Section150(1)oftheState Administrative Tribunal Act 2004(WA)requiresthePresidentoftheStateAdministrativeTribunal(theTribunal)toprovideanannualreportontheactivitiesoftheTribunalduringtheyearending30JuneandtosubmitthereporttotheAttorneyGeneralby30Septemberineachyear.Thisreportisprovidedinaccordancewiththatrequirementinrelationtothereportingyear2010-2011.

TheoperationsoftheTribunalinthereportingyearhavebeenmarkedbytwosignificantareasofchange.ThefirstareaofchangeisinthecompositionofthemembershipoftheTribunal.Thesecondareaofchangeisinrelationtotherestructureofstaffpositionsandresponsibilities,andthedevelopmentofworkplacecultureandtrainingforstaff.

ThechangesincompositionoftheTribunalhaveoccurredatboththejudicialandnon-judiciallevels.Atthejudiciallevel,2010-2011sawtheappointmentoftwonewDeputyPresidentstoreplaceJudgeJaninePritchardfollowingherappointmentasaJusticeoftheSupremeCourt,andJudgeJudithEckertfollowingherretirement.

Asreportedinmylastannualreport,JusticePritchardwasappointedtotheSupremeCourton13June2010,andthereforeleftherpositionasaDistrictCourtJudgeandDeputyPresidentoftheTribunalonthatdate.JudgeTimothySharp,whowaspreviouslyStateSolicitorforWesternAustralia,wasappointedtotheDistrictCourt,andasDeputyPresidentoftheTribunal,on2August2010.

Regrettably,healthproblemswhichJudgeJudyEckerthadenduredforsomeyearsledtoherbecomingunabletocontinuewithherworkasDeputyPresidentoftheTribunalfromearlyOctober2010.Itwashopedthatalongperiodofconvalescencewouldenablehertoreturntowork,butthathopewasnotrealised.Shethereforetenderedherresignationonthegroundofherillhealth,andherretirementwasacceptedbyExecutiveCouncilon3May2011.

On14June2011,JudgeDavidParrywasappointedasaDeputyPresidentoftheTribunalandaJudgeoftheDistrictCourt.JudgeParryhadpreviouslyheldthepositionofSeniorMemberoftheTribunalintheDevelopmentandResourcesStreamsincetheTribunalwasformedinJanuary2005.

IwishtorecordthesignificantcontributionwhichJudgeJudyEckertprovidedtotheformationandoperationoftheTribunal.PriortoherappointmentasDeputyPresident,JudyEckerthad,whileabarristerinprivatepractice,actedasinstructingofficertotheParliamentaryCounsel’sOfficeforthedraftingandpassageoftheverysubstantialbodyoflegislationwhichwasnecessarytoestablishtheTribunal,anditsmanyjurisdictions.ShethereforecametothepositionofDeputyPresidentoftheTribunalwithavastknowledgeoftheenablingActsconferringjurisdictionontheTribunal,andoftheState Administrative Tribunal Act 2004(WA).HerHonourprovidedagreatresourceofknowledgetotheinauguralPresidentoftheTribunal,JusticeBarker,andtotheothermembersoftheTribunalgenerally.

Uponappointment,JudgeEckertassumedresponsibilityfortheoversightoftheHumanRightsStreamwithintheTribunalwhichwasthen,andcontinuestobe,theareaoftheTribunal’s

operationwhichseesthelargestnumberoflodgementseachyear.Sheplayedasignificantroleinestablishingtheprocedureswhichhaveseenthatstreamacquititssubstantialworkloadefficientlyandeffectively.ShecontinuedtodemonstrateahighlevelofcommitmenttotheTribunalanditsoperationsoverthesixyearsofherservice,notwithstandinganumberofperiodswhenherhealthpreventedherworking.IwouldalsowishtoaddmypersonalthankstoJudgeEckertforherfriendshipandsupporttomebothduringmytimeasPresidentandbeforethatasDeputyPresident.

TheconsequenceofthesixweekgapbetweenJudgePritchard’sdepartureandJudgeSharp’scommencement,andofJudgeEckert’sabsenceonsickleave,meantthatforovernineofthetwelvemonthsinthereportingperiod,theTribunaloperatedwithonlyoneoftheusualtwoDeputyPresidents.TheworkloadforthejudicialmembersoftheTribunalissubstantial,withanumberofenablingActsrequiringthatajudicialmemberhearorpresideoverparticularareasoftheTribunal’sjurisdiction.TheappointmentofJudgeParryinJune2011willenhancethecapacityofthejudicialmembershiptodealwiththatworkloadinatimelyway.

