"AN ORDER CREATING THE BOARD OF TRUSTEES OFTHE SAMAL ISLAND CITY COLLEGE"

WHEREAS, Philippine Constitution, Article XIV, Section 1, Re: Education, Science andTechnology, Arts, Culture and Sports states, "The state shall protect and promote the right of allcitizens to quality education at all levels and shall take steps to make such education accessible to

all."

WHEREAS, Philippine Constitution, Article II, Section 17 mandates the State to givepriority to education, science and technology, arts, culture and sports with the following goals: (1)to foster patriotism and nationalism; (2) to accelerate social justice; and (3) to promote total human

liberation and development;

WHEREAS, Republic Act No. 7160, otherwise known as the Local Government Code of1991, authorizes the Local Government Unit, thru the Sangguniang Panlungsod, to establish andprovide for the operation of vocational and technical schools and similar post-secondary institutionsand fix and collect reasonable tuition fees and other school charges in educational institutionssupported by the city government, subject to the availability of funds and to existing laws, rules andregulations. Further, it may establish a scholarship fund for the poor but deserving students inschools located within its jurisdiction or for students residing within the city;

WHEREAS, the City Government of the Island Garden City of Samal recognizes the vitalrole of the youth in nation-building and shall promote and protect their physical, moral, spiritual,intellectual and social well-being. Accordingly, it shall protect and promote the right of itsconstituents to quality education at all levels and shall take steps to make such education accessible

to all;WHEREAS, for several years, students who wish to pursue their tertiary education bear the

challenges of expensive tuition fees, board and lodging in Davao City as well as transportation coststo and fro Davao City or other neighbouring cities. Thus, the City Government has exhausted allefforts to invite schools and state universities to establish a school in the island but all were in vain;

WHEREAS, the City Government proposed for the establishment of a Local College whichrefers to a public higher education institution established by the LGUs through an enablingordinance, and financially supported by the concerned local government unit;

WHEREAS, in September 27, 2017, the City Development Council Resolution No. 34,Series of 2017 was issued approving the Proposed Local Community College of the Island Garden

City of Samal;

WHEREAS, in November 24, 2017 - the Commission on Higher Education, Region XIthrough its Regional Director, Raul C. Alvarez Jr., Ed.D., CESO III Director IV interposed noobjection to the request of the Local Government of the Island Garden City of Samal for theestablishment of local community college provided that the policies and standards in establishing a

quality educational institution are faithfully followed;

WHEREAS, in December 6, 2017, Department of Interior and Local Government throughRegional Director Alex C. Roldan issued a Certification Interposing no Objection in considerationto the nobility of the Establishment of the Samal Island City College;

Section 2. Powers and Duties of Governing Board. The Governing Board shall be thehighest policy-making body of the college and shall have the following powers and duties:

a.Promulgate policies in accordance with the declared state policies on higher education aswell as the policies, standards and thrusts of the CHED under RA 7722 and other

pertinent laws;

b.Promulgate rules and regulations consistent with existing laws, rules and regulations asmay be necessary to carry out the purposes and functions of the local Higher Education

Institution;

5.President of the Alumni Association;6.Representative from the Association of Local Colleges and Universities (ALCU);

7.Representative from the Professional Sector.

NOW, THEREFORE I, AL DAVID T, UY, City Mayor of the Island Garden City ofSamal, by virtue of the powers vested in me by law, do hereby order:

Section 1. Creation of the Board of Trustees. There is hereby created the Board ofTrustees (BOT) for the Samal Island City College and shall be composed of the following:

WHEREAS, on September 25, 2018, the Sangguniang Panlungsod of the Island GardenCity of Samal promulgated City Ordinance 2018 - 296, entitled "An Ordinance Establishing aLocal College Institution in the Island Garden City of Samal, Province of Davao Del Norte to be

Known as Samal Island City College (SICC)";

WHEREAS, on October 22, 2018, Resolution No. 775 series of 2018 was issued bySangguniang Panlalawigan of Davao del Norte confirming City Ordinance 2018 - 296;

WHEREAS, pursuant to Section 3 of the same Ordinance, SICC shall be established for thefollowing purposes: Provide high-quality, industry-relevant, and values-driven professionalprograms that takes pride in the culture of excellence; Sustain and promote research, communityextension and linkages towards inclusive community development and healthy environment;Develop responsible, God-loving, environment-friendly and productive citizens who can contributeto the local, national and global goals; Reserve the Indigenous Peoples culture through strongpartnership with the government, non-government organizations and other sectors; and build strongbrand and identity being a City Government-owned and operated college that will infuse sense of

ownership among Samalenos;

WHEREAS, the Board of Trustees is the governing board and the highest policy-makingbody of the college. It shall have the powers and duties as stated in Commission on HigherEducation Memorandum Order 004, Series of 2007 IRR of Policies, Standards and Guidelines onthe Establishment and Operations of Local Colleges and Universities;

Section 7. Promulgation and Implementation of Policies. The Governing Board shallpromulgate and implement policies in accordance with the declared state policies on education andother pertinent provisions of the Philippine Constitution on education, science and technology, arts,

culture and sports.

