CONSTITUTION THE SOUTH AFRICAN COUNCIL ON SPORT INTERPRETATION CLAUSE In interpreting these rules, regulations and standing orders of the Council the words- L "Council" or "SACOS" mean The South African Council on Sport. 2. CONSTITUTIONTHE SOUTH AFRICAN COUNCIL ON SPORT

INTERPRETATION CLAUSE

In interpreting these rules, regulations and standing orders of the Council the words-

ARTICLE 1: NAME:The name of the Organisation shall be "The South African Council on Sport" (herein referredto as the "SACOS".)

ARTICLE 2: AIMS AND OBJECTS

T̂ he objects of the Council are:

(a) To foster a spirit of goodwill, equality and fraternity among all people without any dis­crimination whatever on the grounds of race, colour or creed and further carry out the provisions of the statutes of IOC and other international bodies controlling sport in the world and also to prevent racial, colour, religious or political discrimination among sportsmen.

(b) To assist a member of this Council to affiliate to International bodies controlling their particular branch of sport.

(c) To foster friendly relations among the National Associations, officials and players in the Repgblic of South Africa and overseas.

(d) To assist affiliated members of the Council to promote, control and administer their particular branch of sport in keeping with the rules and principles laid down by the International bodies.

ARTICLE 3 : MEMBERSHIP

<a) The membership of SACOS shall be open to all National Associations and Provincial Councils of sport, playing or conducting sport in compliance with the provisions and principles of IOC and or the world body controlling that particular branch of sport.

The Provincial Council shall consist of not less than five bona fide codes.

(b)

The annual membership fee shall be the sum of R100 payable on or before the 28 February of each year.

Application for membership shall be dealt with by the Conference, Council or the Executive of SACOS.

ARTICLE 4 : OFFICIALS

The Officials of the SACOS shall be:

(a) A President,(b) A Vice President,(c) The Secretariate: The Secretariate shall consist o f:—

i A Secretary General,

ii A Secretary who shall at the direction of the Secretary General convene all meetings (except departmental) record the proceedings of meetings, prepare and circularise the minutes within 21 days of it being held, and generally attend to all local correspondence.

iii A Secretary who shall raise funds and to generally to keep the Council in good financial standing. He shall however, co-opt to assist him in his undertaking. A report reflecting the Income and Expenditure shall be drawn and presented each month.

iv A Secretary who shall prepare literature for publication and to ensure that a Newsletter is produced at least once a month. The Newsletter shall include local news and informa-tion from abroad.

(d) Three Patrons shall be elected at the Biennial Conference.

ARTICLE 5: COUNCIL OF SACOS

The six officials and the four delegates from each affiliated unit and two delegates from each of the Provincial Councils shall constitute the Council.

ARTICLE 6: THE EXECUTIVE

The Executive of SACOS shall consist o f : -

The President,The Vice-President, The Secretary General,

(d) The Three persons elected to the Secretariate, and(e) Four other persons to be elected from the floor.

ARTICLE 7; BIENNIAL CONFERENCE

The Biennial Conference of SACOS shall be held every two years (before 31st March). Each Conference shall fix the place and the date for the next Conference, All members of the Council as laid down in Clause 5 shall be entitled to participate in the Biennial Conference.

ARTICLE B: EXECUTIVE COMMITTEE

The Executive Committee of SACOS shall be responsible for the administration of SACOS. It shall have full powers in dealing with all matters in-between Conference.

The Executive Committee shall meet at least once a month.

ARTICLE 9: AGENDA OF THE BIENNIAL CONFERENCE

The Agenda of the Biennial Conference shall be drawn up by the Executive Committee.

ARTICLE 10: HEADQUARTERS

The Headquarters shall be decided upon by the Conference.

ARTICLE 11: BANKING ACCOUNT

SACOS shall open an account in an approved bank. The President and the Treasurer or the Secretary General shall operate on the account.

ARTICLE 12: MATTERS NOT PROVIDED FOR

Any matters not provided for in the Rules and Regulations shall be decided by the Executive Committee.

