This is your Easi-Drive 2 Personal Accident Policy. Please read it carefully and if incorrect, immediately return it to us

for correction.

Your Easi-Drive 2 Personal Accident Policy comprises this document, the Schedule and any endorsement. They

should be read as one document and any word or expression which has a particular meaning shall have the same

meaning wherever it may appear.

The written proposal and the declaration submitted by you shall form the contract of this insurance. The

conditions appearing in this Policy or in any endorsement are part of this contract and must be complied with by you

and/or the Insured Person(s) before we pay a claim.

Our Agreement

For Consumer Insurance Contracts (Insurance wholly for purposes unrelated to the Insured’s trade, business or profession)

This Policy is issued in consideration of the payment of premium as specified in the Policy Schedule and pursuant to

the answers given in your Proposal Form (or when you applied for this insurance) and any other disclosures made by

you between the time of submission of your Proposal Form (or when you applied for this insurance) and the time this

contract is entered into. The answers and any other disclosures given by you shall form part of this contract of

insurance between you and us. However, in the event of any pre-contractual misrepresentation made in relation to

your answers or in any disclosures given by you, only the remedies in Schedule 9 of the Financial Services Act 2013

willapply.

This Policy reflects the terms and conditions of the contract of insurance as agreed between you and us.

For Non - Consumer Insurance Contracts (Insurance for purposes related to the Insured’s trade, business or profession)

This Policy is issued in consideration of the payment of premium as specified in the Policy Schedule and pursuant to

the answers given in your Proposal Form (or when you applied for this insurance) and any other disclosures made by

you between the time of submission of your Proposal Form (or when you applied for this insurance) and the time this

contract is entered into. The answers and any other disclosures given by you shall form part of this contract of

insurance between you and us. In the event of any pre-contractual misrepresentation made in relation to your answers

or in any disclosures made by you, it may result in avoidance of your contract of insurance, refusal or reduction of

your claim(s), change of terms or termination of your contract of insurance.

This Policy reflects the terms and conditions of the contract of insurance as agreed

between you and us. For the purpose of this Policy, the following definitions apply:

"We/Us/Our" means Great Eastern General Insurance (Malaysia)

Berhad "You/Your" means the person or corporation named as the

Insured in the Schedule.

"Vehicle" means a passenger car registered and used solely for private, social and domestic purposes.

"Named Vehicle" means Your Vehicle described in the Schedule, used solely for private, social and domestic purposes.

"Driver and/or Passenger(s)" means any person(s) who, with Your or the driver's permission, is(are) travelling in the

Named Vehicle.

"Insured Person(s)" means You, the Driver and/or Passenger(s), the number of which is specified in the

Schedule, while travelling in the Named Vehicle.

"Travelling" means driving or riding in or boarding or alighting from a Vehicle.

"Accident" means an event of a violent, accidental, external and visible nature which shall independently of any

cause be the sole cause of bodily injury.

"Bodily Injury" means injuries caused by an Accident and which, independently and exclusively of any other

cause, result in death or disablement.

"Sum Insured" means the maximum amount specified in the Schedule which we will pay to each injured person in

the event of a claim for death or disablement.

EASI-DRIVE 2 PERSONAL ACCIDENT POLICY

STAMP DUTY

"Hospital" means any licensed medical centre or establishment equipped with diagnosis, surgery and intensive care

unit facilities for the treatment and care of sick or injured persons, and which provides room and board and 24 hours

nursing services by registered graduate nurses.

SECTION I – BODILY INJURY TO YOU

If, while the Policy is in force, You suffer Bodily Injury caused by Accident while Travelling in the Named Vehicle or

any Vehicle within the territorial limits of Malaysia, Kingdom of Thailand, Republic of Singapore or Negara Brunei

Darussalam, We will pay the Benefits set out in this Policy.

But we will not pay the Benefits for Bodily Injury suffered by You as the Driver of the Named Vehicle or any Vehicle if at the time of Accident

(a) You do not hold a valid driver's licence or are not qualified for holding or obtaining such a licence to drive a

vehicle under any required laws, by-laws and regulations;

(b) You were under the influence of intoxicating drugs or liquor.

SECTION II – BODILY INJURY TO DRIVER ANDlOR PASSENGERS

If any of the Insured Persons shall suffer Bodily Injury caused by Accident while travelling in the Named Vehicle within

the territorial limits of Malaysia, Kingdom of Thailand, Republic of Singapore or Negara Brunei Darussalam, we will pay

the Benefits set out in this Policy.

But we will not pay the Benefits for Bodily Injury suffered by the Insured Persons if at the time of Accident the Driver of the Named Vehicle:

1. does not hold a valid driver's licence or is not qualified for holding or obtaining such a licence to drive a vehicle

under any required laws, by-laws andregulations;

2. is under the influence of intoxicating drugs or liquor.

(j) Loss by physical severance of ail phalanges of all toes - both feet

"Loss" as used in reference to limbs shall mean physical severance or total

and irrecoverable loss of use.

3. MEDICAL & SURGICAL TREATMENT: We will, upon presentation of original bills, reimburse the actual

cost of medical, surgical and hospital expenses (including expenses for sinseh or other traditional

treatment but limited to RM25 per visit and a maximum of RM250 per Accident) necessarily and reasonably

incurred and expended up to an amount not exceeding the sum specified in the Schedule. But we will only

pay this Benefit if you or the Insured Person first seek, obtain and comply with proper Western medical

treatment and advice from a qualified and registered doctor within twenty (20) days of the Accident.

4. COSMETIC SURGERY & DENTAL TREATMENT: We will, upon presentation of original bills, reimburse

the actual cost of corrective cosmetic surgery performed on the head or neck, or treatment of injury of or

damage to sound natural teeth reasonably incurred and expended up to an amount not exceeding the

sum specified in the Schedule provided that such corrective cosmetic surgery and/or dental treatment is

recommended a licensed cosmetic surgeon or licensed dentist.

5. BEREAVEMENT ALLOWANCE: In the event of an Insured Person's death, we will upon receipt of

the Police Report and Death Certificate, pay the amount specified in the Schedule as bereavement

allowance.

6. HOSPITAL CONFINEMENT CASH ALLOWANCE: If an Insured Person is confined in a Hospital for a

period of more than twenty-four (24) hours for medical treatment, we will pay the Insured Person a daily

cash allowance as specified in the Schedule for each day of confinement up to a maximum of sixty (60)

days. But we will only pay this Benefit if confinement takes place within 24 hours after the Accident.

LIMITATION TO PAYMENT OF BENEFITS

1. All Benefits under this Policy are payable to any one Insured Person in respect of any one Accident.

2. The total amount we will pay under Benefit Items 1 and 2 to any one Insured Person in respect of any one

Accident shall not exceed 100% of the Sum Insured specified in the Schedule. However, all other Benefits if

payable are payable in full.

3. Passengers aged 15 days to 15 years at the time of Accident are only entitled to 50% of Items 1 and 2 of the

Benefits payable. However, all other Benefits if payable are payable in full.

