A regular session of Troy City Counci l was held Tuesday, January 20, 2015, at 7:00 p.m. in Council Chambers.

INVOCATION : The meeting began with the Pledge of Allegiance led by Boy Scouts from Troops 365 and 1030.An invocation was given by Mr. Kendall.
PUBLIC HEARING. At 7:02 p.m., Mrs. Baker declared open a public hearing on Ordinance No . 0-1-2015,changing the zoning of 40 parcels from M-2, Light Industrial District to OC-1, Office Commercial District. This isthe property that had been the location of the Hobart Brothers/ITW factory on West Main Street and parking lotson Adams Street. There were no comments in this regard, and at 7:03 p .m . Mrs . Baker declared this publichearing closed.
MINUTES : The Clerk gave a summary of the minutes of the January 5 , 2015, meeting of Troy City Council.There were no corrections or additions to these minutes . A motion was made by Mr . Clark, seconded by Mr.Phillips, to approve these minutes. Motion passed by unanimous roll call vote.
COMMITTEE REPORTS:Personnel Committee: Mr. Clark, Chairman, gave an oral report regarding the Mayor's appointments to Boardswhich require the approval of Council. A motion was made by Mr . Clark, seconded by Mr . Schweser, toapprove the reappointment of Russ Thayer to the Economic Development Revolving Loan Fund Committee fora new term ending 12-31-2018. Motion passed by unanimous roll call vote .
A motion was made by Mr. Clark, seconded by Mr . Twiss, to approve the reappointment of Roy Carlson andthe appointment of Jordan Romberger to the Enterprise Zone Tax Incentive Review Council for terms ending
10-31-2017. Motion passed by unanimous roll call vote .
Recreation & Parks Committee: Mr. Heath, Chairman, reported as follows:1. Committee recommends legislation be prepared authorizing the Board of Park Commissioners to
execute the addendum to the lease of the property known as the Barn in the Park to allow the Troy CivicTheater, Inc. the use of additional public property on which a shed structure will be placed.
2 . Committee recommends legislation be prepared authorizing the Director of Public Service and Safety toenter into an agreement regarding the Troy Strawberry Festival to be held within the levee area, thedowntown, the Market Street Bridge, and the ball field parking lot during 2015, and that the HobartArena/Stadium parking areas be used for the Friday Night Events . The City will be paid $14, 150 inadvance, which is the estimated City overtime cost for the 2015 fest ival in excess of the $56 ,000average of the City's costs over the prior five years .

CITIZEN COMMENTS:-Cynthia Scheafer, 26 N. Short Street, commented that she thinks the festival plans are very good, suggestedthere be tables and chairs at the corner of Staunton Road and N. Market Street to enjoy the music from the carshow, and she would like to see non-service dogs prohibited .-Deborah Char, 1519 Surrey Road, asked for an explanation regarding prohibited activities during the
Strawberry Festival, and asked what has been done regarding the materials for the shed next to the Barn in thePark) and maintaining it.Mr. Titterington responded that all Strawberry Festival prohibitions are covered in the legislation and includesale of wares by those not associated with the festival, weapons, non-service animals, and chalking/marking,etc . of public streets and public areas. Regarding the shed, all issues of maintenance and color are covered inthe addendum to the Lease Agreement.