ARTICLE 13 MEETING NOTICES

Biennial Conference and Council Meetings 30 Days Notice; Executive Meetings 7 days Notice.

ARTICLE 14: QUORUM

One more than half entitled to be present.

ARTICLE 15 AMENDMENT TO RULES AND CONSTITUTION

May be charged only by a two-thirds majority of those present and voting.

ARTICLE 16: INDEMNITY

The Chairman, Secretary, Treasurer, members of the Executive Cpmmittee and all other Officials of the Council shall be and are hereby indemnified out of and from funds and property of the Council from and against all losses, charges, costs, damages and every other expense and liability they may incur of put to concerning or about the Executive or their respective duties as Officers of the Council, and no one of them shall be held answerable or deemed to be in any way responsible for any act or default of the one or the other of them, or

for any deficiency of any title or security whatsoever taken by the Council, nor shall the Officers of the Council, as aforesaid, be liable for any loss occasioned by any banker or other persons with whom money entrusted for safe custody, invested or otherwise placed, nor for any involuntary loss, misfortune or damage which may happen or take place in the execution of their respective offices as a result thereof, provided, however, that any such loss, misfortune of damage be not occasioned by the bona fide acts of such Officer or though his wilful default. Membership of the Council shall be in no way given to any affiliated body or member of the Committee, any individual with title, interest, claim or demand in or any monies, property or assets of the South African Council on Sport.

ARTICLE 17: DISSOLUTION

In the event of a dissolution of the South African Council on Sport the assets of the Council shall be realised and shall be handed over either to an organisation of similar objects or donated to charity.

ARTICLE 18: SUSPENSION OR EXPULSION

(a) The South African Council on Sport (SACOS) shall have the power to suspend, expel, fine or otherwise deal with any Official, member or affiliate guilty of a breach of the rules, aims and/or objects of SACOS, and/or guilty of any conduct which is adjudged by the Council of SACOS and/or a Committee appointed by it, to be prejudicial to the aims and/or objects of SACOS.

(b) Without prejudice to the generality of the aforegoing conduct which may adjudged prejudicial to the aims and/or objects of SACOS may include:

(i) The co-operation with or support of any person or body of persons which in the opinion of the Council and or the Committee appointed by it, pursues a policy incon­sistent with the policy of non-racialism as enunciated by SACOS.

Volkswagen has stated that it made the kombis available to the SARB as part of a marketirig promotion. The company has argued Piat in these recessionary times it had to use every means to promote vehicle sales and preserve {Obs in the depressed motor industry. The company is raported as saying that it “ presumed the Union shared this obiective”

Mr Makahaya Sam. Volkswagen Branch Secretary, condemned the company's action as ''insensitive'’. “ How can a multi-national like Vokswagen which operates in a rioHorn area like Uitenhege think o l a thing lika this." he said. A statement released by the Union said that members should not build buses while the townships bum. “We are not interested in providing transport lo r the pleasure of a privileged m m oriiy". the statement said.

ALL BLACKS BUSES

Support tor workers at V.W. has come Irom other brarKhes of NAAWU. FOSATU has also expressed its support for opposition to the tour. A FOSATU spokesperson slated that the IDS 000 member Federation had condemned the lour at Its Executive Meeting in May. The NAAWU action at Volkswagen was the lirst action of FOSATU alliliates against the lour. Support has also come Irom the Black Allied. Mining ar>d Consirucbon Workers Union which called on Volkswagen to apologise lo r this insult to the black community.

The All Blacks tour was cancelled on Monday ts ih July. The cancellation followed a New Zealand Court order forbidding the players to leave New Zealand. A spokesperson for NAAWU at Volkswagen said that workers were glad the lour had been cancelled. They would be returning to work on Tuesday I6th July.

"There must still be consultations over the future ol these kombis." he said. “ Management must learn that they cannot act alone m highly sensitive international luues like (his one. The voice of the majority of South AIncan s must he respec*“ i locally and overseas."