4. If, at the time of Accident, the actual number of persons travelling in the Named Vehicle exceeds the number

specified in the Schedule, our limit of liability per person under all Benefits shall be reduced by the ratio of the

actual number of persons to that of the number of persons declared. This limitation shall not apply to the Driver.

SPECIAL PROVISION TO SECTION I AND II

1. Double Indemnity

We will pay double the Sum Insured if an Insured Person shall suffer death, permanent total and incurable

paralysis from the neck down or permanent complete and incurable insanity by Accident while travelling in the

Named Vehicle if the Accident occurs

(a) during a nationwide Public Holiday;

(b) in any state in Malaysia which was observing a State Public Holiday;

(c) while participating in any organised motor treasure hunt.

2. Loss of or Damage to Personal Effects

If, immediately after an Accident, any of the Insured Persons having been transported in a state of

unconsciousness from the site of the Accident to a Hospital for medical treatment, shall upon recovery discover

that watches, pens, jewellery or other personal ef fects belonging to them and while on their person at the time of

Accident are lost or damaged, we will compensate the Insured Persons for such loss or damage up to an amount

not exceeding RM500.00 per person.

But,

the Accident must involve the Named Vehicle which the Insured Persons were travelling in;

the loss or damage must be reported to the Police immediately upon its discovery before we can pay;

We will not pay for loss or damage to money or cash, credit cards, phone cards, personal identity cards,

passports or documents of any kind.

3. Guardian's Allowance

If a child passenger aged from 15 days to 15 years old who, while travelling in the Named Vehicle, is hospitalised

as a result of Accident and requires overnight attention and companion of a parent or guardian during the period

of hospitalisation, we will pay an allowance of RM50.00 per night up to a maximum of sixty (60) nights.

4. Ambulance Charges

We will pay the actual charges incurred for the provision of road ambulance services necessary for transporting

the Insured Persons for medical treatment as a result of an Accident, but up to an amount not exceeding

RM200.00 per person.

SECTION III – CAR RENTAL l TRAVELLING ALLOWANCE

If the Named Vehicle is damaged in an Accident occurring within the territory of Malaysia and is laid up for repair in a PIAM

approved repairer workshop or a repairer workshop approved by Us, We will,

(a) subject to presentation of original bills, subsidise You a daily cash amount specified in the Schedule for renting a

vehicle of similar make and capacity as the Named Vehicle from a licensed car rental company, or, (b) at Your option, pay a daily cash amount as specified in the Schedule as travelling expenses

for a period of up to a maximum of seven (7) days.

But We will not pay this Benefit

(a) if the Named Vehicle is not insured under a Comprehensive Motor insurance policy at the time of Accident.

(b) if the Named Vehicle is not removed to the repairer workshop for repair within forty-eight (48) hours after the date of Accident.

(c) for the first three (3) days the Named Vehicle is undergoing repair.

(d) if, at the time of Accident, the Driver or You as the driver of the Named Vehicle do not hold a valid driver's licence

or are not qualified for holding or obtaining such a licence to drive a vehicle under any required laws, by-laws and

regulations.

Upon payment of a claim under this Section, this Benefit shall automatically be terminated unless reinstated by payment of

a further additional premium of RM15.00 flat.

SECTION IV – HOTEL ACCOMODATION

If, while You are travelling in the Named Vehicle, the Named Vehicle shall, by reason of Accident occurring more than

100 km from your usual place of residence, be totally immobilised and is required to be immediately towed to a PIAM

approved repairer workshop or a repairer workshop approved by Us for repair, We will, subject to presentation of

original bills, reimburse You for the actual cost incurred up to an amount not exceeding the sum specified in the

Schedule for an overnight stay in a hotel located at the nearest town to the site of the Accident.

But We will not pay the Benefit if You as the driver of the Named Vehicle at the time of Accident do not hold a valid driver's

licence or are not qualified for holding or obtaining such a licence to drive a vehicle under any required laws, by-laws and

regulations.

Upon payment of a claim under this Section, this Benefit shall automatically be terminated unless reinstated by payment of

a further additional premium of RM15.00 flat.

GENERAL EXCLUSIONS - THESE APPLY TO THE WHOLE POLICY

This Policy does NOT apply:

1. to any person below the age of 15 days and above the age of 80 years.

2. to loss caused directly or indirectly, wholly or partly by

(a) viral or bacterial infection (except pyogenic infections which shall occur through an accidental cut or wound);

(b) any other kind ofdisease.

3. to childbirth or any bodily injury which shall result in hernia.

4. to suicide or attempted suicide (sane or insane).

5. to miscarriage unless caused solely and directly by Accident to:

(a) You while travelling in the Named Vehicle or any vehicle.

(b) the Insured Person(s) while travelling in the Named Vehicle.

6. while the Named Vehicle is used for hire, racing, road rally, pacemaking, speed-testing or use for any purpose in

connection with motor trade or used for illegal business pursuit as an unlicensed common carrier or for any

criminal activities.

7. to Accident occurring outside the territorial limits of Malaysia, the Kingdom of Thailand, the Republic of

Singapore and Negara Brunei Darussalam.

8. to claims under any Workmen's Compensation Laws or at "Common Law" for damages obtained by Passengers

against You or the Driver of the Named Vehicle for negligence, recklessness or default.

9. to loss occasioned by confiscation, seizure, commandeering or requisition by or under the order of any

government or public or local authority.

10. to any direct or indirect consequences of war, invasion, act of foreign enemy, hostilities (whether war be declared

or not), strike, riot or civil commotion, civil war, mutiny, rebellion, revolution, insurrection, military or usurped

power or state of siege.

11. to any act of terrorism. For this purpose an act of terrorism means an act, including but not limited to the use of

force or violence and/or the threat thereof, of any person or group(s) of persons, whether acting alone or on behalf

of or in connection with any organisation(s) or government(s), committed for political, religious, ideological or

similar purposes including the intention to influence any government and/ or to put the public, or any section of the

public, in fear.

12. loss directly or indirectly caused by or arising from or contributed to by nuclear weapons material, ionizing radiation

or contamination by radioactivity from any nuclear fuel or from any nuclear waste from the combustion including

any self-sustaining process of nuclear fission of nuclear fuel.

CONDITIONS - THESE APPLY TO THE WHOLE POLICY

1. Duty of Disclosure l Fraud

If You fail to disclose to Us fully and faithfully all the facts which You know or ought to know, or if You

misrepresented any facts to Us before the Policy was entered into, or if any claim made shall be fraudulent or

exaggerated, We may avoid this Policy.

2. Alterations

No alteration in this Policy shall be valid unless We approve such alteration by endorsement.

3. Making A Claim

(a) All claims must be submitted through You and in the event of Your death Your legal personal representatives.

(b) Notice in writing must be given to Us of any injury on which a claim may arise as soon as possible and, in any

event, within thirty (30) days after the happening of the accident causing such injury. In the event of accidental

death, immediate notice must be given to Us. A claim shall not be invalidated on the grounds that You or the

Insured Person failed to notify Us within the prescribed time if it can be shown to Our satisfaction that it was

not reasonably possible to give such notice within the prescribed time limit for an otherwise legitimate claim.

