I hope many of you are enjoying the “lazy days” of summer. Iknow some of your colleagues are spending their summerhours planning a strong start to the Fall FCBA schedule.Immediately after Labor Day, we will be hosting our firstFCBA-wide event this year — the September 7 reception toformally welcome both FCC Commissioners Deborah TaylorTate and Robert M. McDowell. I would like to recognize andthank the Executive Committee organizers — Anna Gomez,Laura Phillips, Ryan Wallach, and Kathy Zachem — for theirplanning and sponsorship efforts.

Our committee co-chairs are also already actively planning this year’s activities. Itbegan with our co-chair kick-off event in July, and continues as they pull togetherseveral exciting fall events. In recognition of the important substantivecontributions that our colleagues make during the year, the FCBA Newsletter willspotlight individual committees, chapters, and co-chairs.

Our FCBA Newsletter is an important tool to share with you the upcoming FCBAactivities, as well as the successes of the past month. It also offers us an opportunityto provide information about our fellow Members, so we will be introducing twonew elements. First, in this month’s newsletter, we are establishing a WelcomeColumn to recognize new FCBA members. Second, we will be initiating a BookNotes corner to feature our FCBA authors – we will highlight new books publishedin the field of communications and authored by FCBA Members. The frequency ofthis new element will depend, of course, on the prolific nature of our Members. Iencourage you to share your publication information with the FCBA office!

own interesting career path andcurrent job as an analyst shouldprovide insight into current and futuretrends in communications. Rebeccajoined what was then Legg Mason inSeptember 2001 from the FCC, whereshe was Chief of TelecommunicationsDivision of the International Bureau.Before joining the Commission in1997, Rebecca served in the Office ofLegal Counsel of the U.S. Departmentof Justice. She began her legal practiceas a corporate lawyer with theWashington D.C. law firm of Wilmer,Cutler, and Pickering. Ms. Arbogastreceived a law degree from Yale LawSchool and clerked for the NinthCircuit Court of Appeals. She was the1993 Fulbright Fellow in EuropeanCommunity Law, studying andteaching in London.

The wireless spectrum isa vital natural resource. Like sunlight, itcannot be depleted and is available allaround us. The challenge forgovernment policy is to define andenforce rules to govern its use.Historically, those rules have tightlyprescribed who, how, and for whatpurpose the wireless spectrum could beused. As such, traditional command-and-control rules limited opportunitiesfor technological change, playedfavorites among technologies, andimpeded marketplace activity.

As the command and control modelapproaches its 80th anniversary (datingback to its codification in the Radio Actof 1927), there is a widespreadconsensus that it needs to be replaced.The two candidates that will, likely inconjunction with one another, providefor greater dynamism and more efficientuse of this resource are knowncolloquially as the “commons model”and the “property rights model.” In fitsand starts, the Federal CommunicationsCommission continues to implementeach model.

Over the next several years,telecommunications policy faces anextraordinary opportunity to set a newcourse that would be a paradigm shiftfrom the existing framework’scommitment to a command-and-controlapproach. In charting a new course,regulators must appreciate the changingtechnologies that can operate effectivelyusing commons access spectrum andpropertized spectrum. Moreover,regulators must consider carefully whattype of rules will govern spectrumeffectively. In a variety of contexts-etiquette standards for how commonsspectrum is used; database requirementsfor those using spectrum; or property-like rights and remedies (i.e., injunctionsfor trespass)-it is clear that spectrum isnot just like real property and a newframework must be developed. Indeveloping that framework,policymakers need to look not onlyaround the world, but also to other legalregimes, such as water law. In thisconference, we will set out the cuttingedge perspectives on spectrum policyreform as well as examine what lessonswater law can offer about restricting how

CommunicationsLaw, Copyright &Digital RightsManagementCommitteeOnce upon a time, lawyers working inthe field of media andtelecommunications fell into one oftwo camps: you were either a memberof the “communications bar” or youwere a member of the “copyright bar.”But like so many other things, the wallof separation between these two areasof law has crumbled under theonslaught of the digital revolution.Today, a media andtelecommunications lawyer needs tohave a basic understanding, if notoutright expertise, in bothcommunications law and copyrightlaw. With that fact in mind, a new adhoc committee has been born: theCommunications Law, Copyright &Digital Rights ManagementCommittee, co-chaired by Ann Bobeckof NAB, Seth Davidson of Fleischmanand Walsh LLP, and Ben Golant of theCopyright Office.

