburg began leasingthe Frostburg armory property, consisting of three parcels in 1981. The Attorney General'sOffice discovered in 2008 that the main armory parcel containing the armory building hadreverted back to the City of Frostburg per a reversion clause contained in a 1949 deed from theCity of Frostburg to the State. This reversion did not apply to the two small parcels nowrequested for transfer. The City of Frostburg has leased and maintained the armory property forover 29 years. The property is currently used as a community gymnasium; as offices. amaintenance garage and equipment yard for the City's Street Department; and office space isalso leased to the Maryland Department of the Environment. REFERENCE Approval is requested to accept anassignment of an agreement of sale from The Conservation Fund for the purchase of the abovecaptioned property in the Town of Vienna, Dorchester County. The property contains 0.25 acres+/- and fronts for approximately 28 feet on the east side ofWaler Street and 82 feet on the westside of the Nanticoke River. The property is improved with a two story residential structurecontaining 1,216 square feet. The purchase of this property represents a unique opportunity toconserve the sole remaining parcel needed to complete the Vienna Waterfront Park as an integralpart of the Vienna Greenbelt Project. This acquisition will allow the Town of Vienna to extendthe Vienna Riverwalk and connect to the Town's Greenbelt located to the south. It will provideopportunities for environmental interpretation as well as direct public access to the NanticokeRiver.

The Nanticoke River is a premier component of the newly established Captain John SmithChesapeake National Historic Trail, and appears much as it did when Captain Smith explored theriver 400 years ago, in June, 1608. In order to ensure the stewardship of this tremendousresource, the States of Maryland and Delaware recently signed a historic partnership agreementto achieve collaborative goals of a healthy and productive Nanticoke River. In this agreement,the States agreed to "identify opportunities to improve low-impact recreational activities alongthe River; and foster environmental education and stewardship opportunities for residents,schools, area businesses, organizations, visitors and recreation users.

The Town of Vienna has taken a leadership role in planning a waterfront "Discovery Center" thatwill serve as an ecotourism driver to surrounding communities and amenity to families wishingto experience the trail. This project is a further extension of the Vienna Greenbelt project and lieswithin the designated Nanticoke-Marshyhope Focus Area and the Target Ecological Area (TEA),and has received ecological ranking score of 105 under the new Program Open Space TargetingSystem. Title will be vested in the name of the Town of Vienna.
