13. BONDING OF PERSONNEL

15. Recommend that the Board of Education approve the district entering into transportation arrangements with other school districts of the Wayne-Finger Lakes BOCES.

16. Recommend that the Board of Education authorize the Business Administrator and Superintendent to sign all contracts.

17. To approve the Organizational Chart for the Phelps-Clifton Springs Central School District for the 2021-2022 school year.

18. To approve the 2021-2022 Phelps-Clifton Springs CSD Code of Conduct.

19. Authorization for appointment of an Impartial Hearing Officer:

BE IT RESOLVED, that the current list of certified hearing officers from the State Education Department's web-based Impartial Hearing Officer Reporting System, who are identified as available to serve in this District, and the list as amended from time-to-time by the State Education Department and posted on the web-based IHO reporting system as the District's list of Impartial Hearing Officers.

BE IT ALSO RESOLVED, that the School District Clerk and Chief School Officer or Chief School Officer's designee shall select certified hearing officers from the State Education Department's web-based Impartial Hearing Officer Reporting System, who are available to serve in the District from the list of Impartial Hearing Officers who are certified by the Commissioner of Education of New York State; and document the rotational selection process and engage in the ministerial acts necessary to determine the first available impartial hearing officer for selection in each particular case. The State Education Department's then-current published list on the web-based Impartial Hearing Officer Reporting System will constitute the District's list of names and statement of the qualifications of each Hearing Officer.

BE IT ALSO RESOLVED, that when an Impartial Hearing Officer must be appointed at a time when the Board of Education is not in session or between board meetings, the Board President or Vice-President are authorized to appoint the first available hearing officer to serve in a particular case. In the event that neither the Board President nor Vice President is available to make such an appointment, any member of the Board may appoint the first available hearing officer to serve on a particular case. Board Member appointment of an Impartial Hearing Officer to conduct a hearing shall be promptly reported to the Board.

The Board of Education values the input of the Midlakes community and welcomes public comment on any topic related to Board work, with the exception of matters pertaining to individual personnel and/or students. All public comments must include appropriate language and observe proper decorum. Anyone making public comment must identify themselves by name and address. The public comment period will be limited to a total of thirty (30) minutes and one (1) comment per person. Individual comments will be limited to two (2) minutes. The Board does not respond to items presented or questions raised through public comment. However, the Board may discuss topics of public comment at a later time and/or contact the individual who submitted the comment.

RESOLUTION APPROVING SMART SCHOOLS INVESTMENT PLAN AMENDMENT

WHEREAS, the Board of Education of the Phelps-Clifton Springs Central School District has been presented an Amended Smart Schools Investment Plan (“SSIP”) pursuant to The Smart Schools Bond Act (the “Act”); and

WHEREAS, the Amended SSIP has been posted on the District’s website, and the District included an address to which any written comments on the preliminary SSIP should be sent; and

WHEREAS, the Board of Education has completed an amended SSIP, and determined that approval of the amended SSIP is in the best interest of the District.

NOW, THEREFORE, BE IT RESOLVED, that the Amended Smart Schools Investment Plan be approved.

F. To approve the creation of the following 1.0 FTE positions utilizing CRRSA funds effective July 1, 2021 (one opening

1. To appoint Heather DeRuyter as a Probationary Registered Nurse, at a salary of $36,750, effective September 1, 2021. Probationary period will be September 1, 2021 to August 31, 2022.

2. To appoint Natalie Schinsing as a Probationary Math 7-12 Teacher in the Math 7-12 tenure area, at a salary of Step 1 Bachelors $43,272 pending completion and verification of her teaching certification in September. Her anticipated certification is Initial Certification in Math 7-12. Probationary period will be September 1, 2021 through August 31, 2025.

Superintendent Sickles, Business Administrator Tracy Marshall, and Director of Curriculum Michelle Robinette presented the CRRSA Spending Plan. Topics included: CRRSA Act 2021-2023, CRRSA Spending Criteria, CRRSA Positions, CRRSA Plan Allocations (ESSER), and CRRSA Plan Allocations (GEER 2).

