Moran Lake Water Quality & Lagoon Restoration Study

Dear Members of the Board:

In an action taken during the budget hearings of June 2002 the Redevelopment Agency was directed to undertake a feasibility study to evaluate modifying the roadway along East Cliff Drive at Moran Lake for the purpose of improving water quality, habitat character and to provide qualitative improvements for the benefit of local residents and visitors to the area. As staff began to evaluate the issue, it was felt that a basic assessment of the dynamics of hydrology, water quality, ocean tidal impacts and other conditions should be a first step in determining future improvements. The purpose of this letter is a request Board approval of a consultant services agreement to undertake this initial assessment study.

Background

Moran Lake is coastal lagoon, located on East Cliff Drive in the Pleasure Point area in Live Oak. It is currently managed and maintained by the County Parks Department as part of the Moran Lake Park. Existing improvements include a small restroom building and parking lot, path to the beach and large groves of Eucalyptus trees serving as a Monarch Butterfly habitat during the winter months. During the past ten to twenty years various “improvements” to the area have included construction of a new 12’ square box culvert to replace a 4’ diameter culvert (1981) and partial filling and regrading of the lagoon area and stream channel. The area serves as a storm drainage outlet for a large urban watershed area which includes the downstream flows from the large drainage retention basin on 3gth Avenue and portions of the 4ISt Avenue commercial area.

Proposed Study

The purpose of this study is to develop some basic information about the dynamics of the hydrology of this coastal lagoon area, to provide some preliminary data about water quality conditions and to evaluate the existing information regarding drainage structures

and changes which have been implemented through the years. This is important in order to provide a framework for making future decisions about management of the area and whether drainage and roadway modification would be of benefit to the lagoon and adjacent habitat areas. A parallel track is being undertaken by the Parks Department. They have prepared a butterfly habitat management plan for the area and are assuming the management for the Lode street property, currently the site of the Sanitation district sewage pumping station. In order to conduct this work, Agency staff have negotiated a contract with John Gilchrist & Associates, a firm which has completed numerous habitat restoration studies in the Monterey Bay area and has extensive experience on projects of this nature. (See attached proposal which includes resume and qualifications.) The expected cost for this work is $43,515.00. Funds for this project are appropriated within the current budget of the Redevelopment Agency.

ConclusionlRecommendation

Redevelopment Agency staff has determined that the project is of benefit to the Project Area. We expect that the results of this study will lead to a better understanding of the complex issues of water quality and drainage and tidal interactions, and will provide important direction for decisions about the value of roadway, drainage and other habitat management issues for Moran Lake. At this time there are no other reasonable means of financing the improvements are available to the community. The project will assist in the elimination of blight, and the project is consistent with the Redevelopment Agency's Five Year Implementation Plan.

It is therefore RECOMMENDED that your Board, as the Board of Directors for the Redevelopment Agency, take the following actions:

1. Approve Agency funds totaling $43,515.00 for the consultant contract for the Moran Lake Water Quality & Lagoon Restoration Study;

2. Concur with and adopt the associated findings; and

3. Authorize the RDA Administrator to sign the attached contract with John Gilchrist and Associates.

INDEPENDENT CONTRACTOR AGREEMENT

THIS CONTRACT is entered into this - day of , 20-, by and between the COUNTY OF SANTA CRUZ REDEVELOPMENT AGENCY, hereinafter called AGENCY, and John Gilchrist & Associates, hereinafter called CONTRACTOR. The parties agree as follows:

1. DUTIES. . CONTRACTOR agrees to exercise special skill to accomplish the following result: as described in Exhibit A. Scope of Services and ComDensation.

2. COMPENSATION. In consideration for CONTRACTOR accomplishing said result, COUNTY agrees to pay CONTRACTOR as follows: as described in Exhibit A. Scope of Services and Compensation.

3. TERM. The term of this contract shall be: until June 30. 2004.

4. EARLY TERMINATION. Either party hereto may terminate this contract at any time by giving 30 days written notice to the other party.

