VIII. ProceduresA. Any individual may obtain a copy of any MPD report that is classified as public

information. A person requesting a copy of a report must provide sufficient informationto allow records personnel to identify and retrieve the particular record. Recordspersonnel will not generally provide research assistance or conduct an extensive filesearch.

B. Public requests to review or obtain copies of any report must be made to the RecordsSection during normal business hours.

C. All information contained in either an adult or juvenile sex offender registration formwhich has been entered in the DPS database is public information and must be releasedupon written request, except for the registrant's social security number, driver's licensenumber, telephone number, and any information that on its face would reveal the victim 'sidentity.

D. According to Open Records Decision No. 304, the Open Records Statute does not requireany governmental body to produce information in the absence of a written request. If awritten request is considered within one of the exceptions, an Attorney General's Opinionmust be requested by the tenth business day after the written request.

E. Any individual with a valid court order mandating release of a record may obtain a copyof that record. Court orders shall be reviewed by the supervisor of the Records Sectionprior to release of such record.

F. Representatives of law enforcement, prosecution, or correctional agencies, in theperformance of their official duties, may review or obtain copies of any report, whetherpublic or confidential.

G. A Report Fee Schedule establishes charges for copies of reports. Fees will not be chargedfor copies made for other units of government.

H. The Police Records Section shall maintain a file ofwritten responses to requests forinformation that would require programming, in accordance with Section 552.231 of the

Mesquite Police Department

Code of Conduct

Chapter 1 - PurposeI.I The Code of Conduct of the Mesquite Police Department is designed to promote

effic iency, discipline, and good public relation s by setting forth policies governing thecond uct of every employee of the Depar tment. Observation of the provisions of this codewill contribute to the maintenance of public confi dence in the Mesquite PoliceDepartment.

1.2 This Code of Conduct is intended for departmental use only and does not app ly in anycriminal or civil proceeding. Departmental policy should not be construed as a creation ofa higher legal standard of safety or care in an evidentiary sense with respect to third partyclaims. Violations of departmental policy will only form the basis for departmentaladmi nistrative sanctions. Violations of law will form the basis for civil and crimi nalsanctions in a recognized judicial setting.

Chapter 2 - Scope2.1 The prov isions of the Written Directives shall be observed by all employees of the

Department in order to maintain the confidence, respect, and support of the public.2.2 Violations of the Written Directives, departmental orders or regulations, Chapter 143 of

the Local Government Code, the City of Mesquite Civil Service Rules and Regulations,the Charter of the City of Mesquite, the ordinances of the City of Mesquite, and/or thelaws of the State of Texas or the United States shall subject the offender to disciplinaryaction which may take the form of a verbal or written reprimand, reduction in rank,grade, or step, uncompensated duty, and/or suspe nsion or discharge from employment.Act ion taken will depend on the degree of severity of the offense, the record of theoffender, and the seriousness of the conseq uences of the violation.

2.3 Disciplinary action will be in accordance with the City of Mesquite Civi l Service Rulesand Regu lations and Chapter 143 of the Local Government Code .

2.4 It shall be the duty of all employees to report to a superv isor (and take corrective actionwhen required) any violation or suspected viola tion of the Written Directives, the City ofMesq uite Civil Service Rules and Regulations, Chap ter 143 of the Local GovernmentCode , the Char ter of the City of Mesquite, the ordinances of the City of Mesquite. and/orthe laws of the State of Texas or the United States by any employee of the department.A. Shoul d the violation involve an incident of a serious nature, the employee

detecting the violation shall notify the offender's on-duty supervisor. A lieutenantor above may relieve the offender from duty with pay, take custody of anycredentials and firearms issued by the department, and instruct the offender toreport the next business day at II :00 a.m. to the office of the Chief of Police .

B. A special report of the incident shall be submitted by the reporting employee orsupervisor.

2.5 Whe n a violation involves neither gross misconduct nor moral turpitude but cou ld causediscredit to the Department or any employee thereof, a report shall be made in writingsetting out the known facts of the case and an investigation initiated to dete rmine thenature and degree of the violation.

2.6 Minor violations which do not involve gross misconduc t or moral turpitude and whichwill not reflect discredit upon the Department, but which indicate a need for some formof summary disci pline andlor training , may be hand led by the offender's supervisor.

2.7 No empl oyee shall procure appointment in the Department by mean s of willfulmisrepresentation or omission of any fact concerning his personal history, qualificationsfor employment, or physical condition.

2.8 Employees are required to establish and maintain a worki ng knowledge of the WrittenDirec tives, of all laws and ordinances in force in the City of Mesqu ite, and the writtenrules and policies of the Department and divisions thereof. In the event of improperaction or breach of discip line, it will be presu med that the employee was familiar with thelaw, rule, Or policy in question.

