    Dear Mr. Libkey,

    National Inspection Services® was retained by LIV Sotheby’s International Realty to perform a comprehensive asbestos survey for demolition at the “Substation Building” located at 8200 Indiana Street in Arvada, CO (Subject Building). The purpose of this survey was to collect samples of suspect asbestos‐containing building materials to be impacted by planned demolition and have the building material samples analyzed for asbestos. This survey also addressed suspect building material debris located in the immediate exterior vicinity of the Subject Building. Suspect materials are divided into two types, friable and non-friable, based upon the material’s consistency. Friable is a material that, when dry, can be reduced to a powder or crumbled by finger (hand) pressure only, thereby rendering the material friable and allowing suspected asbestos fibers to become airborne. Friable materials produce a human health risk if the fibers are asbestos. When airborne the asbestos can be inhaled into the lungs causing future health problems and risks. Non-friable materials are miscellaneous building materials that in composition are hard and cannot be easily disturbed, and do not present a human health risk, unless activities such as crushing, sanding, or any activity that damages in a destructive way, such as during a demolition, causes its condition to become friable. According to section III.A.1.c of the Colorado Department of Public Health & Environment’s (CDPHE) Regulation 8, if the asbestos content of a sample of friable asbestos is estimated

    to be 1% asbestos or less, but greater than 0%, by a method other than point counting, the determination shall be repeated using the point count technique with polarized light microscopy. The EPA and the CDPHE define asbestos containing materials (ACMs) as any materials which test positive at greater than (>) 1% asbestos.     The sample above was submitted to DCM Science Laboratory in Wheat Ridge, CO who is accredited by the National Voluntary Laboratory Accreditation Program (NVLAP). Each layer included in the sample above was analyzed for asbestos content concentrations utilizing Polarized Light Microscopy (PLM). See the homogeneous area descriptions below.

    As per Colorado Regulation 8 requirements, suspect asbestos containing building materials (ACBMs) were separated into individual homogeneous areas. Homogeneous areas were determined based on the color, texture, and date of material application for the individual ACBMs. The six (6) homogeneous areas of suspect materials are described below:

    BULK SAMPLING RESULTS There were no asbestos containing materials identified during the comprehensive asbestos sampling at the Subject Building. See the Recommendations section below.

    RECOMMENDATIONS

    Based on the findings of this survey, National Inspection Services® recommends the following:

    • This Comprehensive Asbestos Inspection was conducted per Colorado

    Regulation 8 guidelines and is sufficient for State demolition permit requirements. All samples collected yielded PLM results of non-detect for asbestos with the exception of the window glazing (I-6A) located on the northeast window exterior which yielded trace asbestos results (0.25% Chrysotile), via PLM Point Count Method. Trace materials are not regulated by the Colorado Department of Public Health and Environment (CDPHE) and therefore may remain during demolition; however, if this material is to remain during demolition, special attention should be paid to ensure surrounding soils are not impacted. OSHA protocol should be followed to ensure worker protection when disturbing materials containing ANY amount of asbestos. A State of Colorado Demolition Permit should be obtained from the CDPHE, see the Colorado State Demolition Permit Application in the appendices. Any applicable county and/or city permits should also be obtained prior to demolition.

    LIMITATIONS This survey was designed to provide the client with observable materials (materials which were readily accessible and visible) that were collected and analyzed for asbestos content.

    Performance of this asbestos survey is intended to reduce, but not eliminate, uncertainty regarding the presence of asbestos-containing building materials. National Inspection Services® neither expresses nor implies a guarantee that all asbestos- containing materials were identified during this survey. National Inspection Services®

    used reasonable diligence consistent with industry standards to identify asbestos- containing materials during this survey. Samples were collected randomly based on sampling criteria outlined in Colorado Regulation 8. Any suspect materials not sampled during this asbestos inspection should be assumed to be an ACM until confirmed otherwise by a Colorado Certified Asbestos Building Inspector.

    This report has been expressly prepared to deliver the results of a physical survey based on the collection of, and the laboratory analysis of, suspect asbestos samples. National Inspection Services® does not engage in the abatement of asbestos containing materials, and as such will not dispense abatement methodology advice. Revisits to any subject property post-abatement, for the purpose of validating the abatement work of other parties, or for the preparation of state certification documents, will accrue additional fees. This report is not an abatement plan; National Inspection Services® will not be held responsible for the mishandling of the information contained herein.

    BULK SAMPLE ANALYSIS PROCEDURES:

    DCM Science Laboratory, Inc. analyzes bulk asbestos samples following procedures developed by the Mccrone Research Institute and in compliance with guidelines established by the Environmental Protection Agency (EPA-600/M4-82-020, 1982 and EPA-600/R-93/116, July, 1993).