(c) Upon receipt of such notice We shall furnish You or the Insured Person with Our usual claim form to be

completed giving full details of the accident and injuries and, at your own expense, return it to Us together

with police report and all original bills together with other reports or evidence which We may reasonably require

to assess the claim.

(d) We shall, at Our own expense, have the right and opportunity to subject the Insured Person to medical

examination during such period or periods as We may reasonably require.

(e) In the event of accidental death, We shall be entitled at Our own expense to conduct a post mortem examination.

4. Payment ofBenefits

Death Benefits due to You or the Insured Person shall be payable to Your or the Insured Person's legal personal

representatives. All other Benefits which are payable shall be payable to You and in the case of any Insured Person

payable only with Your approval and directly to the Insured person or to his legal personal representatives whose

receipt shall in all respects be a full and effective discharge to Us.

5. Cancellation

You may cancel this Policy at any time bynotifying Us in writing and, provided that no claim has arisen during the

then current period of insurance, We will, subject to our retention of a minimum premium of RM50.00, make a

refund of premium paid for any unexpired period of insurance calculated at Our usual short-term rates as follows:

We may also cancel this Policy by giving You fourteen (14) days written notice by registered post to Your last

known address and We will make a pro rata refund of the premium for any unexpired period of insurance.

6. Arbitration

Where a claim has been submitted under this Policy and there is a disagreement, the matter shall be referred to

an Arbitrator in accordance with the statutory provisions then current. If this happens, an award must be made by

the Arbitrator before legal proceedings can be commenced.

7. Time Limitation

We will not be liable to pay any claim after the expiration of twelve (12) calendar months from the happening of

the accident unless the claim is the subject of pending action or arbitration.

8. Applicable Law

This Policy is governed by, and shall be construed in accordance with the Laws of Malaysia.

CAR EMERGENCY ASSISTANCE PROGRAMME

This Policy also entitles You to car emergency assistance as provided for under a programme that We have arranged

with an Emergency Assistance Provider. The benefits are only for the Named Vehicle specified in the Schedule. Details

of the benefits including terms, conditions and exclusions are detailed as follows.

Important Notice

Your Easi-Drive Personal Accident Policy comes with a Car Emergency Assistance Programme (herein referred

to as "the CAP") and its scope of services is distinct from and independent of the scope of cover provided under

this Policy.

The services under the CAP are provided in accordance with and subject to an agreement signed the Emergency

Assistance Provider named in the Policy Schedule (herein referred to as "the EAP") and Us. We reserve the rights to

revise, change or cancel any or all of the services provided under the CAP at any time without prior notice.

Territorial Limits

The services provided under the CAP shall be available within Peninsular Malaysia excluding the islands excepts for

Penang, Langkawi and Labuan. While in East Malaysia, the services shall be available in Kota Kinabalu, Sandakan,

Tawau, Kuching, Bintulu and Miri.

Scope of Services

Only Your Named Vehicle as described in your Easi-Drive Policy Schedule is entitled to the services provided under

the CAP. The CAP provides the following services to the Named Vehicle 24 hours a day throughout the year but your

Easi-Drive Policy must be in force and the CAP agreement is still valid and in force.

1. Emergency Towing and Minor Roadside Repair

If the Named Vehicle is immobilised by reason of accident or breakdown, the driver or passenger may contact the

EAP's 24 hours Alarm Centre for immediate assistance.

If it is possible to repair the Named Vehicle on the spot, the EAP shall dispatch a mechanic for such roadside repair services and the EAP

shall pay the labour cost. But the EAP shall not be responsible for any cost incurred for the supply of any spare par ts.

If it is not possible to repair the Named Vehicle on the spot, the EAP shall organise and pay for the towing of the

Named Vehicle to the nearest available workshop.

The maximum amount which the EAP shall be responsible to pay for towing and/or labour cost for the roadside repair

is up to the sum specified in the Schedule per event.

2. Car Replacement Assistance

If the Named Vehicle is immobilised by reason of accident or breakdown and the driver and/or passenger(s) require

replacement car, the EAP shall refer and assist the driver and/or passenger(s) to arrange for car rental. The cost

of car rental shall be borne by the driver and/orpassenger(s).

3. Arrangement for Hotel Accommodation

If the Named Vehicle is immobilised by reason of accident or breakdown and the driver and/or passenger(s)

require hotel accommodation, the EAP shall assist the driver and/or passenger(s) to organise for hotel

accommodation. Cost incurred for such hotel accommodation shall be borne by the driver and/or passenger(s).

4. Referral to Service Centre

The driver and/or passenger(s) of the Named Vehicle may contact the EAP to arrange for referral to the nearest

repair or service centre and prior appointment for car servicing or repair. All costs incurred shall be borned by the driver and/or passenger(s).

Exclusions

The following conditions are excluded from this programme:

1. Services not organized directly by Asia Assistance Network (M) Sdn Bhd (AAN). 2. Service outside the territorial limits stated. 3. Cost of repair or replacement of parts and components in the workshop or service centre. 4. Petrol, toll charges, taxi fare, accommodation and telephone charges. 5. When the car keys are not available or locked inside the Named Vehicle. 6. When the Named Vehicle do not have an engine or mechanical parts. 7. When towing is for the reason to dispose the Named Vehicle. 8. Towing for discovered stolen Named Vehicle or abandoned vehicle. 9. When towing is for a reason of transferring the Named Vehicle from one workshop to another.

10. When there is no valid road tax disc displayed on the Named Vehicle. 11. Towing of a Named Vehicle after it has been sent for a spray job. 12. Cost of services that are covered by a motor claim insurance which a claim would be made (e.g; towing cost

in the event of an accident). 13. Towing or breakdown assistance due to catastrophe events or Act of God such as earthquake, flood and

windstorm. 14. If the Named Vehicle is or has been modified for participation in rally or racing, or if the Named Vehicle has

been modified against government regulations. 15. Failure of the Member to take reasonable precautions or to follow warnings of any intended strike, riot or civil

commotion via the mass media. 16. Any illegal or unlawful act by the Member or the use of the Named Vehicle for any unlawful or illegal

purposes.

17. Towing or repair of any motorcycles and commercial Named Vehicles such as but not limited to lorries,

trucks, wagons, taxis etc. THE COMPANY reserves the right to refuse assisting and towing of such vehicles.

18. When special towing and/or special equipment is required during the course of providing the towing services for the Named Vehicle which, in the sole opinion of THE COMPANY, are considered high risk and/or reasonably impracticable.

19. When the Named Vehicle is on an unpaved road surface or on a road that is not a gazette road of the road

systems of Malaysia. 20. When the named vehicle is 10 years old and above. 21. When the named vehicle is drivable.

The following Clauses shall apply to and form part of this Policy.

