CALIFORNIASenate Bill 1078 Civil Procedure: arbitration was vetoed by the Governor at the end of September.

In his veto message the Governor stated…

“The bill prohibits an arbitrator from accepting an offer of employment in a future case involving

a party or lawyer in a pending arbitration, without prior written consent. The bill also adds

prohibitions and disclosure requirements relating to certain solicitations made by private

arbitration companies.

Arbitrators in California are already subject to stringent disclosure requirements under existing

state law and Judicial Council standards. I am reluctant to add additional disclosure rules

and further prohibitions without evidence of a problem. Further, the existing Judicial Council

procedure for amending arbitrator ethics standards is a deliberative and public process that can

appropriately consider additional requirements.”

Senate Bill 1065 Dismissal or Denial of Petitions to Compel Arbitrations: Appeals was signed by

the Governor and enacted. SB 1065 originally would have eliminated provider’s ability to appeal a

court ruling when the court does not compel arbitration. CALA along with many other stakeholders

were able to secure an amendment to the bill which will expedite the appeal process.

Senate Bill 648 Health and Care Facilities: Referral Agencies was vetoed by the Governor on

September 30th. SB 648 would have required among other things that a referral agency obtain a

license from the Department of Social Services. In his veto message the Governor stated…

“This bill creates an expansive and costly licensing scheme for agencies that make referrals to

residential care facilities for the elderly.

The proponents of this measure have not made a convincing case for this new licensing structure.”

ARGENTUM AND OUR STATE PARTNERS ARE MONITORING OR ACTIVELY WORKING TO GAIN PASSAGE OR DEFEAT THE FOLLOWING BILLS/REGULATORY MATTERS.

PENNSYLVANIA House Bill 1785 An Act Requiring the Preparation and Publication of Information Relating to

the Influenza Vaccine is being considered in the Senate. This bill would require personal care

homes and assisted living residences to distribute information provided by the Department of

Health to residents about information pertaining to the influenza vaccine.

Lame Duck Outlook

On September 28, 2016 the House and Senate passed a continuing resolution funding the government through December 9, 2016. In addition to providing funding at $3 billion below the FY 2017 level discretionary spending cap, the bill includes money for Zika abatement and flood relief for Louisiana. When the Congress reconvenes after the November election it will have to address a number of priorities and decide how it will tackle a number of issues, most importantly how it will advance a final budget deal.

For Argentum, key issues include funding for senior priorities included in the FY 2017 Health, Education and Labor Appropriations bill and passage of the 21st Century Cures Act. Senate Majority Leader Mitch McConnell has been quoted saying that passing the 21st Century Cures Act is one of his main goals in the lame duck session. Additionally, more than 30 tax provisions are set to expire at the end of 2016. Senate Finance Chairman Orrin G. Hatch has said a tax extenders bill is possible for the lame-duck session; however, the final decision will be up to the House and Senate leadership. The outcome of the November elections will definitely impact these issues and set the stage for the 115th Congress.

CMS Rule to Expand Coverage for Alzheimer’s Supports as part of Physician Payment Reform

Updates for coming year – As part of the CMS proposed rule to update payment policies for services provided under the Medicare Physician Fee Schedule a number of proposed policy changes were also included. One that Argentum has been closely monitoring and strongly supports is the new code to pay for cognitive and functional assessment and care planning for patients with cognitive impairment (e.g., for patients with Alzheimer’s and as advocated for as part of the HOPE for Alzheimer’s Act). This policy will ensure screening and a person centered approach which will lead to better care and quality of life. Additionally, other important changes included: payment for specific behavioral health services furnished using the Collaborative Care Model; payment for chronic care management, including payment for new codes and for extra care management furnished by a physician or practitioner following the initiating visit for patients with multiple chronic conditions; and more accurate payments to physicians for furnishing services to beneficiaries with mobility-related impairments. Finally, the rule would expand the Diabetes Prevention Program model; expand telehealth services to include advanced care planning and critical care services; and payment for primary care services. The final rule will be issued later this year and all payments under the new Medicare Physician Fee Schedule will be effective beginning January 1, 2017.

NIH Funding Increased The National Institutes of Health recently received increased funding for the BRAIN initiative. The NIH announced $70 million for the BRAIN initiative, nearly doubling its investment in the research program.

