ORDINANCE NO. _____________ AN ORDINANCE OF THE CITY OF BRYAN, TEXAS, AMENDING THE CITY OF BRYAN’S THOROUGHFARE PLAN, BEING FIGURE 22 OF THE CITY OF BRYAN COMPREHENSIVE PLAN (BLUEPRINT 2040), SPECIFICALLY AMENDING MULTIPLE ROADWAY ALIGNMENTS AND CLASSIFICATIONS IN ORDER TO MATCH MPO THOROUGHFARE PLAN AND FUTURE DEVELOPMENT; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; FINDING AND DETERMINING THAT THE MEETING AT WHICH SAID ORDINANCE IS PASSED IS OPEN TO THE PUBLIC AS REQUIRED BY LAW; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Texas Local Government Code, Section 213.002, authorizes municipalities to adopt a comprehensive plan for the long-range development of the municipality; and WHEREAS, the City of Bryan adopted a new Comprehensive Plan (BluePrint 2040) with the adoption of City Council Ordinance No. 2178. on October 25, 2016; and WHEREAS, Figure 22 of said Comprehensive Plan is the City of Bryan Thoroughfare Plan that provides a long-term vision of the major street network necessary to meet the future travel needs of the residents of the City of Bryan and the surrounding area; and WHEREAS, the citizens of Bryan require a transportation system that provides mobility in the face of ever-increasing population and traffic; and WHEREAS, the City of Bryan Thoroughfare Plan must be amended periodically to adapt to new patterns of development and changes in existing or expected traffic conditions; and WHEREAS, as development patterns progress and conditions change over time, there becomes a need to adjust the current alignment of proposed thoroughfares shown on the City of Bryan Thoroughfare Plan, to allow for better traffic flow and future development; and WHEREAS, the Bryan Planning and Zoning Commission during its regular meeting on March 7, 2019 recommended approving an amendment to the City of Bryan’s Thoroughfare Plan, specifically to amend multiple roadway alignments and classifications in order to match MPO Thoroughfare Plan and future development.; and NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BRYAN, TEXAS: Section 1. That the City of Bryan Thoroughfare Plan, being Figure 22 of the City of Bryan Comprehensive Plan (BluePrint 2040), adopted by City Council Ordinance No. 2178 on October 25, 2016, is hereby amending multiple roadway alignments and classifications in order to match MPO Thoroughfare Plan and future development., as described and depicted in attached Exhibit “A” and made a part hereof. Section 2. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed to the extent of such conflict.

WHEREAS, Texas Local Government Code, Section 213.002, authorizes municipalities to adopt a comprehensive plan for the long-range development of the municipality; and

BRYAN, TEXAS:

Section 1.

That the City of Bryan Thoroughfare Plan, being Figure 22 of the City of Bryan Comprehensive Plan (BluePrint 2040), adopted by City Council Ordinance No. 2178 on October 25, 2016, is hereby amending multiple roadway alignments and classifications in order to match MPO Thoroughfare Plan and future development., as described and depicted in attached Exhibit “A” and made a part hereof.

Section 2.

That all ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby

repealed to the extent of such conflict.

Section 3.

The City of Bryan Thoroughfare Plan, as amended, shall remain in full force and effect, save and except as amended by this ordinance.

Section 4.

If any section, paragraph, sentence, clause, phrase or word of this ordinance is declared unconstitutional or invalid for any purpose, the remainder of this ordinance shall not be affected thereby and to this end the provisions of this ordinance are declared to be severable.

Section 5.

It is hereby found and determined that the meeting at which this ordinance was passed was open to

the public, as required by Section 551.001, et seq., of the Texas Government Code, and that advance public notice of the time, place and purpose of said meeting was given.

Section 6.

This ordinance shall take effect immediately upon its first and only reading and passage.

PASSED, ADOPTED AND APPROVED the 9th day of April, 2019, at a regular meeting of the City Council of the City of Bryan, Texas, by a vote of ___ yeses and ___ noes.

