The Minister issued these instructions after holding a meeting with Labor Union representa- tives of FCS&CA, who apprised the Minister with of various issues. After giving a patient hearing to the representa- tives, the Minister issued directions to concerned officers to make a propos- al to revise loading, unloading rates of gunny bags falling in range of 49 to 80 kg from Rs 2.22 per bag to Rs. 2.65 per bag. During the meeting, the Minister also directed that from now on the increment for loading, unloading of the bags should be done every year on April as per price index. Besides, the Minister also directed the laborers above the 65 years of age should be replaced by their legal heir. And those who fall in between 60 to 65 years of age bar would serve as Head Labor. Clarifying on the issue, the Minister said it is an unjustifiable thing to ask a person to do load- ing, unloading work after the age of 65. Therefore, the Minister said it would be better if the person is relieved from his work after attaining the age of 65, and gets replaced by his legal heir. He said it would ensure that the source of livelihood is maintained for the family till they find some other alternative. Addressing the labor representatives present in the meeting, Mr. Zulfkar Ali said the Government sees the laborers working for the department as an important pillar without whom serving people would be extremely diffi- cult. He said all the gen- uine demands of laborers would be taken care of. However, laborers also have to work as responsi- bly, to ensure that they deliver their duties as per requirement and guide- lines, so that food grains reach to consumers on time, and also ensure pil- ferage is checked on their end also. Stressing on timely payment to the laborers, the Minister directed to (Contd on Page 2) Rs 10 cr in new notes, total Rs 106 cr, 127kg gold seized by I-T cheNNai dec 9 : The Income Tax department has seized at least Rs 106 crore in cash, including Rs 10 crore in new currency, and gold bars weighing 127 kg in searches at multiple locations in the city to check tax evasion post demonetization. This is the largest seizure of new currency notes after the old Rs 500 and Rs 1,000 notes were scrapped on November 8. The I-T operation had been launched yesterday here. Officials said S Reddy, a contractor work- ing with the state govern- ment, has claimed the entire money and the gold as his own and is being questioned. "127 kg gold in 1 kg bars and Rs 96 crore in old currency and Rs 10 crore in Rs 2,000 notes have been seized by the sleuths after the oper- ation," top I-T depart- ment officials said, adding "this is an unprecedented amount that the tax department has seized in recent times". The department car- ried out the searches based on intelligence inputs about the activities of Reddy and few others for the last few days. Officials said the agency was investigating how the new notes in such a large quantity were stashed by the individual. The bun- dles of the new Rs 2,000 had no banking slips on them. Most of the wedding halls operating in and around Jammu city have been flouting green norms with impunity and are reportedly running for the last many years without setting up mandatory waste water treatment plants. Sources informed that maxi- mum of banquet halls across Jammu province have been vio- lating the Jammu and Kashmir Water Resources (Regulation and Management) Act, 2010 (Water Act). As per an order issued by Finance Department, the bank accounts of Drawing and Disbursing Officers, having positive cash balance but lying inoperative for more than 2 years, shall be closed and the money will be transferred to Finance Secretary’s official account. Meanwhile, the cash balance of government accounts which are lying inoperative for more than one year will be trans- ferred to Finance Secretary’s account but they will not be closed. Meanwhile, the cashbalance of governmentaccounts which are lyinginoperative for more thanone year will be trans-ferred to FinanceSecretary’s account butthey will not be closed.The State Drawing andDisbursing Officer andJ&K Bank have beenasked to ensure that nobanking transaction takesplace in these accounts.

tions of a "syndicate" involved in currency conversion.The officials said a number of documents related tofinancial transactions, entries of gold sale and records ofsale/purchase have also been seized by the tax sleuths.

At least three people of the alleged syndicate arebeing questioned while few others are under the radar,they said. "He (Reddy) is a contractor working with thestate government. He is claiming the entire cash andgold to be his own. Further probe is on," they said.

The I-T department, they said, will share the casedetails with the Enforcement Directorate and CBI forfurther probe into money laundering and corruptionangles. Some bank officials are also under the scanner ofthe taxman.

The tax department had made the largest seizure ofRs 5.7 crore cash in new notes in Bengaluru few daysback after which two other central probe agencies, theCBI and the Enforcement Directorate, had taken overthe cases to probe instances of corruption, money laun-dering and large-scale hawala transactions in the wakeof the currency scrap on November 8.