Asreportedlastyear,MsJenniferHawkins,aFullTimeOrdinaryMemberoftheTribunal,wasappointedasaMagistrate,andaccordinglyresignedherpositionasamemberoftheTribunalwitheffectfrom23July2010.SheinfactceasedworkingattheTribunalinJune2010,takingaperiodofleavefromtheTribunalbeforecommencinghernewdutiesasaMagistrate.Herreplacement,MsLisaWard,waseventuallyappointedon2November2010.ThedelayinthatappointmentresultedinadditionalpressureforotherfulltimemembersoftheCommercialandCivilStreamwhowererequiredtocoverfortheabsenceofonemember.

Theotherareaofsignificantchangeinrelationtothenon-judicialmembershipoftheTribunalwastheappointmentofthreenewmembersinordertoenabletheTribunaltodealwiththeadditionalworkloadasaresultoftheconferralofthejurisdictionpreviouslyexercisedbythe

BuildingDisputesTribunal.AlthoughitwasoriginallyexpectedthatanewjurisdictionwouldbeconferredinMay2011,thelegislationdidnotprogressasquicklyasexpectedandthejurisdictionwillcommenceon29August2011.

Thenewjurisdictionrequiredtheappointmentofaseniormember,twoordinarymembers,andanumberofsessionalmembers.ThepositionofSeniorMemberwasfilledbyMrMauriceSpillane,whohadpreviouslybeenaFullTimeOrdinaryMemberoftheTribunalsince2005.Thatappointmentcreatedavacancyforanadditionalordinarymember,sothatitwasnecessarytoappointthreenewfulltimeordinarymembers.MrDavidAitken,MsCharlotteWallaceandMsRebeccaMoorewereappointedtothosepositions.Thoseappointmentstookthenumberoffulltimenon-judicialmembersto17.Fourteennewsessionalmemberswereappointedatthesametime.Twelveofthosewerepersonswithrelevantexperienceinrelationtobuildingwork,andtheremainingtwoweremedicalpractitionerswhowereappointedtomeetaparticularneedfortheTribunalforadditionalsessionalmemberswithqualificationsinthatarea.

TheappointmentofJudgeParryleftavacancyinthepositionofSeniorMemberintheDevelopmentandResourcesStream.Itishopedthatthepositionwillbefilledreasonablyquickly,butthepositionremainedunfilledattheendofthepresentreportingperiod.

Thevacanciesinfulltimememberpositions,whileinevitablefromtimetotime,createasignificantburdenonothermemberstocontinuetomaintaintheperformancestandardswhichtheTribunalsetsforitself.Delaysintheappointmentofmemberstofillvacantpositionsincreasesthatburden.Themembershaveshoulderedthatburdenwell,andhavecontinuedtodemonstrateastrongcommitmenttomaintainingtherelativelyhighstandardsofperformanceforwhichtheTribunalisgenerallyrenowned.

IwasgratefulforthesupportofGovernmentandoftheChiefJusticeofWesternAustraliainhavingfourSupplementaryPresidentsappointedfromamongsttheJudgesoftheSupremeCourt.TheirappointmentswerefinalisedinMarch2011.AlthoughexistinglistingcommitmentsinboththeCourtandtheTribunalpreventedtheSupplementaryPresidentsfrombeingutilisedwithinthereportingyear,arrangementsareinplacetoutiliseSupplementaryPresidentsfromtimetotimetoassistingindealingwiththeincreasingworkloadoftheTribunal.TheavailabilityofSupplementaryPresidentsfromtimetotimewillalsoassistinenablingmetositfromtimetotimeintheSupremeCourt.

efficiencyoftheTribunal’sadministrativefunctionshavebeenachievedasaresultoftherestructure.

