I recently requested and actually read the “Report and Recommendatons of the Supreme Court of Ohio Task Force on Access to Justice.” It is very well written and professes to grant access to low-income Ohioans and Ohioans with limited English proficiency. These are the only people the report aims to help, but the report’s potential solutions will “benefit” all Ohioans—especially those do-it-yourselfers, who want to save a buck.

We must wake up to the fact that this is going to happen, and sooner rather than later. The Supreme Court is already implementing the report’s recommendations. Effective July 1, 2016, the pro hac vice registration fees for lawyers will be doubled. Never heard of it? Neither did I. It is a fee imposed on out of state attorneys who want to handle a case in Ohio. They have also added a $50.00 voluntary “add on” fee to our biennial attorney registration to help fund legal aid (we should pay this one).

Where access to justice has lofty goals, those goals are undermined, it not completely shattered by their stubborn insistance on promoting self-help and pro se representation. What happened to the old adage that “a lawyer who represents himself has a fool for a client?” (and that is with a real live licensed lawyer). Do they expect some tight wad off the street to do a better job of representing himself? Could you imagine if the AMA took the same approach?

I view self-help as well intentioned, but misguided. I spent 18 years in small claims court, listening to pro se litigants. It was a nightmare I choose never to repeat. Every member of the Supreme Court’s Task Force on Access to Justice, including the

Supreme Court Justices, should be required to sit in judgment of real pro se cases for at least a week. Maybe then they will realize the utter futility of trying to teach the “masses” how to try a lawsuit--even a simple one.

I realize that I am old and set in my ways, but to me promoting pro se representation is demeaning to the profession I love, an onerous burden on the Judiciary and does a disservice to the pro se litigant. We must find another way.

Unbundling of Legal ServicesThis is another term we better get used to. It is

limited scope representation, where a lawyer is hired to perform a particular service, but not take over the entire case. One can be hired, for example, solely to prepare a qualified domestic relations order or answer discovery or write a complaint. I’m not sure where this will lead, but they are already preparing proposed fee agreements for limited scope representation, so it will be on our doorsteps soon.

It looks as if the pro se litigant will be like a general contractor who hires subs (us) to do the actual work. It will be interesting to see how this plays out.

The Law Week theme this year is “Miranda: More than Words.”

Our program at the Law Day Luncheon will feature Keynote Speaker Attorney Avery Friedman. Attorney Friedman has been called a “walking reference source” on civil rights by The Wall Street Journal. Avery is a nationally recognized civil rights lawyer and law professor and has been called a “true freedom fighter” and “an artist in the courtroom.” He is a weekend legal analyst for CNN and reaches over 3,000,000 viewers weekly.

The luncheon is open to the public and the Bar Association cordially invites your staff, fellow attorneys, family members and friends to attend the luncheon.

Tickets will be $24.00 per person. Please note that the luncheon will begin promptly at 11:45 A.M. We cannot reserve tables other than for the award recipients so it is suggested that you arrive early.

We will be recognizing the recipient of the Liberty Bell Award and Legal Aid Pro Bono Awards, as well as the winners of the Moot Court Competition, Essay and Poster contests. Please join us as we honor these deserving award winners.

All nominations must include a resume and biographical sketch of the nominee, a list and description of the organizations the nominee is serving or has served with letters of support from those organizations, and a brief explanation of why you believe the nominee meets the Award’s criteria. This Award is presented to attorneys, 40 years and younger, who contribute substantial time and effort in service to a local social service, or a local civic, artistic or cultural organization. The service must be outside the recipient’s practice of law and must be given without compensation. Emphasis is placed on current service. Recipients should represent the ideals of the legal profession and, by example, be a credit to the profession. This Award is presented to honorees in each of the OSBA Districts. The statewide Award is chosen from the District honorees.

Why did you join the Stark County Bar Association?My father, Robert Eckinger, has been a member of the Bar for a number of years and encouraged me to join.

