The Chairman welcomed the members to the 238th

SEAC meeting.

The Members of SEAC unanimously taken following decisions on the agenda points

discussed:

1. Group Housing Project “VVIP Addresses” at Khasra No-826, 1111-1113, 1117, 1119, 1120, 1125,

1126,1144m, 1146, 1147, Vill-Noor Nagar, Distt-Ghaziabad.- Sri B K Jain, CEO, 58, Rajnagar

Extension, Ghaziabad. File N0. 3091/OSD-T.

The committee noted that an application dated 15/05/2015 was made by the project

proponent for environmental clearance of Expansion of Group Housing Project “VVIP Addresses”

at Khasra No-826, 1111-1113, 1117, 1119, 1120, 1125, 1126, 1144 M, 1146, 1147, Vill-Noor

Nagar, Sadik Nagar, Distt-Ghaziabad, M/s Vibhor Vaibhav Infrahome Pvt. Ltd. The terms of

reference were prescribed in SEAC meeting dated 27/06/2015. Final EIA was submitted by the

project proponent through letter dated 03/08/2015.

A presentation was made by Shri B.K. Jain, CEO, VVIP Ltd., project proponent along with

their consultant M/s GRC Pvt. Ltd. The proponent, through the documents submitted and the

presentation made, informed the committee that:-

1. The environmental clearance is sought for Expansion Group Housing Project “VVIP

Addresses” at Khasra No-826, 1111-1113, 1117, 1119, 1120, 1125, 1126, 1144 M, 1146,

1147, Vill-Noor Nagar, Sadik Nagar, Distt-Ghaziabad, M/s Vibhor Vaibhav Infrahome Pvt.

Ltd.

2. Earlier, M/s Vibhor Vaibhav Infrahome Private Limited has obtained Environmental

Clearance from SEIAA, U.P. vide Letter no. 2531/SEAC/785/2011/DD(S)/ dated

11.11.2011 for existing plot area 67,819.59 m2 (16.76 acres) and built up area 2,48,505.17

m2. Now, the expansion of the project is proposed.

The committee noted that the project proponent through affidavit dated 21/07/2015 has submitted that no activity relating to the expansion of Group Housing Project "VVIP Address"

including civil construction will be done in expansion part without getting environmental clearance.

The project proponent also submitted Khatuni details/papers related to project. Ghaziabad

Development authority through letter dated 31/MP/2-1/15 dated 10/04/2015 is given approval for

building maps wherein it is also mention that ^^LFky ds e/; ls xqtj jgh ,p0Vh0 ykbu ls fdlh Hkh fuekZ.k dh nwjh mifof/k ds izLrj&3-11-4 ds vuqlkj j[kuh gksxh**. The committee directed that no

construction shall be undertaken on related part of site which is prohibited as above clause by GDA.

The committee discussed the matter and directed to submit following information: 1. There is a change in area statements of ToRs approved in SEAC meeting dated 21/06/2015

and the area statement submitted alongwith EIA report. A detailed explanation/clarification

should be submitted.

2. Sanctioned letter submitted but the copy of maps/drawing showing FAR, proposed built up

area details under the expansion scheme should also be made available.

3. The project proponent should submit an affidavit that there is no change in the proposals

submitted for scoping and proposals being presented before the committee for

appraisal/EIA.

4. No change in basement area and stilt area in the existing/previously issued EC, however

proposal for additional basement as per the sanctioned maps can be undertaken as

committed by project proponent.

5. No podium area is proposed under the project as committed by project proponent. 6. NOC from Fire Department and Airport Authority of India/copy applied should be

submitted. 7. Structural design certificate signed by architect and vetting authority should be submitted.

8. Project proponent submitted that external drain is being constructed by GDA. The committee directed that if it does not complete prior to completion of project, the project

proponent shall make their own provision for safe discharge of treated waste water. In no case, water logging situation should arise. An affidavit in this regard shall be submitted by

the project proponent. 9. Corporate Social Responsibility (CSR) plan along with budgetary provision amounting to

2% of project cost (Rs. 1.64 Crore) shall be prepared and approved by Board of Directors of

the company. A copy of resolution as above shall be submitted to the authority alongwith

list of beneficiaries with their mobile nos./address.

The matter shall be discussed after submission of information as above.

2. Group Housing at Plot No-GC-03K/GH-03, Sector-16C, Noida Extension, Greater Noida.-Sri B K

The committee noted that an application dated 21/05/2015 was made by the project

proponent for environmental clearance of Expansion of Group Housing Project at Plot No-GC-

03K/GH-03, Sector-16C, Noida Extension, Greater Noida, M/s Solitaire Infrahome Pvt. Ltd. The

terms of reference were prescribed in SEAC meeting dated 27/06/2015. Final EIA was submitted

by the project proponent through letter dated 04/8/2015.

A presentation was made by Shri B.K. Jain, CEO, VVIP Address, authorized signatory for

the project alongwith their consultant M/s GRC India Pvt. Ltd. The proponent, through the

documents submitted and the presentation made, informed the committee that:-

1. The environmental clearance is sought for Expansion of Group Housing Project at Plot No.

GC-03K/GH-03, Sector-16C, Noida Extension, Greater Noida, U.P. M/s Solitaire Infrahome

Pvt. Ltd.

2. Earlier, M/s Solitaire Infrahome Pvt. Ltd. has obtained Environmental Clearance from

SEIAA, U.P. vide Letter no. 1727/Parya/SEAC/1648/2013/AD(VB) dated 11.10.2013 for

the plot area of 31,475 m2 and built-up area of 1,40,796.405 sq.m.