The proposed rate has beenenhanced by 20% in A zone, 25% in B and 30% in C zoneareas.The Cabinet also approved revision in the sale ratesof firewood in the state supplied for religious and institu-tional purposes. The Cabinet accorded sanction to thecreation of an independent and separate department of‘Disaster Management, Relief, Rehabilitation andReconstruction’ (DMRRR). Till date the business ofRelief and Rehabilitation department was assigned to theRevenue department. However, based on the experi-ences of earthquake of 2005 and the devastating floodsof September-2014, it was felt appropriate to have a sep-arate department for Disaster Management, Relief andRehabilitation, considering the importance of timely ,adequate and focused response to natural disasters. TheCabinet approved the recommendation of theEmpowered Committee to enhance the mandate of theScience & Technology department to take up small HydelProjects upto 10MW Capacity through the PPPmode.The Cabinet directed that PDD and the S&Tdepartments shall suitably amend the current HydroDevelopment Policies being implemented by JAKEDA &JKSPDC to make the Policies investor friendly forattracting private investments in the development of thehydro sector in the state. The Cabinet accorded sanctionto the creation of five (5) posts of Secretaries in theJammu and Kashmir High Court. Out of the 5 posts cre-ated, two posts are of Secretaries in the Selection Gradeof Rs 12,000-16500 (pre-revised) and three posts in theSpecial Scale of Rs 14300-18300 (pre-revised). TheCabinet accorded sanction to the creation of 172 posts ofData Entry Operators in the pay band of Rs.5200-20200+ GP of 1900, by corresponding reduction of 172 posi-tions of CIC Operators, who have been engaged up to thecut of date i.e. 28th April, 2010 and to whom the provi-sions of J&K, Civil Services (Special Provisions), Act,2010 apply.The Cabinet accorded sanction to the implementation ofthe ‘High Density Apple Plantation Scheme’ by theHorticulture department.In his 2015-16 Budget speech,the Finance Minister had announced establishment ofHigh Density Plantation Orchards in the State and ear-marked Rs 150 Cr under the ‘Secure Horticulture Future’initiative, envisaging raising average production from thecurrent level of 10 MT/Ha to the international level of40-70 MT/Ha. Under the Scheme the normative expen-diture and sharing pattern (per Ha) will be 100 % inrespect of public sector and 50:50 basis between StateGovernment and beneficiaries in respect of private sec-tor. The Horticulture Department shall sign MoU withthe beneficiary clearly mentioning the role and responsi-bilities of stake holders together with normative cost andsharing pattern and other terms and conditions envis-aged in the proposal. The planting material shall firstlybe procured by the department at 100% cost and then10% cost shall be recovered from the beneficiariesagainst delivery which shall be deposited in theGovernment Treasury. The source of funding shall bemet from Capex Budget provisions for 2016-17. TheCabinet instructed the Horticulture department to workout a similar scheme for Mango and Apricot Plantationalso.The Cabinet accorded sanction to the transfer ofState Land measuring 1309 Kanals and 02 marlas situat-ed at Village, Awantipora District Pulwama in favour ofHealth and Medical Education Department, for estab-lishment of an AIIMS like institution. At the same time, he said, for Pakistan Jammu andKashmir was the core issue between the two countriesand finding a solution to it could bridge the trustdeficit them.

"We need to move from conflict management toconflict resolution and that obviously cannot happenunless we talk to each other with sincereity and seri-ousness of purpose," Basit said.

Holding that talks may bring down tension, Basitsaid Islamabad was "positive and constructive" in itsattitude, adding the engagement should be meaning-ful and address the core issue of Jammu and Kashmir.

Sources further said that these banquet halls werealso lacking other necessary facilities, including suffi-cient parking space in their premises. “More than 90banquet halls in Jammu city san sufficient parkingspace and have also got notices of Jammu MunicipalCorporation (JMC) in the last many years”, sources said,adding, “Instead of closure of these banquet halls sameare operating with impunity.” “It is a routine thatnotices are served by PCB to banquet hall owners direct-ing them to comply the guidelines but action warrantedunder law was not taken so far”, banquet hall ownershave been saving themselves from action, allegedly bypaying graft. Over 90 banquet halls, hotels, resorts andfarm houses are operating in the city without permis-sion and No Objection Certificates (NOC) from the stategovernment, Deputy Chief Minister Nirmal Singh hasadmitted during assembly session. These establish-ments are operating due to cases being subjudice beforethe High Court. Similarly, four other such establish-ments are operating due to being cases of subjudice inthe court of law. However, 46 such establishments areoperating after being granted permission and NOCs byJammu Municipal Corporation (JMC) and JammuDevelopment Authority (JDA). According to the dataavailable, the status of the land on which 80 such estab-lishments have come up is not known. A banquet hall inthe outskirts of Udheywala, has been constructed ille-gally over land owned by Jammu DevelopmentAuthority.The banquet hall has come up illegally over 7kanals of government land in the area with active con-nivance of government officials.