REPORTS No update was provided regarding the Four County School Boards Association.

High School Principal Frank Bai-Rossi presented copies of the 2021 Midlakes High School Yearbooks to the Board.

Superintendent Sickles reported on the following: Celebrating the Class of 2021, Graduation Guidance, Public Comment/Survey on Proposed ARP-ESSER Spending Plan is open on the school website through 4.p.m. on June 17, 2021, and Planning for September 2021.

BOARD DISCUSSION Superintendent presented the draft of the 2021-2022 Board of Education Meeting dates to the Board. No revisions were requested, and the listing was approved as is.

NEW BUSINESS A motion was made by Ms. Altman, seconded by Mr. Freelove to approve the following New Business item, carried unanimously (5-0).

A. To approve the April 2021 Office of the State Comptroller Fuel Purchasing Audit and Corrective Action Plan.

B. To approve the following resolution approving the second amendment to the SRO Agreement.

WHEREAS, the County of Ontario, a municipal corporation of the State of New York (the “County”) and the Phelps-Clifton Springs Central School District (the “District”) previously entered into an Agreement for the provision of School Resource Officer (“SRO”) Services (“Agreement”); and

WHEREAS, the Parties thereafter entered into an Amendment to the Agreement, dated September 22, 2020, regarding the cost of School Resource Officer Services for the 2020-2021 school year; and

WHEREAS, the Parties seek to enter into a second amendment to the Agreement to address an extended term (the “Second Amendment”); and

WHEREAS, the County has indicated the Second Amendment will go before its Board of Supervisors for approval at its June 24, 2021 meeting;

NOW, THEREFORE, the Board of Education of the School District resolves as follows:

1. The Board of Education hereby approves the Second Amendment to the Agreement between the School District and County for School Resource Officer services.

2. The Board authorizes the Superintendent of Schools to execute the Second Amendment in the form approved by legal counsel.

3. This Resolution shall take effect immediately.

C. To approve the following resolution regarding the purchase and installation of a bus lift.

WHEREAS, the Phelps-Clifton Springs Central School District is considering undertaking a capital improvement project consisting of the acquisition and installation of a bus lift in the District’s bus garage, including, required site improvements, original furnishings, fixtures and equipment (the "Project"); and

WHEREAS, the District, as a local agency pursuant to the New York State Environmental Quality Review Act ("SEQRA"), ECL Section 8-0 IO1, et seq., and implementing regulations, 6 NYCRR Part 617 (the "Regulations"), having reviewed the impact of the Project upon the environment, intends hereby to determine that the Project constitutes a "Type II Action" under 6 NYCRR § 617.5(c)(25) of the Regulations and is not subject to review under SEQRA.

NOW THEREFORE, BE IT RESOLVED by this Board of Education as follows: Section 1. The Project constitutes a "Type II Action" under 6 NYCRR § 617.5(c)(25) of the Regulations and is not subject to review under SEQRA. The regulatory bases for this determination are Section 617.5(c)(1): "maintenance or repair involving no substantial changes in an existing structure or facility"; Section 617.5(c)(2): "replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same site ...." and/or 617.5(c)(8): “routine activities of educational institutions, including expansion of existing facilities by less than 10,000 square feet of gross floor area….”

Section 2. This Resolution shall take effect immediately.

D. To approve the updated 2021-2022 APPR Plan, based on initial NYSED feedback.

WHEREAS, the District is required to have in place a plan for Annual Professional Performance Review of classroom teachers and building principals; and

WHEREAS, the Plan must be negotiated in accordance with the NYS Education Law and the implementing Regulations; and

WHEREAS, the Superintendent of schools has negotiated an updated APPR Plan for both classroom teachers and building principals with the respective unions, for implementation in the 2021-2022 school year; and

WHEREAS, the respective unions intend to certify the Plan as having been duly negotiated in accordance with the law.

NOW, THEREFORE, upon recommendation of the Superintendent of Schools, the Board approves of the APPR Plan negotiated for classroom teachers and building principals for implementation for the 2021-2022 school year, and directs the Superintendent or his designee to submit the Plan to the New York State Education Department for review and approval.