TherestructurehasalsoprovidedanopportunitytoworkonandimprovethecultureoftheTribunalworkplaceandjobsatisfactionamongstadministrativestaff.Iwouldliketoacknowledgethecontributiontoboththerestructureprocess,andtotheculturaldevelopmentprocess,madebyMsFionaNobel,whowasengagedona12monthcontractasaChangeManager.Hercontractwassubsequentlyextendedbythreemonths.Inthattime,MsNobelputinplaceprocesseswhichwillhaveongoingbenefitsinimprovingworkplacesatisfaction,andthereforeefficiencywithintheTribunal.Throughoutthereportingyear,MsNobelworkedinclosecollaborationwiththeseniormanagersintheTribunal,andundertheguidanceandsupervisionoftheExecutiveOfficer,MarkStreet.Staffsatisfactionsurveys,whichweretakeninmid2010,andagaininmid2011,demonstratedasignificantlyimprovedlevelofstaffsatisfactionwiththeirwork.TheseniormanagementoftheTribunalhasshownastrongcommitmenttoimprovingtheservicesofferedbytheadministrativestaff,andhaveledbyexample.

TheworkloadoftheTribunalcontinuedtorisein2010-2011.AcrosstheTribunal,6,327applicationswerereceivedcomparedto6,248in2009-2010.6,319applicationswerefinalised,comparedwith6,242in2009-2010.

NotallstreamsoftheTribunalreceivedanincreasednumberofapplications.AshasbeenaconstanttrendsincetheTribunalcommencedoperations,theHumanRightsStreamreceiveda6%increaseinapplications,receiving3,815applicationscomparedwith3,608inthepreviousreportingyear.TheCommercialandCivilStreamexperiencedareductioninthenumberofapplicationsreceived.TheVocationalRegulationStreamandtheDevelopmentandResourcesStreamlodgementsweresteadywhencomparedtothepreviousyear.Fulldetailsofthenumbersofapplicationsreceivedwithineachstreamarecontainedlaterinthisreport.

SubmissionsforadditionalresourcestodealwiththesignificantworkloadintheHumanRightsStream,andinparticularintheguardianandadministration

ThesecondmajorareaofchangeintheTribunalconcernsthefinalisationoftherestructureofadministrativestaffarrangements.Inmylastannualreport,Ireportedthattherestructureplans,whichinvolvemoreendtoendcasemanagementbystaff,werenearingcompletion.Inthecurrentreportingyear,thepositionscreatedintherestructurehavebeenfilled.Improvementstothe

area,wereagainunsuccessful.Iexpressedconcernastotheneedforadditionalresourcesinmyannualreportfor2009-2010.AlthoughtheTribunalmanaged,withdifficulty,toachieveitsbenchmarkofresolving80%ofguardianshipandadministrationapplicationswithineightweeks(infact80%wereresolvedwithinsixweeks)thatlevelofperformancewillnotbemaintainedwithoutadditionalresources.Inordertorelievetheexcessiveburdenonadministrativestaff,attemptswillbemadeduringthenextreportingperiodtoreallocateexistingpersonnelwithintheTribunalsothatmoreresourcesareallocatedtoworkintheguardianshipandadministrationarea.GiventhatallareasoftheTribunal’soperationsareatfullcapacity,reallocationofresourceswillinevitablyleadtodifficultiesintheareasfromwhichstaffaretaken.ThereisnoreasontobelievethattheincreaseinworkintheguardianshipandadministrationareawillnotcontinueattheratethathasbeenexperiencedinthesixyearsoftheTribunal’soperationtodate.

Duringthereportingyear,theTribunalintroducedforthefirsttimeane-lodgementfacility.Asaninitialtrial,e-lodgementbecameavailableinrespecttoapplicationsunderSection13(7)ofthe

Commercial Tenancy (Retail Shops) Agreements Act 1985(WA)whichseekapprovalforearlyterminationclausesinretailshopleases.TheTribunalwillmonitortheup-takeandsuccessofthefacilityfore-lodgementwithaviewtoitsexpansiontootherareasoftheTribunal’sjurisdictionovertime.

Duringthereportingyear,theTribunalhascontinuedtoforgecloserlinkswithsimilarTribunalsinotherstates.Inparticular,ahighlevelofcooperationtheVictorianCivilandAdministrativeTribunalandtheQueenslandCivilandAdministrativeTribunalinareasofcommoninteresthasbeenpursued.TherehasbeenconsiderableinterchangebetweenthoseTribunalsinrelationtomembers’professionaldevelopmentandapproachestodisputeresolutioninareasofcommonjurisdiction.

