1 AGREEMENT BETWEEN SPRING COVE SCHOOL DISTRICT AND SPRING COVE EDUCATION ASSOCIATION I. RECOGNITION The Spring Cove Education Association, hereinafter called the bargaining agent, is hereby recognized by the Spring Cove School District, hereinafter called the employer, as the bargaining agent for the Spring Cove Education Association, hereinafter called the bargaining unit under the conditions of Pennsylvania Law (Act 195) providing for collective bargaining for public employees. Both parties aver this agreement sets forth the terms and conditions to which each party agrees to be bound, and that such agreement has been reached voluntarily without undue or unlawful coercion or force by either party. II. TERM OF AGREEMENT The term of this agreement shall begin on July 1, 2003, and shall continue in full force and effect until June 30, 2008 or until such later date as the two parties may hereinafter agree is to be the extended ending date. Any such extended date shall be evidenced by an amendment to this agreement, to which amendment both parties shall signify their approval by affixing their signature thereto. III. AGREEMENT BETWEEN SPRING COVE SCHOOL DISTRICT

AND SPRING COVE EDUCATION ASSOCIATION

I. RECOGNITION The Spring Cove Education Association, hereinafter called the bargaining agent, is hereby

recognized by the Spring Cove School District, hereinafter called the employer, as the bargaining agent for the Spring Cove Education Association, hereinafter called the bargaining unit under the conditions of Pennsylvania Law (Act 195) providing for collective bargaining for public employees.

Both parties aver this agreement sets forth the terms and conditions to which each party

agrees to be bound, and that such agreement has been reached voluntarily without undue or unlawful coercion or force by either party.

II. TERM OF AGREEMENT The term of this agreement shall begin on July 1, 2003, and shall continue in full force

and effect until June 30, 2008 or until such later date as the two parties may hereinafter agree is to be the extended ending date. Any such extended date shall be evidenced by an amendment to this agreement, to which amendment both parties shall signify their approval by affixing their signature thereto.

reflected in Appendix A made part of this agreement, and that the schedule of wages and salaries set forth in Appendix A shall be the schedule which shall remain in force for the period of this agreement.

V. OTHER EMPLOYEE BENEFITS The parties agree that other employee benefits to be provided under this agreement are

accurately reflected in Appendix B attached to and made part of this agreement.

a change in the term of this agreement, as provided in Section II, shall be evidenced by a revised Appendix B which shall be executed by the parties and attached hereto and made part of this agreement.

VI. GRIEVANCE PROCEDURE It is in the interest of the general public, and in the interest of the school children that

both employer and employees serve, that grievances be reconciled and disposed of as expeditiously as is possible in accordance with provisions as authorized in Appendix C, attached to and made a part of this agreement.

VII. JOB SECURITY AND JOB PROGRESSION The Pennsylvania School Code includes certain job security provisions, certification, and

other regulatory provisions associated with various classes of employees. The parties hereby aver that such provisions of the School Code represent their complete agreement and that said provisions shall govern the manner in which the job security, job progression, and reduction in force practices shall be effected with respect to members of the bargaining unit.

VIII. WAIVERS The parties agree that no additional negotiations on this agreement will be conducted on

any item, whether contained herein or not, during the life of this agreement except by mutual consent of the parties hereto.

IX. NEGOTIATION OF A SUCCESSOR AGREEMENT The parties agree to enter into collective bargaining over a successor agreement not later

than January 11, 2008. X. EFFECTIVE DATE AND SIGNATURE This agreement is made and entered into this 21st day of April, 2003 and by and

VII. SUPER-MAXIMUM Each member of the bargaining unit will receive a super-maximum increment after

completion of their 10th, 15th, 20th, 25th and 30th years as a full-time professional employee in the public schools of the Commonwealth of Pennsylvania.