2.9 The fai lure to comply with the Writt en Directives and all other orders , pol icies , anddirec tives issued by proper authority will subjec t the offender to disciplin ary actions asprescribed in Chapter 2, Sec tion 2.2, of the Code of Conduct.

2.10 Any employee who, by an act or conduct , attempts to violate or conspires with anyperson to violate the Written Directives, departmental orders or regu lations, the City ofMesquite Civil Serv ice Rule s and Regula tions, Chapter 143 of the Local GovernmentCode, the Charter of the City of Mesquite, and/or the laws of the State of Te xas or theUnited States shall be subject to the same discipline as though the actual violation hadbeen accomplished.

2.1 1 No employee is give n or will be given any prop erty right or expectation of any propertyright to any assignment, duty, area of specia lizat ion, training, work schedule, duty hours,working con ditions, or expectation of overtime avail ability in the Mesquite PoliceDepartment, except as may be provided by law. All assignme nts in the Mesquite PoliceDepartment are temporary rather than permanent assignments. Assignments are based onthe overall needs of the Mesquite Police Department and are subject to change by theMesquite Police Department at any time, with or without notice. Changes in assignmentor any other working conditions (except as may be made under the Local GovernmentCode, Section 143.032, 143.035 , 143.052, or 143.054) do not constitute a promotion,demo tion, Or adverse personnel action . No representation to the contrary by anyemployee of the Mesquite Police Department may supersede this departmental policy.

Cha pter 3 - Uniform, Equipment, and Appearance3.1 Uniforms shall be kept neat , clean, in good repair, and well pressed at all times.3.2 All employees shall wear the duty uniform on a tour of duty. However, supervisors the

rank of lieutenant or above may prescribe other clothing to be worn as required by thenature of the duty to which a particular employee is assigned . Offi cers whose dutyassignment s normally req uire civilian clothing shall maintain at leas t one uniform that isreadily accessible in case of call -back to uniformed duty.

3.3 No employee shall wear his uniform, or any part of it for personal purposes or usc, wheresueh wearing could result in discredit or embarrassment to the Department.

3.4 No employee shall wear any item on the uniform not specifically au thorized by order ofthe Chief of Police.

3.5 Officers shall car ry their official identifi cation card at all times.3.6 Employees shall report for duty clean-shaven, with hair neatly trimmed . Mustaches,

beards, sidebu rns, and hair length shall be governed by current department al order.

3.7 Officers performing an enforcement or invest igati ve function shall be armed while onduty, unless precl uded by policy or directive. Officers performing admi nistrative orsupport functions at police headquarters shall have sidearms available at their dutystations. Sidearms shall conform to the standards set forth in current directives.

3.8 Officers in civilian clothes shall conceal their weapon, badge, handcuffs and any otherpolice related hard ware that would identify a person as a police officer while in publicview. Exceptions: normal inves tigative work areas and city hall.

3.9 No empl oyee shall wear a police uniform while under suspension. An officer shallimmediately surrender his badge and official identificat ion card. upon request, to thesupervisor notifying him of his suspension.

3.10 Improper or negligen t handling of or willful damage to city property is a violation of thisCode.

3.11 No employee shall negligently cause the loss of. damage to. or destruction of anyproperty or equipment bel onging to the Mesquite Police Department. Employees may berequired to make res titution of a loss or damage to Mesqui te Police Department propertyif loss or damage is the result of negligence on the part of the emp loyee.

3. I2 Employees shall promptly report the need for repairs of any city-owned property issuedto. used. or possessed by them to the city department offic ially charged with themain tenan ce of such property.

3.13 Employees assigned a police vehicle, home storage or pool, shall inspect it daily andreport immediately to their supervisor any new vehicle damage. If an incident occursduri ng operation of the vehicle which should cause the employee to reasonably helievethat the vehicle has been damaged , the employee shall inspect the vehicle for damage assoo n as possible, and repo rt immediately to the superviso r any new damage.

3.14 No employee shall alter , repair, or in any way change , add to, or remove any parts oraccessories of any city-owned property without authorization . This includes buildings,office equi pment, machines, clothing, firearms, communication equipment, and motorvehicles.

3.I5 No employee shall use city equipment. supplies. funds, or services for personal purposes,except as authorized by explicit wri tten order [for example: approved off-duty use of ahome-storage vehicle).

3.I6 An employee may be reimbursed for 50% of the rep lacement cost of personal propertydamaged during performance of duty , up to a maximum of $100 . A receipt documentingreplacement/repair cost of the property may be required. Each claim will be subject toreview.

