Liu Chuntian, Renmin University of China 刘春田, 中国人民大学知识知识产权学院

Professor Liu enrolled in Renmin University in 1978. He followed Professor Tong Rou in his graduate

courses in civil law and since then has been teaching for more than 20 years. In 1985, Professor Liu

Chuntian established the first intellectual property law courses in China, which became part of the training

program for law undergraduates.

Over the years, Professor Liu has contributed significantly to the evolution of a number of important pieces of legislation. These

laws are the very foundation of intellectual property law in China. He has taken part in the drafting and amendment of the Patent

Law, Trademark Law, Copyright Law, Anti-unfair Competition Law and other intellectual property legislation.

Professor Liu recalls that when drafting the Copyright Law there were disagreements over whether it should be called banquan,

the literal translation of copyright or zhuzuoquan with the focus on an author’s rights, but literally translated as the right in a work.

Liu believed that banquan may lead to a one-sided understanding of the publisher’s rights, while zhuzuoquan has no such

possibility of such a misunderstanding. Finally, zhuzhuoquan was used as the official title for the first PRC Copyright Law back in

1990, when it was passed by the fifteenth session of the National People’s Congress.

In 2009, Renmin University formally announced the establishment of the Intellectual Property School. As the founding Dean of the

IP School, Professor Liu Chuntian continues to educate China’s next generation of intellectual property lawyers and advocates.

There is no doubt that for many years to come, Professor Liu’s efforts and expertise will serve to advance the development of

China’s intellectual property structure.

刘教授于 1978 年考入人民大学。他在民法研究生课程中师从佟柔教授，自此之后逾二十载孜孜不倦地教书育人。1985 年，刘春

田教授开设了中国第一门知识产权课程，该课程已成为法律本科生培训大纲的一部分。

多年以来，刘教授为数部重要法规的进展做出了重大贡献。这些法律是中国知识产权法的根基之所在。他参与了专利法、商标法、

著作权法、反不正当竞争法和众多其他知识产权立法的起草和修订。

据刘教授回忆，当年起草著作权法时，曾经就法律名称应采用“版权”还是“著作权”发生分歧。前者是“Copyright”的字面译文，

而后者侧重于作者的权利，但字面翻译则是在著作中的权利。刘教授认为使用版权可能导致对出版商权利的片面理解，而著作权则

不会引起此类误解。最终，经 1990 年第七届全国人大第十五次会议批准，第一部中华人民共和国著作权法的正式名称中采用了

“著作权法”的译法。

2009 年，人民大学宣布正式成立知识产权学院。在知识产权学院创办院长的岗位上，刘春田教授继续教育着中国下一代知识产权律

师。毫无疑问，刘教授所作努力和专业知识在未来很多年中都将帮助推动中国知识产权体系的发展。

Tom Duke, British Embassy Beijing 杜涛, 英国驻华大使馆

Tom Duke has been the UK’s intellectual property attaché to China since December 2011, based in the

British Embassy, Beijing. Tom is part of the UK Intellectual Property Office’s international IP attaché

network, which includes attaché postings to India, Brazil and South East Asia.

IP attachés help to build relations with the governments of host countries to understand and actively engage with IP policy makers.

The network has significantly increased the level of support available for UK businesses operating within these important markets.

Tom works alongside UKTI, the British diplomatic network, and UK and EU-level industry associations and projects to ensure that

UK stakeholder IP concerns are addressed and smoothly integrated into bilateral policy discussions.

Prior to joining the embassy, Tom was Director responsible for the IP Centre at the EU Chamber of Commerce in Seoul, South

Korea. In Korea, Tom designed and implemented government engagement programmes on IP on behalf of European companies,

and launched projects to enhance regional cooperation in IP enforcement.

Tom has lived and worked in the region for eight years and speaks fluent Mandarin Chinese and Korean.

Alex An, JK Sucralose 安立军, 盐城捷康三氯蔗糖制造

An Lijun, Deputy to the People’s Congress of Jiangsu Province, Senior International Business

Development Executive, is the Board Director, General Manager of JK Sucralose Inc.. He is also one

of the founders of the company.