The Committee is anticipating abanner inaugural year. Our plansinclude brown bag lunches and CLE’s

on a variety of topics, including someof the high profile copyright battlesbeing waged in Congress, the courts,and before the FCC and CopyrightOffice. These include the applicationof fair use to network DVRs andsatellite radio receiver/recorders, thebroadcast and audio flags, the satelliteand cable compulsory licenses, andWIPO and other internationalcopyright issues. We also plan toinvite speakers representing theCopyright Office, congressional staff,and content owners and users toparticipate in events sponsored by theCommittee (either individually orjointly with other committees).

The Committee’s events will be held onthe third Thursday of each month. Weencourage all FCBA members, whethercopyright is part of their currentpractice or not, to sign up for theCommittee and to join us for our firstmeeting (an organization brown bag)on Thursday, September 21. We areinterested in suggestions for programideas and welcome volunteers to helpwith the planning of committee events. HLS/EmergencyCommunications AdHoc CommitteeThis year the FCBA has formed a newAd Hoc Committee on HomelandSecurity and EmergencyCommunications (the HLS/ESCommittee), chaired by David Wye,Robert Gurss, Gregory Cooke andJennifer Manner. The HLS/ESCommittee promises a most excitingyear educating FCBA members aboutissues of importance surroundinghomeland security and emergencycommunications, including E911,interoperability, emergency alertsystems, funding and other criticalissues. Among the events that theHLS/ES Committee is planning this yearis a meet the Bureau lunch subsequentto the formation of the FCC’s newPublic Safety and Homeland SecurityBureau and a panel discussion on theEmergency Alert System, among others.To start off the year, we plan to hold aCommittee brown bag lunch onWednesday, September 27 to hear frommembers what other issues they wouldlike us to focus on. 2005-2006 FCBAFoundation AnnualReportThe Federal Communications BarAssociation Foundation, celebrating the15th Anniversary of its founding, had arecord year providing charitable supportfor education and children’s issues infurtherance of the goals set out in itsMission Statement to:

n Support worthwhilecommunications-related andeducational projects, as well as othercommunity service projects,particularly those directed towardschildren and students, throughfinancial contributions and throughvolunteer services provided byFoundation members and others.

n Foster greater public awareness andunderstanding of the development ofcommunications technology,resources and law.

The Foundation’s accomplishments thisyear included awarding $192,000 in col-lege scholarships, plus laptop comput-ers, to 18 students from four inner cityDistrict of Columbia high schools; pro-viding $16,600 in stipends to four lawstudents working in summer intern-ships at the Federal CommunicationsCommission; donating more than$75,000 to Kids Enjoy Exercise Nowof Greater DC (KEEN) raised duringthe annual Charity Auction co-spon-sored with the FCBA’s Young Lawyer’sCommittee, and numerous volunteeractivities. These activities, and theFoundation’s overall success, are a directresult of the generous support of indi-vidual FCBA members, as well as theirfirms and companies. This AnnualReport summarizes the Foundation’sactivities during the recently completed2005-2006 year.

T R USTEES

The Foundation is governed by a Boardof Trustees, most of whom are electedby the FCBA membership, but which

also may include persons appointed inaccordance with the Foundation’s By-Laws. This year’s Trustee’s were PaulaBoyd, James R. Coltharp, Joseph M.Di Scipio, Jack N. Goodman, PraveenGoyal, Laura H. Carter, Dee A. May,Maureen A. O’Connell, Lee G. Petro,Loretta P. Polk, Mark Van Bergh,Cara Voth, and Amy R. Wolverton.The Foundation’s officers, as elected bythe Board of Trustees, were: Mark VanBergh, Chairman; Joseph DiScipio,Treasurer; Cara Voth, Secretary; andLee Petro, Assistant Treasurer.

