This interactive program will provide insights into the process of building a safety champion along with explaining the role that good communication skills play in the process. It will provide attendees with techniques they can use within their safety program as well as when interacting with contract employees. Barriers will be discussed and methods of effective communication will be examined to build effective safety champions.

Introduction to Kinesio Taping – 4.0 CEU Credit

This 4-hour introductory course will use lecture, case presentation and hands-on lab experiences to introduce healthcare providers to the modality of Kinesio Tape. Practical strategies for managing pain, inflammation and common orthopedic conditions will be discussed, and then practiced by participants. Contraindications for use of tape, as well as safe application and removal techniques will also be reviewed. Come learn about a time-tested, cost-effective modality you can begin adding to your practice!

9:30AM When Safety and Animals Collide

This session will provide an understanding of dog and cat behavior, how to interpret dog behavior, possible interactions with wildlife (and how to avoid them), treating bite wounds and, finally, how to keep yourself safe in situations where animals may be present.

11:00AM OSHA Compliance Update

This presentation provides an update of NC OSH activities during the 2nd Quarter of FY2019. Topics to be discussed include National and North Carolina TRC and Dart rate averages, strategic plan goals, special emphasis programs, recognition programs, standards and compliance activity, alliance activity, as well as training and outreach programs. If we wish to achieve and sustain an extreme safe environment in our daily occupations, then we need to take a hard look at our goals, metrics and the overall approach taken to manage safety in the workplace.

This dynamic one-hour course will provide the healthcare provider with the most recent literature on components of the “core”. Incidence of low back pain among healthcare providers, particularly nurses, is epidemic but there are exercises and strategies to strengthen core components and provide increased balance during transfers and patient handling. Come learn what you can do to protect one of your most valuable commodities – your spine!

A Case Study: The Graniteville, South Carolina train derailment on January 6, 2005

On January 6, 2005 a train derailment and subsequent release of a tank load of chlorine gas cause a massive evacuation of a populated area. This cases study will focus on lessons learned in responding to and managing a no-notice evacuation during a hazardous materials (HAZMAT) incident. Students will how to use the Incident Command System (ICS) during a HAZMAT event and discuss the the extent to which New Hanover County agencies and first responders are prepared to handle a major HAZMAT incident such as this.

4:15PM Safety and Health Across the Generations

In 1970, the Occupational Safety and Health Administration (OSHA) was created. Today, over four decades after the implementation of the OSHA Act, a safe place to work is a requirement and an expectation. Yet, each year we still have an incredible number of workplace injuries and deaths. What is not understood is why worker fatalities are so high and why workers continue to injure themselves.

Several behavioral theories suggest that workers “may not care about the consequences; they could misperceive the risks or the consequences; or they might intentionally sabotage the safety policies and procedures.” Within any discussion of workplace safety and good health, it’s important to consider the implications that generational shifts are having on the number and type of work-related injuries, as well as attitudes, work practices, and performance.

"Nutrition: Ignoring It Doesn’t Seem to be Helping!” - 1.0 CEU Credit

This one-hour course will provide participants with the most current information on gut health and its implications for chronic disease processes. Signs and symptoms of “leaky gut” or inflammation will be reviewed, as well as foods to avoid and foods to enjoy that promote healing in this critical system. You are taking care of everyone else – take a moment to care for yourself! Come learn some tips and natural remedies to poor gut health.

Post Injury Return to Work Issues: Managing Compliance in the Intersection between ADA, FMLA, WC, EEOC, and Privacy Laws

Safety and HR Managers are finding it increasingly challenging to stay in compliance with employment and privacy laws when managing WC claims. Each, on their own, is challenging enough but when more than one of these laws intersect with WC, especially, when considering return to work, the landscape often creates fertile ground for conflicts, confusion and potential non-compliance issues. The panelists will address these issues and provide insight on how to manage the expectations of each law without exposing your company to violations of regulatory compliance rules and regulations.