12. The project proposals are covered under category 8"b" of EIA Notification, 2006.

The committee discussed the matter and observed that approved maps with FAR details

have been submitted. Details of ToRs and the details submitted in the EIA report are same. The

committee examine the EIA and found it to be satisfactory and recommended grant of

environmental clearance on the project proposals alongwith general conditions as earlier prescribed

by the authority for construction project and following specific conditions:

1. The proponent shall submit the copy of structural safety certificate/fire NOC showing the details of blocks/towers etc duly vetted by competent authority.

2. 03 m peripheral green shall be provided around the project inside the project boundary.

3. Parking provisions as per Development Authority bye-laws should be made.

4. Revised road section as per norms showing all services in view of fire tender movement.

5. Construction material should be recycled/utilized for internal roads.

6. 15% area of the total plot area shall be compulsorily made available for the green belt

development including the peripheral green belt.

7. Project falling with in 10 Km. area of Wild Life Sanctuary is to obtain a clearance from

National Board Wild Life (NBWL) even if the eco- sensitive zone is not earmarked.

8. Criteria/ norms provided by competent Authority regarding the seismic zone be followed for

construction work. Provision of alarm system, to timely notify the residents, in case of

occurrence of earthquake/other natural disasters/fire should be provided. A well defined

evacuation plan should also be prepared and regular mock drills should be arranged for the residents. Rise of stairs should be constructed in a way, so that it should provide smooth

movement. 9. For the treatment for total sewage, a full-fledged STP is to be provided with 20% more

capacity than waste water generated during operation phase.100% waste water is to be treated in captive STP conforming to prescribed standards of receiving body for designated use.

Monitoring of STP to be done daily till its stabilization. 10. Dual plumbing should be adopted. Recycling of water as proposed shall be undertaken with

regular testing and monitoring of treated water. 11. Dedicated power supply for STPs is to be ensured during operation. Sludge of STP is to be

used in-house as manure and surplus manure should be managed by giving it to end users.

STP shall be suitably located nearest to back side boundary with shortest out let.

Operation and the maintenance cost of the STP shall also be informed along with the

compliance of the E-waste and municipal solid waste disposal.

12. Total cost of the project is 498 crore. Environmental Corporate Responsibility (ECR) plan

along with budgetary provision amounting to 2% of total project cost shall be prepared and

approved by Board of Directors of the company. A copy of resolution as above shall be

submitted to the authority. A list of beneficiaries with their mobile nos./address should be

submitted alongwith six monthly compliance reports.

13. LEDs should be used in all common areas and corridors. 100% solar lighting is to be provided

in the open areas/ stairs cases. 14. Parking guideline as per Noida Development Authority should be followed. Parking for

disabled persons should be explored. 15. All entry/exit point should be bell mouth shaped.

16. To discharge excess treated waste water into public drainage system, permission from the competent authority to be taken prior to any discharge.

17. 100 % provision of Rain Water Harvesting is to be made. RWH shall be initially done only from the roof top. RWH from green and other open areas shall be done only after permission

from CGWB. 18. An underground Pucca tank for collection/reuse of rain water may be constructed.

19. Height of the stack should be provided based on combined DG sets capacity and be 6mt

higher than the tallest building.

20. Post project monitoring for air, water (surface + ground), Stack noise of D.G. sets, STP to be

carried out as CPCB Guidelines.

21. Crèche to be provided during the construction/operation phase.

22. Provision of separate room for senior citizen with proper amenities shall be made.

23. Protection shall be provided on the windows of the high rise flats for security of residents.

24. Unless and until all the environmental issues are sorted out the occupancy will be restricted

and would be only allowed after achieving the Permission from the competent authority.

25. The project proponent shall ensure that the project site does not attract/infringe any buffer

zone of no activity identified/declared under law. 26. For any extraction of ground water, prior permission from CGWB shall be taken.

27. Sprinkler to be used for curing and quenching and ready mix concrete may be used for construction.

28. Possibilities of use of treated waste water for irrigation purposes should be explored. Drip

irrigation should be tried upto extent possible. No fresh water will be used for irrigation

purpose.

29. Mobile toilets, safe drinking water facility, sanitation facility and eco friendly fuels etc. Shall

be made available to the temporary residents/workers at the project site including the proper

treatment and the disposal of the wastes.

proponent for environmental clearance of Revision and Expansion of Group Housing Project at Plot

No-GH-16 A, Sector-1, Greater Noida, U.P. M/s. Morpheus Developers Pvt. Ltd. The terms of

reference were prescribed in SEAC meeting dated 27/06/2015. Final EIA was submitted by the

project proponent through letter dated 05/8/2015.

A presentation was made by Shri Triloki Kumar, authorized representative of project

proponent alongwith their consultant M/s GRC India Pvt. Ltd. The proponent, through the

documents submitted and the presentation made, informed the committee that:-

develop and marketing of the Group Housing Project and has in turn got the permission

from GNIDA for development of the project as per Letter No.

The committee discussed the EIA report/the presentation made by the project proponent and

observed that the project proponent/consultant were not able to explain the proposed expansion in a justified manner. The committee defer the matter with direction to prepare the proposals

appropriately and submit for further consideration of the matter. The matter the deferred till

submitted of information as above. The committee also directed to give specific attention to following points while preparing the presentation next time:

1. The project proponent should submit an affidavit that there is no change in the proposals submitted for scoping and proposals being presented before the committee for appraisal/EIA.

2. The project proponent should submit an affidavit that there is no construction proposed in the towers/blocks where construction has already been started. There is no construction started in

the towers where expansion is proposed under this expansion. 3. Justification regarding comparatively less increase in no. of DU against the increase in no. of

floors. Submit floor wise details about Dwelling Units proposed earlier and after expansion.

4. Status of floor wise construction with photographs.

5. Certificate from architect that no. of floors and nos. of DU has been constructed as per bye-

6. Structural design certificate for revised proposal/expansion signed by architect and vetting

25/05/2015. Final EIA was submitted by the project proponent through letter dated 06/8/2015.