5. INDEMNIFICATION FOR DAMAGES, TAXES AND CONTRIBUTIONS. CONTRACTOR shall exonerate, indemnify, defend, and hold harmless AGENCY and the COUNTY OF SANTA CRUZ (hereinafter called COUNTY) (which for the purpose of paragraphs 5 and 6 shall include, without limitation, their officers, agents, employees and volunteers) from and against:

A. Any and all claims, demands, losses, damages, defense costs, or liability of any kind or nature which COUNTY or AGENCY may sustain or incur or which may be ;. imposed upon it for injury to or death of persons, or damage to property as a result of, arising out of, or in any manner connected with the CONTRACTOR'S performance under the terms of this Agreement, excepting any liability arising out of the sole negligence of AGENCY or COUNTY. Such indemnification includes any damage to the person(s), or property(ies) of CONTRACTOR and third persons.

B. Any and all Federal, State and Local taxes, charges, fees, or contributions required to be paid with respect to CONTRACTOR and CONTRACTOR'S officers, employees and agents engaged in the performance of this Agreement (including, without limitation, unemployment insurance, social security and payroll tax withholding).

6. INSURANCE. CONTRACTOR, at its sole cost and expense, for the full term of this Agreement (and any extensions thereof), shall obtain and maintain at minimum compliance with all of the following insurance coverage(s) and requirements. Such insurance coverage shall be primary coverage as respects AGENCY and COUNTY, and any insurance or self-insurance maintained by AGENCY or COUNTY shall be excess of CONTRACTOR'S insurance coverage and shall not contribute to it.

If CONTRACTOR utilizes one or more subcontractors in the performance of this Agreement, CONTRACTOR shall obtain and maintain Independent Contractor's Insurance as to each subcontractor or otherwise provide evidence of insurance coverage for each subcontractor equivalent to that required of CONTRACTOR in this Agreement, unless CONTRACTOR and AGENCY both initial here I

A. Tvpes of Insurance and Minimum Limits

(1) Worker's Compensation in the minimum statutorily required coverage amounts. This insurance coverage shall not be re ired if the CONTRACTOR has no employees and certifies to this fact by initialing here

(2) Automobile Liability Insurance for each of CONTRACTOR'S vehicles used in the performance of this Agreement, including owned, non-owned (e.g., owned by CONTRACTOR'S employees), leased or hired vehicles, in the minimum amount of $500,000 combined single limit per occurrence for bodily injury and property damage. This insurance coverage shall not be required if vehicle use by CONTRACTOR is not a material part of performance of this Agreement and CONTRACTOR and AGENCY both certify to this fact by initialing here I

(3) Comprehensive or Commercial General Liability Insurance coverage in the minimum amount of $1,000,000 combined single limit, including coverage for: (a) bodily injury, (b) personal injury, (c) broad form property damage, (d) contractual liability, and (e) cross-liability .

(4) Professional Liability Insurance in the minimum amount of $1,000,000 combined single limit, nd only if, this Subparagraph is initialed by CONTRACTOR and AGENCY

B . Other Insurance Provisions

(1) If any insurance coverage required in this Agreement is provided on a "Claims Made'' rather than "Occurrence" form, CONTRACTOR agrees to maintain the required coverage for a period of three (3) years after the expiration of this Agreement (hereinafter "post agreement coverage") and any extensions thereof. CONTRACTOR may maintain the required post agreement coverage by renewal or purchase of prior acts or tail coverage. This provision is contingent upon post agreement coverage being both available and reasonably affordable in relation to the coverage provided during the term of this Agreement. For purposes of interpreting this requirement, a cost not exceeding 100% of the last annual

policy premium during the term of this Agreement in order to purchase prior acts or tail coverage for post agreement coverage shall be deemed to be reasonable.

(2) All required Automobile and Comprehensive or Commercial General Liability Insurance shall be endorsed to contain the following clause:

"The County of Santa Cruz, The County of Santa Cruz Redevelopment Agency, their officials, employees, agents and volunteers are added as additional insureds as respects the operations and activities of, or on behalf of, the named insureds performed under Agreement with the County of Santa Cruz The County of Santa Cruz Redevelopment Agency. 'I

(3) All required insurance policies shall be endorsed to contain the following clause:

"This insurance shall not be canceled until after thirty (30) days prior written notice has been given to: County of Santa Cruz Redevelopment Agency Agency Administrator 701 Ocean Street, Room 510 Santa Cruz, CA 95060.

