I. OPENING BUSINESS

I.A. CALL TO ORDER – 4:15 P.M. 1. Roll Call President Blair called to order the regular meeting of the Board of

Education, Thursday, January 15, 2015, at 4:15 p.m. with Feix, Na, Orozco, and Blair present. Cruz arrived at 4:17 p.m.

Administrative Personnel Wayne M. Joseph, Superintendent Norm Enfield, Ed.D., Deputy Superintendent (absent) Sandra H. Chen, Assistant Superintendent, Business Services Patricia M. Miller, Assistant Superintendent, Student Services Grace Park, Ed.D., Assistant Superintendent, Human Resources Gregory J. Stachura, Assistant Supt., Facilities, Planning, and Operations 2. Public Comment on Closed Session Items Joe McTarsney addressed the Board in support of invocations at Board

meetings and presented the Board with supporting signatures. 3. Closed Session President Blair adjourned to closed session at 4:15 p.m. regarding student

discipline matters; student readmissions; conference with legal counsel-existing litigation; conference with labor negotiators, A.C.T. and CSEA; and public employee discipline/dismissal/release.

I.B. RECONVENE TO REGULAR OPEN MEETING – 7:00 P.M. 1. Report Closed Session Action President Blair reconvened the regular meeting of the Board of Education

at 7:00 p.m. The Board met in closed session from 4:15 p.m. to 6:46 p.m. regarding student discipline matters; student readmissions; conference with legal counsel-existing litigation; conference with labor negotiators, A.C.T. and CSEA; and public employee discipline/dismissal/release. The Board took action to direct the Superintendent to bring a recommendation and proposed action to the next Board meeting to retain a law firm that will defend the CVUSD without charging attorney fees in the existing litigation:

2. Pledge of Allegiance Principal Ryan Cummins, Briggs K-8, led the Pledge of Allegiance. Peter Patel, BAPS Shri Swaminarayan Mandir Temple, gave an invocation. I.C. PRESENTATIONS 1. Student Showcase: Briggs K-8 Nuria Davis, Briggs K-8 teacher and dance team advisor, led 4th and 5th

grade students in a dance performance. 2. Employee Retirement Recognition President Blair and Denise Arroyo, CSEA President, recognized retiring

classified employee Bernice Gray (in absentia) for 29 years of service. 3. Special Recognition: Janet Gasio, Liberty ES Janet Gasio, 1st grade teacher at Liberty ES, received a certificate of

recognition for her contributions to the school. 4. H.O.P.E. Committee: Family Resource Centers, Liz Lara; Richard and Lisa

Montijo; Melissa Rosas; Rosa Olguin; Christina Andreas; Angela Milversted; Luz Conner; Kevin Cisneroz; Rachel Arreguin; and Sherry Young; Missy Burnette; and Massiel de Guevara

Liz Lara, Child Development Program Technician, provided a presentation on the work of the H.O.P.E. Committee. President Blair presented certificates of recognition to Richard and Lisa Montijo; Melissa Rosas; Rosa Olguin; Christina Andreas; Angela Milversted; Luz Conner; Kevin Cisneroz; Rachel Arreguin; and Sherry Young; Missy Burnette; and Massiel de Guevara for their help and assistance for a young family in need.

I.D. COMMENTS FROM STUDENT REPRESENTATIVE Carissa Ramirez spoke about the proposed adjustments to the school

calendar, and shared student comments on the issue. I.E. COMMENTS FROM EMPLOYEE REPRESENTATIVES Todd Hancock, A.C.T. President, shared Theodore Roosevelt’s quote

regarding responsibility; thanked the Board for adjusting some of the Professional Learning Community meetings; expressed appreciation for the collaboration on the calendar issue; congratulated Janet Gasio for her contributions; recognized the H.O.P.E. Committee; quoted Mary Kay Ash regarding making others feel important; and quoted Walt Disney regarding people making dreams a reality.

Denise Arroyo, CSEA President, extended new year greetings; apologized for not attending the December organizational meeting because her daughter had a baby; praised Liz Lara on her presentation; spoke on the Governor’s proposed school budget; addressed CSEA vacancies and positions; said the Association is requesting that the District restore positions; asked for clarification on the item on the agenda for contractor/consultant agreements regarding contracting out substitutes; spoke about the use of non-student days and the need for training opportunities; expressed condolences to CSEA unit member Margaret Makorow for the loss of her husband Larry Makorow, who worked at Woodcrest JHS as an instructional aide; and extended best wishes to Delia Smallwood, Don Lugo HS secretary, who recently had surgery.

I.F. COMMENTS FROM COMMUNITY LIAISONS None. I.G. COMMENTS FROM THE AUDIENCE ON ITEMS NOT ON THE AGENDA Russell Mills, Anthony Vela, Lorette Peruch, James Reid, Gustavo Reza, Karen

Haughey, and Cherie Wood addressed the Board regarding invocations at Board meetings.

