SYNOD EUCHARIST AND CHARGE:The members of the Twenty-second Session of the Provincial Synod of

the Church of the Province of South Africa assembled in the Cathedral Church of St. Michael and St. George, Grahamstown, at 5-00 p.m. on Wednesday, 24th November, 1976. The Holy Communion was celebrated by the Most Reverend Bill Bendy she Burnett, Archbishop of Cape Town and President of Synod.

After the Nicene Creed, the Provincial Registrar certified to the President that a quorum of Synod was present, and the President declared the Synod duly constituted.

The President announced that after the service Synod would re-assemble in Kimberley House, Rhodes University, at 8.15 p.m., when greetings would We brought from local churches and preliminary business would be taken. The hours uf Synod thereafter would be 9 a.m. to 12.45 p.m., and 2 p.m. to 6 p.m.

Proceedings were opened with Scripture re ding and prayer, the saying of the Nicene Creed and the singing of , he Veni Creator.The President obtained the permission of the House for the Mothers'Union representatives to be present, and for the Vicar-General of Damaraland to attend Synod and speak, but not vote.

Agendum 19: Revised Standing RulesMr Neville Matterson moved that the report of the Committee appointed by the Metropolitan at the request of Provincial Synod 1973 to"revise the standing Rules of the Provincial Synod be received.Seconded by Canon J. M. Mashikinya, and CARRIED.Mr Matterson moved the motion:

"1.That the existing standing Rules of Provincial Synod be and they are hereby repealed.

2. That tae Rules contained in the document laid before Synod and signed by the President f r identification be adopted as the Standing Rules of Provincial Syn>d.

3. That upon the adoption by Synod of the Standing Rules aforesaid they shall come into force immediately except in so far as they relate to any action required to be taken prior to the current Session of Synod in terms of the repealed Rules."

The Bishop of St John's moved the following amendment:"That Rule 8 be deleted."

Seconded by Mr J. L. Mallory of Pretoria, and LOST.The Very Revd. G. W. E. C. Ashby moved the deletion of the second sentence in rule 30 (a) (ii) from "Where such notice ... or merit the attention of Synod." Seconded by the Bishop of Natal and LOST*The Bishop of Johannesburg moved the amendment of Rule 8 by the deletion of the last sentence commencing "After the meeting".Seconded by trie Ven. E. H. Smithers, and CARRIED.Canon R.C. R. Brings was given permission to change an amendment to Rule 30 (a) (ii) to read as follows;

"Noting the comments of the Judge President of Natal, Mr Justice James, on 28th October, 1976, at the conclusion of the trial of four policemen charged with the culpable homicide of Mr Joseph Mdluli, that the uncertainties surrounding his death while in detention should be cleared up, THIS SYNOD urges the Minister of Justice, as a matter of public morality, to bring.to trial those responsible for his death, as expeditiously as possible."

Bishop Hallowes brought the following motion from Provincial Standing . Committee;

National Council for Community Service (Anglicare)Provincial Standing Committee recommends to this Synod;(1) That the Apartment of Community Service (Anglicare) •

continues to operate with its W.O. number^(2) That Anglicare alter its constitution by deleting the

word "white" in Clause 3 (l) of its constitution together with all consequential amendments?

(3) That the membership of the National Council of Anglicare be changed as soon as possible to conform with the proposed change of its constitution!

(4) That Anglicare report back to Provincial Standing Committee in 1977, and Provincial Standing Committee be authorised to take any action necessary if the above changes have not been implemented.

Canon R. C. R. Briggs to move:"Whereas certain matters of urgent concern in the life of thecountry are not dealt with in agenda before Synod, and becauseit is desirable that there be debate on these matters:That this Synods(1) expresses its deepest sympathy with all who have suffered

in black townships up and down the land who have sustained the loss of loved ones and the detention of leaders and spokesmen, and calls upon our congregations through their parish councils to give immediate and urgent consideration to ways and means of assisting and supporting those who have suffered.

(2) respectfully requests the Archbishop to ask the Anglican Bishops in those parts to which many young people from Soweto and elsewhere have fled to give responsible and compassionate help and pastoral care to them.

(3) urges all Christian people of Southern Africa to recognise the crisis times we are in, particularly in the areas of political rights, race relations and economic justice, and to commit themselves to far bolder and more determined efforts to seek to bring about a peacerful solution to these problems before war begins to rage across our lands, from which no-one will escape unscathed.