OngoingprofessionaldevelopmentformembersremainsanimportantpriorityoftheTribunal.TheTribunal’sProfessionalDevelopmentCommitteehasworked,duringthereportingyear,towardsamorecoordinatedprocessofinductionandongoingtrainingformembers,aprocesswhichhasbeeninformedby,andisadjunctto,thememberappraisalschemewhichcommencedoperationin2009.

Inconclusion,IwouldlikeagaintoacknowledgetheexcellentworkundertakenbythemembersandstaffoftheTribunalduringthereportingyear.IamparticularlygratefulfortheexcellentworkundertakenbytheTribunal’sExecutiveOfficer,MarkStreet,whocommencedinthatpositionearlyinthereportingperiod.InthetimethathehasbeenwiththeTribunal,hehasdemonstratedahighlevelofleadership,andasmentionedearlier,hehasoverseentheintroductionofmanybeneficialchangeswithintheadministrativestructureandprocessesoftheTribunal.

Iwouldalsoliketoexpressmygratitudeforthesupportofthemembers,andinparticular,JudgeSharpwhoshoulderedasignificantworkloadduringtheperiodofJudgeEckert’sunavailability.

ABOUT THE TRIBUNAL

TheTribunalisestablishedundertheState Administrative Tribunal Act 2004(SATAct)andcommencedoperationson1January2005.

TheTribunalconsistsofjudicialandnon-judicialmemberswithawiderangeofskillsandqualifications.ThePresidentoftheTribunalisaSupremeCourtjudgeandjudgesoftheDistrictCourtserveasDeputyPresidents.Non-judicialmembersaregenerallyalignedtoparticularstreamsoftheTribunaldependingupontheirspecialistareasofexpertise.ThisenablestheTribunaltodealwithabroadrangeofmattersconferreduponitby151enablingActsandRegulations.MembersareappointedtotheTribunalbytheGovernorontherecommendationoftheAttorneyGeneralforaperiodofuptofiveyears.

Individuals,businesses,publicofficialsandvocationalregulatorybodiescanbringbeforetheTribunalmanydifferenttypesofmattersthataremanagedwithinfourstreams.

• CommercialandCivil;• DevelopmentandResources;• HumanRights;and• VocationalRegulation.

ThisdivisionofmattersenablesprocedurestobeadaptedtosuitthetypeofmatterandtheneedsofdifferentpeoplewhousetheTribunal.

Vision, objectives and values

TheTribunal’svisionistobeoneofAustralasia’sleadingtribunalsthatadoptsbestpracticeandinnovativetechnologyinmakingfairandtimelydecisionsforthebenefitofthepeopleoftheStateofWesternAustralia.

TheobjectivesoftheTribunalsetoutinSection9oftheSATActare:

• Toachievetheresolutionofquestions,complaintsordisputes,andmakeorreviewdecisions,fairlyandaccordingtothesubstantialmeritsofthecase;

• Toactasspeedilyandwithaslittleformalityandtechnicalityasispracticable,andminimisethecoststoparties;and

• TomakeappropriateuseoftheknowledgeandexperienceofTribunalmembers.

Inmeetingtheseobjectives,theTribunal:

• aimstomakethecorrectandpreferabledecisionbasedonthemeritsofeachapplication;

• isnotacourtandstrictrulesofevidencedonotapply;

• encouragestheresolutionofdisputesthroughmediation;

• allowspartiestoberepresentedbyalawyerorapersonwithrelevantexperience,orbythemselves;

• holdshearingsinpublicinmostcases;and

WorkloadDuringthereportingyear,theCCStreamreceived1811applicationsandinthesameperiodfinalised1831applications.Thevolumeofapplicationsreceivedandfinaliseddeclinedslightlycomparedtothepreviousyearinwhich1933applicationswerereceivedand1932werefinalised.ThiswaspartlyduetotherepealoftheConsumer Credit (Western Australia) Act 1996witheffectfrom1July2010,althoughanumberofcomplexmatterscommencedpriortothatdatehadtobefinalisedwhichactuallyincreasedtheworkloadonmembers.Thedeclineinapplicationsreceivedisthoughtalsotobepartlyduetothenumberofpublisheddecisionswhichhaveprovidedguidance.

