California Public Utilities Commission Daily Calendar Tuesday, November 29, 2005

Copies of tendered notices are available in the Central Files Office for review and/or reproduction under existing procedures. They are also available from the filing party who is under the obligation to provide copies of the notice without delay.

11/22/05 A04-06-030 City of Petaluma, for an order authorizing the relocation of one at-grade crossing of the tracks of the Sonoma Marin Area Rail Transit District in the City of Petaluma, County of Sonoma.

Summary: On November 22, 205, David Glass, Mayor of the City of Petaluma (City), met with Kelly Hymes, advisor to Cmmr. Grueneich, in San Francisco. Also present were Jose E. Guzman, Jr., special counsel to the City, and Paul Andronico, an attorney for Basin Street Properties. Written material (attached to the notice) was used. Mayor Glass stated that the two conditions imposed on approval of the proposed Caulfield Lane crossing by the ALJ’s proposed decision would effectively prohibit much if not all development contemplated by the Central Petaluma Specific Plan (CPSP). Andronico indicated that the current plans called for Basin Street development in the Lower Reach to be forty percent of what had been studied in the final environmental impact report. Guzman stated that it made little sense for the City to completely lose the authority for the Caulfield Lane crossing simply because SMART began to run one train or even two dozen trains on the SMART railroad tracks. Guzman stated that he did not understand how the Commission could approve at-grade crossings for MTA and VTA with large train and vehicle volumes without any conditions on the continued use of such at-grade crossings, but require the City to close the Caulfield Lane crossing immediately upon the commencement of any level of train traffic by SMART on the railroad line.Filer: City of PetalumaContact: Jeannie Wong Phone: (415) 398-3600

Also present were Dexter Khoury of the Office of Ratepayer Advocates, Jody London on behalf of the City of Chula Vista, and Norman Furuta on behalf of the Federal Executive Agencies. Furuta stated that the FEA objects to the modification the PD imposes on the all party settlement with regard to the Total Rate Adjustment Component. Furuta stated that if the PD adopted as currently drafted, FEA would withdraw from the Settlement Agreement and demand hearing on all issues covered by the Agreement. On behalf of the Alliance for the Retail Energy Markets (AReM), Furuta stated that AReM would also withdraw from the settlement agreement if the PD were adopted as drafted. Furuta urged that the all party settlement agreement be adopted without modification.Filer: Federal Executive AgenciesContact: Norman Furuta Phone: (650) 746-7312

11/23/05 R03-10-003 Order Instituting Rulemaking to Implement Portions of AB117 concerning Community Choice Aggregation.

Summary: On November 22, 2005, Billy Blattner, CPUC Relations Manager, San Diego Gas and Electric Company (SDG&E), met with Rami Kahlon, advisor to Cmmr. Peevey, in San Francisco. Blattner stated that SDG&E supports Community Choice Aggregation (CCA), but is concerned that language in the Proposed Decision (PD) creates constitutional issues. Specifically, Blattner suggested that PD use the ‘billing process’ language of AB 117. Blattner noted that this should be a mutually beneficial outcome for utilities and community choice aggregators. Blattner also suggested that the marketing prohibition be clarified so that ordinary utility-customer communications that are unrelated to CCA activities are not captured.Filer: San Diego Gas & Electric CompanyContact: Renee Le Camus Phone: (415) 202-9986