(4) urges individual Christians to recognise that it is an essential part of their Christian disc^pleship, particularly in these days, to play a responsible and personal part in the political groupings whion seem to them to embody best the Christian principles upon which a peaceful solution may be built;

(5) urges all white Christians not to put their trust in guns and legislation but in determined efforts to bring about a juster and fairer society.

(6) requests Bishops to ensure that this resolution is forwarded to parish councils for discussion and action, and further requests the Editor of "Seek" to publish it in the near future.

NOTICE OF QUESTIONS:

The Ven. A. G. Shepperson gave notice of the following question :"(1) Nhy was a change made in the old established principle

that the Dean of the Cathedral shall officiate at the enthronement of his Diocesan Bishop?

(2) Was any notification of this change given to members of the O.P.S.A*? If so? when and where?

(3) Is it the intention of those who drew up this new form of service for the enthronement of a Bishop incorporating a change of principle to submit this to Provincial Synod in terms of Canon 7 (9) for its approval? "

AGENDUM 1: CONFIRMATION OF AMENDMENT TO ARTICLE VI RE AGE OF SYNOD— — ' "REPRESENTATIVES;The Bishop of Natal, seconded by the Bishop of Johannesburg, moved the following:

"That the following amendment to Article VI of the Constitution made at the 1973 Session be confirmed, viz* :

Synod approved the measure in principle and agreed to take the committee stage after lunch the same day.

AGENDUM 18; MODEL RULES FOR THE ELECTION OF A BISHOP:Discussion on Agendum 18 was deferred until after the completion of Agendum 2.

The Bishop of Bloemfontein moved that the measure be approved in principle, seconded by the Ven. A. G. Shepperson.Synod approved the measure in principle and agreed to take the committee stage after the committee stage of Agendum 2 the same afternoon.

AGENDUM 36; MOTION EE- THE METROPOLITAN;

Proposed by Canon R. C. R. Briggs and seconded by the Rev. E. K. Mosothoan"That this Synod, gratefully acknowledging the contribution of both past and present Metropolitans to the work and witness of the Church,nevertheless recognises the growing significance of the office of Metropolitan within the Church of the Province and the church in Southern Africa, and the unifying and representative nature of this ministry!therefore respectfully requests the Synod of Bishops to appoint a commission, to report back to both Synod of Bishops and to Provincial Synod, with the following terms of references’(i) to investigate various forms of metropoiitical or

archiepiscopal government in the church today and the needs of the Church of the Province in the future, and in particular to investigate ways and means whereby the office of Metropolitan may be separated from that of the Bishop of Cape Town and it become possible for any Diocesan Bishop to be elected Metropolitan; and the desirability of any such change;

(ii) to prepare any necessary amendments to the Constitution or Canons which might be necessary to effect any recommended changej for debate at Provincial Synod at its next session.'"

The proposer and seconder accepted an amendment proposed by the Bishop of Johannesburg and seconded by the Very Revd. G. ¥. E. C. Ashby that in paragraph (i) the words after "and in particular" in the fourth Tine be deleted and replaced by "to consider whether the office of Metropolitan should be separated from the office of Bishop of Cape Town, and if so, to suggest ways and means of doing so."

Synod adjourned for lunch at 12.45, and resolved to go into committee from 2 p.m. to 4 p.m.

Members of Synod in committee resumed after tea, and the Chairman of Committee reported progress and suggested continuation of committee until 6 p.m.

The President, however, said that the Advisory Committee had recommended that Synod should consider Agendum 52 on Racial Apperception Tests.This was proposed by the Bishop of Natal and seconded by the Rt. Rev.K. B. Hall owes. Synod received the recommendation of Standing Committee and on the recommendation of the Advisory Committee agreed to devote the evening to the tests. This was put to a division and carried.It was moved by the President that Synod should go back into committee until 5.45 P*®., when a shortened evening service would be held. Synod would resume at 7.30 p.m., but attendance at this session would be voluntary.

Synod resumed at 7.30 p.m., when Canon T. D. Verryn conducted the Racial Apperception Tests.Synodadjourned at the completion of the tests.

owing answer to the question put by the Venerable A.G.Shepperson, Kimberley & K.