WORKFORCE DEVELOPMENT

Argentum joins in Support of legislation to Delay or Modify the New Federal Overtime Rules – Both the the Regulatory Relief for Small Businesses, Schools and Nonprofits Act and the Overtime Reform and Review Act would offer a six-month delay of the Dec. 1st implementation deadline and

make modifications to the Department of Labor’s new overtime regulation. Argentum joined the Partnership to Protect Workplace Opportunity in supporting S. 3464 and praising Senator Lamar Alexander (R-TN), Chair of the Senate Health, Education and Labor Committee as well as other lead sponsors including Senators James Lankford (R-Okla.), Tim Scott (R-S.C.), Jeff Flake (R-Ariz.) and Susan Collins (R-Maine). The letter stated “While a responsible increase to the salary threshold is due, the DOL’s drastic increase of more than 100 percent to the salary threshold is too much, too fast, and will have a disproportionate impact on a wide variety of industries, sectors, and geographic areas of the country.”

The Overtime Reform and Review Act ( S. 3464) would phase in the salary threshold over five years and include a “pause year” after the first year to give federal agencies a chance to assess the regulation's impact and possibly exempt certain entities from further increases based on that assessment. The bill would also prohibit automatic indexing of the salary threshold in the future. The Regulatory Relief for Small Businesses, Schools and Nonprofits Act would provide a six-month delay in implementation, similar to legislation (H.R. 6094) passed by the House Sept. 28. Argentum has and will continue to work with the Congress as well as broader business coalitions to find solutions to addressing the complexities of the rule and impact on the senior living industry.

QUALITY CARE

The Agency on Community Living (ACL) announces first-ever voluntary guidelines for state Adult

Protective Services (APS) – ACL Acting Administrator, Edwin Walker announced new voluntary guidelines during the fall meeting of the Elder Justice Coordinating Committee to assist states in

developing efficient and effective APS systems. ACL intends to re-visit and update the guidelines every two years to account for new feedback from the field and emerging research. The guidelines provide recommendations from the field about quality APS practice in the areas of program administration, response times, receiving reports of maltreatment, conducting investigations, service planning and intervention, training, and evaluation. Additionally, Walker emphasized $2.2 million in grants recently awarded to 13 states to enhance statewide APS systems, improve practices and data collection, and interface with ACL’s National Adult Maltreatment Reporting System (NAMRS). The funding doubles the number of states receiving APS enhancement grants since ACL awarded the first-ever federal grants for state APS systems last year.

CONSUMER CHOICE

Efforts to Permanently Extend the Independence at Home Demonstration Program (IAH) – Senator Edward J. Markey (D-Mass.), John Cornyn (R-Texas), Michael Bennet (D-Colo.) and Rob Portman

(R-Ohio) recently introduced legislation to convert the Independence at Home (IAH) demonstration into a permanent, national Medicare program. In 2012, IAH began as a three-year demonstration program in the Affordable Care Act (ACA) and has been extended for the past two years. Additionally, nationwide expansion of the program is strongly supported by the Senate Finance Committee’s Chronic Care Working Group. Currently, 13 states have demonstration programs where teams of doctors, care givers and other health care professionals coordinate to provide primary care services in the comfort of patients’ own homes, reducing unnecessary emergency room visits and avoidable hospitalizations and readmissions, as well as the costs associated with them. According to the Centers for Medicare and Medicaid Services (CMS), the IAH payment model saved more than $25 million in its first performance year alone, an average of $3,070 per participating beneficiary.

Wyden Proposes Improvements To Medicare Benefit, Enrollment Process – To address several key challenges with the Medicare benefit today that impacts enrolling seniors and many times result in errors that can lead to a lifetime of higher premium costs, Senator Ron Wyden (D-OR) introduced the Medicare Affordability and Enrollment Act. “Medicare has long been an ironclad guarantee to seniors of health care security and peace of mind in their later years,” Wyden said. “Today, the promise of Medicare falls short for too many who find their health costs becoming more and more unaffordable. Protecting and strengthening the Medicare guarantee is a vital task as the program prepares to enroll the next generation of older Americans, and these policies will put many seniors on a firm foundation for years to come.” Key provisions of the bill would:

• Set a maximum out-of-pocket cap for medical services under traditional Medicare, which exists today for Medicare Advantage and most commercial insurance plans;

• Significantly expand the number of low-income beneficiaries eligible for financial assistance to cover premiums and out-of-pocket costs;

• Reduce cost-sharing for “near-poor” beneficiaries who are not eligible for any assistance today;

• Eliminate the arbitrary two-year waiting period for people with disabilities to enroll in Medicare; and

• Modernize the Medicare enrollment system to facilitate easier enrollment, begin coverage earlier and reduce arbitrary late-enrollment penalties that today are paid for a lifetime.

