Bay Street Corridor Rezoning & Related Actions Final Environmental Impact Statement CEQR No. 16DCP156R 10‐1 CHAPTER 10: HAZARDOUS MATERIALS INTRODUCTION This chapter assesses the potential for human and/or environmental exposure to hazardous materials in soil and/or groundwater at the Projected and Potential development sites identified in the Reasonable Worst‐Case Development Scenario (RWCDS) of the proposed Bay Street Rezoning and Related Actions Proposal. The Project Area is an approximately 20‐block area on Staten Island’s North Shore that includes portions of the Tompkinsville, Stapleton, and St. George neighborhoods in Community District 1. The RWCDS identified 30 Projected Development Sites (sites considered more likely to be developed by the 2030 analysis year) and 23 Potential Development Sites (sites considered less likely to be developed over the same period. Both Projected Development Sites (1 – 30) and Potential Development Sites (labeled A – W) are included in this Hazardous Materials assessment (Figures 10‐1 through 10‐3). As described in the CEQR Technical Manual, the goal of a hazardous materials assessment is to determine whether the proposed project may increase the exposure of people or the environment to hazardous materials, and, if so, whether this increased exposure would result in potential significant public health or environmental impacts from (i) elevated levels of hazardous materials on a site where pathways to human exposure would be increased, (ii) introduction of new activities or processes using hazardous materials, or (iii) introducing a population to potential human or environmental exposure from off‐site sources. If significant adverse impacts are identified, CEQR requires that the impacts be disclosed and mitigated or avoided to the greatest extent practicable. 1 Potential routes of exposure to hazardous materials can include: direct contact, e.g., contact between contaminated soil and skin (dermal contact); breathing of VOCs or chemicals associated with suspended soil particles (inhalation), swallowing of soil or water (ingestion). Public health may also be threatened when soil vapors migrate through the subsurface and/or along preferential pathways (e.g., building foundations, utility conduits, or duct work) and accumulate beneath a concrete slab or inside a basement, resulting in an explosive, oxygen‐deficient, or hazardous atmosphere. 2 A preliminary screening by tax lot of potential hazardous materials impacts was performed for all 30 Projected Development Sites and 23 Potential Development Sites. Each Projected and Potential Development Site may be comprised of more than one tax lot. This screening was performed to determine whether an (E) designation or other comparable mechanism should be placed on the Projected and Potential Development Sites identified in the RWCDS for the Proposed Actions. If an (E) designation is indicated, additional investigation and remediation would be required, thereby avoiding the potential for impacts pertaining to hazardous materials. 1 CEQR Technical Manual, 2014. 2 Ibid.

INTRODUCTION

PRINCIPALCONCLUSIONS

Apreliminaryscreeningofpotentialhazardousmaterialimpactswasperformedforeachblockandtaxlotcomprisingthe30ProjectedDevelopmentSitesand23PotentialDevelopmentSites.Basedonthe screening, 27 of the 30 ProjectedDevelopment Sites and all 23 Potential Development Sitespossess,insomecapacity,aconcernregardingtheirenvironmentalconditions.Asaresult,undertheProposed Actions, all privately held Projected and Potential Development Sites (25 ProjectedDevelopmentSitesand23PotentialDevelopmentSites)would include(E)designationsrequiringthat a hazardous materials assessment be performed including, but not limited to, a Phase IEnvironmentalSiteAssessmentandanysubsequentappropriateassessmentoraction.Inaddition,fortwoofthethreeCity‐ownedsitesidentifiedfordisposition(CityDispositionSites1and2),theenvironmentalrequirementswithrespect tohazardousmaterialswouldbe incorporated into thelanddispositionagreement(LDA)betweentheCityofNewYorkandthefuturedeveloper.3Forthetwo(2)StapletonWaterfrontPhaseIIIProjectedDevelopmentSites,humanexposuretoknownon‐site hazardous materials on both of the sites would be reduced or eliminated during and afterremediation/construction by following the health and safety protocols and implementing theremedial measures outlined in the Phase II Environmental Site Investigation (ESI) Report andRemedialActionWorkPlan(RAWP).ImplementationoftheRAWPwouldberequiredpursuanttoaMemorandumofUnderstanding(MOU)betweenEDCandNYCDEP.Throughtheimplementationofthepreventativeandremedialmeasuresoutlinedinthe(E)designationsappliedtothe25eligibleProjected Development Sites and the 23 eligible Potential Developments Sites, and comparablemeasuresappliedtoCityDispositionSites1and2,andtheStapletonWaterfrontPhaseIIISites,theProposedActionswouldnotresultinsignificantadverseimpactsfromhazardousmaterials.