1. The custom of the Dean enthroning the Bishop is peculiar to the Church of England, where the Dean has virtually the freeholdin the Cathedral and the Bishop may only claim the use, as of right of the Cathedral for such purposes as Ordinations. This position does not obtain in South Africa. It is believed that the enthrone -ment of a new Bishop by the Metropolitan or his deputy emphasises that the Bishop represents the Universal Church as well as the local Diocese. The role of a Dean at an enthronement is preserved at important points in the service; for example, in the formal welcome at the door of the Cathedral and in the presentation of the new Bishop to the congregation as their "undoubted Bishop".2. The newcform of service, after approval thereof by the Synod of Bishops, was tabled at Provincial Synod in 1970, and it is open for Provincial Synod at any time to adopt it or otherwise. This is the normal procedure that has been followed in the case of occasional offices.3. In view of the answer "2" above, the answer is in the negative, but it is open to anyone to give notice of a motion in this regard.

"to consider the role of the Metropolitan within the Churchin Southern Africa today."

shall he recognized under Article XXIV 3 of the Constitution as. Bishops of the Province.

8. A Bishop-Suffragan shall he a member of the House of Bishops in the Synod of his Diocese and as such entitled to vote both in the Synod and the House of Bishops ; provided that in any Diocese in which a Bishop-Suffragan is appointed, the Bishop of the Diocese shall have both a deliberative anda casting vote in the House of Bishops. No Bishop- Suffragan shall, however, by virtue of his office as such be the Senior Priest of the Diocese.

9. (Present Section 10, amended) A Bishop-Suffragan shall hold the Commission of the Bishop of the Diocese and his successors, and during any vacancyof the See, that of the Metropolitan, for the powers, authorities, duties and responsibilities which were specified in the application to the Synod of Bishops for the creation of his office, which powers, authorities, duties and responsibilities shall be stated in such Commission. The said Commission shall not be withdrawn, SaVE AS IS PROVIDED IN SECTIONS 12 TO 15, nor shall the_said powers, authorities, duties or responsibilities be altered, save with the consent of the Bishop-Suffragan or the authority of the Synod of Bishops given after hearing any representation which the Bishop of the Diocese and the Bishop-Suffragan may wish to make on the matter.

10. (Present Section 7 amended) A Bishop-Suffragan shall be subject to the authority of his Diocesan Bishop in all matters of policy, doctrine and discipline, and if he is aggrieved by any decision or direction of his Diocesan Bishop in regard to the aforesaid matters, he shall have the right of appeal provided in SECTION 9, the terms whereof shall apply so far as is relevant, to such appeal.

11. Notwithstanding the provisions of_SECTION 9, if a new Diocesan Bishop shall be appointed^in any^ Diocese in which any Bishop-Suffragan is appointed, such new Diocesan Bishop may, with the authorityof the Synod of Bishops given after hearing any representations which the Diocesan Bishop and the Bishop-Suffragan may wish to make on the matter, withdraw or alter the Commission of such Bishop- Suffragan for any good cause shown to the Synod of Bishops.

12(a) A Bishop-Suffragan shall reside within his Diocese unless, upon the ground of ill health or other important considerations, it should for a time be undesirable ; and of such exceptional circumstances the Bishop of th.e. Diocese, and failing him the Metropolitan, shall ..judget

(c) In the event of any Bishop-Suffragan being absent from his Diocese, except' for dutyT without the consent required in terms of sub-section (b) afore­said, it shall be competent for the BISHOP OP THE DIOCESE to give him three months1 notice in writing to return to his Diocese, and should he fall then ^o return timeously, the BISHOP OF THE DIOCESE may, with the consent of the majority of the Bishops of the Province, withdraw 'the Commission of the Bishop-Suffragan.

13. 14. UPON THE REPRESENTATION TO THE METROPOLITAN OF AT LEAST THREE BISHOPS OF THE PROVINCE AND AFTER DUE CONSIDERATION BY THE SYNOD OF BISHOPS OF ANY REPRESENTATIONS WHICH THE BISHOP-SUFFRAGAN AND HIS DIOCESAN BISHOP M Y WISH TO MAKE, THE COMMISSION OF THE BISHOP SUFFRAGAN MAY BE REVOKED BY THE DIOCESAN BISHOP (OR FAILING HIS AGREEMENT BY THE METROPOLITAN) IF AT LEAST TWO THIRDS OF THE SYNOD OF BISHOPS DECIDE THAT THE BISHOP-SUFFRAGAN IS NO LONGER ABLE TO DISCHARGE ADEQUATELY THE DUTIES OF HIS OFFICE.