GOVERNMENT TAX

Please be informed that the premiums on this policy are subject to the Government tax prevailing during the term of this policy. Your obligation to pay the prevailing Government tax shall form part of the terms and conditions of Your insurance policy

SANCTION LIMITATION AND EXCLUSION CLAUSE (SANC)

The Company shall not be deemed to have provided any insurance cover and/or shall not be liable to pay any claim

or provide any benefit pursuant to the policy, including but not limited to, making any cancellation or refund under the

policy , to the extent that the provision of such insurance cover and/or the payment of such claim and/or the provision

of such benefit and/or the making of such payments, would expose the Company to any sanction, prohibition or

restriction under any laws and/or regulations, administered by any governmental, regulatory or competent authority,

or any law enforcement in any country.

kami dengan serta merta untuk pembetulan.

Polisi Kemalangan Diri "Easi-Drive 2" anda mengandungi dokumen ini, Jadual dan apa-apa pengendorsan. la

harus dibaca sebagai satu dokumen dan mana-mana perkataan atau pernyataan yang mempunyai makna tertentu

hendaklah mempunyai makna yang sama di mana sahaja ia mungkin berada.

Cadangan dan pengisytiharan bertulis yang diserahkan oleh anda hendaklah merupakan asas kontrak insurans ini.

Syarat yang terdapat di dalam Polisi ini atau di dalam apa-apa pengendorsan adalah bahagian kontrak ini dan mesti

dipatuhi oleh anda dan/atau Orang Diinsuranskan sebelum Kami membayar tuntutan.

Pembayaran anda atau persetujuan untuk bayar kepada kami premium yang dinyatakan di dalam Jadual

hendaklah diambil sebagai balasan untuk Faedah terkandung di dalam Polisi semasa tempoh insurans tetapi tertakluk

kepada terma, penghadan, kecualian dan syarat Polisi.

Untuk tujuan Polisi ini, definisi berikut diguna pakai:

"KitalKami" bermakna Great Eastern General Insurance (Malaysia) Berhad

"Anda" bermakna orang atau syarikat yang dinamakan sebagai Pihak Diinsuranskan di dalam Jadual.

"Kenderaan" bermakna kereta penumpang yang didaftarkan dan digunakan semata-mata untuk tujuan persendirian,

sosial dan domestik.

"Kenderaan Dinamakan" bermakna Kenderaan Anda yang diterangkan di dalam Jadual, digunakan semata-mata

untuk tujuan persendirian, sosial dan domestik.

"Pemandu dan/atau Penumpang" bermakna seseorang yang, dengan kebenaran Anda atau pemandu,

mengembara di dalam Kenderaan Dinamakan.

"Orang Diinsuranskan" bermakna Anda, Pemandu dan/atau Penumpang, yang bilangannya ditetapkan di dalam

Jadual, ketika mengembara di dalam Kenderaan Dinamakan.

"Mengembara" bermakna memandu atau menunggang atau menaiki atau menuruni dari Kenderaan,

"Kemalangan" bermakna peristiwa yang bersifat ganas, tidak disengaja, luaran dan ketara yang hendaklah secara

bebas daripada sebarang sebab lain menjadi satu-satunya sebab kecederaan anggota badan.

"Kecederaan Anggota Badan" bermakna kecederaan disebabkan oleh Kemalangan dan yang, secara bebas dan

secara berasingan daripada sebarang sebab lain, mengakibatkan kematian atau hilang upaya.

"Jumlah Diinsuranskan" bermakna amaun maksimum yang ditetapkan di dalam Jadual yang kami akan bayar

kepada setiap orang yang cedera sekiranya berlaku tuntutan untuk kematian atau hilang upaya.

"Hospital" bermakna mana-mana pusat atau pertubuhan perubatan berlesen dilengkapi dengan kemudahan

diagnosis, pembedahan dan unit penjagaan rapi untuk rawatan dan penjagaan orang yang sakit atau cedera, dan

yang menyediakan bilik dan makan-minum dan perkhidmatan jururawat 24 jam oleh jururawat siswazah berdaftar.

SEKSYEN 1 - KECEDERAAN ANGGOTA BADAN KEPADA ANDA

Jika, ketika Polisi berkuat kuasa, Anda mengalami Kecederaan Anggota Badan ketika mengembara di dalam

Kenderaan Dinamakan atau sebarang Kenderaan di dalam had wilayah Malaysia, Negara Thailand, Republik

Singapura atau Negara Brunei Darussalam, Kami akan bayar Faedah yang ditetapkan di dalam Polisi ini.

Tetapi kami tidak akan bayar Faedah untuk Kecederaan Anggota Badan dialami oleh Anda sebagai Pemandu

Kenderaan Dinamakan atau sebarang Kenderaan jika pada masa Kemalangan

(a) Anda tidak mempunyai lesen memandu yang sah atau tidak layak memegang atau memperolehi lesen

demikian untuk memandu kenderaan di bawah mana-mana undang-undang, undang-undang kecil dan

peraturan yang diwajibkan.

(b) Anda di bawah pengaruh dadah atau minuman keras yang memabukkan.

SEKSYEN II - KECEDERAAN ANGGOTA BADAN KEPADA PEMANDU DANlATAU PENUMPANG

Jika mana-mana Orang Diinsuranskan mengalami Kecederaan Anggota Badan ketika mengembara di dalam

Kenderaan Dinamakan atau sebarang Kenderaan di dalam had wilayah Malaysia, Negara Thailand, Republik

Singapura atau Negara Brunei Darussalam, Kami akan bayar Faedah yang ditetapkan di dalam Polisi ini.

Tetapi kami tidak akan bayar Faedah untuk Kecederaan Anggota Badan dialami oleh Orang Diinsuranskan jika pada

masa Kemalangan Pemandu Kenderaan Dinamakan:

(a) tidak mempunyai lesen memandu yang sah atau tidak layak memegang atau memperolehi lesen demikian

untuk memandu kenderaan di bawah mana-mana undang-undang. undang-undang kecil dan peraturan yang

diwajibkan.

(b) di bawah pengaruh dadah atau minuman keras yang memabukkan.

- satu tangan

(f) Kehilangan penglihatan satu mata menyeluruh dan tak boleh pulih semula

(g) Kehilangan satu anggota pada atau atas daripada pergelangan tangan atau buku lali

(h) Kehilangan pendengaran kedua-dua telinga menyeluruh dan tak boleh pulih semula

(i) Kehilangan pertuturan menyeluruh dan tak boleh pulih semula

(j) Kehilangan melalui pemutusan fizikal semua falanks semua jari kaki - kedua-dua kaki

kaki "Kehilangan" sebagaimana digunakan merujuk kepada anggota

hendaklah bermakna pemutusan fizikal atau kehilangan kegunaan

sepenuhnya dan tak boleh pulih semula.

3. RAWATAN PERUBATAN & PEMBEDAHAN:

Kami akan, apabila penyerahan bil asal, membayar balik kos sebenar belanja perubatan, pembedahan

dan hospital (termasuk belanja untuk rawatan sinseh atau tradisional lain tetapi terhad kepada RM25

sekali lawatan dan maksimum RM250 setiap Kemalangan) yang ditanggung perlu dan wajar dan

dibelanjakan sehingga amaun tidak melebihi jumlah yang ditetapkan di dalam Jadual. Tetapi kami akan

hanya bayar Faedah ini jika anda atau Orang Diinsuranskan terlebih dahulu mencari, mendapatkan dan

mematuhi rawatan perubatan Barat dan nasihat yang wajar daripada doktor berdaftar dan berkelayakan

dalam masa dua puluh (20) hari dari Kemalangan.