Mr. An is the recommended experts by the Mofcom’s IP Overseas Protection Center. He has a

professional legal background and more than ten years company management experience. His

concept of "preventive actions mean an investment, and remedial actions mean expenses” is an innovative idea, which is applied

as the basic theory for corporate management and market development strategy.

The strategy of “market growth supporting legal defense and legal defense promoting the market competition” is to be combined

together of market and legal implementation, which lead JK volunteered to join the U.S. ITC-337 investigation, when JK is not the

defendant's case. Therefore, JK has become the first enterprise voluntarily intervened the US ITC-337 investigation and won the

case in the history of SINO-US intellectual property litigation. JK’s case was included in the first of the ten classic case of

intellectual property by the China Intellectual Property Office.

Up to now, JK became the largest Sucralose manufacturer in China and the second largest in the world after winning of the case.

JK Sucralose products is now supplying to various industry of the global food, beverage, health care products, pharmaceuticals,

etc., and sold in over 90 countries and regions around the world.

Saif Aziz, IBM 盛世安, IBM

Saif Aziz is the IBM Technology & IP licensing (T&IP) Exec at IBM Greater China, responsible for

promoting and managing IBM’s IP Licensing programs in China, Taiwan and Hong Kong. His main focus

is monetizing IBM IP developed by IBM Research, Systems & Software and IBM Microelectronics

business units through a range licensing and collaborative joint development initiatives. He has over 30

years of IT industry experience with the last 11 years spent directly with IBM T&IP business unit. During

this time he negotiated and executed numerous technology license and joint development agreements, patent cross-license and

assignment engagements globally. His experience in IP ranges from patent proof package development, patent and technology

valuation, opportunity identification and progression and negotiating IP business terms.

Prior to joining IBM US in 1996, Saif spent close to 15 years with numerous IT companies globally in various roles, ranging from

tech support, project and program management, marketing and sales. He has a degree in Electrical Engineering from the Indian

Institute of Technology, India and a Masters Certificate in Project Management from George Washington University, Washington

D.C., USA.

Chris Benson, Harrison Goddard Foote

Chris principally handles patent matters in the areas of electronics, computer software and physics.

Chris has prosecuted and advised on patents relating to electronic circuits and systems, including

computer processors and semiconductor devices, computer based inventions, such as graphics

processing, computer algorithms and computer communications, consumer electronics such as

navigation devices and home electronics, and also carbon nanotube-based inventions.

Chris represents a wide range of clients from multi-national companies to start-up companies at the outset of developing their IP

portfolio. Chris regularly attends proceedings at the European Patent Office, particularly before Examining Divisions. Chris has

also represented clients in proceedings before the UK Intellectual Property Office.

Chris graduated from Lancaster University in 1999 with a first class degree in Computer Systems Engineering. He then obtained a

PhD from Lancaster University through the study of electronic radiation detectors and the effect of radiation on microelectronic

devices. His PhD studies involved the production of a microelectronic dosimeter for real-time in-vivo radiation dosimetry of patients

during radiotherapy and the response measurement of MOSFET- based dosimeters to differing radiation fields.

Chris qualified as a Chartered and European patent attorney in 2006. Chris joined Harrison Goddard Foote in 2008 and became a

partner in 2010.

Richard Bird, Freshfields 富而德律师事务所

Richard is a Counsel in the Asia IP/IT practice group and is based in the firm’s Hong Kong and

Shanghai offices. Richard’s practice spans intellectual property, information technology, commercial

law and pharmaceutical regulatory advice. Richard's main focus is on the commercialisation of IP

rights in licensing and technology transfer, and in R&D and other types of partnering agreements.

His practice also includes significant trade mark and patent litigation and other enforcement work in

China and Hong Kong. He has particular experience in providing intellectual property advice in the

life sciences, consumer goods and low carbon sectors in China. Recent work highlights include concluding the first co-marketing

agreement in China (for a US pharmaceutical company), helping a leading European automobile company to launch a range of

electric vehicles for the China market under a new brand, and assisting China’s Geely to acquire Volvo Corporation from Ford.