COMMENTS OF THE DIRECTOR OF PUBLIC SERVICE AND SAFETY : Mr. Titterington commented asfollows :-The new parking kiosk in the S . Cherry Street parking lot became operational this date and the signage is beingupdated.-This date there was a non-fatal officer involved shooting: Officer Short responded to a welfare check call; therewas an altercation; the other party was taken to Miami Valley Hospital; in accordance with policy , the officer ison paid administrative leave; and the situation is being investigated.
COMMENTS OF THE PRESIDENT OF COUNCIL:-Mrs. Baker asked for the number of locations from which the siren warning system can be set off.-Mrs . Baker congratulated the firefighters involved in the recent rescue o a dog from the Miami River; stated herappreciation for the City crews doing an excellent job of clearing the streets after a weather event; and thankedthose who participated in the Martin Luther King walk and ceremony on January 19.
COMMENTS OF COUNCIL:-Mrs . Oda asked that lights be left on the trees downtown around the Public Square as a trial, noting that thelights are still up and that she feels the lighting enhances the town and would be beautiful even in the summer.Mr. Tremblay said he understands the lights do remain through Valentine's Day , but believes that as the leavescome out the lights would be more harmful to the trees.Mr. Titterington explained issues with leaving the lights on the trees longer: due to vandalism and weatherconditions the lights require almost daily maintenance and repair; the workload and priorities of the electricalstaff will soon make it very difficult to attend to the on-going maintenance and repair; the lights are considereddisposable and are, therefore, not long-lasting; with the vandalism and the lights burning out, the look would notbe consistent; the downtown ginkgo trees are rapid growth trees with a narrow root system and the trees couldstart to grow around the wires , girdling them into the bark; and the City's Park Superintendent/arborist hasstated his concern regarding the damage to the trees that could likely result from leaving the lights in place.Mrs. Oda stated her disappointment.-In response to Mr. Clark regarding an update on the placement of the lighthouse, Mr. Titterington advised that itis at the manufacturer and is being painted, and the plan is to install the lighthouse structure once the winterweather is over.
CITIZEN COMMENTS:-Lester Conard, 1210 S . Clay Street, commented he has a better understanding of the assessment for grassmowing (imposed only when the City has to mow a property that is in violation of property maintenance codes)and he believes the 100 administrative fee and other fees charged by the City have been established becausethe City needs more revenue to pay debt payments. He suggested the City should not seek comparable costsfrom other communities, but try to run the City on smaller revenue amounts. Mr. Conard also commented thatCity crews piled snow up on Surry Road at a street crossing, and children had to climb over piles of snow whenwalking to school.-Debbie Char, owner of the downtown Bulk Barn and Deli, commented regarding : she does not believe the Cityis properly cleaning and maintaining parking lots after a snow and ice event, as people fell in the S. CherryStreet lot , while the City is reminding property owners that they must keep sidewalks safe and free of snow andice; with the removal of the parking blocks from the S. Cherry Street lot, drivers slid into the grass area due tothe ice; people also fell downtown where snow and ice was piled into parking spaces; there are not sufficientparking spaces downtown with only about 120 spaces available in six off street parking lots and on streetparking quickly filling; the City should follow recommendations of prior parking studies and work with the Countyto build a parking garage; and she feels some issues still need to be worked out regarding the kiosk in the S.Ch S l

Thatrecommendation is that the 40 parcels that make up the site at and adjacent to 600 W. Main Street, known as theformer Hobart Brothers/ITW factory site and two parking lots, be rezoned from M-2, Light Industrial District, to OC-1,Office-Commercial District. The OC-1 zoning would complement the commercial district and respect the nearby
residential uses. DETAILED REPORT:This Committee met on January 27 2015 to review the recommendation from the Troy Planning Commission that 40parcels that make up the site at and adjacent to 600 W. Main Street, known as the former Hobart Brothers/ITW factorysite and two parking lots, be rezoned from M-2, Light Industrial District, to OC-1, Office-Commercial District. TheCommittee Meeting was also attended by Council President Baker, Council Member Tremblay, the City Auditor, theDirector of Public Service and Safety, and members of the City staff.
The owner of the property is the Hobart Brothers Company and the City of Troy is the applicant for the rezoning.Ten parcels are located along North Elm Street (between Washington Street and West Water Street), five parcelsare located along the intersection of West Water Street and Adams Street, and 25 parcels encompass the 600West Main Street location. The factory building that had been on most of the property has been demolished. Theparcels have not been replatted. Council held a public hearing on the proposed rezoning at the January 20meeting, and no comments were made opposing the rezoning.

From a business standpoint, the study would address the economic impact and financialfeasibility o a second sheet of ice. Funds for such study were included in the 2015 budget in recognition of thesupport a second sheet of ice received during discussions related to the Riverfront Development ProjecUHobartArena portion of the project.

Committee members Tremblay and Heath met January 27 2015 to consider recommending a professional servicesagreement with Crossroads Consulting Services of Tampa, Florida to perform a feasibility study related to a secondsheet o ice for the Hobart Arena . This meeting was also attended by Council President Baker, the City Auditor, theDirector of Public Service and Safety, the President of the Troy Recreation Board, and a member of the City staff .
Last year, when the Riverfront Development Project was being considered, a recommendation included in thereport of the Committee of the Whole was that based on the interest in the stand-alone second sheet o ice option,the 2015 budget include funds related to a feas ibility study and a study of the economic impact such a facility couldbring to the Troy community, as well as exploring partnerships to fund such a facility.
50,000 was included in the 2015 Hobart Arena Budget for that feasibility study. The Recreation Director hasrecommended that the firm of Crossroads Consulting Services of Tampa, Florida be authorized to perform thefeasibility study . This is the firm that Council authorized to perform the Hobart Arena Study at the end o 2013 andas a part of the study, already has some information relating to a second sheet of ice. At the January 21 meeting ofthe Recreation Board, the Board supported the recommendation o the Recreation Director and approved a motionthat the Recreation Board recommends that Troy City Council authorize the Board to enter into a professional