4. PEMBEDAHAN KOMESTIK & RAWATAN PERGIGIAN:

Kami akan, apabila penyerahan bil asal, membayar balik kos sebenar pembedahan pembetulan kosmetik

kepada kepala atau leher, atau rawatan kecederaan atau kerosakan gigi asli yang baik ditanggung dan

dibelanjakan sehingga amaun tidak melebihi jumlah ditetapkan di dalam Jadual dengan syarat

pembedahan pembetulan kosmetik dan/atau rawatan pergigian demikian disyorkan oleh pakar bedah

berleses atau doctor pergigian berlesen.

5. ELAUN PERKABUNGAN:

Sekiranya kematian Orang Diinsuranskan, kami akan apabila menerima Laporan Polis dan Sijil Kematian,

bayar amaun yang ditetapkan di dalam Jadual sebagai elaun perkabungan

6. ELAUN TUNAI PENAHANAN HOSPITAL:

Jika Orang Diinsuranskan ditahan di Hospital untuk tempoh melebihi daripada dua puluh empat (24) jam

untuk rawatan perubatan, kami akan bayar Orang Diinsuranskan elaun tunai harian sebagaimana ditetapkan

di dalam Jadual untuk setiap hari penahanan sehingga maksimum enam puluh (60) hari. Tetapi Kami akan

hanya bayar Faedah ini jika penahanan berlaku dalam masa 24 jam selepas Kemalangan.

PENGHADAN KEPADA PEMBAYARAN FAEDAH

1. Semua Faedah di bawah Polisi ini perlu dibayar kepada mana-mana Orang Diinsuranskan berkaitan

dengan mana-mana satu Kemalangan.

2. Jumlah amaun kami akan bayar di bawah Faedah Butiran 1 dan 2 kepada mana-mana satu Orang Diinsuranskan

berkaitan dengan mana-mana satu Kemalangan tidak melebihi 100% Jumlah Diinsuranskan yang ditetapkan di

dalam Jadual. Walau bagaimanapun, semua Faedah lain jika perlu dibayar adalah perlu dibayar sepenuhnya.

3. Penumpang berumur 15 hari hingga 15 tahun pada masa Kemalangan hanya berhak kepada 50% daripada

Butiran 1 dan 2 Faedah yang perlu dibayar. Walau bagaimanapun, semua Faedah lain jika perlu dibayar

adalah perlu dibayar sepenuhnya.

4. Jika, pada masa Kemalangan, bilangan sebenar orang yang mengembara di dalam Kenderaan Dinamakan

melebihi bilangan yang ditetapkan di dalam Jadual, had liabiliti kami setiap orang di bawah semua Faedah

hendaklah dikurangkan dengan kadar bilangan

orang sebenar kepada jumlah orang yang diisytiharkan. Penghadan ini tidak terpakai kepada Pemandu.

PERUNTUKAN KHAS KEPADA SEKSYEN I DAN 11

1. Indemniti Berganda

Kami akan bayar dua kali ganda Jumlah Diinsuranskan jika Orang Diinsuranskan mengalami kematian,

kelumpuhan menyeluruh kekal dan tak boleh sembuh dari leher ke bawah atau betul-betul ketaksiuman kekal

dan tak boleh sembuh oleh Kemalangan ketika mengembara di daiam Kenderaan Dinamakan jika Kemalangan

itu berlaku

(a) semasa Cuti Umum seluruh negara;

(b) di dalam mana-mana negeri dalam Malaysia yang merayakan Cuti Umum Negeri;

(c) ketika mengambil bahagian dalam mana-mana mencari harta karun berkenderaan yang terancang;

2. Kehilangan atau Kerosakan kepada Barang Persendirian

Jika, sejurus selepas Kemalangan, mana-mana Orang Diinsuranskan telah dibawa dalam keadaan tidak

sedarkan diri dari tempat Kemalangan ke Hospital untuk rawatan perubatan, apabila pulih semula mendapati

yang jam, pen, barang kemas atau barang persendirian lain milik mereka dan ketika bersama mereka pada masa

Kemalangan hilang atau rosak, kami akan mengganti rugi Orang Diinsuranskan untuk kehilangan atau kerosakan

demikian sehingga amaun tidak melebihi RM500.00 seorang.

Tetapi,

• kemalangan mesti mengakibatkan Kenderaan Dinamakan yang di dalamnya Orang Diinsuranskan mengembara;

• kehilangan atau kerosakan mesti dilaporkan kepada Polis dengan serta merta apabila penemuannya sebelum kami

boleh membayar;

• Kami tidak akan bayar untuk kehilangan atau kerosakan kepada wang atau tunai, kad kredit, kad

telefon, kad pengenalan diri, pasport atau sebarang jenis dokumen.

3. Elaun Penjaga

Sekiranya penumpang kanak-kanak berumur dari 15 hari hingga umur 15 tahun yang, ketika mengembara di

dalam Kenderaan Dinamakan, dimasukkan kehospital akibat Kemalangan dan memerlukan perhatian

semalaman dan teman ibu atau bapa atau penjaga semasa tempoh berada di hospital, kami akan bayar elaun

RM50.00 semalam sehingga enam puluh (60) malam.

4. Caj Ambulan

Kami akan bayar caj sebenar tertanggung untuk penyediaan perkhidmatan ambulan jalanan yang perlu untuk

membawa Orang Diinsuranskan untuk rawatan perubatan akibat Kemalangan, tetapi sehingga amaun tidak melebihi

RM200.00 seorang.

SEKSYEN III - ELAUN PENGEMBARAANlPENYEWAAN KERETA

Jika Kenderaan Dinamakan dirosakkan dalam Kemalangan yang berlaku di dalam wilayah Malaysia dan tersimpan untuk

pembaikan di dalam bengkel pembaik yang luluskan PIAM atau bengkel pembaik yang diluluskan oleh Kami, Kami

akan,

(a) tertakluk kepada penyerahan bil asal, memberi Anda subsidi amaun tunai harian yang ditetapkan di dalam

Jadual untuk menyewa kenderaan yang serupa jenis dan kapasiti seperti Kenderaan Dinamakan daripada

syarikat sewa kereta berlesen, atau,

(b) pada opsyen Anda, bayar amaun tunai harian sebagaimana ditetapkan di dalam Jadual sebagai

belanja pengembaraan. untuk tempoh sehingga maksimum tujuh (7) hari.

Tetapi Kami tidak akan bayar Faedah ini

(a) jika Kenderaan Dinamakan tidak diinsuranskan di bawah polisi insurans Motor Komprehensif pada masa Kemalangan.

(b) jika Kenderaan Dinamakan tidak dipindahkan ke bengkel pembaik untuk pembaikan dalam masa empat puluh

lapan (48) jam selepas tarikh Kemalangan.