A presentation was made by Shri Abhishek Singh, authorized representative of project

proponent along with their consultant M/s Greencindia Consulting (P) Ltd. The committee

discussed the matter and observed that the project proponent have not brought the complete

information in their presentation. The committee directed to defer the matter till next day meeting

the project proposals alongwith general conditions as earlier prescribed by the authority for construction project and following specific conditions:

1. Provision of parking should be restricted to ECS as required under Development Authority

bye-laws.

2. Provision of setback on all sides should be made as per Development Authority bye-laws.

3. Copy of all NOCs as obtained from different Department should be submitted.

15. Dual plumbing should be adopted. Recycling of water as proposed shall be undertaken with

regular testing and monitoring of treated water.

16. Dedicated power supply for STPs is to be ensured during operation. Sludge of STP is to be

used in-house as manure and surplus manure should be managed by giving it to end users. STP shall be suitably located nearest to back side boundary with shortest out let.

Operation and the maintenance cost of the STP shall also be informed along with the

compliance of the E-waste and municipal solid waste disposal.

17. Corporate Social Responsibility (CSR) plan along with budgetary provision amounting to 2%

of total project cost shall be prepared and approved by Board of Directors of the company. A

copy of resolution as above shall be submitted to the authority. A list of beneficiaries with

their mobile nos./address should be submitted alongwith six monthly compliance reports.

18. LEDs should be used in all common areas and corridors. 100% solar lighting is to be provided

in the open areas/ stairs cases.

19. Parking guideline as per Development Authority should be followed. Parking for disabled

persons should be explored.

20. All entry/exit point should be bell mouth shaped.

21. To discharge excess treated waste water into public drainage system, permission from the

competent authority to be taken prior to any discharge.

22. 100 % provision of Rain Water Harvesting is to be made. RWH shall be initially done only

from the roof top. RWH from green and other open areas shall be done only after permission

from CGWB. 23. An underground Pucca tank for collection/reuse of rain water may be constructed.

24. Height of the stack should be provided based on combined DG sets capacity and be 6mt higher than the tallest building.

25. Post project monitoring for air, water (surface + ground), Stack noise of D.G. sets, STP to be carried out as CPCB Guidelines.

26. Crèche to be provided during the construction/operation phase. 27. Provision of separate room for senior citizen with proper amenities shall be made.

28. Protection shall be provided on the windows of the high rise flats for security of residents. 29. Unless and until all the environmental issues are sorted out the occupancy will be restricted

and would be only allowed after achieving the Permission from the competent authority.

30. The project proponent shall ensure that the project site does not attract/infringe any buffer

zone of no activity identified/declared under law.

31. For any extraction of ground water, prior permission from CGWB shall be taken.

32. Sprinkler to be used for curing and quenching and ready mix concrete may be used for

construction.

33. Possibilities of use of treated waste water for irrigation purposes should be explored. Drip

irrigation should be tried upto extent possible. No fresh water will be used for irrigation

purpose.

34. Mobile toilets, safe drinking water facility, sanitation facility and eco friendly fuels etc. Shall

be made available to the temporary residents/workers at the project site including the proper treatment and the disposal of the wastes.

6. Group Housing “Spring Meadows” at Plot No-GH-07-A, Techzone-4, Greater Noida- Sri Gajen

Jain, Director, 16- 17FF, Konark Building RDC, Ghaziabad. File N0. 2965/DD-Sh.

The project proponent did not appear. The committee discussed and deliberated that project

file should be closed and should be opened only after request from the project proponent. The file

shall not be treated as pending at SEIAA/SEAC.

7. Group Housing Project “Aunipark” at Plot No-INS-02, CHI-V, Yamuna Expressway, Greater

The committee noted that the proposals do not include details of the floors 1-5. Complete

details should be submitted for which EC required alongwith is proposed landuses of the project

matter till submission of complete proposals. The matter shall not be treated as pending with

documents submitted and the presentation made, informed the committee that:-

1. The Environmental Clearance is sought for Revision of Group Housing project “Saya

Gold Avenue” at Plot No-10 (10/1), Vaibhav Khand, Indirapuram, Ghaziabad, U.P. M/s

Saya Homes Pvt. Ltd.

2. Environmental clearance for the earlier proposal was issued through SEIAA letter no.

1960/Parya/SEAC/1327/2013/DD (Sh) dated 12th

Oct., 2013 to Shipra Sun City located at

3. Now, M/s Shipra Estate Ltd. has transferred plot 10/1 (type-C) measuring to 20036 sqm

alongwith the sanctioned FAR to M/s Saya Homes Pvt. Ltd. by way of transferred deed

duly registered in the office of sub registrar vide no. 1/29584/145-182/8688 dated

05/05/2015. M/s Shipra Estate Ltd. also submitted an undertaking that they have not

started any kind of construction activity on any other land parcels on the said plot which is

mentioned in EC. M/s Shipra Estate Ltd. further undertakes that they shall submit their

revised proposal for environmental clearance before the start of construction on the

balance land parcels comprised under plot no. 10, if required.

4. M/s Saya Homes Pvt. Ltd. has submitted that plot no. 10/1 is a part and parcel of plot no.

10, Vaibhav Khand, Indira Puram Ghaziabad for which an environmental clearance dated

12/10/2013 was obtained by M/s Shipra Estate Ltd. from SEIAA. The subject plot has

now been transferred to M/s Saya Homes Pvt. Ltd. so they are presenting their case before

SEAC for revised EC. Their building plans have been revised for which approval has

been obtained from GDA. Structural stability study for the revised building plans has been

done through IIT.