REPORT OF THE PLANNING COMMISSION ON A REZONING APPLICATION - 600 WEST MAINSTREET 40 PARCELS TOTAL) FROM TO M-2 LIGHT-INDUSTRIAL DISTRICT, TO OC-1, OFFICE-COMMERCIAL DISTRICT; THE AREA PROPOSED TO BE REZONED CONSISTS OF TEN PARCELSLOCATED ALONG NORTH ELM STREET BETWEEN WASHINGTON STREET AND WEST WATERSTREET , FIVE PARCELS LOCATED ALONG THE INTERSECTION OF WEST WATER STREET AND
ADAMS STREET, AND 25 PARCELS THAT ENCOMPASS THE 600 WEST MAIN STREET LOCATION.
On December 10, 2014, the Troy Planning Commission considered the rezoning of 40 parcels that make up theformer ITW/Hobart Brothers site, with the general address of 600 West Main Street, from the zoning of M-2, LightIndustrial District, to the zoning of OC-1 Office-Commercial District. The owner of the property is the HobartBrothers Company; the City of Troy is the applicant.
Ten parcels are located along North Elm Street (between Washington Street and West Water Street), five parcels
are located along the intersection of West Water Street and Adams Street, and 25 parcels encompass the 600West Main Street location.
The Commission had received a report of City staff, which was reviewed as part of the meeting discussion. Acopy of the packet provided to the Commission is attached.
It was commented at the meeting that the City reached out to the property owner for a rezoning of the area thatwill complement the commercial district and respect the nearby residential uses. Staff reviewed with the
Commission that the proposed OC-1 Office-Commercial District zoning will fit best into this mixed use area, as OC-1 zoning is designed to accommodate a mixture of office and commercial uses consisting of groupings ofprofessional type uses and the district is designed and intended to act as a buffer and is intended to be mappedalong major thoroughfares as a transitional area between nonresidential and residential uses. The OC-1 zoningdoes not permit residential development in this district; however, it does allow residential uses on the secondstory or above. Further, the OC-1 district limits commercial uses that are envisioned to prevent disruption to the

The Planning Commission determined not to hold a public hearing on this rezoning application.
By unanimous vote, the Troy Planning Commission recommends to Troy City Council th t the rezoning requestidentified as 600 West Main Street (40 parcels total) from to M-2, Light-Industrial District, to OC-1 OfficeCommercial District, be approved, based on the findings of staff that:
o The proposed rezoning is consistent with the Zoning Code s intent to separate incompatible land uses;o The proposed rezoning will complement the existing commercial zoning districts and provide flexibility for

A list of the parcels, as well as, a maphighlighting the parcels of the proposed rezoning has been attached to this report.
The area of the rezoning is broken into 10 parcels located along North Elm Street(between Washington Street and West Water Street), five parcels along the intersectionof West Water Street and Adams Street, and 25 parcels that encompass the 600 WestMain Street location.
The surrounding zoning districts include B-2 General Business District to the south, amixture of B-2 General Business District and R-7 Multi-Family to the east, R-6 TwoFamily Residential to the west, and M-2 Light-Industrial to the north.
DISCUSSION
The razing of the old Hobart Brothers building has left an opportunity for redevelopment
in the heart of our community. This area was once dominated y industrial uses but hassince grown into a mixture of commercial and residential uses. The City has reached outto the property owner for a rezoning of the area that will complement the commercialdistrict and respect the nearby residential uses. A rezoning from the M-2 Light-Industrialdistrict to the OC-1 Office-Commercial district will fit harmoniously into this mixed usearea.
The Zoning Code describes the OC-1 Office-Commercial district as designed toaccommodate a mixture of office and commercial uses consisting of groupings ofprofessional, research, executive, administrative, accounting, clerical, stenographic andsimilar uses. This district is designed and intended to act as a buffer and is intended to
e mapped along major thoroughfares as a transitional area between nonresidential andresidential uses. The OC-1 district does not permit residential development in thisdistrict; however it does allow residential uses on the second story or above

