DEFINITION OF TERMS

Ancestral Domain

- Refers to all areas generally belonging to ICCs/IPs comprising lands, inland waters, coastal areas, and natural resources therein, held under a claim of ownership, occupied or possessed by ICCs/IPs, themselves or through their ancestors, communally or individually since time immemorial, continuously to the present except when interrupted by war, force majeure or displacement by force, deceit, stealth or as a consequence of government projects or any other voluntary dealings entered into by government and private individuals, corporations, and which are necessary to ensure their economic, social, and cultural welfare. It includes land, forests, pasture, residential, agricultural, and other lands individually owned whether in alienable and disposable or otherwise, hunting grounds, burial grounds, worship areas, bodies of water, mineral and other natural resources, and lands which may no longer be exclusively occupied by ICCs/IPs but from which they traditionally had access to for their subsistence and traditional activities, particularly the home ranges of ICCs/IPs who are still nomadic and/or who practice shifting cultivation. Ancestral Domain Sustainable Development and Protection Plan (ADSDPP)

- The ADSDPP is a long-term community-based, comprehensive plan that contains the ICCs/IPs’ collective vision, mission, general objectives, long-term goals, and priority concerns. The ADSDPP contains a list of development plans and projects that is used as reference in determining the fit between a proposed infrastructure project and the long-term development goals and priority concerns of the affected ICC/IP. Often interchanged with the ADB-IP Development Plan (IPDP), but where ADSDPP is all encompassing, planning for IPDP is limited to the ADB investment/project/subproject

Ancestral Lands

- Refers to land occupied, possessed and utilized by individuals, families and clans who are members of the ICCs/IPs since time immemorial, by themselves or through their predecessors-in-interest, under claims of individual or traditional group ownership, continuously, to the present except when interrupted by war, force majeure or displacement by force, deceit, stealth, or as a consequence of government projects and other voluntary dealings entered into by government and private individuals/corporations, including, but not limited to, residential lots, rice terraces or paddies, private forests, swidden farms and tree lots. (Adopted from R.A.8371)

Compensation - Means payment in cash or in kind for land, housing, income, and other

assets acquired or adversely affected by the Project. All compensation is based on the principle of replacement cost, which is the method of valuing assets to replace the loss at current market rates, plus any transaction costs such as administrative charges, taxes, registration and titling costs.

Certificate of Precondition (CP)

- It is a document issued by NCIP attesting that the applicant or project proponent has complied with the requirements for securing the consent of affected ICCs/IPs I accordance to the Free, Prior and Informed Consent Guidelines of 2006

Community Management Plan (CMP)

- CMP describes the current community land use, potential development map, investment plans (targets and activities) and includes all sub projects to be funded under INREMP

Entitlement - Range of measures comprising compensation, income restoration

support, transfer assistance, income substitution and relocation support which are due to affected people, depending on the nature and severity of their losses, to restore their economic and social base.

Free and Prior Informed Consent (FPIC)

- The consensus of all members of the affected IP group is to be determined in accordance with their respective customary laws and practices, free from any external manipulation, interference and coercion, and obtained after fully disclosing the intent and scope of the activity, in a language and process understandable and appropriate to the community. Broad community support may exist even if some individuals or groups object to the project

Indigenous People

- Refers to a group of people or homogenous societies identified by self-ascription and ascription by other, who have continuously lived as organized community on communally bounded and defined territory, and who have, under claims of ownership since time immemorial, occupied, possessed customs, tradition and other distinctive cultural traits, or who have, through resistance to political, social and cultural inroads of colonization, non-indigenous religions and culture, became historically differentiated from the majority of Filipinos. ICCs/IPs shall likewise include peoples who are regarded as indigenous on account of their descent from the populations which inhabited the country, at the time of conquest or colonization, or at the time of inroads of non-indigenous religions or cultures, or the establishment of present state boundaries, who retain some or all of their own social, economic, cultural and political institutions, but who may have been displaced from their traditional domains or who may have resettled outside their ancestral domains. Land Acquisition

- The process whereby a person is compelled to relinquish ownership, possession, control or use of all or part of their land, structures or other assets to the Project in exchange for cash or in-kind compensation. This includes land or assets for which the possessor or user enjoys customary or uncontested access but lacks legal title. For this Project, compensation is based on replacement cost.

Resettlement - All measures taken to mitigate any and all adverse impacts of a project

on AP property and/or livelihoods, including compensation, relocation (where relevant), and rehabilitation as needed.

River Basin - A river basin is the portion of land drained by a river and its tributaries.

