I. Call to Order

The meeting was called to order at 8:01 a.m., Thursday, September 18, 2014.

The following Board members were present: Berrigan, Dalton, Harrell, Johnson, Snider and Gutierrez.

Berrigan presided.

Berrigan welcomed members of the audience, explained the procedure for addressing the Board, and

stated the mission of the Board.

VI.C.6. Jenny Martha Pina RN166241 (Richter)

Snider moved, Gutierrez seconded, and it was unanimously carried to table Agenda Item VI.C.6.

VI.E.1. Mark Newton RN162648 (Pilder)

Newton was present and available for questions. Attorney Rob Chelle was present and addressed the

Board. Johnson moved, Dalton seconded, and it was unanimously carried, based upon the information in

the investigative report, to offer a Consent Agreement for a Decree of Censure. If not signed within 30

days, issue a Notice of Charges.

VI.O.5. Toni Papin RN063339 (Chambers)

Papin and attorney Rob Chelle were present and addressed the Board. Snider moved, Gutierrez

seconded, and it was unanimously carried to issue a Letter of Concern for medication errors made on or

about November 28, 2009, and July 31, 2013, while working as a RN at Hospice of Arizona in Phoenix,

Arizona.

Quinn arrived at the meeting at 8:13 a.m. Quinn presided.

VI.D.7. Christina E. Palaez RN Exam (Morton)

Attorney Rob Chelle was present and addressed the Board. Harrell moved, Dalton seconded to grant

licensure upon meeting all requirements, and issue a Letter of Concern for her May 29, 2002

misdemeanor conviction of Minor in Possession of Liquor, in the Chandler Municipal Court, in

Chandler, Arizona, her December 27, 2003 DUI arrest in Scottsdale, Arizona, her April 13, 2005

conviction of a misdemeanor DUI, and a class six undesignated offense of endangerment, that was

reduced to a misdemeanor on March 2, 2007, in the Maricopa County Superior Court, in Maricopa

County, Arizona. The motion carried with six in favor and one abstained.

VI.N.5. Julie Lindeman Locke RN158299 (Wilson)

(aka: Lindeman; Fahnel)

Wilson addressed the Board and confirmed receipt of additional information. Attorney Rob Chelle was

present and addressed the Board. Julie Locke was present and available for questions. Dalton moved,

Gutierrez seconded, and after discussion it was unanimously carried, based upon the information in the

investigative report, offer a Consent Agreement for a Decree of Censure. If not signed within 30 days,

issue Notice of Charges. The Board recommended that Locke complete an Ethics Course.

Quinn moved, Snider seconded, and it was unanimously carried to reopen Agenda Item VI.C.6.

Attorney Craig Orent was present and addressed the Board. Johnson moved, Snider seconded, upon a

determination of reasonable cause, based on the facts alleged in the investigative report, and material

presented at this Board meeting, issue an Interim Order for a substance abuse evaluation by a Board

approved PhD level licensed psychologist, at no cost to the Board, and to include any additional testing

deemed necessary by the evaluator, to be completed within 45 days and then return to the Board. If the

Interim Order is not completed, based upon the findings of fact and statute/rule violations identified in

the investigative report, issue a Notice of Charges and include the factual allegations and alleged

violations of statute and rule for failure to comply with the Interim Order.

VI.P.10. Amie Lyn Schnorr RN123257 (Galan) Attorney Teressa Sanzio was present and addressed the Board. An attempt was made to contact Schnorr

telephonically. Johnson moved, Dalton seconded, and it was unanimously carried, based upon the

findings of fact and statute/rule violations identified in the investigative report, upon meeting all

licensure requirements and signing a Consent Agreement for a 12 month stayed revocation during which

time the license is placed on probation with terms and conditions, followed by a 12 month probation

with terms and conditions, all to include attached stipulations, grant a limited license for the purposes of

completing an RN Refresher course, for licensure. Upon successful completion of RN Refresher Course,

issue RN license under applicable terms contained on the attached stipulation worksheet. If not signed

within 30 days, deny licensure.

telephonically and addressed the Board. Gutierrez moved, Johnson seconded, and it was unanimously

carried, upon a determination of reasonable cause, based on the facts alleged in the investigative report,

and material presented at this Board meeting, issue an Interim Order for a psychological evaluation with

an emphasis on anger management by a Board approved PhD level licensed psychologist, and to include

any additional testing deemed necessary by the evaluator, at no expense to the Board, to be completed

within 45 days and then return to the Board. If the Interim Order is not completed, based upon the

findings of fact and statute/rule violations identified in the investigative report, issue a Notice of Charges