At least three banquet halls near Thandi Khui inSamba district and two at Udheywala on the outskirts ofJammu city are operational illegally under the ‘watchful’eyes of JDA.Quoting CTP, JDA, sources said no permis-sion had been granted for the construction of R SBanquet Hall, Anand Farms, both opposite ThandiKhui, and Bee Pee Farms, opposite Radha SwamiAshram near Thandi Khui, and all these were opera-tional illegally.Two notices for demolition under section7 (3) of J&K Control of Building Operation Act (COBO)were issued by the JDA’s khilafwarzi officer to the pro-prietor of R S Banquet Hall; first on April 12, 2014 andthe second on May 3, 2014.Similarly, the proprietors ofAnand Farms and Bee Pee Farms were also issued twonotices each on April 12, 2014 and May 3, 2014 for dem-olition under section 7 (3) of COBO by the khilafwarziofficer.

The contents of notices issued to the proprietors ofthe three banquet halls are same. The notices read as:“Whereas you were called to show cause under section 7(3) of COBO Act 1988 as to why the illegal constructionraised by you be not demolished and whereas, you haveneither altered or removed the illegal construction madeon your own nor able to produce any substantive docu-mentary proof, of building permission of the prescribedauthority as prescribed under the Act till date. Thereforein exercise of powers conferred under section 7 (3) ofCOBO Act 1988, read with October 6, 2007 ResolutionNo JDA/CTP/BPC/26-B of the building operations con-trolling authority, Jammu Local Area, you are herebydirected to remove the illegal construction on your ownlevel within a period of five days from the date ofissuance of this order. If you fail to remove the illegalconstructions within stipulated period of time, the sameshall be removed by enforcement wing of JDA and thecost of removal shall be recovered from you as arrears ofland revenue.”No follow-up action in most of the casesallowed violators to manage operation of Banquet hallsresulting in loss to exchequer as had the violators panel-ized and fined it could have generated handsome rev-enue in the account of Govt treasury besides it couldhave stopped further illegal construction of banquethalls.

The second notice, which was also the last, to the pro-prietors of three banquet halls was issued by JDA onMay 3, 2014. JDA had threatened them all to get theencroachments removed under law by its enforcementwing in case they themselves did not do so on their ownwithin five days from the date of issuance of the lastnotice. One year and eight months have passed sincethen, but JDA has taken no action against them as yet.This gives strength to the allegations that JDA firstallowed the illegal banquet halls to come up withimpunity from law and then issued COBO notices forthe sake of formality only. These notices were issuedafter the construction was complete in all respects.

Sources alleged that the banquet halls were raisedillegally in connivance with the JDA field staff and oth-ers at the helm of affairs. “That is why these are neitherbeing demolished nor sealed by JDA,” sources said.Notice was also issued to Krishna Resort Banquet Hall,Udheywala, several times under BOCA by JDA and anorder to seal it was also issued under section 8(1) of theAct under No JDA/DLM/HQA/3391 on February 9,2015.So deep rooted is the nexsus between some JDAofficials and the banquet hall owners that despite theissuance of BOCA notice and sealing order, the banquethall, which has been raised illegally by Kasturi Lal ofAkalpur on the land of Pracheen Shri Ram JankiMandir, is still operational. While the sealing order saidthe seal should not be broken without the order of thecompetent authority and the trespasser would be prose-cuted under law, the banquet hall was not at all sealed.

In reply to a query of JDA’s director land manage-ment as regard the compliance report of the sealing ofthe banquet hall, the concerned khilafwarzi officer said:“Submitted with request that detail report alreadystands submitted vide incharge KWI Letter NoJDA/KWI/716-18 dated 21-3-2015. Moreover, SHODomana was personally contacted for providing ofpolice assistance. The moment undersigned startedsealing operation, a group of people got themselvesassembled and creating nuisance law and order prob-lems. We tried our level best to resist them but they werebent upon to create law and order problems and vio-lence. However, due to insufficient/meager police forceand non-deployment of duty magistrate, situation wasgetting out of control and there was apprehension ofviolence and breach of peace. It is, therefore, requestedthat senior officers may please be requested to providesufficient police force along with lady force and alsodepute magistrate on duty for maintaining law andorder problems so that seal order is implemented in let-ter and spirit please.” (sic)This reply was made by khi-lafwarzi office over nine months back but the sealingorder was yet to be implemented.