Two non-Board members worked exten-sively with the Board as co-chairs of theVolunteer Services Committee, HowardWeiss and Megan Stull. The FCBA’sExecutive Director Stan Zenor,Administrative Director Heidi Kurtz,and its new Director of MembershipServices, Kerry Loughney (who suc-ceeded Heidi Kurtz), provided invalu-able support to the Foundation. FCBAPresident Michele C. Farquhar,President-Elect Jennifer A. Warren, andthe FCBA’s Executive Committee, alsoprovided important support for theFoundation’s activities, including a sig-nificant donation announced at thecommemoration of the FCBA’s 70thAnniversary.

S CHOLARSH IP PROGRAM

The Foundation’s scholarship program,the Chairman Robert E. LeeScholarship Fund, is its most signifi-cant undertaking, both in terms of thefunds awarded and in the amount oftime required to administer the pro-gram. The 18 scholarships, and the lap-tops awarded to the scholarship recipi-ents, have the Foundation committingmore than $200,000 to this year’s schol-arship program, a record amount andmore than a 33% increase over last year.The scholarship recipients and addition-al details about this year’s scholarshipprogram appeared in the June 2006issue of the FCBA News.

The scholarships are awarded based ona number of different criteria, includingthe student’s predicted ability to succeed

in college, past academic performance,participation in school activities, schoolattendance, service to the community,financial need, and other relevant fac-tors that may apply to each individualapplicant. The scholarship applicantsare reviewed on the basis of a writtenapplication (including biographicalinformation, academic performance andan essay) and a personal interview withmembers of the Foundation’s Board ofTrustees.

Laura Carter, Lee Petro, Loretta Polkand Cara Voth served as theFoundation’s Scholarship CommitteeCo-Chairs, overseeing the entire pro-gram. They were responsible for con-tacting and coordinating with the fiveDistrict of Columbia high schools fromwhich the Foundation solicited appli-cants, Bell Multicultural High School,Cardozo High School, Roosevelt HighSchool, Spingarn High School and, forthe first time, Anacostia High School.The Foundation received a record num-ber of written applications (27). TheScholarship Committee Co-Chairs par-ticipated in and coordinated the reviewof the written applications, which deter-mined the applicants who would beinterviewed. The Co-Chairs also partic-ipated in and coordinated the applicantinterviews, in which nine of theTrustees participated (a complete list ofthose participating in the written appli-cation reviews and interviews appearedin the June 2006 issue of the FCBANews). The Co-Chairs also attendedthe award ceremonies at three of thehigh schools to announce the scholar-ship recipients at those schools (Bell,Cardozo and Roosevelt; the Spingarnawards ceremony was held before thedetermination of the scholarship recipi-ents).

The Foundation also continued its men-toring program for the scholarshiprecipients. As the year ended, theFoundation was soliciting FCBA mem-bers interested in serving as a mentor toa scholarship recipient. (A post-script;as this report is being written theFoundation has received overwhelmingresponse to its request for mentors, with

far more volunteers than there are stu-dents to mentor.) The mentors areavailable to help support the students intheir transition to college. This is animportant component of the scholarshipprogram, as most of the scholarshiprecipients lack family members or otherpeople to whom they can turn whohave gone through the college experi-ence to provide advice and assistance.At year-end, the Foundation’s Boardapproved an event, to be held July 27 ata Washington Mystics basketball game,where the scholarship recipients, theirmentors, and Foundation Board mem-bers will be able to meet. Thanks toVerizon, NBC and the NationalAssociation of Broadcasters, whodonated tickets to their Executive Suitesat the Verizon Center for theFoundation to host this event.

IN T ERNSHI P PROGRAM

The Foundation’s internship programawards stipends from the ChairmanRobert E. Lee Scholarship Fund to lawstudents serving in unpaid summer gov-ernment legal internships involvingcommunications law. The Foundationawarded four students a total of$16,600. The base amount of eachstipend is $4,000, which is intended tohelp defray the student’s expenses dur-ing the internship. One student isselected to receive an additional $600Max Paglin Award, in honor of the for-mer FCBA member, FCC GeneralCounsel and Executive Director, andfounder of the Golden JubileeCommission on Telecommunications.This year’s recipients are:

n Lisa Haas, previously of the TuoroCollege Jacob D. Fuchsberg LawCenter, transferring to GeorgetownUniversity Law School, who isworking in the office of FCCCommissioner Jonathan Adelstein;

n Jennifer Holtz, of the SyracuseUniversity College of Law, who alsois the Max Paglin Award recipientand is working in the office of FCCChairman Kevin Martin;

n Joo Young Lee, of Lewis & ClarkLaw School, who is working in theFCC’s Wireless TelecommunicationsBureau; and

n Daniel H. Mark, of the GeorgeWashington University Law School,who is working in the PolicyDivision of the FCC’s Media Bureau.