It encompasses the entire land surface dissected and drained by many streams and creeks that flow downhill into one another, and eventually into one river. The final destination is an estuary or an ocean

Watershed - A land area drained by a stream or fixed body of water and its

tributaries having a common outlet for surface runoff. It includes small watersheds with an area of 10,000 hectares (ha) or less, medium-scale watersheds of more than 10,000 ha up to 50,000 ha, and large watersheds exceeding 50,000 ha.

Sub-watershed - Normally its boundary or divide is delineated topographically, following

the ridges in a landscape. However, its area can also be outlined based on the bedrock formation that impacts groundwater. This divide is called phreatic. The difficulty of groundwater study and the convenience of using a contour map to outline the watershed boundary resulted to the use of the topographic divide instead of the phreatic divide. Inside a watershed, water is channeled through a network of tributaries. Due to vast coverage of some watersheds, it is divided into sub-watersheds. Watershed and sub-watershed is used interchangeably in the INREMP context (Watershed Characterization and Vulnerability Assessment using Geographic Information System-DENR-FMB)

Watershed Management

- Watershed management is the process of guiding and organizing land and other resource uses in a watershed to provide desired goods and services without adversely affecting soil, water and other natural resources. The watershed management plan shall be holistic, integrated and participatory. It shall fully take into account the well-being of the affected communities, including the indigenous peoples (DENR-DMC 2008-05)

Watershed Management Plan (WMP)

- An operational plan developed in a participatory way with all stakeholders concerned for a defined watershed that recognizes legal tenurial rights and defines the uses for land and other resources in the watershed to provide desired goods and services without adversely affecting soil, water, and other natural resources. It establishes an investment schedule for financial and other resource inputs to improve the productivity of the land with a 5-year rolling program of activities. The watershed management plan is consistent with the watershed and ecosystems management framework designed (i) to strengthen convergence and collaboration between and among various agencies and other stakeholders; (ii) develop and maintain an effective database management system for watershed information; and (iii) to upgrade the technical and operational capabilities of DENR, LGUs and other stakeholders for the sustainable development of watershed. It describes the current land use, potential development, define and prioritize sub-projects and established a work program for implementation of LGU clusters and municipal development councils. WMPs are institutionalized and adopted by LGUs.

Upland - Land area located on slopes of more than 18%

Upper River Basin

- The upstream portions of a river basin where the headwaters of streams and rivers emanate, consisting of lands with moderate to very steep slopes and medium-to-high elevations relative to the river basin valley

1. The Government of the Philippines (GOP) is currently implementing Integrated Natural Resources and Environmental Project (INREMP) through DENR-Forest Management Bureau to address the unsustainable watershed management in four (4) priority river basins: (i) the Chico River Basin in the Cordillera Administrative Region, Northern Luzon; (ii) the Wahig–Inabanga River Basin on the island of Bohol; (iii) the Lake Lanao Basin in the Autonomous Region of Muslim Mindanao; and (iv) the Upper Bukidnon River Basin in Bukidnon, Northern Mindanao. 2. The Project impact will be improved condition of watersheds generating livelihood benefits in the four URBs covering at least 24 watersheds in four (4) regions composed of nine provinces, 81 municipalities and approximately 1,332 barangays. The project outcome will be increased rural household incomes and local government unit (LGU) revenues in selected watersheds in the four URBs. 3. The Project has 4 outputs: (1) River basin and watershed management and investment plans established; (2) Smallholder and institutional investments in conservation increased and URB productivity enhanced in the forestry, agriculture and rural sectors. (3) River basin and watershed management capacity and related governance mechanisms strengthened. (4) Project management and support services delivered. 4. Institutional Arrangements. DENR is the executing agency responsible for over-all administration and management of the project and administer imprest accounts for proceeds from ADB and IFAD Loan and GEF and CCF grant. The FMB through the NPCO is the project implementing unit within the DENR. Through the NPCO, it will lead and oversee INREMP implementation in collaboration with various operating units of the DENR and LGUs—i. e.,