It caused a complete skull fracture, with a section of his skull depressed against his brain. Ricky tells the story of the accident and how he came to realize the impact it had on his family. What changed Ricky’s life was realizing the potential impact it would have had if he hadn’t survived. Come along on the journey and see the event unfold before your eyes. You won't soon forget the ride.

In these ever changing times, alcohol and substance misuse poses particular challenges in the workplace. This session will provide participants with strategies for recognizing and combating drug misuse in the workplace and at home. Participants will gather information on current drug trends and available resources in their community.

Surviving an OSHA Inspection/Investigation

Students will gain an understanding of the different types of inspections and investigations and what is expected. The class will explore the Do's and Don’ts during an inspection, how to analyze citations, fines and penalties and manage the process to address them.

11:00AM Preventing EH&S Burnout: How To Improve Performance While Increasing Career Happiness

Learn what causes EH&S career burnout. Each attendee will learn if they're at risk, what to address and how. Attendees will leave the session with a personal action plan leading them towards a successful and rewarding career.

Physical Therapy for Industry: Benefits of On-Site PT

This session will examine the benefits of onsite versus offsite industrial physical therapy. The discussion will include a brief history of occupational medical management and industries with the most prevalent work related injuries and claims. Cost effectiveness in regards to number of visits, travel, quality of care and overhead will be discussed in detail as well as ergonomic training and implementation of injury prevention programs. Easy access to physical therapy services also serves as an opportunity to improve employee wellness and satisfaction which cannot truly be measured.

Medical and Legal Issues Surrounding Drug Testing in the Modern Workplace

The last several decades have seen a significant increase in utilization of drug testing to promote a safe, drug-free workplace. Most employers adopted drug testing policies during the hiring phase and after a workplace injury. As with any employment strategy, new laws, rules and regulations began to affect utilization leaving employers to wonder if they should even bother with it. Recently, OSHA began to question the utilization of post-injury testing because of concerns that such testing encourages non-reporting of workplace injuries. So what is an employer to do? In this session, we will explore the efficacy of drug testing, what drugs employers should be focused on, how different drugs affect the human body and associated work safety and performance and the legal issues to consider when developing and executing a drug testing policy.

1:00PM New Ladder Standard Falls from ladders account for 20 percent of all fatal and lost work-day injuries in general industry. The new rule includes requirements to protect workers from falling off fixed and portable ladders as well as mobile ladder stands and platforms. Attendees will learn the new standards, the timeline for implementation and how and where they apply in industry.

From Injury to Return-to-Work: How Medical Case Management Impacts your Bottom Line and Improves the Process

Medical management programs enable early engagement on a claim and a faster return-to-work which is good for both the employer and employee - a win-win for everybody. In medical management, the goal is to get the patient on the right track from day one of an injury. This involves care coordination and optimizing outcomes.

Encouraging employers to have a return-to-work plan in place, with senior management support, and clear responsibilities for the injured worker and employer is critical. With the rise in the cost of medical care, there has been a greater focus and need for medical management in all aspects of claims. Learn how medical management is an effective way to contain costs.

Incident Investigations in the 21st Century

Claims and onsite investigations have very different roles and objectives and both types seek specific information to support those objectives. We will discuss how to differentiate between them, conduct effective investigations to support claims and business decisions, and protect the data collected from discovery in future litigation.

3:30PM Disaster Preparedness and Recovery

Almost daily we hear of disasters affecting businesses and the people they serve. Disasters due to Mother Nature affect nearly everyone in their path. They often affect the supply chain and the people who rely on the business for their income and livelihood. Hurricane Florence was one of the most impactful disasters to hit the east coast in decades. It affected nearly everyone in the State of NC and along the eastern seaboard. Few anticipated that Wilmington would become an island in the storm requiring unique approaches to respond to the disaster it left behind. No one person or business came out of this storm unaffected by its wrath and utter destruction. The Panelists will discuss lessons learned from Hurricane Florence and tips on how to prepare for and recover from a disaster with particular focus on safety, security and compliance, health and wellness, and associated claims and legal issues.