During this contract, the maximum amount that will be added as super-maximum

increment to an individual’s salary is $800. An employee becomes eligible after service, according to the above stipulations, as listed below:

$100 after the 10th year; $100 after the 15th year; $200 after the 20th year; $200 after the 25th year; $200 after the 30th year; No changes will be made in an employee’s salary at mid-term. Such super-maximum increments shall be made a part of the attached salary schedules

and shall become a permanent part of the employee’s salary. This is added to the employee’s salary after all other computations have been made.

AGREEMENT--SCHOOL DISTRICT/EDUCATION ASSOCIATION (Cont.) APPENDIX B I. SCHOOL YEAR The school term shall be as follows: 186 days -- (180 student days and 6 non-student days -- administrative, inservice, etc.) The per diem rate is based upon the total of student and inservice days and the annual

salary. Industrial arts instructors are employed annually for 188 days, guidance counselors and

librarians are employed for 193 days. (Compensation for the extra days shall be at the per diem rate.) The school year for industrial arts, guidance counselors and librarians hired after July 1, 1994 shall be 186 days. Twelve-month instructors’ salaries shall be determined by a ratio of 1.25 times their respective position on the schedule in Appendix A of this agreement.

II. HOSPITALIZATION AND INSURANCE Spring Cove School District shall provide for the professional employees and their eligible

dependents medical care coverage which is defined as a point of service managed care program through Highmark, Inc. including hospitalization, medical/surgical services, prescription drug, with preventive care, that is equal to or better coverage than was in effect for the 2003/04 school term.

The School District shall pay the full premium for the 2003/04 school year for the

professional employees and their eligible dependents. Effective July 1, 2004, the School District shall pay the full premium for the professional

employees and their eligible dependents provided the professional employee authorizes $600 per year ($50 per month) payroll deduction toward the premium of this insurance, regardless of family coverage, individual, two persons, etc.

The School Board shall provide group term life insurance protection which shall pay to

the designated beneficiary the following amount without cost, to each member of the bargaining unit covered under this agreement during tenure of his employment or so long as this agreement remains in full force and effect: $18,500 plus $18,500 AD & D (accidental death and dismemberment).

MEMBERS OF THE BARGAINING UNIT ARE PAID TWICE MONTHLY AS FOLLOWS: 1. Members of the unit are paid the base salary in twenty-four (24) equal installments,

on the fifteenth day and the last day of the month. In the event that the fifteenth or last day of the month should fall on a day when school is not in session, payment will be made on the last day that school is in session preceding the fifteenth or last day of the month.

All payments for extra duties, overtime, etc. as well as deductions for lost time, etc.

shall be made only on the payroll of the fifteenth of the month. Except in unique situations, no extra pay or deductions will be made on the pay of the last day of the month.

2. Any member of the bargaining unit wishing to be paid the balance of his earned salary

on the June 15 payroll may receive it provided the Administration Office is notified no later than May 1, and approval will be given on a first-come, first-serve basis so long as the district is able to pay without incurring debt prior to the end of the fiscal year.

V. LIABILITY INSURANCE The School Board carries liability on all employees. This protection is not provided to

suggest the employee may be careless in the performance of his duties, but rather to give him confidence and freedom of fear.

VI. WORKMEN’S COMPENSATION All employees are covered by compensation for medical or hospital bills for accidents

occurring in the course of school employment. Such claims must be filed within three (3) days with the Board Secretary.

VII. TRAVEL AND RELEASED TIME When it is necessary for a member of the bargaining unit to travel in discharging his

assigned duties, he will be reimbursed at the highest rate allowed by the Internal Revenue Service.

AGREEMENT--SCHOOL DISTRICT/EDUCATION ASSOCIATION (Cont.) In the event that the allowable rate drops below $.20 per mile, the reimbursement rate

would revert to $.22 per mile. The Board agrees to provide a substitute for four (4) days in each school term for the

elected delegate of the Spring Cove Education Association to attend the professional association conference.

