Fay Atchley, 81, went to be with her Heavenly Father on Feb. 11, 2015. She passed peacefully after a short illness, surrounded by several members of her family in Perth, Western Australia. Fay was born May 17, 1933, in Erick, Oklahoma. She was married almost 62 years to Herman Atchley (dec), and the mother of nine children. Fay was preceded in death by her husband, Herman; her son, Benjamin; her mother and father, Della and Warren Smith; her brother, Clinton; three grandchildren and a great-granddaughter. She is survived by two brothers, William (Bill) and Stephen (Steve) Smith; her sister, Lavonda (Vonnie) Declippel; eight children: Toni Wilson (Lanny), Eva Lee (Jef), Karen Fennell (Eric), Daniel (Kim), Mark, David (Diane), Michael (Kim) and Anna Tyers (Paul); 19 grandchildren, and 17 great-grandchildren. She was deeply loved, and will be greatly missed by those of us on earth as she rejoices in heaven. Funeral services will be held on Saturday, March 7, 2015 at 11 a.m. at the Church of Christ, Kearny, AZ with burial to follow at 2 p.m. at the Dudleyville Cemetery, Dudleyville, AZ. Mary Guzman, a beloved mother, grandmother, aunt, friend and community servant, passed away on Monday, March 2, 2015, at her home in Superior at the age of 84 years young. The family has announced that her memorial services will be held on Saturday, March 7, with the Chaplet of Divine Mercy at 9:30 a.m. followed by a Mass of Celebration at 10 a.m. at the St. Francis of Assisi Catholic Church, located at 490 Main St. in Superior, Arizona. Christian burial will follow at the Fairview Cemetery in Superior. A full obituary will follow next week.

Fay Atchley Land use in and around Kearny is in the spotlight. The town council has been asked by the railroad to evaluate the current agreement for the use of the OHV access trail that allows non-licensed off-road vehicles a way to enter and exit town without using the public streets. This access is typically used by our citizens, and/or visitors, that have four-wheelers or dirt bikes that are not street legal. There have been numerous citizens that own and ride horses, who use this route rather than riding down the public streets. It was under consideration by the Town Council to just abandon the current easement. I asked for a time to obtain public input. The Council Members said they would love to have your input, so, I volunteered to put out petitions. The construction of this trail was paid for with grant funds that created the Mescal Mountain OHV Park and

Trail system. In light of all the recent land closures, in and around Kearny, marked by the red and white no trespassing signs and new fences, this access is one of the only remaining access routes that allows anyone who goes horseback riding, motorcycle riding, ATV riding, a safe way in and out of town. We need to keep this access route to avoid the problems that my friends and I had riding our motorcycles in and out of Kearny in the 70s. The very route that is now the current trail was the one where we had to use excessive speed to flee the pursuing local authorities, who thought that we should push our motorcycles all the way to the end of city limits. This sometimes ended well and, other times, ended with tickets and unhappy parents. The purpose of this trail was to create a safe and legal access for our citizens.

More than a few people have asked me, “What happened to the survey letter you wrote about back in

January? No one sent me one.” This is a story of bureaucratic entangle-ment. When surveys are sent out as part of a preliminary grant process, the federal government requires that they be sent to a recognized legal address, in our case a street address. Well, as you know, every-one in Kearny has a post office box, for we have no street delivery. When Central Arizona Governments sent out the surveys in January, they complied with federal rules and used street addresses. As a result, only a very few of the letters were actually delivered; the rest were “returned to sender.”

I thank the few who received the letter and promptly replied – you get a gold star in my book. But now we are exploring the issue with the feds, who do not recognize letters sent to box numbers for the pur-pose of surveys. It is possible that we will receive a waiver of sorts. We’ll still have to use street addresses, but will probably have to hand deliver the surveys. I’ll let you know when we find out for sure. The financial survey is part of our ten-year plan which, once it is completed, will serve as a basis for grant requests over the next several years. Previous 10-year plans did not deal overly much with the economy of the town and the region. Our new plan will be different, containing factual information and eco-

This is a crucial part of the plan, because historically the mining towns in Arizona have suffered economic batterings which the majority of cities and towns in Arizona have not experienced. Thank you for your patience. Anyone in town who has ever ordered items through the mail knows that the manner of delivery (post office, UPS or FedEx) is a critical matter. Things were even more compli-cated a few years ago when our ZIP code of 85237 was changed to 85137. Many stores which delivered to Kearny took a long while to change to the new code, and our packages went everywhere but where they were supposed to be! Well, take a break from worrying and get ready for our Pioneer Days coming up in less than two weeks. We know who we are and where we are, even if the larger world

gets a bit confused, and we’re going to have a fine time.

On Friday, March 13 at the Cul de Sac at the end of the food vendor row, Olivia Fernandez will open for the Cardells at 5:30 p.m. Doug and Shay Cardell have been performing at chamber events for several years and have an interesting history since their music sounds like a full orchestra. They

performed as SKY in the 70’s and have performed with many other musicians over the years. To make the orchestra affect they record the backing track with Shay playing flute, violin, bass and drums and Doug plays harmonica. In addition to guitar and keyboard they also include 12 string guitars, steel guitars or even banjos. They use a computer to play back the recorded backing tracks and to control the mixing board. chosen. The new site is within a quarter of a mile of the original site and ground is scheduled to be broken in the late

fall. Construction of phase one of the new casino is expected to be completed in 2017.

A day-into-night celebration is set at Oracle State Park Center for Environmental Education on Saturday, March 21, to honor its designation as an International Dark Sky Park — only the 20th park in the world and the first state park in Arizona. The Ray baseball team opened its season last week as one of five teams competing in the Tomas Pinon/Matt Huffman Memorial, a pool-play style preseason tournament hosted by Casa Grande and Maricopa high schools.

Bearcats open season at Pinon/Huffman Tournament

The Cats went 1 – 3 in the four-day tournament, which began with a 7 – 5 loss to Marana on Feb. 25. Ray’s lone win in the tourney came against Maricopa, an 11 – 1 run-rule victory on Feb. 27. The Cats scored in each of the game’s five innings, which included scoring three runs each in the second, fourth, and fifth frames. The Bearcats, the only Division IV team in the

tournament, played against four Division II programs – Marana, Casa Grande, Maricopa, and Higley. Upcoming schedule: Mar. 4 at Combs (3:15 p.m.), Mar. 6 at Combs vs. Estrella Foothills (3:15 p.m.). Both games are part of the Joe S. Padilla Tournament, which may continue through this weekend. Next week, the Cats will play their home opener on Mar. 10 vs. Show Low. First pitch is scheduled for 4 p.m.

The Junior Cats played their first game of the season last Wednesday. With the lost of nine players from last years team, the five returning players and seven new players had some work to do before the start of their first game. Wednesday’s game with the visiting Mt. Vista Cougars allowed the coaches to see what skills and drills the team needed to work on to continue to progress through the softball season. The start of the first inning the Cougars sent three batters to the plate the result, three up, three down. The Bearcats sent four batters to the plate with Julie Meza breaking the 0-0 tie with a double and run scored. The second inning the Cougars sent three more batters to the plate three up, three down. The Bearcats sent six batters to the plate resulting in two runs scored, led by Danielle Barajas and Shelby Yocum singles and an Amee Kenyon double. The third inning the Cougars sent three more batters to the plate and with the same result, three up three down. The Bearcats sent five batters to the plate in this inning resulting in 0 runs scored. The fourth inning the Cougars bats were waking up. They sent six batters to the plate, filling the bases but the Bearcat defense held them scoreless. This turn at bat for the Bearcats resulted in three runs by seven batters at the plate. Leading the offense this inning was a Tara Lorona triple, Julie Meza double, and a Julia Lorona single. At the end of four complete innings the score was 6-0. The top of the fifth inning the Bearcats made some fielding changes to allow players to experience playing other positions. The Cougars were able to send nine batters to the plate this inning resulting in five scored runs. Holding on to a one run lead the Bearcats sent five batters to the plate resulting in one insurance run. The score after five complete innings 7-5.

5:30 P.M. PUBLIC HEARING REGARDING USE OF CDBG FUNDS

The Town of Hayden is expected to receive approximately $113,000.00 in FY 2015 Federal CDBG Funds from the Arizona Department of Housing Regional Account (RA). The Town of Hayden also intends to apply for $300,000.00 in FY2015 CDBG funds from the State Special Projects (SSP) account. CDBG funds must be used to benefit low-income persons and areas, alleviate slum and blight or address urgent need. Based on citizen input as well as local and state planning objectives several potential projects have been selected to be forwarded to the State of Arizona with a request for funding. A public hearing will be held at the Regular Council Meeting at 5:30 p.m. on March 23rd, 2015 at the Town of Hayden Council Chambers to discuss the potential projects. It is expected that the Town Council will select the final project at this hearing and adopt applicable resolutions. The potential CDBG projects are named and described as follows:

1. Street repairs and/or replacement, including all infrastructures. Project cost approximately $96,000 for Community Wide Benefit with approximately 377 persons of low to moderate income

2. Sidewalk repair and/or replacement, including all infrastructures. Project cost approximately $96,000 for Community Wide Benefit with approximately 377 persons of low to moderate income.

3. Water system improvements, including but not limited to repair and/or replacement of main water lines, water line valves and fire hydrants. Project cost approximately $96,000 for Community Wide Benefit with approximately 377 persons of low to moderate income.

4. Town Hall and Senior Center emergency repairs, including but not limited to roof repair and electrical repairs. Project cost approximately $96,000 for Community Wide Benefit with approximately 377 persons of low to moderate income.

5. Housing rehabilitation. Project cost approximately $96,000 for Community Wide Benefit with approximately 2-6 homes for low to moderate income families.

6. Housing demolition. Project cost approximately $96,000 for Community Wide Benefit with approximately 377 persons of low to moderate income.

7. New home or manufactured home purchase for low income housing. Project cost approximately $96,000 for Community Wide Benefit with estimate of one new home of low to moderate income family.

The fifth annual Women’s Expo held at the Hayden High School was a fun filled day with good food, fun, learning, laughing, shopping and prizes! The vendors were happy to talk with everyone about their booths. The concession stands had good food to keep everyone fed and the money will benefit the Hayden PTO. Throughout the course of the day many people cycled through the Women’s Expo, the parking lot seemed constantly filled. There were prizes drawn every hour that consisted of many different items from vendors and sponsors. The grand prize was a one night stay at Apache Gold Casino and two rounds of golf. Thank you to the event sponsor’s: Apache Gold Casino, ASARCO, Copper Basin Chamber of Commerce, Ray Federal Credit Union, Gordon’s Market IGA Food Store, Town of Winkelman and Hayden School District. It would be difficult to have such events without the benefits of these sponsors. Among the speakers Iona Dease spoke about PTSD what it is, what treatments are available for it and other helpful information. Hayden Police Chief Louie Tartaglia spoke to the attendees about self defense and awareness. Martina Burnam spoke about Mediocre Meditation and how it is important for us to take time to relax in our lives. Cobre Valley Hospital was available to perform blood pressure checks and answer questions. The vendors that helped make this event successful included Pampered Chef,

Women’s Expo in WinkelmanCentral Arizona College, Copper Community Action Board, Melaleauca, AVON, Native Air, She’s Country Boutique, Scentsy, Georgianna Woods local author, Mary Kay, Girl Scouts; there was not a shortage of things to experience. The day was pleasant as was the vendors and

speakers. There was also a fashion show by the Pioneer Day Queen Contestant’s. All the young girls did a fantastic job at entertaining a large audience with the fashion show. Thanks to everyone who came out and supported the Copper Basin fifth annual Women’s Expo!

Scott Schaefer's spending the weekend as ‘artist-in-residence’ at BTA, leading a two-day workshop teaching students how to make howling, growling didgeridoos from hollowed Agave stalks. Being onsite for a Saturday evening inspired Scott to offer a unique concert featuring ‘indigenous instruments,’ playing didgeridoo and Native American style flutes accompanied by Saggio - who adds ethereal arias of percussion with hand-pans and the 'hang' (plus his own music on Native American style flute, too). BTA will remain open one hour later than usual – taking admissions until the music begins at 5 p.m. The Arboretum will close promptly at 6:30 Saturday evening. The two musicians shared the stage in November during the Arboretum's Fall Foliage Festival, said Schaefer: “the didgeridoo is a powerful instrument – with a sound even

more soul-inspiring when that hypnotic drone of the didge wraps around Saggio's percussion, using hand-pans and a hang drum. Listeners unfamiliar with a hang drum often remark that it sounds like the lilting steel drums that are typical of Caribbean music. I'm always honored when Saggio has an evening free to create a completely new, organic and exotic musical improvisation together. The Ordinance takes effect March 21, 2015 and is shown below:

ORDINANCE NO. PZ-C-001-14AN ORDINANCE OF THE PINAL COUNTY, ARIZONA, BOARD OF SUPERVISORS AMENDING THE PINAL COUNTY DEVELOPMENT SERVICES CODE, CHAPTER 2.191, SECTION 2.191.010, SUBSECTION (C), MEDICAL MARIJUANA DISPENSARY OFF-SITE CULTIVATION LOCATION, REGARDING OUTDOOR CULTIVATION LOCATIONS; AND DIRECTING ITS PUBLICATIONWHEREAS, pursuant to Arizona Revised Statutes § 36-2806.01, the Board of Supervisors (“Board”) is authorized to enact reasonable zoning regulations that limit the use of land for registered nonprofit medical marijuana dispensaries including off-site cultivation locations; andWHEREAS, the Board held a work session on this Ordinance on January 14, 2015; held a public hearing on this Ordinance after the aforesaid work session on February 18, 2015, giving no less than 15 days notice thereof; and made copies of this Ordinance available to all Justice Courts, Supervisors’ District Offices, the Office of the Clerk of the Board and the County web site at least 15 days prior to the aforesaid public hearing; andWHEREAS, the Board has determined it is necessary for the health, safety and general welfare of the public to amend the Pinal County Development Services Code, Chapter 2.191, Section 2.191.010, Subsection (C), Medical Marijuana Dispensary Off-Site Cultivation Location, regarding outdoor cultivation locations.NOW, THEREFORE, BE IT ORDAINED by the Pinal County Board of Supervisors as follows:Section 1: Pinal County Development Services Code, Chapter 2.191, Section 2.191.010, Subsection (C), Medical Marijuana Dispensary Off-Site Cultivation Location is hereby amended as follows:Deleted text in strikethroughAdded text in UNDERLINED CAPS C. Medical Marijuana Dispensary Off-Site Cultivation Location. As long as the Arizona Revised Statutes remain in full force and effect to allow medical marijuana dispensaries, a medical marijuana dispensary off-site cultivation location is permitted as a conditional SPECIAL use subject to the following conditions:1. Minimum Notification Area. The minimum notification area for a conditional SPECIAL use permit for a medical marijuana dispensary is 1,000 feet.2. Supplemental Application. In addition to the application required by Chapter 2.150 PCDSC, an applicant for a conditional SPECIAL use permit for a medical marijuana dispensary off-site cultivation location shall complete an application that includes all of the following information:a. If the application is by an agent for the owner, the authorization must include an explicit acknowledgment from the owner that the owner knows that the proposed use of the property is as a medical marijuana dispensary off-site cultivation location.b. The legal name and address of the affiliated medical marijuana dispensary.c. The name, address and date of birth of

each principal officer and board member of the medical marijuana dispensary affiliated with the off-site cultivation location and the name, address and date of birth of each medical marijuana dispensary agent.d. A copy of the operating procedures adopted in compliance with ARS 36-2804(B)(1)(c).e. A notarized certification that none of the principal officers or board members for the medical marijuana dispensary affiliated with the off-site cultivation location has been convicted of one of the following offenses:i. A violent crime as defined in ARS 13-901.03(B) that was classified as a felony in the jurisdiction where the person was convicted;ii. A violation of state or federal controlled substance law that was classified as a felony in the jurisdiction where the person was convicted including an offense for which the sentence, any term of probation, incarceration or supervised release was completed within the 10 years prior to applying for the application for the off-site cultivation location, or an offense involving conduct that would be immune from arrest, prosecution or penalty under ARS 36-2811 except that the conduct occurred before the effective date of that statute or was prosecuted by an authority other than the state of Arizona.f. A notarized certification that none of the principal officers or board members for the medical marijuana dispensary affiliated with the off-site cultivation location has served as a principal officer or board member for a registered nonprofit medical marijuana dispensary that has had its registration certificate revoked.g. A floor plan showing the location, dimensions of and type of security measures demonstrating that the medical marijuana dispensary off-site cultivation location will be conducted completely within an enclosed locked building and meet the definition of “enclosed locked facility” contained in ARS 36-2801(6).h. A SECURITY PLAN THAT MEETS OR EXCEEDS ARIZONA DEPARTMENT OF HEALTH SERVICES (AZDHS) REQUIREMENTS, WHICH SHALL BE SUBMITTED TO THE PINAL COUNTY SHERIFF’S OFFICE FOR REVIEW AND COMMENT PRIOR TO THE APPLICANT’S SPECIAL USE PERMIT HEARING.3. Permitted Location. A medical marijuana dispensary off-site cultivation location is only permitted in the A CB-2 (general business) zone ZONING DISTRICT, GR (GENERAL RURAL) ZONING DISTRICT, and the OR C-3 (general commercial) zoning district.4. Community Impacts. The board may or may not approve a medical marijuana dispensary off-site cultivation location at a location if substantial evidence is presented that locating the cultivation location at the proposed site will negatively impact neighboring property values or if substantial evidence is presented that shows that locating the cultivation location at the proposed site will create an unreasonable risk to the health, safety or general welfare in the area.5. Development Standards.a. A medical marijuana dispensary off-site cultivation location must be located in a permanent building MEET THE DEFINITION OF AN “ENCLOSED LOCKED FACILITY” UNDER ARS 36-2801(6) AND THE DEFINITION OF “ENCLOSED AREA” UNDER ARIZONA ADMINISTRATIVE CODE R9-17-101 (16) and may not be located in a trailer, cargo container or motor vehicle.

b. A medical marijuana dispensary OFF-SITE CULTIVATION LOCATION shall be set back a minimum of 2,000 feet from all other medical marijuana dispensary off-site cultivation locations measured from the parcel boundaries.c. A medical marijuana dispensary off-site cultivation location shall be set back a minimum of 1,500 feet from schools, community service agencies, activity facilities and/or activities where children may be enrolled, measured from the parcel boundaries.d. A medical marijuana dispensary off-site cultivation location shall be set back a minimum of 1,500 feet from a childcare center.e. A medical marijuana dispensary off-site cultivation location shall be set back a minimum of 1,500 feet from a library or public park.f. A medical marijuana dispensary off-site cultivation location shall be set back a minimum of 1,500 feet from a church.g. A medical marijuana dispensary off-site cultivation location shall be set back a minimum of 1,500 feet from a residential substance abuse diagnostic and treatment facility or other drug or alcohol rehabilitation facility.h. A medical marijuana dispensary off-site cultivation location may not have outdoor seating areas.I j.. The secure storage area for the medical marijuana stored at the medical marijuana dispensary off-site cultivation location shall not exceed 1,000 square feet.j k. A medical marijuana dispensary off-site cultivation location must have a legible copy of a valid medical marijuana dispensary agent registry identification card, the original of which is issued by the state of Arizona, plainly displayed inside of the doorway at all times.k l. Must have the address of the medical marijuana dispensary that the off-site cultivation location supplies plainly displayed inside of the doorway at all times.l m. THE COUNTY SHALL NOT PERMIT MORE THAN ONE (1) OFF-SITE CULTIVATION LOCATION FOR EACH DISPENSARY LOCATED IN THE COUNTY, ABSENT A SHOWING OF UNNECESSARY HARDSHIP.

6. Permit Conditions. The board may include any conditions it finds necessary to conserve and promote the public health, safety, convenience and general welfare. The board must include the following permit conditions for issuance of the special use permit for a medical marijuana dispensary off-site cultivation location:a. An expiration date for the special use permit that requires reapplication or renewal of the permit after two years ONE YEAR or less.b. A requirement that the medical marijuana dispensary off-site cultivation location meets security requirements adopted by the Arizona Department of Health Services.c. A requirement that the storage facilities for the medical marijuana stored or grown on site prevent the emission of dust, fumes, vapors or odors into the environment.d. A requirement that the owner secure a certification from the State Fire Marshall or from another acceptable entity responsible for fire safety in the area in which the medical marijuana dispensary off-site cultivation location is to be located stating that the structure complies with all fire code requirements and supply a copy of that certification to the building and safety department.e. A requirement that the medical marijuana dispensary off-site cultivation location is prohibited from permitting anyone to consume marijuana on the premises.f. A requirement that the medical marijuana dispensary off-site cultivation location comply with applicable sections of the Pinal County sanitary code.G. A REQUIREMENT THAT THE APPLICANT SHALL PROVIDE NOT LESS THAN THREE (3) DAYS ADVANCE NOTICE TO THE PINAL COUNTY SHERIFF’S OFFICE WHEN MEDICAL MARIJUANA IS TO BE HARVESTED AT THE CULTIVATION LOCATION AND WHEN MEDICAL MARIJUANA IS TO TRANSPORTED FROM THE SITE TO A MEDICAL MARIJUANA DISPENSARY.H. A REQUIREMENT THAT PRIOR TO OPERATION OF A MEDICAL MARIJUANA DISPENSARY OFF-SITE CULTIVATION LOCATION THE APPLICANT SHALL SUBMIT FOR REVIEW AND APPROVAL A SPECIFIC SITE PLAN AS REQUIRED BY PCDSC, CHAPTER 2.200.7. Enforcement. The provisions of this subsection may be enforced through the use of the civil penalty procedure provided for by PCDSC 2.160.140 or by injunction or other civil proceeding as provided by ARS 11-80815(H). Notwithstanding any other provision of this code, this subsection shall not be enforced under ARS 11-80815(C) as a misdemeanor.8. Fees. Fiestas featured will be from the states of Guerrero, Nayarit, Michoacan, Nuevo Leon, and the group’s home state of Veracruz. While recreating the pageantry, spectacle, and color of each fiesta, the choreography of each dance represents a unique facet of life, culture, history, or nature. The rhythms and music are a synthesis of Spanish, European, Indigenous, and Afro-Caribbean influences. The troupe is named after the “Quetzal”, a splendid regional bird of southern Mexico, and with costumes that echo the bird’s plumage; they tap their heels, twirl their skirts, and thoroughly entertain an audience. One of their best known performances is “La Bamba”, originally a folk song, then converted to a dance, and later made famous by Ritchie Valen’s 1958 adaptation which became a top 40 hit in the US. “Ballet Folklórico Quetzalli” was founded in 1985 by maestro Hugo Betancourt after spending years learning the artistry of dance and passion for these traditions. Last week the Legends of Superior Trail Committee along with the International Mountain Biking Association hosted a joint kick off meeting to start mapping and plan-ning for mountain bike, hiking and some equestrian trails in the area surrounding Superior. About a dozen local residents along with outdoor enthu-siasts from Kearny, Tucson, Scottsdale, Tempe and Gold Canyon attended the open house meeting. There is a tremendous amount of enthusiasm for this project and its potential impact. One type of trail that will be developed are gravity trails to be used specifically by mountain bik-ers who want a down hill rush. The planning and mapping process will take about three to four months. Once the plan is complete the IMBA will present it to the LOST committee for modifications. The two groups will be working closely with the Tonto National Forest on the planning stages. Once the plan is complete the plan will need to have an environmental impact statement written about the project that will take two to three years for completion. Following an approved EIS/NEPA the trails will be able to be constructed. The Legends of Superior Committee will be forming a 501c3 organization to be able to apply for grants to fund the construction of the trails as well as other trails in the area. Funding for the planning and mapping of the trail is being funded by Resolution Copper.