n Amy Wolverton chaired theinternship program. This includedcoordinating the distribution ofnotices of the Foundation’sInternship Program to law schoolsthroughout the country (a copy ofthe application also is posted on theFoundation’s website), and thencoordinating the review of the 26applications submitted. A group ofFoundation Trustees reviewed theapplications, evaluating theapplicants’ financial need, academicachievements, community service,and the relationship of theirproposed internship tocommunications law.

CHARITY AUCT ION

The 2005 Charity Auction was held onNovember 17, 2005. Co-sponsored bythe Foundation and the FCBA YoungLawyers Committee, this year’s eventraised more than $75,000 to benefitKids Enjoy Exercise Now of Greater DC(“KEEN”). KEEN provides a range ofone-to-one recreational activities forchildren and young adults with disabili-ties in a non-competitive environmentthat encourages the fulfillment of indi-vidual goals. KEEN used the fundsraised at the Charity Auction to increaseits presence in Southeast D.C.

The Charity Auction planning commit-tee co-chairs were Jason Friedrich andNatalie Roisman. Other members ofthe planning committee were RyanWallach, Adam Kirschenbaum, ChrisFedeli, David Don, DebreaTerwilliger, Pam Slipakoff, PaigeFronabarger, Heidi Kurtz, Lee Petroand Mark Van Bergh.

The Charity Auction included a raffle,four silent auction tables, and three liveauctions with guest auctioneersCalifornia Congresswoman ZoeLofgren (Live Auction I); DanielBrenner and Melissa Newman (LiveAuction II); and Brian Fontes andBryan Tramont (Live Auction III). Inaddition, more than 150 FCBA mem-bers volunteered their time and energyto help plan the Auction or work thenight of the Auction. The sponsors ofthe 2005 Charity Auction were: Cole,Raywid & Braverman, LLP; CTIA -The Wireless AssociationTM;Fletcher, Heald & Hildreth, PLC;Hogan & Hartson, LLP; Latham &Watkins LLP; Lockheed MartinCorporation; Sonnenschein Nath &Rosenthal LLP; Trimble Navigation,Ltd.; Vonage; and Willkie Farr &Gallagher LLP.

COMMUNITY SER V ICE

The Foundation continued to sponsornumerous volunteer events and activi-ties to fulfill one of its primary missions:volunteer services that support commu-nity service projects, particularly thosedirected towards children and students.Howard Weiss (a former member andchair of the Foundation’s Board ofTrustees) and Megan Stull coordinatedthe Foundation’s Volunteer ServicesCommittee. They were primarilyresponsible for coordinating all volun-teer activities, including makingarrangements for several special fieldtrips for children. I am particularlyappreciative of the Co-Chairs efforts thisyear as they helped to reinvigorate theFoundation’s volunteer activities, andthey served as Co-Chairs although nei-ther was a member of the Foundation’sBoard. They exemplified how FCBAmembers who are not members of theFoundation’s Board can contribute to theFoundation’s work in the community.

The Foundation continued its long-standing, monthly volunteer activities atMartha’s Table. On the last Sundaymorning of each month, volunteershelped prepare meals for the homeless,

and on the fourth Sunday of everymonth volunteers delivered meals to thehomeless in the District throughMcKenna’s Wagon (a mobile soupkitchen operated by Martha’s Table).Howard Weiss was responsible forcoordinating the Sunday morning mealpreparation, while Cara Voth and TomVan Wazer (also a former member andchair of the Foundation’s Board ofTrustees) coordinated the McKenna’sWagon volunteers. For the Sundaymorning meal preparation, theFoundation successfully initiated a newconcept, soliciting the participation ofmembers of various FCBA standingcommittees for a particular month. Theresponse was at times overwhelming,with participating committees includingthe Media Practice, Cable Practice,International TelecommunicationsPractice, Wireless TelecommunicationsPractice and Young Lawyers.Additionally, a group from the NationalTelecommunications and InformationAdministration (NTIA) also volunteeredfor the Sunday morning meal prepara-tion.