VIII. EXTENSION OF DEATH LEAVE BENEFITS In addition to the list of immediate family in Section 1154 (b) of the School Code,

whenever a teacher is absent because of the death of a grandchild, there shall be no deduction in salary for absence for three days as is allowed for other members of the immediate family.

IX. PAYMENT TO A RETIRING TEACHER When a member of the bargaining unit gives the Spring Cove School District his letter of

intent to retire by March 1 of his last year, the member shall be paid $25.00 per day for all accumulated unused sick leave on the first payroll in July.

X. MATERNITY LEAVE POLICY The maternity leave policy shall be as prescribed by the various governmental

departments and commissions. (Department of Education - School Administrator’s Memorandum No. 354)

XI. MEMBERSHIP DUES DEDUCTIONS A. Deduction from Salary The Board agrees to deduct from the salaries of members of the local association, the

Pennsylvania State Education Association, and the National Education Association as said members authorize the Board to deduct and transmit the monies by check in eight (8) equal monthly installments to the Spring Cove Education Association.

1. Equal Monthly Installments Deductions referred to in Paragraph A above will be made in sixteen (16) nearly

equal semi-monthly installments as practicable during the school year. First deduction is to be made on the October 15th pay check.

B. List Supplied to Board No later than September 30, of each calendar year under contract, the Spring Cove

Education Association will provide the Board with a list of those employees who have authorized the Board to deduct dues for the Association in Paragraph A above.

AGREEMENT--SCHOOL DISTRICT/EDUCATION ASSOCIATION (Cont.) C. Authorization Cards The Board will honor such authorization cards as are drawn up by the local

Association. XII. POSTING OF VACANCIES Whenever a professional vacancy arises, a notice shall be posted of the same for no less

than one (1) week before the position is filled. Members of the professional staff of Spring Cove School District applying for said position will be given consideration based on the experience, competency, qualifications, length of service in the district, and other relevant factors.

XIII. PURCHASE OF NECESSARY BOOKS, MATERIALS AND EQUIPMENT The Board and the Association mutually recognize the importance of continuous use of

adequate teaching reference material in maintaining a high level of professional performance. In the furtherance of that recognition, the Board shall attempt to provide a teacher reference library in each school in the district. The quantity and quality of the materials is purely within the policy-making powers of the Board and is not subject to the Grievance Procedure.

XIV. REIMBURSEMENT FOR GRADUATE STUDY The Board shall reimburse each professional employee for graduate study as follows: A. $250.00 per graduate credit. Payment of tuition or registration fee from IU 08

inservice credits. Reimbursement for graduate study shall start with the 13th credit. B. Credits must be completed between July 1 and June 30 for payment in current year. C. The graduate credits must be in the major area of certification as defined and agreed

upon between the employee and the superintendent. This definition includes those education graduate courses that are applicable to the major area of certification.

D. A limit of not more than 12 graduate credits paid each school year during the term of

this contract. E. Payment shall be made only upon presentation of an official transcript showing

satisfactory completion of the courses along with a written request from the professional employee, and in the case of IU 08 inservice credits, a receipt of payment.

F. Payment for additional work will be made on the payroll for the 15th day of any month

provided that the transcript and written request have been received by the administrative office prior to the 1st day of the same month.

G. Members of the unit who are on leave of absence shall not qualify for the payment for

credits received during the time of their leave.

AGREEMENT--SCHOOL DISTRICT/EDUCATION ASSOCIATION (Cont.) H. Members of the unit who are on sabbatical leave shall qualify for the payment of

credits received during the time of their leave. XV. MEET AND DISCUSS COMMITTEE A Meet and Discuss Committee shall be established to meet and discuss policy matters

affecting wages, hours, and terms and conditions of employment. The Committee shall consist of not more than six members from the membership of the

Spring Cove Education Association and not more than six members from the School Board and Administration Staff. A consultant may become a member of the group by mutual consent.

The Committee shall form its own rules and regulations and shall meet on the first

Monday in November, February, and April of each school term unless mutually waived. Additional meetings may be scheduled at mutual consent.