(c) untuk tiga (3) hari pertama Kenderaan Dinamakan menjalani pembaikan.

(d) jika, pada masa Kemalangan, Pemandu atau Anda sebagai pemandu Kenderaan Dinamakan tidak mempunyai

lesen memandu yang sah atau tidak layak untuk mempunyai atau memperolehi lesen demikian untuk memandu

kenderaan bawah mana-mana undang-undang, undang-undang kecil dan peraturan yang diwajibkan.

Apabila pembayaran tuntutan dibuat di bawah Seksyen ini, Faedah ini hendaklah secara automatik ditamatkan

melainkan dikembalikan semula melalui pembayaran lagi premium tambahan RM15.00 bersih.

SEKSYEN IV - PENGINAPAN HOTEL

Jika ketika Anda sedang mengembara di dalam Kenderaan Dinamakan, oleh kerana Kemalangan yang berlaku lebih

daripada 100 km dari tempat kediaman anda yang biasa, tidak dapat bergerak sama sekali dan diperlukan untuk

ditunda dengan serta merta ke bengkel pembaik yang diluluskan PIAM atau bengkel pembaik diluluskan oleh Kami

untuk pembaikan, Kami akan, tertakluk kepada penyerahan bil asal, membayar balik Anda untuk kos sebenar

tertanggung sehingga amaun tidak melebihi jumlah yang ditetapkan didalam jadual untuk tinggal semalaman di

hotel yang terletak di bandar yang terdekat kepada tempat Kemalangan.

Tetapi Kami tidak akan bayar Faedah jika Anda sebagai pemandu Kenderaan Dinamakan pada masa Kemalangan

tidak mempunyai iesen pemandu yang sah atau tidak layak untuk mempunyai atau memperolehi Iesen demikian

untuk memandu kenderaan di bawah mana-mana undang-undang, undang-undang kecil dan peraturan yang

diwajibkan.

Apabila pembayaran tuntutan dibuat di bawah Seksyen ini, Faedah ini hendaklah secara automatik ditamatkan

melainkan dikembalikan semula dengan pembayaran lagi premium tambahan RM15.00 bersih.

KECUALIAN AM - INI DIGUNA PAKAI KEPADA SELURUH POLISI

Polisi ini TIDAK diguna pakai:

1. kepada seseorang di bawah umur 15 hari dan melebihi umur 80 tahun.

2. kepada kehilangan disebabkan secara langsung atau secara tidak langsung, keseluruhannya atau sebahagian oleh

(a) jangkitan virus atau bakteria (kecuali jangkitan pyogenik yang berlaku melalui luka);

(b) sebarang jenis penyakit lain.

3. kepada melahirkan anak atau sebarang kecederaan anggota badan yang mengakibat hernia.

4. kepada membunuh diri atau percubaan membunuh diri (siuman atau taksiuman).

5. kepada keguguran melainkan disebabkan semata-mata dan secara langsung oleh Kemalangan kepada:

(a) Anda ketika mengembara di dalam Kenderaan Dinamakan atau sebarang kenderaan.

(b) Orang Diinsuranskan ketika mengembara di dalam Kenderaan Dinamakan.

6. ketika Kenderaan digunakan untuk sewa, berlumba, rali jalanan, mengatur gerak, ujian kelajuan atau digunakan

untuk sebarang tujuan berhubung dengan perdagangan motor atau digunakan untuk usaha perniagaan haram

sebagai pengangkutan umum tanpa Iesen atau sebarang kegiatan jenayah.

7. kepada Kemalangan berlaku di luar had wilayah Malaysia, Negara Thailand, Republik Singapura dan Negara Brunei Darussalam.

8. kepada tuntutan di bawah mana-mana Undang-Undang Pampasan Pekerja untuk ganti rugi diperolehi oleh

Penumpang terhadap Anda atau Pemandu Kenderaan Dinamakan kerana kecuaian, kemeluluan atau

ingkar.

9. kepada kehilangan disebabkan oleh perampasan, penyitaan, menyita atau rekuisisi oleh atau bawah

perintah mana-mana kerajaan atau pihak berkuasa awam atau tempatan.

10. kepada sebarang akibat langsung atau tidak langsung peperangan, serangan, tindakan musuh asing,

pertempuran (sama ada peperangan diisytiharkan atau tidak), mogok, rusuhan atau kekecohan awam,

peperangan saudara, pemberontakan, revolusi, insureksi atau kuasa tentera atau rampasan atau keadaan

pengepungan.

11. kepada sebarang tindakan pengganasan. Untuk tujuan ini tindakan pengganasan bermakna tindakan, termasuk

tetapi tidak terhad kepada penggunaan kekerasan atau keganasan dan/atau ugutannya, oleh seseorang atau

kumpulan orang, sama ada bertindak berseorangan atau bagi pihak atau berhubung dengan mana-mana

organisasi atau kerajaan, dilakukan untuk tujuan politik, agama, ideologi atau seumpamanya termasuk niat

mempengaruhi mana-mana kerajaan dan/atau meletakkan orang awam, atau mana-mana bahagian orang

awam, dalam ketakutan.

12. kehilangan secara langsung atau secara tidak langsung disebabkan oleh atau timbul daripada atau

disumbangkan oleh bahan senjata nuklear, sinaran pengionan atau pencemaran oleh keradioaktifan daripada

mana-mana bahan api nuklear atau daripada mana-mana sisa nuklear daripada pembakaran termasuk apa-

apa proses selenggara diri pembelahan nuklear bahan api nuklear.

SYARAT - INI DIGUNA PAKAI KEPADA SELURUH POLISI

1. Kewajipan PendedahanlFraud

Jika Anda gagal mendedahkan kepada Kami sepenuhnya dan jujur semua fakta yang Anda tahu atau sepatutnya

tahu, atau jika Anda memberi gambaran yang salah mana-mana fakta kepada Kami sebelum Polisi berkuat

kuasa, atau jika sebarang tuntutan dibuat fraud atau diperbesar-besarkan, Kami mungkin menghindari Polisi ini.

2. Pemindaan

Tiada pindaan di dalam Polisi ini sah melainkan Kami benarkan pindaan demikian melalui pengendorsan.

3. Membuat Tuntutan

(a) Semua tuntutan mesti dibuat melalui Anda dan sekiranya Anda meninggal dunia wakil diri sah Anda.

(b) Notis bertulis mesti diberi kepada Kami secepat mungkin atas apa-apa kecederaan yang tuntutan boleh timbul

dan, bagaimanapun, dalam masa tiga puluh (30) hari selepas kejadian kemalangan yang menyebabkan

kecederaan demikian. Sekiranya kematian tidak sengaja, notis segera mesti diberi kepada Kami. Tuntutan

tidak dinafikan atas alasan yang Anda atau Orang Diinsuranskan gagal memberitahu Kami dalam masa waktu

ditetapkan jika boleh ditunjukkan kepada kepuasan Kami bahawa ia tidak boleh dengan munasabah

memberi notis demikian dalam masa had waktu yang ditetapkan untuk sebaliknya tuntutan yang sah.