(4) CONTRACTOR agrees to provide its insurance broker(s) with a full copy of these insurance provisions and provide AGENCY on or before the effective date of this Agreement with Certificates of Insurance for all required coverages. All Certificates of Insurance shall be delivered or sent to:

This contract is subject to the provisions of Santa Cruz County Code Chapter 2.122, requiring payment of a living wage to covered employees. Noncompliance during the term of the contract will be considered a material breach and may result in termination of the contract or pursuit of other legal or administrative remedies.

8. EOUAL EMPLOYMENT OPPORTUNITY. During and in relation to the performance. of this Agreement, CONTRACTOR agrees as follows:

Such action shall include, but not be limited to, the following: recruitment; advertising; layoff or termination; rates of pay or other forms of compensation; and selection for training (including apprenticeship), employment, upgrading? demotion, or transfer. The CONTRACTOR agrees to post in conspicuous places, available to employees and applicants for employment? notice setting forth the provisions of this non-discrimination clause.

B. If this Agreement provides compensation in excess of $50,000 to CONTRACTOR and if CONTRACTOR employs fifteen (15) or more employees, the following requirements shall apply:

(1) The CONTRACTOR shall, in all solicitations or advertisements for employees placed by or on behalf of the CONTRACTOR, state that all qualified applicants will receive consideration for employment without regard to race, color, religion, national origin, ancestry, physical or mental disability, medical condition (cancer related), marital status, sex, sexual orientation, pregnancy, gender, age (over 1 S), veteran status, or any other non-merit factor unrelated to job duties. In addition, the CONTRACTOR shall make a good faith effort to consider Minority/ Women/Disabled Owned Business Enterprises in CONTRACTOR'S solicitation of goods and services. Definitions for Minority/Women/Disabled Business Enterprises are available from the COUNTY General Services Purchasing Division.

(2) In the event of the CONTRACTOR'S non-compliance with the non- discrimination clauses of this Agreement or with any of the said rules, regulations, or orders said CONTRACTOR may be declared ineligible for further agreements with the COUNTY.

(3) The CONTRACTOR shall cause the foregoing provisions of this Subparagraph 7B. to be inserted in all subcontracts for any work covered under this Agreement by a subcontractor compensated more than $50,000 and employing more than fifteen (15) employees, provided that the foregoing provisions shall not apply to contracts or subcontracts for standard commercial supplies or raw materials.

9. INDEPENDENT CONTRACTOR STATUS. CONTRACTOR and AGENCY have reviewed and considered the principal test and secondary factors below and agree that CONTRACTOR is an independent contractor and not an employee of AGENCY. CONTRACTOR is responsible for all insurance (workers compensation, unemployment, etc.) and all payroll related taxes. CONTRACTOR is not entitled to any employee benefits. AGENCY agrees that CONTRACTOR shall have the right to control the manner and means of accomplishing the result contracted for herein.

PRINCIPAL TEST: The CONTRACTOR rather than AGENCY has the right to control the manner and means of accomplishing the result contracted for.

SECONDARY FACTORS: (a) The extent of control which, by agreement, AGENCY may exercise over the details of the work is slight rather than substantial; (b)

CONTRACTOR is engaged in a distinct occupation or business; (c) In the locality, the work to be done by CONTRACTOR is usually done by a specialist without supervision, rather than under the direction of an employer; (d) The skill required in the particular occupation is substantial rather than slight; (e) The CONTRACTOR rather than the AGENCY supplies the instrumentalities, tools and work place; (f) The length of time for which CONTRACTOR is engaged is of limited duration rather than indefinite; (g) The method of payment of CONTRACTOR is by the job rather than by the time; (h) The work is part of a special or permissive activity, program, or project, rather than part of the regular business of AGENCY; (i) CONTRACTOR and AGENCY believe they are creating an independent contractor relationship rather than an employer-employee relationship; and (i) The AGENCY conducts public business.

It is recognized that it is not necessary that all secondary factors support creation of an independent contractor relationship, but rather that overall there are significant secondary factors which indicate that CONTRACTOR is an independent contractor.

By their signatures to this Agreement, each of the undersigned certifies that it is his or her considered judgment that the CONTRACTOR engaged under this Agreement is in fact an independent contractor.