EXCERPT FROM PLANNING AND ZONING COMMISSION REGULAR MEETING MINUTES OF MARCH 7, 2019: 6. PROPOSED AMENDMENTS TO THE CITY OF BRYAN’S THOROUGHFARE PLAN – A

PUBLIC HEARING WILL BE HELD FOR EACH ITEM (Commission makes recommendation; City Council has final approval). a. Comprehensive Plan Amendment CPA19-01: City of Bryan

A proposal to amend the City of Bryan's Thoroughfare Plan in order to remain consistent with the Metropolitan Planning Organization (MPO) Thoroughfare Plan, as well as realign certain thoroughfares in order to make room for new development. (K. Williams) Mr. Kaspar presented the staff report (on file in the Development Services Department). Staff recommends approval of the proposed amendment. Mr. Leeper clarified that the Commission could recommend approval of all proposed amendments except those affecting Milagro Drive, and staff could then present a separate amendment specifically regarding Milagro Drive at a future meeting of the Commission. The public hearing was opened. Mr. Joel Mitchell, 3204 Earl Rudder Fwy, College Station, TX, came forward to express concern regarding the proposed amendments affecting Milagro Drive, and requested that consideration of those changes be postponed to a future meeting of the Commission. The public hearing was closed. Commissioner Beckendorf moved to recommend approval of Comprehensive Plan Amendment CPA19-01 to the Bryan City Council, with the exception of taking no action on the thoroughfare amendment affecting Milagro Drive, and to adopt the written staff report and analysis, as the report, findings and evaluation of the Commission. Commissioner Rodriguez seconded the motion. Commissioners thanked citizens for expressing their concerns, and commented that they look forward to a solution for Milagro Drive that benefits adjacent property owners and the City of Bryan. The motion passed unanimously.

the City of Bryan’s Thoroughfare Plan, specifically to match the MPO Thoroughfare Plan and future development.

SUMMARY RECOMMENDATION: Staff recommends approving this Comprehensive Plan Amendment.

BACKGROUND: The Texas Local Government Code requires that cities wishing to govern land use within their corporate limits do so in accordance with a Comprehensive Plan. The most recent update to Bryan’s Comprehensive Plan was adopted in October 25, 2016 (BluePrint 2040). It is in the context of this plan that zoning ordinances and other development regulations have legal standing. Among other things, the Comprehensive Plan assesses the growth that Bryan has experienced and estimates the likely growth that the City will have to manage in the future. BluePrint 2040 provides a vision to guide Bryan’s growth and development in the near term and for years to come.

BluePrint 2040 Chapter 6, Transportation, identifies the need to provide an efficient, functional, and multimodal transportation network that supports a wide range of mobility needs in the City of Bryan. The first objective in the process of achieving that goal is the development of a unified thoroughfare system linked to land use. According to the BluePrint 2040, three actions are crucial to the accomplishment of that objective:

Ensure that the transportation network and land use objectives are effectively coordinated. Utilize the Thoroughfare Plan and Future Land Use Plan during the subdivision and site

development review process to ensure that the provisions for adequate roadway infrastructure are secured.

Continue to refine the extensions of thoroughfares in targeted growth areas.

The City’s Thoroughfare Plan, a long-range plan that identifies the location and type of roadway facilities that are needed to meet the projected long-term growth of the community, is included in BluePrint 2040 as Figure 22 on page 201. A current and accurate plan is essential to the planning process, and the last time an amendment was made to the Thoroughfare Plan was the summer of 2018. Designations for the roadway sizes are shown in the legend below.