Tom Brand, WP Thompson

Tom is a Chartered Patent Attorney, European Patent Attorney, European Trade Mark Attorney

and Registered Trade Mark Agent. A chemist by training, with BSc and PhD degrees in

chemistry from the University of Manchester, he is also a Chartered Chemist (CChem) and a

Member of the Royal Society of Chemistry (MRSC).

Tom’s practice is based primarily on domestic clients, but also encompasses a wide range of

clients from around the world and from many different technology areas. These areas include mechanical, automotive, fuel cells

(both electrochemical and graphitic), organic and polymer chemistry, chemical engineering, medical devices, wound care,

diagnostics, cell separation, catalysis, microencapsulation, therapeutics and assay equipment.

Tom has longstanding experience in filing and prosecuting patent applications on a global basis. For example in the field of

polymer chemistry, he acts effectively as in-house counsel for a major global manufacturer in the areas of biaxially oriented

polypropylene (BOPP) films and cellulosic films. He performs a similar role for a leading supplier of force protection equipment to

the US and many other militaries.

Tom files and prosecute patent and trade mark applications worldwide for these and other clients, and represent his clients in

oppositions, in an advisory capacity in litigation, and also advise in connection with operational freedom and in all commercial

areas affected by intellectual property.

Tom is also a contributor to various publications, most recently The United Kingdom Trade Mark Handbook (Sweet & Maxwell,

2012) and From Innovations to Cash Flows (Wiley, 2009) and he has been cited in The Legal 500 (2012) as being “very

knowledgeable”.

Neel Chatterjee, Orrick 奥睿律师事务所

Neel Chatterjee, co-chair of Orrick's global Intellectual Property Group, concentrates his practice on

complex litigation for technology companies. Mr. Chatterjee is nationally recognized for his

experience in patent litigation, Internet liability litigation, trade secrets litigation and technology

transactions litigation. He has particular experience with Internet, software, computer networking and

Hsu Min specialises in patents in the fields of chemistry, material science and pharmaceuticals.

Her experience includes drafting and prosecuting patent applications in a wide range of

technologies, including those relating to pharmaceuticals, catalytic processes, household products,

electrochemistry, petrochemicals, osmosis, medical devices and polymers.

Hsu Min has a wealth of experience in European Oppositions and Appeals and regularly

represents clients at Oral proceedings at the European Patent Office. She manages substantial patent portfolios and regularly

provides clients with opinions on their freedom to operate in the light of third party rights. She has also produced due diligence

reports for company flotation’s on AIM. She works for a variety of clients including universities, start-ups and multi-national

corporations.

Hsu Min entered the patent profession after gaining a First Class Honours Degree in Chemistry from Oxford University. She joined

HGF as a partner in 2011, having been a partner at another major patent firm. She has authored a number of articles including

several articles for Bio-Science Law Review.

Born in Malaysia and educated in Europe, Hsu Min speaks Italian, Mandarin, Cantonese and French, in addition to English her

mother tongue.

During his career, Brett has also worked in the patent profession in Japan and Singapore and now

actively manages the International patent portfolios of a number of clients. Brett has worked as an

in-house patent counsel in the patent department of a large Australian company, where he worked

with researchers, obtained protection for inventions and commercialised the outcomes

Brett Connor joined private practice in 1989. He has expertise and experience working with both

large and small local clients in Australia, developing appropriate intellectual property protection strategies for inventions,

Joaquim Eugenio Goulart is a partner of Dannemann Siemsen. He has a Law Degree at the

Catholic University of Rio de Janeiro and he is specialized in Economic and Corporate Law at

Fundação Getúlio Vargas (FGV). He has a LLM in Intellectual Property Law from John Marshall

Law School in Chicago, Illinois.