(c) Apabila menerima notis demikian Kami hendaklah memberi Anda borang tuntutan biasa Kami untuk

dipenuhkan memberi butir sepenuhnya kemalangan dan kecederaan dan, pada belanja anda sendiri,

kembalikan kepada Kami dengan laporan polis dan semua bil asal beserta dengan laporan lain atau bukti

lain yang Kami mungkin perlukan sewajarnya untuk mentaksir tuntutan itu.

(d) Kami hendaklah, pada belanja Kami sendiri, mempunyai hak dan peluang untuk menghendaki Orang

Diinsuranskan menjalani pemeriksaan perubatan semasa tempoh demikian sebagaimana Kami

mungkin memerlukan sewajarnya.

(e) Sekiranya berlaku kematian tidak sengaja, Kami hendaklah berhak pada belanja Kami sendiri

menjalankan pemeriksaan post mortem.

4. Pembayaran Faedah

Faedah Kematian yang patut diberi kepada Anda atau Orang Diinsuranskan hendaklah perlu dibayar kepada

wakil diri yang sah Anda atau Orang Diinsuranskan. Semua Faedah lain yang perlu dibayar hendaklah perlu

dibayar kepada Anda dan dalam hal mana- mana Orang Diinsuranskan perlu dibayar hanya dengan kelulusan

Anda dan secara langsung kepada Orang Diinsuranskan atau kepada wakil diri yang sahnya yang penerimaan

hendaklah dari segala segi menjadi pelepasan penuh dan berkesan kepada Kami.

5. Pembatalan

Anda boleh batalkan Polisi ini pada bila-bila masa dengan memberikan Kami notis secara bertulis dan, dengan

syarat bahawa tiada tuntutan dibuat sepanjang tempoh insurans semasa pada ketika itu. Kami akan, tertakluk

kepada penahanan Kami premium minimum RM50.00, membayar balik premium yang dibayar untuk tempoh

insurans yang belum habis dikira pada kadar jangka-pendek seperti berikut:

Kami juga boleh batalkan Polisi ini pada bila-bila masa dengan memberi Anda empat belas (14) hari notis

bertulis melalui surat berdaftar kepada alamat Anda yang terakhir diketahui dan Kami akan buat pembayaran

balik pro rata premium untuk sebarang tempoh insurans yang belum habis.

6. Timbang Tara

Di mana tuntutan telah diserahkan di bawah Poiisi ini dan ada perselisihan, perkara itu hendaklah dirujuk kepada

Penimbang Ta ra menurut peruntukan statutori semasa pada ketika itu. Jika ini berlaku, award mesti dibuat oleh

Penimbang Tara sebelum prosiding undang-undang boleh dimulakan.

7. Had Masa

Kami tidak akan bertanggung jawab membayar sebarang tuntutan selepas tamat tempoh dua belas (12) bulan

kalendar dari kejadian kemalangan melainkan tuntutan itu adalah perkara tindakan atau timbang tara yang masih

belum selesai.

8. Undang-Undang yang Diguna Pakai

Polisi ini dikawal oleh, dan hendaklah ditafsirkan menurut Undang-Undang Malaysia.

ATURCARA BANTUAN KECEMASAN KERETA

Polisi ini juga memberi anda hak kepada bantuan kecemasan kereta sebagaimana disediakan di bawah aturcara

yang Kami telah atur dengan Pembekal Bantuan Kecemasan. Faedah adalah hanya untuk Kenderaan Dinamakan

yang ditetapkan di dalam Jadual. Butir faedah termasuk terma, syarat dan kecualian diperincikan seperti berikut.

Notis Penting

Polisi Kemalangan Diri 'Easi-Drive' anda disediakan dengan Aturcara Bantuan Kecemasan Kereta (di dalam ini

dirujuk sebagai "CAP") dan skop perkhidmatannya berbeza dan bebas daripada skop lindungan yang disediakan

di bawah Polisi ini.

Perkhidmatan bawah CAP disediakan menurut dan tertakluk kepada perjanjian ditandatangani di antara Pembekal

Bantuan Kecemasan yang dinamakan di dalam Jadual Polisi (di dalam ini dirujuk sebagai "EAP") dan kami. Kami

punyai hak untuk menyemak, mengubah atau membatal mana-mana atau semua perkhidmatan yang disediakan di

bawah CAP pada bila-bila masa tanpa notis dibuat terlebih dahulu.

Had Wilayah

Perkhidmatan yang disediakan di bawah CAP hendaklah terdapat dalam Semenanjung Malaysia tidak termasuk

pulau kecuali untuk Penang, Langkawi dan Labuan. Sementara di Malaysia Timur, perkhidmatan hendaklah terdapat

di Kota Kinabalu, Sandakan, Tawau, Kuching, Bintulu dan Miri.

Skop Perkhidmatan

Hanya Kenderaan Dinamakan Anda sebagaimana diterangkan di dalam Jadual Polisi 'Easi-Drive' anda berhak

kepada perkhidmatan yang disediakan di bawah CAP. CAP menyediakan perkhidmatan berikut kepada Kenderaan

Dinamakan 24 jam sehari sepanjang tahun tetapi Polisi 'Easi-Drive' anda mesti berkuatkuasa dan perjanjian CAP

masih sah dan berkuat kuasa.

1. Tunda Kecemasan dan Pembaikan Kecil Di Tepi Jalan

Jika Kenderaan Dinamakan tidak boleh bergerak disebabkan kemaiangan atau kerosakan, pemandu atau

penumpang boleh menghubungi Pusat Kecemasan 24 jam EAP untuk bantuan segera.

Jika boleh membaiki Kenderaan Dinamakan tanpa bergerak dari tempat, EAP hendaklah menghantar mekanik

untuk khidmat pembaikan tepi jalan demikian dan EAP hendaklah bayar kos buruh. Tetapi EAP tidak

bertanggungjawab untuk apa-apa kos ditanggung untuk pembekalan apa-apa barang ganti Sekiranya tidak boleh

membaiki Kenderaan Dinamakan ditempat itu, EAP hendaklah mengatur dan bayar untuk penundaan Kenderaan

Dinamakan ke bengkel terdekat yang ada.

Amaun maksimum yang EAP bertanggungjawab membayar untuk menunda dan/atau kos buruh untuk

pembaikan tepi jalan tidak melebihi jumlah yang di tetapkan di dalum jadual setiap peristiwa.

2. Bantuan Penggantian Kereta

Jika Kenderaan Dinamakan tidak boleh bergerak oleh sebab kemalangan atau kerosakan dan pemandu dan/atau

penumpang memeriukan penggantian kereta, EAP hendaklah merujuk dan membantu pemandu dan/atau

penumbang bagi mengatur penyewaan kereta.

Kos penyewaan kereta hendaklah ditanggung oleh pemandu dan/atau penumpang.