In addition to these regular monthlyvolunteer activities, the Foundation alsosponsored several outings with childrenfrom Martha’s Table’s Youth Program.These included attending a WashingtonNationals baseball game in July, an after-noon trip to a Pumpkin Patch inOctober, a George WashingtonUniversity basketball game in January,and an ice-skating trip in March. Inaddition to the children and chaperonesfrom Martha’s Table, VolunteerCommittee co-chairs Howard Weissand Megan Stull, and FCBA membervolunteers accompanied the children onthese trips.

At the FCBA’s annual meeting and lun-cheon on June 28, the Foundation rec-ognized Megan Stull as its Volunteer ofthe Year. As noted above, although nota member of the Foundation’s Board,

Megan served as a co-chair of theVolunteer Services Committee. She wasinstrumental in coordinating many ofthe activities the Foundation undertookduring the year. In addition, she was aregular participant in the Sunday morn-ing meal preparation at Martha’s Table,and accompanied children fromMartha’s Table’s Youth Program on allfour of the outings described above.Megan’s efforts were a significant contri-bution to the Foundation’s effort to rein-vigorate its volunteer activities.

FUNDRAIS ING

The Foundation could not maintain orincrease the level of services it provideswithout the funds needed to do so. TheBoard of Trustees remained committedto funding scholarships and internshipsusing funds raised during the currentyear rather than drawing on theFoundation’s reserves. At the sametime, the Board hoped to further buildthe Foundation’s reserves towards even-tually reaching a level at which incomefrom the reserves is sufficient to helpfund the Foundation’s on-going work.Fundraising is, therefore, a critical ele-ment to the Foundation’s ability to ful-fill its mission. James Coltharp, JackGoodman, Dee May, and MaureenO’Connell co-chaired the Foundation’sFundraising Committee, taking the leadin what became a record setting year fordonations, particularly for the Robert E.Lee Scholarship Fund.

The FCBA’s 19th Annual Chairman’sDinner, honoring FCC Chairman KevinMartin, was held December 8, 2005 atthe Washington Hilton’s InternationalBallroom. The support of 124 law firmsand companies that purchased sponsortables raised more than $42,000 for theFoundation’s Scholarship Fund. Thiswas the first Chairman’s Dinner forChairman Martin, and it included a“first ever” roast of the Chairman byDick Wiley, Eddie Fritz and JimCicconi. This year’s special guests alsoincluded FCC Commissioners KathleenAbernathy, Michael Copps andJonathan Adelstein, AmbassadorDavid Gross, and Assistant SecretaryMichael Gallagher.

The 10th Annual FCBA FoundationHonorable Robert E. Lee MemorialGolf Tournament was held on Friday,June 16, at the Bull Run Country Clubin Haymarket, Virginia. The tourna-ment raised almost $14,000 for theFoundation’s Scholarship Fund. It isnamed in memory of former FCCChairman Robert E. For the second year, a Casino Night tobenefit the Foundation was held afterthe Saturday evening dinner at theFCBA’s Annual Seminar, which this yearwas held at the Greenbrier Resort inWhite Sulphur Springs, West Virginia.The Casino Night, in combination withthe sale of FCBA Polo Shirts (which theYoung Lawyers Committee initiated atlast year’s Annual Seminar), providedmore than $2,500 to the Foundation.

FCBA members generously donatedmore than $2,200 to the Foundation’sannual giving campaign, and con-tributed more than $8,500 through themembership dues check-off.

This was the first year that theFoundation was eligible to receive contri-butions from the Combined FederalCampaign (CFC), the annual charitablegiving program that allows federal gov-ernment employees to contribute to anyorganization on the list of approved char-ities. In the fall of 2005, Praveen Goyaland Mark Van Bergh attended the FCC’scharity fair for CFC qualified charitableorganizations to provide more informa-tion about themselves to FCC employ-ees. The Foundation received more than$700 from CFC contributions.