What practice areas interest you the most? Civil litigation and business/corporate law. Each case is something different and can present new challenges, which requires you to always be on top of the relevant case and statutory law.

Who are some of your heroes in the legal profession? My father, who has been a respected attorney in Wayne and Stark counties for over 20 years and has mentored me as I begin my legal career.

What was your most rewarding experience during law school? Serving as managing editor of Akron’s Journal of Constitutional Law and Policy during my third year of law school. I had a chance to work with several great legal minds to edit and research their work prior to publication.

What has been your most rewarding or memorable experience while practicing law? Obtaining summary judgment on an employment law matter. Our offi ce put in a lot of work to obtain it and to have our client vindicated in the end was a terrifi c feeling.

What groups or activities are you involved in outside of work?I attend St. Paul Catholic Church in North Canton and try to get to the North Canton YMCA as much as possible. I also enjoy attending Cleveland sporting events, even though each team breaks my heart year after year.

What motto will shape/has shaped your legal career? “Let no young man choosing the law for a calling for a moment yield to the popular belief -- resolve to be honest

What is your favorite legally-related movie or book? A Few Good Men

Are you a stark county native? I grew up in nearby Wayne County, but much of my family resides in Stark County and I spent much time here in younger years so it was always an option that I would end up living here.

What is your favorite place to spend an evening in Stark County? My girlfriend and I enjoy a number of restaurants in the area, but our favorite seems to be Table Six due to the atmosphere and excellent food and drinks.

If the SCBA gave you a blank check to plan a bar outing, what would it be? Attending a Canton Charge game followed by a number of the bars in downtown Canton.

If you could work for any client today, who would it be and why? Smuckers. A local company that has largely remained local and would certainly provide a wide array of legal issues to handle.

If you could clerk for any U.S. Supreme Court Justice in history, who would it be and why? Clarence Thomas because of his consistent application of the original intent of the Constitution and its amendments.

hope and my prayer is that the merger can address the needs of the Community’s exploding mental health and addiction problems. I believe CommQuest is now well positioned to do just that. Susan and I are blessed to be able to mix our lives into each organization’s public functions and fund raisers too. We especially enjoy Quest Cooks (Coming this Summer), the annual Stearn Center fundraiser (Early Spring) and St. Joe’s Lenten Fish Fry and Pancake Breakfast (Coming again in May & we

pray more regularly in the Fall). You can fi nd them all on the web.

Has your community involvement enhanced your career? Absolutely! It has made me a better person and lawyer. It has helped me appreciate the blessings I have in my own life. I have been humbled by many things, but seeing so many souls struggle with life’s problems has energized Susan and I to say yes when we can. We’ve been blessed with so many good people and experiences that we hope we can translate that to impact others, in whatever God calls us to do. There is more than enough work to go around and there is more than enough blessing to share. God willing, I will remain involved where and as long as I can.

What advice would you give to others wishing to get involved? Make time. Susan likes to say that life with me “is always an adventure”. So make it an adventure. Also, I often give the same advice to young people as given to me in my childhood by my elder Italian neighbor. He gardened from sunup to sundown. Life wasn’t work to him either. He was very old when he passed, but extremely blessed with love and family. He used to say, “know your onions”. Learn your stuff before you think you know it all. Get out there, dig around, learn what works and get your hands dirty from time to time. Another favorite movie quote comes to mind, “get busy living, or get busy dying!” Choose to get busy with life!! Put your energy in others and you can never go wrong. When you volunteer, sometimes it means you have to take the trash out. So take the trash out! Sometimes it means being the “Good Samaritan”. So stop and lend a hand! JUST LIVE!!

In what organizations are you currently involved?St. Joseph’s Roman Catholic Church, Canton, Ohio; men’s club. The Stark County Bar Association; Bar Applicant, Municipal Court and Judicial Committees.J. Babe Stearn Community Center; Board of Directors.CommQuest; Board of Directors, Executive Committee, Operations Chair.

