RE: Part Lot 1 Concession IV 393053 County Rd 12 , Amaranth
Dear Deputy Clerk Ms. Nicole Martin and members of Council,
I am the owner of lands that directly abut the Municipal Works Yard on the east side ofCounty Road 12. A portion of the lands are designated Environmental Protection while otherportions of the land include a rural designation. I would like the ability to build a house onthat portion of the lands that is designated rural. However, there is a policy that has beenadded in the Official Plan and the Zoning By-law that states that no dwelling shall beconstructed within l-50 metres of the Municipal Public Works Yard located in the west Halfof Lot L Concession IV. These policies and regulations have been inserted into theTownship's planning documents to benefit the municipality. However, the regulations havea significant adverse effect on my ability to use the lands without compensating me. Theeffect of the regulations is to prevent the rural lands from being used for a dwelling, whichwould otherwise be permitted.
The Ministry of Environment and Climate Change establishes guidelines for separationdistances between industries and sensitive land uses. In our respectful submission, webelieve that the Municipality should delete this section from the Official Plan, and eventuallythe Zoning By-law, and that the use of the lands should be subject to the Ministry ofEnvironment and Climate Change Guidelines. This would enable us to determine theappropriate setbacks and buffers required from the Municipal Public Works Yard to ensurethat the abutting uses can be compatible.
I expect these changes to happen very soon and solely at your costs. We will be calculatingour costs and damages to date and will advise you of what our damages are soon.
In addition to the above matter the Municipality without a thorough environmental impactstudy has constructed a salt storage building very close to its northerly boundaryencroaching on my lands. This issue has been discussed with your road superintendent andsome council representatives in the past without resolution. I am asking council to instructthe township engineer as to how fill and silt on my property can be removed off my landsand a proper retaining wall be constructed. I look forward to all these issues being resolvedby council as soon as possible.

I have not heard from you since our discussion of August 12, 2020.
I understand from the email sent by Ms. Martin on August 26th, 2020 that you were in an LPAT hearing.
As you may know, a Town Council meeting was held on September 2nd, 2020. My understanding from
our discussions pertaining to this matter and from the email sent by Ms. Martin on August 26th was that
the Township would be prepared to “amend the Stop Work Order to allow for the removal of illegal fill
once the Township is provided with the additional amounts of fill that is required to complete the work.”
Although I still have not received clarification on why the decision to lift the Stop Work Order to
remove fill was contingent on the information regarding import of new fill, my client provided same.
During the September 2nd Town Council meeting, Council members advised that they were not prepared
to lift the Stop Work Order despite providing the information previously requested. In addition, they
requested a map of the site of the contaminated soil, as well as a plan with respect to the removal of the
soil, after which they would consider temporarily lifting the Stop Work Order.
In addition, the Township advised that they would require full payment of the road repairs which
occurred in November, 2020. The issues with the amount payable for the road repairs have been
previously outlined and more specifically were communicated to you in our June 26th correspondence.
Nevertheless, my client has agreed to pay the outlined amount in protest, in order to expedite this

Page 2 of 2… matter. I am currently holding the amount of two thousand five hundred and eighty dollars ($2,580.00)
in our firm’s trust account per the invoice sent by Ms. Martin on May 11, 2020. Kindly advise how to
forward these funds to the Township.
I have attached the site map and plans from Fisher Environmental Ltd. which outlines all of the
information that the Township has required in order for my client to have the necessary fill removed.
At this time, there should be no further impediments to the Stop Work Order being lifted immediately
and my client completing the repair work.

Re: Summary of Conclusion – Soil and Surface Water Results 285462 Dufferin County Road 10, Amaranth, Ontario As requested, Fisher Environmental Ltd. (Fisher Environmental) has taken 35 soil samples along the Murray Wesley Kot Field tarmac at 285462 Dufferin County Road 10, Amaranth, Ontario (the “Site”). Site sampling was conducted in a westerly to easterly direction (see map). Based on a review of the laboratory results, the following soil exceedances were identified: Table A: Summary of Soil Exceedances

Discussion and Recommendations: The Runway is approximately 640 m in length with the first samples taken bordering the highway west to east. At each location 1 KG of soil was removed at 10 inches below surface and 1litre of ground water was taken from adjoining water ponds. In only two of the soil samples a very slight exceedance was detected above the MOECP soil, Ground water and Sediment Standards for Use under Part XV.1 of the Environmental protections Act, dated April 15, 2011.Table 1 full depth background site condition standards for all type of property use. Location 33 with 1ppm exceedances of Selenium is considered negligible quantity and no action is required.

We are recommending that at location 35, which is at the north-easterly end of the tarmac (shown on map), 20 tonnes of soil be removed and shipped to an approved MOECP receiving disposal site. General Limitations The comments presented in this letter report are based on the limited soil and water sampling conducted at the Site during this investigation. There is no warranty expressed or implied or representations made by Fisher Environmental that the current investigation has discovered all potential environmental risks or liabilities associated with the Site. Fisher Environmental shall not be responsible to the client for lost revenues, loss of profits, cost of content, claims of customers, or other special indirect, consequential, or punitive damages. To the fullest extent permitted by law, the client’s maximum aggregate recovery against Fisher Environmental, its directors, employees, sub-contractors and representatives, for any and all claims by the owner for all causes including, but not limited to, claims of breach of contract, breach of warranty and/or negligence, shall be limited to the amount of professional fees paid. Any use and/or interpretation of the data presented in this letter report, and any decisions made on it by the third party are responsibility of the third party.