The Comprehensive Plan s Future Land Use (Figure 14-2) shows this area s it currentlyis (industrial) and the surrounding land uses to remain the same, s a mix of commercial,
government, residential and recreational uses. The industrial use does not fit well withthe adjoining mix o f uses.
t is staffs opinion that adjoining properties will benefit from the positive impact of theproposed rezoning. The proposed OC-1 district permits the greatest flexibility to thereuse o f the property while complementing the existing commercial uses and protectingthe surrounding residential zoning districts.
n reviewing a rezoning proposal, Section 1139.07 outlines the criteria on which tobase decisions:
A) Whether the change in classification would be consis tent with the intent nd purposeof his Zoning Code.
The proposed rezoning is consistent with Zoning Code. As described in the ZoningCode, the purpose o f the OC -1 District is to accommodate a mixture of office andcommercial uses and is designed and intended to act s a buff t. The OC-1 district isintended to be mapped between nonresidential and residential uses.
B) Whether the proposed amendment is made necessary because o changed or changingconditions in the area affected, and, i o, the nature o uch changed or changingconditions.
The proposed amendment is a result of the razing of the former Hobart Brother s buildingwhich was used to house an industrial use. This provides an opportunity forredevelopment in the downtown area to can promote commercial use but also respect thesurrounding residential neighborhoods.

To follow up with our conversation last week, the City of Troy is interested in initiating the rezoning of heparcels that collectively make up the site of the former Illinois Tool Works ITW)/Hobart Brothersmanufacturing facility at 600 West Main Street. A meeting of the Troy Planning Commission was held Wednesday, December 10 2014, at 3:30 p.m . in the
second floor conference room, City Hall, Vice-Chairman Thomas Force presiding. Also present were members -Mahan, Titterington, Johnson, McGarry, and Beamish; Planning Staff - T Davis, S Brandon and D Puckett.
The minutes of the November 12, 2014 meeting were approved.
REZONING REQUEST - 6 WEST MAIN STREET 40 PARCELS TOTAL) FROM TO M-2, LIGHT
INDUSTRIAL DISTRICT, TO OC-1, OFFICE-COMMERCIAL DISTRICT; THE AREA PROPOSED TO BE
REZONED CONSISTS OF TEN PARCELS LOCATED ALONG NORTH ELM STREET BETWEEN

Street Including Solid Waste Jerry Mullins Foreman Collected and transported 222 tons of residential t rash since the last report of
254 tons. Collected over 731 Christmas trees and transported them to the Miami County
Transfer Station for disposal/recycling. Delivered recycling bins as requested. Salted and plowed for snow and ice events. We currently have around 650 tons
of sal t left for the winter season. Cleaned the Dye Mill Road Facility. The EPA conducted its annual inspection of
our facility and found no reportable violations. This is the first year we havereceived zero violations for our yard waste facility. Steve Wesco, the siteattendant, deserves a lot of the credit for this favorable report. We have workeddiligently over the past couple of years to become EPA compliant, and our effortshave paid off.
The sign shop worked on various sign projects including signage for the newkiosk in the South Cherry Street parking lot.
Installed the new solar powered Big-Belly trash/recycling receptacles on thePublic Square.
Cleaned and maintained snow equipment. Brined for the weekend snowstorm. Replenished the brine storage tanks. We currently have 10,000 gallons of brine
ready for distribution.
Electrical Brian Ferree Foreman Completed Ohio Utilities Protection Service requests as needed. Completed the safety report for the month of February. Repaired several parking lot lights a t Fire Station 2. Wired-up the rake motor on the primary flocculation t ank a t the Water
Treatment Plant. Removed the Christmas tree from the Public Square. Removed the decorations from the levee and the wreathes from the bridges. Installed a new motor on the settl ing t ank a t the Wastewater Treatment Plant.