I.H. CHANGES AND DELETIONS The following items were read into the record: Item III.E.2., Facilities,

Agreements for Contractor/Consultant Services, Deputy Superintendent, contract DS-1415-005, ESL 4 Asia, corrected term to read January 16, 2015, through March 30, 2015; and deleted contract F-1415-016 with Student Transportation of America; Item III.E.7., Facilities, Resolution 2014/2015-27, Adopting Notice of Exemption for Storage Yard License Agreement, deleted this item from the agenda; and Item III.F.1., Human Resources, Certificated Personnel Items, under Hired at the Appropriate Placement on the Certificated Salary Schedule and Appropriate Credential for the 2014/2015 school year, under position, corrected to read International Student Counselor.

BOARD MEMBERS AND SUPERINTENDENT James Na said he recently visited Chino HS and a lockdown situation ensued due to a potential threat to the school; said students commented about terrorist attacks in France; said we need to appreciate servicemen and our nation; read a portion of Martin Luther King’s “I Have a Dream” speech; and closed with his prayers for teachers and staff members going through hardships or illnesses. Pamela Feix said she attended the Oak Ridge ES spelling bee yesterday and said it went 25 rounds; attended the CSBA Annual Education Conference in San Francisco this last December; and recommended reading Amanda Ripley’s book “The Smartest Kids in the World.” Sylvia Orozco congratulated Superintendent Joseph and Liz Lara on the H.O.P.E. Committee’s accomplishments, and said she is inspired by the community who comes together and is willing to help; said that at last night’s ROP meeting, the process has started on the re-writing of the joint powers agreement with the four districts and that it will come before our Board thereafter, and that it is also working on a new funding formula based on district participation; thanked individuals for the phone calls, emails, those who came to the meeting, and the 1,000 signatures that were presented to the Board in support of invocations at Board meetings; asked Superintendent Joseph to look into CSEA training opportunities and what can be provided.

Minutes of the Regular Meeting of the Board of Education January 15, 2015

Andrew Cruz said he attended the CSBA Annual Education Conference and noted that President Blair was a guest speaker for the arts academy; visited several elementary schools; thanked Sandra Chen for doing excellent work relative to the audit that was completed; spoke about his uncles who fought in WWII; stated that we have to look at our leaders because they are eroding our rights and moving away from God; expressed concern at the country’s leadership and that it should be examined in light of the terrorist attacks in Paris; said we should not focus on terrorists, but rather focus on the response of our leaders; spoke about MIT research on autism; and wished everyone a happy new year. Superintendent Joseph congratulated Mark Stone, Ayala HS band instructor, for being selected as a finalist for the California League of High Schools Educator of the Year for Region 10; said Principal for a Day is scheduled for Thursday, February 12, 7:00 a.m., Liberty ES; said students and staff shared good will and good fortune with families in need over the holidays; and extended appreciation to everyone helping those in need. President Blair extended new year wishes; commended Liz Lara and staff working on behalf of the CARE and H.O.P.E. programs; said she is grateful for those who drop off clothing to the CARE program, and encouraged everyone to donate the appropriate attire for young girls and boys who want to look and feel special at upcoming school dances; thanked individuals who stepped up during the holidays to help students and families in need in the Chino Valley; said she wants to begin the conversation with Superintendent Joseph and cabinet regarding combination classes; said she doesn’t know how to fix it, but that collectively a solution can be derived to make it better for the upcoming school year; said it is important to start the conversation now rather than August or September; said she would like the District to start looking at offering breakfast at more school sites; spoke on Kaiser (Permanente) partnering with the PATHWAYS program; said there is a portion of the student population who will be working with their hands and that transportation is an issue with classes offered through ROP; said we need to figure out how to partner with local businesses, such as auto repair shops, plumbers, barbers, to meet student needs; said that consideration must be made for the restoration of more safety officers because of the recent bomb threat; thanked Superintendent Joseph and his staff for helping her with her first meeting; and thanked cabinet for being patient with her.

The goal of the Nutrition Services Department is to ensure students in the Chino Valley Unified School District receive healthy and nutritious meals during the school day. A healthy meal is essential to a student’s full learning potential, making the Nutrition Services Department an essential link to student success in the classroom. Lunch Meals The Healthy, Hunger-Free Kids Act of 2010, Public Law 111-296, mandates Nutrition Services to complete an annual paid lunch equity calculation to ensure that the school district is gradually increasing the price of the meals offered and not encroaching on the general fund. The National and State reimbursement subsidizes the cost of the meals served to K-12 students.

In accordance to the federal law, staff is recommending the Board approve an increase in school lunch prices at the elementary and junior high schools as mandated. Using the paid equity calculator, the current high school and adult lunch prices are in compliance with the National School Lunch Program. Additionally, the reduced lunch price will also remain the same at $0.40.