Pilder addressed the Board with additional information. Spender was present and attorney Kathryn

McCormick were present and addressed the Board. Quinn moved, Gutierrez seconded, based on a

determination of reasonable cause, based on the information in the investigative report (and material

presented at this Board meeting), at no cost to the Board, issue an Interim Order for a psychosexual

misconduct evaluation to be completed by a Board approved licensed psychologist who has expertise in

professional sexual misconduct, and to include any additional testing deemed necessary by the

evaluator, to be completed within 45 days and then return to the Board. If the Interim Order is not

completed, based upon the information identified in the investigative report, issue Notice of Charges

against the privilege to practice and deny the application for licensure and include the factual allegations

and alleged violations for failure to comply with the Interim Order. The motion carried with four in

Daniels was present and attorney Darius Nickerson was present and addressed the Board. Johnson

moved, Snider seconded to issue a Letter of Concern for tampering with a prescription label and

submitting the label as false evidence in response to a positive urine drug test for oxycodone, a drug for

which she did not have a prescription. After discussion the motion failed with five opposed and two in

favor.

1202088 and issue a Letter of Concern that on or around September 13, 2013, while Shepis was

employed as an RN at BrightStar Home Care in Tucson, Arizona, she completed a form required for

patient C.C. to receive home health aide services and failed to include on the form that respondent

obtained the required information from C.C.’s niece, R.C. instead of directly from C.C.

Greabell addressed the Board and confirmed receipt of additional information. Michael and attorney Ken

Baker was present and addressed the Board. Quinn moved, Berrigan seconded, on a determination of

reasonable cause based on the information contained in the investigative report (and material presented at

this Board meeting), at no cost to the Board, issue an Interim Order for a substance abuse and relapse

evaluation to be completed by a Board approved evaluator who is at minimum PhD prepared, and to

include any additional testing deemed necessary by the evaluator, to be completed within 45 days and then

return to the Board. If the Interim Order is not completed, based upon the information contained in the

investigative report and material presented at this Board meeting, issue Notice of Charges and include the

factual allegations and alleged violations for failure to comply with the Interim Order.

requirements, and issue a Letter of Concern for Applicant’s April 4, 2013, conviction of Driving under

VI.B.9. Taylor Bryce Mitchell RN Exam (Monas)

Monas addressed the Board with additional information. Attorney David Klink was present and

addressed the Board. Mitchell was present and available for questions. Dalton moved, Johnson

seconded, and it was unanimously carried to grant licensure upon meeting all requirements, and issue a

Letter of Concern for Applicant’s January 3, 2005, charges of Manuf/Dist or Intent to Manuf/Dist

Controlled Dangerous Substances, Possession of Marijuana/Hash over 50 grams, Possession of Drug

Paraphernalia, Possession of Controlled Dangerous Substances (Other), Inhalation of Toxic Chemicals,

Distributing Drugs on School Property, dismissed on or about January 17, 2007, after completion of “1

year Conditional Discharge,” received on November 3, 2005.

The meeting recessed at 9:52 a.m. and reconvened at 10:09 a.m.

Attorney Anthony Fernandez was present telephonically and addressed the Board. Covert was present

telephonically and available for questions. Berrigan moved, Dalton seconded, and it was unanimously

carried to dismiss the complaint.

Complainant S.H. was present telephonically and addressed the Board. Attorney Fulton Cavett was

present telephonically and addressed the Board. Mellinger was present telephonically and available for

questions. Snider moved, Dalton seconded to dismiss the complaint. After discussion the motion carried

with four in favor and three opposed.

III.E. Board Information Regarding Imposters, Cease and Desist Orders and Court

Ordered Revocations

III.E.1. Amanda L Trujillo RN137552 V. Smith

Lucia Trujillo, mother of Amanda Trujillo, was present and spoke to the Board, including reading a

statement she said was written by Amanda Trujillo. Ms. Trujillo asserted the complaint information

submitted to the Board related to Cease and Desist Order was fabricated, and a document showing

Amanda Trujillo’s LinkedIn profile had been altered. She stated the LinkedIn profile that was online

was created years ago and did not contain current information. Ms. Trujillo stated she does not agree

that Amanda Trujillo should not be able to use title "nurse". Board members directed her to the

statutes, and mentioned title protection. Staff clarified that after receipt of the complaint, Ms. Trujillo’s

LinkedIn profile was obtained independently by staff, who found that the online profile was active and

incorrectly identified Trujillo as presently employed as an RN.