A defect tha t was discovered in the west pump motor at the Air StripperPumphouse has been repaired under warranty, and this motor was returned toservice on January 21. Occasional high torque events with the east pump arenow being investigated. The new system continues to operate very well overall.
The Train 1 Primary rake drive gear motor was found to be leaking slightly andhas been replaced. The faulty 5 hp gear motor has been returned to themanufacturer for warranty inspection and repair .
The 150 hp High Service Pump 1 motor has been returned for warranty repairsafter excessive vibration levels were detected.
A failed check valve is believed to have caused flooding of the Well 17 controlcabinet on January 22. This well was due for cleaning and repairs in earlyFebruary . Inspection, cleaning and repairs will now begin this week.
The Electrical Division Staff completed installation of a new 100 amp breaker inthe Well 13 disconnect panel and this Well has been returned to full service.
A new chlorine storage policy has been implemented. Effective January 1 theWTP reduced maximum inventory of liquid chlorine to less than 2,500 pounds.Past storage levels ranged between 6,000- 7 ,500 lb s . The plant will now store upto four 600 lb. cylinders, instead of three to four 2,000 lb. containers, reducingthe risks from onsite storage while maintaining sufficient inventory to meetdemands. USEPA and OEPA Risk Management Plan compliance costs will begreatly reduced.
WTP Maintenance Staff completed insulation improvement projects at the AirStripper Pumphouse and Extra High Service Zone Booster Station, andconstructed a protective cover for the C02 storage t ank temperature controlequipment.

Received the inspection report from OEPA for the annual industr ial
pre t rea tment inspection. We will be forwarding a response to OEPAconcerning the findings/ recommendations.
Vendor is making a new shaf t for the raw sludge re-circulation pump andshould have it to u s by February 2.
Staff reinstalled the motor drive on Final Settling Tank (FST) 3. Completed and submit ted the annual OEPA Sewage Sludge Report. Vendor replaced faulty fuel injectors on 350 Kva generator. Vendor repaired faulty generator switch A , and performed preventive
maintenance on both switch A and switch B . Ken Parks and Tim Parker at tended the annual industr ial pretreatment
seminar in Mason . Vendor performed quarterly calibration and preventive maintenance on the
plant gas monitors.

Items oflnterest - Fourth Quarter Loan Programs Status Report
Please find attached the Status Report for the business loan programs for the Fourth Quarter of 2014.
Again, this was a less active three months than the First Quarter of 2014, in which City Councilapproved three new loans. This quatier, one new application was filed (Ryan McNeill), but waswithdrawn by the applicants just as it was being scheduled for City Council's review.
Another project continued in its constmction and disbursement phase. R&E, LLC is converting theformer tennis b m on Olympic Drive into a larger manufacturing facility for West Troy Tool &Machine, Inc. West Troy already has relocated and its sister company, Global Source Manufacturing,Inc. has expanded at the Maryhill Drive plant. About 20,000 square feet of extra warehousing space ateach location also is available for subleasing to other Troy manufacturers. The final work on thisexcellent business expansion project is nearly complete.
Already this month, we have begun to receive new inquiries about these business loan programs. Weexpect 2015 will be even busier than 2014. As of the end of December, the Small BusinessDevelopment Revolving Loan Fund (SBD) had an available balance of 325,000; the DowntownBuilding Repair Revolving Loan Fund had an available balance of 595,000; and the EconomicDevelopment Revolving Loan Fund ED RLF) had an available balance of 150,000.
The total of the outstanding principal balances for the 34 open loans was just over 2,500,000 of theirinitial loan amounts totaling over 3,700,000. Another 40 past loans for a total of over 4,300,000 havebeen repaid in full. The business loan programs have been quite successful and have contributed to theeconomic vitality of he Troy community.

NOTES:
1 The Economic Development Revolving Loan Fund (ED RLF) has larger loans, but usually long
tenns because it finances only capital assets. This is Troy's oldest loan program and usuallygenerated the most revenue. All projects must create at least one new job per 25,000 loaned.
2) The Downtown Business Building Repair Revolving Loan Fund (DBR) s for real estate assets,only. The D R usually has longer terms, therefore less revenue. Prevailing Wage rules apply.
3) The Small Business Development Revolving Loan Fund (SBD) is Troy's newest program. t doesnot have the federal Community Development Block Grant restrictions that affect the ED RLF
and the DBR. The SBD typically has smaller loans and shorter terms.
4) Brian & Karen Hammond and David & Melissa Kuo remain in default. Judgments have been obtained.
5) No new loans were made this quarter, perhaps due to an improving commercial loan market.
6) The SBD loan to R&E, LLC for conversion of the former tennis ham at 650 Olympic Driveis about 95% disbursed. The constrnction work s very nearly complete.
7) An application was filed by Ryan McNeill for a D R loan to help acquire theWasse1man Building, but was withdrawn before City Council acted on it. As of the endof he year, the application had not yet been refiled.
8) New projects in Downtown Troy are being evaluated by prospective borrowers . At thistime, none are ready to move forward.