James Jarvis, Executive Director Major, U.S. Marine Corps (Retired) American Red Cross - Cape Fear Chapter General Session: Disaster Preparedness and Recovery

James D. Jarvis serves as the Executive Director for the American Red Cross of the Cape Fear Area of North Carolina. In this capacity, Jarvis oversees all Red Cross operations in 13 counties in eastern NC (Brunswick, Carteret, Columbus, Craven, Duplin, Greene, Jones, Lenoir, New Hanover, Onslow, Pamlico, Pender, and Wayne). Prior to joining the American Red Cross as a public affairs volunteer in February 2013 and as a full-time employee in July 2014, Jarvis served honorably in the U.S. Marine Corps for nearly 23 years, retiring in February 2011 at the rank of major. During his decorated military career, Jarvis served as an enlisted Marine and officer, while completing combat tours in Afghanistan, Iraq, and Liberia.

For the American Red Cross, Jarvis served as the Disaster Program Specialist for the Cape Fear Chapter from July 2014 to January 2016 with territorial responsibility for all disaster response in Brunswick, Columbus, Duplin, New Hanover, and Pender Counties. As a Service to the Armed Forces Manager, Jarvis worked with committed staff and volunteers to fulfill the important mission of providing humanitarian support to service members, veterans and their families around the clock, around the globe, under the trusted symbol of the Red Cross. In addition to the important work of building strong and resilient military families, Jarvis and his volunteers are also working hard to help end veteran homelessness and suicides.

Finally, as the Executive Director for the American Red Cross of the Cape Fear Area, Jarvis works with a dedicated cadre of volunteers who prevent and alleviate human suffering every day in eastern NC. He serves on the Board of Directors and numerous Advisory Boards committed to ensuring that the American Red Cross remains ready to assist people in need for decades to come.

Jarvis is a graduate of the University of Oklahoma (BBA, Management Information Systems, Summa Cum Laude) and Webster University (MBA). He and his wife, Heather, reside in Wilmington, NC and have a daughter, Hunter, and two sons, Chase and Dashiell.

Lauren graduated from the University of Georgia with her BS in Microbiology and later obtained her Master’s in Rehabilitation Sciences with an emphasis in Physical Therapy from the Medical University of South Carolina. She opened the Newnan, GA clinic for BenchMark Physical Therapy in 2009, and shortly thereafter completed her Manual Therapy Certification and Trigger Point Dry Needling Certification. She was promoted to the Director of Workers’ Compensation for BenchMark Rehab Partners in 2015. Also in 2015, she completed her Specialist Certification in Ergonomics Assessment. She is a Certified Functional Capacity Evaluator, as well as an instructor for the 6th edition AMA Impairment Rating Calculation Course through ErgoScience.

Her current role is the Director of Network & Payer Management for the Upstream Rehabilitation family of brands which encompasses education, training, and onboarding for all clinicians as well as payer relations, program development, and business expansion throughout the Upstream footprint. As manager of Lowe’s emergency command center, Rick Neudorff is responsible for staging emergency inventory and leading emergency events that involve Lowe’s stores. Additionally, he oversees the company’s relationships with federal, state and local emergency management agencies.

Rick has 9 years of experience in emergency management and is a highly sought after speaker on establishing successful public/private partnerships for emergency management. Prior to joining Lowe’s, Rick served as general manager for Mitsui Bussan Logistics and was responsible for logistics and the supply chain, including recovery after emergency events. He also has nearly 10 years of experience serving in the public sector, and was elected to the city council four times in Plano, Texas.

After his entry into the steel business as a Melting Department clerk, Ricky held various management and hourly positions with Refractory and Steel companies, gaining a wealth of experience in steel operations.

Russ Simmerman is the owner of Physical Therapy Services of Wilmington. Established in 1983, Physical Therapy Services of Wilmington has 2 locations, 17th St and Porters Neck Rd. Russ graduated with a Doctorate of Physical Therapy from East Carolina University in 2008. He has been honing his skills in the outpatient setting since 2010. Russ' rehab interests include sports, post-operative, industrial medicine and orthopedic rehabilitation most notably of the shoulder, spine, hip, knee and ankle. Russ is a Certified Manual Therapist, a Certified Dry Needle Practitioner and a WorkSTEPS provider. He finds success with a hands-on approach and integrating exercise to guide his patients back to activity.