13. (From present Sections 10 and 11) The Synod of Bishops shall not authorise any withdrawal of the Commission of a Bishop-Suffragan without first being satisfied that he will be adequately provided for in some way.

16. IF A BISHOP-SUFFRAGAN SHALL DESIRE TO RESIGN HIS COMMISSION, HE SHALL SEND HIS RESIGNATION TO THE BISHOP OF THE DIOCESE (OR FAILING HIM THE METROPOLITAN IN 'WRITING. THE BISHOPS OF THE PROVINCE SHALL JUDGE WHETHER THE RESIGNATION SHOULD BE ACCEPTEDOR NOT.THE PROVISIONS OF THE LAST FOREGOING SENTENCE OF THIS SECTION SHALL NOT APPLY WHEN A BISHOP-SUFFRaGAN IS ELECTED AS BISHOP OF A DIOCESE OR SO APPOINTED BY A DELEGATION M D E IN TERMS OF SECTION 12 OR SECTION 23 of Canon 3 OF THE ELECTION OF BISHOPS.

17. 11. Notwithstanding the provisions of SECTION 9, if a new Dioceaan Bishop shall be appointed in any Diocese in which any Bishop-Suffragan is appointed, such new Diocesan Bishop may, with the authorityof the Synod of Bishops given after hearing any representations which the Diocesan Bishop and the Bishop-Suffragan may wish to make on the matter, withdraw or alter the Commission of such Bishop- Suffragan for any good cause shown to the Synod _ of Bishops.

(Present Section 13 unamended) The title of Assistant Bishop may he conferred upon a retired Bishop holding special Letters of Appointment issued by a Diocesan Bishop, Assistant Bishops shall have no right to be summoned to meetings of the Synod of Bishops and their Letters of Appointment shall in no ws,y confer any new Canonical rights upon them.

19. THE FUNCTIONS ASSIGNED TO THE METROPOLITAN IN THIS CANON SHALL, IN THE EVENT OF THE METROPOLITAN COMING UNDER ITS PROVISIONS, BE EXERCISED BY THE DEAN OF THE PROVINCE.

20. (present Section 12 amended) Bishops—Suffragan holding office at the date when this Canon comes into force shall be deemed to have received their Commissions in terms hereof, and they shall continue in office subject to the provisions of SECTIONS9 TO 17.

on Christian Initiation, with the printed amendments submitted to Provincial Synod;

(2) resolves that further discussion on this report he post­poned in this Synod;respectfully requests the Archbishop to appoint a com-

"There has never been, to the best of my knowledge, any specific provision in the Anglican Communion for the training of bishops in the areas indicated in the Question. That is not to say that recently elected bishops are any less fit and qualified for their task than those before them. St Francis de Sales once said that in marriage the pro ession comes before the novitiate. This perhaps may also be said of the training of bishops. His diocese, like a man's wife, can teach a bishop many lessons for his own good, if he is prepared to listen.It is also true that the training a bishop once received in his theol­ogical college for the pastoral and prophetic work of a priest serves him equally well, if he was a studious pupil, in his performance of these two essential functions of the episcopate. Episcopal Synod at every session sets aside a time for the bishops to share the problems which arise in their work, so that they gain valuable insights into

V. H. Matterson, proposed the motion standing in his name, amended as follows:"That in the light of further legislation in the Parliament of the Republic of South Africa, which extended the provisions of earlier legislation, hy which established principles of the rule of law concerning habeas corpus had already been abrogated, this Provincial Synod expressed deep concern and resolves(a) Respectfully to request the Metropolitan and the representatives

to the Provincial Synod, to oonTey to our brethren in Christin all the Dioceses of the Church of the Province of South Africa within the Republic, our deep concern.

(b) That the Metropolitan be respectfully requested to ask the S.A.C.C. to appoint a theological commission, which, recalling the "Message to the People of South Africa on Apartheid" issued in 1968,be invited to prepare and make an agreed declaration on civil and religious liberty in South Africa, taking into account all the relevant theological, ethical and political issues involved."

"Noting the comments of the Judge President of Natal, Mr Justice James, on 28th October, 1976 at the conclusion of the trial of four policemen charged with the culpable homicide of Mr Joseph Mdluli, that the uncertainties surrounding his death while in detention should be cleared up, THIS SYNOD urges the Minister of Justice to give direction that the cause of death be investigated afresh, and if it should be discovered that'fcis be other than as a consequence of natural causes, then as a matter of public morality, to bring to trial those responsible for his death, as expeditiously as possible."