In response to recent interest in senior living by states attorney generals, Argentum engaged the firm of Patrick Lynch Group LLC to help educate states attorney generals about our issues, and get a sense of topics they are following that could impact our industry.

NH AG CREATES UNIT TO PROTECT NEW HAMPSHIRE SENIORS FROM SCAMSIn New Hampshire, the Attorney General’s Office has dedicated a new unit to fight elder abuse. Elder abuse is a crime, which in the past, has oftentimes gone unreported and unchecked by law enforcement — especially when it’s a family member doing the scamming.

Prosecutors from the New Hampshire Attorney General’s Office have been working to educate consumer on a new law that strengthens the elder abuse statute. The prosecutors have said that education and outreach is the most important way to stay vigilant against elder abuse.

OR ATTORNEY GENERAL ROSENBLUM APPOINTS OREGON’S FIRST ELDER ABUSE PROSECUTOROR Attorney General Ellen Rosenblum recently announced the appointment of Malheur County District Attorney Dan Norris as Oregon’s first statewide Elder Abuse Prosecutor. Mr. Norris has 28 years of experience prosecuting complex criminal cases in Oregon, including 16 years as the Malheur County District Attorney. In the new position, Mr. Norris will lead the Oregon Department of Justice’s elder abuse unit, which includes two full-time investigators, to tackle the epidemic of elder abuse in Oregon.

OFFICE OF ATTORNEY GENERAL REACHES $2 MILLION SETTLEMENT WITH RELIANT NURSING HOME CHAINPA Attorney General Bruce R. Beemer recently announced the Office of Attorney General has reached a settlement with a chain of nursing homes accused of misleading consumers by failing to provide basic services to elderly and vulnerable residents.

The settlement with Reliant Senior Care Holdings, Inc. and related companies requires a $2 million payment to the Office of Attorney General and a series of changes devised to make sure that staffing levels and care within facilities owned or operated by Reliant match the representations made in marketing materials, care plans and bills.

The settlement was the result of an investigation conducted by the Office of Attorney General's Health Care Section. The investigation revealed that Reliant allegedly violated the Commonwealth's Unfair Trade Practices and Consumer Protection Law when it misled consumers through advertising and marketing materials, resident assessments and care plans. Reliant promised to provide basic care to residents in its facilities, as alleged by the Commonwealth, but failed to do so by leaving its facilities understaffed.

This is important for Argentum members to note the use of state unfair and deceptive trade practice statutes relating to advertising and marketing materials.

New Research Could Explain Some Alzheimer’s Drug Trial Failures

Inadequate blood flow to the brain due to a mini-stroke is a hallmark of a disease called Vascular Cognitive Impairment and Dementia, or VCID, which is the second leading cause of dementia after Alzheimer’s disease.

Researchers estimate that up to 60 percent of individuals diagnosed with Alzheimer’s disease also have VCID. Dr. Donna Wilcock of the University of Kentucky’s Sanders-Brown Center on Aging recently published a report explaining that a certain immunotherapy targeted to someone with Alzheimer’s may be ineffective if that person also has VCID.

Analysis: Health Care System Must Better Address High Need, High Cost Individuals

High-need adults, who are defined as having three or more chronic diseases and limitation in ability to care for themselves, account for a high proportion of health care spending and most are age 75 and older, according to new data analysis from the Commonwealth Fund.

The findings, which come from an analysis of the 2009-2011 Medical Expenditure Panel Survey, shows that these adults had annual health care expenses that were nearly three times higher and out of pocket expenses that were more than one-third higher than adults with multiple chronic diseases.

Both companies exceeded previous records and each raised over $37,000 for Silver PAC. Both Silverado and Belmont will be presented with trophies at the Chief Executive Summit in Miami. Congratulations to both companies!

Silver PAC would also like to congratulate Benchmark Senior Living and LCS who each raised over $25,000 and Merrill Gardens who raised over $22,000. The dedicated support from these five companies has allowed Argentum members and staff to attend over 40 PAC events in 2016 that build relationships with critical lawmakers and help educate them on issues that senior living professionals face on a regular basis.