He is also adjunct professor of International Intellectual Property Law at the Post Graduation

Dr. Jennifer Jian Kang works as a senior patent counsel with Bayer China Legal department. She primarily practices intellectual

property law and focuses on the fields of pharmaceuticals, chemicals, biotechnology, agrichemicals, and medical devices. She is

responsible for IP related matters of Bayer Greater China and supports the company’s business and R&D center by providing

Esther H. Lim has a broad patent practice, including litigation, prosecution, licensing, opinions, due

diligence, and portfolio management. She has represented many international companies from

Asia, Europe, and the United States in complex cases. Ms. Lim served as the founding managing

partner of the firm’s Shanghai office.

Ms. Lim frequently lectures and writes internationally on issues relating to procurement and

enforcement of U.S. intellectual property rights. She is the editor-in-chief of the Last Month at the Federal Circuit, Finnegan’s

monthly newsletter distributed to subscribers worldwide. Ms. Lim taught advanced patent law and public policy courses as an

adjunct professor at Howard University School of Law in the United States for six years. In 2010, she started teaching IP courses

to postgraduate students at Renmin University and Shanghai Jiao Tong University in China.

Ms. Lim served as a law clerk to the Honorable Randall R. Rader of the U.S. Court of Appeals for the Federal Circuit.

Mr. Liu is currently the IPR director for ZTE Corporation, a leading global provider of telecom

equipment and network solutions with over 70,000 employees worldwide. He is responsible for ZTE’s

IP licensing and litigation matters, as well as IP related contractual issues, over the years with this

company, he has been involved in various kinds of IP licensing deals, and has handled contentious IP

cases such as patent/copyright litigation, 337 ITC investigation and border detentions in different

jurisdictions including China, Europe and US. His key interest and experience on enterprise IP also

include IP strategy planning and implementation, IP prosecution and management, anti- IP risk system

establishment and commercialization of IP Assets.

Mr. Liu graded from Peking University with a master degree in Law; he is a Certified Chinese Patent Agent and a qualified Attorney

at Law.

Kevin Luo, Microsoft罗立凡, 微软

Dr Kevin Luo is presently the general manager of legal affairs for Microsoft Asia-Pacific Research and

Develop Group (“Microsoft ARD”). He has the overall responsibility for all legal issues for Microsoft ARD

as well as patent issues relating to the region.

Microsoft ARD is Microsoft’s largest R&D center outside the US. It has over three thousand people

conducting world-class research or contributing to the development of Microsoft’s major products.

Prior to his current position, Dr Luo was the associate general counsel for patents for the Server and Tools Business of Microsoft,

a business with over US$16 billion in annual revenue. He led a team of attorneys, patent agents, technical analysts, and

paralegals, and was responsible for all aspects of patent-related matters for the business. The Server and Tools Business

develops and markets world leading enterprise IT products and solutions, such as servers, database products, system

management tools, cloud computing platforms, and programming tools.

Before this, Dr Luo held the position of the director of IP licensing and senior licensing counsel of the IP Licensing Group at

Microsoft, and he worked as the lead patent attorney for Microsoft’s Windows Division.

Ethan Ma, Corning Inc.

Yufeng (Ethan) Ma is the Director of Intellectual Property, East Asia with Corning Incorporated. Prior to

assuming his current position in January 2012, he was a senior partner and board member of the law

firm McAndrews, Held & Malloy, Ltd. in Chicago, Illinois, where his practice focused on intellectual

property law. As a patent attorney, Mr. Ma served clients in the U.S. and internationally on intellectual

property matters with a focus on intellectual property litigation and U.S. International Trade Commission

(ITC) investigations. He holds a Bachelor of Laws degree from Peking University in Beijing, China, and a Juris Doctor degree from

Vanderbilt University School of Law in Nashville, Tennessee.