In the case of G R Eves (GRAND Eves) Banquet Hall,Udheywala, JDA claims that the land was allotted to itunder rules and permission was given by JDA in thename of Suresh Kumar, son of Chaman Lal, vide No

CTP/JDA/BPC/258-59 on November 26, 2013. Locals,however, belied the JDA claim, saying this piece of landalso belongs to Pracheen Shri Ram Janki Mandir. Also,this banquet hall is constructed on 9.17 kanals of land.Norms, which say that a banquet hall is to constructedon minimum 12 kanals of land, have been violated inthis case. When asked if the proprietors of these banquethalls had moved the J&K Special Tribunal against theCOBO orders, a JDA officer refused to comment. Byallowing the illegal constructions to come up, the devel-opment charges were also not deposited in the govern-ment exchequer. This way, the government has suffereda loss of revenue due to the alleged nexus between someJDA officials and the banquet hall owners. It deservesmentioning here that there are 136 villages under thejurisdiction of JDA since 2004, however 108 more vil-lages added under extended areas added to the localarea of Jammu city master plan 2021 making it total 244villages. If with the available staff they have such a loosegrip on violators what will be its fate when revisedJammu Master Plan 2032 gets implemented within twomonths after the direction of High Court. It has alreadybeen seen that the JDA already suffering loop holeswithin the system to manage its affairs and with furtherload on work its functioning will definitely collapse.Similarly in near future JMC will be facing same kind ofwork pressure and its preparation is all the same. Bothneed thorough preparations to bring proficiency in theirworking.

Mittal assured the conference that, to begin with, theMinistry would provide 75% capital subsidy for settingup Community Radio Stations in Jammu and Kashmirand Northeastern states. He also assured the conferencethat the Directorate of Audio Visual Publicity (DAVP)will provide advertisement support to the CommunityRadio Stations in the State to meet the recurring costs.

Pertinently, during a Community Radio AwarenessWorkshop organized by the Union Ministry ofInformation and Broadcasting in Jammu last month itwas told that out of 200 Community Radio Stationsoperational across the country, there is only one such sta-tion in J&K. The State has 18 Community Radio dark dis-tricts and as per the Union Ministry of Information andBroadcasting guidelines every district in the State has tohave at least two such radio stations.

The Jammu and Kashmir Government is now plan-ning to promote setting up of Community Radios in edu-cational and technical institutions of the State.

During today’s deliberations at SIMCON, Dr Shahidalso called for organizing Children’s Film Festivals acrossall districts of J&K. He also asked the Union Ministry ofInformation and Broadcasting to launch news bulletinsand programmes in Urdu, Kashmiri, Gojri, Pahari,Ladakhi and Dogri on the national hookup ofDoordarshan. Stressing for adopting E-tendering, E-payments and E-procurement, the CVC said that department should easenorms fixed for getting services and facilities by the farm-ers, orchardists and other categories associated with agri-culture and horticulture activities in order to minimize thehuman interface and chances of corruption. He asked theofficers of the departments to find out ways to eliminatehurdles in service delivery system so necessary for check-ing the menace of corruption.

US Congress .........conditions on Pakistan to be eligible for USD 400

Passed by the US House of Representatives (by 375 to34 votes) last week, NDAA 2017 now heads to the WhiteHouse for President Barack Obama to sign it into law.

As per NDAA–2017, the defence secretary needs tocertify to the Congress that Pakistan continues to con-duct military operations that are contributing to signifi-cantly disrupting the safe haven and freedom of move-ment of the Haqqani network in Pakistan and thatPakistan has taken steps to demonstrate its commit-ment to prevent the group from using its territory.

The defence secretary also needs to certify thatPakistan actively coordinates with Afghanistan torestrict the movement of militants, such as the Haqqaninetwork, along the Afghanistan-Pakistan border; andfinally that Pakistan has shown progress in arrestingand prosecuting Haqqani network senior leaders andmid-level operatives.

US Defence Secretary Ashton Carter had refused togive a similar certification to Pakistan this year as aresult of which Islamabad was not given a USD 300 mil-lion under CSF.