14. The project proposals are covered under category 8"b" of EIA Notification, 2006.

The committee discussed the matter and observed as follows:

1. In view of undertakings given by M/s Shipra Estate Ltd., the environmental clearance dated

12/10/2013 for plot no. 10 Vaibhav Khand, Indira Puram Ghaziabad shall become null and

void.

2. The matter of environmental clearance for plot no. 10/1 M/s Saya Homes Pvt. Ltd. shall be

treated as a fresh case and not as a revision of earlier EC dated 12/10/2013 issued for plot

no. 10, M/s Shipra Estate Ltd.

3. An affidavit shall be submitted by both M/s Shipra Estate Ltd. and M/s Saya Homes Pvt.

Ltd. that no construction has been undertaken on plot no. plot no. 10 Vaibhav Khand,

Indirapuram Ghaziabad and plot no. 10/1 Vaibhav Khand, Indira Puram Ghaziabad

respectively.

The committee, subject to compliance of above points, recommended following TORs and

general guidelines for conducting EIA studies regarding the proposals. Further PP has requested

the committee to accept the baseline data generated during March to May2013 for its earlier EIA

report. The committee also directed PP to submit EIA report as per MoEF guidelines:

5. Status of construction undertaken till date (block wise/tower wise/floor wise).

6. Compliance of earlier EC.

7. Master plan of the area showing proposed project.

8. Permissible uses of the proposed site as per zoning regulation.

9. Allotment letter from concerned development authority.

10. Physical features within 30 m of the project sites with their ownership.

11. Section details of all road.

12. Area details showing proposed uses as residential, commercial, parks, parking, roads, other

services, facilities of the project also in percentage.

13. Details of land Scape plan.

14. Land use approved by the competent authority.

15. Complete details of facilities to be developed by the project proponent i.e. for which

environment clearance is sought.

16. Plan for no of trees, one tree per 80.0sq.mt.of area.

17. Use of reflecting paints on roof top and side walls.

21. 10% EWS / LIG housing provision shall be made as per Development Authority bye-laws. 22. Sanctioned plans/maps regarding the project with all services plans.

23. All plans and elevation sections/all service plan/landscape plan/standard electrification

plan/drainage/sewerage plan.

24. Structural plan is to be submitted signed by qualified structural designer.

25. All service plans like sewer drainage water supply rain water harvesting fire fighting

landscape plan is to be submitted.

26. Section of all inter roads as proposed along R/W and C /W as well dimension is to be

27. Examine in detail the proposed site with reference to impact on infrastructure covering

water supply, storm water drainage, sewerage, power, etc., and the disposal of treated/raw

wastes from the complex on land/water body and into sewerage system.

29. Hydro-geological investigations be carried out and obtain permission from Central Ground

Water Authority for withdrawal of ground water.

services and make adequate provisions in the proposal.

36. Assess soil erosion in view of the soil characteristics, topography and rainfall pattern.

37. Application of renewable energy/alternate energy, such as solar and wind energy may be

described including solar water heating in the guidelines for entrepreneurs.

38. Consider solid wastes, including e-waste in addition to other solid wastes and their disposal.

39. Identification of recyclable wastes and waste utilization arrangements may be made.

40. Explore possibility of generating biogas from biodegradable wastes.

41. Arrangements for hazardous waste management may be described as also the common

facilities for waste collection, treatment, recycling and disposal of all effluent, emission and

refuse including MSW, biomedical and hazardous wastes. Special attention should be made

with respect to bird menace.

42. Provisions made for safety in storage of materials, products and wastes may be described.

43. Disaster management plan should be prepared.

44. Traffic management plan including parking and loading/unloading areas may be described.

Traffic survey should be carried out both on weekdays and weekend.

45. Parking provision is to be made for higher ECS worked out either as per state bye-laws or

construction manual of the MoEF.

46. Exclusive Parking area in the basement (excluding other facilities) and surface is to be

clearly mentioned.

47. Provide service road for entry and exit to project site.

48. Use of local building materials should be described.

49. Consider provision of DG Flue Gas emissions to be treated in a scrubber. Stack details with

provisos of sampling port for monitoring be described.

50. Work out MGLC for the combined capacity of DG sets.

51. Provide for conservation of resources, energy efficiency and use of renewable sources of

energy in the light of ECBC code.

52. Application of resettlement and rehabilitation policy may be described. Project affected

persons should be identified and rehabilitation and resettlement plan should be prepared.

53. Examine separately the details for construction and operation phases both for Environmental Management Plan and Environmental Monitoring Plan.

54. Total cost is 350 crores. Environment Corporate Responsibility (ECR) plan along with

budgetary provision of minimum 2% of the project cost as discussed in meeting shall be

submitted on need base assessment study in the study area.

55. Details of all internal and peripheral roads width.

56. Source and quantity of required water during construction and management of generated

waste water.

57. Project falling with in 10 Km. area of Wild Life Sanctuary is to obtain a clearance from

National Board Wild Life (NBWL) even if the eco- sensitive zone is not earmarked.

58. Declare/submit the running cost of STP and other environmental management services (e.g.,

Municipal Solid Waste Disposal, Green belt Maintenance, Water Management etc.) in the

proposals which are to be including in the allotment letters.

59. The proponent will submit the schedule of monitoring/data collection programme to the

Office of Directorate, Member Secretary, UP Pollution Control Board and District

Magistrate of related District.

60. Aforesaid proposal is the part of Shipra Suncity (Shipra Estate) with an overall sanctioned

FAR 2.5 (including purchasable FAR) and the same shall be maintained.