Overthepastnumberofyears,aconcertedeffortwasmadetoreducetimeforcompletionofBuildingDisputesTribunalreviews,whichpeakedforcompletionof80%ofmattersat45weeksduringthe2007-2008year.Thatperiodwasreducedto35weeksin2008-2009,29weeksin2009-2010andmaintainedat29weeksforthisreportingyear.

Whilethisimprovementispleasing,benchmarkperformancehasdeclinedinrelationtoLocalGovernmentandCreditCodematters.Thelatterisduetotheabnormalnumberofcomplexmattersdealtwithintheyearunderreview.RelativelyfewLocalGovernmentmattershavetoberesolvedbyformalhearing.Thefacilitativeprocessesfollowedinthisareaarebeneficialtothepartiesbutareoftendelayedthroughrelianceonexpertstoassistthepartiesandtheneedforongoingconsultationbetweentheparties.Effortswillbemadetoholdthepartiestotightertimelines.

Duringthereportingyear,57%ofthetotalnumbersofdisputedapplicationswereresolvedbyfacilitativemeasures.Thisresultwasachievedthroughtheuseofdirectionshearingsandmediation.Inrelationtomediation,78%ofthemattersreferredwereresolvedthroughthatprocess,whichisslightlylowerthanthe82%resultachievedinthepreviousyear.

Asreportedinlastyear’sannualreportthequestionofresourcesintheCCStreamwaskeptunderreviewduetotheplannedadditiontotheTribunaloftheBuildingDisputesTribunaloriginaljurisdiction.Uptonow,thisTribunalonlydealtwithreviewsofdecisionsoftheBuildingDisputesTribunal.

AlthoughMay2011wasoriginallynominatedasthedateforthetransfer,delaysinhavingthenecessarylegislationpassedandotherpractical

considerationsresultedinthatdatebeingpushedoutonanumberofoccasions.

AtthedateofpreparingthisreporttheplannedcommencementdateoftheBuilding Services (Complaint Resolution and Administration) Act 2011whichwilleffectthistransferofjurisdictioniscurrently29August2011.

Inanticipationofandplanningfortheconferralofthatjurisdiction,anewfulltimeseniormemberandtwonewfulltimeordinarymembers,togetherwithanumberofsessionalmemberswereappointedtotheTribunalinlateJune2011,alongwithadditionaladministrativestaff.Unfortunately,thedelayintransferofthejurisdictionhasresultedinthelossoffundingprovidedforexpenditureonincreasedsessionalmemberusageinthisreportingyear.Theimpactofthatwilldependonthenumberofmatterstransferredonthecommencementdateofthelegislationandthestateofreadinessofthosemattersforfinalhearing.

ItiscurrentlyanticipatedthatonthecommencementdaytheTribunalwilltakeoverapproximately200uncompletedmattersfromtheBuildingDisputesTribunalsoconsiderableeffortwillberequiredfrommembersduringtheinitialtransitionalperiod.Inadditionitisestimatedthatapproximately40newmatterswillbereferredtotheTribunaleachmonth,althoughitmaytakesomemonthsbeforethosereferralscommence,astheBuildingCommissionerwillmakeeveryefforttoresolvemattersbeforereferringthemtotheTribunal.

Toensuremattersaredealtwithasspeedilyaspossible,theTribunalplanstoruntwodirectionslistseachdaywithimmediateeffectandtomoveassoonaspossibletothreetribunalssittingeachdaytodealwiththeinitialvolumeofcases.

AmendmentsarealsocurrentlyproposedtotheCommercial Tenancy (Retail Shops) Agreements Act 1985whichmayincreasethenumberofmatterscomingtotheTribunal.Thiswillbekeptunderreviewduringthecomingyear.

ofdirectionshearings,mediations,compulsoryconferencesandinvitationsunderSection31oftheState Administrative Tribunal Act 2004toanoriginaldecision-makertoreconsideritsdecision,ofteninlightoffurtherinformationoramendmentstoaplanningproposaldevelopedthroughmediation.Bytheseprocesses,Tribunalmembersassistthepartiestocreatetheirownsolutiontoadispute,ratherthanhaveawin/lossdecisionimposedonthem,andenablethepartiestoavoidthetimeandexpenseofhavingtoparticipateinafinalhearingordeterminationondocuments.During2010-2011,only20%ofDRapplicationsrequiredadjudicationbytheTribunal.(6%ofDRapplicationswereresolvedbetweenthepartieswithoutfacilitationoradjudicationbytheTribunal).AnotherbenefitofFDRduringthereportingyearwasthatin17%ofcasesthatwereadjudicatedbytheTribunal,butinwhichFDRprocesseshadbeenapplied,theFDRprocessesreducedthescopeofthedisputerequiringadjudication,therebyminimisingthelengthofhearingsandreducingcoststoparties.