The Haqqani network has carried out a number ofkidnappings and attacks against US interests inAfghanistan. The group is also blamed for several dead-ly attacks against Indian interests in Afghanistan,including the 2008 bombing of the Indian mission inKabul that killed 58 people.

NDAA-2017 "refocuses security assistance toPakistan on activities that directly support US nationalsecurity interests and conditions a significant portion offunding on a certification from the secretary of defencethat Pakistan is taking demonstrable steps against theHaqqani Network in Pakistani territory," said SenatorJohn McCain, Chairman of the Senate Armed ServicesCommittee.

NDAA allows for reimbursement of Pakistan forsecurity activities along the Afghanistan-Pakistan bor-der, including providing training and equipment for thePakistan Frontier Corps in Khyber Pakhtunkhwa.

However, members of the Conference Committeeexpressed concern that Pakistan continues to delay ordeny visas for US personnel that could assist with theprovision of such training. Given this situation, thereport recommends the Pentagon to condition reim-bursements for training and equipment with appropri-ate access by US personnel.

It also expressed concern about the persecution ofgroups seeking political or religious freedom inPakistan, including the Balochi, Sindhi and Hazara eth-nic groups, as well as religious groups, includingChristian, Hindu and Ahmadiyyas.

It said the defense secretary should continue to close-ly monitor the provision of its security assistance toPakistan and ensure that it is not using its military orany assistance provided by the US to persecute minori-ty groups.

The India-US defence relationship, built over multi-ple administrations in both Washington and Delhi, hasstarted to blossom in the past three years, it said.

The CSIS observed that early outreach by PrimeMinister Narendra Modi to the United States signaled toboth Washington and his own bureaucracy that he wasserious about engagement.

"Similarly, President-elect Trump could send animportant early signal of his intent to cooperate closelywith India by arranging a meeting with Prime MinisterModi in the first 100 days President Trump is in office,"it said.

Asserting that there are a wide range of issues toaddress, CSIS experts said the change in personnel thatcomes with a new American administration, combinedwith typical turnover within India's government, couldlead both countries to "forget" the patterns of engage-ment and cooperation that have been so fruitful over thepast two years. In greater South Asia, it said the USincreasingly sees India as a partner for solving enduringchallenges.

This is not to say that US' relations with Pakistan orAfghanistan will neatly align with Indian positions orthat the two countries will agree on every action, itnoted.

"However, the strategic challenges facing bothnations are drawing them closer as they seek ways toreach common objectives. Communication on sharedinterests and capabilities in South Asia is critical toensure that the United States and India cooperateinstead of compete in the region," the CSIS said.

It said the benefits to the US of stronger ties withIndia are growing with each new avenue of cooperation."Over the past three years, thanks largely to the jointefforts of Secretary Carter and Defence MinisterManohar Parrikar, the two countries have advancedcooperation on issues ranging from military exercises todefence trade," the op-ed said.

FMPHW’s areregarded as the first contact personbetween people and organisation,between needs and services andbetween consumer and provider. Itis through their activities that peo-ple perceive health policies andstrategies. It is through them thatplanners at the upper level gaininsights into health problems andneeds of the rural people.