V.B.6. Norman Nicholas Mack LP018901; RN146159 Greabell

Greabell addressed the Board with additional information. Quinn moved, Harrell seconded, and it was

unanimously carried to allow Respondent to continue on Consent Agreement and Order No. 1303033.

Respondent shall obtain a substance abuse and anger management evaluation with a Ph.D. level Board

approved evaluator and begin nursing ethics counseling or coursework in nursing ethics within 60 days

of the Board meeting. If the evaluation is not completed and coursework or counseling in nursing ethics

has not commenced with 60 days, lift the stay of revocation. Consent Agreement and Order No.

1303033 remains in effect until the matter is resolved. Issue a Letter of Concern, while under Consent

Agreement and Order No. 1303033 for failing to complete a psychiatric substance abuse and anger

management evaluation with a Ph.D. level Board approved evaluator within 30 days of the effective date

for the Order and for failing to make an appointment to undergo and complete nursing ethics counseling

or submit a syllabus of proposed ethics coursework to Board staff within 30 days of the effective date of

the Order.

Gregg Harris addressed the Board regarding his work on the CNA funding issue relating to operating

costs for the CNA program. Meetings have been held with some legislators and additional meetings are

scheduled to be held with stakeholders interested in determining a comprehensive goal solution, with

funding solutions that would work well for the stakeholders and for the Board. A report outlining CNA

funding issues, federal restrictions to not charge CNA applicants, and Board recommendations to

implement a fee structure to charge, is due to the legislature on November 1, 2014.

Gregg Harris noted there was interest in sunrise applications which he will monitor. Harris stated that

VII.B.11. Grand Canyon University Family Nurse Practitioner Program Investigative Report

Doolen addressed the Board with addition information. Dr. Anne McNamara was present and addressed

the Board. Busby moved, Snider seconded, and it was unanimously carried, based upon the information

contained in the investigative report, issue a Letter of Concern to Grand Canyon University, Family

Nurse Practitioner Program for accepting more students than could be placed in clinical settings within

the first two weeks of the class in the NUR 668 (Advanced Practice Management Pediatric and

Adolescent Health Care Problems) course, and providing instruction to students to document pediatric

care given in Typhon logging system on a different date than actually seen.

Harrell left the meeting 1:16 p.m. and returned at 1:20 p.m.

VII.B.12. Everest College Phoenix RN Program Investigative Report

Dr. Ed Johnson and Dr. Bonnie Wilson were present and addressed the Board. Busby moved, Quinn

seconded, and it was unanimously carried, based on information contained in the investigative report,

issue a Notice of Deficiency with 6 months to correct the identified deficiencies. Additionally require

that the program submit a comprehensive self-study before the end of the 6 month period. Board staff

shall conduct an evaluative site visit following receipt and analysis of the self-study report.

VII.B.13. Pima Community College RN Nursing Program – West Campus: Resolution of

Deficiencies

Brian Stuart was present and available for questions. Busby moved, Dalton seconded, and it was

unanimously carried to accept evidence provided by Pima Community College West Campus RN

Nursing Program as evidence of resolution of the deficiencies of August 30, 2013. Restore full approval

status to the Program.

VII.B.14. Standard Education Program Stipulation Sheet and Template for Probation for

Education Programs.

Johnson moved, Gutierrez seconded, and it was unanimously carried to approve Standard Education

Program Stipulation Sheet and Template for Probation for Education Programs.

VII.A.8. Board Member Education: New Data- Interpretation of the Nursing Performance

Profile and Report on the NCSBN National Simulation Study – Randolph.

Randolph provided an educational session related to medication errors analysis as part of the NCSBN

supported research, “Measuring Competency with Simulation: Phase II”. Ridenour applauded Randolph

for helping to understand practice break down.

An attempt was made to contact Hoffman telephonically and a message was left that the Board would

move forward with the case. Quinn moved, Gutierrez seconded, and it was unanimously carried to issue

controlled substance on or about December 18, 2012, while employed as a RN at Sierra Blanca

Rehabilitation in White River, Arizona, and for failing to properly store and/or dispose of unused

medication when you mistakenly removed the medication from its card in non-sequential order.

II.I.2. Kyle Stephen Oswald RN176980 Powell

The proceeding began at 1:57 p.m., with the following Board members present: Quinn, Berrigan,

Dalton, Harrell, Johnson, Snider, Gutierrez, and Busby.

Powell addressed the Board with additional information.

Attorney Michael Helbert and Oswald were present and addressed the Board.

Based upon the information presented at this meeting, all Board members verbally agreed that a showing

of extraordinary circumstances or the possibility of irreparable harm has been made supporting the need

for a Summary Suspension.