TheprincipletaskoftheHumanRights(HR)StreamistodetermineapplicationsbroughtundertheprovisionsoftheGuardianship and Administration Act 1990(GAAct).Primarilytheseapplicationsseektheappointmentofsubstitutedecisionmakerstomakedecisionsabouthealth,lifestyleandestatemattersonbehalfofpeoplewhonolongerhavethecapacitytomaketheirowndecisions.TheGAActprovidesameansbywhichprotectivemeasuresmaybeputinplacetoensurethatthefinancialandgeneralwelfareofvulnerableadultsisnotjeopardisedbyimprovidentpersonaldecisions,orbyill-advisedorunscrupulousdecisionsofotherpeople.

ApplicationsundertheHRStreamaccountfor60%ofallapplicationsmadetotheTribunalacrossallstreams.GAActmattersaccountfor99%oftheworkundertakenintheHRStream.

InadditiontheHRStreamhearsanddeterminesmattersreferredtoitbytheEqualOpportunityCommissioner,concerningdiscriminationasitarisesundertheEqual Opportunity Act 1984(EOAct).ItalsoexercisesareviewjurisdictionundertheMental Health Act 1996(MHAct)concerningdecisionsmadebyMentalHealthReviewBoard,andundertheChildren and Community Services Act 2004(CCSAct)concerningdecisionsmadebytheChiefExecutiveOfficeroftheDepartmentforDepartmentforChildProtectionregardingthecareplanofachildinthedepartment’scare.

Trends in workloadThereislittledoubtthattheproblemsidentifiedinrecentresearchintothefinancialexploitationoftheelderlyandvulnerableareveryreal.ApplicationsundertheGAActraisingissuesoffinancialabusebyfamilymembersandcarersarecommon.AnumberofapplicationsweremadetotheTribunalbythePublicTrustee,seekingrevocationofordersappointingprivateadministratorswhohavefailedtodischargetheirobligations.

TheTribunalreceivedanumberofcomplexapplicationsraisingissuesrangingfromforcedandservilemarriagestoconsenttomedicaltreatment.

LastyearitwasreportedthatthechangesintroducedbytheLegal Professions Act 2008(WA)inMarch2009whichenableddissatisfiedcomplainantswhosecomplainthadbeendismissedbytheLegalProfessionComplaintsCommitteetoseekareviewintheTribunalhadcontinuedtohaveanimpactontheworkloadandtimelinessofdecision-makingintheVRStream.Duringthe

reportingperiodtheTribunalhadcontinuedtoexaminethemostefficientandcosteffectivewayofdealingwiththosematters.Apracticehasdevelopedofdealingwiththosemattersonthedocumentsafterthepartieshavebeengivenanopportunitytomakewrittensubmissions.Giventhevolumeofdocumentswhichisoftenassociatedwiththesematters,considerationisbeinggiventowhetherthemattersmightbedealtwithbyashorthearing.TheTribunalwillcontinuetomonitorthemostefficientwayofdealingwiththeseapplications.

Section150(5)oftheSATActauthorisesthePresidenttoreporttotheMinisteraboutanymatterconnectedwiththeexerciseoftheTribunal’sjurisdiction.Inpreviousannualreports,thePresidenthasnotedpossiblelegislativereformsconnectedwiththeTribunal’sjurisdictionwhichmightbeconsidered.

Duringthereportingyear,noadditionalrequirementsforreformhavebeenbroughttothenoticeofthePresident.TheTribunalmaintainsthefollowingsuggestionsforlawreformreferredtoinpreviousannualreports:

• ConsiderationbegiventothepotentialfortheissueofAssessmentNoticessubjecttoconditions,orlimitedtoparticularoccupationsoremploymentundertheWorking with Children (Criminal Record Checking) Act 2004(WA)(see 2009 - 2010 Annual Report at p 21).