Considering their status as grass-root level workers in the healthorganisational hierarchy, a heavyresponsibility rests on them. Theirservices are considered essential toprovide safe and effective care andas a vital resource to achieve thehealth-related targets. The presentconcern in the country is to provideaccessible, affordable, accountable,equitable, effective and reliablehealth care, especially to poor andvulnerable sections of population inrural areas. The feeling of Patriotism is importantfor the Freedom of a Country. A patri-otic person will always be ready tosacrifice his life for the love for hiscountry. A Patriot is immortal. Menlove their own country. They do manythings for the good of the country.Every one of us knows the name ofMaharana Rana Pratap Singh ofMewar. He was a king. But he sufferedgreat hardship for his country. He sac-rificed everything for the freedom ofhis country. He was a great patriot. Heearned an immortal name by his self-sacrifice. Thus many patriots lost theirall, even their lives for the good of thecountry. But they gained one thing.They won the hearts of their country-men. We must love our country; at thesame time we must not hate others.Wars break out between two nationsfor want of love for other countries.We should, therefore, love our countryas well as those of others. To under-stand the significance of patriotism,consider what happens within a familywhen a certain amount of loyalty doesnot exist. A spouse cheats on a spouse,a parent fails to defend his child, achild ignores an elderly parent. Thefamily disintegrates. Another apt com-parison is a football team. What wouldhappen if players who are unhappywith the coach decided to get even byrevealing their playbooks to the oppos-ing team or by undermining the team’sstrategy and purposely failing to dotheir jobs? That would lead to the endof the team eventually. In a country,patriotism is necessary to preserve andprotect the nation as it currently exists.The order of the Supreme Court to playthe national anthem before every fea-ture film in cinema halls is a curiousact. Where does the Supreme Court getthe power to issue executive fiats, andon what basis is the court encroachingupon purely executive and legislativefunctions which are itself a dangerousmove. Patriotism has many meaningsand nuances, apart from feeling goodabout your nation. Does the constanthearing of the national anthem pushthe many “desired” traits of a patriot?Does it make you more law-abiding,does it prompt greater consciousnessof the spirit and elements of ourConstitution, does it make you morehumane, compassionate and respectfultowards all fellow citizens? Theanswer is a clear no. A reasonable fre-quency and appropriate time, and placeand event for the national anthem doesreinforce this feeling of joy and pridein our nation. But as you increase thefrequency of symbols and symbolicgestures (as the anthem is), and distortthe logic of symbolic gestures an theirassociation with appropriate events,you cheapen and weaken the force ofthe impact and relevance of such ges-tures. I believe the Supreme Court hasdone that. Why should the SupremeCourt’s order to play the nationalanthem in cinema halls or for people tostand up when the anthem is played, beseen as illegal, for, all it has done asthe custodian of India’s Constitution,is to re-instil respect for the flag, thenation, and to restore a sense of nation-alism and patriotism in each and everyIndian citizen, and love for the mother-land. Playing the national anthem andremembering the multicultural diverseaspects of our country for 52 secondsis not going to harm the amount of ourpleasure time during any film. Rather,it will help us in connecting with thesocio-cultural identity of the countryand sense of proud we carry with it.This decision should not be debated,but rather seen as the crying need ofthe hour to restore the principle ofunity in strength.

These are moral principles ornorms, which describe certain stan-dards of human behavior and areregularly protected as legal rights inmunicipal and international law.They are universally understood asinalienable fundamental rights "towhich a person is intrinsically enti-tled simply because she or he is ahuman being," and which are"inherent in all human beings"regardless of their nation, location,language, religion, ethnic origin orany other status. To protect therights of Human beings, severalorganizations are working tirelesslyin this direction but a big questionarises here “Are Human Rights of allthe communities being protected? Ifwe introspect our conscience, wewill not get satisfactory answer tothis question because in many cases,Rights of Human beings are not pro-tected; moreover they are beingexploited by their ownGovernments. After post independ-ence of India, a series of humanrights violation of the citizens beganin October 1947, and the said terri-ble spree is still continued. Indiawhich is also known as the largestdemocracy in the world failed toprotect rights of its own people(Displaced Persons) who were force-fully thrown out of their own nativeplaces which is now know asPakistan occupied Kashmir (PoK). Itis an evident fact that Pak sponsoredtribal raid was conducted in variouserstwhile parts of princely State ofJammu and Kashmir. Since then,the Displaced Persons of these areashave been the worst victims ofhuman rights. The Human rights ofPakistan occupied Kashmir (PoK)Displaced Persons is unprecedented

as they have been bearing the agonyfor the last 7 decades and this periodof their exile has been the worstexample of Human Rights abuse ofthe most destitute community whichwitnessed terrible genocide of theirnear and dear ones.

As per United Nations HumanRights Commission (UNHRC)despite the fact that India is a host todiverse groups of refugees, the coun-try has no specific laws or organizedpolicy for refugees. India is neither asignatory to the 1951 RefugeeConvention nor to its 1967 Protocolon the Status of Refugees. Therefore,the protection of refugees is con-fined to wantonness taken by theGovernment of India, leavingrefugees with petite protection fortheir civil and political rights andvirtually no legal provisions for theirsafety and welfare. The HumanRights of people whose loved oneswere brutally killed has been theworst sufferers as the Governmentof India has no policy for theDisplaced persons especially whocannot go back to their ancestralplaces. In the whole world, there hadnot been such abuse of HumanRights as it would have beenoccurred to Human Rights violationof PoK Displaced Persons. The his-tory is witness that none of the coun-try has taken much to rehabilitatedisplaced persons except which stillhas no policy regarding displacedpersons. The condition of PoKDisplaced Persons from PoK is notconcealed to anyone as they are still

constrained to spend their lives inmiserable conditions. They aredeprived of basic amenities whichinclude food, shelter, education,healthcare and many more. Evenlawmakers are not concerned aboutit; lawmakers’ prime job is to redressthe problems of citizens but our law-makers keep on exploiting displacedpersons for their petty gains which isdespicable blot at the world’s largestdemocracy of the world.