    Bulk samples are prepared for analysis using a 1 OX-SOX stereo microscope in a hepa filter hood which provides a contamination-free environment. The sample is then analyzed by polarized light microscopy (PLM) at 1 OOX. When the sample consists of more than one layer, each layer is prepared and analyzed separately. Fiber and matrix materials are identified by the characterization of optical properties including color and pleochroism, form, cleavage, relief, birefringence, extinction, orientation, twinning , interference figure and other distinguishing features. Dispersion staining is also used to further aid in mineral identification. All percentages of asbestos, other fibers and non-fibrous constituents are calculated from the values obtained from analyses using the stereo and PLM microscopes. In-house and NIST standards as well as a chart prepared by R.D. Terry and G.V. Chilinger for "The Journal of Sedimentary Petrology", (Volume 24, pp. 229-234, 1955) provide a guide for estimating percentages. All samples are archived for six months unless other arrangements are made by the client.

    QUANTITATIVE BULK SAMPLE ANALYSIS PROCEDURES:

    DCM Science Laboratory, Inc. analyzes bulk samples in accordance with the National Emission Standard for Hazardous Air Pollutants (NESHAP) for asbestos (Federal Register, Vol. 55, No. 224, pp. 48406-48433, 11 /20/90). The analytical procedures followed are described in "Interim Method for the Determination of Asbestos in Bulk Insulation Samples" , (USEPA 600/M4-83-020, 1982), with minor modifications recommended by the Atmospheric Research and Exposure Assessment Laboratory, USEPA, Research Triangle Park, N.C.

    Samples analyzed by the point count method are milled to homogenize the sample, prepared on microscope slides and point counted using polarized light microscopy (PLM) in conjunction with a point counting stage and counter. One hundred counts are performed on four separate preparations of each sample for a total of 400 points.. If asbestos is identified but not counted during the point counting procedure, total asbestos is reported as zero and presence is noted on the report. Other preparation procedures including ashing and acid washing may be performed with client permission to improve accuracy in determining asbestos concentration. All samples are archived for six months unless other arrangements are made by the client.

    DCMSL is accredited by NVLAP (since April 1, 1989). DCMSL complies with NVLAP requirements unless otherwise noted.

    Demolition Notice Application Form Information and Instructions:

    1. To determine the proper amount for the application fee, multiply the length of the building (lineal feet) by the width of the building (lineal feet). Divide the total by 1000, round the result up to the next whole number and multiply this number by 5$. This is the square footage fee. Add the square footage fee to the base fee of $50 and submit the total amount to the Division along with the demolition notice application form.

    Ex: 40ft. x 52ft. = 2080 square feet; 2080/1000 = 2.08 (round up to 3); 3 x $5 = $15 (square

    footage fee) $15 + $50 (base fee) = $65 total application fee.

    2. In the event that only a load-bearing member is demolished, the square footage fee is calculated the same way as in “number 1”. However, you only need to calculate the actual footprint of the load-bearing member.

    3. All spaces must be filled in on the application. If the information is not applicable, please write N/A. Incomplete information may result in a delay in processing the application, which may delay your project.

    4. We must have proposed start and end dates for the demolition.

    5. There is a 10 working-day advance notification requirement for permit applications. Day 1 is the 1st business day following the postmark or hand-delivery date. (Working Day means Monday through Friday and including holidays that falls on any of the days Monday through Friday.) If a demolition follows a permitted or noticed asbestos abatement project within 10 business days of the completion of the abatement project, the 10 working-day advance notification requirement will be waived.

    6. The Colorado-certified asbestos inspector must sign the form in blue ink. (Original signature must be submitted.) The building owner or the contractor must also sign the application certifying that all refrigerants and luminous signs have been properly removed from the site.

    7. If the notice must be modified after the application has been submitted, notify the Asbestos Unit by fax at 303-782-0278 or e-mail at [email protected] by the end of the next regular State business day following the modification. Project modifications include discovery of unidentified asbestos-containing materials, changes in scope of work or the scheduled work dates. Please use the Permit/Notice Modification Form.

    8. Recycling of materials, such as concrete or wood, that are bonded or contaminated with asbestos-containing material (ACM), such as floor tile or mastic, is NOT permitted.

    9. Demolition of a building that has non-friable asbestos-containing materials remaining must be completed without causing the asbestos-containing materials to become friable. Burning a building with any asbestos-containing materials is PROHIBITED. Concrete floors covered with floor tile shall be removed in as large sections as possible. Operations such as crushing, pneumatic jacking, etc. of materials containing asbestos are not permitted.

    10. All provisions of laws and ordinances governing this type of work shall be complied with whether specified herein or not. Demolition permits or approval notices appearing to give authority to violate or override the provisions of any other laws or ordinances shall be invalid. Furthermore, demolition permits or approval notices issued in error or based upon incorrect information supplied to the Division shall also be invalid.