Teresa Smith, Emergency Management Technician New Hanover County Emergency Management General Session: Disaster Preparedness and Recovery

Teresa currently works for New Hanover County Emergency Management. Her career began in Public Safety in 1986, when she joined the Scotland County Sheriff’s Office as a telecommunicator. Her family moved to Wilmington in 2006. In 2007, she began working for New Hanover Co. Emergency Management.

Teresa received her Bachelor of Science Degree in Psychology from UNC Pembroke and later a Master of Arts in Psychology from the University of the Rockies in Colorado Springs, CO. She currently holds certification as a North Carolina Executive Emergency Manager. Additional certifications include an ICS Instructor, CERT Instructor, Mental Health First Aid for adults and youth, WebEOC Trainer, Operations, Logistics and Finance sections trainer for emergency workers in the NHC Emergency Operations Center.

She serves on the Southeast Incident Management Team (SeIMT) and has served on one deployment to the wildfires in the western part of NC. Her main function during disasters is working in the Emergency Operations Center helping all participants represented in the EOC where she is required to have knowledge of all ICS positions represented in the EOC. Teresa serves as a part-time adjunct instructor for Cape Fear Community College in their new Emergency Management Associate Degree Program. She is a member of the North Carolina Emergency Management Association (NCEMA) and the International Association of Emergency Managers (IAEM) and also currently serves on the NCEMA training committee.

Benton Toups, Attorney/Partner Cranfill, Sumner & Hartzog Post Injury Return to Work Issues: Managing Compliance in the Intersection between ADA, FMLA, WC, EEOC, and Privacy Laws Incident Investigations in the 21st Century

Benton L. Toups is a partner in the Wilmington office of Cranfill Sumner & Hartzog. Benton is a seasoned attorney whose practice focuses on Employment Law, Business Litigation and ERISA Litigation. Benton is also a certified mediator and is often called upon by his colleagues from other firms to assist them in that capacity.

Benton represents employers and executives before the Equal Employment Opportunity Commission, the Department of Labor, the North Carolina Industrial Commission, and several state and federal courts. He has extensive experience assisting with claims of harassment and discrimination under Title VII, the Americans with Disabilities Act (ADA), and the North Carolina Retaliatory Employment Discrimination Act (REDA), as well as claims for unpaid wages and overtime pursuant to the Fair Labor Standards Act (FLSA) and the North Carolina Wage and Hour Act.

Jason Toups, JD - Attorney McAngus Goudelock & Courie Medical and Legal Issues Surrounding Drug Testing in the Modern Workplace

Jason Toups is a member at MGC practicing workers’ compensation in Wilmington. His practice concentrates on the defense of North Carolina employers and municipalities against disability claims filed by their employees, as well as the defense of insurance carriers providing coverage to these entities. Having practiced in the Wilmington area since 2006, Jason is one of only two defense attorneys in eastern North Carolina to be certified by the North Carolina State Bar as a specialist in workers’ compensation.

Jason strives to provide aggressive and strategic legal representation for his clients in a cost-efficient manner, whether through negotiating settlements or developing and implementing a strong defense strategy for trial, all while maintaining an emphasis on client responsiveness and satisfaction. J. Allan Turner, MSOS, CSP Retired Safety & Health Lead My Journey to Safety-II, Embracing Proactive Safety, Employee Involvement, and Managing Performance Variability

J. Allan Turner, MSOS, CSP is a native of Wilmington, NC. He received his Bachelors in Economics and Business Administration from Catawba College in Salisbury, NC and his Masters in Occupational Safety from East Carolina University in Greenville, NC. Allan is retired from Corning, Incorporated, Wilmington, NC where he worked for 30 years, the last nine as their Safety & Health Lead. He is also retired from the U.S. Navy Reserve as a Supply Corps Captain where he served for 26.5 years, the last three as the Navy Emergency Preparedness Liaison Officer for the state of North Carolina.