General Guidelines:

a. A legal affidavit by the Project proponent on Rs. 100/- non-judicial Stamp Paper, duly attested

by Public Notary, stating that:

I. “There is no litigation pending against the project and/or land in which the project is proposed to be set up (please give name & ownership etc. of the project) and that for any

such litigation what so ever, the sole responsibility will be borne by the Project proponent.” II. “No activity relating to this project (i.e. name of the project) including civil construction

has been undertaken at site except fencing of the site to protect it from getting encroached and construction of temporary shed(s) for the guard(s). (if fencing has not been done, then

the same may be deleted). III. “I/We hereby give undertaking that the data and information given in the application,

enclosures and other documents are true to the best of my knowledge and belief and I/We

am/are aware that if any part of the data and information submitted is found to be false or

misleading at any stage, the project will be rejected and clearance given, if any to the

Project will be revoked at our risk and cost.” IV. Project does not fall under any buffer zone of no-development as declared /identified under any

law.

b. Another legal affidavit by the consultant stating “(a) that the prescribed TORs have been

complied with (to be deleted if not applicable) & (b) that details and the data presented are

factually correct”, as per MoEF circular dated 04.08.2009 is also to be submitted along with

EIA.

c. Current, site photographs viewing towards the project area from four directions indicating date

of photograph taken, direction from which taken, name of the project, and signature of Project

proponent along with consultant with seal should be submitted, so as to ensure that no

construction has been started before the grant of EC.

d. EIA should strictly follow the guidelines prescribed in annexure-III to the EIA notification of

2006 and the Methods of Monitoring and analysis (Annexure-IV): Guidance for assessment of

representativeness and reliability of baseline environmental attributes detailed under EIA

manual January, 2001 and other guidelines in the matter. e. The status of accreditation of the EIA consultant with NABET/QCI shall be specifically

mentioned. The consultant shall certify that his accreditation is for the sector for which this EIA is prepared.

f. On the front page of EIA/EMP reports, the name of the consultant/consultancy firm along with their complete details including their accreditation, if any shall be indicated.

g. While submitting the EIA/EMP reports, the name of the experts associated with/involved in

the preparation of these reports and the Name of laboratory through which the samples have

been got analysed should be stated in the report. It shall clearly be indicated whether said

laboratory is accredited by NABL or approved under the Environment (Protection) Act, 1986 (Please refer MoEF office memorandum dated 4th August, 2009). The name project leader of

the EIA study shall also be mentioned. h. The EIA document shall be printed on both sides, as for as possible.

The Information’s no (a I , II, III & c) asked under the general guidelines is to be submitted

within 15 days from the date of receipt of the letter and remaining of the information’s is to be

submitted along with the EIA.

8.The project proposals are covered under category 8"b" of EIA Notification, 2006.

The committee discussed the matter and recommended following TORs and general

guidelines for conducting EIA studies regarding the proposals:

1. The project proponent should submit an affidavit that there is no construction proposed in the towers/blocks where construction has already been started. There is no construction

started in the towers where expansion is proposed under this expansion. 2. Justification of increase in population should be given in view of increase in dwelling units.

3. Justification of decrease in parking provisions. 4. Specific area statements regarding proposed expansion.

5. Comparative area and other environmental parameter statements showing values earlier and

proposed as expansion.

6. All approved revised drawings/maps alongwith all approved revised services plans.

7. The revised structure design certificate by qualified structure engineer should be submitted.

The structural design certificate should preferably be vetted by IITs/CBRI. Provision of

alarm system, to timely notify the employees/residents, in case of occurrence of

earthquake/other natural disasters/fire should be provided.

10. Master plan of the area showing proposed project.

11. Permissible uses of the proposed site as per zoning regulation.

44. Arrangements for hazardous waste management may be described as also the common

facilities for waste collection, treatment, recycling and disposal of all effluent, emission and

refuse including MSW, biomedical and hazardous wastes. Special attention should be made

with respect to bird menace.

45. Provisions made for safety in storage of materials, products and wastes may be described.

46. Disaster management plan should be prepared.

47. Traffic management plan including parking and loading/unloading areas may be described.

Traffic survey should be carried out both on weekdays and weekend.

48. Parking provision is to be made for higher ECS worked out either as per state bye-laws or

construction manual of the MoEF.

49. Exclusive Parking area in the basement (excluding other facilities) and surface is to be

clearly mentioned.

50. Provide service road for entry and exit to project site.

57. Total cost is 350 crores. Environment Corporate Responsibility (ECR) plan along with budgetary provision of minimum 2% of the project cost as discussed in meeting shall be

submitted on need base assessment study in the study area.

58. Details of all internal and peripheral roads width.

59. Source and quantity of required water during construction and management of generated

waste water.

60. Project falling with in 10 Km. area of Wild Life Sanctuary is to obtain a clearance from

National Board Wild Life (NBWL) even if the eco- sensitive zone is not earmarked.

61. Declare/submit the running cost of STP and other environmental management services (e.g.,

Municipal Solid Waste Disposal, Green belt Maintenance, Water Management etc.) in the

proposals which are to be including in the allotment letters.

62. The proponent will submit the schedule of monitoring/data collection programme to the

Office of Directorate, Member Secretary, UP Pollution Control Board and District

Magistrate of related District.

General Guidelines:

a. A legal affidavit by the Project proponent on Rs. 100/- non-judicial Stamp Paper, duly attested by Public Notary, stating that:

I. “There is no litigation pending against the project and/or land in which the project is proposed to be set up (please give name & ownership etc. of the project) and that for any

such litigation what so ever, the sole responsibility will be borne by the Project proponent.” II. “No activity relating to this project (i.e. name of the project) including civil construction

has been undertaken at site except fencing of the site to protect it from getting encroached and construction of temporary shed(s) for the guard(s). (if fencing has not been done, then

the same may be deleted).