10. NONASSIGNMENT. CONTRACTOR shall not assign this Agreement without the prior written consent of the AGENCY.

11. RETENTION AND AUDIT OF RECORDS. CONTRACTOR shall retain records pertinent to this Agreement for a period of not less than five (5) years after final payment under this Agreement or until a final audit report is accepted by AGENCY, whichever occurs first. CONTRACTOR hereby agrees to be subject to the examination and audit by the Santa Cruz County Auditor-Controller, the Auditor General of the State of California, or the designee of either for a period of five ( 5 ) years after final payment under this Agreement.

12, PRESENTATION OF CLAIMS. Presentation and processing of any or all claims arising out of or related to this Agreement shall be made in accordance with the provisions contained in Chapter 1.05 of the Santa Cruz County Code, which by this reference is incorporated herein.

13. ACKNOWLEDGMENT. CONTRACTOR shall acknowledge in all reports and literature that the Santa Cruz County Redevelopment Agency has provided funding to the CONTRACTOR.

14. ATTACHMENTS. This Agreement includes the following attachments (identify by name or write "NONE"):

RE: Moran Lake Water Quality and Lagoon Restoration

Dear Paul:

In response to your request I am forwarding the following proposal to review existing information on Moran Lake and provide the County with preliminary recommendations on restoration and enhancement alternatives. Previous recommendations have been proposed for drainage and water quality improvements, including replacing the East Cliff Drive box culvert with a free-standing bridge. Although previous studies suggest that Moran Lake suffers from hyper-salinity, urban water quality impairment and eutrophication, it is not clear whether these problems persist today, have grown substantially, or would be corrected by suggested solutions. Furthermore, there are biologic conditions in the lagoon which could either be enhanced or degraded by management and enhancement measures. Brackish waters in Moran Lake provide habitat for the federally threatened tidewater goby, and eucalyptus groves surrounding the lake provide important overwintering roosting habitat for monarch butterfly, a state sensitive species. The Moran Lake eucalyptus groves are one of few significant monarch overwintering sites in the central California coast. The eucalyptus however may also be inhibiting natural revegetation of lagoon margins by native wetland and upland species, and may be affecting lagoon water quality. Alteration of the tidal prism, tidal influx, changes upper watershed freshwater inflows and other management measures could alter biotic conditions and affect habitat for the two sensitive species either in a beneficial or adverse way.

As you are aware, Moran Lake lagoon and watershed are complex man-altered systems. There may be some cost-effective, implementable management strategies that should be accomplished as soon as possible. We will attempt to review previous recommendations as well as newer wetland management techniques to provide a future framework for possible County and resource agency actions.

The project team consists of John Gilchrist and Fall Creek Engineering. Fall Creek Engineering, Inc. (FCE) is a civil and environmental engineering consulting firm with office in Santa Cruz. Fall Creek specializes in the field of environmental, water resources engineering, and water quality protection, including stream and wetland restoration, and surface and groundwater hydrology. Fall Creek has worked with J. Gilchrist & Associates in the design and construction management of several local stream and wetland restoration projects.

At your request, in this latest proposal we have added time for meetings with RDA staff and interested community members, added sediment testing, and have proposed a schedule for project completion. We have also added some time to compile and review the extensive information base referred to by Mike Guth.

The following tasks are proposed for the project:

Task 1 - Compile and Review Existing Information

As the initial task the consulting team will review existing information pertaining to land use, topography, hydrology and drainage, water quality and biotic resources, including applicable restoration plans and Public Works engineering reports. The consulting team will gather and review information available from the County of Santa Cruz and other local sources, including local community members. A brief review of historical aerial photos maintained at the UCSC Map Library will be conducted to review modifications of the lagoon outlet to the ocean, and possible historic changes to Moran Lake beach.

Task 2 - Hydrologic Analysis

A hydrologic analysis will be conducted to estimate the influence of storm water and dry weather runoff and tidal influences on the hydrology of the lagoon. A water balance will be developed to evaluate changes in water levels and exchange rates in the lagoon for dry, average and wet water year conditions. Information available from County Public Works on streamflow, drainage impediments, culvert invert elevations and other public works facilities (wastewater interceptors, pump stations, etc.) that could affect lagoon hydrology will be incorporated into the Task 2 and 3 assessments.

