Sub : Adalath 2020 – Petition received from Sri. Biju Kuriakose, Kuruppampadi – shifting of electric line passing through his property.

Resolved to accord sanction to the Deputy Chief Engineer, Electrical Circle, Perumbavoor for resolving the issue of dismantling of LT line passing through the property of Sri. Biju Kuriakose as follows, since it is reported that there is no legal issues involved in this proposal.

1. By installing a 25kVA transformer in the existing Odakkali feeder and converting 0.279 kms of LT single phase line to 3 phase 4 wire line and thereby strengthening the LT network, on collecting 75% of the cost of the work (balance 25% to he met by KSEBL), considering that the petition was received in Adalath 2020 and that the proposal is beneficial to KSEBL and the issue has been remaining contentious for a long time.

2. The line passing through the property of Sri. Biju Kuriakose shall be dismantled on remittance of dismantling cost, under deposit work scheme, after the completion of the above work.

Resolved to review the earlier decision for not permitting cable drawal along the KSEBL poles and to authorize the Deputy Chief Engineers of Electrical Circles to consider the requests received for drawing cables along electric poles of KSEBL subject to the following conditions.

i) An undertaking in Stamp Paper worth Rs.200/- is to be executed stating their willingness to remit the pole rentals which is to be

fixed by KSEB Ltd. w.e.f 01.04.2021 and to follow the terms and conditions as fixed by KSEBL for drawing of cables along its electric poles, from time to time.

ii) Sanction shall be issued after reviewing the reports from the field Offices on feasibility and safety aspects of drawing new cables along the requested routes.

iii) The sanction shall be for a maximum period of 1 year from the date of sanction or till the Cable TV Operators migrate to K-FON whichever is earlier.

iv) Pole rental shall be paid in advance for the sanctioned period at the rates for the financial year 2020-21, as per the B.O. under ref (4) and its revision from time to time.

v) Terms and conditions as applicable as per B.O. dated 16.9.2020.

Further resolved to accord in principle sanction to the Deputy Chief Engineers of Electrical Circles for processing the new cable drawaI requests for obtaining sanction from the Board subject to the above conditions.

Further resolved to direct all Cable TV Operators to remove unused cables at the earliest.

Further resolved to conduct a detailed technical study by a team to ascertain the exact number of cables which can be safely drawn through PSC Poles in the wake of introduction of KFON.

Further resolved that the Committee may analyze the matter on case to case basis for clearing the pole rental arrears in line with the recent Adalath and OTS guidelines, conducting personal hearings wherever required. All the pending cases may be settled at Circle level on or before 31.03.2021. Cases calling for policy decisions may be taken up with the Director (Distribution, IT & HRM).

Further resolved to inform the settlement authorities under the OTS-2021 that no revision in the principal amount may be taken in Clause b&c of Annexure-2 (Guidelines for settling arrears entangled in Court cases) of Office Order dated 15.02.2021, in view of the general approach taken by the KSERC in the Order dated 11.02.2021.

Further resolved to clarify that no other interest rate than the rates for age wise category as approved by the Hon'ble Commission in the OTS-2021 Scheme be applied as part of settlement.

Further resolved that an agreement including the location of project, period of project, validity, right of KSEBL on the contents and the area occupied for Safety Slogans and area for advertisement of project shall be executed with M/s. TRACO Cables Company Ltd. by concerned Chief Engineers.