RPCO, PPMO, CENRO, WMPCO, etc., and in close coordination with oversight agencies and ADB. The RPCO coordinates with national government agencies at the regional level while the PPMO coordinate and undertake liason works among agencies at the provincial level, provide guidance and technical support to implementing LGUs and coordinate the implementation of URB forest conservation, protection and rehabilitation and the execution of technical extension and IEC. The administrative and technical focal point for the project at the watershed level is the Watershed Management and Project Coordination Office (WMPCO) based at the DENR-CENRO. This office will oversee the implementation of project activities and demonstration projects by Communities and Organizations (CBOs, IPs, POs, NGOs, Private Sectors, and Institutions). WMPCO’s coordinate the implementation of rural rehabilitation and improvement works by municipal LGUs; Coordinate the implementation of models for forest based investments by communities, POs and IPOs, and private investors: agroforestry, conservation farming, forest plantations, sustainable forest management, including Reduced Emissions from Deforestation and Degradation (REDD) and climate change adaptation activities. 5. Other implementing agencies are Municipal Development Fund Office (MDFO) and Department of Agriculture (DA). MDFO administer the funds for rural infrastructure improvements which will be implemented by the municipal LGUs except for those covered by the Cordillera Highland Agricultural and Resources Management (CHARM) Project which will be administered by DA. 6. An interagency National Project Steering Committee (NPSC) is established at the DENR Central Office (CO) to provide policy guidance for the smooth implementation of the Project. The NPCO shall be assisted by an inter-agency Technical Working Group (TWG). 7. Foreign Assisted and Special Projects Services (FASPS) and the Financial Management Service (FMS) of the DENR coordinately administer the Project funds and accounts. 8. SAFEGUARDS. NPCO is tasked to oversee safeguards compliance in all project implementing units. To enhance NPCOs capacity, Project Consultants were engaged1:

9. The SDS and SSS at NPCO provides assistance in the social and environmental compliance and concerns of all subprojects in NRM and RI respectively. The SSS and ES of TA-PMIC through Center for Environmental Studies Management (CESM) provides assistance in the appraisal, safeguards screening and preparation of IPPs and IEEs, EMPs/EIAMMPs, of subprojects in RI. At WMPCO Level, Watershed Management Officers (WMOs) and Community Development Officers (CDOs)3 provides assistance to POs and LGUs in social and environmental safeguards compliance of subprojects in NRM and RI.

10. In this monitoring period, safeguards tasks were clearly defined for the TEOs in their contracts’ terms of reference (TOR), specifically:

Work with the NPCO, WMPCO and RPCO in integrating social safeguards (indigenous people and involuntary resettlement), environmental safeguards and gender and compliance to processes of all activities (subprojects, trainings, workshops and others) in a watershed

Review and coordinate the integration of social safeguards requirement in all subproject proposals and participate in Council deliberations of such proposals

Provide support in internal monitoring of subproject implementation and confirm the technical soundness of the social safeguard measures

11. Significant environment and social safeguards impacts are anticipated in INREMP project output 2, in natural resources management (NRM) and rural infrastructure (RI) investments prepared and implemented by people’s organizations (POs) and LGUs, respectively. In output 1, they are addressed in watershed management plans (WMP) prepared by URBs and eventually adopted by LGUs, in integrated development plans (IDP), and in community management plans (CMP) prepared by communities and people’s organizations. CMP describes the current community land use, potential development map, investment plans (targets and activities) and includes all sub projects to be funded under INREMP including rural infrastructure subprojects. This document is prepared by all POs with subproject proposals. 12. Notwithstanding that most of the areas in 4 URBs are within ancestral domains and/or occupied by IPs, communities and IP organizations assisted by the project also prepared CMP, following the outline of Ancestral Domain Sustainable Development and Protection Plan (ADSPP) in compliance to the ADB’s IP Plan requirement and INREMP’s IPPF. To comply with both requirements, it was agreed during August 2016 ADB Review Mission that “IPP will be incorporated in the CMP4 by including section for mitigation measures addressing the negative impacts of subprojects to IPs.” CMP also addresses the rural infrastructure

subprojects impacts and mitigation measures, if any. There are instances that an IPP is prepared by the LGU. This situation indicates that the PO preparing CMP is non IP. Since the proposed subproject is within ancestral domain or there is presence of IPs, possible safeguard impacts may be expected, hence the IPP. This situation mostly applies to rural infrastructure subprojects. LGUs Damulog and Maramag are among the examples. In WIRB, an IPP for the Eskaya Tribe is being prepared. Eskaya IPP covers NRM, RI and Livelihood subprojects in municipalities of PIlar, Duero and Sierra Bullones in Bohol. All CMPs are being revised and updated based on the agreed outline and likewise the Eskaya IPP is being prepared. 13. As of 2nd half of 2017, 1 IDP (WIRB) has been adopted while 3 remaining IDPs (BURB, CHICO and LLRB5) are currently under review. 18 of the 23 WMPs have been prepared by URBs and these have been adopted by 57 (out of targeted 81) LGUs. Watershed characterization and vulnerability assessments for the five (5) WMPs in Lake Lanao River Basin are ongoing. Table No. 1. List of WMPs prepared and adopted by LGUs as of December 2017