The consulting team will perform an initial assessment of the lagoon outlet to evaluate how modifying the outlet by replacing the road/culvert with a bridge deck will influence inter-tidal flows into the lagoon.

Task 3 - Baseline Water Quality Assessment

The consulting team proposes to conduct a limited baseline water quality assessment to evaluate water quality conditions in the lagoon. We will conduct water quality testing once a month for a seven month period (May - November 2003) to evaluate spring, summer and early winter conditions. Water quality testing will be performed using field instruments and will include measurements of pH, electrical conductivity, dissolved oxygen, and temperature. “First flush” samplings after a fall storm event will also include measurements of TSS, TDS, metals and organics, run by Toxscan. Measurements will be taken at three locations in the lagoon and at two-three depths at each location. Water quality testing will be coordinated with the Santa Cruz County Environmental Health Agency staff, who conducts periodic testing for total and fecal coliform bacteria and nutrients (J. Ricker, personal corn.). We did confirm that Environmental Health will analyze samples from the lagoon but would need to be reimbursed for their time. Water quality results will be compared to pertinent water quality standards and historical water

quality test results. We will also conduct sediment sampling of the lagoon one time at three locations-near the mouth, middle and upper end. At least 2 sites will correspond to sampling locations in the 1980 Stern-Courter study. Constituents tested will include metals: copper, cadmium, silver, chromium, lead, mercury and zinc; organics, including chlorinated pesticides, organophosphate pesticides, carbamate pesticides and PAH’s; nutrient and aggregate parameters including ammonia, sulfide, phosphate, potassium, sulfate, sodium, chloride, magnesium, iron, manganese pH and conductivity. A staff gage will be installed in the lagoon to track water level changes, with levels recorded at least two times per month. From these data, we will try and draw some conclusions on causes and potential solutions to water quality problems in the lagoon.

Task 4 - Biotic Assessment

John Gilchrist will review all biologic documents pertaining to the lagoon and technical information on the two sensitive species known from the area. Field surveys of the lagoon and adjacent upland areas will be conducted and important vegetation and plant communities mapped. A winter and summer survey will be conducted to document any seasonal changes in vegetation. The project team will evaluate the interrelationship of hydrologic and biotic resources, particularly as it relates to wetland vegetation, tidewater goby and monarch butterfly habitat.

Task 5 - Technical Report

A technical report will be prepared that summarizes the results of the technical assessment work. The technical report will also present analysis of alternative restoration measures that may be implemented to improve the environmental conditions of the lagoon. The analysis may include an analysis of modification of the lagoon outlet, installation of storm water treatment systems in the upper watershed areas, removal of invasive plants, revegetation strategies and other measures. The technical report may also recommend further technical studies that may be required to more fully assess conditions in the lagoon, or interactions between biotic habitat and hydrology. Lastly, the study report will present an implementation plan and cost estimate for the proposed restoration projects and/or technical studies recommended. We will provide the Agency with a draft report, respond to any comments and then produce a final report for public distribution. Three copies of the draft report, and five copies and one camera ready copy of the final report will be provided.

Task 6 - Meetings with RDA staff and Interested Community Members

John Gilchrist and Fall Creek Engineering will meet with RDA staff and interested community members at the site in May 2003 to review site conditions, the project approach, study objectives and available information. A second meeting will be scheduled with community members after field work is completed and before the draft report is prepared. Two meetings will be scheduled with RDA and Environmental Health staff after completion of Task 2, and after water quality sampling is complete in late November 2003.

Our schedule is to complete Tasks 1 and 2 within 8 weeks after contract approval. Assuming contract approval in late April, these tasks would be complete by late June 2003. The consultant-RDA/EH meeting would occur in July. Tasks 3 and 4 require seasonal sampling or field surveys and would be complete by December 2003. A draft technical report (task 5 ) will be delivered to RDA for review by mid-February 2004.

A proposed budget is also attached for your review. We look forward to working with the Agency on this important and interesting project.