Chapter 4 - P rofessional Conduct and Personal Bearing4.1 Dereliction of duty on the part of any employee. detrimental to the proper performance of

the functions of the departme nt, is cause for disciplinary action. Disciplinary action willbe taken according to the degree of severity of the violation . the resul ts brought about bythe dereliction. and the affect it has upon the discipline . good order. and best interest ofthe Department. Dereliction of duty may include, but is not limited to:A. Failure of a supervisor to immediately take action when a violation of rules or

regulations comes to his attention . regardless of the supervisor's or violator'sass ignment or rank within the Department.

B. Failure to observe and give effect to the policies of the Department.C. Failure to deliver to the official departmental custodian any property found by,

confiscated by. or relinquished to officers of this Department withoutunnecessary delay and. in any event, before their tour of du ty is end ed.

D. Failure to place eviden ce in its officially designated place fo r preservation andstorage.

E. Failure to give last name and identification number to any person upon request.The pro vision of name and identification number may be orally or in writing.

F. To be under the influence of drugs or to be a user of drugs when such drugs arenot prescribed by a physician or dentist or to take drugs in a manner notprescribed by a physic ian or dentist, or to be under the influence of prescriptiondrugs which results in a state of intoxi cation or impairmen t that may be a hazardto safety. The use of medications that are lega lly available over-the-counter isexcluded. unless such use results in a state of intoxication or impairment that isclearly a hazard to safety. The failure of any employee to notify a supervisorwhen reaso nable suspicion exists of improper drug or alcohol use or possessionby ano ther employee. is a violation of policy.

G. Unnecessary or excessive use of force or harassment toward any person.H. Disrespect shown to a supervisor. subordinate, or other employee .I. Use of indecent, profane. or harsh language in the perfo rmance of official duties.J. To accept. agree to accept, or solicit a bribe . (A bribe shall be defined as a gift,

emolument. money. thing of value. tes timonial. appointment or personaladvantage, or the promise or solicitation of same for the purpose of obtai ningspecial priv ileges or personal gain by the donor or other person.)

K. Cowardice or fail ure to perform police duti es because of dan ger.L. Any irresponsible action which places any person in greater danger than is

necessary for the proper performance of the employee's duties.M. Failure or refusal to perform assigned work or fully comply with instructions or

lawful orde rs as requested by appropriate authorities; failure or refusal to fullycooperate with offic ial investigations. Acts of defiance towards a supervisorincluding but not limi ted to arguing about assignments, talking back, walkingaway from or ignoring a superv isor while being addressed, deliberate attempts toundermine or put the supervisor in a false light , deliberate falsification ormisrepresentation of facts which would place the police department in anunfavorable light and cause the public to lose confide nce in the policedepar tment.

N. Neglect of duty .4.2 No employee shall engage in any conduc t which constitutes conduct unbec oming an

officer. Conduct unbecoming an officer shall mean any personal conduct or action which,if brought to the attention of the public, could result in justified unfavorable criticism ofthat employee or the department; any action or conduct by an employee that could causethe publ ic to lose confidence in the department; andlor any personal involvement by anemployee in a disturbance or police incident to his discredit.

4.3 Employees shall treat supervisors, SUbordinates, and associates with respect. T hey shallbe courteous and civi l at all times in their relationships with one another. When on dutyin the presence of other employees or the public , officers should be referred to by rank.

4.4 Employees sha ll not publicly criticize or ridicu le the Department, its polici es. or otheremployees by talk ing, writing. or expressing in a manner which:A. Is defamatory.B. Is obscene.C. Is unlawful.D. Tends to impair the operation of the department by interfering with its

efficiency, by interferi ng with the ability of supervisors to maintain discipline,or by a reckless disregard for the truth.

4.5 No employee shall at any time ridicule, mock, deride. taunt , or beli ttle any person.Neither shall he willfully embarrass, humiliate, nor shame any person or do any thing thatmight incite any person to violence .

4.6 No employee shall use racial slurs or recite ethnic jokes or humor or in any manner castnegative characteristics on any race, sex or religion.

4.7 No employee shall conduct himself in the offices and buildings of the Department in amanner which would discredit the police service.

4.8 No employee shall engage in any form of gambling in the police squad rooms. lockerrooms. assembly rooms, or any other police facili ties.

4.9 No employee shall use loud, indecent, profane, or harsh language in the presence of thepublic. A loud voice. where necessary to communicate in crowd or high noise levelconditions, is not a violation of this section. Employees shall be courteous and civil indealing with the public.

4.10 No employee shall engage in "horseplay" or the playing of pranks while on duty. Suchconduct is prohibited.

4.11 No employee shall solicit any funds for the purpose of buying a gift for any employee ofthe Department. However, employees may solicit nominal amounts from employees ofthe department for gifts for employees leaving the employ of the Department, or forspecial circumstances with authorizat ion by the Chief of Police.

4. 12 No employee shall receive any money or gifts from any type of solicitation related to hispolice employment, except when leaving the employ of the Department or for specialcircumstances approved by the Chief of Police.

4.13 Employees shall not under any circumstances solicit any gift, gratuity, loan, or fee wherethere is any direct or indirect relation between the solicitation and their departmentalmembership except as provided by law and approved by the Chief of Police.

4.14 Employees shall not accept, either directly or indirectly, any gift, gratuity, reward, loan,fee, discount, rebate. or special consideration arising from or offered because of policeemployment or any activity connected with such employment that might reasonahly tendto influence him in the discharge of his official duties.

4.15 No employee shall receive any gift or gratuity from employees junior in rank without theexpressed written permission of the Chief of Police.

4.16 No supervisor shall offer or give any reward or special privilege to any employee of theDepartment for job perf ormance.

4.17 Employees shall not buy anything from or sell anything to any complainant, suspect,witness, defendant, prisoner, or other person involved in any case which has come totheir attention through their employment with the Department, nor shall they act as anintermediary in the payment of a reward for the return of stolen property without priorwritten authorization by the Chief of Police. This does not prohibit an employee fromdealing with legitimate places of business.

4.18 Any reward paid or sent to any employee shall be promptly turned in by that employee tothe Chief of Police, for deposit in a designated fund to be used for the benefit of theDepartmen t.

4.19 Uniformed employees shall render a military salute to the United States flag and nationalanthem at appropriate times, whether wearing a hat or not. Employees in civilian dressshall render proper civilian honors to the United States flag and national anthem atappropriate times.

4.20 No employee shall gossip about matters affecting the Mesquite Police Department orabout any employee of the Mesquite Police Department. No employee shall originate orrepeat rumors about matters affecting the Mesquite Police Department or about anyemployees of the Mesquite Police Department.

Chapter 5 - Responsibilities and General Conduct5.1 For the purpose of protecting life and property, officers shall always be prepared to act

any time circumstances indicate their services are required.

5.2 Officers shall respond without delay to all calls for police assistance. Emergency callstake precedence. However, all calls shall be answered as soon as possible consistent withnormal safety preca utions and traffic laws. Excep t under the most extraordinarycircumstances or when otherwise directed by a supervisor, no officer shall fail 10 answerany call for service directed to him.

5.3 While on duty or in uniform within the city of Mesquite. officers shall at all times takeappropri ate action to:A. Protect life and property .B. Preserve the peace.C. Prevent crime .D. Detect and arrest violators of the law.E. Enforce all federal, state. and local laws and ordinances coming within

departmental j urisdiction.5.4 While off duty and out of uniform. officers shall take appropriate action if requi red by the

situation to:A. Protect life and property .B. Preserve the peace.C. Prevent crime.D. Detect and arrest violators of the law.E. Enforce federal. state, and local laws and ordinances coming within departmental

jurisdiction.In most case s, appropriate action will consist of stabilization of the situation andreferral of the matter to an on-duty officer for resolution.

5.5 The ranking on-duty supervisor at the scene of any police incident shall be in charge andresponsible for the proper conclusion of that incident. In the absence of a supervisor, thesenior officer present shall be in charge and responsible for the handling of the incident.The supervisor or senior officer shall remain at the scene until such time as the incident isunder control, is being prope rly handled in accordance with existing policies, andsufficient instructions have been issued to result in the proper conclusion of that incident.

5.6 Employees shall , at all times, respond to the lawful orders of supervisors and other properauthorities as well as requests for police assistance from citizens. The administrativedelegation of the enforcement of certain laws and ordinances to particu lar units of theDepartment does not relieve office rs of other units from the responsibility of takingprompt, effective police action within the scope of those laws and ordinance s when theoccasion so requires . Officers assigned to special duty are not relieved from takingenforcement action outs ide the scope of their specialized assignment when necessary. Allemployees shall perform their duties as required or directed by law, departmental rule,policy, or by order of a supervisor.

5.7 No employee shall fail or deliberately refuse to obey a lawful order given by a supervisor.5.8 Officers are required (0 take appropriate police action to aid a fellow peace officer

exposed to imminent danger.5.9 All emplo yees are subject to recall to duty, regardless of the duty hours assigned to that

employee, in compliance with (2 V.T.C.A. Local Government Code , Chapter 142.00 15(g).

5.10 No employee shall be absent without leave. (Absence without leave shall mean either afailure to report for duty at the time and place of duty or the leaving of a place of duty orassignment withou t proper authoriza tion.)

5.11 Unless otherwise directed, employees shall report to daily roll call at the time and placespecified in proper dress and equipment. They shall give careful attention to orders andinstructions. avoiding unnecessary talking or movement.

5. 12 It shall be the responsibility of each employee who cannot report for duty due to illness,injury , or other circumstance to notify a supervisor in accordance with currentdepartmental order.

5.13 Each employee shall keep the Department informed as to his current address andtelephone number.

5.14 Employees shall report any change in address or telephone number within one businessday of such change.

5.15 In instances where an employee shall be absen t from his listed address and telep honenumber for an extended period; he shall provide information as to how he may bereached in an emerg ency as required by current departme ntal directive.

5.16 No employee shall work off-duty or engage in any other activity which would reasonablybe expected to hinder rec uperation or aggravate an incapaci tation:A. DUli ng a scheduled duty period when he is on sick or injury leave, orB. Withi n 8 hours prior to a scheduled duty period during which he expects to be on

sick or injury leave, orC. Within 8 hours after a scheduled duty period for which he was on sick or inj ury

leave.5.17 Employees shall remain alert, observant, and occupied with police business during their

tour of duty. When on duty, employees shall devo te their entire time and attention to thebusiness of the Department.

5.18 Employees are prohibited from engaging in the following activities while on duty:A. Sleeping.B. Recreational reading (except at meal s).C. Conducting private business.D. Carrying any articles which distract from the proper performance of police duty.E. Drinking intoxicating beverages (exce pt in performance of a police duty, and

then only with the specific consent of a lieutenant or above, and never inuniform).

F. Gambling (except in performance of a police duty, and then only with thespecific consen t of a lieutenant or above , and never in uniform).

G. Any sexual cond uct.H. Promoting a par ticular political or religious philosophy or position, or

distributing political or religious materia l.5. 19 Employees are proh ibited from following any other vocation which might conflict or

interfere with their responsibility to the Department. Employees must receive permissionfrom the Chief of Police to engage in off-duty employment or business activities. Officersare prohibited from holding a deputation or commission from any other law enforcementagency.

5.20 Employees shall promptly submit reports which are required by the performance of theirdu ties or by supervisory authority.

5.2 1 Officers shall have prior approval of their supervisor before initiating undercoverinves tigations. In cases where officers are already deploy ed in an undercover capacityand they begin another assignment unrelated to the existing assignment, they shall notifytheir super visor within twenty-four (24) hours.

5.22 Employees shall not consume intoxicants to the extent that evidence of such consumptionis apparen t when reporting for duty, when on duty, or when in uniform, or to the extenttheir job performance is impaired.

5.23 Employees shall not consume or use any substance which , by reason of odor or othercharacteristic. might reasonably lead an employee of the public to conclu de that theemployee had cons umed alcohol, or was under the influence of alcohol, while on duty orin uniform.

5.24 Employees shall not be intoxicated while on duty or in uniform. They shall not at anytime. on or off duty, be intoxicated in public view.

5.25 No employee in uniform shall purchase, possess . be under the influence of, or drinkintoxicants while on or off duty. Possession of intoxicants which have been lawfullyseized for the purpose of transporting such intoxicants to the official departmentalproperty control officer is not a violation of this section.

5.26 Employees shall not bring or keep any intoxicating liquor on departmental premises.except for the follow ing purpose:

Liquor brought on departmental premises in thefurtherance of a police task shall be properlyidentified and stored according to policy.

5.27 No employee shall smoke or chew tobacco or gum while making personal contacts withcitizens in the performance of his duties. No employee shall smoke, chew, or use tobaccoproducts in a city-owned/leased building. No employee shall smoke, chew or use tobaccoproducts in a city vehicle.

5.28 No expen diture of money shall be made or liability incurred in the name of the City ofMesquite or the Department unless authori zed by the Chief of Police.

5.29 No employee shall initiate or accept a toll telephone call for personal purposes. Toll callscha rged to a city telephone account shall be limited to City business.

5.30 No employee shall permit any person to enter a police facility whose purpose is to sellgoods, offer them for sale, canvass or solicit for any purpose without permission of theChief of Police.No employee shall use the address of the Department as a mailing address for personal orprivate purposes including, but not limited to, motor vehicle registration and driverslicense records. No employee shall use Department telephone numbers as contactnumbers for personal or private purposes.Each employee shall cooperate with every other employee in all departmental matters.Official intra departmental communications shall be conducted through the chain ofcommand. However, no supervisor shall prohibit a subordinate employee fromcommunicating directl y with a supervisory officer, provided the subordinate first makescontact with each intermediate level in the chain of command. The office of the Chief ofPolice is always open to employees for discussion of individual career goals, personalmatters , or other subjects not relating to operational procedures or departmental policy.

5.34 No employee shall send any official written communication which does not bear thename of the Chief of Police to any person outside the Department.

Ch apter 6 - Protection of Prisoners Righ ts and Property6.1 No employee shall arrest any person or search any premises or person except with a

warrant of arrest. a search warran t, or where such arrest or search is authorized without awarrant under the laws of the State of Tex as. the United States. or the ordinan ces of theCity of Mesquite.All empl oyees shall protect the rights of any person held in custody and no employeeshall verbally abuse or use any unnecessary force against any person.No emplo yee shall falsely arrest, imprison, or direct any malicious prosecution againstany person .No employee shall willfully mistreat or give inhumane treatment to any person held incustody.Employees shall use no greater force than necessary in effecting an arrest andmaintaining custody of prisoners.Office rs shall use deadly force in effecting an arrest only as authorized by law and asprescribed by the general orders and other orders of the Department.

6.7 No employee shall negligently lose or cause to be damaged or destroyed any property orequipment belonging to a person in custody or which has come into possession of saidemployee by reason of his office. Employees may be required to make restitution if a lossor damage does occur as a result of negligence on the part of the employee.

Chapter 7 - Public Activ ities7.1 No employee shall seek the influence or intervention of any person outside the

Department for purposes of personal preferment, advantage, transfer, or advancement.Should any employee learn of any intervention in his behalf, he shall notify his BureauCaptain.

7.2 No employee shall become a member of any organization, association, movement orgroup which advocates or approves the commission of acts of force or violence to denyothers their rights under the Constitution of the United States or which seeks to alter theform of government of the United States by unconstitutional means.

7.3 No employee shall participate in any type of disruptive protest demonstration nor shallany employee act as a spokesman, representative, or agent for any group engaged in orplanning to engage in any type of disruptive protest demonstration.

7.4 Except for official police duties, no employee of this Department shall associate withpersons whom the employee could reasonably be expected to know were of immoralcharacter. convicted felons, gamblers, or other persons who habitually commit violationsof the law. This does not exelude an employee of this Department from associating withmembers of his immediate family if they fall within the aforementioned category.

7.5 Employees shall not permit their name or photograph to be used to endorse any productor service which is in any way connected with law enforcement without the permission ofthe Chief of Police. Employees shall not, without the permission of the Chief of Police,allow their name or photograph to be used in any commerc ial testimonial which alludesto their position or employment with the Department.

7.6 Debts - incurrence and payment:A. Employees shall not solicit subordinates to co-sign or endorse any promissory

note or other loan.B. Employees shall pay all just debts and legal liabilities incurred by them.

Chapter 8 - Civil, Criminal, Judicial, and Investiga tive Actions8.1 The Department has jurisdiction in criminal cases only. No employee shall render aid or

assistance in civil cases except to prevent an immediate breach of the peace or to quell adisturbance actually existing. This rule is not intended to prevent employees frominforming any citizen as to steps necessary to institute a civil lawsuit.

8.2 No employee shall investigate any criminal case or personally file any criminal charge ina court of law against any person for a criminal offense committed against him or anymember of his family except Class C misdemeanors occurring in the employee 's presencewhile on duty. Other offenses that may be committed against him or members of hisfamily shall be reported to the division of the Department having responsibility for theinvestigation of such offenses, The personnel of that division shall investigate and filesuch charges as may be proper. This section is not intended to prohibit an officer fromtaking immediate action as required to stabilize the situation until the arrival of theinvestigating officer(s).

8.3 Employees shall be truthful at all times, whether under oath or not.8.4 Employees shall answer questions by or render material and relevant statements to a

competent authority in a departmental personnel investigation when so directed.8.5 No employee shall willfully misrepresent any matter, submit any false statement or

report, commit perjury, or give false testimony before any court, grand jury. board,commission. official hearing, or departmental hearing.

8.6 No employee shall knowingly falsify any report , document, or record or cause to beentered any inaccurate. false, or improper information on records, documents, or reportsof the Department or of any court or alter any record, document, or report except by asupplemental record. document, or report. No employee shall remove or destroy or causethe removal or destruction of any report, document, or record without authorization.

8.7 Employees must be present and available to testify in any court or before any grand j uryin Dallas County when officially notified to appear. In criminal cases outside DallasCounty and in all civil cases employees shall respond to a legal subpoena only. Anemployee who receives a subpoena or other directive to testify in a civil case shallimmediately notify the Mesquite Police Department, in writing, through the chain ofcommand.

8.8 Employees who, for a valid reason, are unable to answer an official summons must beexcused by the court or grand jury at least one hour prior to the time they are scheduled toappear.

8.9 Any employee subpoenaed or who volunteers to testify as a witness for the defense inany criminal proceeding shall immediately notify the Mesquite Police Department uponreceipt of the subpoena or of his intention to testify prior to his appearance. Anyemployee subpoenaed or who volunteers to testify or witness against the City ofMesquite or any other governmental body in any civil proceeding or hearing shallimmediately notify the Mesquite Police Department upon receipt of the subpoena or ofhis intention to testify. prior to his appearance as a witness. Notifications required underthis section shall be made to the Chief of Police, in writing, through the chain ofcommand.

8.10 No employee shall accept a fee for service as a witness in any criminal case. Witness feesfor civil court appearances may be authorized on an individual basis.

8.11 Employees shall not engage in any of the following conduct:A. Interf ering with the service of lawful process.B. Interfering with the attendance or testimony of witnesses through coercion,

bribery. or other means.C. Attempting to have any Notice to Appear on traffic citation reduced, voided, or

stricken from the calendar without approval of a lieutenant or above.D. Recommending a dismissal, reduction of charges, or other disposition of a

pending criminal case which has been previously filed in any criminal court orbefore any grand jury without approval of a supervisor the rank of lieutenant orabove.

E. Taking any other action which interferes with the efficiency or integrity of theadministration of criminal justice or departmental discipline.

F. Having knowledge of such interference and failing to inform a supervisor inwriting.

8.12 Employees shall not suggest, recommend, advise, or otherwise counsel the retention ofany attorney or bail bond broker to any person coming to their attention as a result ofpolice business. This does not apply when a relative or personal acquaintance of theofticer seeks such service. In no case may such advice be given where a fee, gratuity, orreward is offered by. solicited or accepted from the attorney or bail bondsman.

8.13 No employee shall give any lawyer, bondsman, or the agent of either, or any other personunauthorized information regarding prisoners in confinement, property in custody, orrecords of the Department.

8.14 Employees shall not furnish bail or act as a principal or surety on any bail bond or bailbond application for any person charged with any type of criminal offense exceptmembers of their immediate family.

8.15 No employee shall reveal any confidential information to anyone unless authorized to doso and then only to a person or persons authorized to receive such confidentialinformation.

8.16 No employee shall make known any information concerning the progress of aninvestigation, a known or reported law violation, a condition against which action is to betaken at a future time, or any proposed police operation to any person not authorized toreceive it.

8.17 Employees shall not communicate in any manner, either directly or indirectly, anyinformation which may assist persons guilty or accused of criminal or quasi-criminal actsto escape arrest or punishment or which may enable them to dispose of or secreteevidence of unlawful activity, money, merchandise, or other property unlawfullyobtained .

8.18 No employee shall release any police report, police record, arrest report, prosecutionreport, criminal history file, mug shot picture, or other record or report to any person oragency except in compliance with the current General Order regarding Open Records andthe Texas Public Information Act.

8.19 No employee shall encourage or recommend the initiation of a civil suit against the Cityof Mesquite, the Mesquite Police Department, or any employee of the Mesquite PoliceDepartment. Complainants seeking redress of any alleged grievances shall be referred tothe City Attorney.

8.20 Any employee who is arrested, charged with, accused of, convicted of, or who postsbond, or who pleads "guilty" or "no contest" to any criminal offense of any grade or toany offense other than a Class C Misdemeanor traffic offense, or who is the subject of adomestic violence charge or a protective order shall immediately notify the MesquitePolice Department in writing, through the chain of command.

Chapter 9 - Effective Date9.1 This Code of Conduct was effective May I, 1984 (Revised: September, 1990; Revised:

January, 1996: Revised: July, 2000; Revised: August, 2003; Revised: October. 2006;Revised August. 20 II), at which time the previous Code was superseded, except asprovided in Section 9.2 of this Code.

9.2 The previous Code of Conduct shall remain in full force and effect for any violationswhich occurred prior to the effective date of this Code.

9.3 If any section. sentence, clause, or phrase of this Code is for any reason held to beinvalid, such decision shall not affect the validity of the remaining portions of this Code.

ALUMNIPlate Scan Program Overview

The Plate Scan Unit is a 2008 Ford Expedition that was purchased with aFederal grant from money confiscated from drug dealers. This unit isequipped with four cameras that are designed to take pictures of licenseplates. The vehicle is driven slowly through business parking lots,apartment complexes, and residential streets scanning license plateswhich are compared to an on-board database. The system is specificallylooking for stolen vehicles} stolen plates, vehicles owned by a personwith a warrant, a person registered as a sex offender, vehicles flagged bythe police department as a "BOLO" (Be on the Look Out}, and vehiclesflagged as related to an Amber Alert.

The following are rules that apply specifically to the operations and use of the MCPAAAPlate Scan unit:

a) Members must complete the City of Mesquite's Volunteer Application and thedrug screen, paid by the city, with negative results.

b) Members must complete the Plate Scan training and obtain approval from theMCPAAA Liaison officer prior to operation of the Plate Scan unit.

c) Members should schedule time through their Team Leader or Instructor. ThePlate Scan schedule shall be maintained by Team Leaders and Plate ScanInstructors (currently on the MCPAAA Yahoo! Groups page athttp ://groups.yahoo.com/group/MCPAAA).

d) MCPAAA uniform shirts should be worn while driving the Plate Scan unit.e) The Plate Scan unit can be driven during daylight hours.

f) The Plate Scan unit is a multi-person volunteer opportunity. Up to 4 persons canride at one time. Members will be required to allow additional members to joinduring their shift, if requested .

g) Members are not allowed to use or activate the overhead light-bar and/or sirenunless they are in a qualifying event detailed below:

a) Under the direction of a sworn officerb) In a situation to protect self or a third party from immediate dangerc) For maintenance purposesd) Special Events (i.e.: Rodeo Parade)Light-bar use will activate the DVR camera and record events of the situation .Misuse of the light-bar may result in disciplinary action.

h) Members riding in the unit shall remain in the unit at all times, unless to protectself or third party from immediate danger.

i) Members shall not engage in activities while on duty that exceed their authorityas volunteers. Members legally have no implied authority above that of anyother citizen.

j) Members on duty shall not allow family members or guests to "ride along"during volunteering. On rare occasions, by obtaining prior approval of theMCPAAA Liaison Officer, a guest may accompany a member as an observer.

k) Members shall NOT transport citizens without approval from someone rankingas MCPAAA Liaison Officer or above.

I) At all times a member should take the appropriate actions to ensure the safetyof themselves and others.

m) Wear vehicle Safety belts at all times while the vehicle is in motion.n) Observe and obey all traffic rules and laws at all times. Under NO circumstances

are members to commit an intentional traffic infraction in an effort to observeor report any criminal offense.

You will need to locate and obtain the Plate Scan bag, which includes the keys, phone,and charger, from the designated storage location. You will need to fill -out the vehiclelog-out sheet that is located with the bag. The log should include your name, the date ofservice, and the time you are leaving. PRE-START UP PROCEDURES

All members will need to inspect the exterior of the unit for any obvious damage, andreport it to the MCPAAA Liaison Officer. Once you enter the unit, you will need to getfamiliar with the vehicle. Adjust the seat, mirrors, and steering wheel and getcomfortable. You will be driving the Plate Scan unit around town like this was yourvehicle, so you need to know where the controls are. Get used to the words on the backwindow. This sometimes causes confusion while driving, so be aware that it is there.Start the engine.

START-UP PROCEDURES

The following will be a brief overview on how to get the computer and other electronicsgoing in the Plate Scan Unit prior to you driving away.

a) Locate the silver toggle switch on the front of the center console. This is themain power switch for t he computers, DVR and light-bar/PA system. You willneed to press this switch DOWN to power it on .

e) Since you are now officially connected with police dispatch, you need to callthem and let them know that you are taking the Plate Scan Unit int o the city.Call 972-216-6759 and give them your name, number (cel l phone # from thePlate Scan), and the hours that you will be out in the city.

f) The Plate Scan program should start on thecomputer. You will see "Welcome to Platescan" onthe top of the screen and Mesqu ite Police in thecenter. Press the 'Start of Watch' button on thebottom left corner

The Plate Scan computer reads license plates from 4 different cameras. The cameras areplaced in strategic spots fo r the best possible license plate capture. The camera arelabeled 'Front', 'Front Left', 'Front Right', and 'Parking'. The only came ra that you canadjust is t he 'Front' came ra, which is located on the windshield of the uni t (labeledPLATESCAN). You shou ld only adjust th is camera if you need to set t he zoom, focus, orangle. You will not be able to adjust any other cameras since they are pre-set andmounted on the top of the Plate Scan unit.

COMPUTER PROGRAM OPERATIONS

While scanning license plates, the program wi ll notify you that you got a good read oneach plate by beeping and showing you the picture that it took of the vehicle . Theprogram wi ll not always scan every plate, sometimes due to angle, light, reflectivity, etc.The best speed for scanni ng occurs when you are travelling less than 5 mph. If you needto verify a camera angle, you can enable video mode by selecting 'VIDEO' above t hepicture. Make sure that you place the camera back in picture mode ('PIC' button) whi ledriving around .