• AreviewofthemandatorydisqualificationforsecurityagentsinrelationtospecifiedoffencesundertheSecurity and Related Activities (Control) Act 1996(WA)(see 2009 - 2010 Annual Report at p 22).

• AmendmenttotheMental Health Act 1996(WA).ItwaspreviouslyindicatedthatthefunctionsoftheMentalHealthReviewBoardwerepoisedtobeconferredontheTribunal(see 2007 - 2008 Annual Report at p 6).Itisunderstoodthatthegovernmentintendsintroducingreformsinthisareainthenextreportingperiod.

• AmendmenttoSection216ofthePlanning and Development Act 2005(WA)(P&DAct)toconfer(concurrent)jurisdictionontheTribunalconstitutedbyorincludingajudicialmembertograntaninjunctiontorestrainacontraventionoftheP&DAct,aninterimdevelopmentorder,aplanningschemeoraconditionofapproval(see 2007 - 2008 Annual Report at p 51);

• AmendmenttoSection69oftheHeritage of Western Australia Act 1990(WA)toconfer(concurrent)jurisdictionontheTribunalconstitutedbyorincludingajudicialmembertograntaninjunctiontorestrainabreachofaconservationorder(see 2007 - 2008 Annual Report at pp 51-52);

• AmendmenttoSection41oftheEnvironmental Protection Act 1986(WA)toenabletheTribunaltodetermineproceedingsinvolvingareferredproposal(see 2007 - 2008 Annual Report at p 52);

• ReviewoftheGAAct.ThecurrentGAActhasbeeninplacesince1990anddoesnotadequatelymeetthedemandsofachangingdemographicandcurrentapproachestohealthandlifestyleevidentinlegislationinsomeotherjurisdictions.TheStandingCommitteeInquiryintotheTribunalproposedbothanamendmenttotheGAActandtherefocusingoftheGAActWorkingParty.ItissuggestedthatthisprovidesanopportunitytocarryoutareviewoftheActinitsentirety(see 2007 - 2008 Annual Report at p 69);and

• ReviewoftheEqual Opportunity Act 1984(WA),particularlytherightofpeopletorequiretheCommissionerforEqualOpportunitytoreferclaimsthatshehasdismissedtotheTribunalunderSection90oftheEOAct(see 2007 - 2008 Annual Report at p 69).

LEGACY MATTERS

WhentheTribunalcommenced,mattersthathadnotbeendeterminedbyprioradjudicatorsweretransferredtotheTribunal.Therewere897suchlegacymattersinthefirstinstance.Asat30June2007,onlyfourlegacymattersremainedtobedetermined.Asat30June2009,therewasonlyonelegacymatteroutstanding.Thematterwasstillnotfinalisedasat30June2010,butwasconcludedinthecurrentreportingyear.TherearenownolegacymatterswiththeTribunal.

ARRANGEMENTS WITH OTHER AGENCIES

FormalarrangementsareinplacewiththeChiefMagistrateenablingamagistratetositasamemberoftheTribunal.ThisarrangementwasinitiatedbytheformerPresidentandagreedtobytheChiefMagistrateinthe2005-2006reportingyear.

IthasnotbeennecessarytoutilisethesearrangementsforanumberofyearsbecausetheTribunalhasbeenabletoadequatelyserviceregionalareaseitherbytelephoneandvideolinksorbymemberstravellingtoregionswhereappropriate.GiventhedifferentproceduresoftheTribunalfromthoseoftheMagistratesCourt,theTribunal’spreferenceistoutiliseitsmembersratherthanmagistrates.

ArrangementshavealsobeensettledwithspecificagenciestobetterserveapplicantsandrespondentstotheTribunal.Agreementshavebeenmadewiththefollowingagencies:

• StateSolicitor’sOffice;• EqualOpportunityCommission;• Landgate;• PublicAdvocate;• PublicTrustee;• OfficeofStateRevenue;and• WesternAustralianPlanningCommission

ADDITIONAL INFORMATION

Arrangements with the Parliamentary Commissioner under Section 168

ThePresidentandtheParliamentaryCommissioner(Ombudsman)maintainanearlieragreementwithregardtomattersofpubliceducation,trainingofTribunalmembersontheroleoftheOmbudsman,regularmeetings,betweenthePresidentandtheOmbudsmanandreferralofcasesfromtheTribunaltotheOmbudsman.