Government of India has keptunsympathetic approach towardsDisplaced persons who were force-fully kicked out of PoK. Governmenthas been talking about the vacatingPoK from the illegal occupation ofPakistan and the lawmakers havebeen reiterating this song since1994, the year a resolution wasunanimously passed in theParliament of India. Strange it mayappear but it’s true that India is theonly country in the whole whichgives priority to area instead of itsinhabitants. I would like to quote afact of Northern Ireland which isunder the possession of UK but thepeople can freely roam in eachother’s territories as it seems there isno conflict there. If there is someconflict between them that would beconfined to papers or some forumsbut there is no impact of these con-flicts on them. Contrary to NorthernIreland example, it’s a distant dreamfor displaced persons to roam inthese conflicted areas and the worstsufferers are people associated tothis area. Displaced Persons are fac-

ing brunt on part of Government asneither have any policy for the dis-placed persons nor signatory ofUNHCR.

The need of the hour is thatGovernment must come up with apolicy which will prove helpful andbeneficial for displaced persons.Government needs to setup aNational Refugee Commissionwhich will open portals for displacedpersons that will redress the issuepertaining to them. It is the primeduty of Government of India tomake a policy that will provide suc-cor to displaced persons who aresurrounded with lot of woes sincetheir exodus from their ancestralplaces.

There is a need of Uniform policyfor all the displaced persons of thecountry whether they are the dis-placed of 1947, 1965, 1971, 1989 andBorder Migrants. All the displacedpersons communities must be treat-ed with same yardstick as it has beenseen for last many years. One morething which is quite mandatory to sayhere that all the displaced personscommunities of India have been thevictims of manmade disaster andthey all ought to be treated undersame humane approach. Thereshould not be any place for discrimi-nation among several displaced com-munities and they all must be provid-ed healing touch with utmost humilityand honesty. This issue must be keptout from political arena as politicianshave already exploited the concernsby one way or other.

Need for “National Refugee Policy” to protect Human Rights abuse

The demonetisation impactof banning the Rs 500 and Rs1,000 legal tender currencypost November 8, has taken itstoll. The Purchasing Managers’Index (PMI) of the services sec-tor – litmus test of consump-tion growth nose dived to athree-year low of 46.7 inNovember as against 54.5 inOctober.

dor waving a red cloth in front of a bull.A lazy Sunday afternoon is when grownups at

home want to enjoy their afternoon siesta whilethe kids and teenagers want to make the most oftheir holiday by playing board games or spend-ing time at a friend’s place. I must tell you,though, that this particular Sunday afternoonwas over three decades ago when playing actual-ly meant physical activity, and not virtual gameson smartphones and tabs. The silence at homewas not appealing to my senses and the intenserays of the sun were not a welcome sight either.But I had to make a choice, and the young andthe restless me chose the latter, of course. Myschool friend, Roopa, lived not too far from myhome but the walk to her place was an ‘uphill’task! Simply put, our house was situated at thebottom of a hillock while hers was atop it.

Unmindful of the physical strain I had toendure, I put on a bright red skirt and a white t-shirt and stepped out in style. With not a soul insight, and only the sun and silence as my com-panions, I started walking excitedly towards mydestination. I was half way up the road, when Inoticed a lone bull standing on the other sidepeering at some stray strands of grass. An opti-mist at heart, I assumed that it would keep gaz-ing at mother earth while I silently walked awayfrom its sight. But, lady luck was not on my side.The swish of my bright red skirt was akin to amatador waving a red cloth in front of a ragingbull. But, this was no rodeo show – there were nospectators to cheer my gallant act or rescue mefrom the menacing bull. Fear gripped my trans-fixed body. Making eye contact with an irate bullwas not my idea of a Sunday well spent. And tak-ing a few steps would mean encouraging the bullto attack. However, one look at the road aheadgave me a glimpse of hope. Climbing it may slowdown the speed of the bull while I could put myPT class training to optimum use with a goodsprint, I reasoned. I took to my heels and thebull, too, started charging towards me with equalvigour. As the gradient on the road becamesteep, the bull’s speed reduced but I maintainedthe same pace. Once I reached the hill top road,I was relieved to see my friend’s house. My hap-piness, though, was short lived when I noticedthat the bull had not given up its effort in reach-ing its soon-to-be victim. “Roopa, Roopa... openthe gate!” I shouted, shaking the gate with what-ever little strength I had. My friend must havebeen taking an afternoon siesta, too, but myshrill voice awakened her and she came to thedoor with a smile. “Don’t just stand there. Comeand open this blessed gate”, I yelled at her, atwhich she quickly let me in to her sanctuary.