He also holds a Bachelor of Science in Chemistry from Peking University and a Master of Science degree in Chemistry from

Vanderbilt University. Mr. Ma is admitted to practice in Illinois and New York and is registered to practice before the U.S. Patent

and Trademark Office. While in private practice, Mr. Ma and his litigation teams won a number of high profile ITC investigations

involving Chinese companies. In one investigation, his clients are four subsidiaries of one of the largest state owned companies of

China, who were sued for patent infringement before the ITC. The Commission reversed the late Chief ALJ’s decision and found

that Mr. Ma’s clients were not infringing and did not violate Section 337. In another investigation, he represented the Complainant

and its subsidiaries in China suing a group of Chinese respondents for trade secret misappropriation. The ITC issued a 10-year

exclusion order against these respondents. This landmark decision represents a new development of trade secret law in the U.S.,

and was upheld by the U.S. Court of Appeals for the Federal Circuit.

Hidero Niioka, IPEXC

Dr. Hidero Niioka is a German-educated Japanese entrepreneur. Born in Japan and raised in Munich,

Germany, he wrote his PhD in “Clinical Trials in Patent Law” while research fellow to Prof. Joseph

Strauss at the Max Planck Institute for Intellectual Property Law. He is a German and US (New York)

admitted attorney and a Stanford Law School graduate with extensive experience as an IP lawyer,

and also as an investment banker at Deutsche Bank.

Combining his interests in IP law and finance, Dr. Niioka has recently launched IPEXC, an online exchange for monetizing

intellectual property. The inspiration behind IPEXC is to make IP monetization more accessible to all IP owners, from individuals,

startups, SMEs, universities to multi-national corporations.

The market for IP is growing rapidly. Globalization, the pace of technological change, and the increasing activity of large

companies in building up their patent portfolios are all factors contributing to the changing IP landscape.

Michael Warnecke, Perkins Coie 博钦律师事务所

Michael Warnecke is a partner in the firm's Patent Litigation practice. He has focused his practice on

major patent litigation cases, including international patent, technology licensing and other intellectual

property matters. He has been first chair on numerous patent litigation cases in which he represented

companies such as Caterpillar Inc., Brunswick Corporation, MetLife and Mitsubishi Corporation. In one of

the most significant cases of his career, Michael obtained successful damages and injunctive relief for

Rockwell International on a major trade secret matter. The case was later affirmed on appeal where it garnered substantial

national media attention for its innovative use of computer graphics to present evidence.

More recently, in August 2010, Michael was lead trial counsel in the Riddell v. Schutt case. This patent infringement case involved

Riddell’s significant football helmet technology developed to reduce concussions. The jury award of $30 million was the largest in

Wisconsin history for a patent case.

In the 1990s, Michael was selected by the People's Republic of China trade delegation, led by Vice Premier Li Lanqing, to host a

two-day seminar for American automotive and after-market companies, as well as the Chinese delegation on the legal aspects of

doing business in China.

At the request of the Chinese government, he also provided advice on the redrafting of the 1984 Patent Act. Similarly, in 1993, he

provided advice on the Unfair Competition Act, which was adopted in 1994.

Michael’s extensive experience has led him to be retained as an expert witness in many litigation matters.

Prior to joining Perkins Coie, Michael was the chair of the Intellectual Property practice at Mayer, Brown, Rowe & Maw in Chicago.

Dr. Zongliang Zou is a partner of Lung Tin International Intellectual Property Agent Ltd. (“Lung Tin”), where he focuses on patent

matters, primarily on patent application preparation and prosecution in the fields of pharmacy, chemistry, and biotechnologies, as

well as on patent reexamination, invalidation and litigation. In particular, Dr. Zou has rich experience in providing clients with patent

infringement analysis. Dr. Zou joined Lung Tin in 2012.

Since Dr. Zou started his professional as a patent attorney from 2003, he has been entrusted by a lot of multinational

pharmaceutical giants to handle their patent matters in China. Prior to joining Lung Tin, Dr. ZOU was engaged in research and

development in pharmaceutical basic research and diagnostic reagent development, and had served in a well-known IP firm as a

patent attorney and a partner for many years.

Dr. Zou obtained his Ph.D. in pharmaceutical chemistry at China Academy of Military Medical Science (China). Master of Laws in

Intellectual Property Law from The John Marshall Law School (US).

Dr. Zou’s working languages are English and Chinese.