III. “I/We hereby give undertaking that the data and information given in the application,

enclosures and other documents are true to the best of my knowledge and belief and I/We

am/are aware that if any part of the data and information submitted is found to be false or

misleading at any stage, the project will be rejected and clearance given, if any to the

Project will be revoked at our risk and cost.” IV. Project does not fall under any buffer zone of no-development as declared /identified under any

law.

b. Another legal affidavit by the consultant stating “(a) that the prescribed TORs have been

complied with (to be deleted if not applicable) & (b) that details and the data presented are

factually correct”, as per MoEF circular dated 04.08.2009 is also to be submitted along with EIA.

c. Current, site photographs viewing towards the project area from four directions indicating date of photograph taken, direction from which taken, name of the project, and signature of Project

proponent along with consultant with seal should be submitted, so as to ensure that no

construction has been started before the grant of EC.

d. EIA should strictly follow the guidelines prescribed in annexure-III to the EIA notification of

2006 and the Methods of Monitoring and analysis (Annexure-IV): Guidance for assessment of

representativeness and reliability of baseline environmental attributes detailed under EIA

manual January, 2001 and other guidelines in the matter.

e. The status of accreditation of the EIA consultant with NABET/QCI shall be specifically

mentioned. The consultant shall certify that his accreditation is for the sector for which this

EIA is prepared.

f. On the front page of EIA/EMP reports, the name of the consultant/consultancy firm along with

their complete details including their accreditation, if any shall be indicated.

g. While submitting the EIA/EMP reports, the name of the experts associated with/involved in

the preparation of these reports and the Name of laboratory through which the samples have

been got analysed should be stated in the report. It shall clearly be indicated whether said laboratory is accredited by NABL or approved under the Environment (Protection) Act, 1986

(Please refer MoEF office memorandum dated 4th

August, 2009). The name project leader of the EIA study shall also be mentioned.

h. The EIA document shall be printed on both sides, as for as possible.

The Information’s no (a I , II, III & c) asked under the general guidelines is to be submitted

within 15 days from the date of receipt of the letter and remaining of the information’s is to be

submitted along with the EIA.

however the possession on the site has only been provided for plot area 15,000 sqm by the

Noida Authority. The committee also observed that the whole proposal is calculated for plot

area 20,002.40 sqm which should be revised as per actual availability of land. The

committee also found that some constructed areas like parking, basement etc. have not been

included in built-up area. The committee directed the project proponent to revise and submit

the matter for appraisal. The matter is deferred till submission of revised proposals."

The project proponent submitted their replies through letter dated 09/03/2015 and the matter

was again discussed in SEAC meeting dated 01/06/2015 wherein the committee directed to submit

following information:

1. Podium should be covered under built-up area. Area details should be accordingly

modified.

2. Area statement with tower wise and floor wise details alongwith no. of units.

3. Area details showing proposed uses as residential, commercial, parks, parking, roads,

other services, facilities of the project also in percentage.

4. Provision of 100% solar lighting along the road site, stair cases, common places.

5. Physical features within 100 m of the project sites with their ownership.

6. Running cost of STP and other environment management facilities which shall be

transferred to the alloties during operation phase.

7. Parking plan.

8. Environmental Corporate Responsibility (ECR) plan along with budgetary provision

amounting to 2% of project cost shall be prepared and approved by Board of Directors of the company. A copy of resolution as above shall be submitted to the authority

alongwith list of beneficiaries with their mobile nos./address.

The project proponent submitted their replies through letter dated 14/08/2015. A

presentation was made by Shri Lakhvendar Deep Singh, project proponent alongwith their

consultant M/s Development Consultant Pvt. Ltd, Kolkata. The committee discussed the replies

submitted by the project proponent and found it unsatisfactory and directed the project proponent to

submit following information:

1. The project proponent should submit an affidavit that there is no change in the proposals

submitted on dated 09/03/2015 and the proposals being presented before the committee in meeting dated 09/10/2015.

2. Population calculation should be submitted alongwith commensurate water balance diagram.

3. Solar power requirement in places as submitted by project proponent should be calculated. Space required for solar provisions alongwith its location on layout should be

provided.

4. Parking provisions as per Development Authority bye-laws should be provided.

10. Proposal for use of STP in modular form in proportion to its actual uses.

11. It is proposed to release 120.3 KLD Tertiary Treated Waste Water into drain. A feasibility

study shall be undertaken and submitted to channelize this Tertiary Treated Waste Water into

artificial KUCHCHA pond as the complete project is dependent on underground water

extraction. Project Proponent himself accepted during presentation that the underground water

situation will become very bleak in coming 10 years/due to underground water extraction in

this project, which itself is a part of a mega township, having multiple similar projects, in

close vicinity. Hence, offensive measures are required to recharge the underground water up

to maximum possible extent.

12. The proposed water body in the project covers around 0.77 % of Net plot area. This proposed

area shall be decided on the basis of a feasibility study undertaken to recharge the

underground water up to maximum possible extent.

13. Explore in increase of no. of trees under proposed green plan.

14. Sludge disposal plan with required area should be submitted with earmarking its location on

the layout plan. (i) An allocated space (with calculated area) on layout, required for the

processing of sludge, with proper justification about "sludge to manure" conversion process

management, and prominent wind direction. (ii) Amount of total manure generated per day/

per year.(iii) Amount of manure required inside the project boundary per day/ per year.(iv)

Plan to handle the extra manure.

15. Plan for solar provisions proposed for the project with required area and location. Project

proponent has mentioned that "Solar Photo Voltaic Lighting shall be provided for partial

landscape lighting". In this regard:

16. Regarding quantity of hazardous waste, minimum and maximum quantity, based on justified

calculations, should be submitted.