Busby moved, Berrigan seconded, and it was unanimously carried, based upon the information

presented at this meeting and the information contained in the investigative report, to accept and adopt

the proposed preliminary Findings of Fact and Conclusions of Law of the Findings set forth in the draft

Order attached to the investigative report.

All Board members verbally agreed that the foregoing conduct poses an immediate threat to the public

health, safety, or welfare and requires emergency action pursuant to A.R.S. § 41-1092.11(B).

Busby moved, Berrigan seconded, and it was unanimously carried, based upon the information

presented at this meeting, the findings of fact and statute/rule violations identified in the investigative

report, and make a finding that public health safety and welfare imperatively requires emergency action

and issue an Order summarily suspending the license of Kyle Oswald, RN176980, pending further

hearing. The hearing shall be promptly instituted and determined within 60 days.

It was therefore ordered that the license of Kyle Oswald, RN176980 be suspended effective with the

service of the written Order, and that Oswald will immediately cease practice as a nurse/certified nursing

assistant. This suspension shall remain in effect pending a public hearing and final decision by the

Arizona State Board of Nursing pursuant to A.R.S. § 32-1664.

regular Board meeting.

VII.A.2. FY 2014 Budget Final Report; Proposed FY 2016 Budget-

Orchard/Bontrager/Ridenour

Orchard offered a summary of the FY 2014 Budget Final Report and Proposed FY 2016 Budget. She

reported the total appropriated funding for FY 2014 was $4,275,600. As of the current date,

$4,275,083.42 has been expended, with a remaining balance of $516.58. Once all FY 2014 expenditures

have been paid the estimated balance will be $0.00.

During the spring of 2014, the Board was granted additional supplemental funding for CNA program

operations in the amount of $150,000. At the end of the fiscal year, 2014, all was expended, leaving a

balance of $0.00.

The estimated budget for FY 2016 is $4,721,600. The budget submittal includes an additional funding

request from the Nursing Board fund in the amount of $449,500 and approval to extend the General

Fund appropriation of $150,000 into FY 2016, for a total request of $599,447. The total funding request

of $599,447 represents the amount of grant funding that is short in covering all costs of the CNA

program.

VII.A.5. FY 2014 Licensure Time Frame Report & Average Cycle Times for Licensing

Nurses & Certifying Certified Nursing Assistants –Bontrager

Bontrager stated that there was a 6.7% increase in applications received in fiscal year 2014.

VII.A.6. Update on House Bill 2087: Health Regulatory Board Training Requirements-

Ridenour

Ridenour presented information regarding Health Regulatory Board Training Requirements that have

not yet been finalized. Some Boards are looking at FARB/CLEAR. Our Board will continue our

dedicated cycle for continuing education.

VII.A.7. Update APRN Consensus Model & APRN Compact - APRN Consensus Workshop

October 25, 2014 – Scottsdale Healthcare Shea Campus Conference Center Quinn

Quinn gave an update on the upcoming APRN Consensus workshop, noting that Ridenour would be a

speaker at the conference.

Quinn reported that the annual meeting was attended by Quinn, Randolph and Bontrager.

Valerie Smith introduced new staff: Daniel Phelan joined as Sr. Investigator, Rosemary Powell and

Cindy Mand joined as Nurse Practice Consultants.

Austin acknowledged, Monitoring and CANDO staff for the outstanding job they did on the transition to

Recovery Trek.

VII.A.11. Proposed Revision to Policy: Certification of Nursing Assistant Applicants-

Randolph addressed the Board. Busby moved, Snider seconded, and after discussion it was unanimously

carried, to approve recommended changes in the policy.

VII.C.1. Update on New Board Member Appointments Reappointments –Quinn

Quinn reported Governor Brewer appointed Jana Machesky, LPN, and Dr. Melinda Preston and

reappointed Lori Gutierrez and Randy Quinn to the State Board of Nursing.

VII.C.2. Recognition of Board Members Retiring: Pat Johnson & Charleen Snider-All

Quinn and the Board expressed their appreciation and offered best wishes to retiring Board members,

Pat Johnson and Charleen Snider.

VII.C.3. Debriefing on Board Processes and Suggested Changes - All

The Board thanked Susie Flores, Administrative Assistant, for quick uploads of additional information

in the Board packet.

The Board discussed how to handle respondents who contacts the Board members regarding their cases.

The Board expressed concern regarding sexual misconduct/domestic violence. Discussion centered on

the best way to handle these kinds of cases and how to educate the public.

Staff asked the Board for feedback on Education Investigative reports and to approve stipulation sheet

format. Approved for the use of the stipulation sheet was given.