3. Mengatur Penginapan Hotel

Jika Kenderaan Dinamakan tidak boleh bergerak oleh sebab kemalangan atau kerosakan dan pemandu dan/atau

penumpang memeriukan penginapan hotel, EAP hendaklah membantu pemandu dan/atau penumpang

mengatur penginapan hotel. Kos yang tertanggung untuk penginapan hotel demikian hendaklah ditanggung oleh

pemandu dan/atau penumpang.

4. Rujukan Kepada Pusat Servis

Pemandu dan/atau penumpang Kenderaan Dinamakan boleh menghubungi EAP untuk mengatur bagi rujukan

kepada pusat pembaikan dan servis yang terdekat dan temujanji terlebih dahulu untuk servis atau pembaikan

kereta. Semua kos tertanggung hendaklah ditanggung oleh pemandu dan/atau peumpang.

Kecualian

Keadaan yang berikut dikecualikan daripada aturcara ini:-

1. Perkhidmatan yang tidak diatur secara langsung oleh Asia Assistance Network (M) Sdn Bhd (AAN).

2. Perkhidmatan di luar mempunyai wilayah yang jelas

3. Pembaikan kos atau penggantian bahagian dan komponen di bengkel atau pusat servis

4. Bayaran petrol, tol, tambang teksi, penginapan dan telefon.

5. Apabila kunci kereta tidak tersedia atau terkunci di dalam Kenderaan Dinamakan.

6. Apabila Kenderaan Dinamakan tidak mempunyai bahagian mesin atau mekanikal.

7. Semasa penarik adalah dengan alasan untuk membuang Kenderaan Dinamakan. Apabila Kenderaan Dinamakan tidak mempunyai bahagian mesin atau mekanikal.

8. Tunda untuk kenderaan dinamakan dicuri atau kenderaan terbengkalai yang ditemui.

9. Semasa penarik adalah dengan alasan untuk memindahkan Kenderaan Dinamakan dari satu bengkel ke

bengkel yang lain.

10. Apabila tidak ada cakera cukai jalan yang sah yang dipaparkan di Kenderaan Dinamakan.

11. Tunda Kenderaan Dinamakan setelah dihantar untuk kerja penyemburan.

12. Kos perkhidmatan yang dilindungi oleh insurans tuntutan motor yang mana tuntutan akan dibuat (contoh: Kos penarik sekiranya berlaku kemalangan).

13. Bantuan penarik atau kerosakan akibat kejadian bencana atau Perbuatan Tuhan seperti gempa bumi, banjir

dan ribut angin.

14. Sekiranya Kenderaan Dinamakan telah atau telah dimodifikasi untuk penyertaan dalam perhimpunan atau perlumbaan, atau jika Kenderaan Dinamakan telah diubahsuai dengan peraturan pemerintah.

15. Kegagalan Anggota untuk mengambil langkah berjaga-jaga yang sewajarnya atau mengikuti amaran mengenai

sebarang mogok, rusuhan atau kekacauan yang dimaksudkan melalui media massa.

16. Apa-apa tindakan yang tidak sah atau menyalahi undang-undang oleh Anggota atau penggunaan Kenderaan Dinamakan untuk tujuan yang menyalahi undang-undang atau menyalahi undang-undang.

17. Menarik atau membaiki mana-mana motosikal dan Kenderaan Dinamakan komersial seperti tetapi tidak terhad

kepada lori, trak, gerabak, teksi dan lain-lain. AAN berhak untuk menolak bantuan dan penarik kenderaan tersebut.

18. Apabila penarik khas dan / atau peralatan khas diperlukan semasa menyediakan perkhidmatan penarik untuk

Kenderaan Dinamakan yang, dalam pilihan tunggal AAN, dianggap berisiko tinggi dan / atau tidak dapat dilaksanakan.

19. Apabila Kenderaan Dinamakan berada di permukaan jalan yang tidak berturap atau di jalan yang bukan jalan

yang diwartakan dari sistem jalan raya di Malaysia.

20. Apabila kenderaan Dinamakan berumur 10 tahun ke atas.

21. Apabila Kenderaan Dinamakan dipacu.

Fasal-Fasal yang berikut hendaklah terpakai bagi dan menjadi sebahagian daripada Polisi ini.

CUKAI KERAJAAN

Dimaklumkan bahawa Cukai Barangan dan Perkhidmatan (GST) telah dikuatkuasakan pada 1 April 2015. Kewajipan pembayaran GST pada kadar semasa GST membentuk sebahagian istilah dan syarat didalam polisi insurans ini.

HAD PENETAPAN DAN PENGECUALIAN (SANC)

Syarikat tidak dianggap telah menyediakan sebarang perlindungan insurans dan/atau tidak bertanggungjawab untuk

membayar sebarang tuntutan atau menyediakan sebarang manfaat berdasarkan Polisi ini, termasuk membuat

sebarang pembatalan atau pembayaran balik di bawah Polisi ini yang tidak terhad kepada peruntukan perlindungan

insurans tersebut dan/atau pembayaran tuntutan tersebut dan/atau peruntukan manfaat tersebut dan/atau membuat

pembayaran tersebut, yang akan mendedahkan Syarikat kepada sebarang penetapan, larangan atau sekatan di

bawah sebarang undang-undang dan/atau peraturan yang ditadbir mana-mana kerajaan atau pihak berkuasa yang

mengawal selia atau berkelayakan atau sebarang penguatkuasaan undang-undang dalam mana- mana negara.

SERVICE TAX REFUND (if applicable)

Section 21A of the Service Tax Act 1975 provides that no service tax refund (‘refund’) can be approved by the Director General of Custom & Excise unless an application in respect of the refund is made in the prescribed format within one year from date of occurrence of the event leading to the refund. Essentially, this would mean that no service tax can be refunded if it exceeds one year after the premium payment date. Hence, any changes to your policy that may result in the refund should be promptly notified to the Company at least 14 working days before the expiry of the policy so as to facilitate the Company to refund the same to you on a timely basis.

STATEMENT Pursuant to Schedule 9 of the Financial Services Act 2013

A 'consumer insurance contract' is a contract of insurance entered into, varied or renewed by an individual wholly for purposes unrelated to your trade, business or profession.

In relation to non-consumer insurance contracts STATEMENT pursuant to Paragraph 4, Schedule 9 of the Financial Services Act 2013, you are to disclose in this form any matter that: a) you know to be relevant to the decision of the insurer on whether to accept the risk or not and the rates and

terms to be applied; or b) a reasonable person in the circumstances could be expected to know to be relevant. This duty of

disclosure shall continue until the time the contract is entered into, varied or renewed.

In relation to consumer insurance contracts STATEMENT pursuant to Paragraph 5, Schedule 10 of the Financial Services Act 2013, you are under a duty

to take reasonable care not to make a misrepresentation when answering any specific questions that are relevant to the decision of the insurer on whether to accept the risk or not and the rates and terms to be applied. This duty of disclosure shall continue until the time the contract is entered into, varied or renewed.

The Insured shall read this Policy carefully, and if not error or misdescription be found herein, or if the cover be not in accordance with the wishes of the Insured, advice should at once be given to the Company and the Policy returned for attention.