How did you become involved? I’ve been more involved in the last 5 years of my life than the previous 45. I’m blessed to be alive. Growing up in a blue collar suburb of Youngstown, we learned that “Church on Sunday and Work on Monday” was an important basis for fi nding our way and staying focused. My involvement with these community groups has happened very organically as part and parcel to the growth of my life and practice here in Stark County. My grandmother always said, “do well what you choose to do and the money and your life will take care of itself.”

What is the time commitment? I don’t keep track. My wife Susan helps keep me on track. We make sure that there is a good balance between our faith, family, my private practice and our health. I am blessed to have such a supportive partner, who shares the same values. Our commitment to St. Joe’s is attending Mass and fi nancial, for now. The Bar Committees meet convenient to everyone’s busy work day. The Stearn Center is a great place to help young men and women stay on track. Its run on the commitment of Dave Miday and Tim Haverstock. The Center’s hallways are fi lled with pictures of great people who have had a far greater impact on the Center than I, so I typically try to stay the course. Quest has been more time intensive. During the merger with Community Services, we met early and often for almost 2 years. Our

The 2014 US Consumer Legal Needs Survey indicated that more than 1 in 3 individuals seeking an attorney turned to the Internet to vet their options, and the overwhelming deciding factor in whom they chose came down to practice area expertise.1 This statistic can make marketing for new attorneys, small firms, and even seasoned lawyers who dab-ble in several different areas of the law seem like a daunting task. But one of the easiest ways for attorneys to demon-strate their commitment to a practice area and communicate expertise to inquiring clients is to join related trade associa-tions. There are thousands of niche professional groups to choose from related to virtually every legal topic under the sun, and while pricey membership fees can be a turn off, trade associations have a lot more to offer attorneys than simply a quick resume boost.2 1) Reputation Through Association Increased credibility among clients and colleagues is of-ten the byproduct of trade association affiliation because membership demonstrates an individual’s commitment to and understanding of an industry/group and its initiatives and standards.3 Likewise, membership also offers attorneys the opportunity to build a reputation within the industry/group itself by getting involved in projects, presentations, and committees and through interactions with other associa-tion members.4 2) Exposure to Potential Clients & Referrals Joining a professional organization provides attorneys with an instant network of potential clients and referrals. Attendance at official meetings and annual events gives at-torneys a chance to meet industry leaders and make an im-pression on the precise demographic their law practice serves. This kind of targeted outreach can position attorneys as go-to resources within trade groups and result in a ripple effect of referrals to potential clients outside the association.5 3) Tapping into Knowledge Trade associations have their finger on the pulse of indus-try news, developments, and trends. Many offer members-

only publications in print or delivered digitally that provide analysis and insight into the perspectives of the organization and its leaders. Trade groups also frequently release various independent research reports, surveys, and statistical compi-lations. Fellow members can prove to be information assets as well when it comes to technical or specialized industry-related questions that attorneys may have, and association-sponsored webinars and lectures by industry experts provide additional educational opportunities that aren’t available elsewhere.6 4) Diverse Marketing Opportunities One thing all trade associations have in common is their emphasis on member networking, which means the oppor-tunities for attorneys to engage with their target market are endless. Some example marketing opportunities include:

Publishing an article in the association’s trade publication Registering in the association’s public directory Exhibiting at annual conventions and trade shows Volunteering to provide a lecture or consultation services Sponsoring association events7

5) Industry Engagement Many volunteer leadership opportunities, like committee and board member positions, are available to trade associa-tion members who are interested in contributing to the organ-ization’s outreach mission and member services. In addition to gaining stature among industry leaders, service to trade groups can help attorneys maximize their firsthand knowledge of issues that matter to their clients.8 Choosing a Trade Association Professional organizations exist at the local, state, and na-tional level, and attorneys can investigate their options by querying their clients on what professional organizations they have joined, as well as by browsing association database websites, like the Directory of Professional and Industry As-sociations and Societies.9 Law firms can reap the benefits of multiple association affilia-tions by identifying desira-ble organizations and nom-inating the right lawyers to join on the firm’s behalf.10