In 2016 the Brazos Valley Metropolitan Planning Organization (MPO) began discussions on creating a comprehensive thoroughfare plan for the region. The Technical Advisory Committee and MPO staff created this regional plan with heavy input from Bryan and College Station City staff. During this process, there were 10 public meetings and 2 follow-up meetings showing the final product. A majority of the public input was received through those meetings and the changes that they proposed were accommodated where possible prior to the MPO’s Thoroughfare Plan being adopted in June of 2017. In order to remain consistent with the MPO’s Regional Thoroughfare Plan, and to provide favorable conditions for new private development, staff recommends amending the City of Bryan Thoroughfare Plan. Acting on behalf of the public, only the City Council is authorized to officially amend the City of Bryan’s Thoroughfare Plan through a Comprehensive Plan amendment. The Planning and Zoning Commission hears and makes a recommendation on proposals to amend the Thoroughfare Plan.

ANALYSIS: As development patterns progress and conditions change over time, plan amendments similar to the one proposed will refine the level of detail in a specific area and will ultimately result in improved opportunities for orderly development. Staff contends that the proposed plan amendment will serve to minimize confusion for residents and developers by minimizing the differences between the City of Bryan, College Station, and MPO Thoroughfare Plans while making BluePrint 2040 a more useable and common sense planning tool.

Autumn Lakes Drive: staff finds that in order to match the MPO Thoroughfare Plan, the alignment of Autumn Lakes Drive from Viva Road to a proposed major collector must be adjusted to avoid bisecting the future Jenkins RV Resort.

Milagro Drive (proposed): staff finds that in order to create a more practical alignment with better creek crossings, a straighter roadway, and alignment with the Alamosa Springs subdivision, Milagro Drive must be realigned.

Viva Road: staff finds that in order to preserve buildable land for future development, the alignment of Viva Road must be adjusted.

North Thornberry Drive (proposed): staff finds that in order to improve alignment and connectivity, the alignment of the proposed North Thornberry Drive extension must be adjusted.

Proposed Super Arterial: staff finds that in order to match the MPO Thoroughfare Plan, the proposed super arterial east of Highway 6 must be realigned.

Proposed Minor Arterial: staff finds that in order to match the MPO Thoroughfare Plan, the proposed minor arterial, which would run through the City of Bryan’s ETJ, must be reduced so as to end at the proposed Steep Hollow Road extension.

Proposed Freeway: staff finds that in order to match the MPO Thoroughfare Plan, the proposed freeway, which would run through the City of Bryan’s ETJ, must extend to FM 2038 at its

intersection with State Highway 30. The proposed freeway would then be downgraded to major arterial starting at State Highway 30 and heading north.

Proposed Major Arterial: staff finds that in order to match the MPO Thoroughfare Plan, the proposed freeway, which would run through the City’s ETJ, must be downgraded from freeway to major arterial.

FM 2038: staff finds that in order to match the MPO Thoroughfare Plan, FM 2038 should be upgraded from a major arterial to a freeway. Staff finds that FM 2038 meets the criteria to be classified as a freeway.

Steep Hollow Road: staff finds that in order to match the MPO Thoroughfare Plan, Steep Hollow Road must be reduced so as to end at the proposed freeway in the City’s ETJ.

Broach Road: staff finds that in order to match the MPO Thoroughfare Plan, Broach Road must be realigned to connect with existing roadways.

Proposed Major Arterial: staff finds that in order to match the MPO Thoroughfare Plan, the proposed major arterial, which would run west to east in the City’s ETJ, should be realigned to match existing roadways.

FM 974: staff finds that FM 974 should be upgraded from major collector to minor arterial. Staff finds that this stretch of FM 974 meets the criteria to be classified as a minor arterial.

Dilly Shaw Tap Road: staff finds that in order to match the MPO Thoroughfare Plan, Dilly Shaw Tap Road should be realigned.

Proposed Major Collector: staff finds that in order to better align with proposed development and eliminate additional creek crossing, the proposed major collector should be realigned.

RECOMMENDATION: Staff recommends approving the proposed amendments to the City of Bryan’s Thoroughfare Plan, as presented in order to:
