Introduction The BBC is committed to providing reasonable relocation support to mitigate the financial impact on employees where business needs require an employee to relocate. Any relocation support is offered to an employee at the discretion of the new department and the relocation budget must be signed off by the Divisional Board. The detailed relocation process and arrangements will meet each distinct set of circumstances and will be applied carefully and fairly. This policy covers;

1. Permanent Relocation Support for Individual Employees 2. Group Move Relocation Support 3. Attachment Support 4. Additional Information

If your new work location is within daily travelling distance you may be able to claim Excess Fares instead of relocation/attachment expenses. Please refer to the Excess Fares Policy.

PERMANENT RELOCATION SUPPORT FOR INDIVIDUAL EMPLOYEES

Descriptor Employee Relocation support is available when there is a permanent change of

work location that means the new place of work is not within reasonable daily commuting distance of your home. Change of work location can be as a result of promotion, personal development or organisational requirements.

To Qualify Only employees on a continuing contract of employment whose job is being

relocated will be eligible for relocation support within this policy.

There must be a significant distance between the old home and the new home and you must relocate to within a commutable distance of the new base location. You must change your sole or main residence to be within reasonable daily commuting distance of the new work location. NB Acceptable relocation maps are available from the relocation service provider.

Application To apply for relocation expenses you will need to complete the Permanent

Relocation Support Authorisation Form which is available on HR Gateway. Approval Relocation support entitlement will be offered to an employee at the discretion

of the new department and the relocation budget must be signed off by the Divisional Board.

Relocation Options Relocation support is available to employees who intend to sell their principal family residence and buy a property at the new location. Please see below for details. Option 1: Sell & Buy (Sell the existing and buy the new property)

Location Recce allowance reimbursed against receipts for expenses incurred for travel, accommodation and meals.

Legal and other associated costs of selling and buying a property (eg EPC, search fees, valid building society charges, mortgage arrangement and surveyors fees). The relocation service provider has an appointed panel of professional suppliers. However, if you wish to use your own, the BBC’s contribution will be capped at the rates payable to the relocation service provider’s appointed panel.

Homebuyers Survey from a surveyor on the appointed panel. A Full Building Survey will only be authorised if recommended in the Homebuyers Survey.

Stamp Duty (Stamp Duty Land Tax) up to a maximum value of the equivalent stamp duty payable on the sale price of your existing home, (e.g. if you sell your existing home for £200,000 the equivalent stamp duty value would be £1,500*. Therefore the stamp duty support would be capped at a maximum of £1,500.)

Reasonable temporary accommodation costs will be paid (including letting agent fees). You should refer to the service definition or your relocation consultant for full details.

Return travel costs to the existing family home whilst in temporary accommodation in accordance with the working pattern agreed with your Team Manager.

Duplicate costs for gas, electric, water rates, council tax whilst in temporary accommodation. You should apply for a discount on council tax and essential utilities if applicable (this will only apply to standing charges if you are single and do not have a partner living in your previous home).

Estate Agency Fees up to 1.5% plus VAT of the sale price, providing the fee is agreed on a ‘no sale no fee’ basis and is inclusive of advertising.

Removal services using an approved supplier. If you wish to use your own, the BBC’s contribution will be capped at the rates payable to the relocation service provider’s appointed removal company.

The BBC will not meet the penalty costs of redeeming a mortgage on a fixed or low rate unless you are prohibited from transferring the mortgage to the new property by your lender.

A contribution towards household goods (eg carpets and curtains) if you are selling and buying a property. This will be payable against receipts and you will be required to

demonstrate that these goods are being left as part of the sale of your home. Please see the service definition or speak to your relocation consultant for further information.

Any tax liability arising out of the reimbursement of approved expenses over the tax exemption limit.

Option 2: Homeowner Retainer (Retain existing property in old location - disposal by renting out. Rent in new location)

Location Recce allowance reimbursed against receipts for expenses incurred for travel, accommodation and meals.

A rental allowance for a property in the new area (including letting agent fees). You should refer to the service definition or your relocation consultant for full details.

Removal services using an approved supplier. If you wish to use your own, the BBC’s contribution will be capped at the rates payable to the relocation service provider’s appointed removal company.

Any tax liability arising out of the reimbursement of expenses over the tax exemption limit.

Where an employee rents out their existing property. The difference between the existing mortgage, rental income received and rent in the new location will be paid up to the maximum specified period, refer to your relocation consultant for further information. Evidence to support the claim will be required.

Travel expenses for the ‘family unit’ to travel to the new location - equal to one journey to complete the move. To be reimbursed against receipts or mileage at the prevailing rate. This is dependent on your individual circumstances and subject to agreed budget limits.

The BBC will not support purchase costs in the new area where the property in the old location is retained.

In order to satisfy the HMRC requirements for tax exemption, the employee will be required to provide evidence that they have moved their ‘principal’ family residence to the new location. Failure to provide this could result in a tax liability which the employee may be liable for. The use of the words ‘Homeowner’ and ‘Property owner’ are interchangeable throughout this document and are intended to mean the legal owner of the ‘principal’ family residence in accordance with the HMRC definition, i.e. if your spouse or partner is the legal owner of your ‘principal’ family residence the rules of this policy still apply. Option 3: Employees in Rented Accommodation (Rent to Rent) If you are currently in rented accommodation, the following expenses will be reimbursed:

Removal services using an approved supplier. If you wish to use your own, the BBC’s contribution will be capped at the rates payable to the relocation service provider’s appointed removal company.

Letting agent administration fees, referencing fees and credit check fees.

Any tax liability arising out of the reimbursement of approved expenses over the tax exemption limit.

Support for the deposit payment of the rental property made via a loan to you, which will be deducted from your pay over an agreed timescale. The deposit is then returned directly to the employee at the end of the rental period by the lettings agent.

Travel expenses for the ‘family unit’ to travel to the new location - equal to one journey to complete the move. To be reimbursed against receipts or mileage at the prevailing rate. This is dependent on your individual circumstances and subject to agreed budget limits.

Relocation expenses will be reimbursed on a like for like basis and therefore employees who are renting accommodation will not be eligible for those elements of relocation assistance associated with house purchase. Legal Costs in Scotland The legal position with regard to the purchase and sale of property in Scotland is different to England and Wales. It is recognised that where a property is to be purchased in Scotland the employee may have to incur valuation costs a number of times before finalising a purchase. The BBC will agree to meet the cost of necessary valuations. Where 3 valuations have already been paid for by the BBC the employee must be prepared to discuss with the relocation service provider the reasons for the unsuccessful bids. If the employee is deemed to have acted without due care in this matter the BBC may refuse to meet any further costs.

GROUP MOVE RELOCATION SUPPORT: WITHIN THE UK

Descriptor Relocation expenses as set out in this policy will be paid in circumstances where

a decision has been made to move a number of roles, team or department/function to another location and employees at risk of redundancy. We will offer relocation support to enable affected employee to secure redeployment to alternative roles in other BBC locations, providing this is economically and operationally appropriate.

Employees whose work transfers will be offered a package of financial and practical support designed to enable as many employees as possible to take up opportunities in the new work location. Relocation expenses as set out in this

policy will be paid in circumstances where employees at risk of redundancy secure redeployment to alternative roles in other BBC locations, providing this is economically and operationally appropriate.

To Qualify In order to qualify for relocation support the employee must hold a continuing

contract in a relocating role ahead of the proposed move. Anyone recruited into a role, with prior knowledge that the role is subject to an imminent move will not qualify for support under this policy.

Application To apply for relocation support you will need to complete the BBC Permanent

Relocation Support Authorisation Form which is available on HR Gateway. Relocation Options The main elements of the relocation package are;

For all employees:

o Assistance from a specialist relocation service provider

o Removal services using an approved supplier

o A contribution towards the cost of a Recce visit to the new work location.

For employees who are property owners:

o The choice of one of two relocation packages

Option 1: Assisted Relocation Option (ARO) Assistance to sell the existing and buy the new property: The following costs can be reclaimed;

Option 2: Remote Location Allowance (RLA) Remote Location Allowance is designed to allow employees greater flexibility over the timing of their move. Providing that you are a property owner, and intend to retain this property as your/your family’s main home temporarily you may choose the Remote Location Allowance. Under the Remote Location Allowance, an appropriate work and travel pattern will be agreed between you and your Team Manager. The anticipated costs will then be used as the basis for calculating a taxable monthly allowance which will be claimable. You should refer to the service definition or your relocation consultant for further information. If your circumstances change (either work, travel or housing arrangements, including house shares), and therefore the basis on which any agreed amount has been calculated is no longer accurate, you must notify your Team Manager and relocation consultant immediately to ensure any revision to the allowance be notified to payroll.

Support for the deposit payment of the rental property is made via a loan to you, which will be repayable at the end of the temporary rental period. During or at the end of the RLA period, you may choose to relocate, in which case relocation support is available to cover expenditure on allowable expenses, this will be capped at the prevailing tax free threshold for example:

Legal and other associated costs of selling and buying a property (eg EPC, search fees; valid building society charges, mortgage arrangement and surveyors fees). Should the tax window expire during the remote location allowance period, a suitable timescale to sell your property will be agreed by the BBC Head of Tax. ATTACHMENT SUPPORT WITHIN THE UK

Descriptor In certain circumstances, Travel and Accommodation support may be available

for employees offered an Attachment within the UK. An attachment must be at least 3 months long and no longer than 12 months.

To Qualify The BBC will only authorise assistance if you already have a financial

commitment for accommodation at your substantive work base, and will continue to have that commitment whilst on attachment, or you are incurring extra costs for commuting to your temporary base. You cannot claim the costs of temporary accommodation if:

Your temporary base is within a commutable distance or time of your home. However you may be able to claim excess travel costs via the Excess Fares Policy.

Special arrangements are being made to cover the cost of your accommodation.

You let out your main residence whilst you are on attachment.

You are not retaining accommodation at your substantive base. Application To apply for attachment expenses /support you will need to complete the BBC

Attachment Support Authorisation Form which is available on HR Gateway. Approval All applications are subject to locally agreed limits with your new Team Manager

and authorized budget holder. Entitlement If you are unable to live at home and travel daily to the new location you will be

entitled to claim the following:

Accommodation – a rent allowance up to a specified limit will be agreed.

Letting agent administration fees, referencing fees and credit check fees.

Support for the deposit payment of the rental property, made via a loan to you.

Duplicate costs for gas, electric, water rates, council tax whilst in temporary accommodation. You should apply for a discount on council tax and essential utilities if applicable (this will only apply to standing charges if you are single and do not have a partner living in your previous home).

Tax As long as the attachment is not expected to exceed 2 years, the BBC can

reimburse you for the costs associated with temporary living or additional travelling costs without deducting tax. As soon as it is seen that the attachment will exceed 24 months, all these costs become taxable.

ADDITIONAL INFORMATION

Relocation Provider The BBC has engaged a specialist relocation service provider to support you with your relocation needs. The details of the current provider are available on Gateway.

The HR Service Centre will forward any approved relocation forms to the relocation service provider, who will then allocate a relocation consultant, who will contact you to confirm the details outlined on your form and explain any entitlement or process. The relocation service provider is responsible for administering the relocation policy on behalf of the BBC and managing the relocation and expense claim process. All claims must be submitted to the relocation service provider in accordance with the expenses procedure, which they will outline to you when they contact you. Tax In order to qualify for tax relief available on relocation spend, the following must apply:

There must be a change of work location that means the new place of work is not within reasonable daily commuting distance of your home.

You must change your sole or main residence to be within reasonable daily commuting distance of the new work location.

There must be a significant distance between the old home and the new home.

The relocation costs must be incurred and reclaimed by the end of the tax year following the role move. For example:

If the role transfers in January 2016, you must complete your relocation by 5 April 2017

If the role transfers in May 2016, you must complete your relocation by 5 April 2018.

Tax Liability The expenses of relocation are taxable once they cumulatively exceed the tax threshold or if they are deemed to be ineligible. In order to encourage and ease the burden of relocation the BBC will meet any tax liability which arises on the reimbursement of approved core expenses as outlined in the policy. International Attachments Please note attachments to Jersey, Guernsey, Isle of Man or the Republic of Ireland, are not a UK attachment, and the local tax and social security legislation needs to be considered for those going to or from any of these locations. Should you have such an attachment, please contact the International Assignment Team in the first instance so all requirements for tax can be considered. Change in Circumstances It is your responsibility to notify your Team Manager and the HRSC to any change in circumstances which may affect your entitlement. Location Recce Allowance As part of the relocation support for employees, a ‘Recce’ allowance is available to claim against receipts. This can be used for travel, accommodation and meal expenses for a Recce

visit to the proposed new work location. There is a maximum amount claimable which will be explained by the relocation service provider. Leaving the BBC When applying for relocation support you will be required to agree that the BBC can recoup an element of the costs of relocation if you voluntarily leave or are dismissed from your role in the new base location, within 36 months. You will be asked to sign a declaration to this effect. The date of relocation is the date when you start your new position and the repayment terms are:

Year 1; 100% of the relocation costs incurred.

Years 2 & 3; the relocation costs incurred on a sliding scale. The amount repayable is reduced by 1/24th per month for each full or part month that you remain employed by the BBC during years 2 and 3 (eg employees who leave after 18 months from the date of their relocation will be required to repay 18/24 of the costs and staff who leave after 30 months will be required to repay 6/24 of the costs).

International Attachments Please note attachments to Jersey, Guernsey, Isle of Man or the Republic of Ireland, are not a UK attachment, and the local tax and social security legislation needs to be considered for those going to or from any of these locations. Should you have such an attachment, please contact the International Assignment Team in the first instance so all requirements for tax can be considered. General Conditions Team Managers will notify an employee of their relocation and the effective date. They will also agree the core package available. Any personal issues or difficulties concerning an employee’s relocation should be discussed with the Team Manager and your relocation consultant as soon as they arise. The BBC does not provide bridging loans under any circumstances. The BBC does not provide support for second home purchases.

Gallai methu â darparu’r dystiolaeth hon arwain at atebolrwydd treth y gall y cyflogai orfod ei dalu. Gwasanaethau symud celfi gan ddefnyddio cyflenwr sydd wedi’i gymeradwyo. Os bydd arnoch eisiau defnyddio eich cyflenwr eich hun, bydd cyfraniad y BBC yn cael ei gyfyngu i’r cyfraddau a delir i’r cwmni symud celfi a benodwyd gan y darparwr gwasanaeth adleoli.

Ffioedd gweinyddu, ffioedd tystlythyrau a ffioedd gwirio credyd yr asiant gosod tai.

Unrhyw atebolrwydd treth sy’n deillio yn sgil ad-dalu treuliau a gymeradwywyd uwchlaw’r terfyn eithrio rhag treth.

Cefnogaeth ar gyfer talu blaendal ar yr eiddo rhent a roddir ar ffurf benthyciad ichi, a fydd yn cael ei dynnu o’ch tâl dros gyfnod o amser y cytunwyd arno. Yna dychwelir y blaendal yn uniongyrchol gan yr asiant gosod tai i’r cyflogai ar ddiwedd y cyfnod rhentu.

Bydd treuliau adleoli’n cael eu had-dalu ar sail ‘tebyg am ei debyg’ ac felly ni fydd cyflogeion sy’n rhentu llety yn gymwys am yr elfennau hynny o gymorth adleoli sy’n ymwneud â phrynu tŷ. Costau Cyfreithiol yn yr Alban Mae’r sefyllfa gyfreithiol o ran prynu a gwerthu eiddo yn yr Alban yn wahanol i’r hyn ydyw yng Nghymru a Lloegr. Cydnabyddir, pan fydd angen prynu eiddo yn yr Alban, y gall fod angen i’r cyflogai dalu costau prisio sawl gwaith cyn y bydd pryniant yn un terfynol. Bydd y BBC yn cytuno i dalu cost prisiadau angenrheidiol. Pan fydd y BBC eisoes wedi talu am dri phrisiad, rhaid i’r cyflogai fod yn barod i drafod â’r gwasanaeth adleoli y rhesymau am y bidiau aflwyddiannus. Os bernir bod y cyflogai wedi ymddwyn heb ofal digonol yn y mater hwn, gall y BBC wrthod talu unrhyw gostau pellach.

Os bydd eich amgylchiadau’n newid (o ran trefniadau gwaith, teithio neu lety, gan gynnwys rhannu tŷ), ac felly nad yw’r sail a ddefnyddiwyd i gyfrifo unrhyw swm y cytunwyd arno yn gywir mwyach, rhaid i chi roi gwybod i’ch Rheolwr Tîm a’ch ymgynghorydd adleoli yn ddi-oed er mwyn sicrhau y gellir rhoi gwybod i dîm y gyflogres am unrhyw newid i’r lwfans. Rhoddir cefnogaeth i dalu blaendal ar yr eiddo rhent drwy gyfrwng benthyciad ichi, y bydd angen ei ad-dalu ar ddiwedd y cyfnod rhentu dros dro. Mae’r BBC wedi cyflogi darparwr gwasanaeth adleoli arbenigol i’ch cefnogi â’ch holl anghenion adleoli. Mae manylion y darparwr presennol ar gael ar y Porth. Bydd y Ganolfan Wasanaeth AD yn anfon unrhyw ffurflenni adleoli a gymeradwywyd ymlaen at y darparwr gwasanaeth adleoli, a fydd yna’n pennu ymgynghorydd adleoli, a bydd ef/hi yn cysylltu â chi i gadarnhau’r manylion a amlinellwyd ar eich ffurflen ac i esbonio unrhyw hawliau neu’r broses. Mae’r darparwr gwasanaeth adleoli yn gyfrifol am weinyddu’r polisi adleoli ar ran y BBC a rheoli’r broses adleoli a hawlio treuliau. Rhaid cyflwyno’r holl hawliadau i’r darparwr gwasanaeth adleoli yn unol â’r drefn dreuliau, y byddant yn ei hamlinellu wrthych pan fyddant yn cysylltu â chi. Treth Er mwyn bod yn gymwys am y rhyddhad treth sydd ar gael ar wariant adleoli, rhaid i’r pethau canlynol fod yn berthnasol:

Rhaid i’r newid lleoliad gwaith olygu nad yw’r man gwaith newydd o fewn pellter cymudo dyddiol rhesymol i’ch cartref.

Rhaid ichi newid eich unig neu brif breswylfa fel ei bod o fewn pellter cymudo dyddiol rhesymol i’r lleoliad gwaith newydd.

Rhaid bod pellter sylweddol rhwng yr hen gartref a’r cartref newydd.

Rhaid i’r costau adleoli gael eu talu a’u hawlio’n ôl erbyn diwedd y flwyddyn dreth wedi i’r rôl symud. Er enghraifft:

Os caiff y rôl ei throsglwyddo ym mis Ionawr 2016, rhaid ichi gwblhau eich adleoliad erbyn 5 Ebrill 2017

Os caiff y rôl ei throsglwyddo ym mis Mai 2016, rhaid ichi gwblhau eich adleoliad erbyn 5 Ebrill 2018.

Atebolrwydd Treth Bydd treuliau adleoli yn drethadwy pan fyddant, ynghyd, yn uwch na’r trothwy treth neu os bernir nad ydynt yn gymwys. Er mwyn annog a lleddfu baich adleoli bydd y BBC yn talu cost unrhyw atebolrwydd treth sy’n codi yn sgil ad-dalu treuliau craidd a gymeradwywyd fel yr amlinellir yn y polisi. Ymlyniadau Rhyngwladol Noder nad yw ymlyniadau i Jersey, Guernsey, Ynys Manaw na Gweriniaeth Iwerddon yn ymlyniadau o fewn y DU, a rhaid ystyried y ddeddfwriaeth dreth a nawdd cymdeithasol leol yn achos y rhai sy’n mynd i, neu’n dod o, unrhyw un o’r lleoliadau hyn. Os cewch ymlyniad o’r fath, cysylltwch â’r Tîm Ymlyniadau Rhyngwladol yn y lle cyntaf fel y gellir ystyried yr holl ofynion treth. Newid mewn Amgylchiadau Eich cyfrifoldeb chi yw rhoi gwybod i’ch Rheolwr Tîm a’r Ganolfan Wasanaeth AD am unrhyw newid yn eich amgylchiadau a allai effeithio ar eich hawliau.

Lwfans Rhagchwilio Lleoliad Yn rhan o’r gefnogaeth adleoli i gyflogeion, mae lwfans ‘Rhagchwilio’ ar gael a gallwch ei hawlio ar sail derbynebau. Gellir ei ddefnyddio ar gyfer treuliau teithio, llety a phrydau ar gyfer ymweliad Rhagchwilio â’r lleoliad gwaith newydd arfaethedig. Ceir uchafswm y gallwch ei hawlio, a bydd y darparwr gwasanaeth adleoli yn esbonio hyn wrthych. Gadael y BBC Wrth wneud cais am gefnogaeth adleoli bydd gofyn ichi gytuno y gall y BBC hawlio elfen o’r costau adleoli yn ôl os byddwch yn gadael eich rôl yn y prif leoliad newydd yn wirfoddol neu’n cael eich diswyddo ohoni o fewn 36 mis. Gofynnir ichi lofnodi datganiad i’r perwyl hwn. Y dyddiad adleoli yw’r dyddiad pan fyddwch yn cychwyn eich swydd newydd a dyma’r telerau ad-dalu:

Blwyddyn 1: 100% o’r costau adleoli a dalwyd.

Blynyddoedd 2 a 3: y costau adleoli a dalwyd ar raddfa leihaol. Bydd y swm y bydd gofyn ei ad-dalu yn lleihau 1/24 fesul mis am bob mis llawn neu ran o fis y byddwch yn parhau i fod yn gyflogedig gan y BBC yn ystod blynyddoedd 2 a 3 (e.e. bydd gofyn i gyflogeion sy’n gadael 18 mis wedi dyddiad eu hadleoliad ad-dalu 18/24 o’r costau a bydd gofyn i staff sy’n gadael wedi 30 mis ad-dalu 6/24 o’r costau).

Ymlyniadau Rhyngwladol Noder nad yw ymlyniadau i Jersey, Guernsey, Ynys Manaw na Gweriniaeth Iwerddon yn ymlyniadau o fewn y DU, a rhaid ystyried y ddeddfwriaeth dreth a nawdd cymdeithasol leol yn achos y rhai sy’n mynd i, neu’n dod o, unrhyw un o’r lleoliadau hyn. Os cewch ymlyniad o’r fath, cysylltwch â’r Tîm Ymlyniadau Rhyngwladol yn y lle cyntaf fel y gellir ystyried yr holl ofynion treth. Amodau Cyffredinol Bydd Rheolwr Tîm yn rhoi gwybod i gyflogai am ei adleoliad a’r dyddiad pan fydd yn digwydd. Bydd hefyd yn cytuno ar y pecyn craidd sydd ar gael. Dylid trafod unrhyw faterion personol neu anawsterau ynghylch adleoliad unigolyn â’r Rheolwr Tîm a’ch ymgynghorydd adleoli cyn gynted ag y byddant yn codi. Nid yw’r BBC yn cynnig benthyciadau pontio dan unrhyw amgylchiadau. Nid yw’r BBC yn cynnig cefnogaeth i brynu ail gartrefi.