Finally, at a gala celebration of theFCBA’s 70th Anniversary, held at theCorcoran Gallery of Art on June 14,2006, FCBA President Michele C.Farquhar presented a donation of$10,000 to the Foundation from theFCBA.

C O NCLUS I ON

Fifteen years ago this past April, theFCBA created the Foundation as ameans to give back something to theWashington, D.C. community. TheFoundation has come a long way sinceits founding. It has provided an outlet

for FCBA members to become moreinvolved in the FCBA and in the com-munity, thereby fulfilling the goals ofthen FCBA President Dick Zaragozawhen he and the FCBA ExecutiveCommittee established an Ad HocCommittee that led to the Foundation’sformation. Many FCBA members haveserved as Foundation Trustees, andmany hundreds of other FCBA mem-bers have participated in theFoundation’s varied activities and con-tributed to its success.

The Foundation’s Board of Trusteesworked hard this year to build uponthese past efforts. The continued gen-erosity and dedication of FCBA mem-bers contributed to making this arecord-setting year for the Foundation,helping to make a difference in the livesof students and children who are thedirect beneficiaries of the Foundation’sprograms. As the year ended, five Boardmembers ended their terms (PaulaBoyd, James Coltharp, Praveen Goyal,Maureen O’Connell, and Mark VanBergh), while five new members pre-pared to start theirs (KathleenAbernathy, Rick Chessen, Donna N.Lampert, Jane E. Mago, and LawrenceJ. Movshin). The remaining and newmembers of the Board of Trustees have asolid Foundation upon which to buildand continue to fulfill the mission uponwhich it embarked 15 years ago, mak-ing a difference in the community inwhich many of us work and live.

Martha’s Table feeds hundreds ofhungry, homeless adults and childrenon the streets of Washington daily,through its mobile soup kitchen.Children and friends are also welcome.We will begin at 10:00 am and workuntil 1:00 pm. Martha’s Table is locatedin a yellow building at 2114 FourteenthStreet, NW, in the District, near theintersection of 14th and U Streets. On-street parking is available. Volunteersare asked to bring food if possible, (e.g.,cold cuts, bread, peanut butter, jelly,vegetables and potatoes) because thecenter often runs out of donated food.

to deliver food to the needy. For thosewho have volunteered, it has been awonderful experience and a great wayto help the needy in the D.C.community.

The Wagon is a white van that is loadedup with sandwiches, snacks and soup.We meet at Martha’s Table at 4:45 pm incomfortable clothes and shoes. Martha’sTable is located in a yellow building at2114 Fourteenth Street, NW, in theDistrict, near the intersection of 14thand U Streets. On-street parking isavailable.

Upon arrival we get assignments (someof us will distribute snacks andsandwiches, others will serve soup), andput on aprons before we depart in thevan to 5th and New York Ave., NW(near the new Convention Center). Weare driven by one of our experiencedvolunteers and the trip to distributionlocation takes about 10-15 minutes.

We serve about 30-75 people per visitincluding a few mothers who come forfood for their families. The area is wellpatrolled by police. The fooddistribution is conducted in an efficient,calm and orderly fashion and many ofthe people we serve are quiteappreciative of our efforts. Once we

serve all of the food, we do a clean up ofthe immediate area. Total time for thedistribution takes about one hour andwe usually return to Martha’s Table byor before 6:30 pm.

SUB M I SS I ON I NS TRUCT IONS : DySPAN 2007 has worked with the IEEE Communications Magazine RadioCommunications Supplement to fast track the three top papers as determined by review of the Technical Program Committeefor publication. DySPAN-07 is soliciting following types of contributions that will be published in a paper proceedingspublished by IEEE and made available to conference registrants. The top papers from the conference will also be considered forrelevant IEEE journals and publication on IEEE Explore.

F ULL PAPERS : Full Papers in technology and policy domain must present original, previously unpublished, completeworks. Papers in technology track presenting research experiences from realistic systems are welcome. The extended abstractsthat are accepted need to be expanded to full papers under the guidance of program committee members.