LEVELS OF COMPLIANCE BY DECISION MAkERS

Section150(2)(d)oftheSATActrequiresthisannualreporttoincludedetailsofthelevelofcompliancebydecision-makerswiththerequirementsunderSection20andSection21to:

(i) Notifypersonsofreviewabledecisionsandtherighttoseekreview;and

(ii)Providewrittenreasonsforreviewabledecisionswhenrequestedtodoso.

Thesetworequirementsaredesignedtoensurepersonsaffectedbyadversedecisionsknowwhythedecisionwasmadeandthattheyhavetherighttoseekreviewinrelevantcases.

TheTribunalissatisfied,onthebasisofreviewproceedingscomingbeforeit,thatdecision-makersaremeetingtheirobligations.

ADMINISTRATIVE SUMMARY

Organisational change

The2010-2011yearwasayearofchangeandculturaldevelopmentforthestaffoftheTribunal.AkeyfocuswastheimplementationofStage2oftheOrganisationalChangeProjectthatcommencedthepreviousyearthroughthefinalisationoftheorganisationalrestructurethatrepresentedStage1oftheproject.TheintendedoutcomesforStage2weretocommenceaprocessofculturalchangeaimedatimprovingservicedeliveryacrosstheTribunal.ThewillingnessoftheTribunal’sstafftoactivelyparticipateinthechangeprocessundertheleadershipoftheExecutiveOfficerandManagementTeamwasverypleasing.

AkeyoutcomeofthechangeprocesswastheidentificationofthedesiredworkplaceculturefortheTribunalandassociatedbehavioursthatstaffcanreasonablyexpectofeachother.Thiscultureischaracterisedbythefiveguidingprincipalsof:

• OneSATteam• Customerfocussed• Resultsfocussed• Learningandinnovative• Greatplacetowork

RealisingandmaintainingthisculturewillrequireongoingleadershipbytheManagementTeam,howeverasurveyofstaffconductedduringMay2011demonstratedadramaticimprovementintheirlevelofsatisfactioninworkingattheTribunalincomparisontothesamesurveyconductedduringMay2010.

AsecondkeyoutcomeoftheOrganisationalChangeProjectwastheimplementationofanend-to-endcasemanagementmodelwithrespecttothesupportservicesprovidedtotheTribunalmembers.Thiswasasignificantachievementthatresultedinamoreseamless,improvedcustomerservicedeliverytopartiesandtotheTribunalmembers.Italsoprovidesgreaterjobsatisfactionforcasemanagementstaffbyincreasingthediversityoftheirtasksandtheskillstheyneedtoperformthem.

Building Disputes Conferral

ConsiderableeffortwascommittedtopreparingfortheconferralofadditionalbuildingdisputematterstotheTribunal,anticipatedinAugust2011.Threeadditionalfulltimememberswereappointed,12additionalstaffpositionswerecreatedandadditionalaccommodationwassecuredandfittedoutwithhearingandmediationrooms.ThisisthelargestconferralofnewjurisdictiontotheTribunalsinceitsinceptionandrequiredahighdegreeofcooperationbetweentheTribunal,theBuildingDisputesTribunal,theDepartmentoftheAttorneyGeneralandtheDepartmentofCommerce.

Human resources

TheTribunal’smembernumberseffectivelyremainedunchangedfortheyearatthreejudicialmembers,14fulltimemembersandtheequivalentof5.5fulltimesessionalmembers.Threeadditionalfulltimememberswereappointedon28June2011inpreparationforthebuildingdisputesconferral.

Theeffectiveadministrativestafffulltimeequivalentbudgetremainedat71.IndividualPerformancePlansweredevelopedforallstaffasanintegralpartoftheOrganisationalChangeProjectreferredtoearlier.

AlistairBorgretiredfromthepositionofExecutiveOfficerinSeptember.AlistairhadservedtheTribunalinthispositionsince2008andplayedakeyroleintheplanningoftheOrganisationalChangeProject.MarkStreetwasappointedtothepositionofExecutiveOfficeruponAlistair’sretirement.

Budget performance

TheTribunal’sexpenditureof$15,972,991waswithinitsbudgetallocationof$16,275,373.