Breakfast Meals With the recent increase to food and labor costs, the current breakfast program is financially impacting the Nutrition Services Cafeteria Fund. In 2014/2015 five additional schools are being served breakfast, bringing the number of schools serving breakfast to 23. The average cost to the District of each breakfast served is $0.90 per meal at the elementary schools and $1.15 per meal at the secondary schools. Breakfast prices have remained unchanged for the past four years. In order for Nutrition Services to remain financially solvent, a price increase is warranted. Staff is recommending the Board approve a minimal increase in school breakfast prices at the elementary and secondary schools. Additionally, the reduced breakfast price will remain the same at $0.25.

When these policies and standards are violated, it may be necessary to suspend or expel a student from regular classroom instruction. Expulsion is an action taken by the Board for severe or prolonged breaches of discipline by a student. Except for single acts of a grave nature, expulsion is used only when there is a history of misconduct, when other forms of discipline, including suspension, have failed to bring about proper conduct, or when the student's presence causes a continuing danger to him/herself or others. A student may be expelled only by the Board of Education. The Board shall expel, as required by law, any student found to have committed certain offenses listed in Education Code 48915. Approval of this item supports the goals identified within the District’s Strategic Plan. RECOMMENDATION Based upon the recommendation of the Expulsion Hearing Administrative Panel, it is recommended the Board of Education approve the student expulsion cases 14/15-20 and 14/15-21. HIGH SCHOOL AND CHINO VALLEY LEARNING ACADEMY ==================================================================== BACKGROUND On June 13, 2013, the Board of Education adopted the 2014/2015 school calendar. In order to prepare CVUSD’s implementation of Common Core State Standards, the District has designated four District-wide professional development days to train staff. These days are reflected on the attached calendars for Boys Republic High School and Chino Valley Learning Academy listed as student free day/teacher professional development day. The previously adopted calendar is being revised to reflect these days. Implementing the CCSS demands fundamental shifts in how we prepare students to be college and career ready which calls for a significant increase in learning expectations focusing on deeper understanding of content and higher levels of thinking and application. Transitioning to the CCSS requires leadership that is well versed in the learning and teaching demands of the CCSS and how to effectively implement and monitor its implementation. Approval of this item supports the goals identified within the District’s Strategic Plan. This proclamation is a means of recognizing the District’s support of Save a Sweet Heart Day on February 13, 2015. As part of the Save a Sweet Heart Day, several schools will participate in school site activities to encourage students and staff to stop smoking and improve their health. Participating student groups and clubs sponsor secondary school activities. Students will receive educational items to reinforce tobacco use prevention. Approval of this item supports the goals identified within the District’s Strategic Plan. Chino Valley Unified School District Proclamation

Save a Sweet Heart Day February 13, 2015

WHEREAS, Save a Sweet Heart Day encourages smokers to quit; WHEREAS, increasing numbers of children are experimenting with a product that can produce a lifetime addiction with an increased risk of cancer; WHEREAS, more Americans die every year from tobacco-related diseases than from AIDS, alcohol, car accidents, fires, illegal drugs, murders, and suicides combined; WHEREAS, youth-related promotions such as Save a Sweet Heart Day encourage youth not to smoke; and WHEREAS, the health benefits of not smoking are substantiated and well known. NOW THEREFORE, BE IT RESOLVED, the Board of Education of the Chino Valley Unified School District does hereby support February 13, 2015, as Save a Sweet Heart Day in this District, and in doing so, urges all smokers and smokeless tobacco users to demonstrate to themselves and our children that they can quit, and to further encourage our children not to start smoking. The Board encourages its students and staff to participate in tobacco use prevention education activities, making a visible statement that we are firmly committed to a tobacco-free community; and BE IT FURTHER RESOLVED, the Board of Education of the Chino Valley Unified School District encourages all students, staff, and the community to adopt this proclamation. Claimant alleges that her vehicle sustained damage after a gate swung into the side of the vehicle while parked in the school site parking lot. Claimant seeks reimbursement for vehicle damage in the amount of $587.54. The Board is requested to reject the claim against the District to allow the insurance carriers to investigate the merits of the claim and make a recommendation regarding disposition. WILLIAMS FINDINGS DECILE 1-3 SCHOOLS SECOND QUARTERLY REPORT 2014/2015

==================================================================== BACKGROUND California Education Code 1240 requires that the San Bernardino County Superintendent of Schools visit all decile 1-3 schools (Williams monitored schools currently based on the 2009 Academic Performance Index and all Quality Education Investment Act schools) identified in the county and report the results of findings on a quarterly basis to ensure compliance with the Williams Legislation. The San Bernardino County Superintendent of Schools office is required to file quarterly reports on schools progress in rectifying any findings. The attached report serves as the district fourth quarterly report for the 2013/2014 school year. Consideration of this item supports the goals identified within the District’s Strategic Plan. RECOMMENDATION It is recommended the Board of Education receive for information the San Bernardino County Superintendent of Schools Williams Findings Decile 1-3 Schools Second Quarterly Report 2014/2015.