14. At least 8 CMPs have been prepared in this monitoring period—4 IPOs in CURB; 1 Non-IPO in WIRB and 3 Non IPO in LLRB. Overall a total of 359 CMPs and 4 IPPs were prepared as of December 2017. Of the 359 CMPs, 269 or 74% comprise IP organizations (IPOs) and 94 non-IPOs or 26%. Table No. 2. Number of CMPs prepared by POs per URB as of December 2017*

15. A total of 27 Certificate of Precondition (CP)6, for the Chico Upper River Basin (CURB), were issued by the National Commission for the Indigenous People (NCIP) for this monitoring period. CPs issued cover NRM, RI and Livelihood Subprojects in Kalinga and Mt. Province. BURB and other subprojects at CURB are still at various stages of Free and Prior Informed Consent (FPIC) process, specifically joint-field validation and community consultations among

NCIP, DENR, IP organizations. CP is a document issued by NCIP attesting that the applicant or project proponent has complied with the requirements for securing the consent of affected ICCs/IPs I accordance to the FPIC Guidelines of 2006. FPIC is a process by which the consensus of all members of the affected IP group is to be determined in accordance with their respective customary laws and practices, free from any external manipulation, interference and coercion, and obtained after fully disclosing the intent and scope of the activity, in a language and process understandable and appropriate to the community. Broad community support may exist even if some individuals or groups object to the project 16. A total of forty-three (43)7 comprising 8 NRM subproject proposals (SPPs) and 35 Livelihood Enhancement Support SPPs have been prepared and submitted to ADB for this monitoring period. 17. For Livelihood Enhancement Support Subprojects, DENR engaged the Department of Trade and Industry (DTI) to assist in the management and implementation of livelihood activities in INREMP. A Memorandum of Agreement (MOA)9 was signed in October 2017 to formalize partnership. Consultation meetings are still ensuing to iron out the cost structure, targets, monitoring and reporting arrangements, and financial management arrangements. 18. A total of 33 RI subprojects in WIRB and BURB are at various stages of proposal preparation, detailed engineering design and IEE preparation. LLRB and CURB are mostly at project identification and concept proposal stage. At least six (6) RI subproject concept proposals from 3 LGUs were prepared for LLRB. 19. RI subprojects at CURB will be managed by Department of Agriculture. A Regional MOA between DENR AND DA was signed on November 2017. However, part of the clause in the regional MOA states that the MOA will only take effect if and only a National MOA between DA and DENR was signed. While preliminary discussions and agreements are ensuing for RIs that will be managed by Department of Agriculture (DA), a total of 21 concept proposals were submitted by 13 LGUs in CURB in this monitoring period. At least 13 of these concept proposals were field validated and pre-screened by INREMP in this monitoring period.

II. Safeguards Performance Monitoring 21. In subproject preparation stage, screening of environment and social safeguards are conducted using the rapid environmental checklist (REA), indigenous people’s checklist (IPC) and involuntary resettlement checklist (IRC). A Resettlement Action Plan (RAP) is prepared for all subprojects with involuntary resettlement (IR) impacts. For RI subprojects, being a category B, an initial environment examination (IEE) is prepared, reviewed, cleared and disclosed to ADB and INREMP website. In addition, an Environmental Impact Assessment and Management and Monitoring Plan (EIAMMP), Certificate of Non-Coverage (CNC) or Environment Certificate of Compliance (ECC) is also complied for each of the subproject proposals. All subproject checklists are prepared by the POs and LGUs with assistance of SMOs, CDOs, TEOs and Safeguards Specialist (APS and CESM). RAP, IPP and IEE is prepared by the LGU with the assistance of TA-PMIC/CESM while the ECC or CNC is applied accordingly by the LGU at the DENR-Environmental Management Bureau. 22. The second half of 2017 were devoted to providing technical assistance in implementation and monitoring of NRM subprojects that were cleared and issued no objection by ADB. Succeeding subproject packaging and finalization of proposals for NRM, LES and RI ensued, including compliance of safeguards requirements. In this monitoring period, first of its kind subproject proposals for CBPM and CF were submitted to ADB; RI subproject proposals submitted to ADB were given no objection letter (clearance to proceed to procurement) and IEEs were cleared and disclosed to ADB and INREMP websites. III. Information Disclosure and Socialization including Capability Building 24. Community consultation and planning activities were conducted during preparation of subproject proposals and CMP to ensure stakeholder and community participation. Subproject proposals and safeguards concerns are discussed during conduct of public/community consultations and planning. Resolutions of Support were issued by POs/IPOs, and Sangguniang Barangays after the conduct of consultation and planning activities along with the minutes of consultations and attendance sheets which are collected and attached to subproject proposals. A joint-community field validation with NCIP15 (for areas within ancestral domains) is conducted to facilitate issuance of CP and address other IP concerns. A Tribal Council Resolution or an IPO Resolution of Support is likewise issued after consultation disclosure activities. 25. Based on the INREMP 2017 Annual Report, several technical trainings were conducted in the different URBs on land use assessment and extension services to the partner Peoples Organizations (PO) with particular focus on both the capacitation of stakeholders and sharing of public awareness pertaining to the project.