METHODOLOGY

ConsistentwiththeCEQRTechnicalManual,reviewsofregulatorydatabasesand/orSanborn®mapswereusedtodeterminehistoricalusesandincidentsthatoccurredonpropertiesorwithina400‐footStudyAreaofthepropertiestodeterminewhetherthetaxlotwouldbeeligibletoreceivean(E)designation.

Chapter24ofTitle15oftheRulesoftheCityofNewYork(15RCNYChapter24)specifiestheprocessfor determining whether an (E) designation should be placed on a specific site. Section 24‐04describesthepreliminaryscreeningprocess,whichincludesreviewinghistoricaldocumentationforpastorcurrentusesthatmayhaveaffectedorbeaffectingaProjectedorPotentialDevelopmentSiteor an adjacent site. Appendix A of 15 RCNY Chapter 24 provides a list of facilities, activities, orconditionsthatwouldrequireasiteassessment.

An(E)designatedsiteisoneonwhichnochangeofuseordevelopmentthatrequiresaNewYorkCityDepartmentofBuildings(DOB)permitandsuchpermitmaynotbeissuedwithoutapprovaloftheNewYorkCityMayor’sOfficeofEnvironmentalRemediation(OER).Redevelopmentofthesesitesrequires OER review under the (E) designation program to protect human health and theenvironment from any known or suspected hazardous materials associated with the site. For

propertieswhereexistingbuildingswillbeconvertedwithnointrusivesoilwork,theownerwouldneed to contact theOERandprovide themwith thedevelopmentplans.OERwould then issue aNoticeofNoObjectioniftheplansdemonstratethatnoexposuretohazardousmaterialswouldresultas part of development, which would enable the DOB to issue the conversion permit. The (E)designation forthesitewouldremainandmustbesatisfied ifanyfutureredevelopment involvesexcavationand/orsoildisturbance.

ThespecificmethodologyforevaluatingthepotentialforenvironmentalimpactsontheProjectedandPotentialdevelopmentsitesisdescribedbelow.ThemethodologyconsistsofareviewofrelevantenvironmentalsourcesincludinghistoricSanbornmapsandregulatoryagencydatabases.Startingwith the reviewofSanbornmaps, if an indicationofpotentialhazardousmaterialsona sitewasdiscovered,nofurtherreviewforthatsitewasundertaken.IftheSanbornmapdidnotindicateanyhazardousmaterialsinvolvement,theregulatorydatabaseinformationwasreviewedforeachsite.Inaddition,avisualinspectionoftheexteriorofeachProjectedandPotentialDevelopmentSitewasperformedtoidentifyobservableevidenceregardingthecurrentuseofthesiteandpotential,visibleevidencethatcouldindicateenvironmentalimpacts.

Insummary,ifapotentialenvironmentalconcernwasidentifiedduringthereviewofasingledatasourceondevelopmentsite,an(E)designationwasplacedonthesiteandnofurtherenvironmentalreviewwasperformed. Ifaconcernwasnot immediately identified,additionaldatasourceswereconsultedforthesite,adjacentsitesandsiteswiththe400‐footStudyAreaaroundeachsiteuntilenvironmentalconcernswereconfirmedforeachdevelopmentsite.

HistoricSanbornFireInsuranceMaps

HistoricSanbornmapswereobtainedfromEnvironmentalDataResources,Inc.(EDR).TheSanbornmapreviewfortheProjectedandPotentialDevelopmentSitesincludedanexaminationofmapsfrom1885,1898,1917,1937andeachavailabledecadefrom1950through2007.

RegulatoryDatabases

ForeachoftheProjectedandPotentialDevelopmentSites,publishedenvironmentaldatabaseswerereviewed to identify use, generation, storage, treatment, disposal, and/or release of hazardoussubstances and/or petroleum products that may have impacted the development sites. Theregulatorydatabaseswerereviewedseparatelyforeachsite,adjoiningsitesandforsiteswithintheStudyAreaaroundeachofthePotentialorProjectedDevelopmentSites.Wheresiteswereadjacenttoeachotheronthesameblock,thebufferzonewasmeasuredfromthecenteroftheclusteredsites.

