SPECIAL CONDITION

1. Delivery Schedule : Early delivery required.2. Eligibility criteria: As per clause no. 5.10 of DLW Purchase Specification no. MISC-328 Rev. 2 [Feb. 2016]3. RATES MUST BE QUOTED IN WORDS AND FIGURES BOTH.4. The rate submitted in the offer should be valid for minimum 120 days from the date of opening of tender.5. In case you have quoted Excise duty, Sale tax, Service tax, or any other levy, Please confirm whether

statutory variation will be applicable for these levies.6. Evaluation criteria: In all such cases where more than one item is tendered, inter-se ranking of the offers shall

be decided item wise.7. Break-up of rate including basic rate, applicable taxes and freight charges should invariably be quoted

separately.8. Performance statement should invariably be given alongwith the offer indicating D.L.W. purchase order Nos.

details of supply and rejections if any etc.9. In case you have not supplied this item to D.L.W. in the past please enclosed detail of supplies of similar

items made to other organisations and also list of M and P and quality control equipment available at yourwork.

10. Have you submitted authenticated copy of the document authorizing the signatory to submit offer and commiton behalf of tenderers.

11. Tenderes are requested to mention contact person, Designation, Telephone No.(Residence & Office),Fax No.and E-Mail address alongwith their offer to enable to update the progress of supplies againstcontract/purchase order.

12. Indian agent of firm may submit their offer in Indian Rupees alongwith tender specific authorization fromOEM.

13. The material should be packed suitably to protect against damage deterioration during transit & storage. Thepacking material should be Eco-friendly. The returnable packing will be encouraged but for that the firmshould clearly mention in its offer ifse

14. Wherever all or most of the approved firm quote equal rates and cartel formation is suspected,Railwayreserve the right to place order on one or more firms with exclusion of the rest without assigning any reasonsthereof.

15. A)RISK IN TRANSIT :In all cases of road transport,the suppliers are advised to arrange insurance withTransport co.,since risk in transit/transport will be on contractors accounts.

16. Discounts with conditions attached such as discounts having linkages to quantity, early payment, earlyreceipt Notes etc. will not be considered for evaluation purpose. Thus discounted rates, linked to quantitiesand prompt payment etc. will be ignored.

17. All the offers will be arranged in ascending order of the all in cost.18. The purchaser reserves the right to split the tender quantity among two or more tenderers at its descretion for

reasons like vital/critical nature of items, quantity to be procured, past performance and capacity of thebidders, delivery required etc.

19. Risk purchase period for this item will be nine months from the date of breach of contract.As provided in para0702(B) IRS condition of contract.

20. If discrepant documents are received and discrepancy/ies is/are reported to DLW, the exchange ratevariation on higher side, if any will be on firm’s account.

21. In case the successful tenderer is not liable to be registered under CGST/IGST/UTGST/SGST Act. TheRailway shall deduct the applicable GST from his/their bills under reverse chargemechanism [RCM] and deposit the same to the concerned tax authority.

22. Do you agree to supply the tendered stores at the rates quoted by you in accordance with the Tendercondition, Special tender conditions [if any] and IRS Conditions of Contract.

23. If you are not a MSE or a consortia of MSEs formed by NSIC, please indicate percentage of sub contracts inexecution of this tender that will be from Micro and Small Enterprise [in per cent oforder value] with further breakup of MSE owned by SC/ST. [Information will be provided in per cent termswith 6 fields, Micro owned by SC, Micro owned by ST, Micro owned by Others,Small industry owned by SC, Small industry owned by ST, Small industry owned by Others]

Bidder may please note that the purchaser shall be entitled to increase theordered quantity by 30 per cent with respect to tendered quantity at the time of ordering itself and thetenderer shall be bound to accept the quantity so ordered on the basis of his originaloffer.The purchaser shall be entitled to exercise plus 30 per cent option in one or more than one instalmentas long as the total variation in quantity does not exceed the limit of 30 per cent ofordered quantity.

37. New sources found technically suitable in the range of consideration as per their ranking may be consideredfor a small quantity developmental order as per Latest DLW office order no. 109/2017 Dtd. 17.06.2017attached with this tender.