When I peered out, I saw the bull standingnear her house and staring at us. The compoundwall was high enough and the gate was durabili-ty personified. “Phew, saved at last,” I heaved abig sigh of relief. I narrated the entire drama toRoopa, hoping to hear a few words of sympathy.Instead, she rolled on the floor with laughter andsaid, “Sad that this local bull run had no specta-tors. It would have been thrilling to watch all thison a lazy Sunday afternoon.” I gave a wry sm-ileand patted myself for my victory.

The utterances of National Conferencehave put the entire nation to seriousembarrassment in front of the entireworld. The embarrassment is further com-pounded by the position taken by the rul-ing PDP leadership with regard to thepresent turmoil in Kashmir as well asPakistan. The PDP, which is the leadingpartner of the ruling PDP-BJP alliance inthe state, has consistently maintained aposition on the present situation inJammu and Kashmir as well as relationswith Pakistan which is different thanGovernment of India. It is brazenly man-ifest that the present Government in thestate has its own foreign policy as well ashome policy distinctly in conflict withthat of the Government of India. How canGoI allow this state of affairs to continue?Agenda of Alliance is being used by all theanti-national forces within theGovernment and outside it to promotethe cause of Pakistan and secessionists inthe state. It is high time for GoI to realize

that soft-separatism only irrigates seces-sion. It breeds alienation. It strangulatesnational interests. Similarly toleratingand patronizing communalism destroyssecular fabric. The religious fascist seces-sionism in Jammu and Kashmir hasgrown on the fertile soil created by vari-ous variants of Muslim autonomy poli-tics. Defeat of this fascism is critical to thesurvival of Indian nation.We want tostate without hesitation that Jammu andKashmir has a 60 lakh population ofHindus, Sikhs and Buddhists. The rightsand claims to the state of Jammu andKashmir of Hindus, Sikhs and Buddhistsare no less than the Muslims living in thestate. Jammu and Kashmir is neither anextension of Central Asia nor of MiddleEast. The state has thousands of years ofcontinuity with the civilization of India.

Panun Kashmir unambiguously sup-ports the present policy of Governmentof India in relation to Pakistan. Wehave unequivocally endorsed the surgi-cal strikes against the terror bases inPoJK by the Indian army as well asdropping of inhibitions to claim PoJKincluding Gilgit and Baltistan as part ofnation of India. This was announced at ameeting of the officers andscientists from IndianSpace ResearchOrganization (ISRO) whocalled on the Minister forEducation, Mr NaeemAkhtar here today.Commissioner Secretary,Higher Education, DrAsghar Hassan Samoonwas also present at themeeting.

Mr Virender, Director,Development Educationand Communication Unit(DECU) and Mr Murthy,Senior Scientist.

The meeting was toldthat the EducationDepartment has alreadycovered 400 HigherSecondary Schools in theState with ICT-enabledclassrooms to facilitate e-learning while other schoolsincluding the high schoolsare being covered in aphased manner to facilitatesmooth launch of the pro-gramme. The Departmentis also planning to have full-fledged studios in all theschools with advanced tech-

nological facilities to recordlectures for creation of e-content.

The ISRO team assuredthe Education Minister thatthe Organization willupgrade all the EDUSATs inJ&K with latest technologyand expand the facility,presently available in highereducation sector only, to theschool education sector aswell. The Department ofEducation will sign MoUwith ISRO in this regard.

The ISRO team has beeninvited by the EducationDepartment to make func-tional all the EDUSAT sys-tems installed in variouscolleges of the State.

Pertinently, GSAT-3,known as EDUSAT ismeant for distant classroomeducation from school tohigher education level. Thiswas the first dedicated"Educational Satellite" thatprovides the country withsatellite based two-waycommunication to class-rooms for delivering educa-tional materials.