26. In Chico URB16, the target of eight (8) printed materials/news items and ten (10) video documentations of the various activities undertaken in 2017 were produced during the year. Two (2) trainings on Community Organizing and Skills Enhancement Training for Community Development Officers were conducted and 228 on-site extension services/trainings, mentoring and strengthening were provided to the POs. The extension services provided in the partner POs in Chico URB included trainings/ demonstrations on asexual propagation, nursery establishment, site preparation and planting, plantation care and development, records keeping, bookkeeping, basic financial management, geo-tagging, actual demonstration on capping/topping of planted coffee, cut flower training, subproject WFP orientation and NRM disbursement procedure.

27. For WIRB17, the Project has continuously ventured in the strengthening of partner POs by providing both on-site and off-site technical assistance. INREMP has also partnered with FoodSTART+ implemented by the International Potato Center (CIP) for the training of partner POs to Farmer Business School (FBS) which is linked with the component 2’s Livelihood Enhancement. WIRB also aired a radio program in two radio stations in Bohol and packaged FBS training manual which was translated in their local dialect as part of its IEC activities. The translation to bisaya is viewed as a vital strategy in order for the partner PO’s to more easily absorb the information inside the manual. 28. BURB18 has accomplished its targets on the development and implementation of IEC materials and institutional and organizational strengthening activities under this component. These include training on LAWIN (5), procurement process for LGUs in relation to the implementation of RI (16), leadership and value formation for POs and IPOs (6), farmers’ trainer’s’ training on nursery establishment (6), plantation establishment and maintenance and protection for NRM subprojects (6), financial management training (6), and on-site PO/IPO extension services and mentoring (24). 29. In LLRB19, the staff was able to develop a communication plan in assistance of the TA-PMIC. They were also able to package a printed material and produce an audio-visual documentation. Five (5) on-site organization strengthening and technical trainings in NRM subproject Implementation, conservation farming, and IEC were conducted for LLRB.

IV. Grievance Redress Mechanism (GRM)

30. GRM and procedures (for IP and non IPs) for the rural infrastructure subprojects are incorporated in all the 39 subproject proposal documents prepared (on-going). GRM in NRM investments are incorporated in CMPs and also stipulated in the Partnership Agreement. At PO level, grievances are discussed and resolved through meetings or general assembly. However, there are no record of these grievances. Recording and documentation of GRM has yet to be improved.

V. Plans for the next monitoring period

31. In the succeeding period, among the key activities to ensure safeguards compliance are:

Updating of CMP based on the agreed revised outline to include IPP and gender

Revision of CMPs-- Cascading safeguards requirements and compliance activities in incorporating safeguards in CMPs and subproject proposals.

Follow through activities to NCIP for CP Issuance and intensify joint field validation to comply with FPIC process and eventual issuance of remaining CPs

VI. Conclusion

32. The project is partially compliant to both environmental and social safeguards. Among key issues identified were non submission and disclosure of CMPs or IP Plans, the need to further strengthen staff capacity in screening and planning of safeguards in subproject proposals, mitigation planning and monitoring, additional AP for environment to be assigned at NPCO to assist project staff and implementing units in environmental compliance. 33. This period is still focused on moving INREMP to catch up with the targets, both physical and financial. Delays in implementation of NRM and RI are noted. These have been addressed by streamlining of processes, and requirements; conduct of parallel compliance activities; safeguards screening checklists simplified and contextualized and safeguards templates for screening have been agreed upon and staff complementation is being addressed. 34. Component/output 2 of INREMP has most of the anticipated safeguards impact, specifically NRM and RI. In terms of physical progress, NRM subprojects are already at various stages of subproject development and implementation while most of the RI subprojects are either at subproject development or procurement stage and none have been implemented yet. As such, there is a need to improve safeguards compliance by strengthening staff support and intensify capacity building in safeguards screening and planning, firming up data collection and collation, improve tools and mechanisms for monitoring including the GRM.