Alto Corralitos Ranch Stream Channel and Bank Stabilization Project, Corralitos, California Fall Creek Engineering (FCE) in association with John Gilckst and Associates prepared engineering design plans and specifications for the channel and bank stabilization project utilizing biotechcal methods to restore a deeply incised stream and eroded bank along a 80 foot long reach of Jesus Creek in Corralitos, California. The project designs include the construction of a four-step boulder vortex weir for grade control, a vegetated redwood log crib wall, and log revetment for bank stabilization. Erosion controI and revegetation plans were also prepared for the project.

Apanolio Creek Steelhead Fish passage Restoration Project, Half Moon Bay, California. Fall Creek Engineering (FCE) in association with Hagar Envirumental Services and JGA conducted a stream and hydrologic analysis of three fish barriers on Apanolio Creek FCE prepared engineexing design plans and engineering cost estimates to restore steelhead fish passage in the stream. Two fish passage projects involved the design of boulder step pool sequences to restore grades to restore upstream migr&on of adult fish during high winter flows. Two culverts will be replaced with clear span bridges to maintain vehicle access itcross the stream. The designs also included creation of a new stream alignment around an existing instream pond to provide for year round passage of juvenile and adult fish. Each project included the design of grade control structures (convex boulder weirs) to mitigate erosion potential resulting h m the removal of existing stnrctures. The pmject effectively restores approximately 2-1f2 miles of steelhead stream. The project was completed for the San Mateo County Resource Conservation District.

Arroyo Lean Steeihead Stream Enhancement Project, Haif Moon Bay, California. Fall Creek Engineering @CE) with Swanson Hydrology and Geomorphology, JGA and HES developed engineering design plans, specifications, construction bid documeots and provided construction supervision for a San Mateo County Resource Conservation District stream restoration project. A steelhead fish barrier (a six-foot diameter and forty- foot long culvert) was replaced with a boulder step-pool sequence and bio-engineered bank stabilization measures-for a perennial coastal stream.

lands west of the City of Watsonville. The project site is in the Watsonville Slough wetland complex, an 800-acre coastal wetland system located in Central California. The proposed wetland areas would be integrated into the existing wetland system. FCE performed a hydrogeologic analysis of the property and tributary watershed to determine the availability of water resources required to support a restored wetland at the site. A ~

network of shallow groundwater monitoring wells were installed and monitomi, a water balance was prepared for the site, and dternative conceptual designs for restored wetlands were developed for the site.

iiddell Creek Fish Passage AaaJysis, Davenport, California. Fall Creek Engineering (Fa) has prepared a peer review of a fish baffle design for a 389 foot long culvert on Liddell Creek The Department of Fish and Game requires that both juvenile and adult steelhead be able to migrate upstream through the culvert. FCE prepared a hydrology, stream flow, and hydraulic analysis to evaluate the proposed design for fish passage and ff ood flow conditions in the culvert and to propose impmvements to the design. The project was completed for RMC Pacific Materials.

Lower Week’s Creek Stream Restoration, Pescadero, California. Fall Creek Engineering (FCE) has prepared a restoration plan for restoring 1,500 Linear feet of Lower Week’s Creek to allow for steelhead passage, spawning and rearing habitat. The plan includes the removal of several fish passage barriers including culverts, portions of concrete l ied channel and an in-stream pond and restoring riparian and in stream habitat conditions. The pian includes replacing several culvert with ciem span bridges. The project was completed for Mazzanti Carnations, Inc.

Natfvidad Creek Storm Water Detention Facility, Salinas, California. Fall Creek Engineering (FCE) has prepared engineering design plans and specifications for a multi- function flood control project, which will restore approximate ‘/a miles of Natividad Creek and create a 17.5 acres of palust$ne (fkeshwater wetlands) for flood control and riparian and in stream habitat enhancement. The project includes designs for a pond outlet structure uskg slide gates to control fl DWS out of the wetland and to allow for passage of steelhead. The project was completed for the City of Salinas.

Pajaro River Watershed Water Quality Mauagement Plan. Fall Creek Engineering managed a multi-disciplinary team of scientists, geologists, planners, and engineers to prepare a comprehensive water quality management plan for the Pajaro River Watershed, a 1,300 square mile watershed located in Central California. The study was prepared far the Association of Monterey Bay Area Governments (AMBAG), the California Regional Water Quality Control Board (RWQCB), the State Water Resource Control Board, and the U.S. Environinental Pmtection Agency.