Section 4. CHED Representation. The Commission on Higher Education (CHED)Regional Director or his/her duly designated representative may be invited as a resource person

during board meetings.

Section 3. Meetings. The BOT Chairperson and members shall personally attend the regularBoard Meetings. The Board of Trustees shall regularly convene at least once every quarter. TheChairman of the Board of Trustees may call a special meeting whenever necessary: Provided, thatmembers are notified in writing at least three (3) days prior to said meeting. Provided further, thatno other agenda shall be discussed other than those in the notice of meeting.

c.Establish policies, guidelines and procedures for participative decision-making;

d.Develop academic arrangements and linkages for institutional capability building withappropriate institutions and agencies, both public and private, local and foreign;

e.Determine / approve curricular programs and course offerings in response to the needsand demands of the community provided that these should comply with the provisions

of CMO No. 10, series 2005;

f.Promulgate policies on admission, retention, and graduate of students and to awarddegree(s), title(s), diploma(s) and certificate(s). However, conferment of honorarydegree(s) or title(s) shall be in accordance with the policies and guidelines set by CHED;

g.Ensure the efficient management of non-academic services such as medical and dental,guidance and counselling, canteen, buildings, grounds, property maintenance and similar

services;

h. Institutionalize research and extension programs;

i. Appoint the President of the college upon the recommendation of the search committee;

j. Confirm appointments of other school officials, teaching and non-teaching personnel

appointed by the President;

k. Delegate any of its powers and duties provided for herein to the President and/or otherofficials of the college as it may deem appropriate so as to expedite the administration of

the affairs of the college;

1. Invite representatives from other government or private entities as resource person(s) of

the Board;

m. Determine the fees and other school charges;

n. In coordination with the Sangguniang Panlungsod, provide for the regular support forthe development, operation and maintenance of the local Higher Education Institution;

and

o. Recommend to the Sangguniang Panlungsod policies on tertiary education and other

related development legislation on effective governance and management.

Section 5. Terms of Office of the BOT. The terms of office of the Chairman, Vice-Chairman, and of the following members namely the Chairman of the Committee on Eudcation ofthe Sangguian and representatives of the Faculty, Student and Alumni Associations shall be co-

terminus with the terms of office of their respective position.

The representative of the ALCU who shall be appointed by the BOT for a specific term ofoffice shall hold the position not lower than Vice-President either from the national ALDU or its

Regional Chapter.

The representative from the accredited business or industry sector shall be appointed by theBOT for a specific term of office upon the nomination of the business or industry sector of which

the representative is a member thereof.

Section 6. Quorum. A majority of all members of the governing board holding office at the

time of its regular or special meeting shall constitute a quorum.

Section 7. Presiding Officer. The Chairman of the BOT or in his absence the Vice

Chairman shall preside over its regular or special meetings.

Section 8. Secretary of the BOT. The Secretary shall prepare minutes of the meetings ofthe BOT; keep all the records of the college; provide administrative assistance to the BOT;coordinate the schedule of BOT meetings and takes charge of the release of notices of meetings andother undertakings of the BOT upon approval of the Chairman and/or the Vice Chairman; andperform other duties and responsibilities as may be assigned by the BOT and/or by the President of

the local college.

Section 9. Budgetary Requirement and Honorarium. Funds necessary to carry out the

provisions of this Order shall be taken from available funds of the City subject to availability offunds and regular auditing guidelines and procedures. Honorarium for the Board may also be

provided in accordance with the rules and regulations of the Department of Budget and

Management.

Section 10. Repealing Clause. All issuances, memoranda and special orders issued

inconsistent herewith are hereby superseded, repealed and amended accordingly.

Section 11. Separability Clause. If any position, section or part of this Order shall be

declared unconstitutional or invalid, all other part, section or provision thereof not affected thereby

shall remain in full force and effect.

Section 12. Effectivity. This Executive order shall take effect immediately upon approval

and shall remain in frill force unless revoked or amended by the City Mayor.