The project proponent submitted their replies through letter dated 11/08/2015. A

presentation was made by Shri Jonaed Khan, authorized representative of project proponent along

with their consultant M/s Min Mec Consultancy Pvt. Ltd. The committee discussed the replies

submitted by the project proponent and observed as follows:

1. The project proponent has submitted that the project has got technical sanction by the

LDA vide letter dated 18/05/2011. Careful examination of this letter dated 18/05/2011

shows that this technical clearance is only for 520 flats whereas the project proposals

submitted to SEIAA for environmental clearance is for 568 dwelling units. This

difference in dwelling units should be explained by the project proponent as it will

result in change of complete proposal. A self explanatory statement alongwith

supporting documents should be submitted by the project proponent.

2. An agreement with competent agency for management of Municipal Solid Waste

should be done and submitted.

3. Provisions of a pucca underground tank for rain water collection should be undertaken.

4. Structural design certificate signed by architect and vetting authority after

incorporating proposed expansion structure should be submitted. All structural design

drawings should be signed by architect and counter signed by vetting authority.

A firmed up plan as above in-line with sanction given by LDA should be submitted.

The revised proposals as above shall not be treated as pendency and shall be treated

afresh.

matter and recommended grant of environmental clearance on the project proposals alongwith

general conditions as earlier prescribed by the authority for construction project and following specific conditions:

1. Provision of parking should be restricted to ECS as required under Development Authority

bye-laws.

2. Provision of setback on all sides should be made as per Development Authority bye-laws.

3. Copy of all NOCs as obtained from different Department should be submitted.

4. LIG & EWS housing to be provided as per U.P. Govt. Orders and building bye laws.

5. Approach road location should be clearly marked on layout and should be submitted.

6. Necessary planning for any anticipated expansion should be incorporated in present design in view of structural stability.

7. An underground water body shall be planned within the premises for storage of rain water. 8. Structural design certificate signed by architect and vetting authority should be submitted.

9. Municipal solid waste shall be disposed/managed as per Municipal Solid Waste (Management and Handling) Rules, 2000 (as amended).

12. Project falling with in 10 Km. area of Wild Life Sanctuary is to obtain a clearance from

National Board Wild Life (NBWL) even if the eco- sensitive zone is not earmarked.

13. Criteria/ norms provided by competent Authority regarding the seismic zone be followed for

construction work. Provision of alarm system, to timely notify the residents, in case of

occurrence of earthquake/other natural disasters/fire should be provided. A well defined

evacuation plan should also be prepared and regular mock drills should be arranged for the

residents. Rise of stairs should be constructed in a way, so that it should provide smooth

movement.

14. For the treatment for total sewage, a full-fledged STP is to be provided with 20% more

capacity than waste water generated during operation phase.100% waste water is to be treated

in captive STP conforming to prescribed standards of receiving body for designated use.

Monitoring of STP to be done daily till its stabilization. 15. Dual plumbing should be adopted. Recycling of water as proposed shall be undertaken with

regular testing and monitoring of treated water. 16. Dedicated power supply for STPs is to be ensured during operation. Sludge of STP is to be

used in-house as manure and surplus manure should be managed by giving it to end users. STP shall be suitably located nearest to back side boundary with shortest out let.

Operation and the maintenance cost of the STP shall also be informed along with the compliance of the E-waste and municipal solid waste disposal.

17. LEDs should be used in all common areas and corridors. 100% solar lighting is to be provided

in the open areas/ stairs cases.

18. Parking guideline as per Development Authority should be followed. Parking for disabled

20. To discharge excess treated waste water into public drainage system, permission from the

competent authority to be taken prior to any discharge.

21. 100 % provision of Rain Water Harvesting is to be made. RWH shall be initially done only from the roof top. RWH from green and other open areas shall be done only after permission

from CGWB. 22. An underground Pucca tank for collection/reuse of rain water may be constructed.

23. Height of the stack should be provided based on combined DG sets capacity and be 6mt higher than the tallest building.

24. Post project monitoring for air, water (surface + ground), Stack noise of D.G. sets, STP to be carried out as CPCB Guidelines.

25. Crèche to be provided during the construction/operation phase. 26. Provision of separate room for senior citizen with proper amenities shall be made.

27. Protection shall be provided on the windows of the high rise flats for security of residents.

28. Unless and until all the environmental issues are sorted out the occupancy will be restricted

and would be only allowed after achieving the Permission from the competent authority.

29. The project proponent shall ensure that the project site does not attract/infringe any buffer

zone of no activity identified/declared under law.

30. For any extraction of ground water, prior permission from CGWB shall be taken.

31. Sprinkler to be used for curing and quenching and ready mix concrete may be used for

construction.

32. Possibilities of use of treated waste water for irrigation purposes should be explored. Drip

irrigation should be tried upto extent possible. No fresh water will be used for irrigation

purpose. 33. Mobile toilets, safe drinking water facility, sanitation facility and eco friendly fuels etc. Shall

10. The project proposals are covered under category 8"a" of EIA Notification, 2006.

The committee discussed the matter and recommended grant of environmental clearance on

the project proposals alongwith general conditions as earlier prescribed by the authority for

construction project and following specific conditions:

1. Provision of setback on all sides should be made as per Awas Evam Vikar Parishad bye-laws. 2. Municipal solid waste shall be disposed/managed as per Municipal Solid Waste (Management

and Handling) Rules, 2000 (as amended). 3. 03 m peripheral green shall be provided around the project inside the project boundary. Add

Astonia in list of trees.

4. 15% area of the total plot area shall be compulsorily made available for the green belt

development including the peripheral green belt.

5. Project falling with in 10 Km. area of Wild Life Sanctuary is to obtain a clearance from

National Board Wild Life (NBWL) even if the eco- sensitive zone is not earmarked.

6. Criteria/ norms provided by competent Authority regarding the seismic zone be followed for

construction work. Provision of alarm system, to timely notify the residents, in case of

occurrence of earthquake/other natural disasters/fire should be provided. A well defined

evacuation plan should also be prepared and regular mock drills should be arranged for the

residents. Rise of stairs should be constructed in a way, so that it should provide smooth movement.