XVI. PERSONAL LEAVE DAY Two days of personal leave will be granted to each member of the unit during the school

term. Personal leave days are subject to the following conditions: 1. Providing the number of previously planned absences for conferences, workshops, etc.,

that have been arranged for on the particular day do not create a hardship for the respective principal.

2. At least three (3) days notice shall be given the respective building principal except in

unanticipated emergency. 3. In a building with fewer than twenty (20) professional employees, not more than two (2)

may have the personal leave on the same day. In buildings with more than twenty (20) professional employees, not more than three (3) may have the personal leave on the same day.

4. Requests will be considered on a first-come, first-served basis. 5. Personal leave days may not be granted during the first ten (10) days of school for

teachers, nor during the last ten (10) days of school for teachers based on the calendar as adopted by the School Board except in unanticipated emergency. Personal leave days may not be granted when the class has a scheduled field trip.

6. For any unused personal leave days, the employee will have the option of: a. Reimbursement at the rate of $45 paid to the employee on the June 15th check, or b. Transfer unused personal leave days to accumulated sick leave, or c. Unused personal days shall accumulate to a maximum of four (4) with no more

than four (4) taken in any one school year.

AGREEMENT--SCHOOL DISTRICT/EDUCATION ASSOCIATION (Cont.) XVII. JURY DUTY In the case of jury duty, an employee shall be paid the difference between his regular

wage and that received for jury duty during the time involved. XVIII. SICK LEAVE Sick leave shall in all ways be interpreted and administered as in Section 1154 of the

School Code except that each member of the bargaining unit shall receive eleven (11) days per year instead of ten (10) days, as stated in this section of the School Code.

XIX. DENTAL INSURANCE The Spring Cove School District shall provide for each professional employee and/or

immediate family a basic dental plan to include full coverage for routine procedures which will be paid in full by the School District.

AGREEMENT--SCHOOL DISTRICT/EDUCATION ASSOCIATION (Cont.) APPENDIX C I. GRIEVANCE PROCEDURE A “grievance” is hereby defined as an alleged violation of any provision of this agreement

or any alleged discriminatory application of such provisions. A grievance shall not mean any matter over which the School Board does not have

authority to act. The parties to this agreement agree that an orderly and expeditious resolution of

grievances arising out of the interpretation of the terms of this agreement shall provide for a four (4) step process which is described in the following paragraphs and the table thereto.

Step 1 Person or persons initiating the grievance shall present the grievance in writing

and on a form provided by the employer, to the building principal within five (5) days after its occurrence.

A. If the person who is presenting a grievance wishes to have present during the

airing of that grievance a member of the Spring Cove Education Association grievance committee, he may do so.

B. Likewise, the administrator with whom the grievance is being registered may

have an administrative assistant present if the grievance is filed in a secondary school. If the grievance is filed with an elementary administrator, he or she may call in his or her immediate supervisor. The building principal shall reply to the grievance within five (5) days after initial presentation of the grievance.

Step 2 If the action in Step 1 above fails to resolve the grievance to the satisfaction of

the affected parties, the grievance shall be referred to the superintendent of the school district within five (5) school days. In the event of the absence of the individual named in steps one and two, when a grievance is presented to his particular level, the time limit will not commence until the day of his return, provided that this extension of time shall not exceed one week in which case the grievance is to go to his designated representative.

Step 3 If the action in Step 2 fails to resolve the grievance to the satisfaction of the

affected parties, the grievance shall be referred to the Board of Education within five (5) school days, to be acted upon at the next regular Board meeting.

Step 4 If the action in Step 3 fails to resolve the grievance to the satisfaction of the

affected parties, the grievance shall be referred to binding arbitration as provided in Section 903 of the Act within thirty-five (35) days of Board meeting provided for in Step 3. If the grievance fails to meet the criteria of Section 903 of the Act, the decision of the Board of Education in Step 3 shall be final.