EnvironmentalDataResources,Inc.(EDR)wascommissionedtoprepareadatabasereportforthestudyareathatmappedanddescribedpropertieslistedonenvironmentaldatabaseswithinthestudyarea.Table10‐1belowoutlinesthedatabasesthatwerereviewedforeachProjectedandPotentialDevelopment Sites, consistent with ASTM International (ASTM) Standard E1527‐13 StandardPracticeforPhaseIEnvironmentalSiteAssessments:PhaseIEnvironmentalSiteAssessmentProcess.

SITEINSPECTIONS

Exterior site inspectionswere performed onOctober 20th 2016 for each Projected andPotentialDevelopment Site to identify any visible monitoring wells, vent pipes, fill ports and/ormanufacturing,commercialandindustrialuses,whichcouldindicateenvironmentalconcerns.

LIMITATIONS

TheassessmentperformedtopreparethehazardousmaterialschapterincludedareviewofSanbornmaps,EDRdatabasereports,sitereconnaissancefrompublicrights‐of‐way,andareviewofavailablerelevantenvironmentalreportsforspecificproperties.Thereviewdidnotincludetheperformanceofanysubsurfacetestingprograms.ProtocolsusedinconductingreviewswereconsistentwiththoseoutlinedintheASTME1527‐13standardandtheCEQRTechnicalManual.OtherelementsofaPhaseIEnvironmentalSiteAssessment(ESA)andtheprotocolsoutlinedintheCEQRTechnicalManual(e.g.,reviewsofbuildingdepartmentandfiredepartmentrecords,atitledeedsearch,andinterviewswithcurrentandformeremployeesandowners)werenotincludedaspartoftheassessment.FullPhase1ESAswerenotundertakenbecausesufficientinformationpursuantto15RCNYChapter24wasgatheredtoindicatethat(E)designationsshouldbeplacedonsites.

EXISTINGCONDITIONS

TheProjectAreahasbeenoccupiedbyresidential,industrial,andcommercialusesforatleastthelast100years.Intheearly20thcentury,theProjectAreawashometoavarietyofuses,butbythe1950s,manufacturingusesweregenerallyphasedoutandpropertyvacanciesstartedtoincreaseinthe 1970s. Currently, the area is comprised primarily of commercial uses with some scatteredresidential uses along the Bay Street and Canal Street corridors. Amore detailed description ofexistingconditionsontheProjectedandPotentialDevelopmentSitesisprovidedbelow.

PROJECTEDDEVELOPMENTSITES

SITE1(BLOCK488,LOT71)

ThissiteislocatedontheeasternsideofBayStreet,onapproximatelythenortheastcorneroftheintersectionofBayStreetandGrantStreet.Currently,thesiteispartiallydevelopedwithapartiallyconstructedbuildingandverylittlepavedsurface.AnexteriorsiteinspectionperformedonOctober20th2016revealedthebuildingonthesiteremainsunfinishedandhasnotenant.Historically,thesitepossessedalumberyardandcoalpilesthroughthe1970’s,andhasbeenvacantsincethe1980’s.

SITE2(BLOCK487,LOTS60,64&80)

ThissiteislocatedontheeasternsideofBayStreet,onapproximatelythenortheastcorneroftheintersectionofBayStreetandHannahStreet,andextendsadjacenttotheStatenIslandRailroad(SIR)to the intersection of Victory Boulevard and Minthorne Street. Currently, the site is primarilydevelopedwithmultiplebuildingsandlargepavedparkingareaforuseasagasstationandcarwash.Historically,lot60possessedmultipleautomobilerelatedusesincludingautomobilesalesandrepair.Lot64possessedacommercialfacilityinthe1930’sbuthasremainedvacantalongwithlot80sincethe1950’s.Adatabasesearchrevealedthatfour(4)10,000gallonUSTsareinserviceonlot60andeighteen(18)550gallonUSTshavebeenclosedandremovedfromlot60.OnJanuary19th2005anunknownamountofunknownpetroleumwasreleasedtotheseweronlot60byanunknowncause.Thereleasewasassignedspillnumber0411341andwassubsequentlyclosedbytheNewYorkStateDepartmentofEnvironmentalConservation(DEC)onJanuary22nd2008.OnFebruary17th2010anunknownamountofunknownpetroleumwasreleasedonlot60byanunknowncause.Thereleasewasassignedspillnumber0912063andwassubsequentlyclosedbyDEConJuly7th2010.

SITE3(BLOCK488,LOT9)

ThissiteislocatedontheeasternsideofBayStreet,onapproximatelythenortheastcorneroftheintersectionofCongressStreetandBayStreet.Currentlythesiteisprimarilypavedwithgravelwithportionsbeingpavedwithasphalt foruse in itsentiretyasaparking facility.Historically thesitepossessedalumberyard,coalyard,parkingareaandautomobilesalesfacility.

SITE4(BLOCK488,LOTS18,26,175,201&206)

ThissiteislocatedontheeasternsideofBayStreet,onapproximatelythesoutheastcorneroftheintersectionofWilliamStreetandBayStreet.Currentlythesiteisdevelopedwithmultiplebuildingsandcontainsalargepavedparkingareausedforstorage.Lots26and175areoccupiedbyamarine

ThissiteislocatedontheeasternsideofBayStreetbetweentheintersectionsofGrantStreetandBayStreetandClintonStreetandBayStreet.Currently,thesiteisdevelopedinitsentiretywithtwobuildingsand two largepavedparkingareas.Lot53 isoccupiedbya grocery storeand lot65 isoccupied by multiple commercial facilities including a dry cleaning facility and pharmacy.Historically,thesitepossessedalumberyarduntilthe1920’sthenremainedvacantuntilthe1980’s.Adatabasesearchrevealedthatapharmacylocatedonlot65isaknownResourceConservationandRecoveryAct(RCRA)wastegenerator.

SITE6(BLOCK489,LOT5)

ThissiteislocatedontheeasternsideofBayStreet,onapproximatelythesoutheastcorneroftheintersectionofWaveStreet andBay Street. Currently, the site isdeveloped in its entiretywith abuildingandpavedparkingareaforuseasanautomotivesalesandrepairfacility.Historicallythesitepossessedafillingstationfromthe1930’stothe2000’s.Adatabasesearchrevealedthatthirteen(13)550gallonUSTswe’reclosedandremovedfromthesiteandone(1)550gallonUSThasbeenconverted to a non‐regulated use on site. On April 13th 1989, an unknown amount of unknownpetroleumwasreleasedtotheseweronsitebyanunknowncause.Thereleasewasassignedspillnumber8900426andwassubsequentlyclosedbyDEConApril13th1989.OnSeptember12th1989,anunknownamountofgasolinewasreleasedonsitebyanunknowncause.Thereleasewasassignedspillnumber8905762andwassubsequentlyclosedbyDEConNovember18th2014.OnMarch12th1998,anunknownamountofgasolinewasreleasedonsitecausedbytankfailure.Thereleasewasassigned spill number 9713791 and was subsequently closed by DEC on March 15th 2006. OnNovember 20th 2007, an unknownamount ofwaste oilwas released on site caused by tank testfailure.Thereleasewasassignedspillnumber0709111andhasnotbeenreportedclosed.

SITE7(BLOCK497,LOT1,7&9)

ThissiteislocatedontheeasternsideofBayStreet,boundbyMinthorneStreettothesouthandwestandVictory Boulevard to the north. ThissiteislocatedonthenorthernsideofWilliamStreet,onapproximatelythemiddleoftheblockbetweentheintersectionsofWilliamStreetandVanDuzerStreetandWilliamStreetandBayStreet.Currently the site is primarily developed with multiple buildings and a paved parking area forcommercial uses and residences. Historically the site possessed a small number of residentialdwellingunitsandanautomobilerepairfacilityfromthe1950’stothe1960’s.

ThissiteislocatedonthesouthernsideofCongressStreet,onapproximatelythemiddleoftheblockbetweentheintersectionofCongressStreetandBayStreetandtheendofCongressStreet.Currentlythesiteisdevelopedinitsentiretywithabuildingforuseasanautomobilerepairfacility.Historicallythe site has possessed an automobile repair facility since the 1930’s. An exterior site inspectionperformedonOctober20th2016revealedadirectnaturalgaslineextendingtothesite.

ThissiteislocatedonthewesternsideofCanalStreet,onapproximatelythesouthernportionoftheblockbetweentheintersectionsofCanalStreetandBroadStreetandCanalStreetandWaterStreet.Currentlythesiteisdevelopedinitsentiretywithabuildingandpavedareaforuseasadaycarefacility.Historicallythesitepossessedcommercialfacilitiesfromtheearly1900’stothe1980’swhereitremainedvacantuntil2005.

THEFUTUREWITHOUTTHEPROPOSEDACTIONS(NO‐ACTIONCONDITION)

IntheNo‐ActionCondition,theidentifiedProjectedandPotentialDevelopmentSiteswouldeitherremainunchangedfromexistingconditionsorbecomeoccupiedbyusesthatareas‐of‐rightunderexistingzoningandreflectmarketconditionsintheProjectArea.AsdiscussedinChapter2,“LandUse, Zoning, and Public Policy,” in the No‐Action Condition, six (6) Projected Development Siteswould undergo residential development, and it is anticipated that therewould be a decrease incommercial use over existing conditions. The development under the No‐Action Condition isexpected to result in an incremental increase over existing conditions of approximately six (6)residentialunits(two(2) in theBayStreetCorridorProjectAreaand four(4) in theCanalStreetCorridor Project Area) and 24,789 sf of additional community facility space; and result in a netdecreaseof32,825sfofcommercialspace.Initsentirety,thedevelopmentintheNo‐ActionConditionisanticipatedtoconstitutetwelve(12)dwellingunits,343,235sfofcommercialspace,and37,879sfofcommunityfacilityspace.

However,anyconstructioninvolvingsoildisturbancecouldpotentiallycreateorincreasepathwaysfor human exposure to any subsurface hazardous materials present. And, without the controlsrequiredunder(E)designations inplaceonsitesprojected fordevelopmentundertheNo‐ActionCondition,theexposuretohumansandtheenvironmenttohazardousmaterialscouldoccur.

ThereisoneRestrictiveDeclaration(R‐205)thatcurrentlyexistsonStapletonWaterfrontPhaseIIISitesAandB1(Block487,Lot100).UndertheNo‐ActionCondition,SiteA(ProjectedDevelopmentSite29)isanticipatedtoremainunchangedfromexistingconditionsandsuchsoildisturbancewouldnotnecessarilybeconductedinaccordancewiththeprocedures(e.g.,forconductingtestingbeforecommencing excavation and implementation of health and safety plans during construction)describedinthefollowingsection.AbuildingonSiteB1(ProjectedDevelopmentSite30)however,is anticipated to be demolished under the No‐Action Condition. As such, without the ProposedActions,theamountofsoildisturbancewouldbeless,butthecontrolsonitsperformanceonSiteA(Projected Development Site 29) would not be as stringent as under the Proposed Actions, asdescribedbelow.

THEFUTUREWITHTHEPROPOSEDACTIONS(WITH‐ACTIONCONDITION)

IntheWith‐ActionCondition,thereare30ProjectedDevelopmentSites(sitesconsideredmorelikelytobedevelopedbythe2030analysisyear)and23PotentialDevelopmentSites(sitesconsideredlesslikelytobedevelopedoverthesameperiod,butnonethelessincludedinthisHazardousMaterialsassessment).TheanalysisbelowexaminesProjectedandPotentialDevelopmentSiteswhereitcouldbeexpectedthatdevelopmentinthefuturewiththeProposedActionswouldhavethepotentialtoincrease the exposure of people or the environment to hazardous materials. The potential forexposure to humans exists during construction or after construction at an occupied site. Thepotential for exposure to the environmental exists through the transport of hazardousmaterialsduringorafterconstruction.

ASSESSMENT

Thehazardousmaterialsscreeningidentifiedthat27ofthe30ProjectedDevelopmentSitesandall23PotentialDevelopmentSiteshavesomeassociatedconcernregardingenvironmentalconditions.Asa result, theproposedzoningmapactions include (E)designations forall25privately‐ownedProjectedDevelopmentSitesandall23privately‐ownedPotentialDevelopmentSites.Inaddition,onCityDispositionSites1and2,theenvironmentalrequirementswithrespecttohazardousmaterialswouldbeincorporatedintothelanddispositionagreement(LDA)betweentheCityofNewYorkandthefuturedeveloperwithmeasurescomparabletothe(E)designation.CityDispositionSite3locatedat51CentralStreet(Block6,Lot20)wouldbeexcludedfromreceivingan(E)designationorothercomparablemeasure.4Restrictionsrelatedtothetwo(2)StapletonWaterfrontPhaseIIIsiteslocatedat355FrontStreet(Block487,Lot100)aredescribedbelow.5

AppendixAoftheHazardousMaterialsChapter(Chapter24ofTitle15oftheRulesoftheCityofNewYork)providesa listof facilities,activitiesorconditionsrequiringassessment. If theProjectedorPotentialdevelopmentsitesoradjacentpropertieshaveindicationsofactivitiesorconditionslistedinAppendixA,placementofan(E)designationisrecommended.Inaddition,ifpropertieswithintheStudyAreasurroundingeachof theProjectedorPotentialDevelopmentSitespossessedfacilities,activitiesorconditionslistedinAppendixA,assignmentofan(E)designationisalsorecommended.The(E)designationrecommendationsarelistedinTable10‐4andamatrixsummarizingthedetailsofthefindingsoftheassessmentfortheProjectedandPotentialdevelopmentsitesisprovidedinTables 10‐2 andTable 10‐3, respectively, below. In thematrix, the results for the Projected andPotentialdevelopmentsitesarereportedseparatelyfromfindingsforthesitesincludedwithinthe400‐footStudyArea.

Thescreeningforallsiteswasconductedbyreviewinghistoricaldocumentationforpastorcurrentfacilities, activities or conditions thatmay have affected or be affecting a Projected or Potentialdevelopmentsiteoranadjacentsite.Thepastuseswerecomparedtothelistoftypesoffacilities,activitiesorconditionsthatcouldleadtoasitereceivingan(E)designationlistedinAppendixAof

the Hazardous Materials chapter. Based on this screening, 25 Projected and 23 PotentialdevelopmentsiteswithintheProjectAreameetthecriteriaforplacementofan(E)designation.

Byplacing(E)designationsonsiteswherethereisaknownorpotentialenvironmentalconcern,thepotentialforanadverseimpacttohumanhealthandtheenvironmentresultingfromtheProposedActionswould be reduced or avoided. The (E) designation provides the impetus to identify andaddress facilities, activities or conditions environmental conditions so that significant adverseimpactsduringsitedevelopmentwouldbereduced.TheOERwouldprovideregulatoryoversightoftheenvironmentalinvestigationandremediationduringthisprocess.Buildingpermitsarenotissuedby theDOBwithoutpriorOERapprovalof the investigationand/or remediationpursuant to theprovisionsofSection11‐15oftheNewYorkCityZoningResolution(EnvironmentalRequirements).

The(E)designationwouldrequirethatthefeeownerofsuchasiteconductatestingandsamplingprotocol and have an approved remediation planwhere appropriate, prior to redevelopment orchangesinuseonthesite.TheDOBtypicallyissuesthefoundationpermitswhenOERapprovesaremedialactionworkplan—actualremediationisusuallydoneconcurrentlywithconstruction.Theremediation plan provided to OER to satisfy the (E) designationmust also include amandatoryconstruction‐relatedhealthandsafetyplan.

The(E)designationtextrelatedtohazardousmaterialsisasfollows:

Task1

The applicant must submit to the New York City Office of Environmental Remediation (OER), for review and approval, a Phase 1 Environmental Site Assessment (ESA) of the site along with a soil and groundwater testing protocol, including a description of methods and a site map with all sampling locations clearly and precisely represented. Ifsitesamplingisnecessary,nosamplingshouldbeginuntilwrittenapprovalofaprotocolisreceivedfromOER.Thenumberandlocationofsamplesitesshouldbeselectedtoadequatelycharacterize thesite, thespecificsourceofsuspectedcontamination(i.e.,petroleumbasedcontamination and non‐petroleum based contamination), and the remainder of the site’scondition.Thecharacterizationshouldbecompleteenoughtodeterminewhatremediationstrategy (if any) is necessary after review of sampling data. Guidelines and criteria forselectingsamplinglocationsandcollectingsamplesareprovidedbyOERuponrequest.

Task2

Awrittenreportwith findingsandasummaryof thedatamustbesubmitted toOERaftercompletion of the testing phase and laboratory analysis for review and approval. Afterreceivingsuchresults,adeterminationismadebyOERiftheresultsindicatethatremediationisnecessary.IfOERdeterminesthatnoremediationisnecessary,writtennoticeshallbegivenbyOER.

If remediation is indicated from the test results, a proposed remediation planmust besubmittedtoOERforreviewandapproval.TheapplicantmustcompletesuchremediationasdeterminednecessarybyOER.Theapplicantshouldthenprovideproperdocumentationthattheworkhasbeensatisfactorilycompleted.

AnOER‐approvedconstruction‐relatedhealthandsafetyplanwouldbeimplementedduringevacuationandconstructionactivitiestoprotectworkersandthecommunityfrompotentiallysignificantadverseimpactsassociatedwithcontaminatedsoiland/orgroundwater.ThisplanwouldbesubmittedtoOERforreviewandapprovalpriortoimplementation.

All demolition or rehabilitation would be conducted in accordance with applicablerequirements for disturbance, handling and disposal of suspect lead‐paint and asbestos‐containing materials. For all Projected and Potential development sites where no E‐designation is recommended, in addition to the requirements for lead‐based paint andasbestos,requirements(includingthoseofNYSDEC)shouldpetroleumtanksand/orspillsbeidentifiedandforoff‐sitedisposalofsoil/fillwouldneedtobefollowed.

Asnotedabove,theProposedActionswouldinclude(E)designationsforallprivatelyheldProjectedandPotentialDevelopmentSites (25ProjectedDevelopmentSitesand23PotentialDevelopmentSites).FortwoofthethreeCity‐ownedparcelswithintheProjectArea,theimplementationoftheenvironmentalrestrictionswouldberequiredthroughLDAsbetweentheCityofNewYorkandthe

future developer at the appropriate time.6 The following City‐owned sites would requireimplementationofenvironmentalrestrictionsthroughLDAs:

ProjectedCityDispositionSite1(Block9,Lot9);and

ProjectedCityDispositionSite2(Block34,Lot1)

Withtherequirementsofthe(E)designationon25Projectedand23Potentialdevelopmentsitesandanequivalentinstitutionalcontrol,suchasanLDA,onProjectedCityDispositionSites1and2,therewould be no significant adverse impact from thepotential presence of hazardousmaterials. Theimplementation of the preventative and remedial measures outlined in the (E) designationrequirements or other comparable measures would reduce or avoid the potential of significantadversehazardousmaterialsimpactsfrompotentialconstructionintheProjectAreaasaresultoftheProposedActions.

STAPLETONWATERFRONTPHASEIIIDEVELOPMENTSITES

A Phase II ESI Report for the Stapleton Homeport Redevelopment (Appendix F, “HazardousMaterials”),whichencompasses two(2)ProjectedDevelopmentSitesonBlock487,Lot100 (theStapleton Waterfront Phase III Sites) was prepared on behalf of the New York City EconomicDevelopment Corporation (EDC) in August 2008. The investigation activities performedwere asfollows:

Sitereconnaissance;

Utilityclearanceandsite‐widegeophysicalsurvey;

Soil,groundwaterandsoilvaporinvestigation;and

Asbestos,leadandmoldsurveys.

The2006PhaseIEnvironmentalSiteAssessment(ESA),citedinthePhaseIIESIReport,identifiedthefollowingRecognizedEnvironmentalConcerns(RECs):REC1‐TheExpansionoftheShorelineBasedon reviewof aerialphotographsandsitehistory, the shorelinewasexpanded through theplacementof importedfill.Thismaterialmayhavebeencontaminatedwithcompoundsincludingvolatileorganics,semivolatileorganicsandmetals.REC2‐TheHistoricalUsesofthePropertyThehistoricaluseof theproperty and surroundingareasmayhavenegatively impacted the site.Potential uses of the surrounding areas include coal yards, auto repair facilities and petroleumstorageareas.

6CityDispositionSite3(Block6,Lot20)isnotanticipatedtorequireenvironmentalrestrictionsduetothehistoricaluseoftheproperty(primarilyapavedparkingsurface)andbecausetherearenoenvironmentalconcernson‐siteorwithin400feetofthesite.

REC3‐HazardousMaterialsHandlingandGenerationandStorageofHazardousWasteAccording to a Base Realignment and Closure Cleanup Plan report reviewed by Louis Berger,hazardousmaterialswerehandled,generatedandstoredatthefacility.TheareatothesouthoftheSIMAbuildingwasidentifiedasbeingaLargeQuantityGeneratorofhazardouswaste.REC4‐PetroleumStorageAtotalofsevenUnderGroundStorageTanks(USTs)andtwoAboveGroundStorageTanks(ASTs)(misidentifiedinthePhaseIESAtext)wereidentifiedatthesite.However,onlysixofthesetanksarelocatedattheproperty.Thereviewofrecordsidentifiedfive(5)1,000‐gallonwasteoilUSTsandone(1)2,000‐gallonwasteoilUSTlocatedontheproperty.REC5‐CoalYardAcoalyardwasidentifiedasbeingpreviouslyadjacenttotheFrontStreetproperty.REC6‐UpgradientPetroleumReleases&PetroleumStorageFacilitiesReviewoftheRegulatorydatabasesidentifiedeighteen(18)activepetroleumreleasesitesandsixpetroleumstoragefacilitiesupgradientofthesubjectproperty.ThePhaseIISiteInvestigationReportprovidesthefollowingconclusionsandrecommendations:

1. “Based on the results of the Phase II Site Investigation Report, metals and base neutralcompounds have been identified in soil and groundwater in exceedance of the applicablestandards.Thesecontaminantsarelikelytheresultofhistoricfillmaterialusedtoextendtheshorelinetoitscurrentlocation.Thegroundwatercontaminationdoesnotposearisktohumanhealthsincegroundwaterisnotusedasapotablewatersource.Contaminantsinsoildoposeadirectcontactexposureriskanditisrecommendedthatvaporbarriersbeimplemented.

2. Volatileorganiccompoundswereidentifiedabovereportinglimitsinseveralofthesoilvapor

samples.Only trichloroethenewasdetectedataconcentrationaboveNYSDOHAirGuidanceValue.However,thiscontaminantwasnotdetectedineitherthesoilorgroundwatersamplesfrom the location.Basedon theseresults it isrecommended thatadditional investigationbeconductedandifnecessarythatavaporbarrierbeconsideredforfuturedevelopment.

3. Inaddition,sincethefacilityisinactiveandtheirassociateundergroundheatingoiltanksare

notbeingused,werecommendthattheyformallybeclosed,assumingtheyarenotneededaspartofthefuturesitedevelopment.Ingeneral,thiswillincluderemovaloftheUSTsalongwiththesubmissionofclosurereportsdocumentingthattankclosureactivitieswereperformedinaccordancewithNYSDECrequirements.”7

Based on results of the Site Investigation, a remedial action work plan (RAWP) was prepareddescribingtheproposedremedialactionapproachtobefollowedoncethefinalsitedevelopmenthasbeenfinalized.Thestatedobjectiveoftheproposedremedialactionistominimizeoreliminatetheriskposedbythedocumentedcontaminationpresentonsiterelativetotheplannedfutureuseofthesite.

EDChasenteredintoaMemorandumofUnderstanding(MOU)withNYCDEPtobinditssuccessorsandassignstoperformingthenecessaryremediation.Accordingly,thenecessaryremediationwillbeidentifiedthroughaRAPafterthereuse/developmentprogramisestablishedandpriortorenovationandconstructionactivities.TheMOUisaneffectivemeansforensuringthatanypotentialhazardousmaterialsissuesfoundonthedispositionparcelswillbeadequatelyaddressedinordertoavoidthepotentialforsignificantadverseimpactsrelatedtoHazardousMaterials.Inadditiontotheabove,anytransferof theStapletonPhaseIIISites,orportionsthereof, toanotherCityagencywillbindthatentitytotheidentifiedremediationmeasuresdiscussedabove.8 CONCLUSION

Institutional controls (specifically, (E) designations) would be used to require pre‐ and post‐developmentprocedurestomitigateoreliminatethepotentialforsignificantadverseimpactsrelatedtohazardousmaterialsasaresultofconstructionoroperationoftheRWCDSprojectedandpotentialdevelopmentsites.Throughtheimplementationofthepreventativeandremedialmeasuresoutlinedin the(E)designationsappliedto the25eligibleProjectedDevelopmentSitesandthe23eligiblePotentialDevelopmentsSites,andcomparablemeasuresappliedtoCityDispositionSites1and2,andtheStapletonPhaseIIISites,theProposedActionswouldnotresultinsignificantadverseimpactsfromhazardousmaterials.

Therefore,nosignificantadverseimpactsduetohazardousmaterialsareanticipated.