7. For the treatment for total sewage, a full-fledged STP is to be provided with 20% more

capacity than waste water generated during operation phase.100% waste water is to be treated

in captive STP conforming to prescribed standards of receiving body for designated use.

Monitoring of STP to be done daily till its stabilization.

8. Dual plumbing should be adopted. Recycling of water as proposed shall be undertaken with

regular testing and monitoring of treated water.

9. Dedicated power supply for STPs is to be ensured during operation. Sludge of STP is to be

used in-house as manure and surplus manure should be managed by giving it to end users.

STP shall be suitably located nearest to back side boundary with shortest out let.

Operation and the maintenance cost of the STP shall also be informed along with the

compliance of the E-waste and municipal solid waste disposal. 10. Effluent Treatment Plant(ETP)/Sewage Treatment Plant(STP) including proper Oil and Greas

e Trap for the effluent arising from kitchen and /or laundry and shall comply MoEF Standards.

11. All required sanitary and hygienic measures should be in place before starting construction activities and to be maintained throughout the construction phase.

12. Corporate Social Responsibility CSR) plan along with budgetary provision amounting to 2% of total project cost shall be prepared and approved by Board of Directors of the company. A

copy of resolution as above shall be submitted to the authority. A list of beneficiaries with their mobile nos./address should be submitted alongwith six monthly compliance reports.

13. LEDs should be used in all common areas and corridors. 100% solar lighting is to be provided

in the open areas/ stairs cases.

14. Parking guideline as per Lucknow Development Authority should be followed. Parking for

disabled persons should be explored.

15. All entry/exit point should be bell mouth shaped.

16. To discharge excess treated waste water into public drainage system, permission from the

competent authority to be taken prior to any discharge.

17. 100 % provision of Rain Water Harvesting is to be made. RWH shall be initially done only

from the roof top. RWH from green and other open areas shall be done only after permission

from CGWB.

18. A water body with kachcha base shall be planned within the premises for storage of storm

water apart from rain water harvesting pits.

19. Height of the stack should be provided based on combined DG sets capacity and be 6mt higher than the tallest building.

20. Post project monitoring for air, water (surface + ground), Stack noise of D.G. sets, STP to be carried out as CPCB Guidelines.

21. The project proponent shall ensure that the project site does not attract/infringe any buffer zone of no activity identified/declared under law.

22. For any extraction of ground water, prior permission from CGWB shall be taken. 23. Sprinkler to be used for curing and quenching and ready mix concrete may be used for

construction. 24. Possibilities of use of treated waste water for irrigation purposes should be explored. Drip

irrigation should be tried upto extent possible. No fresh water will be used for irrigation

purpose.

25. Mobile toilets, safe drinking water facility, sanitation facility and eco friendly fuels etc. Shall

be made available to the temporary residents/workers at the project site including the proper

treatment and the disposal of the wastes.

Discussion matter with permission of Chairman:

1. Karaundi Khurd Silica Sand Mine at Village-Karaundi Khurd, Taluka-Mau, District-

Chitrakoot, U.P. (Leased Area 13.02 Ha.) File no. 896/AA(S) The committee was informed that an application dated 30/05/2011 was submitted to SEAC

for environmental clearance of above titled Silica Sand Mine against which a query letter dated

29/06/2011 was communicated to project proponent to submit their replies within 15 days failing

which the case shall be closed. The project proponent informed through letter dated 22/07/2011 that

the lease was executed to 23/05/1987 for a period of 15 years i.e. 22/05/2002. He applied for its

renewal through letter dated 12/05/2001 to the State Govt. and the application is pending with State

Govt. Hence, he is operating under clause 24-A (6) of MCR 1960 i.e. deemed renewal. He also

submitted that as per EIA Notification 14/09/2006 such mining projects which were operating

before 14/09/2006 would continue to operate without obtaining environmental clearance till the

mining lease is due for renewal. In view of this, he also submitted that as per notification dated

14/09/2006 environmental clearance for non coal mine upto 50 ha lease area is exempted. In this

continuation a letter dated 12/10/2011 was communicated by Director, Environment to Director,

Geology and Mining, U.P. in which details of the case were sent to Director, Geology and Mining.

Director, Environment requested to inquire and inform that whether the mining activity/project is

being considered as lawful renewal by District Administration/Mining Department or not. Also,

what is the validity period of this renewal. Copy of this letter dated 12/10/2011 was endorsed to

Member Secretary, SEIAA, District Magistrate, Chitrakoot, Joint Secretary, Industry Department,

U.P. and Shri Anand Agarwal who is the applicant. A reminder was again sent to Director, Geology

and Mining through letter dated 14/12/2011. ADM, Allahabad through his letter dated 19/11/2011

requested to give comment that whether environmental clearance would be required for the lease

holder whose lease period have been expired prior to 14/09/2006 and to whom format-G were being

issued considering deemed to be renewed.

In this connection Director, Environment through letter dated 23/12/2011 informed District

Magistrate, Allahabad regarding provisions of EIA Notification, 2006. Director, Environment gave

is opinion that leases (05 ha or more) which are being treated as deemed to be renewed shall also

require environmental clearance. However, legal opinion may be taken by District Magistrate in the

matter. Again, Director, Environment through his letter dated 19/03/2012 communicated to

Director, Geology and Mining that SEIAA has not exempted the said matter from the requirement

of environmental clearance and requested to take necessary action in continuation to letter dated

12/10/2011 and 14/12/2011 of SEAC. No communication from Director, Geology Mining, U.P. has

been received till now.

The committee, in view of long pendency of this matter and no information from Mining

Department/project proponent, discussed and deliberated that in light of above facts the matter

should be finally closed. A copy of decision should also be communicated to District Magistrate,

Allahabad, Mining Directorate, U.P.
